way! The Home Show and silent auction was a great success, thanks to Sharon and all of our committee members and volunteers. We had nice weather and lots of traffic. Our March meeting was at the speak easy. Our speakers were Sandy Gunderson and Matt Dretsch from the Becker County Environmental Ser-vices, as well as, Roger Rolf from the MN pollution control agency. They had lots of good information to share! We have two new members so far this month, and one for April! Let’s keep that momentum going!

Last month I discussed the Legislation issues that BAM, our state associa-tion watch dogs and how being a member supports that fight. This month I will discuss how membership provides credibility to its members. Consumers are intimidated when it comes to hiring contractors and buying from vendors. It is even more challenging in the home building industry. There are so many choices out there. To top it off there are a whole slew of bad choices to be made. Some people just simply understand the value of industry membership and will do business with companies that are giving back to their industry. Good standing membership in just about any type of legitimate organization requires a back ground check and references. They will also revoke the mem-bership of any member who would use unethical business practices. Many consumers look to industry organizations when trying to make these determi-nations about a contractor or vendor who they plan to do business with. Your membership puts you in the trustworthy eye of the consumer.

If you’re here, it’s safe to assume you are committed to the building industry. Many of us have lost much the past few years. Some have literally lost every-thing. Yet here we are. Makes you wonder why, doesn’t it? Well, I have some theo-ries. Some are here to network; some to learn. Others are here to promote their business and sell product. But given that the construction industry isn’t as lucra-tive as it used to be, I believe most of us are here for two main reasons.

Camaraderie. How many times have we heard a football player say the rea-son for their last season or two is not the money – it’s the locker room? My wife, Denise has asked me why I don’t do more with my friends. Fact is I spend time with my friends every day. It just so happens a high percentage of my friends are in the construction industry. No-body understands, accepts, encourages or challenges me more than the friends I’ve made the past 25 years in the con-struction industry. The simple fact is if we are to stay in this industry, we need each other.

You Care. The second reason, I be-lieve you’re here is because you care. You care about your family and your liveli-hood. You care about what happens to your friends in the industry. You care about what happens to the construction industry because it is noble and worth preserving and protecting. Most of you care about your customers and the millions of Americans who still believe home ownership is the foundation of the American Dream.

Because I believe you care and want to succeed I would like to challenge you with five thoughts as we enter 2011.

1. Don’t assume things will return to “normal.” What we experienced a few years ago was not normal. Waiting, wishing or assuming that things will return to the way it was is not healthy. Tom Brokaw made an interesting obser-vation in his documentary The Greatest Generation, stating that after World War II America had no competition. In the years following the war we built 80% of the world’s automobiles, the average

American income doubled pre-to-post ware, making the average American in-come 15 times more than the rest of the world. No wonder we prospered!

In today’s worldwide economy, America faces competition unlike any time in history. We cannot afford to make the mistake of assuming the “good, old days” will return simply be-cause history repeats itself. Richard Nixon said, “Nostalgia is not a crimeas long as people don’t act on it.” It’s time to move on in our thinking.

2. Do your homework. The most intellectually enlightening time in my career was in 2007. I spent the year working for a company that does market research for the residential construction industry. Part of my duties included physically driving through 100’s of neighborhoods counting the inventory of lots, homes under construction, mod-el and spec homes and researching plat approvals at county recorder offices in the 13-county area. I was dumbfounded at the excess inventory in the market-place. Even more astounding was how much information is available to help anyone in the construction business know their clients, what they need, and how much they’ll spend to get it. So chal-lenge number two is: do your homework and discipline yourself to plan your busi-ness activities around facts not habits.

3. Stay engaged in your builders asso-ciation. I can’t tell you how many people I meet in the construction industry have no idea what is going on in the world of politics and building codes and how it affects them. Some are aware of what’s happening, but believe nothing can be done about issues like warranty law or mandatory sprinkler systems. That’s just not true! BAM has become a force at the capitol and we need to keep it that way. I often say, “If we’re not at the table we are on the menu,” and it’s true! (This is one historical pattern that does repeat itself). Remember those who make the decisions impacting your business rarely know as much as you do, so when we lobby, we educate. We absolutely need to stay at the table.

