The Bureau of Immigration (BI) will be monitoring the movement of fi ve Philippine National Police (PNP) gen-erals identifi ed by President Rodrigo Duterte as having link to illegal drugs trade, in case they attempt to leave country.

Unfortunately, many people do not fi le bankruptcy because of misin-formation. One of the most common questions people ask when contem-plating bankruptcy is “will I lose my home?” However, in today’s economy, where few people actually have much equity, the answer is NO!

The bankruptcy trustee will fi rst determine whether your home has equity, and how much. This involves determining the current market val-ue of the home, and subtracting the pay off amount, cost of sale, and any liens. If the equity is below specifi c homestead exemptions, you keep your home provided of course, you stay current on your monthly mort-gage payments.

The general rule of thumb is that if you continue to make your payments on time, the lender prefers that you stay in your house. Mortgage lenders, contrary to popular belief, are not anxious to foreclose on a property. It means a loss to them, as they will have to spend money holding the property and preparing it for resale.

Bankruptcy is also helpful if you are seriously behind on mortgage payments. IT will stop a foreclosure in its tracks, and through a Chapter 13 bankruptcy, provide you with a plan to amortize mortgage arrearag-es over a 5 year period.

In bankruptcy, there are exemp-tions, which render certain property outside the reach of bankruptcy. State law provides that the debtor be allowed to keep personal property up to a certain amount, for instance. If the debtor avails himself or herself of an exemption, that property cannot be used by the bankruptcy court to pay creditors.

Specifi c exemptions are provided through both federal and state law that enable most people to keep their home, since these exemptions usually exceed the home’s equity in today’s real estate market.

Chapter 7 & 13There are several types of bank-

ruptcy, each with different sets of rules and criteria. The most com-mon two types of bankruptcy are Chapter 7 or Chapter 13. Two other types, Chapter 11 and Chapter 12,

are lesser known and not used as often. Chapter 11 is used by business owners, and Chapter 12 is for family farmers. Single or married individu-als typically use both Chapter 7 & 13. In a Chapter 7, debts are discharged. In a Chapter 13, the debts are reor-ganized and paid back to the extent that the party is able.

What Should I Do?If you are a home owner, fi ling for

a Chapter 7, the fi rst thing to do is fi nd out whether your home has eq-uity. If there is equity, you and your bankruptcy attorney can determine if you qualify for an exemption. Typ-ically, in California, the homestead exemption for a married couple is $75,000.00, with higher limits for seniors. Keeping your home pursuant to an exemption is conditioned on the understanding that you will continue to make your mortgage payments.

However, if you still have sig-nifi cant equity, and the exemption is not enough to protect all of the equity in your home; you could still use a Chapter 13 debt reorganization with some partial payments and still protect your home.

MANILA, July 7 (Mabuhay) – The discretion of President Rodrigo Duterte to name the fi ve former and active police offi cials with alleged links to illegal drugs is trustworthy considering his background on criminal justice, the spokesman for the National Police said Thursday.

“We believe the President has enough information or holdings against these five generals. We respect that. We know the back-ground of our commander. He was a lawyer and prosecutor,” PNP spokesperson Senior Supt. Dio-nardo Carlos said in a television interview.

“We believe that the President has access to information coming from intelligence units from dif-ferent government agencies. What we have is information from [the] intel of PNP. We don’t have access on reports being submitted to the President,” Carlos added.

Duterte, three will be investigated by the National Police Commission (NAPOLCOM) because they are still on active duty – Chief Super-intendent Edgardo Tinio, Chief Superintendent Bernardo Diaz, and Director Joel Pagdilao.

The three met with PNP chief Director General Ronald dela Rosa on Wednesday and were advised to “face the music” during their “intimate and personal” meeting in Camp Crame.

Also on Wednesday, NAPOL-COM Commissioner Rogelio Ca-surao said the en banc has been given the directive to fi nish their investigation within seven days.

“The President is very clear on this matter. Ayaw niya na that the investigation will drag on. We are never going into that situation,” Casurao said at a press conference after their en banc session.

Carlos said the three were as-signed to the offi ce of Dela Rosa

for accounting purposes and will be supervised by NAPOLCOM. They are also ordered to stay in Metro Manila to answer to the investiga-tion panel.

Meanwhile, former Deputy Di-rector General Marcelo Garbo Jr. and Chief Superintendent Vicente Loot will not be under the juris-diction of the PNP since they have already retired from the service.

Carlos said Garbo is now a pri-vate citizen while Loot currently sits as mayor of Daanbantayan, Cebu.

“Garbo is now a private citizen while Loot is elected mayor in one of the towns in Cebu. In the case of Loot, the [Department of Interior and Local Government] will take cognisance of the case. [On] Gener-al Garbo, we look at the case at the level of the Department of Justice,” Carlos said.

MANILA, July 7 (Mabuhay) – Senator Juan Edgardo Angara on Thursday reiterated the need for the passage of Magna Carta for the Philippine National Police (PNP) to rid the police force of scalawags in-volved in corruption and the illegal drugs trade.

The senator has been fi ling the Magna Carta for PNP since his days in the House of Representatives and during his fi rst term at the Senate but it has yet to be passed. He once again filed a version in the 17th Congress.

Angara’s bill seeks to establish a separate salary scale for the PNP, distinct from the other agencies of the government, to attract more qualifi ed and competent law enforcers in the country.

This was after President Rodrigo Duterte named retired offi cers PNP Deputy Director General Marcelo Garbo Jr. and Chief Supt. Vicente Loot; Chief Supt. Bernardo Diaz, Chief Supt Edgardo Tinio, and Di-rector Joel Pagdilao as alleged pro-tectors of drug syndicates.

“Talagang nakakadismaya kung mapapatunayan ngang sangkot sa iligal na droga ang ilan sa mga matataas na opisyal ng PNP,” Ang-ara said in a press statement.

