Greetings Everyone, I’d like to thank everyone for

all their help to make our Build-ers’ Show the success it was! If you didn’t help with the show, we’ll press-gang your cooperation next year…. Just kidding, but serious-ly, many people put in many hours to make this happen, and any help would be much appreciated. I went down to the March BAM board meeting, the significant issues are the $35 dollar per member as-sessment to the association itself for the legal ac-tion fund (I voted against it), and NAHB is increas-ing its dues by $16 per member per year for 3 years. March was a busy month for Sharon and I with the Home & Sport Show. We had 64 builder’s /vendors, 17 sport vendors and 198 silent auction items. The attendance for the show was quite good on Saturday with a 725 adults and Sunday was 419 (a little down from

previous years). Overall, though, the weekend was up a couple of hundred people from last year. The Operation Kidsafe Program went well with 295 children fingerprinted. We want to say a special thank you to all of our sponsors of the Kidsafe program. If you see them make sure to say thank you! Sponsors of the Kidsafe program included Arvig, Bell State Bank, Detroit Lakes Shriners, Don Tietz Construction, Detroit Lakes Lions Club, Detroit Lakes Breakfast Rotary Club, Frazee Lions Club, Foltz Builders & Nereson’s. This would not have been possible without these sponsors.

Special thank you to all of our home show committee, Jason Coley, Ed & Linda Jutz, Perry Nodsle and especially Al Clark and Chad Zitzow for chairing this show.

The silent auction ladies did an outstanding job this year; so far collected over $8000. Thank you to Ellie Francis, Linda Jutz , Catie Herman and Tammy Heille for working several hours on phone calling and working that weekend to conduct the auction. We also want to thank all the members who came that weekend to help set up and tear down and work the auction. This show is a group event and takes a lot of man-power. So “Kudo’s” to all involved.

This month’s meeting we will host Lowell Bradbury and Dean Hunter to speak on the topic of what subcontractors (other than electricians) can and cannot do concerning wiring and also maintaining proper clearance away electrical components and warming tile cable.

On to next month, when we will be having our jointly held Spring Picnic and Trap Shoot. Mark Saturday May 4th on your calendars. If you are interested in having a team in the trap shoot, please let us know at the office. More information will follow.

Approaching the halfway mark of session, between the House of Representatives and State Senate, Minnesota Legislators have introduced nearly 3,000 bills. Among them are a series of bills that impact, to varying degrees, the home building and remodel-ing industry. BAM members' lobbying team is actively engaged at the Capitol to make sure that this seemingly never ending supply of "helpful" policy ideas are stopped, advanced, or mitigated.

The month of March brings Policy Committee deadlines and a small degree of relief from the onslaught of proposals and hearings within the Legislature and all the dodging and weaving among interest groups. After committee deadlines we will sprint to the end of session, slated for May 20th, working on big tax and spending bills, floor amendments, and final negotiations on pro-posals that remain "alive". Below is a sampling of the bills BAM is bird-dogging for its members.

Risk Transfer / Anti-Indemnification Bills: These bills are designed to make certain construction contract indemnification and insurance clauses void and unenforceable. The MSA contains a blanket prohibition on these contract provisions, while the design professional bill carves out an exception for engineers and architects.

Minnesota Subcontractors Association (MSA) Bill HF644 (Atkins – DFL, Inver Grove Heights) / SF561 (Jensen - DFL, Owatonna)

Design Professionals Bill HF446 (Hortman – DFL, Brooklyn Park) / SF388 (Carlson – DFL, Eagan)

Retainage: Subcontractors are pursuing legislation to regu-late the manner in which retainage is held and paid to include retainage held in interest bearing accounts and be paid within 30 days upon substantial completion of work. Retainage – HF952 (Sundun – DFL, Esko) / SF841 (Dahle – DFL, Northfield)

Radon Bills: These bills intend to raise public awareness of radon's potential health impacts. The Minnesota Department of Health's Healthy Homes bill requires good faith disclosures at closing, while "Janet's" law requires radon testing prior to com-pleting residential real estate transactions.