4. Think outside the box. The movie, The Patriot (2000), with Mel Gibson is a war-hero’s story in which he comes home to find former troops building him a new house. I noticed the struc-ture looked similar to a modern-day construction site, but the movie was set in the late 1700’s. What product do you own that is still built the same way it was 220 years ago?

I am convinced we don’t build the way we do because of consumer prefer-ence. This may sound crazy, but I don’t recall any customers demanding I place 2x6 studs every 16 inches. But they have always demanded style, sustainability and above all, value. Are there better ways to meet the demands of future ho-meowners? I believe there are and only those of us that figure them out will be here in 10 years. Afraid of change? Bet-ter get over it! Big box stores and big companies will figure out a way to meet the demand if we don’t.

5. Don’t give up. Winston Churchill said, “The pessimist sees the difficul-ties associated with every opportunity and the optimist sees the opportunity with every difficulty.” Let’s face it. It can be hard to see the light at the end of the tunnel, but we know it’s there. Industry experts tell us we are at or near the bottom, and I think that’s true. As a youngster, I recall jumping a little too far off the dock into the lake at my grandmother’s cabin. I struggled to get back and remember the sense of relief in feeling the bottom of the lake. It wasn’t solid, but it was there and I think that’s where our industry is now, beginning to feel the bottom. So, don’t give up!

Thank you to the Board of Direc-tors for placing your trust in me, and this year’s executive committee, to lead in 2011. Most of all, thank you for ap-proving a budget that allows us to keep this great organization moving forward. I anticipate great things!

As of February 1, 2011, municipalities will be required to verify lead certification prior to issuing building permits for pre-1978 residential properties. Yes, you read that correctly. If you do not have your Environmental Protection Agency (EPA) Renovation, Repair and Painting (RRP) Firm Certification, you will not be issued a building permit by municipalities which enforce Minnesota State Building Codes. Com-pliance made direct:

1. Bring proof of the residential property’s date of original construction.

2. Bring a color copy of your firm’s certificate with you.

3. Bring lead-based paint testing results, if you plan to claim an exemption.

4. Enable the permit office personnel to confirm that you are EPA compliant by having your required documentation readily available.

5. Display your firm certificate logo and identifica-tion number on your trucks, business cards, proposals, contracts and letterhead.

6. Stand out and be visible – Say, “Yes, I am a Certi-fied Firm.”

Do not delay your jobs – Be pro-active.According to 326B.106, 2010 Minnesota Statute

subdivisions 13 and 14, residential building contrac-tors, residential remodelers, manufactured home in-stallers, and residential roofers must be EPA certified firms in order to receive a building permit prior to be-ginning their job. Unless the pre-1978 property can be documented as meeting one of the RRP rule’s excep-tions, a licensee working on the structure must provide information to the commissioner so that certification can be verified.

Portion of the statute:Subd. 13.Lead certification.When issuing permits in compliance with the State

Building Code to a residential building contractor, residential remodeler, manufactured home installer, or residential roofer licensed under section 326B.805, municipalities must verify lead certification qualifica-tions of the licensee required under subdivision 14 for renovations performed on residential property con-

structed prior to 1978. Municipalities may charge a sur-charge for verification of this certification under section 326B.815, subdivision 2.

Subd. 14.Pre-1978 structures.A residential building contractor, residential remod-

eler, manufactured home installer, or residential roofer licensed under section 326B.805 performing renova-tion as defined by Code of Federal Regulations, title 40, section 745.83, on a residential structure constructed prior to 1978 must be certified in accordance with Code of Federal Regulations, title 40, section 745.89, unless the property has been determined to meet an exemp-tion under Code of Federal Regulations, title 40, section 745.82. Before performing the renovations as defined by Code of Federal Regulations, title 40, section 745.83, on a residential structure constructed prior to 1978, a licensee working on the structure must be able to pro-vide to the commissioner information so that proof of certification can be obtained as required in this subdivi-sion. The department shall provide on its Web site a link to the United States Environmental Protection Agency Web site for verification of certification of a licensee.