“We are hoping that through the passage of this measure, our police-men will be more encouraged to stay true to their commitment to preserve peace and order and protect the lives of the Filipino people rather than coddling drug lords and exacerbating the drug situation in the country,” he added.

MANILA, July 7 (Mabuhay) – A lawmaker has re-fi led the proposed Freedom of Information Act to fully promote good governance, account-ability and transparency in all branches of the government.

Rep. Raul V. Del Mar (1st District, Cebu City) said the still unnumbered bill seeks to strengthen the right of Filipino citizens to information held by the government by full public disclosure of all government transac-tions involving public interest.

“This same measure was already approved on third and fi nal reading during the 16th Congress. However, due to lack of quorum of the last session day, the subject Conference Committee report was not ratifi ed,” Del Mar said.

Under the bill, request of infor-mation shall be free of charge and could be requested personally, by electronic means or by mail to the government agency concerned.

The FOI Act shall cover the execu-tive, legislative and judicial branches which shall include the national government and all its agencies, de-partments, bureaus, constitutional commissions and mandated bodies,

offi ces of the Senators and Repre-sentatives, the Supreme Court and all lower courts established by law.

It shall also cover local govern-ments and all their agencies, regula-tory agencies, chartered institutions, government-owned or controlled cor-porations, including wholly-owned or controlled subsidiaries, offices and instrumentalities, government fi nancial institutions, state univer-sities and colleges.

Law enforcement agencies are also part of the FOI Act, including the Armed Forces of the Philippines (AFP) and the Philippine National Police (PNP).

Information shall be given upon request to every Filipino citizen and it shall become the government agencies and public offi cials’ duty to disclose all records pertaining to offi cial acts, transactions or decisions and government research data used as a basis for policy development.

“Access to public records means access to evidence vital to prov-ing public officials accountable for wrongdoing. Also, the new bill provides a convenient procedure to facilitate access to information

and remedies are also available for denial of access like administrative, civil and criminal penalties,” Del Mar said.

A Freedom of Information Manual shall be prepared for the use of the public and shall also be posted in the agency website.

Exceptions shall be granted if the information may compromise national security or interfere with any legitimate military or law en-forcement operations.

Immunity from the Act shall also be permitted if the information shall jeopardize the diplomatic and nego-tiating position of the Philippines.

The information shall not also be disclosed if it will expose identity of confi dential sources, techniques, guidelines and procedures of law enforcement investigations.

Furthermore, pieces of informa-tion that will constitute an unwar-ranted invasion of personal priva-cy such as signatures, addresses, telephone numbers, identifi cation numbers, family members, race or ethnicity, religion, sexual orienta-tion, health education shall not be part of the FOI Act.

On the other hand, the Statement of Assets, Liabilities and Net worth (SALN) of all public offi cials shall be mandatory disclosed on an annual basis.

Public offi cials shall include the President, Vice President, Cabinet members, members of the Senate and the House of Representatives, Supreme Court Justices, Constitu-tional commissioners and offi cers of AFP with the rank of a general.

All government agencies shall also publish datasets in the Open Date Philippines website and on Local Government Unit (LGU) websites.

The website shall be maintained and managed by an Open Data Task Force under the Offi ce of the Presi-dent. Request for information can also be tracked using the websites of concerned government agency, including the status, decision on the request and the matrix of the requests made.

Lastly, the principles of account-ability and transparency, democracy, leadership and good governance shall be integrated in the primary and secondary curriculum to guar-antee understanding of the FOI Act.

MANILA, July 6 (Mabuhay) – A measure seeking the full subsidy of irrigation fees for farmers recov-ering from the recent El Niño has been fi led at the Senate as part of legislation for the 17th Congress to work on.

Dubbed as the “Free Irrigation Services Act,” the bill filed by Senator Panfi lo M. Lacson will not require farmers to pay for irriga-tion fees which will be shouldered

instead by the government – once passed into law.

“Irrigation is a very basic govern-mental function that can very easily be shouldered by the state. It does not have to be passed on to farm-ers,” Lacson said on Wednesday.

“Considering that it is a key factor in increasing agricultural productivity, having the state subsidize it will go a long way in ensuring adequate food supply and

the early recovery of the principal means of livelihood of people in disaster-hit and poverty-stricken areas,” he said.

According to the senator, current laws allow the National Irrigation Administration (NIA) to collect fees from farmers tapped into irrigation systems. The fees are supposed “... to fi nance the continuous operation of the system.”

Philippine National Police Chief Director General Ronald “Bato” dela Rosa, who is leading the govern-ment’s anti-drug drive, earlier said a P50-million bounty was put up for himself and the president.

Duterte said Thursday he trusted the military and the police enough to secure him.

“The Armed Forces will not take it sitting down. The Philippine Na-tional Police, even if I’m gone, they will not allow these animals to have their day,” he said.

“And Leni Robredo, if she becomes the President will also be harsh kasi you are talking about the welfare of the country,” he added.

MANILA, July 8 (Mabuhay) – Several groups on Friday fi led charges against former President Benigno Aquino III and former Budget Sec-retary Florencio Abad before the Offi ce of the Ombudsman over the implementation of the Disbursement Acceleration Program, some parts of which were declared unconstitutional by the Supreme Court in 2014.

Aquino and Abad were charged with technical malversation, usur-pation of legislative powers, and graft and corruption by complainants led by Bayan Muna Rep. Carlos Zarate, Bagong Alyansang Makabayan and Volunteers Against Crime and Corruption.

“The DAP was nothing but a presidential pork taken from forced sav-ings then realigned for pet projects of the President. It was not a stimulus program as many of the projects approved by Aquino had nothing to do with stimulating the economy,” said Zarate.

This was the second criminal complaint fi led against Aquino since he stepped down from power and lost immunity from suit on June 30.

Last week, two relatives of the 44 police commandos killed in the 2015 Mamasapano incident fi led multiple homicide charges, citing Aquino’s approval of the operation which the complainants described as “fl awed.”

Aquino dismissed the complaint as mere harassment.

