MINUTES OF THE REGULAR MEETING OF THE TOWN OF BINGHAMTON TOWNBOARD HELD ON TUESDAY, MARCH 19, 2019, 7:00 P.M., TOWN OFBINGHAMTON TOWN HALL, 279 PARK AVENUE, BINGHAMTON, NEW YORK.

The meeting was called to order at 7:00 p.m. by Supervisor Rounds.

PUBLIC HEARING - 7:01 p.m. - TOB PDD Re-Zoning/PDD Zoning/PlannedRecreational District

Town Clerk Conklin confirmed that the Notice of Public Hearing had been properly posted andpublished. The purpose of the Public Hearing is to consider input on the Town of Binghamtonproposed rezoning, including zoning for various parcels related to PDD zoning, and the creationof and/or designation of a new zoning known as Planned Recreational District. SupervisorRounds stated that Ray Mastin would be making a small presentation. She further stated that theTown Council and Town Planning Board have gone through and re-evaluated some of thecurrent zoning of different properties that are in the Town, the current zoning and recommendedzoning by the Planning Board. Ray Mastin, Planning Board Member, discussedrecommendations from the Planning Board for PDD parcels in the Town that are not zonedcorrectly. Mr. Mastin provided a handout with zoning change recommendations for thefollowing areas: Mill Road, Ingraham Hill Road, Webb Road (originally Edward's property),Webb Road at the Micro Wave Relay Tower, Maxian Road, Maxian Road (Broome CountyPark), Hance Road, Pennsylvania Avenue (South Mt. Farms aka Lone Maple), Reynolds Circle(Torto's Orchard), Pierce Creek Road (Fahs Construction, Pierce Creek Road (DeninisConstruction). A copy of Mr. Mastin's handout is available for review at the Town Clerk'soffice. Supervisor Rounds opened the floor to anyone wishing to speak in favor of or inopposition to the rezoning.

John Mastronardi - Mr. Mastronardi asked if that once the parcels are changed to therecommended zoning, can they be changed to any other zoning. Mr. Mastin replied that they

would have to come before the Zoning Board of Appeals in order to be changed. Mr.Mastronardi asked if they can be changed multiple times. Mr. Mastin replied that as long asthere is a good reason for it; they would have to justify it.

Ken Frommer - Mr. Frommer asked if the Vestal Hills Golf Course was zoned FDD before. Mr.Mastin replied that the Golf Course was FDD, and that they came to the Planning Board whenthe Church was going to take the section out and asked that it be changed to an Rl. At that time,everything was changed to Rl. Mr. Frommer asked if the Veterans Center is Rl, and if thepermitted use will be as an Rl. Mr. Mastin stated that as far he knows it is. Mr. Frommer askedif it will be changed to a Planned Recreational District. Mr. Mastin stated that that is notsomething he is aware of, and suggested asking Town Attorney Pope. Town Attorney Popestated that the County can come in and put their use in. Mr. Frommer stated that the last time hewas here, the people that wanted to purchase the Golf Course wanted to change it over to an Rl.So, in order to get that done there were some conversations about the same deed restrictions thatwere put on the properties on the south side of Webb Road, and ultimately they agreed to thosedeed restrictions, and those deed restrictions were supposed to be enforced by the Town. Hefurther stated that since there is no longer a Golf Course there, there is no association to enforcethe rules; the Town said that they would enforce those rules, and those were the deed restrictionsthat Mr. Mastronardi read to them and were accepted by the people that owned the Golf Course.It is Mr. Frommer's understanding that the deed restrictions apply there residentially. He furtherstated that the Veterans Center has nothing to do with it since it is not road front property. Hestated that the deed restrictions were the 250' setback, 2500 square foot minimum house size.He asked if the Board knows if the deed change went from FDD to residential or not. Mr.Mastin replied that the whole parcel is zoned Rl . Mr. Frommer asked if that in order havesomebody change the zoning to something else, will there still be a process? Mr. Mastin replied,right. Mr. McGowan complimented Mr. Mastin on a job well done concerning the rezoning.The Board is awaiting the 239 Review by the County.

There being no other presentations to be brought before the Board, the floor was declared closedat 7:14 p.m.

Councilperson Bensley made the motion to approve the minutes of the Work Session held onMarch 5, 2019 as submitted, and the motion was duly seconded by Councilperson Xlander. Allthose present voted in favor of the motion. Motion carried.