Senate File 139, a bill related to online notification of EPA-certified lead abatement licensed contractors. Un-der current law, a building inspector must prove that a contractor received their EPA certificate in lead special-ization when remodeling pre-1978 houses by confirm-ing their certification online. Under SF 139, contractors who receive their certification now have until August 1 to post their name to the verified list, which will be available on DLI's website.

March has been. It is al-ways an exciting time when the Home Show gets closer with last minute changes to the floor plan, getting people to decide on having a booth, and trying to get the arenas full. There were

495 people on Saturday, 393 people on Sun-day with a total of 888. This was down quite a bit from last year - 1097 and way down from the average of 1300. If you have ideas for making things better, we would appreci-ate hearing from you. April schedule is an RRP class on April 6th, membership meet-ing on April 12th at I’ll Tile and Stone, BAM board meeting on April 13th, and the 4th annual TRAP SHOOT on April 23rd.

There is a lot of information in the news-letter, so enjoy reading and looking at the pictures.

Feb. 17, 2011 -- Gov. Mark Dayton signed into law Senate File 139, a bill related to online notification of EPA-certified lead abatement licensed contrac-tors. Housing starts, a hallmark measure of housing activity, fell 22.5% in February to the second

lowest level in a series that goes back to 1959.The collapse was broad based with single-family starts

falling 11.8% and multifamily falling46.1% from an unusually high January level. The de-

clines were exacerbated by upward revisionsto both single- and multifamily estimates in January

and by unusually bad weather in February across some regions of the country.

Nahb needs your help to identify mem-bers with active construction sites who can assist in data collection efforts on the tur-bidity — or cloudiness — of storm water dis-charges from their construction sites.

The field data will enable Nahb to more accurately assess whether a numeric turbid-ity limit expected to be proposed shortly by the epa — and finalized in June — can be consistently achieved by builders and devel-opers using passive control systems.

The epa originally proposed to limit dis-charges from construction sites disturbing 10 or more acres to 280 NTUs. but Nahb and the small business administration forced the epa to revise and evaluate its proposed limit, which is why Nahb needs your help now.

Nahb will evaluate the data, which we hope your members will gather as quickly as possible, and work towards setting a limit our industry can live with.

Tell your members that collecting the data is easy and quick. all they have to do is fill three small glass vials with storm water. a two-minute video shows how it's done.

If you’re here, it’s safe to assume you are committed to the building industry. Many of us have lost much the past few years. Some have literally lost every-thing. Yet here we are. Makes you wonder why, doesn’t it? Well, I have some theo-ries. Some are here to network; some to learn. Others are here to promote their business and sell product. But given that the construction industry isn’t as lucra-tive as it used to be, I believe most of us are here for two main reasons.

Camaraderie. How many times have we heard a football player say the rea-son for their last season or two is not the money – it’s the locker room? My wife, Denise has asked me why I don’t do more with my friends. Fact is I spend time with my friends every day. It just so happens a high percentage of my friends are in the construction industry. No-body understands, accepts, encourages or challenges me more than the friends I’ve made the past 25 years in the con-struction industry. The simple fact is if we are to stay in this industry, we need each other.

You Care. The second reason, I be-lieve you’re here is because you care. You care about your family and your liveli-hood. You care about what happens to your friends in the industry. You care about what happens to the construction industry because it is noble and worth preserving and protecting. Most of you care about your customers and the millions of Americans who still believe home ownership is the foundation of the American Dream.

Because I believe you care and want to succeed I would like to challenge you with five thoughts as we enter 2011.

1. Don’t assume things will return to “normal.” What we experienced a few years ago was not normal. Waiting, wishing or assuming that things will return to the way it was is not healthy. Tom Brokaw made an interesting obser-vation in his documentary The Greatest Generation, stating that after World War II America had no competition. In the years following the war we built 80% of the world’s automobiles, the average

American income doubled pre-to-post ware, making the average American in-come 15 times more than the rest of the world. No wonder we prospered!