Healthy Homes Radon Disclosure Requirement HF662 (Laine – DFL, Columbia Heights) / SF887 (Marty – DFL, Roseville)

Janet’s Law HF816 (Anderson, P. – R, Starbuck) Street Improvement Districts: Cities continue to look to

the Legislature to grant them authority for new revenue streams. These bills allow cities the ability to create districts within their jurisdictions to capture transportation impact "fees" from new and existing properties to pay for improvements linked to their capital improvement plans.

Street Improvement Districts SF607 (Carlson – DFL, Eagan) / HF745 (Erhardt – DFL, Edina) and

HF931 (Erhardt – DFL, Edina) / SF891 (Dibble – DFL, Min-neapolis)

Non-wage Payments to Construction Workers Reporting to Department of Revenue: Carpenter Union interests are pursuing legislation to require all payments in excess of $600 to be reported to the Department of Revenue. This effort is rooted in the on-

going effort to address "misclassified employees". Non-wage Payments SF863 (Dziezdic – DFL, Minneapolis) /

HF1062 (Anzelc – DFL, Balsam Township) B2B Sales Tax: Governor Dayton's comprehensive tax

reform plan continues to be discussed the the Capitol. Included in the proposal is a overall rate reduction and expansion of sales tax to cover services, although indications from the Governor's office is that construction services are not intended to be included in the proposal. The final bill will not be complete until mid-May 2013.

Governor's Tax Bill HF677 (Lenczewski – DFL, Minneapolis) / SF552 (Skoe – DFL, Clearbrook)

Statute of Repose: This bill extends the period of repose from 12 years to 14 years. Although the repose period is moved out to 14 years, it does not impact the industry's warranty period nor does it change the statute of limitations.

Statute of Repose HF450 (Atkins – DFL, Inver Grove Heights) / SF392 (Latz – DFL, St. Louis Park)

Contractor Recovery Fund: The Department of Labor and Industry's Housekeeping Bill contains a one-word change to the Contractor Recovery Fund. By deleting the word "person" and inserting the word "individual" the Department is intending to deter corporations from tapping into the fund and reserving it for actual homeowners.

DLI Housekeeping Bill HF578 (Isaacson – DFL, Shoreview) / SF656 (Schmit – DFL, Red Wing)

Sprinkler Mandate: A stand-alone bill has been introduced that prohibits sprinkler suppression systems from being man-dated for installation in new single-family construction.

HF499 (Fitzsimmons – R, Albertville) Park Dedication Fee: A bill to allow Hennepin County

Parks Board to collect a park dedication fee has been amended with language to require all park dedication fees to be set through a fair market value standard.

Homeowner's Insurance Coverage / Residential Contract-ing Claims: This bill, pursued by the exterior contractors, requires insurance companies to disclose to homeowners when certain coverages are dropped from their policies, allows homeowners to communicate with contractors, and requires insurance companies to include contractors in payments made on a claim where the contractor is engaged for the work.

HO Insurance Coverage HF930 (Nelson – DFL, Brooklyn Park) / SF722 (Pederson – R, St. Cloud)

Extended Producer Responsibility: This bill requires carpet, paint and battery manufacturers, distributors and retailer to establish "product stewardship programs" for the life-cycle of their products.

EPP HF865 (Sundin – DFL, Esko) / SF639 (Eaton – DFL, Brooklyn Center)

Radon Awareness ActSenator John Marty (DFL-Minneapolis) and Representa-

tive Carolyn Laine (DFL-Columbia Heights) introduced legisla-tion that would require sellers of homes to disclose information about radon, outlining the gas’s health risks and also encourag-ing buyers to conduct a radon test before closing on or moving into a house. Paul Eger, chief lobbyist for the Minnesota As-sociation of Realtors, said state rules already require sellers to disclose factors that could affect someone living in the home. They include environmental concerns, such as radon, mold, lead paint or asbestos. The bill would require a more-clear dis-closure by the sellers about whether they have ever tested for radon. This Just In... A This Week at BAM Special Report Friday March 8, 2013

Today, Governor Dayton announced he will be dropping his proposal to extend the sale tax to business-to-business transactions. Thank you to all of you that came to the BAM Builder Day at the Capitol and talked to your legislators about our concern with the B2B sales tax proposal.

