We tried something different this year with having the annual picnic for May combined with our Annual Trap Shoot.

We had a good turn-out with several teams for the Trap Shoot. There were some obsta-cles on the shooting course. At the station sponsored by Modern Heating and Plumbing, you had to shoot sitting on a toilet. At the station sponsored by I’ll Tile and Stone, you had to shoot with both feet planted on a tile, and at the station sponsored by B & M Electric, you had to wear a lamp shade while shooting. It made it a lot of fun. There are a total of 5 stations, so think about be-ing a sponsor for next year. The First Place team winner was B & M Electric, Second Place team, Green’s Plumbing & Heating and Third Place team was Nodsle Construction. There was a ton of food for the picnic. All awesome!!!! month, and I hope it was as busy for all of you. From what I hear, there are lots of things going on. It will probably be a while until it gets as busy as it was a few years ago. I have sent out quite a few emails, so I

hope you have been reading them. This will be the first of the newsletters that you can just go online to read, except for those that have requested a hard copy. I am trying to cut some of the operating costs.

BAM has been really busy trying to get legislative issues handled, and I think it has been like beating their heads against a wall. The Senate and House pass things, and the Governor vetoes them. Read about what is going on in the BAM columns.

The OSHA AWAIR and Fall Protection classes were well attended. We even had a few non members attend. If anyone needs documentation that they attended a Safety Meeting, please call me and I will send a letter for you to put in your Safety Manual.

We are in our summer hours now, Tuesday, Wednesday and Thursdays from 9 - 1. Should something be needed, you can usually reach me by my cell phone - 849-1037. I will be gone from June 17th to the 24th on a trip to California with my grandkids. Bad time for the heat in California, but it’s when it worked out with school and the kids’ activities.

If any of you attended the Veterans Memorial Day parade and program, it was really interesting and moving. My grandson Nick and a girl from the Marching Band played Taps. Gives me the shivers and they did an awesome job. One played after the other started by a few beats, and it was like an echo. Can’t believe how those kids can play…I never even learned to play a Kazoo!

BAM filed suit against the City of St. Paul seeking a court declaration to prevent cities from enacting policies that violate the State Building Code. According to a Minnesota Statute, the Minnesota State Building Code super-sedes the building code of any municipality, and a municipality may not require building code provisions that differ (in any way) from the State Building Code. Minn. Stat. § 326B.121, subd. 2(c). Nonetheless, St. Paul’s Department of Safety and Inspections adopted a “Uniform Egress Window Policy” that imposes a minimum size requirement on all egress windows that are being replaced or repaired.

There is no exception to this requirement. Minnesota’s State Building Code, however, contains an exception to the minimum egress window size requirements that allows a contractor to replace an existing window with the manufacturer’s largest standard size window that will fit within the existing frame or rough opening. BAM hired Joe Springer from Fredrikson & Byron to commence suit against St. Paul to obtain a court ruling that the city’s Policy violates state law and is prohibited.

The City defended on the grounds that the limitations in Minn. Stat. § 326B.121 do not apply, because the City enacted a “policy” and not an ordinance, the language used in the statute. BAM argued that the City cannot avoid the statute by merely calling its requirement a “policy” and not an ordinance. The trial court agreed with the City, and BAM appealed to the Minnesota Court of Appeals. Oral argument on BAM’s appeal was held on May 9, 2012 and a decision is expected later this summer. The case is important because it addresses the ability of a city to impose requirements on builders that are different than the State Building Code.

The BAM Board Meets May 9Wednesday May 9th the BAM

Board held their second meeting of the year at the Crowne Plaza Min-neapolis North. The Board was pre-sented with BAM’s 2011 financial review done by KDV and given a clean report. The Government Rela-tions Committee provided an exten-sive overview of BAM’s wins, losses and ties at the state capitol this year. The BAM Insurance Committee reported they are close to finding a replacement insurance product since Continental Western Group is leaving the state as of July this year. And the Legal Action Committee re-ported on the ongoing case against the City of Saint Paul.

Government RelationsMinnesota’s 2012 legislative

session concluded Thursday May 10th and BAM had issues in the wins, losses and ties categories. A complete legislative overview will be published in the next few weeks.

WinsBAM won a repeal of the 2%

withholding rule and a repeal of the independent contractor exemp-tion certificate rule. The bill to stop money being pulled out of the con-struction codes fund was signed into law. BAM won a reform of the con-tractor online education rules. BAM also significantly slowed the energy code promulgation process and suc-cessfully obtained a promise that the Department of Commerce would provide data to the Department of Labor and Industry (DOLI) on how efficient Minnesota already builds to help inform the energy code prom-ulgation process.

