We have plenty of room inside if the weather doesn’t cooperate. It will be a fun time. Come early and watch the Trap Shoot, which starts at 9:00 a.m. with lunch to follow. There will be a short meeting time when the awards are given out for the “best of the best” shooters.

ing Saturday (May 4th) as I'm writing this is the annual picnic and fun shoot. I hope everyone is able to make it and enjoy them-selves. This is the last general meeting of the season until the summer is over. You only need one person to actually work for your company to be on the company team and compete. This is a fun event, and after 6 years we have a bit of a ri-valry between some of the teams. We'll see if B & M Electric can keep it together and defend their championship after beating the Green's Plumb-ing team for the first time last year.... Good luck to all the shooters!

Well, hopefully summer is starting soon! Sharon and I will be starting to do some packing here at the office to move into our new home at I’ll Tile & Stone. The office will be moved, by August,

hopefully. Be prepared, we might be calling on you to help with the move. We will need some trucks to haul the furniture, filing cabinets etc.

May’s picnic will be the last meeting for the summer. We will be begin fall meetings in September.

As I am sure you probably know, Brenda is the new Executive Officer for the Association. She is doing a great job and will be an asset to the LRBA. I will continue to work

one or two days a week until fall when we start gearing up for the winter and spring events. I need to figure out a new job title … I guess it will be Public Relations Director. That sounds like it would keep me busy. I will still be doing the newsletter and the dozens of emails we get from NAHB and other things. There are some good things coming up for the 2013 – 2014 meetings; we now have all of our speakers scheduled for the next year. Check out the calendar to see what is being planned for the coming year. Have a great Summer!!

bAM board Holds First Meeting of 2013BAM held its first Board Meeting of 2013 on March

20th and this year’s directors were officially inducted by Minnesota’s NAHB State Representative, Kathe Ostrom, of CN Ostrom & Son. Legal Action Fund One of the most important decisions made by the

Board on March 20th was to approve - by unanimous voice vote - a Legal Action Fund assessment for 2013 in the amount of $35 per member. The legal battles that face the industry are immense and it is important to have the ability to fight to protect the industry.

This year it’s especially important because of the sprinkler mandate currently in the Minnesota version of the International Residential Code with a 4,500 square foot trigger. Fighting the mandate through the state's established code adoption process has led us to the next step of forcing an administrative law judge hearing on the matter. BAM's Legal Action Fund has approved hiring Joe Springer, an attorney from Fredrikson & Byron. BAM has also retained the services of Karen Linner, BAM's former Director of Codes and Research, and Steve Orlowski, an expert from NAHB.

The BAM Legal Action Fund has a near perfect record in the cases it has fought. Copies of those cases and other legal resources, such as white papers and form con-tracts, can be downloaded from the BAM members-only website at www.bamn.org/legislation.

Because of the importance of a statewide legal fund, in a position to fight for the industry in a timely manner, the Legal Action Committee has discussed and intends to put together a long-term funding plan to present to the BAM Board of Directors later this year. As discussed at the Board meeting, possible options include funding out of a combination of dues, fundraisers, partial assessments, and/or a combination of all three. If you have any sugges-tions and or comments on how you would like to see it funded please let us know. Finally, we know this mid-year assessment puts a burden on budgeting cycles and want to have the 2014 proposal done this fall to alleviate the local

association budget concerns for 2014.Government Relations Rick Kot, of RA Kot Homes, is BAM’s 2013 Govern-

ment Relations Committee Chair and he gave a report on BAM’s work this year at the Minnesota Capitol. Halfway through the legislative session nearly 3,000 bills had been introduced. Several indemnification and risk transfer bills were introduced that are not favorable for the industry. BAM has been working to fix the problems.

Governor Dayton’s business-to-business sales tax proposal was dropped as a result of the improvement in the State’s financial situation, and a $750 million bonding bill has been proposed. Kot reported that BAM is attacking the fire sprinkler issue from every angle and has been ag-gressively working to find a solution to effectively remove a government mandate of fire sprinklers in single-family homes in Minnesota.

