Greetings!May was a busy month and went by quickly!
We have had our final meeting of the season which was at Dunton Locks County Park. Sha-ron ordered a perfect evening! We will start up the general meetings again in the fall. There is a lot of things going on at BAM with legislation and code issues right now. You should be getting e-mails with updates as well as some information in the back of this newsletter.
This month’s focus on “tools for recruitment” will be on how LRBA gives back to our community. We have a strong commitment to give back to our local community. The Lake Region Builders Association, along with West Central Initiative, established the LRBA Scholarship Foundation which annually provides scholarships to graduating high school seniors who plan to continue study in a construction-related field. LRBA and its members have contributed to numerous community ser-vice projects over the years including the gazebo at the city park, the box office at the Historic Holmes Theatre, the Tom Oswald House project, the 2005 Habitat for Humanity house, baseball dugouts and ramps for Hospice to name a few. These types of projects show that we care about our community. Not only is volunteer work good karma, it shows that we are committed and trustworthy. With our busy schedules sometimes it is difficult to take on these types of projects. As a LRBA member you can be involved without having to shoulder all of the responsibility your-self. If everybody pitches in a little bit, we can make a huge difference!
In conclusion, being an LRBA member gives you an excellent oppor-tunity to get involved in something of a greater cause, while having a lot of fun! Yet another great benefit of membership to share with prospec-tive members. Until next time… enjoy the warm weather and be safe!

We had guests at our picnic meet-ing : Todd Bjerstad, BAM President, was there and talked about what BAM was doing, the task force on unlicensed contractors and what is going to be done to address this situation. He also talked a little on BAM-PAC and what the funds go for. We are doing pennies for PAC at all of our upcoming meetings
to raise funds for the legislatures that help with the issues that pertain to the building industry.Also in attendance were two of the scholarship winners - Jack Januszewski
and Cyrus Bickell from Perham. They talked about what they were going to be doing. Cyrus and Jack are going to school for Construction Management. They are pictured with Todd Bjerstad.

Variance, Success!The Variance bill HF52 allowing cit-
ies to grant variances again, after the Minnesota Supreme Court ruled on the Krummanacher case last year interpret-ing the law to mean an undue hardship needed to be proven in order for a city to grant a variance. Millions of dollars of member projects were held up by the interpretation and BAM is happy to re-port the bill was passed and signed into law opening the doors for cities to grant variances once again. Register Today! BAM has received a grant from the Legislative-Citizen Com-mission on Minnesota Resources in partnership with the Center for Energy and Environment to design and teach a free two-hour class for licensed con-tractors on how to market air sealing to consumers with one hour of contractor continuing education energy credit.
For the class BAM has developed a series of videos to help sell and explain air sealing to consumers. The videos include infrared camera shots, an ex-planation of what air sealing is, why it’s important, and the importance of using a qualified contractor. Ice dams are used as a visual symptom of a house that needs air sealing. The will provide infor-mation on Minnesota utility rebates in your region and a free demonstration of
infrared cameras and spray foam.Twelve classes are being taught
throughout the state in June.Pre-registration is required and
space is limited. To register visit www.bamn.org and
click on “Fixing Ice Dams – Minnesota Style, A Free 2-Hour Energy Class” un-der the events section. NAHB-Support Bill (Miller Bill) Introduced to Help Restore Flow of Credit to Housing
NAHB reported this week in their e-newsletter Nation’s Building News that a bill was introduced May 5 by Reps. Gary Miller (R-Calif.), Brad Miller (D-N.C.) and 29 other cosponsors with the goal of addressing the severe credit crunch for acquisition, development and construction (AD&C) financing.
According to NAHB, H.R. 1755 would address specific regulatory obsta-cles to the credit needs of the nation’s home builders and “is a significant ad-vancement in NAHB’s overall strategy to help members find the credit they need to move forward with new or ex-isting projects.”