President Franklin M. Drilon has fi led a bill that introduces a 27 per-cent average increase in the salary of about 1.53 million state workers over a period of three years.

Senate Bill No. 13 or the Salary Standardization Law IV, which Drilon fi led recently, seeks to intro-duce reforms in the government’s compensation system to make it competitive with the private sector, and to boost the employees’ morale and productivity.

“The compensation for all civilian government personnel shall be com-

petitive with those in the private sector doing comparable work in order to attract, retain and motivate a corps of effective, effi cient, profes-sional, committed and competent civil servants,” Drilon said.

The bill mandates a three-year compensation increase for the na-tional government’s 1.53 million and military and uniformed per-sonnel.

The bill aslo provides for a mid-year month pay bonus equivalent to a one month’s basic salary and an enhanced performance-based bonus equivalent to one to two months’ basic salary.

In 1959, Neil Sedaka, who had dated King when she was in high school, had a hit single called “”Oh Carol,” which gave Guffi n the idea in writing a response song called “Oh! Neil,” which Carole King re-corded and released as a single the same year. Subsequently, a black girl group called “The Shirelles,” beame Billboard’s “”Hot 100” with the hit song, “Will You Love Me Tomorrow.” The hit song encour-aged Guffi n and King to quit their daytime jobs and concentrated on writing and the same song, “Will You Love Me Tomorrow,” became their standard song. Together, the

songwriting team of Guffin and King were the duo behind Don Kirschner’s “Dominion Records” label, which produced songs like “The Locomotion,” “It Might As Well Rain in September,” (King’s fi rst hit which she recorded herself in 1962)

Through 1967, the songwriting team of Goffi n and King wrote more than two-dozen chart-hit songs for numerous artists which included: :”Half Way To Paradise,” (for Tony Orlando); “Take Good Care of My Baby,” for Bobby Vee; “Up On The Roof,” for The Drifters; “I’m Into Something Good,” for Earl Jean, later done by Herman Hermits; “One Fine Day,” for The Cliftons; “Pleasant Valley Sunday,” for The Monkees; and “You Make Me Feel Like A Woman,” for Aretha Franklin.

The following year (1968), Goffi n and King divorced and King moved to Los Angeles where she formed a Trio composed of::Charles Larkey, her future husband , on the bass, Danny Kortchmar, on guitar and vocals and King on piano and vocals. They produced one album called “Now That Everything’s Been Said,” but was unsuccessful and the group disbanded the fol-

lowing year. Carole King continued writing

and performing her solo acts and by 1970, she scored her breakthrough album called “Tapestry,” which topped the Billboard charts for more than six years.

IN 2000. Billboard named King the most successful female song-writer of 1955-99, because she wrote and co-wrote 118 pop hits. In 2005, a music historian named Stuart Devoy. named her the most successful female songwriter on the U.K singles chart, 1952-2005.

Carole King’s most recent non-compilation album was “Live at the Troubadour,,” in 2010 a col-laboration with James Taylor, that reached number 4 on the charts in its fi rst week and has sold over 600,000 copies. Her record sales were estimated at more than 75 million copies worldwide.

King has won four Grammys, and was inducted to the Songwrit-ers Hall of Fame as well as The Rock and Roll Hall of Fame. She is also the recipient of the Library of Congress Gershwin Prize for Popular Song, the fi rst woman to be honored and in 2015, she was one of the honorees at the Kennedy Center. “

drive. The business started losing money, and could not pay the banks and the leases. Eventually, the truck that caused the accident was returned to the leasing compa-ny. Subsequently, the other truck was also returned to the leasing company. Each truck had a lease return deficiency of $40K each. Unfortunately, client personally guaranteed the leases, so the leasing companies have now sent a demand to client for $80K of lease deficiencies. To make matters worse, the banks have also sent a demand letter to client for $140K to call on his personal guaranty on the bank loans for the purchase of three trucks, which are now also seriously delinquent.

What did I say many times be-fore? Do not sign personal guaran-ties for business loans because you will be on the hook if the business cannot pay the loans. If you own a house, why risk your house with a personal guaranty for a business loan? In any event, client is now about to face lawsuits to collect on his personal guaranty for $220K! It doesn’t even end at $220K. The business itself will be facing law-suits arising from the accident for $700K. Fortunately for client, even though he owns a house, the equi-ty in the house is only $60K, well within the homestead exemption of $100K. So client opts for Chapter 7 to wipe out the $220K, keep his house and all his assets, to start life again without lawsuits. He can be productive again. Maybe he might even be able to go back to school and get his professional degree and license. In two years, with his degree and professional license, client should have no dif-fi culty making $250K gross a year.

The other client is 62. He still works a mid level management position and grosses $60K a year. Wife is a licensed vocational nurse and makes $36K a year. They make about $100K a year, which is good. They still have a daughter in college. They send her $1,500 a month out of state. Wife has a

sister abroad with a big family and insufficient income. Wife sends sister $500 a month. Husband has $40K of credit card debt. He pays $1,200 to keep that current. Wife owes $15K of credit cards. She pays $600 of minimum payments to keep them current. So, credit card payments are almost $2K a month, just to keep them current. Client says that they have been paying for these cards for ten years. They have paid $240K in ten years, and still owe the same $40K and $15K. However, client anticipates that he may just con-tinue working for another year or so. What happens then?

His income will be gone, and he will rely on social security, which is less than $2K a month. Might as well wipe out all credit cards now and save $24K this year, and another $24K next year, or save $48K in two years. Should have done it, Chapter 7, wiped out all his credit cards ten years ago, and set aside $240K more in his retirement account! And now, he would have $240K cash in is retire-ment accounts plus, he would have perfect credit today, if he fi led for Chapter 7 ten years ago!

Client is 45. He is actually a medical professional in his coun-try of origin. It would have been great for him if he could practice his profession here. Unfortunate-ly, his professional license is not recognized here. He is required to study another two years here in California to complete his profes-sional degree, and thereafter pass the licensing board. Since client already has a family with a wife and two kids aged 6 and 7, he be-lieves his priority is to make money to support his family, and not to study further to get his profession-al degree and qualify for a license to practice his profession here. His wife is a teacher and makes about $4K a month.