LossesThe fire sprinkler initiative lost

again this year with a veto from the Governor. It was placed in two bills: SF1653, the subcontractor registra-

tion bill strongly supported by the carpenters’ union, and SF1717, the Department of Labor and Industry’s technical bill. The Governor refused to sign any bill with fire sprinklers. BAM’s third strategy was to put the bill in the bonding bill in conference committee, but for the first time in a long time the bonding bill did not have a conference committee. It went straight from the senate to the house where they accepted the sen-ate’s language as it was and sent it on to the Governor. An override was not possible because Senate demo-crats were not willing to override the Governor. BAM will continue to pursue the fire sprinkler issue in the codes process this summer. Getting a resolution passed by your city council or county commission by August 15 will greatly help the codes process. A letter from your building code official or fire fighter that is against mandatory fire sprin-klers would also be helpful. BAM has written a draft letter, resolution and talking points. Talk with your BAM Board representative to find out more.

TiesBAM was successful in getting

DOLI to work on the contractor recovery fund issue. We will be dis-cussing the issue this summer and proposing legislation in next year’s session. Subcontractor registration is also a tie. Fines are stayed in law meaning they are significantly re-duced or forgiven if a sub registers within 60 days. The program is a test for two years and sunsets in 2014. DOLI has to produce a report and present it to the legislature at the end of the program in order for reg-istration to continue.

Legal Action CommitteeBAM filed a lawsuit in 2010

against the City of Saint Paul in re-

sponse to the City’s egress window policy for existing homes which violates MN Statute 299F.011 by ex-ceeding the Minnesota State Build-ing Code. It would be detrimental to the residential construction in-dustry if other municipalities began applying regulations that violate the State Building Code. BAM lost in district court last year but had a strong enough case to appeal. At 10:00 am on May 9th, 2012 oral ar-guments were heard in the Minne-sota Court of Appeals. The court has 90-120 days to render its decision, which will be announced as soon as we hear.

NAHBThis year’s national legislative

conference is June 6th. BAM staff will be setting up meetings with Min-nesota’s congressional delegation. BAM will also be hosting a meeting for Minnesota’s national directors the week of May 21st. Information about the meeting will be sent to all Minnesota national directors.

Recruiting New MembersNAHB has a new membership

initiative for 2012. If your local association has more builder and associate members by the end of 2012 than you did December 31, 2011 you will receive 50% off the national dues for every builder and associate member on the roster as of December 31, 2011. Every affiliated local association is in the running and eligible; no opt-in is necessary. Hold an old fashioned membership drive or promote “doing business with a member” and encourage your local’s builder members to ensure their subs are members. Governor vetoes Fire sprinklers. again.

BAM has been busy at the Capitol working to get our fire sprinkler proposal passed into law. Last week we sent out an urgent call to the members request-ing they contact the Governor’s office to urge him to sign SF 1717 which included our fire sprinkler proposal. Two percent of the membership responded with calls and emails. Thank you for your support. Un-fortunately, our requests fell on deaf ears and the Governor’s staff refused to meet with the industry. Governor Dayton ve-toed the bill late Monday afternoon. (Veto letter was available by Sharon’s email.)

We generated a good amount of press with members and staff being in-terviewed on local radio and television stations regarding fire sprinkler issue and all of the energy code issues and the cost impact the new codes will have on new residential construction in Minnesota.

for BAM, the issue is yet to be determined as the Commissioner of Labor & Industry Ken Peterson must now decide whether to put the requirement in the code recom-mendation or not. If Governor Dayton has his way, you will have to install fire sprinklers in all new family construction by next year as of July 2013. We have a long way to go before that happens, but BAM will be making our case as the issue moves through the administrative pro-cess. Not only will sprinklers be discussed but also all changes to the building code including all energy code issues as well. It ain’t over yet.

House has adjourned sine die and the Sen-ate will do the same after debating and passing the Vikings Stadium bill. We will provide an overall review of the 2012 leg-islative session next week.

baM energy code & housing summit

The first week of April BAM hosted an Energy Code & Housing Summit for all energy code stakeholders. With over 80 in attendance there were representatives

from the energy community, affordable housing advocates, building code officials, the International Code Council, the MN Department of Commerce and the MN Department of Labor and Industry in ad-dition to several BAM members.

Thank you to members Hans Ha-gen, Cary Becker, Chad Kompelein and Pat O’Malley for presenting and participating as expert panelists. Thank you also to BAM Director of Codes & Research, Karen Linner for her hard work.

month, and I hope it was as busy for all of you. From what I hear, there are lots of things going on. It will probably be a while until it gets as busy as it was a few years ago. I have sent out quite a few emails, so I

hope you have been reading them. This will be the first of the newsletters that you can just go online to read, except for those that have requested a hard copy. I am trying to cut some of the operating costs.

