This month’s focus on tools for recruitment will be about “critical news and information”. Members are informed of local building code requirements, legislative activity, and upcoming LRBA events through the monthly newsletter, A Cut Above. NAHB informs members of na-tional industry news with the biweekly newspaper, Nation's Building News, and monthly Builder magazine. BAM informs members through e-mails, on their website and passes information along to the local asso-ciations. Most of us don’t have the time to put in to do the research and study involved in attaining this information. I find this member benefit to be a huge asset. Our April meeting held at I’ll Tile and Stone was fun, informative and filling. Skye, Troy and Ben did a great job of hosting and making us all feel welcome. Skye said she cooked all day. The “subs” were great Skye. A little test was given at the end. Did you know: That the average person spends about 14 days per year in the bathroom? That porcelain is fired twice which makes it stronger than ceramic tile? That Granite is a natural stone and Quartz is man made? That floor tiles can go on the walls, but wall tile cannot go on the floor? Thank you to I’ll Tile and Stone for hosting the April meeting.

There were 5 teams signed up to shoot, prizes and awards were given. 1st place went to Greens Plumbing and Heat-ing, 2nd place went to B & M Electric and 3rd place to Nodsle Construction. It was a good lunch with Jill Mickelson’s turkey and buns and bars pro-vided by Brenda Eidenschink, Carmen Nodsle, Ellie Francis, Carrie Roble and Sharon. Hopefully next year some new faces will come and be a part of this great spring event.

Update From The CapitolThe Legislature held a few meetings

Monday prior to the their week-long break for the Easter/Passover Holiday. They come back to Saint Paul to resume their work on Tuesday the 26th. While the legislature may have been out, staff has continued to work. We met with the Governors office on Monday the 18th on the sprinkler bill and also met with a few other constituencies on remaining bills such as the bond proposal bill and the engineer indemnification bill.

Fire Sprinkler Bill HF 460The Senate Judiciary Committee

heard over three hours of testimony on our bill April 12th. Approximately 20 minutes were in favor of the bill and the remaining hours were in opposition. Even so, the bill passed out of the com-mittee and on to the Senate floor with a voice vote. Karen Linner and Todd Bjerstedt did a great job focusing the committee members on our data and Lisa Frenette had the votes rounded up well in advance. We expect the bill to be heard on the Senate floor in the next couple of weeks.

In meeting with Dayton's staff about the bill, they were non-committal, but we provided information received from Governor Dayton while he was in our office this summer seeking an endorse-ment. Candidate Dayton told us at that

time, when asked about the fire sprin-kler issue, that he did not believe a man-datory requirement for fire sprinklers was a good idea.

In response to the House floor de-bate some of the comments prompted me to write an editorial which was printed in the Duluth Tribune. Check it out here.

Variance Bill HF 52The bill passed the House floor and

was heard in the Senate Government Operations Committee on Wednesday April 13th. Our lead lobbyist Pete Coyle did an excellenet job explaining the bill, the compromise amendments and deflected some of the bill’s remaining opponents. Pete is working to get the bill heard on the Senate floor as soon as possible.

We’d hoped it would be heard this week Monday, but the Senate barely had a quorum and their only business was to confirm their newest Senator, Mary Jo McGuire (Saint Paul). Senator McGuire is Senator Ellen Anderson’s replacement after Anderson was appointed by Gov-ernor Dayton to chair the Public Utility Commission.

Subcontractor Registration/Re-peal of Independent Contractor Exemption Certificate Bill SF 852

BAM is currently working with Sen-

ator John Pederson (R - Saint Cloud) on his subcontractor registration and re-peal of independent contractor exemp-tion certificate bill. We’ve added a few amendments that would help with the issue of unlicensed contractors in the state. I testified in both the House and Senate Jobs Committees in favor of the bills. The House and Senate bills are not the same and both were sent to other committees. Hearings will most likely be scheduled for after Easter break.

BAM Board Met Wednesday, April 13

As of February 1, 2011, municipalities will be required to verify lead certification prior to issuing building permits for pre-1978 residential properties. Yes, you read that correctly. If you do not have your Environmental Protection Agency (EPA) Renovation, Repair and Painting (RRP) Firm Certification, you will not be issued a building permit by municipalities which enforce Minnesota State Building Codes. Com-pliance made direct:

1. Bring proof of the residential property’s date of original construction.

2. Bring a color copy of your firm’s certificate with you.

3. Bring lead-based paint testing results, if you plan to claim an exemption.

4. Enable the permit office personnel to confirm that you are EPA compliant by having your required documentation readily available.

