    In a landmark judgement on Tuesday, the

    Constitutional Court (ConCourt) set aside

    p r ospec t i ng r i gh t s g r an t ed t o Genor ah

    Resources on the land of the Bengwenyamacommunity near Burgersfort, who lives on

    the farms E erstegeluk and Nooitverwacht.

    These farms compr ises two of three

    f a r m s ( t h e o t h e r i s H o e p a k r a n t z ) ,

    c om p r i s i n g N k w e P l a t i n u m s T u b a t s e

    Project.

    The court found that Genorah (a black

    economic empowerment BEE entity, that

    ho l d s 63% o f Nkwe P l a t i num ) had no t

    c o n s u l t e d w i t h t h e B e n g w e n y a m a

    commun ity as required by the Mineral an d

    Petroleum Resources Development Act and

    t ha t o f f i c i a l s f r om t he Depar t m en t o f

    M i n e r a l R e s o u r c e s h a d n o t g i v e n t h e

    landowners a hearing an d had n ot complied

    w i t h t h e f a i r n e s s r e q u i r e m e n t s o f t h e

    Promotion of Administrative Justice Act.

    The court said a fter the case, i t concerned

    the administrative fairness of the allocationof prospect ing r ights to a th i rd par ty in

    t e r m s o f t h e M i n e r a l a n d P e t r o l e u m

    Resources Developmen t Act (th e Act) on land

    owned by a commu nity. The first respondent

    (Genorah) was a warded prospecting rights

    on the commun itys land . The communit ys

    challenge to the award in the North Gauteng

    High Cour t , Pretor ia was dismissed. An

    appeal to the Supreme Court Appeal was

    also dismissed on the ground, like in the

    High Court, that t he commun ity had failed

    to bring th e application for review timeously

    in terms of the provisions of the Promotion

    of Administrative Justice Act (PAJA).

    The Supreme Court of Appeal did not

    dec i de t he m er i t s o f t he com m un i t y s

    grounds of review. The community applied

    to the Const i tu t ional Cour t for leave to

    appeal against the decision of the Supreme

    Court of Appeal. The commun ity conten ded

    that the Supr eme Court of Appeal erred in

    finding tha t the application was brought outo f t i m e a n d f o r n o t f i n d i n g t h a t t h e

    communi ty should have been awarded a

    p r e f e r en t r i gh t t o p r o spec t i n t e r m s o f

    sect ion 104 of the Act . In addi t ion, the

    c o m m u n i t y a r g u e d t h a t t h e a w a r d t o

    G e n o r a h w a s d e f e c t i v e b e c a u s e o f

    irregularities in the required consultation

    p r ocess , l ack o f com pl i ance w i t h

    environmental requirements and unfai r

    administrat ive procedures.

    Genorah contended th at th e commun ity

    h a d n o r i g h t o f a p p e a l a n d t h a t t h e

    communitys application to the High Court

    was late. I t was argued that there was in

    any event, nothing untoward in the process

    and a ward to it of these prospecting rights.

    The Constitutional Court decided the matt er

    on the basis of whether the decision to

    al locate the prospect ing r ights was fai radministrative action. The Court found that

    an in ternal appeal was avai lable to the

    applicants, t hat t he Department s failure to

    d e a l w i t h t h e a p p e a l a m o u n t e d t o a

    conclusion of the appeal process, and that

    t h e r e v i e w a p p l i c a t i o n h a d t h u s b e e n

    brought in time. The Constitutional Court

    held further that the grant ing and execution

    of prospecting right s is a gra ve invasion of a

    property owners rights. The Court h eld that

    the pu rpose of consulta tion with landowners,

    required by the Act, was to provide them

    with the information necessary to mak e an

    informed decision on how to respond to the

    app l i ca t i on . The Cons t i t u t i ona l Cour t ,

    concluded that Genorah ha d not consulted

    with the commun ity as required by th e Act,

    that the decision-maker had not given the

    commun ity a h earing or complied with th e

    fairness requirements of PAJA, and that the

    environmenta l requirements in terms of the

    Act had not been satisfied. Accordingly the

    community had not been treated as required

    by the Constitution.

