Greetings! The warmer weather is certainly a welcomed

change! Spring is coming soon with lots of new and exciting things coming up for the builders associa-tion. We traveled down to the BAM state Conven-tion, in January, the education was excellent and the evening events were fun!

The Builder’s Expo was well attended and the speakers passed on lots of good information. For many of us builders, we are done with our continu-ing education for another year! We had the strategic planning seminar and gained a whole bunch of new ideas to lead our Association into a successful future.

Our monthly general meeting at Midwest Bank was very informational. Steve Daggett talked to us about the banking industry and the services Mid-west Bank has to offer the home building industry.

The home show is coming soon and we are looking forward to another successful event! Hope to see you there! Last month I left you with a promise to help approach potential new members. Members are the heart and soul of our Association. Without members, there will be no Association. It is vital that we continue to bring new members into our organization!

This month we will focus on the lobbying that Builders Association of Minnesota (BAM) and the National Association of Home Builders (NAHB) does for us. The government is constantly changing the building code, as well as, making new codes. Every so often they have good ideas. More times than not, their “new codes” are a burden to our industry as well as taxing on our economy. Someone has to step up and debate these new codes before they are adopted and it’s too late to stop them. I don’t know about you, but I don’t have the time to keep on top of these issues. That’s where BAM & NAHB come in. Think of them as our “big brother”. They are constantly “watch dog-ging” code issues. They “step up to bat” for us.

Last fall we had a visit from Pam Perri from BAM during our November meeting. If you were there you probably got a good insight of what she does for our industry. She is very, very passionate about her job as a lobbyist and protecting us from frivolous government regulations.

The 2011 Minnesota Builders Convention was a blast. Thank you to all who attended, spon-sored and helped make the Convention a major success. From the leadership training on Friday to the final farewell breakfast Sunday morning, members were kept busy with networking, edu-cation, political talk and fun. Check out the pic-tures on BAM’s facebook page.

Friday members attended the NAHB Leadership Training and the BAM Government Relations Committee meeting. The new Minne-sota Department of Labor and Industry Com-missioner Ken Peterson and Assistant Commis-sioner Jessica Loomens came to talk with the committee. The fun started with Casino Night, which was a hit and the hospitality suites were a great party Friday night and Saturday afternoon thanks to our sponsors.

The BAM Board meeting was Saturday morning followed by keynote speaker Kit Welch-lin. The evening began with a cocktail reception and silent auction, which along with the Heads or

Tails game during the dance and the Wine Wall Raffle raised $4,800 for BAM-PAC.

The Saturday evening Awards and Installa-tion Banquet saw nine members honored and 2010 President Mike Gohman step down as 2011 President Todd Bjerstedt, of McDonald Re-modeling, was installed.

Congratulations to all our 2010 BAM Award winners and to our new association president.

Pictures of all the fun and action are online, so check it out and look for information about next year’s Minnesota Builders Convention.

There are many reasons to be a member of the builders association. You get resources, information, education, events, advocacy and benefits from three levels: local, state and national. Here are just some of the benefits you get from your state association, the Builders Association of Minnesota (BAM).

1: $10,000 In Legal Contracts, Code Guides and Building Best Practices

On the BAM members-only website (www.bamn.org) you have access to up-to-date contracts available in both pdf and word formats. Legal requirements fre-quently change, so it’s important your contracts and procedures reflect those changes. Login, click on Leg-islation/Legal, and look under Legal Resources. 2: Building Performance Guidelines *NEW*

Beginning January 1, 2011 you must, by Min-nesota law, include a set of performance guidelines with your contract with customers. You can buy those guidelines, but as a member the guidelines are free. BAM’s Building Performance Guidelines were put to-gether by a task force made up of BAM members who put in countless hours creating and refining this docu-ment in order to provide the best possible product for you. The guidelines are now posted at bamn.org under Legal Resources on the Legislation/Legal page. 3: 2011 Engineered Documents

