Things have been really hopping! The Builder EXPO, which was a great success, had 20 vendors and 50 builders. The Home Show is down to one, maybe two, booths left on the Home Show side and the Sport Show

side is fully booked. What a great variety in both arenas! We are really excited about two new booths. Jeremy Elbert ,from Wildlife Pursuit (which is on channel 6 at 6:30 on Saturday nights), will be hosting a booth, signing autographs and giving two seminars. The KidSafe program is also hosting a booth. Parents are encouraged to bring in their children; have them fingerprinted & photo taken. Every year all that is needed is to just update the photo. I am hoping for a fully packed two days. There also will be Tri-State Diving doing free diving for those that may be interested in checking that out.

There has been a lot going on at the capitol with the governor pushing for tax increases, as well as, adding tax to other goods. BAM has been working on protecting the building industry from additional taxes that could raise the price of a home. There are articles in the newsletter, so be sure to read it all. There are also website listings that you can go to, to see if it will affect your business.

Our next meeting is at the D L Newspaper office on March 14th. We are checking into other venues to hold our meetings as the Speak Easy gets so loud you can’t hear the speaker.

I would really like to feature a member each month, so if you would like to be featured, please let me know.

BAM Builder Day at the Capitol A SuccessMembers from across the state came to St. Paul Janu-

ary 30th for BAM’s Builder Day at the Capitol. Represent-ing all 3,000 members of the association and the Minne-sota residential construction industry attendees met with a majority of the Minnesota Legislature to talk about the issues facing our industry.

Representative Mike Beard, Senator John Peder-son, and Senator David Tomassoni each spoke to BAM members about how important it is to meet with your legislators in person. It’s important to introduce yourself and continue to build your relationship. BAM’s lobbying team – Larry Redmond and Brian Halloran – echoed that message stating that making a connection “eyeball to eyeball” really makes a difference.

When you take the time to get to know your legislator, they make a personal connection with not only you – but the issues that are most important to you. When BAM sends an alert about an important bill, and you contact your legislator with a phone call or email, your contact makes more of an impact when you have a relationship with them.

If you weren’t able to come to the event there’s plenty of time to build a relationship with your legislator. BAM is working hard representing you and our industry at the State Capitol and we will be sure to keep you updated throughout session. Look for updates from BAM on what's happening and when to contact your legislators.

BAM’s Builder Day at the Capitol event was the first opportunity for many members to meet BAM’s new Executive Vice President Remi Stone. Her first day with BAM was January 16th. She brings more than 20 years of extensive experience with the Minnesota state govern-ment and the construction industry to her new role having previously worked as a lobbyist, practicing attorney, and director of government affairs for several organizations in

23 states and Washington D.C.“We welcome Remi’s experience and leadership to the

BAM community,” said Chad Kompelien, 2013 BAM Presi-dent. “She has a unique knowledge of the homebuilding in-dustry, our association, the legislative process, our issues, and a unique perspective of subcontractors, suppliers, building officials, regulators and municipalities across the state. In her new role as executive vice president, she will be responsible for extending BAM’s excellent reputation at the State Capitol and delivering value to the statewide membership.”

Stone has experience representing the Residential Subcontractors and Suppliers and the Association of Subcontractors, the statewide building officials association (AMBO), the League of Minnesota Cities and the Coalition of Greater Minnesota Cities, and the Builders Association of Minnesota and the Builders Association of the Twin Cities. Stone most recently served as the regional director of government affairs for MillerCoors Brewing Company. Earlier in her career, Stone served as Planning Commis-sioner for the City of Roseville and committee administra-tor to Minnesota State Senator Jim Vickerman.

Stone earned bachelor’s degrees in political science and sociology from the University of Wisconsin, Eau Claire, and served in the United States Air Force, Minnesota Air National Guard. Stone also earned a juris doctorate from the Hamline University School of Law where she currently serves as an adjunct professor.

“BAM is refocused, recharged, and hungry for success,” Kompelien said, “And Remi is the right leader to move BAM forward, driven by our core focus to represent the Minnesota home building industry in the legislative and regulatory arenas and the courts.”