BAM has been really busy trying to get legislative issues handled, and I think it has been like beating their heads against a wall. The Senate and House pass things, and the Governor vetoes them. Read about what is going on in the BAM columns.

The OSHA AWAIR and Fall Protection classes were well attended. We even had a few non members attend. If anyone needs documentation that they attended a Safety Meeting, please call me and I will send a letter for you to put in your Safety Manual.

We are in our summer hours now, Tuesday, Wednesday and Thursdays from 9 - 1. Should something be needed, you can usually reach me by my cell phone - 849-1037. I will be gone from June 17th to the 24th on a trip to California with my grandkids. Bad time for the heat in California, but it’s when it worked out with school and the kids’ activities.

If any of you attended the Veterans Memorial Day parade and program, it was really interesting and moving. My grandson Nick and a girl from the Marching Band played Taps. Gives me the shivers and they did an awesome job. One played after the other started by a few beats, and it was like an echo. Can’t believe how those kids can play…I never even learned to play a Kazoo!

BAM filed suit against the City of St. Paul seeking a court declaration to prevent cities from enacting policies that violate the State Building Code. According to a Minnesota Statute, the Minnesota State Building Code super-sedes the building code of any municipality, and a municipality may not require building code provisions that differ (in any way) from the State Building Code. Minn. Stat. § 326B.121, subd. 2(c). Nonetheless, St. Paul’s Department of Safety and Inspections adopted a “Uniform Egress Window Policy” that imposes a minimum size requirement on all egress windows that are being replaced or repaired.

There is no exception to this requirement. Minnesota’s State Building Code, however, contains an exception to the minimum egress window size requirements that allows a contractor to replace an existing window with the manufacturer’s largest standard size window that will fit within the existing frame or rough opening. BAM hired Joe Springer from Fredrikson & Byron to commence suit against St. Paul to obtain a court ruling that the city’s Policy violates state law and is prohibited.

The City defended on the grounds that the limitations in Minn. Stat. § 326B.121 do not apply, because the City enacted a “policy” and not an ordinance, the language used in the statute. BAM argued that the City cannot avoid the statute by merely calling its requirement a “policy” and not an ordinance. The trial court agreed with the City, and BAM appealed to the Minnesota Court of Appeals. Oral argument on BAM’s appeal was held on May 9, 2012 and a decision is expected later this summer. The case is important because it addresses the ability of a city to impose requirements on builders that are different than the State Building Code.

The BAM Board Meets May 9Wednesday May 9th the BAM

Board held their second meeting of the year at the Crowne Plaza Min-neapolis North. The Board was pre-sented with BAM’s 2011 financial review done by KDV and given a clean report. The Government Rela-tions Committee provided an exten-sive overview of BAM’s wins, losses and ties at the state capitol this year. The BAM Insurance Committee reported they are close to finding a replacement insurance product since Continental Western Group is leaving the state as of July this year. And the Legal Action Committee re-ported on the ongoing case against the City of Saint Paul.

Government RelationsMinnesota’s 2012 legislative

session concluded Thursday May 10th and BAM had issues in the wins, losses and ties categories. A complete legislative overview will be published in the next few weeks.

WinsBAM won a repeal of the 2%

withholding rule and a repeal of the independent contractor exemp-tion certificate rule. The bill to stop money being pulled out of the con-struction codes fund was signed into law. BAM won a reform of the con-tractor online education rules. BAM also significantly slowed the energy code promulgation process and suc-cessfully obtained a promise that the Department of Commerce would provide data to the Department of Labor and Industry (DOLI) on how efficient Minnesota already builds to help inform the energy code prom-ulgation process.

LossesThe fire sprinkler initiative lost

again this year with a veto from the Governor. It was placed in two bills: SF1653, the subcontractor registra-

tion bill strongly supported by the carpenters’ union, and SF1717, the Department of Labor and Industry’s technical bill. The Governor refused to sign any bill with fire sprinklers. BAM’s third strategy was to put the bill in the bonding bill in conference committee, but for the first time in a long time the bonding bill did not have a conference committee. It went straight from the senate to the house where they accepted the sen-ate’s language as it was and sent it on to the Governor. An override was not possible because Senate demo-crats were not willing to override the Governor. BAM will continue to pursue the fire sprinkler issue in the codes process this summer. Getting a resolution passed by your city council or county commission by August 15 will greatly help the codes process. A letter from your building code official or fire fighter that is against mandatory fire sprin-klers would also be helpful. BAM has written a draft letter, resolution and talking points. Talk with your BAM Board representative to find out more.