Broome County Executive Jason Garnar - State of the County Budget - Update/Vestal HillsCountry Club/VA Center - Update - Broome County Executive Garnar spoke about BroomeCounty's Budget, which included the following topics: Finances; Towers/CommunicationsNetwork; Heroin Epidemic, and Work Force Development.

Broome County Executive Garnar explained the following handout: Broome County willconstruct, own and occupy the Broome County Veterans Services Complex. It will be located at3115 Webb Road in the Town of Binghamton. This is the location of the former Vestal HillsCountry Club and the county's purchase of the property includes the clubhouse and 80 acres ofland.

This project will serve as a multi-modal campus which will house extensive Veteran facilitiesand programming. This will be a one-stop shop for Veterans services, serving the over 13,000Veterans in Broome County. It will be a welcoming, quiet and safe place for Veterans and theirfamilies to congregate and receive services.

Veterans will be the direct benefactors of the proposal and are the reason for its existence.

The facility will include the Broome County Veterans Services Agency, Southern Tier Veteranssupport Group and Clear Path for Veterans Inc.

The facility will present a tailored approach to Veteran needs and the life cycle of a warrior - awelcoming place for Veterans to gather, develop and strengthen friendships and to promotecomradery.

The project will result in a considerable expansion of resources for Broome County's Veterans.Serving as a hub of information, programs, and resources, the proposal will help connectVeterans with skilled employment, establish residency, and successfully adjust to life outside ofstructured military service.

Broome County will renovate the existing clubhouse in Phase One. This phase will include thefollowing: Building shell improvements insulation, roof replacement, and windowreplacement; Facility code compliance - energy efficiency (heating), AD access (restroom

upgrades and elevator access); Site upgrades - ADA parking and external access; Complete firstfloor renovation - allocation of space to create modern workflow environment to include: 1)Office space for Veterans Services Agency, STVSG, Clear Path for Veterans; 2) Common spacefor gathering, canteen events, etc., and 3) Rehabilitate and clean up commercial kitchen.

Among the services to be provided at the center upon opening: connecting veterans to servicebenefits, providing support for Veterans through peer-to-peer services, canteen meals forVeterans, community forums for Veterans and employment and training workshops for Veteransthrough Cornell Cooperative Extension of Brome County and Broome-Tioga Workforce.

Long-term programs, services and activities include, but not limited to: Wellness programming,dog training for Veterans, gardening, exercise/fitness area, arts and crafts, food pantry and more.

Vision: Long term amenities, service and programs, including: Wellness program; connectingVeterans to service benefits; dog training program through Clear path for Veterans, Inc.; peer topeer services; canteen meals; community gardens through VINES; Vets in agriculture programthrough Cornell Cooperative Extension of Broome County; nutrition education; food-businessdevelopment; gardening workshops; community forums for Veterans; job preparation skillstraining through Broome-Tioga Workforce; mobile food pantry; Tai Chi and yoga; arts andcrafts; golf putting greens, and education classes. Broome County Executive Garnar's handout isavailable for review at the Town Clerk's office.

Questions were asked, answered, and points of views were expressed on the subject of theproposed BC Veterans Services Complex on Webb Road.

OFFICIALS AND COMMITTEE REPORTS:

Planning Board The next regularly scheduled meeting will be held on Tuesday, April 30, 2019at 7:00 p.m. at the TOB Town Hall.

Zoning Board of Appeals - There is a case pending that will be heard in April.

Youth Commission - Chris Streno, Youth Activities Director, gave the following report: Thesoftball and baseball registrations have been completed. There is one major softball team, fourminors, and one coach pitch, four major baseball teams and two minors. Practices have begun atBrookside and the Middle School. The younger kids with the coach pitch, baseball, and tee ballwill begin next month. There are approximately 42 kids signed up for that small league. They

will be playing in the Tri-Town League this year, both baseball and softball with Conklin andKirkwood. The Youth Commission is working with Conklin and Kirkwood to come togetherwith rules and schedules. Opening day ceremonies are being planned for Saturday, April 27th atJackson Park. New uniforms and equipment are in the process of being ordered. The YouthCommission is being updated on the progress at Jackson Park on a regular basis by Mr. Pappas.The Booster Club is currently raising money by selling banners to outfit the outfield fences atJackson Park. The Youth Commission will be voting this week to add a new member to theYouth Commission, bringing the membership from five to six. There are approximately 130kids registered for softball and baseball. The next regularly scheduled meeting is Thursday,March 21, 2019 at 5:30 p.m. at the TOB Town Hall.

