“to promote professionalism and to educate members and

consumers on legislative issues, while fostering

cooperative relationships for all stakeholders”

We've previously reported to you about the Occupa-tional Safety and Health Administration's (OSHA's) deci-sion to implement a three-month phase-in period for new fall protection guidelines that became effective on June 15 (read more here). As builders focus on understanding the new rules in this area, they are also reminded that OSHA has indicated that it is stepping up enforcement measures on a number of fronts and that it has taken steps to in-crease the dollar amount of all penalties through adminis-trative enhancements to its penalty policy.

Builders and trade contractors should pay particular

attention to the following hazards, which are the top 10 most frequently-cited OSHA standards for construction in 2010 (with the reference to the specific OSHA standard in parentheses):

1. Scaffolding, general requirements, construction (29 CFR 1926.451)

2. Fall Protection, construction (29 CFR 1926.501) 3. Ladders, construction (29 CFR 1926.1053) 4. Fall Protection, training requirements

(29 CFR 1926.503) 5. Hazard Communication Standard

(29 CFR 1910.1200) 6. General Safety & Health Provisions

(29 CFR 1926.20) 7. Head Protection (29 CFR 1926.100)

8. Aerial Lifts (29 CFR 1926.453) 9. Eye & Face Protection (29 CFR 1926.102) 10. Excavation, specific excavation

requirements (29 CFR 1926.651)There are a few simple things that builders and trade

contractors should do to be prepared for OSHA inspec-tions. These include:

• Conducting an assessment to identify and correct safety hazards on the job site.

• Conducting appropriate safety training for employees — such as fall protection and ladder safety training.

• Updating records and making sure they are readily available.

• Understanding the OSHA inspection process. You should know that NAHB has multiple resources

that are designed to assist you in achieving compliance with OSHA rules and regulations. For example, we have versatile handbooks and videos that present key safety issues where builders and workers can reduce accidents and injuries. These are available via BuilderBooks at this link. Also, NAHB's Construction Safety & OSHA web page contains compliance assistance information at www.nahb.org/safety. You can also download a free overview of the OSHA inspection process and obtain OSHA assistance at this link. For more information, contact Rob Matuga or Marcus Odorizzi at 800-368-5242, x8507 or x8590.

Monday June 6, 2011 the National Asso-ciation of Home Builders (NAHB) reported that new OSHA residential fall protection guide-lines would be taking effect June 16, 2011 after NAHB worked to get an extension on the effec-tive date. Last December, OSHA rescinded its Interim Fall Protection Compliance Guidelines for Residential Construction (STD 03-00-001 – STD 3-0.1A), in place since 1995.

Effective Thursday June 16, 2011 employ-ers must provide conventional fall protection systems to protect all employees engaged in residential construction activities six feet or more above a lower level. The new Compliance Guidance for Residential Construction will re-quire employers to follow OSHA’s Subpart M Fall Protection regulation, which allows the flex-ibility of using a written fall protection plan and alternative fall protection procedures when con-ventional systems are either infeasible or using them creates greater hazard.

NAHB Construction Safety and Health Com-mittee Chairman Dean Mon met May 26 with Dr. David Michaels, assistant secretary of labor for OSHA, regarding the change in fall protec-tion requirements. During the meeting, OSHA reiterated that it is holding firm on its decision to retain the June 16 deadline, which will now require residential construction employers to follow OSHA’s Subpart M Fall Protection Regu-lation.