Client decided to set up a busi-ness. He set up a trucking business

with a business partner. They established a C-corporation with each owning 50%. The corporation purchased three trucks with in-stallment fi nancing provided by a bank, and leased two trucks. Client and partner both drove two trucks, and they hired three drivers for the other three. Each truck was gener-ating about $100K a year of gross receipt. On their fi rst year, gross receipts was about half a million $, less operating expenses of $480K. Considering that each partner got paid a salary of $2K a month which was part of operating expenses, plus the net profi t of $20K and the end of the fi rst year of operations, client’s trucking business was ok, but not that great. Business was able to pay all installment and lease payments and all expenses on time.

The problem came about when one of the trucks got into a seri-ous rear end accident out of state. Their truck rear-ended a car on the freeway that stopped all of a sudden. It caused a chain collision of six cars with drivers and pas-sengers suffering a lot of physical injuries. Client’s insurance carrier had limited liability, which was insuffi cient to pay for all damages. So now, the injured parties are suing the business for $$700K for injuries caused not covered by insurance. Their own driver was badly injured, and could no longer

Business owner chooses Chapter 7 for $250k personal guaranties on business loans

CEBU CITY, July 7 (PNA) – Daanbantayan Mayor Vicente Loot on Thursday said he is confi dent that he will be able to clear his name and prove that he never protected drug personalities.

In a speech last Tuesday, Pres-ident Rodrigo Duterte named Loot, retired PNP general Marcelo Garbo Jr., Chief Supt. Joel Pag-dilao, Chief Supt. Edgardo Tinio, and Chief Supt. Bernardo Diaz as “drug protectors.”

Loot, who visited the offi ce of Cebu Governor Hilario Davide III at the Cebu Capitol on Thursday, said he had served the Filipinos for 37 years as a military offi cer and police offi cer.

”I felt sad that these false and malicious allegations happened. But I am confi dent the truth will come out,” Loot said.

Loot was a chief superintendent of the Philippine National Police (PNP), a rank equivalent to a brig-adier general in the Armed Forces, when he retired in July last year.

Loot said he has been a victim of political black propaganda since his wife joined politics in the 1990s, and when he ran and won as mayor of his town last May 9.

He said that even the National Bureau of Investigation (NBI), through a certain Attorney Allan Contado, conducted a lifestyle check on him and his family and fi led charges for having ill-gotten wealth before the Office of the Ombudsman.

However, the case the NBI fi led against him was dismissed by Om-budsman Conchita Carpio Morales in a resolution dated Feb. 6, 2015, Loot said, because the NBI failed to substantiate the allegation.

Loot said their family assets amount to about Php 100 million, and these were acquired long be-fore he became a general.

He said everything has been dis-closed in their Statement of Assets, Liabilities and Net Worth (SALN), a copy of which is with the Offi ce of the Ombudsman.

Curtis revealed that she is cur-rently undergoing a rigorous kali martial arts training in prepa-ration for her movie with Filipi-no-American MMA star Brandon Vera, which will be directed by Erik Matti.

“Excited ako kasi nga hindi ko pa siya ginagawa and it’s actu-ally always been something that I’ve wanted to do. Game kaagad. Ine-enjoy ko siya. I guess it helps that I’m also very active. Doing something na challenging excites me,” she said.

I don’t know how to explain it in Tagalog but she’s a beast. If you’re lucky enough to watch Anne train, you can see how focused she is,” he said.

Garbo was the former Police Regional Office (PRO) Director and Deputy Regional Director for Operations (DRDO) of the National Police (PNP) offi ce in Region 7 and part of the Philippine Military Academy (PMA) Class 1981.

Calida clarifi ed that the “Jaguar” identifi ed in the chart is a different personality and not the “Jaguar” who was killed in a police operation in Las Pinas and was buried in Cebu.

Another alleged big time drug lord was identifi ed as Herbert Colangco, alias Ampang, who is now detained at the NBP. He is said to be involved in kidnap-for-ransom activities and bank robberies and is connected with the Parojinog Drug Syndicate and the Kuratong Baleleng group.

People included in the level 4 and down involves Chinese nationals and some offi cials of the PNP, the Bureau of Jail Management and Penology

(BJMP) and local government units (LGUs), the chart showed.

Among the sites being considered for the relocation of big time illegal drug prisoners are the Building 14 of NBP in Muntinlupa, the prison facil-ity in Tanay, Rizal; the facilities of the Intelligence Service of the Armed Forces of the Philippines (ISAFP), and the islands of Caballo in Cavite and another in Palawan.

On Tuesday, Duterte named PNP Deputy Director General Marcelo Garbo Jr., former National Capital Region Police Offi ce chief Director Joel Pagdilao, Western Visayas re-gional director Chief Supt. Bernardo Diaz, Quezon City Police District director Chief Supt. Edgardo Tinio and retired police general Vicente “Vic” Loot, for allegedly involved in illegal drugs.

Mangrobang noted that the BI knows what to do in case these PNP offi cials try to leave the country.

“The Immigration offi cer would ask for a travel authority, to also refer to the supervisor na this per-son has appeared. Kasi kung may hininging documents na present automatic na I-refer sa supervisor ‘yun,” she said.

With this, the BI offi cial said that they would coordinate with the PNP to give them additional information on the suspected drug lord.

MANILA, July 6 (Mabuhay) – To make it easy for the law to investigate and prosecute erring government offi cials and employ-ees, Senator Panfilo M. Lacson fi led a measure seeking to exclude them from the Bank Secrecy Law or Republic Act 1405, ahead of the 17th Congress which opens on July 25.

Senate Bill 47 removes from all public servants the protection under RA 1405, which prohibits the disclosure or inquiry into bank deposits, Lacson said Wednesday.

