designs and options. Many projects are being sold with a minimal and basic heating system design with the decid-ing factor being the purchase price. After the home or remodeling project is completed, the homeowners, in many instances are not happy with the end product because of either economy or comfort. The goal of this meeting is to make our builder members aware of options that add value to their projects. I think this will be another way to set our members up as the professional builders we want to be. Board meeting at 5:30, Social at 6:30 and meeting to start at 7:00 at the Speak Easy.

the EXPO’s are over. Both were very good for our members and association. The Builder EXPO was attended by 56 builders and was a great success. We are gearing up for

an awesome Home, Garden and Sport Show. The Sport Show arena is full and the Home Show side is getting there. If you are thinking of having a booth and have not booked it yet, better hustle. There is a lot going on at the capitol, so be sure and read Pam’s information. Most of you have not met the people at the BAM office, but they are a hard working group. You can definitely see it by what they do to protect the builders as far as the sprinkler bill which will raise the cost of a new home from $4,000.00 to $14,000.00, the raiding of the License money by the state for what you have to pay to get your license updated. Every year the amount gets bigger and in a tough economy it gets hard to pay for.

The Builders Convention was fairly well attended, with the BATC Product Show on Thursday, along with Casino night, up early on Friday for the BAM Board meeting. We went to the vendor booths in the afternoon and were treated to very good food and beverages. Following for the evening was the Awards Banquet. Our President, Bryan Schoenberger, won the States’ Presidents award. Thanks to Jessy for helping me to get Bryan to stay, without him knowing he was receiving it. Scott and Martha Buchholz also attended and had a mini vacation that they enjoyed.

Hopefully things are looking up for Spring for all of you, and you can keep busy.

Every legislative session has its own personality. The process is basically the same, but the charac-ter of the place changes. This year’s legislative session started January 24th and it promises to be short with a predicted end date in April. This means the pace will be fast and BAM will be moving quickly to push our issues through and oppose unreasonable legislation. BAM’s priorities for the 2012 ses-sion include contractor enforce-ment, the contractor recovery fund, and opposing a fire sprinkler mandate.

The committee deadlines were announced for 2012 by House Speaker Kurt Zellers and Senate Majority Leader Dave Senjem. By

March 16th committees must act favorably on bills in the house of origin. By March 23rd commit-tees must act favorably on bills or companion bills that met the first deadline in the other body. By March 30th committees must act favorably on major appropriation and finance bills.

The next big determining factor for the session, at the time of writ-ing, is the ruling from the courts on redistricting and the February economic forecast for the state. Both will provide more structure and ultimately more urgency at the Capitol. From the time the forecast is released legislators will have just three weeks until the first commit-tee deadline.

COdESIn addition to the legislative

session, BAM is also in the midst of working on adoption of a new residential building code. Karen Linner, BAM’s Director of Codes and Research, and her team of members from across the state are working hard and putting in the hours to represent the residential construction industry and ensure the code is reasonable and Minne-sota-specific.

TOrT rEFOrM vETOS: THE ELLEn AndErSOn

AFTErMATH? OK. The infamous comment by the

Governor after reviewing and veto-ing the tort reform bills was stunning. He accused the republican majority of being unfit to govern. Them’s fightin’ words no doubt and of course the Capi-tol is abuzz. The rhetoric has only more deeply seated the partisanship and the conciliatory and beautiful words of-fered by the Governor during his STATE OF THE STATE this week doesn’t go far enough. (See links to Speech Recap be-low)

STOP STEALInG THE MOnEY! BAM is supporting a bill (HF2172)

authored by Representative McElfat-rick (R-Deer River) which puts an end to the raid on the Construction Code Fund by the legislature. Starting in 2007, the legislature has been pulling out approximately $1.6 million per year from the fees, licenses, fines and permit revenue the industry has been paying to the Department of Labor & Industry (DLI) to enforce the building code and licensing. The bill will prevent the trans-fer of funds so the department can keep that revenue for the purposes for which they’re collected. The bill passed the jobs finance committee and was sent to the House Ways and Means Commit-

tee. The Senate author is Sen. DeKruif (R-Madison Lake).

MOrE CHAnGES FOr IndEPEndEnT COnTrACTOrS.

