    Verma Committee Report - laudable & an eye opener!The UPA government had

    announced the formation of theJustice Verma Committee and askedto look into crimes against women andalso to suggest legal reforms necessaryto deal with sexual assault cases, inthe wake of the public outragefollowing horrific gangrape of a 23year old in Delhi on 16th December

    2012. The Committee was headed bythe former Chief Justice of India,Justice Verma with former ChiefJustice of Himachal Pradesh andretired Supreme court Justice, JusticeLeila Seth and former Solicitor Generalof India, Gopal Subramaniam as itsmembers.

    Eventhough the term of referencefor the committee was limited, thepanel interpreted expansively over600 pages which comprisescomprehensive path-breaking, aninsightful and laudable report. Theysubmitted it in an historical period of29 days spending almost 18 hours aday, despite given a time limit of 2months period, ending February 21st.which is to be commendable. Thecommittee felt and assailed thegovernment that women remain unsafebecause of poor governance which isthe rootcause of all crimes againstwomen, not dearth of laws, pointingout serious lapses committed by theDelhi police in the instant case. Thereport also lambasted for the lack ofaccoutability of public servants, theimportance of making derliction ofduty as a cognizable offence. Theprime recommendations of the reportsuggests rejection of death penalty forrape even in the rarest of rare cases,the convict may be released after 14years at governments discretion, atpresent being maximum 7 years. Ifrape causes death and leaves the victim

    in a vegetative state, the imprisonmentshould be 20 years to rest of convictsnatural life. Same for gangrape andrepeat offenders. If minor, minimum10 years jail upto life sentence, if thevictime dies or reduced to a vegetativestate, sentence should be for 20 years.

    Against reducing the age of ajuvenile from 18 to 16 years sayingthe jails lack reformatory andrehabilitative processes. No tochemical castration since mutilationof body is not permitted byconstitution. Not registering sexualoffences by the police is an offence.

    The panel recommendedsentences for new offences likedisrobing a women, trafficking,stalking, intentional touching,

    constitute an offence of sexual assaultwith a minimum penalty of 5 years.Calls for immediate review of TheArmed Forces Special Powers Act(AFSPA) and similar protocols forapplication to areas of conflict shouldbe revoked calling for stringentpunishment under the normal criminallaw. There should be no need for anyprior sanction to prosecute armypersonnel or para-military personnelwhen an accusation is of sexual offencecommitting a rape or sexual harassingof a woman, is not part of an officialduty. The committee calls forappointment of special commissionin conflict zones to monitor womenssafety and security. Other important

    recommendation is exempt disabled,physically and mentally challengedwomen from coming to police stationfor registering a complaint. A womanpolice officer should go to herresidence and record her statement inthe presence of an interpretor and can

    death sentence against crimes. Over150 countries in the world haveabolished death penalty. Moreoverwomens organisations, educationistsand elites in India felt death sentenceshould not be there for rapes.

    They had also received about80,000 suggestions which is sovoluminous from Indians and abroadwhich has created a record for the sadhappenings. The panel felt thatintroduction of death penalty is not adeterrent effect and infact could beregressive step. The womens groupalso felt against chemical castration.Having given value to thesesuggestions, the committeerecommended imprisonment for thewhole of remaining life as themaximum punishments foraggrevated cases of rape. If rapefollowed by a murder, there is alreadythe provision for capital punishment.Justice Verma commendedparticularly the youth forces for theirpeaceful and mature protests thatpaved way for the constitution of

    committee on amendments to thecriminal law and also forced to take ahard re-look at gender issues in thecountry. The report also takes intoaccount critical issues that plague thecountry such as food security andmalnutrition that force the womenacross the country, sexualharassments on a daily basis, arisingout of their economical conditionsleading to the class and caste aspects.Overall, the rural people are muchaffected and the cases are neverreported to the police.

    Eventhough most of therecommendations of the committeeare comprehensive, far-sighted andmust be congratulated for the big leap

    forward in the struggle for womensrights for its multi-dimensional report,there is no mention for setting up atimebound procedure for rape casesor for setting up of fast courts. Nowthe victim has to wait for a long 10years time for the judgement, leadingto gross injustices , it is advisable fora 3 months time-frame for thecompletion of the case. There is nomention of compensation to thevictims if proved other than medicalreimbursement. This is moredisappointing. Both costs should beborne only by the perpetrator of theoffence. The juvenile law should beamended from the present 18 yearsto 16 years atleast since most of thecrimes are committed offlate by the

    minors, going by records. Evenhardened criminals employ theminors for committing crimes. NowUnited Kingdom, Australia and USAthe minors can be sentenced right from10 years as to the enormity of crimes.Hence the punishments should beequal owing to the magnitude of thecrime.

    It is imperative that the panelsrecommendations should beconsidered by the parliament in itsensuing budget session itself andcontemplate for a stronger criminallaw with stringent provisions for theprotection of women in safeguardingtheir rights as enshrined in theconstitution, thereby make womens

    empowerment strong. It requiresgovernments will and firm resolve torespect the report and work for itsspeedy implementation forenactment of a strong law, thusmaking necessary amendments in thecriminal justice system.

