MANILA, May 26 (Mabuhay) – Presump-tive president-elect Rodrigo Duterte will pursue holding dialogues with rebel groups, including the Communist Party of the Phil-ippines (CPP) and the Moro National Liber-ation Front (MNLF).

Duterte disclosed that he spent three hours talking to Fidel Agcaoili, National Democratic Front (NDF) spokesman, on Wednesday evening in Davao City. The NDF is the political arm of the Communist group.

Duterte, arguably the most controversial president ever elected by the Filipino peo-ple, is dead set on meeting his self-imposed deadline of six months to wipe out crimes and illegal drugs in the Philippines.

This was assured over the week by Dante Jimenez, founding president of Volun-teers Against Crime and Cor-ruption(VACC) and believed to be one of the members of Duterte’s “inner circle.” Jimenez made the assurance during a luncheon meeting

with journalists and commu-nity leaders in Los Angeles.

Although it is becoming an increas-ingly common word, what exactly does bankruptcy mean? Simply put, bankruptcy can be defined as the legal process through which the Fed-eral Government provides people in fi nancial distress with a fresh start.

The two kinds of bankruptcy that you may qualify for. They are called Chapter 7 and Chapter 13. There are various factors that would determine eligibility for either Chapter 7 or Chapter 13. Chapter 7 Bankruptcy is a discharge of all unsecured debt. Chapter 13 is for people who may have signifi cant non-exempt assets, and would be required to enter into a whole or partial repayment plan over a fi ve year period.

Of course, there are intricate details to this legal process. Who qualifi es? Which bankruptcy chapter would apply to you? Is all of your property exempt? There are many questions to resolve before deciding if bankruptcy is for you. Consult a competent bankruptcy attorney to advise you on all the options available in your particular situation.

This week’s FAQ’s.Q: Creditors are harassing me –

but I lost my job, and cannot pay. How do I stop them calling?

A: If you cannot pay your bills, creditors will take steps to collect. That’s natural, but continued harass-ment can be emotionally depressing. If you have lost your job, or simply cannot cope, because debts have grown to the point where you have to choose who gets paid this month, and who doesn’t, then you need to consid-er the benefi ts of fi ling a bankruptcy.

Q: Will a bankruptcy stop collec-tion agencies from calling me?

A: Yes, fi ling a bankruptcy protects you from creditor harassment, and provides peace of mind. Creditors will not contact you if you fi led bankrupt-cy and have an attorney representing you. Otherwise they risk being cited for contempt of federal court, some-thing they will not risk. Another reason to consider a bankruptcy now, even if you do not have assets to pro-tect, is that after a bankruptcy, you can immediately begin the process of repairing your credit. This usually takes between 6 to 12 months, so an early start will get you there faster.

Q: I have just received a summons from a creditor. Is it too late to fi le a bankruptcy?

A: No. When you fi le for bankrupt-cy, an automatic stay goes into effect immediately stopping any lawsuit filed against you and any action against your property by a creditor, collection agency or government entity. This can be very important, Especially if you are at risk of being evicted or foreclosed on, being found in contempt for failure to pay child support or losing such basic resources as utility services, welfare or unem-ployment

Here is how the bankruptcy fi ling affects some common emergencies:

Utility disconnections. If you’re behind on a utility bill and the com-pany is threatening to disconnect

your water, electric, gas or telephone service, the automatic stay will pre-vent the disconnection for at least 20 days. Bankruptcy will also discharge the past due debts for utility service. Although the amount of a utility bill itself rarely justifi es a bankruptcy fi ling, preventing electrical service cutoff might be justifi cation enough.

Q: Will fi ling a bankruptcy stop the foreclosure on my home?

A:If your home mortgage is being foreclosed on, the automatic stay temporarily stops the proceedings, but the creditor will often be able to proceed with the foreclosure sooner or later. If you are facing foreclosure and wish to save your home, Chapter 13 bankruptcy is the appropriate remedy because it provides for a repayment plan on the arrears.

Q: Can a bankruptcy stop an eviction?

A: No, under the new rules, a bankruptcy will not stop a court or-dered eviction, but it will prevent a landlord from seeking to evict you, at least for a while, perhaps just enough time to fi nd somewhere else to live. However, don’t fi le for bankruptcy solely because you’re being evicted. You’ll probably be better off looking for a new place to live or fi ghting the eviction in Municipal court instead. Remember, the main idea behind bankruptcy is to discharge debt.

Q: Will bankruptcy protect me; I’m behind in my child support payments?

A: If you owe child support or ali-mony, bankruptcy will not interrupt your obligation to make current pay-ments. And while the automatic stay will temporarily stop proceedings to collect back support you owe, usually the bankruptcy court will permit col-lection to go forward if the creditor requests it. In any event, these debts will survive bankruptcy intact and will have to be paid once the case is closed. Chapter 13, however, lets you pay the back support as part of the repayment plan.

Q: A creditor is garnishing my wages. Will bankruptcy help me?

A: Yes. Although no more than 25% of your wages may be taken to satisfy a court judgment (up to 65% for child support and alimony), many people fi le for bankruptcy to protect their income. For some people, any loss of income is devastating. Your employer may also get angry at the expense and hassle of facilitating a succession of garnishments and take it out on their employees. Although federal law prohibits you from be-ing fired for one garnishment, an employer can fi re you for multiple garnishments.