TiesBAM was successful in getting

DOLI to work on the contractor recovery fund issue. We will be dis-cussing the issue this summer and proposing legislation in next year’s session. Subcontractor registration is also a tie. Fines are stayed in law meaning they are significantly re-duced or forgiven if a sub registers within 60 days. The program is a test for two years and sunsets in 2014. DOLI has to produce a report and present it to the legislature at the end of the program in order for reg-istration to continue.

Legal Action CommitteeBAM filed a lawsuit in 2010

against the City of Saint Paul in re-

sponse to the City’s egress window policy for existing homes which violates MN Statute 299F.011 by ex-ceeding the Minnesota State Build-ing Code. It would be detrimental to the residential construction in-dustry if other municipalities began applying regulations that violate the State Building Code. BAM lost in district court last year but had a strong enough case to appeal. At 10:00 am on May 9th, 2012 oral ar-guments were heard in the Minne-sota Court of Appeals. The court has 90-120 days to render its decision, which will be announced as soon as we hear.

NAHBThis year’s national legislative

conference is June 6th. BAM staff will be setting up meetings with Min-nesota’s congressional delegation. BAM will also be hosting a meeting for Minnesota’s national directors the week of May 21st. Information about the meeting will be sent to all Minnesota national directors.

Recruiting New MembersNAHB has a new membership

initiative for 2012. If your local association has more builder and associate members by the end of 2012 than you did December 31, 2011 you will receive 50% off the national dues for every builder and associate member on the roster as of December 31, 2011. Every affiliated local association is in the running and eligible; no opt-in is necessary. Hold an old fashioned membership drive or promote “doing business with a member” and encourage your local’s builder members to ensure their subs are members. Governor vetoes Fire sprinklers. again.

BAM has been busy at the Capitol working to get our fire sprinkler proposal passed into law. Last week we sent out an urgent call to the members request-ing they contact the Governor’s office to urge him to sign SF 1717 which included our fire sprinkler proposal. Two percent of the membership responded with calls and emails. Thank you for your support. Un-fortunately, our requests fell on deaf ears and the Governor’s staff refused to meet with the industry. Governor Dayton ve-toed the bill late Monday afternoon. (Veto letter was available by Sharon’s email.)

We generated a good amount of press with members and staff being in-terviewed on local radio and television stations regarding fire sprinkler issue and all of the energy code issues and the cost impact the new codes will have on new residential construction in Minnesota.

for BAM, the issue is yet to be determined as the Commissioner of Labor & Industry Ken Peterson must now decide whether to put the requirement in the code recom-mendation or not. If Governor Dayton has his way, you will have to install fire sprinklers in all new family construction by next year as of July 2013. We have a long way to go before that happens, but BAM will be making our case as the issue moves through the administrative pro-cess. Not only will sprinklers be discussed but also all changes to the building code including all energy code issues as well. It ain’t over yet.

The first week of April BAM hosted an Energy Code & Housing Summit for all energy code stakeholders. With over 80 in attendance there were representatives

from the energy community, affordable housing advocates, building code officials, the International Code Council, the MN Department of Commerce and the MN Department of Labor and Industry in ad-dition to several BAM members.

It’s here!! Summer that is. For the next couple of months we have the privilege of experiencing what makes the Lakes Region one of the best places to live on the planet. Hopefully you will have some time to get away from the hustle & bustle and enjoy it. Last month I traveled to the Twin Cities and attended the BAM board meeting. It was quite interesting to hear what’s been going on at the state capitol. As I’m sure you are aware, the Governor vetoed the fire sprinkler bill… again. I thought we had put the issue to rest, I guess not. There is a small glimmer of hope yet. Later this summer, BAM will be pre-senting our case to a law judge. Keep your fingers crossed! mAy 9th meeting - piCniC Combined with trAp shoot

We tried something different this year with having the annual picnic for May combined with our Annual Trap Shoot.

We had a good turn-out with several teams for the Trap Shoot. There were some obsta-cles on the shooting course. At the station sponsored by Modern Heating and Plumbing, you had to shoot sitting on a toilet. At the station sponsored by I’ll Tile and Stone, you had to shoot with both feet planted on a tile, and at the station sponsored by B & M Electric, you had to wear a lamp shade while shooting. It made it a lot of fun. There are a total of 5 stations, so think about be-ing a sponsor for next year. The First Place team winner was B & M Electric, Second Place team, Green’s Plumbing & Heating and Third Place team was Nodsle Construction. There was a ton of food for the picnic. All awesome!!!! Thank You, to Jessy Jepson for helping me to clean the Sportsman’s Club. In other news, Mike Eidenschink reached the Life Spike goal of 25 Spike Credits. Con-gratulations Mike. A job well done.