“Uncovering ill-gotten wealth of government offi cials may soon get easier. Law enforcement au-

thorities will be equipped with the tools needed to go after crooks in government,” Lacson said.

“The avowed purpose of the law is meritorious in preserving the confidentiality of bank transac-tions,” the senator noted.

“Unfortunately, this provision of the law prohibiting the disclosure of or inquiry into bank deposits had been exploited time and again to hamper and stall investiga-tions of government offi cials and employees suspected of enriching themselves while in public offi ce,” he emphasized.

Lacson noted his bill will amend Section 2 of RA 1405, to exclude

from the protection of the Bank Secrecy Law all depositors who are elected or appointed offi cials or employees of the government, from the President to the lowest-rank-ing employee.

The bill covers members of the uniformed services as well as gov-ernment-owned and controlled corporations.

RA 1405 or “An Act Prohibit-ing Disclosure of or Inquiry Into, Deposits With Any Banking In-stitution and Providing Penalty Therefore,” which was passed on September 9, 1955, covers:

“All deposits of whatever nature with banks or banking institutions

in the Philippines including invest-ments in bonds issued by the gov-ernment, its political subdivisions and its instrumentalities, are here-by considered as of an absolutely confi dential nature and may not be examined, inquired or looked into by any person, government offi cial, bureau or offi ce.”

Exemptions to the provision in-clude a written permission of the depositor, cases of impeachment, or upon order of a competent court in cases of bribery or dereliction of duty of public offi cials, or in cases where the money deposited or invested is the subject matter of a litigation. (MNS)

In 1998, US Congress enacted into law Part C, in answer to the clamor of seniors for more choic-es. This is more popularly known today as the Medicare Advantage Plan.

In 2003, President George W. Bush signed into law Part D. Part D takes care of prescription med-ications.

Who may join Medicare? US citizens and legal residents who are 65 or older; not yet 65 but have been receiving disability benefi ts for 24 months; and, those with End Stage Renal Disease and ALS or Lou Gehrig’s disease.

Medicare members are provided with 2 options: 1) Stay on Original Medicare, i.e. Parts A & B. Most members who pick this option en-roll on Part D. They may see any doctor that accepts Medicare, but they have to pay a share of cost (es-timated to be at 20%). If the total bill is $100,000, the member pays approximately $20,000 as his or her share. To protect against this (share of) cost, the member may enroll on a Medicare Supplement Plan.

The second option is: 2) Enroll on a Medicare Advantage Plan. Provided by private health insur-ance companies, Medicare Advan-tage Plans are mandated by law to provide undiminished benefi ts on

Parts A & B. Most plans combine the benefi ts of Parts A, B and D and embed dental, vision and hearing benefi ts not covered by Medicare. Other benefi ts offered by private companies are nurse helpline, transportation, gym membership, over-the-counter products, and medical emergency coverage outside the US.

Department of Health (DOH) Sec-retary Paulyn Jean Rosell-Ubial said on Monday that aside from fi ghting drug addiction problem and preventing any form of corrup-tion in the department, they will also be focusing on other health priorities at the same time.

In her fi rst offi cial press briefi ng as new Health Chief at the DOH Media Relations Unit in Tayuman, Sta. Cruz, Manila, Secretary Ubial assured that she will implement President Rodrigo R. Duterte’s marching orders versus drug ad-diction and corruption.

She said that they are starting to create a framework on how to make an entire government ap-proach in terms of addressing the drug problem in the country.

She admitted that while there are no specifi c details of that frame-work right now, she is considering the upgrading and expansion of the facilities of the treatment and rehabilitation centers under the DOH, wherein they can begin to do the planning and strategies.

“I think we can start with that… Upgrading and expanding the ser-vices of our treatment and rehab centers. But I know the Duterte administration is formulating a really comprehensive govern-ment-wide strategy to address drug problem in this country,” she said. She added that they are plan-ning to design a community-based program wherein the patients can go instead of proceeding directly to a rehabilitation center itself.

She also said that President

Duterte’s marching orders to be responsive to the needs of the peo-ple and being simple and frugal in spending of government resources should be followed in the entire de-partment. According to her, being frugal can be exemplifi ed through choice of economy plane tickets in travelling and using the simplest forms of transportation of DOH health unit staffs in their delivery of services. She also said she has started reminding the Food and Drug Administration (FDA) and licensing bureaus to speed up the licensing process and avoid long waiting of those securing licenses.

She admitted that while reduc-tion of long queues in government offi ces will be a challenge in hos-pitals, especially in the section of OPD (out-patient department), still, a lot of innovations can be introduced as a remedy.

She said that such can be done through software application by texting patients for doctor’s ap-pointment so they don’t have to wait long for their turn.

She reminded that all clients in every unit of the agency should be given the utmost courtesy, special attention that they themselves would like to be given when coming to other government offi ces.

She called on the health workers to ensure that they give the best services that they can offer to the people to move the health sector agenda forward. “I assure you, regional directors and hospital chiefs, that you have the full sup-port of the DOH Central Offi ce to ensure that you give the best ser-vices to the Filipino people.

New DOH Chief vows fi ght vs. drug addiction and corruption

a day to comply with the current law. Many caregivers are working under a day rate or monthly sal-ary. A day rate or monthly salary does not compensate for the over-time hours worked and results in a substantial unpaid overtime claim for the caregiver.

Oftentimes, employers attempt to avoid liability by claiming the caregiver is an “independent con-tractor.”

In most circumstances, this argument will fail as typically employers maintain significant control over the caregiver such that that California law will fi nd the caregiver to be an employee.

This change in the overtime rules for caregivers became effec-tive on January 1, 2014, when the Domestic Worker Bill of Rights (DWBR) became law. Previously, employees who qualifi ed as “per-sonal attendants,” including care-givers, nannies and babysitters who worked in private households, were The DWBR eliminated the overtime exemption for personal attendants and provides that personal attendants, “shall not be employed more than nine hours in any workday or more than 45 hours in any workweek unless the employee receives one and one-

half times the employee’s regular rate of pay for all hours worked over nine hours in any workday and for all hours worked more than 45 hours in the workweek.” So now caregivers, nannies and babysitters (with limited excep-tions) must be paid overtime compensation.