Code Enforcement - Margory Street/Oswego Street - Mr. Pappas and Supervisor Rounds will bemeeting Friday with the Broome County Land Bank at the Margory Street property. SupervisorRounds stated that the Town is in receipt of the Deed for Margory Street, which has been filedwith the Broome County Clerk's office. Town Attorney Pope stated that the Town is waiting forthe County to decide what they are going to do concerning Oswego Street. Mr. Pappas statedthat there are four upcoming trials for code violations. Mr. Pappas attended an MS4 meeting lastweek. The yearly MS4 dues have been increased from $ 1,000 to $ 1,500. Two thousand dollars($2,000) will need to be budgeted for the Southern Tier 8 Regional Board test with the DEC for2021.

Highway Department - The Highway Department has been trimming trees, and may beginsweeping next week. The water contract with the City has been reviewed. A meeting will bescheduled with the City regarding a new water contract. Superintendent Donahue has beenplanning upcoming projects. Frontier will be replacing 90,000 feet of copper cable with fiberoptics.

SUPERVISOR'S REPORT:

Broome County Association of Towns - Monthly Meeting - The next monthly meeting will beheld on March 28, 2019, at Vestal American Legion 113, 118 Jensen Road, Vestal, New York at6:00 p.m. The guest speaker will be Douglas Garnar, Retired SUNY Broome Professor.

UNFINISHED BUSINESS:

MEGA CCA - Update - The Board has decided not to participate with the MEGA CCA energyprogram as there will be no significant savings for residents. The potential savings would beapproximately $12.00 per year for residents.

WBNG Transmission Building - The Town is in receipt of the signed counter-letter fromWBNG, along with a set of plans.

CDBG Grant - Update - Supervisor Rounds stated that the Town has been awarded a $500,000Community Development Block Grant for housing improvements for 15 qualified residents. Thepaperwork has been provided to the State, and the Public Notice for Requests for Proposals hasbeen published.

Open Councilperson Position - Update - Four letters of intent/resumes have been received. ThePersonnel Committee will be setting up interviews. The appointment will be made after May 2,2019 as the position will be vacated on April 27, 2019.

NYS Comptroller's Audit Report - CAP - Supervisor Rounds stated that the State Comptroller'sOffice responded to the CAP report. The State Comptroller's Office felt that the Town needs tomake it clear on how the Town is going to collect money that was deemed to be usedinappropriately. Supervisor Rounds did address the issue with the State Comptroller's Office.The Town is awaiting a response.

LED Street Lamp Conversion - Approval - N YSEG will be converting the Town's street lampsto LED lighting, which will be a $3,300 savings per year. The initial cost for the conversion willbe $1,400. There are 62 street lamps in the Town. There is some question regarding the City'sownership of some of the street lamps, so the final count may be closer to 55. The Boarddecided to have the street lamps replaced with 3,000 wattage LED lighting instead of 4,000wattage LED lighting. The project will be completed in 2020.

There was no further unfinished business.

NEW BUSINESS:

Hance Road Property - Tree Tops Surplus - Auction International - Highway SuperintendentDonahue suggested selling the tree tops surplus as firewood on Auction International to clean upthe logged area. A motion was made by Councilperson Bensley to approve the listing of the treetops and other wood leftover (surplus) from the logging harvest at 2945 Hance Road on AuctionInternational, and the motion was duly seconded by Councilperson Xlander. All those presentvoted in favor of the motion. Motion carried.

Citizen of the Year - The Citizen of the Year used to be held in January of each year, but poorweather conditions have impacted attendance. Consequently, this has been moved to June. Ifanyone wishes to nominate a resident for Citizen of the Year, they are to contact Vicky Xlander.

19th Annual Town Finance School - The 19th Annual Finance School will be held May 9th and10th in Saratoga Springs (with an alternate session being held in Ellicottville). SupervisorRounds will be providing information for the Finance School to Board Members for theirconsideration to attend.

VOICE OF THE PUBLIC:

Supervisor Rounds opened the floor to the public at 9:15 p.m.

