I t is a good augury andappreciable news to note that the planbeing considered by a committee setup by the central government to dealeffectively and take punitive action

against the willful defaulters with highvalue loans and to be tried in 30 daysin the court of law is a daring attempt.ArunJaitley, Finance Minister hadcategorically announced in the budgetto set up 6 new recovery tribunals,said that the government will work outeffective steps for revival of otherstressed assets which is a big leap forward that over 40000cases to the tune of 1.73 lakh crore rupees are pending in overcourts and debt recovery tribunals. The willful default caseswhich stood at 854 at the end of end of March 2011 has risensteeply increased to a high level of 1311 at the end of December2013 is very disheartening and disappointing.

The beleaguered Kingfisher Airlines and its promoterVijayMallya was declared as willful defaulter and is battling in variouscourts with lender banks owing about 4022 crore rupees to aconsortium of 17 banks altogether is a case in point. The FinanceMinister has set up a committee to advise measures to dealwith large defaulters under former Law Ministry Secretary,V.K.Bhasin as advisor. It is distressing to note that 30 non-performing assets of state run banks account for 40.2% of theirgross bad loan category. The gross non-performing assets of state run banks touched a mammoth figure of rupees 2.16 lakhcrore at the end of March which is an increase of 39% over theprevious fiscal causing the health of the banks deteriorate muchfaster. The non-performing assets of private companiesalsostood at an alarming level of 28.76 lakh crore as on 31 st

March 2014. At present, the lenders can initiate only minimallegal proceedings in a court of law against the willful defaultersand there are no faster legal backing for speedy trials andrecovery of dues. The summary trials are dealt under sections260-265 of the Code Of Criminal Procedure,1973. The willfuldefaulter after declaration, are not allowed to access capitalmarkets or seek more loans from a bank or financial institution.

The said committee appointed by the central governmenthas representatives from Indian Banks Association and debtrecovery tribunals and the Reserve Bank of India which felt thestrong and dire need to amend Sarfaesi Act and Recovery of Debts to Banks and Financial Institutions Act. If these strongmeasures are taken on the large willful loan defaulters forrecovery of dues, there will be greater impact. At present, thereis no strong law to try the willful defaulters and attach their

properties by a court of law within a specified period of timeand there is a long legal battle continued for years and it becomesvery difficult to take recovery measures and thereby thedefaulters enjoy and do not pay any dues to the lenders. Incase, if he dies, then it becomes abundantly difficult to recoverthe dues from their legal heirs which is also a long drawn process.In the process, crores of rupees are written off by banks andfinancial institutions every year which not only affects the fiscaland monetary health of the nation and the lender banks as well.The Non-Performing assets of the banks go up every yearcausing financial instability and the need for strengthening of their capital base and to meet other capital adequacy ratios.

It is imperative that the central government must bring astrong and stringent law to take punitive action upon the willful

defaulters within a specified period of time say 12 months byinstituting legal proceedings in a special court of law to be startedfor this great purpose and put behind bars if found true andrecover the dues forthwith after attaching their properties. Thiswill be a sound proposition and a warning signal for the willfuldefaulters.