In chairman Mon’s memo to NAHB Senior Officers, Mon indicated that OSHA has com-mitted to drafting and sending a letter to NAHB members to alleviate their concerns over pos-sible enforcement actions, as well as agreeing to work with NAHB to identify those instances where the use of conventional fall protection may be deemed infeasible or create a greater hazard and to correct and improve OSHA’s guid-ance documents on residential fall protection. Here’s an excerpt from Mon’s memo:

“Despite NAHB’s arguments that addi-tional time was needed because neither our members nor OSHA is certain of how to com-

ply with the fall protection rule, OSHA’s staff are not prepared to consistently implement or enforce the rule, and once OSHA determines what must be done, more training is needed so that home builders and trade contractors understand what they are supposed to do to comply, OSHA held firm on its decision to retain the June 16 deadline. Dr. Michaels explained that because the Interim Fall Pro-tection Guidelines were rescinded to protect workers from fall hazards, any delay in imple-mentation would unnecessarily leave workers at risk. He also reasoned that since OSHA al-ready had provided more lead-in time than is standard and at least fifteen OSHA state plan states have been operating without the interim guidelines since 1995, additional lead-in time was unnecessary.

Although OSHA rejected our request for an extension, Dr. Michaels did commit to providing enforcement flexibility and working with NAHB to develop guidance and compli-ance materials. Specifically, OSHA commit-ted to drafting and sending a letter to NAHB members to alleviate their concerns over pos-sible enforcement actions. Dr. Michaels sug-gested the letter would acknowledge that: 1) if employers are showing a “good faith” effort to comply with the fall protection regulations, they will not be cited under OSHA’s fall protec-tion regulation; 2) any builder participating in or requesting an OSHA on-site consultation will be exempt from OSHA inspections; and 3) Dr. Michaels, the OSHA Administrator, would personally review any citation that builders believe are not warranted. Dr. Michaels sug-gested that a similar letter would also be sent to the OSHA regional offices and shared with the compliance and enforcement personnel.

For more information and resources on Fall Protection, visit www.nahb.org/fallprotection. You will be required to log-in as an NAHB mem-ber.

my ViewSharon Westerholm, EO June is over, but I

don’t feel like we had any summer yet. The nicest day was the day we had our picnic on June 1st. The newslet-ter is a little late this month, so I hope you

had an awesome 4th of July. As I am writing this, it is a scorcher outside with the heat index to reach 102 to-day. We tried to hold another Reno-vate, Repair and Paint class in July, but only 6 people signed up. We sent out a lot of mailers with our OSHA 10 class. The only ones that signed up for this were members. OSHA could have a field day in this area, if they get back to work, and I understand they are going to be in the rural areas quite a bit.

Things have quieted down at the of-fice right now, but there always seems to be a lot to do.

On July 11th I will be at the Me-nards Contractor Luncheons with a table to promote the LRBA. After that there are no events scheduled , unless we can get enough people that want the RRP class to do another in August.

If you have not brought in any busi-ness cards for our card racks, please do so. Occasionally I get people com-ing in to get them that need a proj-ect.

The office will be closed on Monday and Friday’s for the summer, but you can always reach me on my cell phone - 218-849-1037.

In the tough economy that we are in, it is more important than ever, to use the services of our members. Our associates help keep the association going, with their membership, their volunteering on our projects, the Home Show and other events. Likewise for the associates, if they need the use of a contractor or can recommend a contractor, it is important for them to use one of our fel-low members. help wAntedWe are in need of 5-6 volun-

teers to help out with the Silent Auction for the Home Builders Show that is held in March. Each year we raise money for scholarships for high school students going into the build-ing trades. This is a very im-portant event for our organi-zation to continue. In the past one to two people have been doing the organizing for the items needed at the auction,

but it has grown so much that we need more volunteers.

Marga and Skye have done a great job the last two years, but need to step down from orga-nizing the auction. We would need people to start on this in January. This does not have to be a member themselves, as it can also be a spouse. Many of the people setting up and working at the end are spouses of members.

PLEASE CONSIDER BEING PART OF THIS VERY IMPOR-TANT COMMITTEE. We do not want to stop giving out scholarships because of lack of volunteers.

Call Brenda Eidenschink or Sharon at 847-0699. We would like to know we have volun-teers lined up within the next six weeks.