5. Display your firm certificate logo and identifica-tion number on your trucks, business cards, proposals, contracts and letterhead.

6. Stand out and be visible – Say, “Yes, I am a Certi-fied Firm.”

Do not delay your jobs – Be pro-active.According to 326B.106, 2010 Minnesota Statute

subdivisions 13 and 14, residential building contrac-tors, residential remodelers, manufactured home in-stallers, and residential roofers must be EPA certified firms in order to receive a building permit prior to be-ginning their job. Unless the pre-1978 property can be documented as meeting one of the RRP rule’s excep-tions, a licensee working on the structure must provide information to the commissioner so that certification can be verified.

Portion of the statute:Subd. 13.Lead certification.When issuing permits in compliance with the State

Building Code to a residential building contractor, residential remodeler, manufactured home installer, or residential roofer licensed under section 326B.805, municipalities must verify lead certification qualifica-tions of the licensee required under subdivision 14 for renovations performed on residential property con-

structed prior to 1978. Municipalities may charge a sur-charge for verification of this certification under section 326B.815, subdivision 2.

Subd. 14.Pre-1978 structures.A residential building contractor, residential remod-

eler, manufactured home installer, or residential roofer licensed under section 326B.805 performing renova-tion as defined by Code of Federal Regulations, title 40, section 745.83, on a residential structure constructed prior to 1978 must be certified in accordance with Code of Federal Regulations, title 40, section 745.89, unless the property has been determined to meet an exemp-tion under Code of Federal Regulations, title 40, section 745.82. Before performing the renovations as defined by Code of Federal Regulations, title 40, section 745.83, on a residential structure constructed prior to 1978, a licensee working on the structure must be able to pro-vide to the commissioner information so that proof of certification can be obtained as required in this subdivi-sion. The department shall provide on its Web site a link to the United States Environmental Protection Agency Web site for verification of certification of a licensee.

From the office of Gov. Mark Dayton Feb. 17, 2011 -- Gov. Mark Dayton signed into law

Senate File 139, a bill related to online notification of EPA-certified lead abatement licensed contractors. Un-der current law, a building inspector must prove that a contractor received their EPA certificate in lead special-ization when remodeling pre-1978 houses by confirm-ing their certification online. Under SF 139, contractors who receive their certification now have until August 1 to post their name to the verified list, which will be available on DLI's website.

of you wished for warm-er weather in April. Oth-er that one or two days, I think April was a pit. We had enough attendees to hold another Renovate Repair and Paint class; our meeting at I’ll Tile

and Stone was well attended ; on April 23rd we held our 4th annual Trap Shoot and on April 28th a new member orienta-tion class. April was still busy enough… Brenda has been working to help get rid of the piles of paper on my desk. I tend to keep everything and then end throw-ing it because it wasn’t important any-way.

Our picnic was rescheduled for June 1st. Hopefully it will be warmer and the BAM President, Todd Bjersted, will be at-tending. I also hope to have three more RRP classes in June, so that those that still need can get certified before the August 1st deadline of being on the EPA website. Myself, Bryan and Nick attend-ed the BAM board meeting and listened to some very unintelligent statements, from members of the Minnesota House, on Fire Sprinklers. There is a 99% ratio for getting out of a burning home that has smoke alarms and this goes to 99.5% with the addition of sprinklers. Costs for putting sprinklers in a single family home would go up $4,000 to $11,000, depend-ing if another well needs to be drilled, a back up generator is needed… If you have no power, your well pump wouldn’t run, which in turn would shut down the sprinklers. It passed in the House and is now in the Senate. The bill would make sprinklers mandatory in a building more than a single family home.

For most of us, Spring brings new work. This year, it also means stepped up OSHA enforce-ment. During an EPA/OSHA webinar last week, it was mentioned that the residential construc-tion industry has not been on the Minnesota OSHA radar in the past. All of that has changed due to the large number of violations and acci-dents that could have been prevented.

During the same call, it was mentioned that there are many cases where OSHA has shown up on a jobsite asking for a copy of your safety manual. If the contractor is able to show it, all is well and OSHA moves along. For those that do not, it is a different story.