BAM is also working on a bill that would make significant changes to the independent contractor licensing process. HF2093, authored by Rep-resentative Tim Sanders (R-BLAINE) would make the applications process more streamlined and it sets up a pilot project at DLI to get all subcontractors registered with DLI. The hearing on Thursday was filled with subcontrac-tors from a new organization called the Minnesota Association of Exterior Specialists seeking to also make altera-tions to the bill. The bill passed out of the House Jobs committee and the author will be working with all sides. BAM is hoping to also include a repeal of the 2% withholding requirement contractors must also perform on be-half of subcontractors filed as Inde-pendent Contractors.

FIrE SPrInKLErS: AnOTHEr WIn In

THE COdE PrOCESS. This past week the Minnesota code

committee met to review and finalize amendments to the residential building code. The fire service brought forward a number of proposals for consideration. For example, the fire service proposed a code change that would allow home builders to ELIMINATE smoke alarms and egress windows in bedrooms if a fire sprinkler system were installed.

BAM and other members of the com-mittee could not support that kind of trade off and the proposal failed. All total the fire service introduced 6 sepa-rate proposals, all of which failed by 2/3 vote.

rACE TO rEdUCE rEGULATIOn. It’s the only way I can describe it.

The legislature is considering a whole host of bills that will limit the Admin-istration’s authority to proceed with any kind of regulation without legisla-tive influence. There are bills that create a small business board, bills to put a moratoria on all rule making, and bills to require better fiscal notes and more accurate impact statements on small business. We have been monitoring the progress and like some of them bet-ter than others but have not publicly weighed in on any of them. My best guess at this stage of the game is that all, unfortunately, are veto bait.

FEBrUArY 21 rEdISTrICTInG PLAn. And THE WInnEr IS…The big story next week will be

about the Courts decision on the redis-tricting plan. Why is this so significant? It will decide what a legislative district looks like in Minnesota so every legisla-tor may be looking at new territory, new constituents, and some may be looking at no district at all. This one piece of news is the primary reason the legisla-ture will be so anxious to get their work done and get out of Saint Paul. The win-ners and losers will be announced next week.

the EXPO’s are over. Both were very good for our members and association. The Builder EXPO was attended by 56 builders and was a great success. We are gearing up for

an awesome Home, Garden and Sport Show. The Sport Show arena is full and the Home Show side is getting there. If you are thinking of having a booth and have not booked it yet, better hustle. There is a lot going on at the capitol, so be sure and read Pam’s information. Most of you have not met the people at the BAM office, but they are a hard working group. You can definitely see it by what they do to protect the builders as far as the sprinkler bill which will raise the cost of a new home from $4,000.00 to $14,000.00, the raiding of the License money by the state for what you have to pay to get your license updated. Every year the amount gets bigger and in a tough economy it gets hard to pay for.

The Builders Convention was fairly well attended, with the BATC Product Show on Thursday, along with Casino night, up early on Friday for the BAM Board meeting. We went to the vendor booths in the afternoon and were treated to very good food and beverages. Following for the evening was the Awards Banquet. Our President, Bryan Schoenberger, won the States’ Presidents award. Thanks to Jessy for helping me to get Bryan to stay, without him knowing he was receiving it. Scott and Martha Buchholz also attended and had a mini vacation that they enjoyed.

Hopefully things are looking up for Spring for all of you, and you can keep busy.

Every legislative session has its own personality. The process is basically the same, but the charac-ter of the place changes. This year’s legislative session started January 24th and it promises to be short with a predicted end date in April. This means the pace will be fast and BAM will be moving quickly to push our issues through and oppose unreasonable legislation. BAM’s priorities for the 2012 ses-sion include contractor enforce-ment, the contractor recovery fund, and opposing a fire sprinkler mandate.

The committee deadlines were announced for 2012 by House Speaker Kurt Zellers and Senate Majority Leader Dave Senjem. By

March 16th committees must act favorably on bills in the house of origin. By March 23rd commit-tees must act favorably on bills or companion bills that met the first deadline in the other body. By March 30th committees must act favorably on major appropriation and finance bills.

The next big determining factor for the session, at the time of writ-ing, is the ruling from the courts on redistricting and the February economic forecast for the state. Both will provide more structure and ultimately more urgency at the Capitol. From the time the forecast is released legislators will have just three weeks until the first commit-tee deadline.

COdESIn addition to the legislative

session, BAM is also in the midst of working on adoption of a new residential building code. Karen Linner, BAM’s Director of Codes and Research, and her team of members from across the state are working hard and putting in the hours to represent the residential construction industry and ensure the code is reasonable and Minne-sota-specific.

