Dear Working Wise:I just read your story on vacation pay, which mentioned Holiday Pay and the Canada Day Weekend. I just started a summer job working in a garden centre store this month and my boss told me that I won’t be getting paid for the Canada Day Holiday, because I just started. He also said that I won’t get paid overtime for working Canada Day. Is that right? I also worked more than 100 hours over the past two weeks. I am entitled to overtime for those hours, right? Dear Suspicious:

Congratulations on the new job. Unfortunately, I don’t have great news for you—your manager is most likely right.

To be eligible for general holiday pay under Alberta's Employment Standards, you must:o have worked 30 days for your employer in the preceding 12 months;o work your scheduled shift before and after the holiday (unless employer consent is given);o work on the general holiday if requested; ando normally work that day of the week, e.g., if you don't normally work on Mondays, you are not entitled to be paid holiday pay for a holiday that falls on a Monday.

So, unless you worked for this same employer last summer, you are likely not eligible to receive Holiday Pay for the Canada Day Weekend.You were also wondering if you are entitled to overtime for working on the holiday. Again, because you are short the minimum 30 days of work, you are not eligible for the general holiday.

The good news is that you will be eligible for the Labour Day holiday.

Finally, you were wondering if you are eligible for overtime for working more than 100 hours during a two-week period. The short answer is yes, there is no minimum number of days of employment before you are eligible for overtime. For most employees, overtime is all hours worked in excess of eight hours a day or 44 hours a week. Overtime is calculated both on a daily and weekly basis. The higher of the two numbers is overtime hours worked in the week.

I mentioned that these rules apply to most employees, because some workers are exempted from Employment Standards, including Farm Workers. Farm Workers can include employees of a green-house that’s part of a larger food-producing farm operation, but it sounds like you work in an urban garden centre that’s connected to a larger retail store.