Having said that, if you do not have an OSHA safety manual on your jobsite, get one TODAY! Go over it with your employees and stay safe.

Update From The CapitolThe Legislature held a few meetings

Monday prior to the their week-long break for the Easter/Passover Holiday. They come back to Saint Paul to resume their work on Tuesday the 26th. While the legislature may have been out, staff has continued to work. We met with the Governors office on Monday the 18th on the sprinkler bill and also met with a few other constituencies on remaining bills such as the bond proposal bill and the engineer indemnification bill.

Fire Sprinkler Bill HF 460The Senate Judiciary Committee

heard over three hours of testimony on our bill April 12th. Approximately 20 minutes were in favor of the bill and the remaining hours were in opposition. Even so, the bill passed out of the com-mittee and on to the Senate floor with a voice vote. Karen Linner and Todd Bjerstedt did a great job focusing the committee members on our data and Lisa Frenette had the votes rounded up well in advance. We expect the bill to be heard on the Senate floor in the next couple of weeks.

In meeting with Dayton's staff about the bill, they were non-committal, but we provided information received from Governor Dayton while he was in our office this summer seeking an endorse-ment. Candidate Dayton told us at that

time, when asked about the fire sprin-kler issue, that he did not believe a man-datory requirement for fire sprinklers was a good idea.

Variance Bill HF 52The bill passed the House floor and

was heard in the Senate Government Operations Committee on Wednesday April 13th. Our lead lobbyist Pete Coyle did an excellenet job explaining the bill, the compromise amendments and deflected some of the bill’s remaining opponents. Pete is working to get the bill heard on the Senate floor as soon as possible.

We’d hoped it would be heard this week Monday, but the Senate barely had a quorum and their only business was to confirm their newest Senator, Mary Jo McGuire (Saint Paul). Senator McGuire is Senator Ellen Anderson’s replacement after Anderson was appointed by Gov-ernor Dayton to chair the Public Utility Commission.

Subcontractor Registration/Re-peal of Independent Contractor Exemption Certificate Bill SF 852

BAM is currently working with Sen-

ator John Pederson (R - Saint Cloud) on his subcontractor registration and re-peal of independent contractor exemp-tion certificate bill. We’ve added a few amendments that would help with the issue of unlicensed contractors in the state. I testified in both the House and Senate Jobs Committees in favor of the bills. The House and Senate bills are not the same and both were sent to other committees. Hearings will most likely be scheduled for after Easter break.

As of February 1, 2011, municipalities will be required to verify lead certification prior to issuing building permits for pre-1978 residential properties. Yes, you read that correctly. If you do not have your Environmental Protection Agency (EPA) Renovation, Repair and Painting (RRP) Firm Certification, you will not be issued a building permit by municipalities which enforce Minnesota State Building Codes. Com-pliance made direct:

1. Bring proof of the residential property’s date of original construction.

2. Bring a color copy of your firm’s certificate with you.

3. Bring lead-based paint testing results, if you plan to claim an exemption.

4. Enable the permit office personnel to confirm that you are EPA compliant by having your required documentation readily available.

5. Display your firm certificate logo and identifica-tion number on your trucks, business cards, proposals, contracts and letterhead.

6. Stand out and be visible – Say, “Yes, I am a Certi-fied Firm.”

Do not delay your jobs – Be pro-active.According to 326B.106, 2010 Minnesota Statute

subdivisions 13 and 14, residential building contrac-tors, residential remodelers, manufactured home in-stallers, and residential roofers must be EPA certified firms in order to receive a building permit prior to be-ginning their job. Unless the pre-1978 property can be documented as meeting one of the RRP rule’s excep-tions, a licensee working on the structure must provide information to the commissioner so that certification can be verified.

Portion of the statute:Subd. 13.Lead certification.When issuing permits in compliance with the State

Building Code to a residential building contractor, residential remodeler, manufactured home installer, or residential roofer licensed under section 326B.805, municipalities must verify lead certification qualifica-tions of the licensee required under subdivision 14 for renovations performed on residential property con-

structed prior to 1978. Municipalities may charge a sur-charge for verification of this certification under section 326B.815, subdivision 2.