Chris Streno - Mr. Streno stated that he did not plan to speak until he was listening to the BCVeterans Services Complex discussion. He stated that he shares some of the concerns, andunderstands the concerns of the neighbors there. He was disappointed to hear the expressions ofthe residents in the back of the Board room accusing the Town/County of sneaking behindpeople's backs, and not being open. Mr. Streno stated that he wants to stick up for his fellowPlanning Board Members. He further stated the following: The Planning Board did atremendous job on that project. He moved to this Town when he was 11 years old, and hemoved back as an adult with the hope that he would someday be sitting on the Town Board. ThePlanning Board position became open. He joined the Planning Board in the middle of updatingthe Comprehensive Plan. Again, another big project put out there to everyone that wanted tohear it, and then how many people show up to actually speak about it. He understands theconcerns, but there is a difference between expecting a service and actually getting involved. Hehad no intention of ever being on the Planning Board, but he does it because he wants to help thisTown, and provide a service to this Town if he can. It is evident by how many people left anddid not bother to stick around to hear the rest of the meeting. We have a fine website. It isunderstandable that residents cannot come to meetings. He has his own conflicts, but he doesn'thave a conflict going on the webpage and reading the agenda and reading the minutes. Ifanybody would have taken the time to read those agendas, they would have known what wascoming, and they could have come and participated in the process. So, he wants to commend thePlanning Board. The Town Board at the time did a wonderful job. He thanked the Town Boardfor having the County Executive come and present. He further stated that County ExecutiveGarnar did not have to come, he could have sent somebody, and he thinks he did a great job onthe presentation.

Supervisor Rounds stated that she attended the Neighborhood Watch meeting last Thursdayevening, and that there were approximately 25 attendees. She further stated that Chris Strenogave a wonderful presentation about active shooting and being in an active shootingenvironment. Supervisor Rounds thanked Mr. Streno for putting the program together, anddoing a great job.

Jim Cadden - Mr. Cadden stated that in connection with the active shooter presentation theAmerican Civic Association, what the man did at that time, was block the back door with his carso the people could not get out. He further stated that we have the same situation with the exit inthe Board room; that it can be blocked with a car and we cannot get out. What the CivicAssociation did was put in two big poles so that in the future a car could not come up to thedoorway, but the door could open and let people out. He inquired if the Town Board wouldconsider doing the same thing in the Board room for security purposes. Supervisor Roundsstated that there are other multiple exits in the Town Hall, but the Board will consider hissuggestion.

Supervisor Rounds thanked everyone for attending the meeting, and that the Board's goal is to beas transparent as possible. She further stated that she learned a lot today. She did call some ofthe residents on Webb Road, but did not call everyone, which gives her food for thought for asimilar future situation. She stated that the Town did try to get the word out so that residentscould come and voice their opinions.

There being no further presentations to be brought before the Board, the floor was declaredclosed at 9:22 p.m.

A motion was made by Councilperson Xlander to adjourn the meeting at 9:23 p.m., and themotion was duly seconded by Councilperson Bensley. All those present voted in favor of themotion. Motion carried.

The next meeting of the Town of Binghamton Town Board will be a Work Session to be held onTuesday, April 2, 2019, 5:30 p.m., at the Town of Binghamton Town Hall, 279 Park Avenue,Binghamton, NY.

NOTICE OF PUBLIC HEARINGTOWN OF BINGHAMTON

PLEASE TAKE NOTICE that the Town Board of the Town of Binghamton,Broome County, New York has approved a resolution calling for a public hearing toconsider input on the Town of Binghamton proposed rezoning, including zoning forvarious parcels related to FDD zoning and the creation of and/or designation of a newzoning known as Planned Recreational District. A public hearing will be held on theproposed action at the Town Hall, 279 Park Avenue, Binghamton, New York onTuesday, March 19, 2019 at 7:01 P.M., at which time all persons interested in the subjectmatter thereof will be heard. The purpose of the public hearing shall be to receive publicinput on this issue and to evaluate and consider adoption of the foregoing.

WHEREAS, the Town Board has before it for approval, certainAudited Claims and a request for authorization that said Audited Claims bepaid by the Town of Binghamton.

RESOLVED, that upon review of the Audited Claims by those BoardMembers present, the said Audited Claims are hereby approved for paymentby the Town of Binghamton; and be it further

RESOLVED, that such other Town employees or officials areauthorized to take such additional and further action as is necessary toimplement this Resolution.

RESOLUTION:

WHEREAS, the Town Board has before it for consideration arecommendation that the tree tops and other wood leftover from the timberharvest be declared surplus and sold through Auctions International asfirewood to a single contractor.

NOW, THEREFORE, be it

RESOLVED, that declaring surplus the tree tops and other woodleftover from the timber harvest is hereby approved and shall be soldthrough Auctions International as firewood to a single contractor; and be itfurther

RESOLVED, that the Supervisor, Highway Superintendent and suchother Town employees or officials are authorized to take such additional andfurther action as is necessary to implement this Resolution.