Every year since the 2006 IRC was introduced your membership has provided you with updated en-gineered documents to accompany the BAM Member Guides to Foundation Wall Support and Cantilevered Foundation Walls. The 2011 engineered documents are now available online at bamn.org 4: Savings on Fuel

As a member you can receive a four-cent per gal-lon rebate at Holiday StationStores on all gasoline and diesel fuel purchases and $2 off car washes. To receive the saving you just need to apply for a Holiday Fleet Card and pay it off each month. There’s no fee to carry the card and you can track mileage and purchases by vehicle if you’d like. To apply visit bamn.org/member-ship and look under Member Benefits. 5: Savings on Office Supplies

BAM has partnered with Office Depot to offer you a discount and free delivery on the office supplies you

use every day. You can shop online, by catalog or in-store and get 30-50% off copying and custom print-ing in-store. To save just follow the link found on the Membership page under Member Benefits.6: Savings on Tech Support

As a member Solbrekk offers discounted service, customized solutions and core IT services. Call 763-475-9111 for information about network installation and management, on-site and remote access solutions and support, data backup, hardware and software needs, internet support and integration and more.7: Savings on Wireless Service

Members of BAM and NAHB may be eligible to receive 22% off monthly access calling plan fees and other discounts. Contact Jeff Hebrink at [email protected] to find out more information.8: Members-Only Insurance

Created by BAM and its local associations and part-nered with Continental Western Group, CWG Quality Insurance, was created as a member-only benefit, offer-ing affordable general liability, builders risk, auto and umbrella coverage. The dividend structure pools par-ticipant buying power to achieve lower rates and give policyholders the potential to earn dividends based on the group’s loss ratio. Visit bamn.org/membership and look under Member Benefits to learn more.9: Members-Only Workers Comp

Your workers’ comp needs are different from those of an office, so you need a product that understands the unique demands of the construction industry. The Build-ers Group (TBG) is the largest self-insured workers’ comp fund in Minnesota and was created by the building in-dustry. Visit bamn.org/membership and click on the in-surance link under Member Benefits to learn more.

In addition to the benefits listed above there are many other things you get from builders association membership. As a member you have a voice at the legis-lature; in laws and rules that impact your business. You have a voice in the courts, access to industry research and code advocacy, and the latest information on changes to the state laws impacting your business. In sum, as a member of the association you’re protected.

my ViewSharon Westerholm, EODo you suppose we will

ever get Spring? I am begin-ning to think it will not hap-pen. It has been a very busy month again. Check the cal-endar to see what is happen-ing. I am going to give it an-other try to get enough for a Renovate, Repair & Paint class on March 16th and another on

April 6th. If you haven’t taken it, you may need to think about it.

Mark Dayton signed the EPA ruling into law. They changed the requirement date for Building Officials checking to see if a home was built be-fore 1978 and if the person pulling the permit is certified. See the article in the newsletter.

The Home Show is coming along well. If you are still thinking of having a booth, be sure to get it taken care of. Help will be needed for set-up on the 25th, so be sure to come in. We will also need people to work the front desk. Call Sharon at 218-847-0699.

THIS WILL BE THE LAST PRINTED VERSION I WILL BE SENDING OUT. Several people have requested to have their newsletter mailed. If you need a paper version, please let me know. Those that I do not have email addresses for will still re-ceive them in paper form. Once the newsletter is done, I will send out an email to go to our web-site: www.lakeregionbuilders.com. It is very easy to read and maneuver on this site.

Our next meeting is at Speak Easy. Please call or email me at; [email protected] and let me know if you plan to attend. t for Also, if you have something you would like to go in the newsletter let me know. I would also like to get back to doing a MEMBER SHOWCASE where a member can put a picture of their showroom and have a write up of their business. (How long in business, why you joined the LRBA…) Have a good March and hope for nice weather soon!

Check out the pictures on BAM’s facebook page!

In the year 2010, the Lord came unto Noah, who was now living in the United States, and said: Once again, the earth has become wicked and over-populated, and I see the end of all flesh before me.

Build another Ark and save 2 of every living thing along with a few good humans.