Gov. Mark Dayton said Friday morning, while speaking at the TwinWest Chamber of Commerce in St. Louis Park, he heard a lot of concerns about his proposal to add sales tax to the services business sell each other. Dayton said he will not include the tax plan in the revised budget he will release next week.

BAM will be watching to see what happens next - Monday March 11th the Governor plans to release his revised budget. But for now... there's one more reason to be thankful it's Friday!

N.A.T.E. (North American Technical Excellence) certification/testing was held at MN State in March. N.A.T.E. testing represents real-world, working knowledge of heating, ventilation, air conditioning and refrigeration systems. Modern Heating and Plumbing had four technicians pass licensing/testing.

With the Occupational Safety and Health Administration (OSHA) set to begin enforcing new, more stringent fall protection regulations on March 15, NAHB is working diligently to ensure that builders are fully aware of the updated policy and know how to comply with the new rules in order to eliminate workplace hazards, boost worker safety and avoid costly fines.

Since September 2011, contractors have been required to comply fully with the Compliance Guidance for Residential Construction. However, at NAHB’s urging, OSHA implemented a phase-in period to provide home builders with more time to learn about the rule and get compliance assistance from OSHA. During this period, the federal agency’s temporary enforcement measures allowed for penalty reductions and lengthened abatement times if a contractor was inspected.

The phase-in period has been extended twice since the Compliance Guidance went into effect, and it is unlikely that OSHA will extend it again.

What does this mean for builders and their subcontractors? Roofing contractors must use guardrails, personal fall arrest

systems (harnesses and lanyards), or safety nets on all roofs with

slopes exceeding 4-in-12 when working six feet or more above a lower level.

All other trade contractors must use guardrails or personal fall arrest systems (harnesses and lanyards), or safety nets when the height from one elevation to another is greater than six feet, unless employers can demonstrate that it isn’t feasible to use those fall protection systems or using the systems creates a greater hazard. In those cases, contractors must develop a fall protection plan that utilizes alternative fall protection measures.

All fall protection plans must be in writing and be site specific. However, the written plan developed for repeated use for a particular style/model home will be considered site specific.

The use of fall protection plans is limited to residential construction, and the home must be constructed using traditional wood frame construction materials and methods -- although the limited use of structural steel in a predominantly wood-framed home, such as a steel I-beam to help support wood framing, does not disqualify a structure from being considered residential construction.

NAHB strongly believes that the current fall protection standard can be improved and should be amended to acknowledge the unique

nature of residential construction. In a Dec. 10 letter and petition to OSHA officials, NAHB asked

the agency to reopen the rulemaking and try again to create a rule that applies to home building, rather than continuing to impose a one-size-fits-all approach that is better suited to commercial contracting.

NAHB has provided its members an array of resources — including a sample fall protection plan, a residential fall protection fact sheet and an OSHA fall protection webinar replay — to help builders with this transition at www.nahb.org/fallprotection.

OSHA has also recently posted Spanish versions of its residential fall protection fact sheets online.

Federal vs. State ProgramsComplicating the situation for some members, not all states

follow the federal OSHA programs. Many builders/members are operating in approved state plans and will need to check with their local administrators for further information on the fall protection standards applicable in their states.

Last week BAM held its first Board Meeting of 2013. I want to thank each BAM Director for stepping up and being a part of this year's association leadership. To see the Board Members from your local visit: www.bamn.org/about/bam-board-of-directors.

One of the most important decisions made by the Board last week was to approve - by unanimous voice vote - a Legal Action Fund assessment for 2013 in the amount of $35. BAM's core focus is three-fold - the legislative arena, the regulatory arena, and the third battleground is the courts. The legal battles that face the industry are immense and it is important to have the ability to fight to protect the industry.

