Australian based platinum company,Nkwe Platinum Limited, says theBengwenyama community misled theConstitutional Court (Concourt) in thecase in which Genorah Resources lost itsprospecting rights near Burgersfort on twofarms.

Nkwe says in a media release that, asa result, the Roka-Phasha communityintends to pursue legal action against theBengwenyama. The Roka-Phashacommunity alleges that the Bengwenyamamisrepresented their community statusand their status in terms of Section 104 ofthe Mineral and Petroleum ResourcesDevelopment Act, which affords apreferential prospecting right tocommunities that live on the landearmarked for prospecting while Roka-Phasha is also challenging a claim thatthe Concourt-favoured Bengwenyama hadpreviously won community land claim inthe High Court. Nkwe identifies theEerstegeluk landowners as the and theGreater Tubatse Municipality.

The Concourt, which ruled that theNkwe-linked Genorah had failed tocommunicate properly with theBengwenyama community, consequentlyset aside the prospecting rights that theDepartment of Mineral Resources (DMR)had awarded to Genorah, which is Nkwe’sblack economic-empowerment partner.

The Concourt also overruled thePromotion of Administrative JusticeAct (PAJA), which demands that theaggrieved party brings its reviewapplication to court within 180 days.

Although the Bengwenyamacommunity failed to meet PAJA’s 180-day deadline, the Concourt still foundin its favour, on the grounds that theDMR had failed to deal with its timeousappeal.

Nkwe says Nkwe, Genorah and localcommunities from the Concourtjudgement’s Eerstegeluk andNooitwerwacht farms have resolved toproceed with a new rights application.The court did not automatically give theprospecting rights to theBengwenyama, who will have to submita seperate application, which they arereportedly planning.

The company further states that“over the past four years Genorah andNkwe have initiated numerouscommunity initiatives (employment,building of roads, provision of cleandrinking water, sporting andrecreational activities) over all of the 5farms.

The Company is not suggestingthere have not been issues over theyears. In fact, almost all miningcompanies in the area have hadproblems with regard to various socialissues such as competing claims to land,chieftaincy, and representativity, mostof which are a result of the effects of theprevious policy of apartheid. Nkwe hasat all times ensured significantinvolvement and interaction inresolving any community matters withnumerous community representatives,with Nkwe’s senior executivemanagement and Board members beingon the ground and in constantconsultation.

Media reports of Genorah (and byimplication Nkwe) trampling over thelocal communities rights and ignoringtheir legal and rightful connection and

involvement in the properties and theirmineral worth are blatantly incorrect.”

It also says “until the DMR process fordealing with the two farms has beencompleted we cannot make anyassessment as to what the Court Decisionmeans regarding the impact to the valueof the farms. As referred to above thefarms haven’t been awarded to anyoneelse and the local communities haveresolved to jointly lodge whateverapplications are required by the DMR toensure preservation of the prospectingrights.

The two farms in question do not formpart of the bankable feasibility study that

is being finalised on the Garatau Project –a separate update on this will be madeshortly. The two farms have at this stageonly been subject to exploration andresource drilling which has defined aninferred resource of approximately 20mounces 3PGE+Au (out of 68.5m totalounces 3PGE+Au over the 5 farms.

The two farms are clearly significantand form part of Nkwe’s longer termdevelopment strategy for the Tubatseproject.

In terms of development they are about18-24 months further away from ournorthern Garatau project (the subject ofthe BFS).”

Platinum Australia said on Tuesday thatits mining contractor, JIC Mining haddismissed 85 percent of its workforce atthe Smokey Hills mine near Burgersfort.JIC employees had been engaging in anunprotected industrial action at theSmokey Hills platinum project.

JIC obtained an interdict requiringemployees to return to work, however, anumber of employees refused,necessitating the dismissals, according toPlatinum Australia.

The mining contractor had started theprocess of re-employing some of theworkforce, but it was anticipated that asignificant number would not be re-employed.

Limited underground mining hascontinued during the industrial action,and Platinum Australia said thatunderground production would ramp-up toprevious levels over the next few weeks.

Meanwhile, the processing plant hasremained unaffected by the industrial

action and continued to treat chrometailings over the last week.

In November, over 31 000 t of chrometailings were treated at a grade of around6 g/t platinum group metals.

It was anticipated that between 25 000t and 30 000 t of chrome tailings would betreated in December, along with a further25 000 t to 30 000 t of underground ore.