    Leave to appeal was accordingly gran ted

    to the community a nd t he appeal succeeded.

    The awards of prospect ing r ights on the

    com m u n i t y s l and wer e se t a s i de . TheConstitutional Court therefore ordered the

    r e l e v a n t g o v e r n m e n t d e p a r t m e n t a n d

    Genorah to pay the a pplicants costs, jointly

    a n d s e v e r a l l y , i n t h e H i g h C o u r t , t h e

    S u p r e m e C o u r t o f A p p e a l a n d t h e

    Constitutional Court.

    Bengwenyama Minerals are n ow free to

    a p p l y f o r p r o s p e c t i n g r i g h t s o n t h e i r

    com m un i t y l and a s t he Cons t i t u t i ona l

    Courts judgement did not gran t th is r ight

    automatically.

    Meanwhile, in another case, the third

    farm comprising N kwes Tu batse project,

    H o e p a k r a n t z , i s i n t h e s p o t l i g h t . T h e

    Supreme Court of Appeal agreed to hear an

    appeal by Myelet i Minerals against the

    Pret oria High Court 's refusal to set aside the

    grant of a prospecting right to Genorah on

    the farm. The right was grant ed to Myeletibut wa s inexplicably also granted t o Genorah

    in error, as claimed by Myeleti.

    I n Augus t 2008 Xs t r a t a t ook up an

    exclusive option to acquire a 50% interest

    in the Nkwe PGM projects near Burgers fort.

    The option was exercisable within 90 days

    after completion of a ba nkable feasibility

    stu dy (BFS) for Nkwes Gar ata u pr oject (on

    the nearby farms De Kom and Garatouw.

    Project). A crucial part of the deal is that

    Xstrata will fund the total development

    costs of the properties from mining through

    to concentrat ing. The BFS for Gara tau

    expected in April this year, had been delayed

    and was expected to be completed in the

    fourth quarter of 2010.

    ConCourt judgementhits Genorah

    On 29 November 2010, Fran s

    Khomotso Nonyana(39) was sentencedto life imprisonment for rape and three

    years for abduction. The s entences run

    concurrently.

    The trial was held at the

    Thaba moopo Regional Sexua l Offences

    court in Lebowakgomo. On 27

    November 2007 the accused picked up

    a 10 year old girl in Bothashoek village

    with his motor vehicle and t old her to

    accompany him to the police station.

    Instead he drove in th e direction of

    Burgersfort. They went to Burgersfort

    to fill-up the car with petrol and when

    they were adjacent Alverton village

    the accused drove the vehicle into the

    bushes and sta rted to rape the young

    girl.

    Fortunately for the girl a young boy

    (13) witnessed the vehicle when itdrove away with t he girl and he

    informed the father of the victim. Her

    father informed the P olice in Tubatse

    who made follow-ups to trace the

    motor vehicle. The police spotted t he

    white car of the ra pist next to the st op

    sign to Ga-Motodi village and they

    stopped the vehicle and found the

    young girl inside th e vehicle. She told

    the Police what ha d happened an d

    Nonyana was arrested.

    already in the period of the 16 days of

    activism and no violence against

    women a nd children, the sent ence is

    welcomed a s it will serve as a

    deterrent t o would be rapists.

    At Modikwa Platinum Mine the man agement and

    employees commemora ted World Aids Day on 1

    December 2010.

    Both t he business leaders and unions were in

    agreement that employees must know their HIVstatus. The message was tha t if the test is positive,

    assist ance can be given in terms of medication an d

    councelling. It was emphasised that should a test

    result r etur n positive, it is not th e end of the world. With

    the right medication and lifestyle that person can still

    have a full and pr oductive life.

    The workers were told that healthy employees are more

    productive, but not only that, their families are alsohappier. The chances are also better that they will be there

    in the long run t o help care a nd provide for their families.

    Those who have during the year participated in the

    voluntary testing to know their HIV stat us were entered

    into a lucky draw. The winners in this draw walked away

    with prizes such as TVs and DVD players.

    Dwarsrivier Chrome Mine also

    commemorated World AIDS Day 2010.

    Their function was already held on

    Monday 29 November

    with briefing sessions for all mining and

    engineering line ma nagers, an d continued

    on Tuesday, with a briefing session for the

    plant su pervisors.