Ina painful note, Justice Vermaremarked that in 1997, as ChiefJustice of India , I have issued ordersto the Chief Secretary, TransportSecretary and the PoliceCommissioner where there wasschool accident in Wazirabad. Hadthose 15 years old orders have beenfollowed and from the day of thecommittee was formed in Delhi,police started to take steps , removetinted glasses from buses andimpounded such buses in violationof permits. The said bus in Delhiwas penalised many times. Whydid not they act earlier? That couldhave been saved the girl.

    The committee felt that thegovernment has to choose betweenpolitics and the constitution.Politics is not about defeating theconstitution and hoodwinking theconstitution. The panel hasrecommened changes andamendments in the electoral lawsto enable disqualification of taintedMPs and MLAs upon a courttaking cognizance of certain offencesagainst them or if an electedrepresentative furnished falseaffidavit at the time of filing hisnomination. They wanted actionunder prevention of corruption actalso. As for the assets and liabilitiesdeclared by the candidate, they

    suggested that these be verified bythe CAG , if found false, report itto Election commission and moveto President for his disqualification.They should be punished for aminimum of 5 years imprisonmentand wanted disqualification fromthe date of his conviction to 6 yearsafter his release. There should bede-criminalisation of politics. It issore, when 31% of the electoralcollege has either been charged orconvicted , destortion of moralitywhich is inherent to discharge publicfunction, stands seriously impairedor eroded.The panel remarked thatthe lathi charge done on theprotestors at India Gate will alwaysbe an indelible scar on our

    democracy when the protestorswere simply demonstratingpeacefully.

    What is the watchword for all ethical codes ? Not I but

    thou thus, I is the outcome of the infinite beyond trying to

    manifest itself on the outside world. This little I is the conse-

    quence and have to go back and join the infinite, its own nature.

    Every time you say not I but thou and you take the false step of

    trying to manifest the infinite through the sensual world. That

    brings the struggle and evils into the world but after a time, renun-ciation must come, total eternal renunciation. The little I is dead

    and gone.

    All these vain desires of living and enjoying this life here are in

    some other place, bring death we have been degraded down to the

    animal and are now growing up emerging out of this bondage.

    We shall struggle hard but there will come a time when we shall

    find that it is impossible to be perfect here while we are bound by

    the senses. And then the march back to our original state of infin-

    ity, will be sounded. This is renunciation. We shall have to get out

    of the difficulty by reversing the process by which we got it and

    then morality and charity will begin.

    Through creation there are 2 forces. One is selfishness and

    the other is unselfishness. The one is aquisition and other is renun-

    ciation. The one takes and the other gives. From the lowest of the

    worms to the highest, the whole universe is the playground of thistwo forces. It does not require any demonstration but obvious to

    all. The process of love is competition, the real genesis of compe-

    tition is in love. The motive power of the whole universe whether

    it manifests itself is that one wonderful thing unselfishness, re-

    nunciation, love , the real, the only living force in existance.

    Gout and its management through

    AYURVEDAGout is a disorder characterised by sud-

    den recurring attacks of painful arthritis

    caused by deposits of monosodium urate

    crystals which accumulate in joints because

    of an abnormally high uric acid level in the

    blood. Joint inflammation can become

    chronic and deforming after repeated attack.Most of the people who have this attack

    develop kidney stone.

    In Ayurvedic, this condition looks like

    Vatarakta. Vatarakta also starts at feet. Gout

    also involves the metatarso phalangeal joint

    of the big toe. Pathogenesis of gout through the deposit of uric acid

    crystals and the influence of rakta dhatu has got similarity.

    Symptoms : Articular features are characterised in both the condi-

    tions. In Vatarakta janu, amsa and padasula and southam will be present.

    Redness (raga), warmth (usna), fever(jvara), fatigue(klama), cutaneous

    manifestation (tvakdushti), cutaneous modules (arbuda upadrava) are

    also mentioned. This disease is produced as a result of marga rodha of

    vata by rakta. Here an equal importance is given to vata and rakta.

    Diagnosis : Fasting uric acid level which is less 5 to 6 mg/dl is

    normal.Treatment:

    1. Amapachana with Trikatu Choornam.

    2. Snehapana is done with maha jiktaka grutham

    3. Virechana with Eranda Thailam with milk.

    4. Satva of guduchi.

    Diet : To take: 1.2 o 4 litres of water every day. 2. Green gram,

    wheat. 3. bitter gourd, drumstick, onion and dates.

    To avoid : Smoking and alcohol. Spicy, salty, deep fried, fatty and

    protein rich diet.

    rets, Oil for deep frying, 2 onions, 2 green chil-

    ies, 8-9 cloves of garlic, 1 inch piece of ginger,

    powder (lal mirch powder), 1 tsp coriander pow-

    der (dhania powder), 1 tsp garam masala pow-

    How to make Gobi Masala: First deep fry the washed cauliflower

    flowerets and keep aside. Now heat 2 tblsp oil in a wok. Make a paste of

    onions, green chilies, ginger and garlic and put it in the wok.

    Saute till it changes color and add the tomato puree to it. Now add

    all the spices, salt and kasoori methi and saute till oil separates. You cannow add the flowerets, add cup of water and mix well. Garnish withchopped fresh coriander and serve with rotis.