At a special news conference on June 22, Senators Johnny Isakson (R-Ga.), and Kay Hagan (D-N.C.) and Representa-tives John Campbell (R-Calif.) and Brad Sherman (D-Calif.) expressed the views of a group of more than 325 of their colleagues in Congress when they publicly called on federal regulators to revise a proposed 20% down payment require-ment for Qualified Residential Mortgages (QRM). The law-makers were joined by members of the Coalition for Sensible Housing Policy, which includes more than 40 consumer and industry groups as well as NAHB; our CEO, Jerry Howard, was on hand for the press conference along with representa-tives from our coalition partners. Noting that the proposed rule would shut out responsible home buyers and further cripple the housing market, the lawmakers in attendance said that in promulgating the rule, regulators "did not fol-low our legislative intent" in crafting the Dodd-Frank Act. "We don't have a down payment problem in this country, but rather an underwriting problem," said Senator Isakson. Sen. Hagan also noted that "The proposed rule runs counter to the commonsense, bipartisan provision that Senators Landrieu, Isakson and I included in the Dodd-Frank Act last year. This misinterpretation of our intent could unnecessarily slow the housing market's recovery, and prevent well-qualified, mid-dle class families from securing an affordable mortgage. We are urging regulators to go back to the drafting table." Coinciding with the news conference, joint letters from 44 Senators and 282 members of the House of Representa-tives have been sent to the banking regulators. Senate co-signers called the proposed QRM regulation "unduly narrow" and reiterated that "well underwritten loans, regardless of down payment, were not the cause of the mortgage crisis." Meanwhile, House members argued that the proposed QRM "would particularly harm first-time and minority home buy-ers," and urged regulators "to consider lower down payment loans that have mortgage insurance as constituting a QRM." Federal regulators recently extended the comment period for the 20% down payment rule until Aug. 1, 2011. (Note: The most important thing to remember over the next several weeks is that the information i’m sharing with you is not mine. it belongs to the countless members i have watched over the years be very successful with their own hba involve-ment. association Maximization will only help you if you understand and believe in what i’'m sharing with you in these series of posts. in the beginning my reasons for joining were different from what i’m asking you to have faith in now. Know that i’m speaking with you from the collected knowledge that 25 plus years as a member has given me. That is an extreme advantage if we were having a debate. in this case it is you who will have an extreme ad-vantage because you will learn to maximize your investment in the hba and this will help you with business opportunities that you would not normally have if you weren’t a member.

The first part to association Maximization is re-ally a refresher. Most members tend to forget the real reason for being a member. While there are other reasons that might seem more important to different individuals, and those other reasons have benefits as well, the core mission of the home build-ers association is the following in part 1)

To understand why you’re a member of the home builders association (hba) i first have to begin with the question “what is the hba and why is it important?” in the simplest of statements the hba is an organization that has two types of mem-berships; builder and associate. The builder mem-ber is made up of multiple disciplines; single fam-ily home builder, multi-family home builder (i.e. apartments), mixed use builder, commercial builder

and remodeler. The associate member likewise has many disciplines that fall under three categories; supplier, service provider and trade contractor. The staff of the hba is an executive officer (possibly one or more staff members as well) with the volunteer leadership consisting of a board of directors and a group of officers, with a president as the lead, all of whom are members of the hba. There are bylaws that dictate the make up of the board of directors and officers with the majority of both groups con-sisting of builder members. The president, and the officer positions that form the leadership ladder, are builders. What is the reason for the majority being builders? This is a builders association. The build-ers are the ones who are actually building. builders are the ones who are dealing with all the “red tape” that comes with construction projects. associates are individuals or companies that take part in the construction or renovation process.

The leading purpose of any hba is for the or-ganization to protect the interests of the building industry through the efforts of staff and engaged members. What are the threats that the hba is pro-tecting us from? The list is too long and too confus-ing (government is involved after all) but, through legislation and regulatory mandates, the efforts of the hba help keep the members’ business doors open. ask your executive officer for a list of hba led initiatives and how each could impact building. builders have a great understanding of the regula-tions and legislation that could impact their busi-ness. associates understand to a certain degree but the most important point for an associate to understand; if ‘it’ affects builders ‘it’ will affect as-sociates.