    The ma in ceremony was h eld on

    Wednesday, 1 December, where t hesurface employees were

    addressed by both the Senior General

    Manager, Mr Fra ncois Uys, and a NUM

    representat ive, Ms Maggy Mafulatha . The

    main event included a wall-signing

    ceremony where all present were

    encouraged t o pledge their commitment to

    help improve understanding about H IV,

    prevent tran smission and stop

    prejudice.

    During all the s essions, Mr Uys en gaged

    in dialogue regarding the reason for World

    Aids Day, with

    special focus on taking action to tackle

    HIV prejudice, dispell myths, de-

    stigmatize, and protect

    oneself and others from H IV transm ission.

    He stressed th e fact tha t HIV is no

    different to any

    other chronic illness, as it is non-

    discriminatory. People who contract the

    disease are not bad. Good people also getinfected. We should thu s fight the virus,

    and s upport and care for th e people living

    with the virus.

    He stat ed that it is only by breaking the

    silence on HIV and AIDS t hat we will give

    people a better u nderstan ding of the

    disease and eliminate th e stigma that

    sometimes still cling to people living with

    HIV/AIDS.

    Mr Uys encouraged all Dwarsrivier

    employees to ensure that they get tested

    and know their HIV status. He further

    encouraged those infected to register on a

    disease management programme, and

    those who are not infected to promote and

    mainta in health-orientat ed behaviour.

    The issuing of permits t o hawkers in

    Burgersfort are going according to plan

    says the Burgersfort Cluster of the

    Tubatse Hawkers Association.

    They say hawkers must ma ke sure of

    the process. Money for a permit (R120)

    must be paid to the mun icipality and the

    official receipt must be presented to the

    Cluster man agement at the secretarys

    stall across the road from Barnett s. The

    secretary will verify tha t a hawkers is

    registered and collect t he permit from t he

    municipality upon pr esentation of the

    receipt. They request that h awkers who

    are not registered with them, must not go

    and pa y at th e municipality as th ey will

    not be able to get a refund. Register first

    at the secretary!

    As far as could be determined, perm its

    will be checked by th e mun icipality from

    15 December 2010.

    In the mean t ime hawkers has agreed

    with tra ditional doctors tha t they should

    move out of hawkers stalls. They are not

    starving an d can afford other

    accommodation the hawkers say.

    space.

    On 18 November Xstra ta Lion held a very

    successful Clean up day.

    The staff gathered at the Vantech parking

    area a nd start ed in groups to clean around

    the plant. Three bakkie loads of rubbish

    were collected. This weighed in a t 1600kg.

    North West Recycling sorted, removed and

    will recycle it.

    The employees messa ge to the community

    is that we all should care abou the

    environment and nobody should just

    thr ough rubbish out of the vehicles. The

    employees were also rewarded for their

    har d with with gifts of appreciation.

    Caring at LionXstrata Lion held a Health, Safety, Environmental, Quality, Community

    Awareness d ay on 1 December 2010.

    The employees came in turns to donate blood, participate in a Shavathon

    or spray their ha ir in colourful patterns, learn more about snakes an d get

    health informa tion from th e mobile clinic and sta ll. Pamphlets with

    informa tion on HIV/Aids, TB, Cancer an d other diseases wer e distributed .

    Employees were also encouraged to know their HIV status.

    The CANSA Shavath on exceeded their tar get of R15 000 and collected atotal of R16 250. This will all go towards the Cancer Association.

    The ta rget for the blood donations were 54 units and a total of 63 units

    were collected. The SANBS also presented Xstra ta Lion with a tr ophy for

    their efforts in donating blood (see photograph below).

    The employees each received a T-shirt, cap an d cold drink when they

    attended the event. There were also lucky draws .

    The miserable weather around the region

    early in the morning kept some bikers from

    f u r t he r a f i e l d away , however we s t i l l

    mana ged a turnout of 200 bikes and around

    600 people, who contributed both toys and

    tons of goodwill sa id Ju lia Todd of th e Misty

    Knights MCC.

    We collected 738 new toys in th e tra ilers at

    the venue, along with around 250 items of

    2nd han d toys and clothing.