Under Labor Code § 1194, do-mestic workers are not only able to recover their unpaid overtime in a civil action, but they also may recover reasonable attorney’s fees and costs. California law also provides interest and penalties for workers who are not properly paid overtime compensation.

If you are working as a caregiv-er who is not paid overtime when working more than nine hours a day or 45 hours a week, you should consult with an attorney to discuss your rights under this law. With all the penalties, interest and at-torneys fees allowed, claims often exceed $100,000 for 24-hour em-ployees working just over 1 year.

MANILA, July 6 (Mabuhay) – Filipino Muslims marked the end of a month-long with Eid al-Fitr, beginning a three-day celebration on Wednesday with their friends and families.

Eid al-Fitr is the culmination of Ramadan, when Muslims observe abstinence from vices and contem-plate on their spiritual struggles.

MANILA, July 7 (PNA) – A new policy being implemented in lug-gage screening is seen to rid once and for all the so-called “tanim-bala” (bullet-planting scheme) in Philippine airports.

Newly installed Philippine National Police-Aviation Security Group (PNP-Avsegroup) Director General Senior Supt. Mao Aplasca made this assurance to passengers traveling by air that they will no longer be extorted.

“The new policy is to look at the background of people (caught carrying bullets) before they are prosecuted. For example, the elderly are very unlikely to have criminal or terroristic intentions,” Aplasca told reporters in an interview on Thursday.

Aplasca said President Rodrigo Duterte and Transportation Sec. Arthur Tugade ordered to end immediately these extortion attempts at the country’s premier airport.

“If we do not fi nd a hint that they are part of criminal or terrorist elements, we will release them. Anyway, they can be traceable based on documents they have,” Aplasca said.

They will profi le all incidents and choose those that will be fi led in courts, he said.

“Our primary job here is to provide assistance and protect the public. We are not here to fi nd fault or prosecute... We equally as-sure that the public is protected of criminal elements and terrorist intentions,” Aplasca said.

Bullet-planting scheme now a ‘thing of the past’: airport police

MANILA, July 6 (PNA) – Tour-ism Secretary Wanda Corazon Teo has said she will continue the annual staging of Madrid Fusion Manila (MFM) which fi rst mate-rialized under the helm of former Tourism Chief Ramon Jimenez Jr.

The MFM is the fi rst and only Asian edition of Madrid Fusion –- Spain’s famous culinary event and one of the leading gastronomy gatherings in the world.

It was fi rst held in Manila in April 2015 and a second time this year. “Yes, we will continue Ma-drid Fusion Manila. We will try to invite Anthony Bourdain,” Teo told reporters in an interview, referring to the award-winning chef and TV host. To recall, Bourdain was in the Philippines last December 2015 to shoot a special segment for

his three-time Emmy Award-win-ning show “Parts Unknown” which aired in April 2016.

Teo revealed that during her meeting with Jimenez before she offi cially became his successor, one of his requests was for her to con-tinue the projects already started, to which she said she would.

DOT Chief vows to continue annual staging of Madrid Fusion Manila

CEBU CITY, July 6 (PNA) – Thai Smile Airways has an-nounced it will offer Bangkok-Ce-bu-Bangkok direct air services starting in October this year.

Thai Smile, in a press statement by the Department of Tourism (DOT), said it will fly to Cebu daily, three times weekly in the morning and four times weekly in the afternoon.

The airline will be using an Airbus A320 with 162 dual class seats, with 12 business class and 150 economy class seats.

Cebu Association of Tour Oper-ators president Edilberto Mendoza Jr. welcomed the entry of a new airline with a direct fl ight to an-other country.

“It is really good news for all of us who loves to go to Bangkok. Cebu is really opening its doors to the rest of the world. Thanks to our new airport expansion that is opening very soon,” Mendoza said.

Stephanie Villahermosa, man-aging director of Divaishnavi In-ternational Inc., a travel and tour agency, said Thai Smile’s entry to Cebu will defi nitely add “more fun, endless possibilities and wonders.”

Thai Smile Airways is the re-gional airline and wholly-owned subsidiary of Thai Airways.

Based in Thailand, it began operation in July 2012.

Thailand is also located strategically between the Philip-pines and Europe, the Middle East, and India, where visitor traffi c to the country registers double-digit growth annually.

Arrivals from Thailand to Cen-tral Visayas during the fi rst quar-ter of 2016 stood at 1,757, up by 29.70 percent compared to the 1,361 arrivals recorded in 2015.

Cebu, specifically, welcomed 1,280 guests from Thailand, up by 15.52 percent. Of the ten Associa-tion of Southeast Asian Nations (ASEAN) member countries, Thai-land is one of the biggest tourism source market for the region next to Singapore and Malaysia.

Central Visayas closed 2015 with 6,076 total arrivals from Thailand, a growth of 5.63 percent. Cebu welcomed 5,028 Thai visitors. MANILA, July 6 (Mabuhay) – Lawmakers who skip work and don’t attend sessions at Batasang Pambansa could soon see a deduction in their salaries just like regular employees if a bill fi led by Navotas City Rep. Toby Tiangco becomes a law.

House Bill 412 proposes a “no work, no pay” policy for members of Congress.

Under the measure, appropriate deductions will be made to the the salaries of lawmakers who fail to attend the regular and special sessions for unjustifi able cause.

The salary per session day is computed by dividing the monthly salary by the number of session days.

The total deductions, meanwhile, is computed by multi-plying the salary per session day by the number of absences.

Using the formula provided for in the bill, a lawmaker’s net monthly pay will be equivalent to his monthly salary minus total deductions.

The Civil Service Commission, the Commission on Audit and the Department of Budget and Management, in coordi-nation with Congress’ accounting department, shall issue the rules and regulations necessary to implement the proposal should it be passed into law.