New and now available online are updated BAM Foundation Wall Support Engineered Documents and updated BAM Cantilevered Foundation Wall Engineered Documents for 2013. The code guides and engineered documents are available on the BAM members-only website under the “Regulations/Codes” tab and the “Code Guides” section. You’ll need to log in with your username and password.

Dayton Budget: Capitol Insiders Tell Politics in Minnesota What Is Likely To Stick

Capitol gossip leads reporters at PIM to believe that the following list are the most and least likely proposals from the Dayton budget to be adopted by the legislature:

Most likely to stick: 1. Increase in income tax2. Broadening of sales tax3. Cigarette tax4. Affiliate nexus tax (MN-based affiliate goods

sold online)5. Reduced corporate tax rateLeast likely to pass:1. Business-to-business tax2. The $500 homestead credit3. Decreased sales tax to 5.5 percent4. A number of taxed services (auto-repairs,

legal services)5. A 2% increase to single people making

$150,000BAM is watching the sales tax issue very

closely and will continue to report on it. We will also let you know if and when a grassroots push is needed, so stay tuned.

State Revenues Surpass ExpectationsMinnesota Department of Management

and Budget released figures demonstrating that Minnesota revenue collections in January exceeded expectations by $140 million, or 8.3 percent, bringing in $1.82 billion for the month. Revenue from individual income taxes and sales taxes brought in $137 million more in individual incomes taxes than predicted in the November economic forecast.

FROM THE GOVERNOR'S OFFICEJust today, the Governor's office published

more information on how his proposed sales tax would affect the industry.

In the "Still Exempt" category for contractor and labor are:

1. Construction labor for construction, remodeling or improvement of real property remains exempt. Construction labor includes services such as wiring, welding steel beams, carpentry, laying bricks, cement finishing, pipe installation and plumbing.

2. Repair, installation and replacement of real property such as furnaces, garbage disposals, built-in dishwashers and stovetops, water heaters and softeners, and central air conditioning, or when you work on plumbing or electrical wiring also remains exempt.

In the "Newly Taxes" category are:Architectural services, engineering services,

environmental consulting services and repair labor to "restore tangible personal property so it can be used for its original purpose," such as: furniture re-upholstery, electronics repair, and refrigerator repair.

CONTRACTOR FINED $10,000 FOR UNLICENSED ACTIVITYIn October 2012, DLI revoked the license of a residential building contractor who was found to have submitted a license application that contained false or misleading information. The contractor was also fined $5,000. Also in October 2012, an unlicensed residential building contractor from Golden Valley was ordered to cease and desist unlicensed activity and fined $10,000. And another unlicensed contractor from Winona was fined $7,000 and ordered to cease and desist unlicensed activity. A St. Louis Park electrical contractor agreed to be censured and to file all future requests for electrical inspection electronically using CCLD’s eTRAKiT system. The contractor was also fined $5,000 with $4,500 of the fine stayed on the condition of no future violations. Products containing quaternary ammonia or pine-oil based cleaners should not be used. Use drain cleaners as a last resort to unclog pipes. Floor Drains from Garage and Workrooms Should be diverted away from your septic system. Items like petroleum-based oils, gas, and saw dust should never enter the system. Medicines Do not flush them down any drain. All antibiotic medicines are harmful to treatment quality. Unused medications should be returned to the pharmacy, doctor, or thrown away in the trash. Septic Tank Additives/Enzymes The wastewater in the system contains all the required bacteria for proper operation. Additives are unnecessary; and may do more harm than good.Paper Products Use single- or double-ply, non-quilted, white toilet paper products. LESSONS FROM THE PAST!Not too long ago I came across an e-mail that I had received back in 2006 from another consultant when the market was still hot. This e-mail was describing the associate’s preliminary finding about a prospective new client. An associate and I were scheduled to visit this company’s location the next month and the writing associate was giving us his impressions from multiple client calls in arranging the visit. This company had grown significantly over the preceding two years and was asking for help as they wanted to double their volume again in the next year. It didn’t happen. Between their situation and the housing bubble bursting this company was out of business fifteen months later.The message in this email is loud and clear and it is a classic example of what not to do when the market gets better. Excerpts from e-mail received from an Associate circa February 2006:“More about XYZ Builders - here's the scoop. It ain't pretty. • they are selling more than they can build - it's chaos. It almost buried them, and is set to again because they've

pre-sold a bunch of stuff but didn't figure in any cost increases. They have a real cash problem as a result. Get your money up front (that's a quote from their Controller)

• They are running out of lots and there will be a *9 month* lag as a result before production can get back in gear - major staff cuts will be necessary to keep the doors open during that period.