Platinum Australia said the industrialaction was not expected to have a materialimpact on the production or financialperformance of the Smokey Hillsoperation.

Underground ore treatment andchrome tailings treatment would continueon a batch basis through the plant duringthe March quarter, which should ensurethat the plant operated at close to, or atdesign capacity.

Twickenham rewards crewfor impressive sweeps

Twickenham Platinum Mine on Wednesday thisweek rewarded some of their employees whoformed part of a crew that achieved 360m2 for threeconsecutive months.This achievement by Crew 34A N1 (in the picturebelow) is comparable to the best in the industry andon the Eastern Limb. It is also the best ever atTwickenham Mine. The team is from TwickenhamShaft.Mr Theuns Erasmus, Production Manager

congratulated the team and encouraged them to continuetheir good work. He also urged them to work safely, especiallythe last two weeks before Christmas.“It is the best any team has done on this mine,” he told thegroup that also included Union representatives andrepresentatives of the Health and Safety Committee. Herecapped their sweeps from January up to now, as well astheir safety record.As an incentive the team each received a personalised jacketand they were served a hearty cooked meal.

Nog ‘n inwoner, tannie ThelmaSteenkamp (78) (foto links), ‘noud Rusplaser, is onlangsoorlede. Sy het die laaste tweejaar by haar suster, Edith vanWyk, op Ohrigstad gebly. Sy isPietersburg toe vir ‘n lens-oorplanting waar sy oorlede is.Sy word ook deur twee seunsoorleef.

How often have you heard the above phrase in your life? We bet many times! Normally thiswould entail referring to the comparison to one’s neighbour as a benchmark for social caste orthe accumulation of material goods, failing this would be perceived as demonstrating socio-economic or cultural inferiority.For the 10 years, that Modikwa Platinum Mine is in existence, we also tried keeping up withother industry leaders in the fields of Safety, Production and other key indices. Constantlylearning, applying new technology, sometimes burning our fingers slightly, and yes, sometimesfailing abysmally! We had to live (fight) through a tough recession, came from high incidentrates and not so good production results, having difficulties with communities and not alwaysunderstanding why we seem not to harmonise with Organised Labour structures.As we journeyed along this path, we slowly but surely learnt from our weaknesses and startedto turn them around into opportunities. Through affecting these opportunities, we were becomingthe Joneses…Our Safety performance grew into one of the very few mines that can boast withhaving 7 000 000 Fatality Free Shifts. We lived through the worldwide economic recessionwithout the need to downscale operations. Our production is on a roll to new heights and weare expanding business with the Opencast development and developing a new shaft, South 2Shaft. Management, Organised Labour, our Workforce and our loved ones at home has becomeone family, we ‘staan saam’! We now have strengths, no longer just opportunities, and theweaknesses lies behind us…We now are the Joneses! Other mines now benchmark againstus, trying to keep up with our pace, and yes, we encourage and support them, but we need tokeep up with ourselves, sustaining and improving on these achievements!The only way that we can do this is to stay humble, to stay a family, always striving to be thebest and to always believe, and trusting that our Heavenly Father will always carry us! celebrationsOn Thursday, 2 December the local Islamia Madressa awards ceremony tookplace. Various trophies and gifts were handed to the students. The ceremonywas opened by Mufti Ansarul Karim, Principal of the Madressa IslamiaBurgersfort, Burgersfort Muslim Jamaat.Muhammed Amod recited the Qiraat and Uwais Abdul Aziz the Qasida. Therewere also cultural performances by some of the grades.“Culture reminds us of where we come from and of we are. Culture keeps thenation alive with pride, honour and dignity. Hence we should preserve ouranthropological rituals and cultural values in our daily lives. We are truelyprivileged in this beautiful, multi-cultural and multi national country. Maatlopo United FC beat MphelengSweepers 4-2 at Moroke Stadiumlast week Saturday.The visitors scored first andMaatlopo retaliated by scoring agoal of their own. MogauThobejane should be given creditfor this. The halftime score was 1-1.Trevor Mohlala increased the scoreto 2-1 in the 55th minute of thegame. Collen Mphoka also score inthe 67th minute of the game withTrevor Mohlala coming in for asecond time to score in the 78th

minute.The visitors reduced the gap to 4-2during the second half.Maatlopo United who is trailingbehind Tubatse United in thesecond position on the log washappy with their win.