He gave Noah the blueprints, saying: You have 6 months to build the Ark before I will start the unending rain for 40 days and 40 nights.

Six months later, the Lord looked down and saw Noah weeping in his yard - but no Ark.

Noah! He roared, I'm about to start the rain! Where is the Ark ?

Forgive me, Lord, begged Noah, 'but things have changed.

I needed a building permit.I've been arguing with the inspector

about the need for a sprinkler system. My neighbors claim that I've violated

the neighborhood zoning laws by building the Ark in my yard and exceeding the height limitations.

We had to go to the Development Ap-peal Board for a decision.

Then the Department of Transporta-tion demanded a bond be posted for the future costs of moving power lines and other overhead obstructions, to clear the passage for the Ark 's move to the sea.

I told them that the sea would be coming to us, but they would hear nothing of it.

Getting the wood was another prob-lem. There's a ban on cutting local trees in order to save the spotted owl.

I tried to convince the environmental-ists that I needed the wood to save the owls - but no go!

When I started gathering the animals, an animal rights group sued me.

They insisted that I was confining wild animals against their will.

They argued the accommodations were too restrictive, and it was cruel and inhumane to put so many animals in a confined space.

Then the EPA ruled that I couldn't build the Ark until they'd conducted an

environmental impact study on your proposed flood.

I'm still trying to resolve a complaint with the Human Rights Commission on how many minorities I'm supposed to hire for my building crew.

Immigration and Naturalization are checking the green-card status of most of the people who want to work.

The trades unions say I can't use my sons. They insist I have to hire only Union workers with Ark-building experience.

To make matters worse, the IRS seized all my assets, claiming I'm trying to leave the country illegally with endan-gered species.

So, forgive me, Lord, but it would take at least 10 years for me to finish this Ark.

Suddenly the skies cleared, the sun began to shine, and a rainbow stretched

across the sky.Noah looked up in wonder and asked,'You mean you're not going to destroy

the world?' 'No,' said the Lord. 'The government beat me to it.

it’s Good To be a builders association Member

A recent accomplishment was convincing Minnesota law makers to not adopt a proposed code that would require a fire sprinkler sys-tem in every new single family resi-dence. Sure, it is a good option to have in a new home. That’s what we

think it should be, an option, not a regulated code. A building code that forces us to install them is not necessary and ultimately is very ex-pensive.

Research shows that our current code requiring hard wired smoke detectors is 99.45% effective in sav-ing lives, the fire sprinklers would

increase that to 99.85%. Pam Perri and the rest of the team at BAM were instrumental stopping the fire sprinkler code from being adopted. This is just one example of our as-sociation working for us.

New, potential members need to know this! Many people try to put a monetary value on their

Builder’s Association membership investment. In my opinion, saving us from just the fire sprinkler is-sue, alone, is worth my annual in-vestment 10 fold. There are many, many more benefits of being a member. Next month I will discuss some other not so obvious benefits that come with membership.

2011 Minnesota builders convention Was a success

Feb. 17, 2011 -- Gov. Mark Dayton signed into law Senate File 139, a bill related to online notification of EPA-certified lead abatement licensed contractors. Under current law, a building inspector must prove that a contractor received their EPA certificate in lead specializa-tion when remodeling pre-1978 houses by confirming their certification online. Under SF 139, contractors who receive their certification now have until August 1 to post their name to the verified list, which will be available on DLI's website.

View the text of the bill at: https://www.revisor.mn.gov/bin/bldbill.php?bill=S0139.1.html&session=ls87 <https://www.revisor.mn.gov/bin/bldbill.php?bill=S0139.1.html&session=ls87> More information about the Environmental Protection Agency's new rule for work on homes and other buildings with lead paint is available on DLI's website at http://www.dli.mn.gov/CCLD/lead.asp

Visit the EPA's Renovation Repair and Painting (RRP) information page at http://www.epa.gov/lead/pubs/renovation.htm for further details about the requirements.