This is an especially important year because of the sprinkler mandate currently in the pending Minnesota version of the International Residential Code with a 4,500 square foot trigger. This mandate is not needed because new homes are the safest, sprinkler systems are expensive to install with a range of $4,000 to $16,000 per home price tag (the range including a municipal or well water system), and ultimately the installation of an indoor fire sprinkler system should be a homeowner choice - not a government mandate.

Fighting the mandate through the state's established code adoption process has led us to the next step of forcing an administrative law judge hearing on the matter. BAM's Legal Action Fund has approved hiring Joe Springer, an attorney from Fredrikson & Byron. BAM has also retained the services of Karen Linner, BAM's former Director of Codes and Research, and Steve Orlowski, an expert from NAHB.

The BAM Legal Action Fund has a near perfect record in the cases it has fought. Most recently the LAC won the City of St. Paul case, which stopped the City from overriding the state building code with its egress window policy. If the issue had not been fought by the industry, the City of St. Paul would have successfully overridden the state building code and set a precedent for other cities to force builders to comply with egress window requirements above and beyond the code through policy or ordinance. It is a significant win for the industry.

In addition to the City of St. Paul case, the BAM Legal Action Fund has successfully addressed other statewide legal issues including: zoning ordinance, plat approval, takings claims, TID charges and special assessments, 60-day rule, eminent domain, water intrusion, and construction defects. One of the industry's first collective fights was on over-collection of building permit fees that our local association (WCBA) has used numerous times when the city has tried to raise building permit fee’s. This lawsuit, spearheaded by the original legal action fund (The "Fat Fifty") and argued by Joe Springer for the industry challenged the amount of fees collected by the City of Shakopee. As a result of the litigation, the parties entered into a detailed consent decree that resulted in the City reducing building permit fees for residential properties by between 69 and 91 percent. The consent decree contains requirements for all cities to provide greater transparency when setting fees. Copies of those cases and other legal resources, such as white papers and form contracts, can be downloaded from the BAM members-only website at www.bamn.org/legislation.

It's important to have a Legal Action Fund with a viable war chest and in a position to fight for the industry in a timely manner. Because of the importance of a statewide legal fund, the Legal Action Committee has discussed and intends to put together a long-term funding plan to present to the BAM Board of Directors later this year. As discussed at the Board meeting, possible options include funding out of a combination of dues, fundraisers, partial assessments and or combination of all three. If you have any suggestions and or comments on how you would like to see it funded please let us know. Finally, we know this mid-year assessment puts a burden on budgeting cycles and want to have the 2014 proposal done this fall to alleviate the local association budget concerns for 2014.

In addition to the City of St. Paul case, the BAM Legal Action Fund has successfully addressed other statewide legal issues including: zoning ordinance, plat approval, takings claims, TID charges and special assessments, 60-day rule, eminent domain, water intrusion, and construction defects. One of the industry's first collective fights was on over-collection of building permit fees that our local association (WCBA) has used numerous times when the city has tried to raise building permit fee’s. This lawsuit, spearheaded by the original legal action fund (The "Fat Fifty") and argued by Joe Springer for the industry challenged the amount of fees collected by the City of Shakopee. As a result of the litigation, the parties entered into a detailed consent decree that resulted in the City reducing building permit fees for residential properties by between 69 and 91 percent. The consent decree contains requirements for all cities to provide greater transparency when setting fees. Copies of those cases and other legal resources, such as white papers and form contracts, can be downloaded from the BAM members-only website at www.bamn.org/legislation.

It's important to have a Legal Action Fund with a viable war chest and in a position to fight for the industry in a timely manner. Because of the importance of a statewide legal fund, the Legal Action Committee has discussed and intends to put together a long-term funding plan to present to the BAM Board of Directors later this year. As discussed at the Board meeting, possible options include funding out of a combination of dues, fundraisers, partial assessments and or combination of all three. If you have any suggestions and or comments on how you would like to see it funded please let us know. Finally, we know this mid-year assessment puts a burden on budgeting cycles and want to have the 2014 proposal done this fall to alleviate the local association budget concerns for 2014.