    Toys will be distributed du ring th e weeks

    following the Toy Run. Beneficiaries in clude:

    Lelievlei, Dilokong Hospital (childrens

    ward), Pilgrims Rest Primary School and

    Burgersfort, also known as the Platinum City, in the Limpopo Province

    is set to receive a facelift in more ways than one. Beginning with thetwo residential estates of Cranbrook Property Projects SpekboomRiver Estate and Motaganeng Lifestyle Estate , the well-known schoolgroup Curro are investing in Burgersfort with the construction of amodern new, affordable private model school, within Spekboom River

    Estate. Construction of the pre-primary, primary & secondary school

    will commence in February 2011 with the first intake planned forJanuary 2012.While the two estates are central to Cranbrooks presence in the area,the Development Company is in Burgersfort for the long-term. Thetotal development encompasses a few thousand residential erven,business and light industrial development, a 43 000m shopping mall,a hospital site, as well as the site for the new school.

    While Burgersfort itself has never been a town that strikes one asbeing impressive, residents and visitors will see a gradual change as

    each project is completed, until the town soon to be a city reachesthe Developers ideal a Modern African City.Because of the high expected growth of mining activities, populationgrowth in the broader Burgersfort area is expected to rise from its

    current population of 36 485 to an estimated 42 466 by 2015. TheGreater Tubatse District of Limpopo, within which Burgersfort falls, isexpected to grow from its current number of 53 851 households to71 055 by 2015, while the simultaneous population growth is expected

    to rise from 270 115 to 356 411 within the same time period.The population increase combined with the development of this Modern

    African City will undoubtedly attract businesses and national brandsfrom the mining support sector, lifestyle, health and medical sectorsas well as an array of other services. This expansion and advancementis in line with one of Cranbrooks ideals regarding the Platinum City ofBurgersfort and that is to have healthy, happy, well-balanced andcomplete communities.

    An important fact to take into consideration when deciding where tolive is, amongst others, is the distance travelled to and from work. It is

    not necessarily the distance which is a problem, but rather theassociated risks associated with travelling longer distances. At themoment many roads travelling to towns such as Polokwane andLydenburg for example, are not in the condition they should be. Thiscombined with the fact that early morning mist reduces visibility to a

    great extent, makes travelling long distances to the various minesevery morning a greater risk than it would be should one travel shorterdistances such as from Burgersfort. A safer and shorter travellingtime between work and home contributes to a well-balanced lifestyle,

    one of the visions Cranbrook aims to achieve in the area.The Estates

    Spekboom River Estate is located south east of Burgersfort and itssister development, Motaganeng Lifestyle development to the northeast. Apart from the location, number of stands available (Motaganeng800 residential stands and Spekboom 1 944) and architectural styles,the two developments are almost identical.

    Hendrik Pitzer sadly passed awa y on

    Satur day 27 November 2010 in a

    motorcycle a ccident.

    His fam ily wrote th e following: First of all

    to many people Hendrik was a Legend. H e

    was a hu sband, a father, a brother, a son

    and a friend to many. He was a big man

    Losing a legendwith an even bigger heart.

    He cared and su pported the commun ity of

    Burgersfort. He was fun loving and lived

    his life to the fullest. He wa s involoved in

    a lot of activities, t o enjoy his life. He

    mean t so mu ch to a lot of people. For a

    great amount of people he was a rollmodel,

    someone to look up t o.

    A well respected entrepreneur. H e was

    strict when needed and joyfull most of

    the time.

    To all his employees he was kn own as

    Baas H endrik, not just because he was

    the owner and director of his company,

    but because of his leadership, his

    compassion, his a mbition an d love for

    life.

    His hobbies were deep sea fishing and

    motorcycles.

    And one thing we can add was tha t he

    was a family man, and his business was

    part of his family, and his family was his

    life.

    Baas Hendrik, we salute you and

    th ank you for a ll youve done. You will

    always be our hero, our super man. We

    love you a nd we will keep you in our

    hearts forever more, Amen.

    His funeral Service will take place at

    11:00 on Friday 3 December 2010 at the

    AFM Church, Steelpoort.

    daughter Amanda (11) were laid to rest in

    two local livesOn 27 November a local group of

    motorcyclists were on their way to Polokwane

    when an accident claimed two of the riders.