FEBRUARY NEW MEMBERS

BE SURE AND WELCOME THEM TO OUR ASSOCIATION

Good Day Builder’s Members!I am on the Lakes Crisis and Resource Center’s board and fundraising committee. On April 1, 2011

we host our largest fundraiser. This year it is called “Just Jokin’ an April Fool’s Day Fun-Raiser.”An idea came up at one of our meetings…with the popularity of the Extreme Make-Over Show,

that maybe we could get people in the home/yard/furnishing industries to do a package to auction off…for example electrical, plumbing, heating, landscaping, windows/doors, lumber, carpentry, swimming pools/spas, painting, cabinets, gazebos, furniture….What we’re looking at is, if we could get a $100 gift certificate (or more) from one member in each category…we’d make a live auction home improvement package sponsored by our association. In reality it could be $1000-$2000 value to be used in sprucing up the buyer’s home. Hopefully, if you donated a $100 gift certificate, the homeowner would have more than $100 worth of work to be done.

If you could commit to Sharon, within the next week…I could see if this will work. It will be on a first come, first serve basis for each category. This would be great press for the Builder’s Association and would benefit the Lakes Crisis and Resource Center.Kathy MichaelsonModern Heating and Plumbing

Comments Wanted – RRP RuleRemodelers Asked to Comment on Certification, Re-

cordkeeping Costs of Lead Rule Remodelers and contractors who are trained and certified under the Environmental Pro-tection Agency’s Renovation, Repair and Painting (RRP) rule now have the opportunity to provide the agency with com-ments on the cost of certification and recordkeeping under the new regulation.

The EPA announced it was seeking comments in a rou-tine Information Collection Request published in the Fed-eral Register on Jan. 26.

The various estimated cost burdens of the RRP rule are included in a supporting statement from the EPA.

In its economic analysis of the rule, the EPA estimated that remodelers would spend 3-1/2 hours familiarizing themselves with the rule and completing the initial firm certification form. It should take another three minutes per project to complete, present and explain the post-renovation checklist to the property owners or tenants, according to EPA projections.

Lastly, the EPA said that it expected remodelers to spend a little less than five hours on recordkeeping.

Comments from remodelers are due by March 28.

content/0,,id=104608,00.htmlSmall Business Jobs Act - taxpayers can

claim the self-employed health insurance deduction against 2010 SE tax if the insurance

plan is established under the business and any of the following are true: 1) They were self-employed and had a net profit for the year, or 2) They received wages from an S corporation in which the taxpayer was a more-than-2-percent shareholder.

http://www.irs.gov/businesses/small/index.html http://www.irs.gov/pub/irs-pdf/i1040sse.pdf

The deduction is not available if a self-employed individual is eligible to participate in an employer-subsidized health plan main-tained by an employer of the taxpayer or the taxpayer’s spouse. The self-employed health insurance deduction may be limited and may not exceed the earned income derived from the trade or business to which the health plan is established. The 2010 Form 1040 Schedule

By Bryan SchoenbergerA true general contractor has a li-

cense. In the state of Minnesota, as well as many states, it’s not an op-tion, it is the law. There are many “so called” Contractors that operate with-out a license. The trouble is that the state doesn’t have the type of funding available needed to police valid con-tractors licenses.’’ Unfortunately, it is left up to the customer to do their own policing.

A simple check with the Depart-ment of Labor & Industry at www.dli.mn.gov is all it takes. Hiring an “un-licensed” contractor is a huge mistake! The customer could end up suffering from a number of losses.

Licensed contractors follow build-ing codes; pay into the contractors recovery fund; are required to have proper insurance; have withstood a criminal back ground check; passed an exam showing their trade com-petency and will lose their license if they use poor business practices.

Would you really want to do busi-ness with someone who blatantly breaks the law? -- Or worse yet, someone who is unaware of the legal responsibilities that come with build-ing your home?

I also recommend choosing a con-tractor that belongs to a Builders As-sociation. They are held to a higher standard. Local, State and National Builders Associations provide its members with valuable

education and resources. You can take comfort in knowing that you are working with someone who cares about their industry and has a quest for new knowledge.