N.A.T.E. (North American Technical Excellence) certification/testing was held at MN State in March. N.A.T.E. testing represents real-world, working knowledge of heating, ventilation, air conditioning and refrigeration systems. Modern Heating and Plumbing had four technicians pass licensing/testing.

With the Occupational Safety and Health Administration (OSHA) set to begin enforcing new, more stringent fall protection regulations on March 15, NAHB is working diligently to ensure that builders are fully aware of the updated policy and know how to comply with the new rules in order to eliminate workplace hazards, boost worker safety and avoid costly fines.

Since September 2011, contractors have been required to comply fully with the Compliance Guidance for Residential Construction. However, at NAHB’s urging, OSHA implemented a phase-in period to provide home builders with more time to learn about the rule and get compliance assistance from OSHA. During this period, the federal agency’s temporary enforcement measures allowed for penalty reductions and lengthened abatement times if a contractor was inspected.

The phase-in period has been extended twice since the Compliance Guidance went into effect, and it is unlikely that OSHA will extend it again.

What does this mean for builders and their subcontractors? Roofing contractors must use guardrails, personal fall arrest

systems (harnesses and lanyards), or safety nets on all roofs with

slopes exceeding 4-in-12 when working six feet or more above a lower level.

All other trade contractors must use guardrails or personal fall arrest systems (harnesses and lanyards), or safety nets when the height from one elevation to another is greater than six feet, unless employers can demonstrate that it isn’t feasible to use those fall protection systems or using the systems creates a greater hazard. In those cases, contractors must develop a fall protection plan that utilizes alternative fall protection measures.

All fall protection plans must be in writing and be site specific. However, the written plan developed for repeated use for a particular style/model home will be considered site specific.

The use of fall protection plans is limited to residential construction, and the home must be constructed using traditional wood frame construction materials and methods -- although the limited use of structural steel in a predominantly wood-framed home, such as a steel I-beam to help support wood framing, does not disqualify a structure from being considered residential construction.

NAHB strongly believes that the current fall protection standard can be improved and should be amended to acknowledge the unique

nature of residential construction. In a Dec. 10 letter and petition to OSHA officials, NAHB asked

the agency to reopen the rulemaking and try again to create a rule that applies to home building, rather than continuing to impose a one-size-fits-all approach that is better suited to commercial contracting.

NAHB has provided its members an array of resources — including a sample fall protection plan, a residential fall protection fact sheet and an OSHA fall protection webinar replay — to help builders with this transition at www.nahb.org/fallprotection.

OSHA has also recently posted Spanish versions of its residential fall protection fact sheets online.

Federal vs. State ProgramsComplicating the situation for some members, not all states

follow the federal OSHA programs. Many builders/members are operating in approved state plans and will need to check with their local administrators for further information on the fall protection standards applicable in their states.

March was a busy month for Sharon and I with the Home & Sport Show. We had 64 builder’s /vendors, 17 sport vendors and 198 silent auction items. The attendance for the show was quite good on Saturday with a 725 adults and Sunday was 419 (a little down from

previous years). Overall, though, the weekend was up a couple of hundred people from last year. The Operation Kidsafe Program went well with 295 children fingerprinted. We want to say a special thank you to all of our sponsors of the Kidsafe program. If you see them make sure to say thank you! Approaching the halfway mark of session, between the House of Representatives and State Senate, Minnesota Legislators have introduced nearly 3,000 bills. Among them are a series of bills that impact, to varying degrees, the home building and remodel-ing industry. BAM members' lobbying team is actively engaged at the Capitol to make sure that this seemingly never ending supply of "helpful" policy ideas are stopped, advanced, or mitigated.