    Mr Hendrik Pitzer and Mr Marnel Ehlers were

    involved in an accident with a taxi, about24km from Polokwane.

    Mr Pitzer died on the scene while Mr Ehlers

    passed away in hospital.

    Mr Ehlers was an employee of ASA Metals and

    Mr Pitzer was a local businessman.

    The funeral service for Mr Ehlers took place

    yesterday at at the AFMChurch in Steelpoort.The service for Mr Pitzer is planned for today

    at 11:00 at the same church.

    have already appealed to those marking the

    papers to be biased in favour of African

    pupils.

    While Sadtu praised the Department of

    Education for a smooth running

    examination, th ey also appealed to markers

    to remember that m any pupils are not

    writing the examination in their mother

    tongue.

    The markers h ould bear in mind th at

    African pupils were not writin g in their

    mother tongue and spare a th ought for

    those affected by th e strike, said Mr

    Mbuyiseni Math onsi, Sadtu s provincial

    secretary.

    The Department of Education, Umalusi

    (quality assurer), teacher unions and the

    Education Labour Relations Council are

    currently in discussions regarding this.

    If the mat ric results come out and we

    believe that the learners could have done

    better in the exams, then we might adjust

    the results, said a department

    spokesperson.

    We are in discussions with sta keholders

    about the issue. We must remember that

    this year s mat rics are not like the class of

    2009. There were a lot of distur bances for

    them she added.

    The results of the matric examinations ar e

    due to be out by January 6, 2011.

    Maatlopo United FC narrowly escaped defeat on 27 November.

    The team had a draw of 3-3 with Mpheleng Sweepers of Dennilton.

    The hosts scored first, but Andrew Maleka scored for Maatlopo to

    equalise the score. The halftime score was 1-1.

    In the second half Sweepers cam out strong with two more goals to

    give them a two point lead. Maatlopo responded with two goals byTrevor Mohlala and Sunnyboy Thobejane.

    This week Maatlopo will face RT Giant Killers at the Moroke

    Stadium. The game will start at 15:30 on Saturday 4 December 2010.

    The Steelpoort drum-majorettes had their first

    performance on last week Friday.The group consisting mostly of Steelpoort Academy

    students, para ded for their pa rents a nd familie to

    showcase their hard work of the last six months.

    The group can st ill accommodate more girls, but

    warn s new-comers t hat they will have to be willing

    to work very hard to reach competition level.

    Girls between grade 3 an d 7 are welcome in th e

    group. They will however have to pass an a udition.

    Although their name is Steelpoort drum-

    majorettes, they do not limit themselves to

    children only from St eelpoort. In terest ed girls from

    the a rea a re welcome to conta ct the co-ordinators

    on the numbers below.

    Currently two very dedicated parents are in charge

    of the group. Ms Belinda Veldsman a nd Ms Gret li

    Steyn ar e co-ordina ting their pr actice sessions,

    clothes and participation in events. Belinda have

    been a drum m ajorette all her life and ha s also

    served as a jud ge in competitions. The group ha vebeen asked to perform a t th e Interlaer next year

    and will even practice during the December holiday to

    ensure tha t th ey are in sha pe for a top performance.Although various compan ies have generously

    contributed to the sport, there are still many th ings

    short. A pair of boots needed for participation in event s

    cost a bout R400.

    The group have received their informal sportwear from

    Samancor Eastern Chrome mine and will perform in this

    at t he at hletics. They however need to get all the correct

    gear before going to the competitions next year . Other

    sponsors include: Mega Paint s, Pick n Pay, Build It

    Steelpoort, Tubatse Hardware, Tubatse Ferrochrome,

    Xstrata Lion, Audio Corporat ion, OK Grocer, Hetta

    Riekert, Sama ncor, Pau l Brummer, Siyaya .

    In this area the sport is still relatively unknown, but it

    is an int erna tional sport in which you can achieve your

    nat ional colours. In the cities and bigger towns, ther e

    are a lso great efforts to develop the sport, said Belinda.

    girls, we all love doing this, she add ed.