In seeking the bill’s passage, Tiangco said some lawmakers have been remiss in their duty to attend sessions religiously despite laws requiring them to do their job as government offi cials “with utmost devotion and dedication to duty.”

He noted that the lawmakers’ attendance continue to be a problem even when House of Representatives leaders in previous Congresses shortened the number of session days per week from four to three, with Thursday remaining a free day for legislators to visit their districts.

Tiangco said the bill’s passage will “promote professional-ism, dedication to duty and effi ciency in the performance of duty” since the lawmakers’ presence is required to represent the people and give their constituents a vote in Congress.

MANILA, July 6 (Mabuhay) – Senator Gregorio “Gringo” Honasan II lamented on Wednesday the “trial by publicity” on the fi ve former and active police generals earli-er named by President Rodrigo Duterte as coddlers of drug lords.

In a statement, Honasan emphasized that due process and the rule of law should prevail.

“The names are immaterial as long as due process and the rule of law are applied; and until the fi nal verdict on their guilt or innocence, they should not be subjected to trial by publicity dahil kawawa naman ang mga pamilya at anak na walang kinalaman dito,” he said.

Honasan issued the statement even as fellow Senator Panfi lo Lacson said that he had no reason to doubt the validity of the in-formation of the President in naming the top cops allegedly involved in illegal drugs trade.

Lacson said that Duterte must have had “good basis” in divulging the names of the generals.

“All I’m saying is, since the President

himself mentioned those two names among the fi ve, he must have good basis in what he divulged, especially if he had a different source of that information,” Lacson said on Wednesday.

Lacson said that he received information on two of the fi ve generals during the cam-paign period.

In his speech during the 69th anniversary of the Air Force, Duterte named retired Dep-uty Director General Marcelo Garbo; retired Chief Supt. and now Daanbantayan town mayor Vicente Loot; Chief Supt. Joel Pag-dilao; Chief Supt. Edgardo Tinio; and Chief Supt. Bernardo Diaz as drug lord coddlers.

“I am compelled by my sense of duty to tell you everything, especially the policemen who are involved in drugs. One way or another [they are] contributing to the deterioration of the law and order of the country,” Duterte said.

MANILA, July 6 (Mabuhay) – Philippine National Police (PNP) Chief Superintendent Edgardo Tinio on Wednesday said he was publicly humiliated when President Rodrigo Duterte dropped his name as one of the po-lice offi cials allegedly involved in the illegal drug trade.

Tinio said Duterte’s claims have put him in public humiliation.

“Alam ninyo naman po, nakakahiya ‘yang nangyari na ‘yan. Ang nangyari po ay public humiliation at trial by publicity,” Tinio said.

Tinio stressed that the information Dute-rte might have gotten from his sources and other police offi cials should have been verifi ed fi rst before calling out their names in public.

“Sana bago po niya tinuran ‘yung mga salita na yun, bago po kami binilad sa kahi-hiyan, dapat po sana vinalidate maigi ‘yung kaniyang impormasyon. Kaya willing po ako humarap sa kahit sino mang impormante ng Presidente, kung sino mang opisyal ang nagsabing ako ay involved sa illegal drugs,” he said.

“Imestigahan po ang dapat imbestigahan. Malaman po sana, and we get to the bottom of these cases. And linisin po ang pangalan ng mga hindi talaga sangkot sa illegal drugs,” he added.

At the same time, Tinio stressed that he was never involved in any illegal drug oper-ations even when he was only a low-ranked police offi cer.

MANILA, July 6 (Mabuhay) – The busi-ness process outsourcing (BPO) sector contin-ues to be a major growth driver of Philippine economy, but the economic managers of the Duterte administration are not keen on re-lying too much on the sector as technological advancements may lead to a decline in its contribution to the gross domestic product (GDP).

“Secretary Dominguez is raising concerns on BPO. We should not be too reliant on BPO. It might change in the future,” newly-ap-pointed Budget and Management Secretary Benjamin Diokno told reporters in a briefi ng in Pasay City.

Finance Secretary Carlos “Sonny” Domin-guez III said the country has to prepare and make sure that the economy will not be af-fected in case the demand for manpower will no longer be as robust as it is now.

Although this may not be in the immediate future, manpower may be taken over by arti-

fi cial intelligence, the Cabinet offi cial noted.“We just want to make sure we are pre-

pared if there are any breakthrough de-velopments in new technology for artifi cial intelligence,” Dominguez said.

Data from the Philippine Statistics Au-thority (PSA) showed the services sector, which includes BPO, was the main driver for the fi rst quarter gross domestic product (GDP). Services accelerate by 7.9 percent in January to March from 5.5 percent year-on-year.

“The strength of both the industry and services sector once again shows the ongoing structural transformation taking place in our economy, which is crucial for sustaining economic growth and generating quality jobs,” then-Socioeconomic Planning Secretary Emmanuel Esguerra said.

In 2015, the services sector contributed 4.1 percentage points to the total GDP growth of 5.8 percent.

MANILA, July 7 (Mabuhay) -- The head of the Philippine National Police (PNP) said Thursday he was against vigi-lantes as he reminded his men at the forefront of President Rodrigo Duterte’s relentless anti-narcotics campaign to mount only “legitimate” operations.

Since Duterte’s election victory on May 9, roughly 120 drug suspects, including alleged Cebu kingpin Jeffrey “Jaguar” Diaz, have been killed by police and there will be “more to come,” Director General Ronald “Bato” dela Rosa said.

Dela Rosa sought to allay rights groups’ fears that the wave of killings would inspire vigilantes. “Ayaw ko vigilante. Gusto ko legitimate police operation lang ang mangyayari.”

“Pag ganun papasok mga vigilante, ano mangyayari? Anybody can be killed anytime without due process,” he said.

Police have said that the drug suspects who were killed were shot by police because they resisted arrest and fought back.