The month of March brings Policy Committee deadlines and a small degree of relief from the onslaught of proposals and hearings within the Legislature and all the dodging and weaving among interest groups. After committee deadlines we will sprint to the end of session, slated for May 20th, working on big tax and spending bills, floor amendments, and final negotiations on pro-posals that remain "alive". Below is a sampling of the bills BAM is bird-dogging for its members.

Risk Transfer / Anti-Indemnification Bills: These bills are designed to make certain construction contract indemnification and insurance clauses void and unenforceable. The MSA contains a blanket prohibition on these contract provisions, while the design professional bill carves out an exception for engineers and architects.

Radon Bills: These bills intend to raise public awareness of radon's potential health impacts. The Minnesota Department of Health's Healthy Homes bill requires good faith disclosures at closing, while "Janet's" law requires radon testing prior to com-pleting residential real estate transactions.

reform plan continues to be discussed the the Capitol. Included in the proposal is a overall rate reduction and expansion of sales tax to cover services, although indications from the Governor's office is that construction services are not intended to be included in the proposal. The final bill will not be complete until mid-May 2013.

Statute of Repose: This bill extends the period of repose from 12 years to 14 years. Although the repose period is moved out to 14 years, it does not impact the industry's warranty period nor does it change the statute of limitations.

Contractor Recovery Fund: The Department of Labor and Industry's Housekeeping Bill contains a one-word change to the Contractor Recovery Fund. By deleting the word "person" and inserting the word "individual" the Department is intending to deter corporations from tapping into the fund and reserving it for actual homeowners.

Sprinkler Mandate: A stand-alone bill has been introduced that prohibits sprinkler suppression systems from being man-dated for installation in new single-family construction.

Parks Board to collect a park dedication fee has been amended with language to require all park dedication fees to be set through a fair market value standard.

Homeowner's Insurance Coverage / Residential Contract-ing Claims: This bill, pursued by the exterior contractors, requires insurance companies to disclose to homeowners when certain coverages are dropped from their policies, allows homeowners to communicate with contractors, and requires insurance companies to include contractors in payments made on a claim where the contractor is engaged for the work.

Extended Producer Responsibility: This bill requires carpet, paint and battery manufacturers, distributors and retailer to establish "product stewardship programs" for the life-cycle of their products.

Radon Awareness ActSenator John Marty (DFL-Minneapolis) and Representa-

tive Carolyn Laine (DFL-Columbia Heights) introduced legisla-tion that would require sellers of homes to disclose information about radon, outlining the gas’s health risks and also encourag-ing buyers to conduct a radon test before closing on or moving into a house. Paul Eger, chief lobbyist for the Minnesota As-sociation of Realtors, said state rules already require sellers to disclose factors that could affect someone living in the home. They include environmental concerns, such as radon, mold, lead paint or asbestos. The bill would require a more-clear dis-closure by the sellers about whether they have ever tested for radon. Today, Governor Dayton announced he will be dropping his proposal to extend the sale tax to business-to-business transactions. Thank you to all of you that came to the BAM Builder Day at the Capitol and talked to your legislators about our concern with the B2B sales tax proposal.

Gov. Mark Dayton said Friday morning, while speaking at the TwinWest Chamber of Commerce in St. Louis Park, he heard a lot of concerns about his proposal to add sales tax to the services business sell each other. Dayton said he will not include the tax plan in the revised budget he will release next week.

BAM will be watching to see what happens next - Monday March 11th the Governor plans to release his revised budget. But for now... there's one more reason to be thankful it's Friday!

Week of March 4, 2013….75 Days or so Done – 75 Days or so To GoYour Mid-Session Report

Approaching the halfway mark of session, between the House of Representatives and State Senate, Minnesota Legis-lators have introduced nearly 3,000 bills. Among them are a series of bills that impact to varying degrees the home build-ing and remodeling industry. BAM members' lobbying team is actively engaged at the Capitol to make sure that this seem-ingly never ending supply of "helpful" policy ideas are stopped, advanced or mitigated.