Subd. 14.Pre-1978 structures.A residential building contractor, residential remod-

eler, manufactured home installer, or residential roofer licensed under section 326B.805 performing renova-tion as defined by Code of Federal Regulations, title 40, section 745.83, on a residential structure constructed prior to 1978 must be certified in accordance with Code of Federal Regulations, title 40, section 745.89, unless the property has been determined to meet an exemp-tion under Code of Federal Regulations, title 40, section 745.82. Before performing the renovations as defined by Code of Federal Regulations, title 40, section 745.83, on a residential structure constructed prior to 1978, a licensee working on the structure must be able to pro-vide to the commissioner information so that proof of certification can be obtained as required in this subdivi-sion. The department shall provide on its Web site a link to the United States Environmental Protection Agency Web site for verification of certification of a licensee.

Senate File 139, a bill related to online notification of EPA-certified lead abatement licensed contractors. Un-der current law, a building inspector must prove that a contractor received their EPA certificate in lead special-ization when remodeling pre-1978 houses by confirm-ing their certification online. Under SF 139, contractors who receive their certification now have until August 1 to post their name to the verified list, which will be available on DLI's website.

of you wished for warm-er weather in April. Oth-er that one or two days, I think April was a pit. We had enough attendees to hold another Renovate Repair and Paint class; our meeting at I’ll Tile

and Stone was well attended ; on April 23rd we held our 4th annual Trap Shoot and on April 28th a new member orienta-tion class. April was still busy enough… Brenda has been working to help get rid of the piles of paper on my desk. I tend to keep everything and then end throw-ing it because it wasn’t important any-way.

Our picnic was rescheduled for June 1st. Hopefully it will be warmer and the BAM President, Todd Bjersted, will be at-tending. I also hope to have three more RRP classes in June, so that those that still need can get certified before the August 1st deadline of being on the EPA website. Myself, Bryan and Nick attend-ed the BAM board meeting and listened to some very unintelligent statements, from members of the Minnesota House, on Fire Sprinklers. There is a 99% ratio for getting out of a burning home that has smoke alarms and this goes to 99.5% with the addition of sprinklers. Costs for putting sprinklers in a single family home would go up $4,000 to $11,000, depend-ing if another well needs to be drilled, a back up generator is needed… If you have no power, your well pump wouldn’t run, which in turn would shut down the sprinklers. It passed in the House and is now in the Senate. The bill would make sprinklers mandatory in a building more than a single family home.

to build! Our April meeting was at I’ll Tile & Stone. Ben, Skye & Troy did an awesome job as hosts and fed us well! Skye did a great job speak-ing, mixed with some fun activities. They have a beautiful showroom with a plethora of products. If you have not yet visited I’ll Tile and Stone, make a point to do so. The final meeting of the season is at Dunton Locks County Park. Let’s hope for some nice weather!

This month’s focus on tools for recruitment will be about “critical news and information”. Members are informed of local building code requirements, legislative activity, and upcoming LRBA events through the monthly newsletter, A Cut Above. NAHB informs members of na-tional industry news with the biweekly newspaper, Nation's Building News, and monthly Builder magazine. BAM informs members through e-mails, on their website and passes information along to the local asso-ciations. Most of us don’t have the time to put in to do the research and study involved in attaining this information. I find this member benefit to be a huge asset. Our membership gives us the resources to stay on top of our industry. Most of our customers expect this from us. Until next time… stay busy and be safe!

Our April meeting held at I’ll Tile and Stone was fun, informative and filling. Skye, Troy and Ben did a great job of hosting and making us all feel welcome. Skye said she cooked all day. The “subs” were great Skye. A little test was given at the end. Did you know: That the average person spends about 14 days per year in the bathroom? That porcelain is fired twice which makes it stronger than ceramic tile? That Granite is a natural stone and Quartz is man made? That floor tiles can go on the walls, but wall tile cannot go on the floor? Thank you to I’ll Tile and Stone for hosting the April meeting.

There were 5 teams signed up to shoot, prizes and awards were given. 1st place went to Greens Plumbing and Heat-ing, 2nd place went to B & M Electric and 3rd place to Nodsle Construction. It was a good lunch with Jill Mickelson’s turkey and buns and bars pro-vided by Brenda Eidenschink, Carmen Nodsle, Ellie Francis, Carrie Roble and Sharon. Hopefully next year some new faces will come and be a part of this great spring event.