“Magiging normal ‘yan pag normal din na lumalaban ang mga suspect. Ang importante diyan, buhay ang ating pulis pag sila nagcoconduct ng operations,” he said.

But Dela Rosa also cautioned his men against abusing their authority.

“Ayusin nila trabaho nila. Dapat malinis trabaho nila na hindi sila gagawa ng kalokohan,” he said.

President Rodrigo Duterte is hell bent in doing everything with-in his power to get the job done in eradicating the serious illegal drug problem in the Philippines.Everybody must have been jolted by Duterte’s bold decision to name the fi ve police generals allegedly involved in illegal drug trade in the country.This is a good sign that Duterte is really determined in implementing drastic changes in the country as far as peace and order is concerned.

Named as either drug lords or pro-tectors of drug lords in their respective turfs were Police Generals Joel Pag-dilao, Edgardo Tinio Bernardo Diaz, Marcelo Garbo and Vicente Loot.As expected, the pol ice gen-erals denied having anything to do with illegal drugs. They also denied coddling suspected drug lords in their respective areas.President Digong should order his investigators to look into the bank accounts of these generals to fi nd out if they were able to ac-cumulate huge amounts of money from the illegal drugs business.Garbo and Loot have retired from the police service. Loot is now a town mayor in Cebu. Generals Tinio and Diaz have been identifi ed as being close to losing presidential candidate Mar Roxas. They were seen by the media having a conference with Rox-as shortly before they May 9 elections at the Novitel hotel in Quezon City.Sources were saying that had Roxas won the presidency, Tinio would have been his choice to be his PNP chief. Good thing Roxas lost.President “Digong” must have in his possession a great deal of evidence to sort through, or else he would not have named or shamed in public

the fi ve police generals. He now has gotten the attention of the people regarding his seriousness in eradi-cating criminality and the prolifer-ation of illegal drugs in the country as he had promised throughout his presidential campaign in May.The public is now eagerly awaiting his announcement in naming three provincial governors and 32 city and town mayors reportedly involved in illegal drugs. These local offi cials, he was told by his reliable informants, were either drug users or drug lords or were protecting drug syndicates in their respective areas.

I expect President Digong to name these erring local officials within the next few weeks as he embark on a more aggressive campaign against drug syndicates operating almost in all parts of the Philippines.President Digong should also look into the possible involvement of two senators rumored to have strong ties with big time drug lords. He should also look into the possible involve-ment of movie personalities in the illegal drugs business since most of them are drug users.

There is no doubt that President Digong knows what he is doing since he is a lawyer and was once a government prosecutor before he became mayor of Davao City.Although I know one of these days that he will start implementing dra-

conian measures against the prolif-eration of drugs as well as in going after big time drug lords,

I hope President Digong’s all out campaign against criminality will be conducted within the bounds of law.However, I still see an uphill battle the Duterte administration will face in its effort to put behind bars all these drug lords and erring govern-ment and polio ex offi cials involved in illegal drugs.

It is no secret that the drug business in the country has not only corrupted government of-ficials but the judiciary ax well.President Digong should also start investigating fi scal and judges sus-pected of coddling drug lords in their areas. As a warning to other police offi cers, President Digong ordered

PNP Chief De la Rosa to immediately relieve the three active PNP generals and conduct further investigation to strengthen the criminal case against the erring police offi cials.The DILG as well as the Nation-al Police Commission will also conduct separate probe on the five police generals. These err-ing police generals, once convicted if found guilty, will be forfeiting their retirement benefi ts and other perks entitled to a police general.This should serve as a warning to other government offi cials and police offi cers who have been in cahoots with drug lords for a number of years.Duterte’s campaign against drug syndicates will be a major factor in eradicating, if not minimizing crimi-nality in the country.

Digong declares war on illegal drugs

ing to fi nally stop the disturbing scenario of inmates at the New Bilibid Prison continuing to enjoy perks ranging from cash to drugs to gadgets and fi rearms and even fi ghting cocks and exotic pets.

Lacson’s Senate Bill No. 46 proposes stiffer penalties, including impris-onment of 20 to 40 years and a fi ne of PHP10 million, for visitors who try to bring in fi rearms or ammunition to an inmate.

According to Lacson’s proposal, attempts to bring in other contraband may mean an imprisonment of six to 12 years and a fi ne of PHPP1 million and those who try to assist in smuggling fi rearms or ammunition may face imprisonment of 12 to 20 years and a fi ne of PHP5 million.

Lacson lamented that the continued enjoyment by inmates of such perks has given Philippine corrections authorities’ image a black eye.

Under his proposed law, the prison guards and offi cials who would allow such items into the penitentiary would also be facing stiffer penalties.

“A stiff penalty is required in this circumstance in order to instill fear and be an effective deterrence to those contemplating of doing this crime in the future. More importantly, the said penalty applies as well to gov-ernment offi cials or employees who cooperate or co-opt with the inmate or other private persons involved therein,” he said.

LOS ANGELES - New U.S. Census Bureau population estimates released on Thursday, June 23 show that the Asian American population is the fast-est growing racial group nationwide. Asian Americans Advancing Justice-Los Angeles’ analysis of the data shows that between 2010 and 2015, the number of Asian Americans grew 19%; during this same time period total overall popula-tion growth was only 4%. There are now about 21 million Asian Americans living in the United States. Native Hawaiians and Pacifi c Islanders (NHPI) are now the second fastest growing racial group, growing 13% to 1.5 million.

The new mid-decade Census data show that while certain states like California, Texas, New York, Wash-ington, and New Jersey continue to have large Asian American popula-tions, other states such as North Da-kota, South Dakota, Iowa, Montana, and Indiana have some of the fastest growing Asian American populations.Asian American population growth also

continues to outpace growth among other racial groups. For example, Asian American numeric growth exceeded that of Latinos in four states – Minnesota, Michigan, Vermont, and Washington.While the largest NHPI populations con-tinue to grow in Hawai’i and California, the NHPI community in Arkansas re-mains one of the fastest growing.