That is the “what and why.” it’s very important for all to understand that, while there are other reasons for joining the hba, the pure benefit is for the opportunity to keep working as a builder which provides the associate opportunities to sell. “if ‘it’ affects builders ‘it’ will affect associates” is just not a catch phrase it is reality. That is why, when you write your check or have it charged to a credit card, the money you spend for a membership should be viewed as an investment. if you plan on continu-ing your career in the building industry, or if any of part of your business is connected to the building industry, you need the support of an hba.

When you join the hba you gain access to your state home builders association and The National association of home builders. Your membership investment is a three-in-one investment. The state hba and Nahb both have the same core mission as the local hba. The power of state and Nahb comes from the local hbas because all memberships are local. You can’t be just a member of Nahb and you can’t go solo outside Nahb and the local hba with a direct state membership. You join a local hba first, the rest are part of your membership investment.

Next week we will talk about the local hba and its interaction with the state hba and Nahb. Most states have a state association, but for those of you who might not have one, don’t worry; this doesn’t affect your membership with Nahb.

“your Hometown Quality builder & Remodelers”

in corner? You see, the voice of one brings the awareness, the passion of that one brings the aware-ness into a victory for all. i can't stress this enough; advocacy + unity = success.

The National association is similar in structure to the local and state hbas. They have officers, all of which are builders, and a board of directors made up primarily of builders. This group of volunteers, just like the make up of state utilizing local members, is made up of leaders from all the United states and puerto Rico. These leaders are from your very local. Nahb has, as do some state hbas and local hbas, an executive board which is much smaller than the actual national board. a lot of work is done through the executive board delivering a more streamlined "product" to the national board for guidance and di-rection then action.

The purpose of Nahb? Unity, which brings the power of one voice through out the country, more importantly and with pinpoint accuracy, within the halls of congress.

Meaning......... aDvOcacY.One more time; advocacy + unity = success. as you can see from last week through today,

your membership brings you the most important action which safeguards your career, your business, your family and your employees families; the ability to work with and help educate the legislators, at the local, state and national levels, that could derail your chosen profession. by your self you couldn't even be-gin to make a progress let alone an impact. it would be like trying to raise the ocean levels with an occa-sional drop of water.

The "voice of One, power of Three" mechanism, if embraced by you, is an exciting ride and the cost of a membership should be viewed as the cost of doing business in the most regulated industry in america. That cost becomes an investment for you personally due to the efforts, on your behalf, of the actively engaged leaders and professional staff, at all three levels,

i left out, in these first two posts, committees which are a necessary and a vital part of the struc-ture of all three levels of your hba membership. Next week's posts will we will talk about starting your in-volvement and committees will be included with what their purpose(s) mean to you and the hba.

"Voice of One, Power of Three"Association Maximization Part 2: "Voice of One, Power of Three"

(Note: Most states have a state hba with only a handful being the exception. This post will concentrate on the three level membership but understand the ben-efits of Nahb will work with the two level membership.)

last week's post focused on the simple structure and lead purpose of the local hba. This post will focus how your state hba and Nahb interact with your local's membership bringing the "voice of one, power of three" concept into reality.

Your state hba's lead purpose is advocacy. advocacy is a description i have used for the local and now the state. i will use it again when we discuss Nahb because successful advocacy comes when members, builders aND associates, are united in the protection and growth of the building industry. The state hba is similar in structure to the local hba; officers lead by a builder member in the role of president and a board of directors made up primarily of builder members. This group of volunteers are individuals from each of the local hbas throughout the state which gives the entire state's perspective on initiatives designed for the benefit of the majority of all members. a take on the old saying "you can please some of the people some of the time, but you can`t please all the people all of the time" is very appropriate here. in some cases, members at the state level will disagree on certain steps or direction. it's OK to disagree but if you do, have a

valid argument! The idea is that once a vote on a course of action has taken place the board members should now unite behind the cause and bring unity to the local hbas.