• They did $41,000,000 on 225 closings last year, but their ASP ranges from $200 to $800K - all over the place. The numbers don't add up.

• There is absolutely ZERO sales or production forecasting going on. They sell now, worry later. As a result, they did not plan cost acceleration on a whole series of communities they sold out - so now they're barely breaking even on them. On top of that - their field operation is way behind. Time of construction has increased by *months*.”

Five Lessons Learned:1. This experience confirmed my feeling that the biggest mistake most builders can make is to sell more houses

that they can build. 2. In good market conditions you have to control your lot inventory carefully.3. One way to control lot inventory is to adjust price to cover the housing inflation rate and the carrying costs

during sales period and construction.4. When sales are good, you need to stick with the plan, the budget and the dig slot schedule. Selling more than

that is as bad as not making budget. 5. During good market conditions we get cost creep that can ruin your profits, even in the good times. You have to

use inflation factors in your pricing models. These should be reviewed quarterly, at least. More often when the market appreciation rate exceeds 8% annually.

Please use this as a reminder if and when your market starts to heat up. Be careful and don’t get caught up in the philosophy that more is always better. Working to your budget and maximizing margin during the good markets is the right approach. CONTRACTOR FINED $10,000 FOR UNLICENSED ACTIVITYIn October 2012, DLI revoked the license of a residential building contractor who was found to have submitted a license application that contained false or misleading information. The contractor was also fined $5,000. Also in October 2012, an unlicensed residential building contractor from Golden Valley was ordered to cease and desist unlicensed activity and fined $10,000. And another unlicensed contractor from Winona was fined $7,000 and ordered to cease and desist unlicensed activity. A St. Louis Park electrical contractor agreed to be censured and to file all future requests for electrical inspection electronically using CCLD’s eTRAKiT system. The contractor was also fined $5,000 with $4,500 of the fine stayed on the condition of no future violations. Things have been really hopping! The Builder EXPO, which was a great success, had 20 vendors and 50 builders. The Home Show is down to one, maybe two, booths left on the Home Show side and the Sport Show

side is fully booked. What a great variety in both arenas! We are really excited about two new booths. Jeremy Elbert ,from Wildlife Pursuit (which is on channel 6 at 6:30 on Saturday nights), will be hosting a booth, signing autographs and giving two seminars. The KidSafe program is also hosting a booth. Parents are encouraged to bring in their children; have them fingerprinted & photo taken. Every year all that is needed is to just update the photo. I am hoping for a fully packed two days. There also will be Tri-State Diving doing free diving for those that may be interested in checking that out.

There has been a lot going on at the capitol with the governor pushing for tax increases, as well as, adding tax to other goods. BAM has been working on protecting the building industry from additional taxes that could raise the price of a home. There are articles in the newsletter, so be sure to read it all. There are also website listings that you can go to, to see if it will affect your business.

Our next meeting is at the D L Newspaper office on March 14th. We are checking into other venues to hold our meetings as the Speak Easy gets so loud you can’t hear the speaker.

BAM Builder Day at the Capitol A SuccessMembers from across the state came to St. Paul Janu-

ary 30th for BAM’s Builder Day at the Capitol. Represent-ing all 3,000 members of the association and the Minne-sota residential construction industry attendees met with a majority of the Minnesota Legislature to talk about the issues facing our industry.

Representative Mike Beard, Senator John Peder-son, and Senator David Tomassoni each spoke to BAM members about how important it is to meet with your legislators in person. It’s important to introduce yourself and continue to build your relationship. BAM’s lobbying team – Larry Redmond and Brian Halloran – echoed that message stating that making a connection “eyeball to eyeball” really makes a difference.