The month of March brings Policy Committee deadlines and a small degree of relief from the onslaught of proposals and hearings within the Legislature and all the dodging and weav-ing among interest groups. After committee deadlines we will sprint to the end of session, slated for May 20th, working on big tax and spending bills, floor amendments, and final negotia-tions on proposals that remain "alive". Below is a sampling of the bills BAM is bird-dogging for its members.

Risk Transfer / Anti-Indemnification Bills: These bills are designed to make certain construction contract indem-nification and insurance clauses void and unenforceable. The MSA contains a blanket prohibition on these contract provi-sions, while the design professional bill carves out an exception for engineers and architects.

Design Professionals Bill HF446 (Hortman – DFL, Brook-lyn Park) / SF388 (Carlson – DFL, Eagan)

Retainage: Subcontractors are pursuing legislation to regulate the manner in which retainage is held and paid to in-clude retainage held in interest bearing accounts and be paid within 30 days upon substantial completion of work.

Radon Bills: These bills intend to raise public awareness of radon's potential health impacts. The Minnesota Depart-

ment of Health's Healthy Homes bill requires good faith disclo-sures at closing, while "Janet's" law requires radon testing prior to completing residential real estate transactions.

Janet’s Law HF816 (Anderson, P. – R, Starbuck)Street Improvement Districts: Cities continue to look

to the Legislature to grant them authority for new revenue streams. These bills allow cities the ability to create districts within their jurisdictions to capture transportation impact "fees" from new and existing properties to pay for improve-ments linked to their capital improvement plans.

Non-wage Payments to Construction Workers Re-porting to Department of Revenue: Carpenter Union in-terests are pursuing legislation to require all payments in excess of $600 to be reported to the Department of Revenue. This effort is rooted in the on-going effort to address "misclassified employees".

B2B Sales Tax: Governor Dayton's comprehensive tax reform plan continues to be discussed the the Capitol. Included in the proposal is a overall rate reduction and expansion of sales tax to cover services, although indications from the Governor's office is that construction services are not intended to be in-cluded in the proposal. The final bill will not be complete until mid-May 2013.

Statute of Repose: This bill extends the period of repose from 12 years to 14 years. Although the repose period is moved out to 14 years, it does not impact the industry's warranty pe-riod nor does it change the statute of limitations.

Contractor Recovery Fund: The Department of Labor and Industry's Housekeeping Bill contains a one-word change to the Contractor Recovery Fund. By deleting the word "person" and inserting the word "individual" the Department is intend-ing to deter corporations from tapping into the fund and re-serving it for actual homeowners.

Sprinkler Mandate: A stand-alone bill has been intro-duced that prohibits sprinkler suppression systems from being mandated for installation in new single-family construction.

HF499 (Fitzsimmons – R, Albertville)Park Dedication Fee: A bill to allow Hennepin County

Parks Board to collect a park dedication fee has been amend-ed with language to require all park dedication fees to be set through a fair market value standard.

Homeowner's Insurance Coverage / Residential Contracting Claims: This bill, pursued by the exterior con-tractors, requires insurance companies to disclose to home-owners when certain coverages are dropped from their policies, allows homeowners to communicate with contractors, and re-quires insurance companies to include contractors in payments made on a claim where the contractor is engaged for the work.

Extended Producer Responsibility: This bill requires carpet, paint and battery manufacturers, distributors and retail-er to establish "product stewardship programs" for the life-cycle of their products.

Greetings Everyone, I’d like to thank everyone for

all their help to make our Build-ers’ Show the success it was! If you didn’t help with the show, we’ll press-gang your cooperation next year…. Just kidding, but serious-ly, many people put in many hours to make this happen, and any help would be much appreciated. I went down to the March BAM board meeting, the significant issues are the $35 dollar per member as-sessment to the association itself for the legal ac-tion fund (I voted against it), and NAHB is increas-ing its dues by $16 per member per year for 3 years. We’re still fighting the fire sprinkler issue. I hope everyone has a great season ahead and see you at the next meeting!