I was asked to participate on NAHB’s Exploring Alternatives for the Future Task Force which was formed in response to the Lang Report (view the
report here: http://www.bamn.org/im-ages/pamspov/lang-report.pdf). The task force was charged with “leading the review and further consideration of or-ganizational and governance changes to better position NAHB for the future.”
It’s been an interesting road work-ing on the task force. While two board meetings have come and gone since the Lang Report came out and no discus-sion has happened on the board floor regarding change, the task force recom-mendations could provide a platform to begin that discussion for board action. I firmly believe all NAHB members need to be committed to discussing change and letting the democratic process oc-cur.

mation and new marketing tools, attendees will be eli-gible to win the door prize, a GREAT STUFF PROTM Gap & Cracks Starter Kit, given away at each class and valued at $75. During each class a name will be drawn and placed in a grand prize drawing for one of three FROTH-PAKTM Foam Insulation Kits valued at $375. Eligible winners must attend the entire course and work for a licensed residential contractor.

heavens, the weather was less than desireable. I scheduled the picnic for June 1st, knowing it was going to be nice. It was beautiful! We had decent attendance, but I think a few people for-
got. I know we cooked about 40 burgers and there were salads, fruit and desserts galore. No one went home hungry. It was really nice that two of our scholar-ship recipients were at the picnic. They seemed to enjoy themselves and were very happy for the $1000 scholarship they will receive after their first semes-ter. Todd Bjerstad, the BAM President, was pleased with the turnout for our pic-nic and had a good time meeting every-one. We also gave out five $10 gas cards on a drawing.
We will be holding an OSHA 10 HOUR CONSTRUCTION OUTREACH TRAIN-ING ON June 27th and 28th. See the article in the newsletter. I will also be holding the last RRP class on June 24th, providing I have the 20 minimum. If you haven’t taken the class and want to, call the office for a reservation form for ei-ther class.
The office will be closed on Mondays and Fridays, for the summer, but you can always reach me on my cell phone - 218-849-1037.

BAM Receives Grant to provide Free Energy Class in June From the Desk of pam perri….
CHAIRPERSON: NEEDEDThe Silent Auction has raised funds for many years to give out schol-
arships to students going into the Building Trades. Over $100,000.00 has been raised and most of the scholarship funds have been given out.
We are looking for volunteers to serve on this committee so it may con-tinue to raise funds. Please call Brenda Eidenschink at 218-847-1946 or Sharon at 218-847-0699 for more details.
We will be holding the OSHA 10 hour class for workers covered by OSHA 29 CFR 1926 standards. I understand OSHA will be doing more scouting for violations and they may also be checking on RRP certifications. Forms have gone out in the mail, but if you did not receive them, let me know.
In the tough economy that we are in, it is more important than ever, to use the services of our members. Our associates help keep the association going, with their membership, their volunteering on our projects, the Home Show and other events. Likewise for the associates, if they need the use of a contractor or can recommend a contractor, it is impor-tant for them to use one of our fellow members. If you are using services from non-mem-bers, encourage them to become a member of our association. This benefits everyone!!!

A long time member of the Lake Region Builders Association, Don Gravelle, Don Gravelle Construction, passed away in May, the funeral was held on 19th. Don has been battling brain cancer for about two years. The LRBA enclosed Don’s house for him, installing doors, soffit and fascia and framing the inside so he was able to finish the inside. Our thoughts and prayers go out to him and his family.
Modern Heating and Plumbing was recently awarded a “bronze level award,” by Enertech, for Geo-Comfort Geothermal Systems sales and installation.

For most of us, Spring brings new work. This year, it also means stepped up OSHA enforce-ment. During an EPA/OSHA webinar last week, it was mentioned that the residential construc-tion industry has not been on the Minnesota OSHA radar in the past. All of that has changed due to the large number of violations and acci-dents that could have been prevented.
During the same call, it was mentioned that there are many cases where OSHA has shown up on a jobsite asking for a copy of your safety manual. If the contractor is able to show it, all is well and OSHA moves along. For those that do not, it is a different story.
Having said that, if you do not have an OSHA safety manual on your jobsite, get one TODAY! Go over it with your employees and stay safe.