The reason for a state hba? i described it as advocacy but advocacy only works with the power of one voice. individually, members can visit their state legisla-tors but they are viewed as individuals. but the collective working as one brings attention and the passionate collective brings change. some locals opt to work separately from their state when it comes to lobbying but, as right as they think they are, they are wrong by not working as one for the entire building industry. coalitions only work if all parties agree to work together. The state hba is, in a way, a coalition of local hbas.

The state hba also offers a great way to expand your social capital and busi-ness contacts. Through state hba involvement you will also learn about the building industry from an entire state's perspective with that perspective includ-ing, but not limited to, possible trends ei ther legislatively and/or regulatory, that could be found in different sections of the state. "That's a northern territory issue has no impact on the coast" would be an example of one part of the state being under "attack" while other sections don't view it as a threat. One day your area will be under "attack;" wouldn't it be fantastic to have the whole state

One day your area will be under "attack;" wouldn't it be fantastic to have the whole state

help wAntedWe are in need of 5-6 volun-

teers to help out with the Silent Auction for the Home Builders Show that is held in March.

Dr. Michaels sug-gested that a similar letter would also be sent to the OSHA regional offices and shared with the compliance and enforcement personnel.

my ViewSharon Westerholm, EO June is over, but I

don’t feel like we had any summer yet.

If you are using services from non-members, encourage them to become a member of our association. This benefits everyone!!!

Well hello summer! I’m guessing about the time you read this we

will all be getting ready for some kind of 4th of July celebration. Personally one of my favorites! Whether it’s time at the lake, hanging out with family & friends, fishing or just sitting back and enjoying the sunshine we are truly lucky to be live in such a beautiful place… until January that is! This month’s focus on “tools for recruitment” will be on Knowledge and how you can profit from the building expertise and business experience of other industry profes-sionals. LRBA provides ample opportunities to discuss building trends and exchange ideas. The best way to experience this is to come to the monthly meetings. Sharon and the education committee do a superb job at bringing quality education to our meetings as well as expos and other types of seminars. Another way is to simply get out and network with other members. You have some of the best tradesman in the building industry right in front of you at the meetings. I’m sure most of them would be more than happy to share ideas. Yet another great benefit of membership to share with prospective members. Happy 4th of July! Enjoy and be safe out there.

Committee updAtes: membership CommitteeThe membership committee met to discuss an opportunity for sponsor-

ship of a special drawing held at each meeting. We are looking for 1 busi-ness to sponsor $360.00, or two businesses to sponsor at $180.00. These sponsors will have their name on a banner at the meetings, their logos and name on the LRBA website, and in the monthly newsletter in return.

If sponsorships are obtained, all members would have their name in a drawing. Each time they attend a meeting they would add their name once again. At the end of evening, a drawing would be held for $40.00. If the members name is drawn and they are not there, the $40.00 not given

The Lake Region Builders held an OSHA 10 HOUR safety class on Monday and Tuesday the 27th & 28th of June. Over 450 letters went out to contractors, plus many other business’s and only 14 members attended. It was a very informative and important class to attend as OSHA will be geared for Safety inspections this summer, so you need to be prepared. You must have your Safety Manual up to date - Most important, you must HAVE a Safety Manual. It needs to be set up for quality not quantity. You must have a written Safety and Health Program, with specific actions designed to reduce incidences.

If you are on a scaffold working more than 10 feet off the ground, you must be harnessed. Multiple employer rule - not only will the general on a construction site be cited, but the employee caught not using Safe Work Practices will also be cited. Excavation Safety also had additional requirements. The electrical portion covered several things including flashback.

Previously I wrote that there was a 90 day grace period to have everything in place, however that is the Federal mandate. Minne-sota OSHA is not following the 90 day grace period, although, if there is a government shutdown, they will not be out until the shut-down is over.

Speaking of the shutdown, the Department of Labor and Indus-try will also be shut down, for everything, which includes electrical inspections, administration of exams for licensure.

Anything that is not related to incidents of imminent danger or catastrophic situations.