When you take the time to get to know your legislator, they make a personal connection with not only you – but the issues that are most important to you. When BAM sends an alert about an important bill, and you contact your legislator with a phone call or email, your contact makes more of an impact when you have a relationship with them.

If you weren’t able to come to the event there’s plenty of time to build a relationship with your legislator. BAM is working hard representing you and our industry at the State Capitol and we will be sure to keep you updated throughout session. Look for updates from BAM on what's happening and when to contact your legislators.

BAM’s Builder Day at the Capitol event was the first opportunity for many members to meet BAM’s new Executive Vice President Remi Stone. Her first day with BAM was January 16th. She brings more than 20 years of extensive experience with the Minnesota state govern-ment and the construction industry to her new role having previously worked as a lobbyist, practicing attorney, and director of government affairs for several organizations in

23 states and Washington D.C.“We welcome Remi’s experience and leadership to the

BAM community,” said Chad Kompelien, 2013 BAM Presi-dent. “She has a unique knowledge of the homebuilding in-dustry, our association, the legislative process, our issues, and a unique perspective of subcontractors, suppliers, building officials, regulators and municipalities across the state. In her new role as executive vice president, she will be responsible for extending BAM’s excellent reputation at the State Capitol and delivering value to the statewide membership.”

Stone has experience representing the Residential Subcontractors and Suppliers and the Association of Subcontractors, the statewide building officials association (AMBO), the League of Minnesota Cities and the Coalition of Greater Minnesota Cities, and the Builders Association of Minnesota and the Builders Association of the Twin Cities. Stone most recently served as the regional director of government affairs for MillerCoors Brewing Company. Earlier in her career, Stone served as Planning Commis-sioner for the City of Roseville and committee administra-tor to Minnesota State Senator Jim Vickerman.

Stone earned bachelor’s degrees in political science and sociology from the University of Wisconsin, Eau Claire, and served in the United States Air Force, Minnesota Air National Guard. Stone also earned a juris doctorate from the Hamline University School of Law where she currently serves as an adjunct professor.

“BAM is refocused, recharged, and hungry for success,” Kompelien said, “And Remi is the right leader to move BAM forward, driven by our core focus to represent the Minnesota home building industry in the legislative and regulatory arenas and the courts.”

Dayton Budget: Capitol Insiders Tell Politics in Minnesota What Is Likely To Stick

Capitol gossip leads reporters at PIM to believe that the following list are the most and least likely proposals from the Dayton budget to be adopted by the legislature:

Most likely to stick: 1. Increase in income tax2. Broadening of sales tax3. Cigarette tax4. Affiliate nexus tax (MN-based affiliate goods

sold online)5. Reduced corporate tax rateLeast likely to pass:1. Business-to-business tax2. The $500 homestead credit3. Decreased sales tax to 5.5 percent4. A number of taxed services (auto-repairs,

closely and will continue to report on it. We will also let you know if and when a grassroots push is needed, so stay tuned.

State Revenues Surpass ExpectationsMinnesota Department of Management

and Budget released figures demonstrating that Minnesota revenue collections in January exceeded expectations by $140 million, or 8.3 percent, bringing in $1.82 billion for the month. Revenue from individual income taxes and sales taxes brought in $137 million more in individual incomes taxes than predicted in the November economic forecast.

more information on how his proposed sales tax would affect the industry.

In the "Still Exempt" category for contractor and labor are:

1. Construction labor for construction, remodeling or improvement of real property remains exempt. Construction labor includes services such as wiring, welding steel beams, carpentry, laying bricks, cement finishing, pipe installation and plumbing.

2. Repair, installation and replacement of real property such as furnaces, garbage disposals, built-in dishwashers and stovetops, water heaters and softeners, and central air conditioning, or when you work on plumbing or electrical wiring also remains exempt.

In the "Newly Taxes" category are:Architectural services, engineering services,

environmental consulting services and repair labor to "restore tangible personal property so it can be used for its original purpose," such as: furniture re-upholstery, electronics repair, and refrigerator repair.

Greetings Everyone, I hope everyone has had a