The big news in lead hazard control in 2011 is the pending implementation of the dust sam-pling and clearance requirements under the RRP. That’s because EPA agreed, in the August 2010 Settlement Agreement, to implement wipe sam-pling and clearance for certain renovation activi-ties by July of 2011. Just to add to the drama, several members of the US Senate presented Linda Jackson, EPA Administrator with a request for “further clarification” on the proposed rule. No response yet from EPA to that April 2011 re-quest.
Lead professionals would be well served to re-view the sampling protocol for post-renovation sampling, which, incidentally, is quite a bit dif-ferent from the EPA abatement clearance proto-col, the City of New York requirements, and HUD expectations for subsidized housing. We’ll take a look at the proposed post renovation sampling requirements then compare against the existing agency clearance requirements.
EpA post Renovation Dust EvaluationEPA proposes to require dust wipe testing in
work area on uncarpeted surfaces in certain cir-cumstances that includes:
(1) Use of a heat gun at temperatures below 1100 degrees;
(2) Removal or replacement of window(s) or door frame(s)
(3) Scraping an area of 60 ft2 or greater; and(4) Removal of more than 40 ft2 (or equiva-
lent in a linear foot extrapolation) of trim or molding.
And to require clearance after:(1) Use of machines that disturb lead-based
paint through high speed operation such as sand-ing, grinding, power planing, needle gun, abra-sive blasting, or sandblasting used with HEPA exhaust control; and
2) Demolition or removal of plaster over 6 ft2.
Incidentally, there doesn’t appear to be a dif-ference in the number of samples and locations between “Dust Wipe Testing” and “Clearance”. EPA uses the term ‘‘dust wipe testing’’ (DST) to mean collecting wipe samples of dust on floors and windowsills and in window troughs, analyz-ing the samples for lead content, and reporting the results of the analysis to the owners and occupants of the building being renovated. EPA uses the term ‘‘clearance’’ to mean demonstrat-ing, through dust wipe testing, that the floors, windowsills, and window troughs in the renova-tion work area are below the regulatory clear-ance standards that have been established for the abatement program and codified at 40 CFR 745.227(e)(8). This includes recleaning where
necessary to achieve the clearance standards.The important difference lies between
what happens when the results are in. DWT culminates in reporting the results to the owners and occupants, regardless of the values relative to the EPA hazard standards. Clearance, on the other hands, requires that the Renovator “pass” the EPA hazards standards of 40, 250 & 400 ug/f2 for the floors, sill and wells respectively.
EPA, in the introduction to the proposed rule, explains that information on results of DST is likely to improve landlords and occupants awareness of dust-lead hazards. Per EPA, “It will also greatly improve their ability to make fur-ther risk management decisions”. As such, the owner can’t hold the Renovator to the hazard standards unless they’ve specified such in their contract agreement.
DWT and clearance must be conducted by an individual who has completed the EPA Dust Sam-pling Technician certification, a one day course presented by an EPA accredited trainer. A Reno-vator who has completed the DWT certification can conduct post renovation evaluation on his/her own projects. EPA certified Inspectors and a Risk Assessors can also conduct serve this role.
Now let’s take a look at the actual sampling process. Here’s the common Post Renovation Sampling Protocol for Dust Wipe Testing and Clearance:
1. If there is more than one room, hallway, or stairwell within the work area, the following samples must be collected:
A) One windowsill sample, one window trough sample, and one floor sample within each room, hallway, or stairwell in the work area. If there are more than four rooms, hallways, or stairwells within the work area, only four rooms, hallways, or stairwells must be sampled.
(B) One floor sample adjacent to the work area, but not in an area that has been cleaned.
2. If the work area is a single room, hallway, stairwell, or smaller area, the following samples must be collected:
(A) One windowsill sample, one window trough sample, and one floor sample.
(B) One floor sample adjacent to the work area, but not in an area that has been cleaned.
3. No window sill or trough samples must be collected if there are no windows in the work area.
All dust wipe samples must be mailed or otherwise transmitted to the laboratory within 1 business day of the date that they are col-lected. Dust wipe samples must be analyzed by a National Lead Laboratory Approval Program (NLLAP) laboratory. The renovation firm must provide, within 3 days of the date the renovation firm receives the report, a copy of the clearance or dust wipe testing report to:
(1) The owner of the building; and, if differ-ent, an adult occupant of the residential dwell-ing, if the renovation took place within a resi-dential dwelling, or an adult representative of the child.
Notably, an additional provision exists for clearance only that provides for surfaces in poor condition when the renovation firm did not specifically agree to refinish in the renovation contract. Per EPA the renovation firm may stop re-cleaning and re-testing after the second failed dust wipe test on that surface.
EpA Abatement ClearanceEPA requirements for clearance after abate-
ment date back to 2001. The regulation stipu-lates that an inspector or risk assessor collect wipe samples as follows:
“After conducting an abatement with con-tainment between abated and unabated areas, one dust sample shall be taken from one interior window sill and from one window trough (if pres-ent) and one dust sample shall be taken from the floors of each of no less than four rooms, hall-ways or stairwells within the containment area. In addition, one dust sample shall be taken from the floor outside the containment area. If there are less than four rooms, hallways or stairwells within the containment area, then all rooms, hallways or stairwells shall be sampled.
After conducting abatement with no contain-ment, two dust samples shall be taken from each of no less than four rooms, hallways or stairwells in the residential dwelling or child-occupied fa-cility. One dust sample shall be taken from one interior window sill and window trough (if pres-ent) and one dust sample shall be taken from the floor of each room, hallway or stairwell selected. If there are less than four rooms, hallways or stairwells within the residential dwelling or child-occupied facility then all rooms, hallways or stairwells shall be sampled.”
Consideration for sample collection, labora-tory qualifications and reporting are pretty simi-lar to renovation. The significant differences are found between the number of samples that are expected for renovation versus abatement. The proposed renovation regulation specify that samples are collected at 3 locations (i.e. floor, sill and trough) in up to four rooms while the abate-ment regulation specifies samples from one sill and one trough as well as floor samples from the floors of no less than four rooms.
The minimum number of samples for a reno-vation (in a four room project) is therefore 13 plus one blank. The minimum number of sam-ples for a similar abatement project is 6, plus the blank. Table 1 details the dust evaluation option by work classification:

HUD ClearancesHUD follows the EPA standard for abatement,
which makes historical sense when you think about what protocol existed when the HUD 1012 requirements took effect. The EPA abatement standards have served as the only “official” tech-nique to date and the protocol has made its way into most of the HUD documentation used for hazard control work in Federally assisted housing. In fact, and to be more precise, the HUD clearance protocol leans toward the EPA uncontained abate-ment standard and away from the EPA contained abatement protocol.
SummaryImplementation of the RRP dust sampling re-
quirements promises to be messy, especially if the proposed Dust Wipe Testing provision makes it to the Final Rule. Existing EPA, HUDA and state and city-specific protocol are not consistent with the proposed rule. Lead hazard control professionals and laboratories involved in dust wipe analysis are faced with the challenge of meeting specific, overlapping requirements.
Further, the absence of an expectation to demonstrate that work area was lead safe after most renovations will surely disappoint those who bemoaned the subjectivity of cleaning verifi-cation cards. It should also come as a unpleasant surprise to those who been limiting (and pricing) HUD or EPA clearances based on 8 or 9 samples.

Our thoughts and prayers go out to him and his family.

Variance, Success!The Variance bill HF52 allowing cit-
ies to grant variances again, after the Minnesota Supreme Court ruled on the Krummanacher case last year interpret-ing the law to mean an undue hardship needed to be proven in order for a city to grant a variance. Millions of dollars of member projects were held up by the interpretation and BAM is happy to re-port the bill was passed and signed into law opening the doors for cities to grant variances once again. BAM has received a grant from the Legislative-Citizen Com-mission on Minnesota Resources in partnership with the Center for Energy and Environment to design and teach a free two-hour class for licensed con-tractors on how to market air sealing to consumers with one hour of contractor continuing education energy credit.
For the class BAM has developed a series of videos to help sell and explain air sealing to consumers. The videos include infrared camera shots, an ex-planation of what air sealing is, why it’s important, and the importance of using a qualified contractor. Ice dams are used as a visual symptom of a house that needs air sealing. The will provide infor-mation on Minnesota utility rebates in your region and a free demonstration of
infrared cameras and spray foam.Twelve classes are being taught
throughout the state in June.Pre-registration is required and

click on “Fixing Ice Dams – Minnesota Style, A Free 2-Hour Energy Class” un-der the events section. NAHB-Support Bill (Miller Bill) Introduced to Help Restore Flow of Credit to Housing
NAHB reported this week in their e-newsletter Nation’s Building News that a bill was introduced May 5 by Reps. Gary Miller (R-Calif.), Brad Miller (D-N.C.) and 29 other cosponsors with the goal of addressing the severe credit crunch for acquisition, development and construction (AD&C) financing.
According to NAHB, H.R. 1755 would address specific regulatory obsta-cles to the credit needs of the nation’s home builders and “is a significant ad-vancement in NAHB’s overall strategy to help members find the credit they need to move forward with new or ex-isting projects.”