In today’s worldwide economy, America faces competition unlike any time in history. We cannot afford to make the mistake of assuming the “good, old days” will return simply be-cause history repeats itself. Richard Nixon said, “Nostalgia is not a crimeas long as people don’t act on it.” It’s time to move on in our thinking.

2. Do your homework. The most intellectually enlightening time in my career was in 2007. I spent the year working for a company that does market research for the residential construction industry. Part of my duties included physically driving through 100’s of neighborhoods counting the inventory of lots, homes under construction, mod-el and spec homes and researching plat approvals at county recorder offices in the 13-county area. I was dumbfounded at the excess inventory in the market-place. Even more astounding was how much information is available to help anyone in the construction business know their clients, what they need, and how much they’ll spend to get it. So chal-lenge number two is: do your homework and discipline yourself to plan your busi-ness activities around facts not habits.

3. Stay engaged in your builders asso-ciation. I can’t tell you how many people I meet in the construction industry have no idea what is going on in the world of politics and building codes and how it affects them. Some are aware of what’s happening, but believe nothing can be done about issues like warranty law or mandatory sprinkler systems. That’s just not true! BAM has become a force at the capitol and we need to keep it that way. I often say, “If we’re not at the table we are on the menu,” and it’s true! (This is one historical pattern that does repeat itself). Remember those who make the decisions impacting your business rarely know as much as you do, so when we lobby, we educate. We absolutely need to stay at the table.

4. Think outside the box. The movie, The Patriot (2000), with Mel Gibson is a war-hero’s story in which he comes home to find former troops building him a new house. I noticed the struc-ture looked similar to a modern-day construction site, but the movie was set in the late 1700’s. What product do you own that is still built the same way it was 220 years ago?

I am convinced we don’t build the way we do because of consumer prefer-ence. This may sound crazy, but I don’t recall any customers demanding I place 2x6 studs every 16 inches. But they have always demanded style, sustainability and above all, value. Are there better ways to meet the demands of future ho-meowners? I believe there are and only those of us that figure them out will be here in 10 years. Afraid of change? Bet-ter get over it! Big box stores and big companies will figure out a way to meet the demand if we don’t.

5. Don’t give up. Winston Churchill said, “The pessimist sees the difficul-ties associated with every opportunity and the optimist sees the opportunity with every difficulty.” Let’s face it. It can be hard to see the light at the end of the tunnel, but we know it’s there. Industry experts tell us we are at or near the bottom, and I think that’s true. As a youngster, I recall jumping a little too far off the dock into the lake at my grandmother’s cabin. I struggled to get back and remember the sense of relief in feeling the bottom of the lake. It wasn’t solid, but it was there and I think that’s where our industry is now, beginning to feel the bottom. So, don’t give up!

Thank you to the Board of Direc-tors for placing your trust in me, and this year’s executive committee, to lead in 2011. Most of all, thank you for ap-proving a budget that allows us to keep this great organization moving forward. I anticipate great things!

As of February 1, 2011, municipalities will be required to verify lead certification prior to issuing building permits for pre-1978 residential properties. Yes, you read that correctly. If you do not have your Environmental Protection Agency (EPA) Renovation, Repair and Painting (RRP) Firm Certification, you will not be issued a building permit by municipalities which enforce Minnesota State Building Codes. Com-pliance made direct:

1. Bring proof of the residential property’s date of original construction.

2. Bring a color copy of your firm’s certificate with you.

3. Bring lead-based paint testing results, if you plan to claim an exemption.

4. Enable the permit office personnel to confirm that you are EPA compliant by having your required documentation readily available.

5. Display your firm certificate logo and identifica-tion number on your trucks, business cards, proposals, contracts and letterhead.