Code Update The Department of Labor and Industry’s draft codes

have not yet been published in the State Register. Publica-tion in the Register will provide the statement of need and reasonable (SONAR) and is the necessary step to kick-start the administrative law judge (ALJ) hearing process. Mike Paradise, of Bigelow Homes, and member of the BAM Ex-ecutive Committee is the chair of the BAM Fire Sprinkler ALJ Task Force. This group has been meeting regularly to discuss and vet testimony, witnesses, and arguments.

bAM Insurance program BAM is finalizing the contract with endorsed insur-

ance program Corporate Four. Corporate Four has an out-standing risk management program, and with a finalized contract the program will be promoted widely throughout the state.

bAM-pAC Remi Stone, BAM’s Executive Vice President, stated

that PAC gives BAM credibility at the Capitol. Keith Kyl-mala, of Kylmala Truss, is BAM’s Past President and 2013 chair of the BAM-PAC Committee. The goal is to have $30,000 in the PAC by the 2014 election cycle. BAM-PAC will have a plan put together to generate those funds and will report to the BAM Board at the June or September meeting.

What It Takes To Be a Home Builder

What does bAM membership do for you?

A home builder guides dozens of skilled artisans and professionals, including carpenters, architects, engineers, plumbers, electricians, painters and landscapers. The builder must understand all of the home’s complex systems and know enough about each contractor’s trade in order to coordinate this skilled team to build and sell a quality product. Some home builders develop the land on which the homes are built. They look at a piece of land to determine whether it complies with zoning regulations, local planning laws and environmental restrictions, and whether it is suitable for development. The home builder studies the lot’s topography, searching for rock outcroppings, shallow depth bedrock, shallow groundwater, natural drainage sources and dense vegetation. Landscaping options and erosion control also have to be considered. Once a builder determines that a site is suitable for construction, they must navigate the permitting process.Home builders serve as liaisons with their communities and local government officials. They research and study local building codes to determine what can be built in a given location. Building

codes govern building, plumbing, heating and air conditioning, electrical systems and fire safety.Once the permits are obtained, the builder will prepare the site and select how the home will be situated on it. The home builder then oversees the entire construction process, which includes—but is certainly not limited to—laying the foundation; erecting the framing, roofing and siding; building the walls; and installing the plumbing, heating and electrical work.The local building department will inspect the construction site for code violations throughout the home’s construction. But a professional home builder will make certain the home meets both code and warranty guidelines long before and after the officials show up. Once the house is finished, the builder informs the appropriate municipal departments that it is ready for final inspection and the approval that the home is safe for its new owners to move in.Professional home builders strive to deliver a home that will make their customers happy. To meet this objective, they act as public

relations professionals. The builder will discuss the construction process and building schedule with the buyer, and plan times when the buyer can tour the building site and ask questions about the status of their new home.Home builders are also businesspeople who establish a network of reliable and quality materials suppliers and trade contractors with whom they conduct business on a regular basis.Home builders are schedulers and record keepers. They must think on their feet, keep complex construction timelines and tackle multiple tasks simultaneously in order to keep the construction process moving forward and ensure the home is completed on schedule.Builders must wear many hats in order to deliver a home where the new owners can hang their own hats, raise a family and build lifelong memories.

With the Occupational Safety and Health Administration (OSHA) set to begin enforcing new, more stringent fall protection regulations on March 15, NAHB is working diligently to ensure that builders are fully aware of the updated policy and know how to comply with the new rules in order to eliminate workplace hazards, boost worker safety and avoid costly fines.

Since September 2011, contractors have been required to comply fully with the Compliance Guidance for Residential Construction. However, at NAHB’s urging, OSHA implemented a phase-in period to provide home builders with more time to learn about the rule and get compliance assistance from OSHA. During this period, the federal agency’s temporary enforcement measures allowed for penalty reductions and lengthened abatement times if a contractor was inspected.

The phase-in period has been extended twice since the Compliance Guidance went into effect, and it is unlikely that OSHA will extend it again.

What does this mean for builders and their subcontractors?

Roofing contractors must use guardrails, personal fall arrest systems (harnesses and lanyards), or safety nets on all roofs with slopes exceeding 4-in-12 when working six feet or more above a lower level.

All other trade contractors must use guardrails or personal fall arrest systems (harnesses and lanyards), or safety nets when the height from one elevation to another is greater than six feet, unless employers can demonstrate that it isn’t feasible to use those fall protection systems or using the systems creates a greater hazard. In those cases, contractors must develop a fall protection plan that utilizes alternative fall protection measures.

All fall protection plans must be in writing and be site specific. However, the written plan developed for repeated use for a particular style/model home will be considered site specific.

