It is laudable and May 8th, a great red-

letter day, that the Supreme court came

out heavily with its slew of

observations, with a scathing attack and

stringing criticism, rapping the CBI and

senior officials of the PMO and Coal

Ministry, over the coalgate probe. TheSupreme court Bench, headed by Justice

Lodha along with Justices Madan B. Lokur

and Kurian Joseph, after examining the

affidavit produced by CBI Director, Ranjit

Sinha, extremely expressed unhappiness

and perturbed by the manner in which the probe report into the coal

block allocations, shared with all and sundry in a casual manner, against

the directions of the Supreme court which ultimately diluted, changing

the heart of the probe. They also slammed PMO and Coal Ministry

Joint secretaries along with the Ministry of Law, Ashwini Kumar for

seeking and changing the probe report which mainly pertains to

allocations made in coal blocks between the years 2006 & 2009, when

the Prime Minister held the portfolio of coal.

The CBI drew a heavy flak from the Bench which dubbed the

agency as ‘caged parrot speaking in its master’s voice. It is a sordid

saga, there were many masters and one parrot alone. The whole direc-tions of the probe, the heart of its matter was changed on suggestions

by government officials who were part of the coal allocations scam.

The court quizzed what business do they have over the probe report

changed? and how on earth made the CBI to make it available when

the report was to be given to the court ? asked Solicitor General. The

Supreme court wondered that no sustainable progress was made in the

probe report ever since the registration of the case. It pains us to see

the CBI Director submits the regular interaction between the investi-

gating officers and Ministry officials continues. Is it the job of the CBI

to interact or interrogate ? Why do the CBI agree to the amendments?

The Judges averred and furiously remarked that they gave CBI a struc-

ture of stone in the Vineet Narain case but 15 years later, it seems CBI

is all sand’.

The Supreme court criticised the Union Law Minister Ashwini

Kumar for accessing the draft report along with government officers.

Does it not subvert the investigation and its processes when changesare made in the report, on the suggestion of the government officers?

After a three hour long tongue lashing sweeping observations, an-

nounced a slew of measures and directions to the government to re-

store the sanctity of the investigation, set a two months deadline for

initiating systematic reforms to insulate the CBI from the clutches of

extraneous pressures.

They said that government should not interfere in the CBI probe

, infact, nobody should intervene in the CBI’s investigation, except the

knowledge of the Director of CBI. The CBI must know how to stand

up against all pulls and pressures by government. The Apex court

issued a directive that the CBI officer , DIG Ravikant Mishra who was

originally leading the probe must be brought back from Intelligence

Bureau. No members of the 33 -member investigating squad to be trans-

ferred from the investigation processes. The Bench also said if the CBI

team feels assistance of experts, it can approach the court with an

application. An affidavit should be submitted by the government byJuly 10th, next hearing date, on bringing a strong law to insulate CBI

autonomy.

In the wake of Supreme court’s directions in the coalgate scam,

the CBI asserted that it would follow the matter in letter and spirit and

promised a thorough and equitable probe. Regarding CBI’s functional

autonomy and independent organisation, Attorney General

G.E.Vahanvati said that he would file an affidavit on July 3rd to insulate

CBI from extraneous influences. Then the bench directed the CBI to

file a status report on the progress by July 8th and posted for further

hearing to July 10th. These averments by the Supreme court made

pressure on the Law Minister Ashwini Kumar to submit his resigna-

tion.

In the meantime, after realising the seriousness of the situation,

the government has constituted a Ministerial Committee to study in

depth, the constitution of CBI, etc. and make necessary changes wher-ever necessary. It is imperative and an eye-opener that is a welcome

sign for the CBI should have administrative independence and inde-

pendent Lokpal. If things are not moved in the right direction as ex-

pected by the Supreme court, it may order constitution of an SIT, with

an independent probe under the Chairmanship of a retired Supreme

court Judge to probe the matter in a transparent manner.

The CBI should be made an

autonomous, independent body

with non-partison attitude like

CAG and Election commission to

conduct itself in a fair manner. The

whole coal scam stems from the

abject policy failure without any

standard guidelines, inefficient

state monopoly, necessitative

captive minings. The point ulti-

mately is to remove all the aberra-

tions in the existing law. If the law

is not amended and the CBI is notmade independent, the Supreme

court said that they will step in

for formation of the strong law

and hence the autonomy reforms

of CBI is a must for taking strong

actions in corruption cases with-

out any interventions in a fair

manner.

Gout and its managementthrough Ayurvedha

Gout is a disorder characterised by

sudden recurring attacks of painful

arthritis caused by deposits of

monosodium urate crystals which

accumulate in joints because of an

abnormally high uric acid level in the

blood. Joint inflammation an become

chronic and deforming after repeated

attack. Most of the people who have this

attack develop kidney stone.

In Ayurvedic, this condition looks like

Vatarakta. Vatarakta also starts at feet.

Gout also involves the metatarso phalangeal joint of the big tow.Pathogenesis of gout through the deposit of uric acid crystals and the

influence of rakta dhatu has got similarity.

Symptoms : Articular features are characterised in both the

conditions. In Vatarakta janu, amsa and padasula and southam will be

present. Redness (raga), warmth (usna), fever (jvara), fatigue (klama),

Cutaneous manifestation (tvakdushti), Cutaneous modules (arbuda

upadrava) are also mentioned. This disease is produced as a result of

marga rodha of vata by rakta. Here an equal importance is given to vata

and rakta.

Diagnosis : Fasting uric acid level which is less 5 to 6 mg/dl is

normal.

Treatment :

1. Amapachana with Trikatu Choornam.

2. Snehapana is done with maha jiktaka grutham.

3. Virechana with Eranda Thailam with milk.

4. Satva of guduchi

Diet: To Take: 1.2 to 4 litres of water every day.

2. Green gram, wheat

3. Bittergourd, drumstick, onion and dates.

To avoid : Smoking and Alcohol. Spicy, salty, deep fried, fatty and

protein rich diet.
