June is now here and summer is under way. I hope everyone is busy and has work lined up for the summer.

May was another good month at the Builders Association. We had a great year end picnic at the Nodsle house, a special thank you to Carmen and Perry Nodsle for hosting the event at their home. There was great food grilled over open pit fire and lots of great sweets. Several of our area scholarship recipients were also there and each spoke about what they plan to do for schooling next year and they all thanked us for their scholarships.

We still have RRP classes available. Read Sharon’s article for more information on this topic. We will not be having any general membership meetings until September, so everyone have a good and safe summer.

Our meeting, May 11, held at Perry Nodsles’ was a little chilly but a great time was had by all that were there. We recognized three of the scholarship winners that came; Mark Labat, Jayne Harms and Ben Kunz. We talked about what their plans were for going to college. Mark is going into Architec-tural Design, Jayne is going for Design and Ben is going to school to be an electrician. Really nice young people.

We all thank Perry Nodsle, his wife Carmen and kids – Morgan and Calvin for sponsoring the May meeting. They are both very good cooks. Perry started in the construction business working for his father in 1973 and in 1990 became a partner and now 20 years later he keeps busy with Nodsle Construction. Perry does residential and commercial proj-ects. He is also a very active member of the association, hav-ing served on the Board of Directors and President. What a year BAM and the industry has been hav-ing at the capital! The builder continuing education bill was signed by the Governor in April. The war-ranty bill passed both the house and senate and cur-rently was signed by the Governor Thursday. And last but not least, BAM was able to come to an agreement on the property maintenance code issue.

It’s a far cry from our session last year, but it’s not over yet. Session is scheduled to end next week, how-ever there are rumblings of a special session due to Governor Pawlenty’s veto of the budget bill Tuesday, which passed the senate with a 34-33 vote and the house 71-63. The legislature has until Sunday night to solve the $3 billion budget deficit and negotiations are happening in vain.

BAM 2010 Session Successes: Warranty BillThe Warranty Task Force consensus bill (SF

2832/ HF 3386) discussed all summer and lobbied by BAM members during Builder Day at the Capital has seen it’s final vote in both the senate and house and passed each body. The governor signed it into law Thursday May 13th.

Education BillThe builder education bill streamlining continuing

education requirements and adding the ability to take classes online HF3360 (Nelson) / SF 2944 (Tomasso-ni) was signed into law by Governor Pawlenty April 22nd. Online education will be legally allowed in Min-nesota August 1st. The bill was developed and is sup-ported by the Department of Labor and Industry and the Association of Minnesota Building Officials.

Property Maintenance CodeBAM successfully fought alongside a coalition

of vested parties to prevent municipalities from in-

voking the very strict state fire code requirements on existing buildings through their property main-tenance codes. For more information about the bill the language and progression through the legislature is available online: SF 2759 / HF 2945. The bill was signed into law by the Governor May 11th.

News From the Federal Legislature: Home StarThe federal legislature is currently discussing a

bill called the Home Star Energy Retrofit Act of 2010 (H.R.5019 Welch / S.3177 Bingman) to create a na-tional energy retrofit rebate program. It passed the house last week and the bill is now moving through the senate. BAM has been watching closely and ad-vocating for Project ReEnergize. Minnesota is the only state across the nation that has successfully built and run an energy rebate program.

LEAD: Be Sure To Get TrainedApril 22nd has come and gone which means the

EPA’s new Lead Renovation, Repair and Painting re-quirement is now in effect. All contactors working in homes built before 1978 are required to be trained and certified by the EPA. Be sure to get trained and that your class is taught by an EPA-certified trainer.

BAM has updated and made six of the most im-portant and helpful contracts available online in the members-only section. Legal requirements frequent-ly change, so it is important to be sure your contracts and procedures reflect those changes.

SUCCESS! An Update From the State LegislatureI think Summer is here, and I hope ev-eryone is seeing their business’s getting busier. I seem to keep really busy with EPA, RRP, BAM Skype calls and setting up more classes. There has been a lot of information coming in on the EPA’s Renovate, Repair and Paint. At this time the EPA is in charge of the lead rule until the State of MN’s Dept. of Health finishes updating their lead rule to include the new Federal requirements. (See more in the insert). That process will be com-pleted in 2011. The state legislature has spe-cific rules that have to be followed, so it isn’t a fast process.

A new law was passed that will require building contractor officials to check for lead compliance before they issue a permit. That rule does not take effect until Feb. 2011. Hopefully they could start checking sooner. They won’t be able to charge for this until Feb. 2011 but they could still follow up with those seeking a permit.

NAHB will be sending out a form for our members to send in comment letters to EPA. It is important for the EPA to know how nega-tively these rules affect contractors who are trying to follow regulations in a state that re-quires licensing.

As soon as I receive the form I will send it out as it will make it easy for everyone to respond.

A new law was passed that will require building contractor officials to check for lead compliance before they issue a permit. That rule does not take effect until Feb. 2011. Hopefully they could start checking sooner. They won’t be able to charge for this until Feb. 2011 but they could still follow up with those seeking a permit.

NAHB will be sending out a form for our members to send in comment letters to EPA. It is important for the EPA to know how nega-tively these rules affect contractors who are trying to follow regulations in a state that re-quires licensing.

As soon as I receive the form I will send it out as it will make it easy for everyone to respond.

June is now here and summer is under way. I hope everyone is busy and has work lined up for the summer.

May was another good month at the Builders Association. We had a great year end picnic at the Nodsle house, a special thank you to Carmen and Perry Nodsle for hosting the event at their home. There was great food grilled over open pit fire and lots of great sweets. Several of our area scholarship recipients were also there and each spoke about what they plan to do for schooling next year and they all thanked us for their scholarships.

We still have RRP classes available. Read Sharon’s article for more information on this topic. We will not be having any general membership meetings until September, so everyone have a good and safe summer.

Our meeting, May 11, held at Perry Nodsles’ was a little chilly but a great time was had by all that were there. We recognized three of the scholarship winners that came; Mark Labat, Jayne Harms and Ben Kunz. We talked about what their plans were for going to college. Mark is going into Architec-tural Design, Jayne is going for Design and Ben is going to school to be an electrician. Really nice young people.

We all thank Perry Nodsle, his wife Carmen and kids – Morgan and Calvin for sponsoring the May meeting. They are both very good cooks. Perry started in the construction business working for his father in 1973 and in 1990 became a partner and now 20 years later he keeps busy with Nodsle Construction. Perry does residential and commercial proj-ects. He is also a very active member of the association, hav-ing served on the Board of Directors and President. He also co - chaired the Home & Garden Show this year. He is a very important asset to the LRBA.