The use of fall protection plans is limited to residential construction, and the home must be constructed using traditional wood frame construction materials and methods -- although

the limited use of structural steel in a predominantly wood-framed home, such as a steel I-beam to help support wood framing, does not disqualify a structure from being considered residential construction.

NAHB strongly believes that the current fall protection standard can be improved and should be amended to acknowledge the unique nature of residential construction.

In a Dec. 10 letter and petition to OSHA officials, NAHB asked the agency to reopen the rulemaking and try again to create a rule that applies to home building, rather than continuing to impose a one-size-fits-all approach that is better suited to commercial contracting.

NAHB has provided its members an array of resources — including a sample fall protection plan, a residential fall protection fact sheet and an OSHA fall protection webinar replay — to help builders with this transition at www.nahb.org/fallprotection.

OSHA has also recently posted Spanish versions of its residential fall protection fact sheets online.

Federal vs. State programsComplicating the situation for

some members, not all states follow the federal OSHA programs. Many builders/members are operating in approved state plans and will need to check with their local administrators for further information on the fall protection standards applicable in their states.

Well, hopefully summer is starting soon! Sharon and I will be starting to do some packing here at the office to move into our new home at I’ll Tile & Stone. The office will be moved, by August,

hopefully. Be prepared, we might be calling on you to help with the move. We will need some trucks to haul the furniture, filing cabinets etc.

May’s picnic will be the last meeting for the summer. We will be begin fall meetings in September.

As I am sure you probably know, Brenda is the new Executive Officer for the Association. She is doing a great job and will be an asset to the LRBA. I will continue to work

one or two days a week until fall when we start gearing up for the winter and spring events. I need to figure out a new job title … I guess it will be Public Relations Director. That sounds like it would keep me busy. I will still be doing the newsletter and the dozens of emails we get from NAHB and other things. There are some good things coming up for the 2013 – 2014 meetings; we now have all of our speakers scheduled for the next year. Check out the calendar to see what is being planned for the coming year. Have a great Summer!!

bAM board Holds First Meeting of 2013BAM held its first Board Meeting of 2013 on March

20th and this year’s directors were officially inducted by Minnesota’s NAHB State Representative, Kathe Ostrom, of CN Ostrom & Son. Legal Action Fund One of the most important decisions made by the

Board on March 20th was to approve - by unanimous voice vote - a Legal Action Fund assessment for 2013 in the amount of $35 per member. The legal battles that face the industry are immense and it is important to have the ability to fight to protect the industry.

This year it’s especially important because of the sprinkler mandate currently in the Minnesota version of the International Residential Code with a 4,500 square foot trigger. Fighting the mandate through the state's established code adoption process has led us to the next step of forcing an administrative law judge hearing on the matter. BAM's Legal Action Fund has approved hiring Joe Springer, an attorney from Fredrikson & Byron. BAM has also retained the services of Karen Linner, BAM's former Director of Codes and Research, and Steve Orlowski, an expert from NAHB.

The BAM Legal Action Fund has a near perfect record in the cases it has fought. Copies of those cases and other legal resources, such as white papers and form con-tracts, can be downloaded from the BAM members-only website at www.bamn.org/legislation.

Because of the importance of a statewide legal fund, in a position to fight for the industry in a timely manner, the Legal Action Committee has discussed and intends to put together a long-term funding plan to present to the BAM Board of Directors later this year. As discussed at the Board meeting, possible options include funding out of a combination of dues, fundraisers, partial assessments, and/or a combination of all three. If you have any sugges-tions and or comments on how you would like to see it funded please let us know. Finally, we know this mid-year assessment puts a burden on budgeting cycles and want to have the 2014 proposal done this fall to alleviate the local

association budget concerns for 2014.Government Relations Rick Kot, of RA Kot Homes, is BAM’s 2013 Govern-

ment Relations Committee Chair and he gave a report on BAM’s work this year at the Minnesota Capitol. Halfway through the legislative session nearly 3,000 bills had been introduced. Several indemnification and risk transfer bills were introduced that are not favorable for the industry. BAM has been working to fix the problems.

Governor Dayton’s business-to-business sales tax proposal was dropped as a result of the improvement in the State’s financial situation, and a $750 million bonding bill has been proposed. Kot reported that BAM is attacking the fire sprinkler issue from every angle and has been ag-gressively working to find a solution to effectively remove a government mandate of fire sprinklers in single-family homes in Minnesota.