6. Stand out and be visible – Say, “Yes, I am a Certi-fied Firm.”

Do not delay your jobs – Be pro-active.According to 326B.106, 2010 Minnesota Statute

subdivisions 13 and 14, residential building contrac-tors, residential remodelers, manufactured home in-stallers, and residential roofers must be EPA certified firms in order to receive a building permit prior to be-ginning their job. Unless the pre-1978 property can be documented as meeting one of the RRP rule’s excep-tions, a licensee working on the structure must provide information to the commissioner so that certification can be verified.

Portion of the statute:Subd. 13.Lead certification.When issuing permits in compliance with the State

Building Code to a residential building contractor, residential remodeler, manufactured home installer, or residential roofer licensed under section 326B.805, municipalities must verify lead certification qualifica-tions of the licensee required under subdivision 14 for renovations performed on residential property con-

structed prior to 1978. Municipalities may charge a sur-charge for verification of this certification under section 326B.815, subdivision 2.

Subd. 14.Pre-1978 structures.A residential building contractor, residential remod-

eler, manufactured home installer, or residential roofer licensed under section 326B.805 performing renova-tion as defined by Code of Federal Regulations, title 40, section 745.83, on a residential structure constructed prior to 1978 must be certified in accordance with Code of Federal Regulations, title 40, section 745.89, unless the property has been determined to meet an exemp-tion under Code of Federal Regulations, title 40, section 745.82. Before performing the renovations as defined by Code of Federal Regulations, title 40, section 745.83, on a residential structure constructed prior to 1978, a licensee working on the structure must be able to pro-vide to the commissioner information so that proof of certification can be obtained as required in this subdivi-sion. The department shall provide on its Web site a link to the United States Environmental Protection Agency Web site for verification of certification of a licensee.

March has been. It is al-ways an exciting time when the Home Show gets closer with last minute changes to the floor plan, getting people to decide on having a booth, and trying to get the arenas full. There were

495 people on Saturday, 393 people on Sun-day with a total of 888. This was down quite a bit from last year - 1097 and way down from the average of 1300. If you have ideas for making things better, we would appreci-ate hearing from you. April schedule is an RRP class on April 6th, membership meet-ing on April 12th at I’ll Tile and Stone, BAM board meeting on April 13th, and the 4th annual TRAP SHOOT on April 23rd.

There is a lot of information in the news-letter, so enjoy reading and looking at the pictures.

Greetings!The spring thaw is a little slow but we are on our

way! The Home Show and silent auction was a great success, thanks to Sharon and all of our committee members and volunteers. We had nice weather and lots of traffic. Our March meeting was at the speak easy. Our speakers were Sandy Gunderson and Matt Dretsch from the Becker County Environmental Ser-vices, as well as, Roger Rolf from the MN pollution control agency. They had lots of good information to share! We have two new members so far this month, and one for April! Let’s keep that momentum going!

Last month I discussed the Legislation issues that BAM, our state associa-tion watch dogs and how being a member supports that fight. This month I will discuss how membership provides credibility to its members. Consumers are intimidated when it comes to hiring contractors and buying from vendors. It is even more challenging in the home building industry. There are so many choices out there. To top it off there are a whole slew of bad choices to be made. Some people just simply understand the value of industry membership and will do business with companies that are giving back to their industry. Good standing membership in just about any type of legitimate organization requires a back ground check and references. They will also revoke the mem-bership of any member who would use unethical business practices. Many consumers look to industry organizations when trying to make these determi-nations about a contractor or vendor who they plan to do business with. Your membership puts you in the trustworthy eye of the consumer.

There are several different ways to show your membership credentials and benefit from them. 1. Use the association logo(s) on your business cards, advertising, web site, letter head & so on. 2. Verbally mention to your customers that you are a member and why it should matter to them. 3. Be seen participating in community projects and other organized events organized by the association.

So far we have discussed the legislation issues and credibility benefits that benefit our members. As I previously mentioned these are the things we need to emphasize when recruiting new members. Next month’s discus-sion… I have some ideas of my own; however I am open to hearing some of yours.