I was asked to participate on NAHB’s Exploring Alternatives for the Future Task Force which was formed in response to the Lang Report (view the
report here: http://www.bamn.org/im-ages/pamspov/lang-report.pdf). The task force was charged with “leading the review and further consideration of or-ganizational and governance changes to better position NAHB for the future.”
It’s been an interesting road work-ing on the task force. While two board meetings have come and gone since the Lang Report came out and no discus-sion has happened on the board floor regarding change, the task force recom-mendations could provide a platform to begin that discussion for board action. I firmly believe all NAHB members need to be committed to discussing change and letting the democratic process oc-cur.

heavens, the weather was less than desireable. I scheduled the picnic for June 1st, knowing it was going to be nice. It was beautiful! We had decent attendance, but I think a few people for-
got. I know we cooked about 40 burgers and there were salads, fruit and desserts galore. No one went home hungry. It was really nice that two of our scholar-ship recipients were at the picnic. They seemed to enjoy themselves and were very happy for the $1000 scholarship they will receive after their first semes-ter. Todd Bjerstad, the BAM President, was pleased with the turnout for our pic-nic and had a good time meeting every-one. We also gave out five $10 gas cards on a drawing.
We will be holding an OSHA 10 HOUR CONSTRUCTION OUTREACH TRAIN-ING ON June 27th and 28th. See the article in the newsletter. I will also be holding the last RRP class on June 24th, providing I have the 20 minimum. If you haven’t taken the class and want to, call the office for a reservation form for ei-ther class.
The office will be closed on Mondays and Fridays, for the summer, but you can always reach me on my cell phone - 218-849-1037.

BAM Receives Grant to provide Free Energy Class in June From the Desk of pam perri….

arships to students going into the Building Trades. Over $100,000.00 has been raised and most of the scholarship funds have been given out.
We are looking for volunteers to serve on this committee so it may con-tinue to raise funds. Please call Brenda Eidenschink at 218-847-1946 or Sharon at 218-847-0699 for more details.
We will be holding the OSHA 10 hour class for workers covered by OSHA 29 CFR 1926 standards. I understand OSHA will be doing more scouting for violations and they may also be checking on RRP certifications. Forms have gone out in the mail, but if you did not receive them, let me know.
In the tough economy that we are in, it is more important than ever, to use the services of our members. Our associates help keep the association going, with their membership, their volunteering on our projects, the Home Show and other events. Likewise for the associates, if they need the use of a contractor or can recommend a contractor, it is impor-tant for them to use one of our fellow members. If you are using services from non-mem-bers, encourage them to become a member of our association. This benefits everyone!!!

Greetings!May was a busy month and went by quickly!
We have had our final meeting of the season which was at Dunton Locks County Park. Sha-ron ordered a perfect evening! We will start up the general meetings again in the fall. There is a lot of things going on at BAM with legislation and code issues right now. You should be getting e-mails with updates as well as some information in the back of this newsletter.
This month’s focus on “tools for recruitment” will be on how LRBA gives back to our community. We have a strong commitment to give back to our local community. The Lake Region Builders Association, along with West Central Initiative, established the LRBA Scholarship Foundation which annually provides scholarships to graduating high school seniors who plan to continue study in a construction-related field. LRBA and its members have contributed to numerous community ser-vice projects over the years including the gazebo at the city park, the box office at the Historic Holmes Theatre, the Tom Oswald House project, the 2005 Habitat for Humanity house, baseball dugouts and ramps for Hospice to name a few. These types of projects show that we care about our community. Not only is volunteer work good karma, it shows that we are committed and trustworthy. With our busy schedules sometimes it is difficult to take on these types of projects. As a LRBA member you can be involved without having to shoulder all of the responsibility your-self. If everybody pitches in a little bit, we can make a huge difference!
In conclusion, being an LRBA member gives you an excellent oppor-tunity to get involved in something of a greater cause, while having a lot of fun! Yet another great benefit of membership to share with prospec-tive members. Until next time… enjoy the warm weather and be safe!