AFTErMATH? OK. The infamous comment by the

Governor after reviewing and veto-ing the tort reform bills was stunning. He accused the republican majority of being unfit to govern. Them’s fightin’ words no doubt and of course the Capi-tol is abuzz. The rhetoric has only more deeply seated the partisanship and the conciliatory and beautiful words of-fered by the Governor during his STATE OF THE STATE this week doesn’t go far enough. (See links to Speech Recap be-low)

STOP STEALInG THE MOnEY! BAM is supporting a bill (HF2172)

authored by Representative McElfat-rick (R-Deer River) which puts an end to the raid on the Construction Code Fund by the legislature. Starting in 2007, the legislature has been pulling out approximately $1.6 million per year from the fees, licenses, fines and permit revenue the industry has been paying to the Department of Labor & Industry (DLI) to enforce the building code and licensing. The bill will prevent the trans-fer of funds so the department can keep that revenue for the purposes for which they’re collected. The bill passed the jobs finance committee and was sent to the House Ways and Means Commit-

tee. The Senate author is Sen. DeKruif (R-Madison Lake).

MOrE CHAnGES FOr IndEPEndEnT COnTrACTOrS.

BAM is also working on a bill that would make significant changes to the independent contractor licensing process. HF2093, authored by Rep-resentative Tim Sanders (R-BLAINE) would make the applications process more streamlined and it sets up a pilot project at DLI to get all subcontractors registered with DLI. The hearing on Thursday was filled with subcontrac-tors from a new organization called the Minnesota Association of Exterior Specialists seeking to also make altera-tions to the bill. The bill passed out of the House Jobs committee and the author will be working with all sides. BAM is hoping to also include a repeal of the 2% withholding requirement contractors must also perform on be-half of subcontractors filed as Inde-pendent Contractors.

FIrE SPrInKLErS: AnOTHEr WIn In

THE COdE PrOCESS. This past week the Minnesota code

committee met to review and finalize amendments to the residential building code. The fire service brought forward a number of proposals for consideration. For example, the fire service proposed a code change that would allow home builders to ELIMINATE smoke alarms and egress windows in bedrooms if a fire sprinkler system were installed.

BAM and other members of the com-mittee could not support that kind of trade off and the proposal failed. All total the fire service introduced 6 sepa-rate proposals, all of which failed by 2/3 vote.

rACE TO rEdUCE rEGULATIOn. It’s the only way I can describe it.

The legislature is considering a whole host of bills that will limit the Admin-istration’s authority to proceed with any kind of regulation without legisla-tive influence. There are bills that create a small business board, bills to put a moratoria on all rule making, and bills to require better fiscal notes and more accurate impact statements on small business. We have been monitoring the progress and like some of them bet-ter than others but have not publicly weighed in on any of them. My best guess at this stage of the game is that all, unfortunately, are veto bait.

FEBrUArY 21 rEdISTrICTInG PLAn. And THE WInnEr IS…The big story next week will be

about the Courts decision on the redis-tricting plan. Why is this so significant? It will decide what a legislative district looks like in Minnesota so every legisla-tor may be looking at new territory, new constituents, and some may be looking at no district at all. This one piece of news is the primary reason the legisla-ture will be so anxious to get their work done and get out of Saint Paul. The win-ners and losers will be announced next week.

February was a good month and March is a little closer to summer! Our monthly meeting was at the Speak Easy with Ann Makres from the IRS speaking. We learned some good information about home of-fices and other tax related issues, and no we didn’t get audited! Once again, Jessy, Sharon and I were able to attend the BAM convention down in the Twin Cities. We were joined by Scott and Martha Buchholzand my broth-er Lance and his wife Mary. It was a lot of fun! I was humbly honored with the BAM 2011 President’s award. A huge and exciting surprise to say the least!!! MARCH 8tH Meeting to be Held At tHe speAk eAsyThe speaker for the March meeting is Mike Daniels with Auer Steel Supply. The subject will be on heating system

designs and options. Many projects are being sold with a minimal and basic heating system design with the decid-ing factor being the purchase price. After the home or remodeling project is completed, the homeowners, in many instances are not happy with the end product because of either economy or comfort. The goal of this meeting is to make our builder members aware of options that add value to their projects. I think this will be another way to set our members up as the professional builders we want to be. Board meeting at 5:30, Social at 6:30 and meeting to start at 7:00 at the Speak Easy.

ann Makres gave a very good talk about a very bor-ing subject. She was trying to talk above the group in the next room that were a little loud. She covered tax issues that there are usually questions on relat-ing to home offices, LLC versus Independent con-tractor and other business related issues.