Code Update The Department of Labor and Industry’s draft codes

have not yet been published in the State Register. Publica-tion in the Register will provide the statement of need and reasonable (SONAR) and is the necessary step to kick-start the administrative law judge (ALJ) hearing process. Mike Paradise, of Bigelow Homes, and member of the BAM Ex-ecutive Committee is the chair of the BAM Fire Sprinkler ALJ Task Force. This group has been meeting regularly to discuss and vet testimony, witnesses, and arguments.

bAM Insurance program BAM is finalizing the contract with endorsed insur-

ance program Corporate Four. Corporate Four has an out-standing risk management program, and with a finalized contract the program will be promoted widely throughout the state.

bAM-pAC Remi Stone, BAM’s Executive Vice President, stated

that PAC gives BAM credibility at the Capitol. Keith Kyl-mala, of Kylmala Truss, is BAM’s Past President and 2013 chair of the BAM-PAC Committee. The goal is to have $30,000 in the PAC by the 2014 election cycle. BAM-PAC will have a plan put together to generate those funds and will report to the BAM Board at the June or September meeting.

What It Takes To Be a Home Builder

What does bAM membership do for you?

A home builder guides dozens of skilled artisans and professionals, including carpenters, architects, engineers, plumbers, electricians, painters and landscapers. The builder must understand all of the home’s complex systems and know enough about each contractor’s trade in order to coordinate this skilled team to build and sell a quality product. Some home builders develop the land on which the homes are built. They look at a piece of land to determine whether it complies with zoning regulations, local planning laws and environmental restrictions, and whether it is suitable for development. The home builder studies the lot’s topography, searching for rock outcroppings, shallow depth bedrock, shallow groundwater, natural drainage sources and dense vegetation. Landscaping options and erosion control also have to be considered. Once a builder determines that a site is suitable for construction, they must navigate the permitting process.Home builders serve as liaisons with their communities and local government officials. They research and study local building codes to determine what can be built in a given location. Building

codes govern building, plumbing, heating and air conditioning, electrical systems and fire safety.Once the permits are obtained, the builder will prepare the site and select how the home will be situated on it. The home builder then oversees the entire construction process, which includes—but is certainly not limited to—laying the foundation; erecting the framing, roofing and siding; building the walls; and installing the plumbing, heating and electrical work.The local building department will inspect the construction site for code violations throughout the home’s construction. But a professional home builder will make certain the home meets both code and warranty guidelines long before and after the officials show up. Once the house is finished, the builder informs the appropriate municipal departments that it is ready for final inspection and the approval that the home is safe for its new owners to move in.Professional home builders strive to deliver a home that will make their customers happy. To meet this objective, they act as public

relations professionals. The builder will discuss the construction process and building schedule with the buyer, and plan times when the buyer can tour the building site and ask questions about the status of their new home.Home builders are also businesspeople who establish a network of reliable and quality materials suppliers and trade contractors with whom they conduct business on a regular basis.Home builders are schedulers and record keepers. They must think on their feet, keep complex construction timelines and tackle multiple tasks simultaneously in order to keep the construction process moving forward and ensure the home is completed on schedule.Builders must wear many hats in order to deliver a home where the new owners can hang their own hats, raise a family and build lifelong memories.

OUR NEXT MEETING IS SCHEDULED FOR SATURDAY MAY 4, 2013, at the Sportsman’s Club on Highway 10 E. Detroit Lakes. We will be holding our annual Trap Shoot with our May picnic. We have plenty of room inside if the weather doesn’t cooperate. It will be a fun time. Come early and watch the Trap Shoot, which starts at 9:00 a.m. with lunch to follow. There will be a short meeting time when the awards are given out for the “best of the best” shooters.

Heating contractors and plumbers can only do low voltage; floor installers cannot do any wiring for under flooring, and concrete workers cannot do any wiring. It’s a good thing to be kept up on codes.

Greetings Everyone, Hey everyone! The upcom-

ing Saturday (May 4th) as I'm writing this is the annual picnic and fun shoot. I hope everyone is able to make it and enjoy them-selves. This is the last general meeting of the season until the summer is over. You only need one person to actually work for your company to be on the company team and compete. This is a fun event, and after 6 years we have a bit of a ri-valry between some of the teams.