DAVAO CITY, May 26 (Mabuhay) – Incoming president Rodrigo Dute-rte on Thursday disclosed that he talked with Canadian Prime Minister Justin Trudeau about the Canadian kidnap victims of the Abu Sayyaf group and other concerns.

In a press conference which start-ed before midnight on Wednesday, Duterte said he and Trudeau had a talk over the phone at around 3:30 p.m. on Tuesday, Manila time.

Among the topics they discussed were respect for human rights and the Canadian hostage of the Abu Sayyaf group.

Duterte described their conversa-tion as a “civil one.”

“We are partners, we remain to be partners for all time. I’m aware there are Filipinos, a lot are working there, some are immigrants and I’m happy they have found protection in your labor laws,” Duterte quoted himself as saying, when asked what he told the Canadian leader.

The long-time Davao City mayor said he also apologized that Cana-dian citizens were kidnapped in the Philippines. One of the two Canadian hostages, John Ridsdel, was behead-ed late April after the bandit group’s ransom demand was not met. His head was found April 25 in Jolo, Sulu.

“I said I’m very sorry for the inci-dent which resulted in the killing of your national and we will try our very best and see to it that this will not happen again and you can rest assure that when the time comes, we will be

able to apprehend the criminals and exact justice,” Duterte said.

The incoming Duterte adminis-tration is set to inherit the problems caused by the Abu Sayyaf Group, which has intensifi ed its kidnapping activities.

The beheaded Ridsdel was abduct-ed with fellow Canadian Robert Hall, Norwegian resort manager Kjartan Sekkingstad, and Filipina Marites Flor while on vacation on Samal Island in September 2015.

In the latest video released by Abu Sayyaf, Hall is seen appealing to Duterte to save him and fellow hostages. He asked Duterte to work for their release immediately as they were “three-quarters dead.”

The Abu Sayyaf had threatened to behead one of four captives if the 300 million pesos ($6.4 million) ransom for each of them was not paid. The initial demand was one billion pesos each for the detainees.

The Philippine government ad-heres to a “no ransom policy,” al-though it is widely believed that captives are only freed by the group after a ransom, euphemistically called “board and lodging fee,” has been paid. (MNS)

dent Benigno Aquino III on Thursday said China is not doing reclamation in the Scarborough Shoal, also known as Panatag Shoal and Bajo de Masin-loc, which is only 120 nautical miles from Zambales.

”Well, there are no reclamation works being done by China on Scar-borough Shoal,” President Aquino said in a media interview after the launching of the Balog-Balog Mul-tipurpose Project in Barangay Sula, San Jose, Tarlac.

Aquino said the Philippine govern-ment is taking two-track approach to prevent possible attempt by China to extend its massive reclamation in the disputed West Philippine Sea up to the Scarborough Shoal which is “clearly within the 200-mile exclusive

economic zone” of the Philippines.”I am sure you know we have tak-

en two tracks: One, is to work with ASEAN, and, of course, is arbitration and we are awaiting the decision,” he said.

The President said the members of the Association of Southeast Asian Nations (ASEAN) and China have agreed in 2002 to the Declaration of Conduct of Parties in the South China Sea which states: “The parties undertake to exercise self-restraint in the conduct of activities that would complicate or escalate disputes and affect peace and stability including among others refraining from action of inhabiting on the presently unin-habited islands, reefs, shoals, cays and other features and to handle their differences in a constructive manner.”

Department of Education (DepEd) is urging all public schools to refrain from requiring expensive school sup-plies for students as classes begin on June 13.

The DepEd made the call together with the Department of Trade and Industry (DTI) during the special monitoring activity for school sup-plies in bookstores around Recto Avenue, Manila on Tuesday.

DepEd Assistant Secretary for Legal and Legislative Affairs Atty. Tonisito M.C. Umali called on the administrators of public schools to refrain from prescribing any branded or expensive school supplies which

contribute to budgetary constraints of parents, especially those with children studying in public schools.

“Makakaasa po kayo na ang ating mga pampublikong paaralan ay hindi mag-oobliga ng mga mamahaling school supplies. (Rest assured that our public schools will not require expensive school supplies) No specifi c type or brand of school supplies will be required,” said Umali.

“Maski po yung mga lumang kwaderno na spiral na may sobrang pahina na hindi nagamit noong nakaraang taon ay pwedeng pagsa-ma-samahin at tahiin (All the unused pages of old notebooks in the previous school year can still be compiled and sewn together),” he added.

The DepEd offi cial recommended the “Gabay sa Pamimili ng School Supplies” released by the DTI to properly guide consumers in their purchase of school supplies.

The link is posted on the offi cial website and social media accounts of DepEd.

The special monitoring activity for school supplies was spearheaded by the DTI, together with represen-tatives from DepEd, Department of Health-Food and Drug Adminis-tration (DOH-FDA), Local Govern-ment Unit-Manila and Senator Bam Aquino.

MANILA, May 26 (Mabuhay) – Incoming president Rodrigo Duterte on Wednesday said he will not allow the construction of more factories in Metro Manila.

“Manila is already saturated. I will not allow factories anymore in Manila,” he said in a press conference.

“Not only because it is a dead city but because I have to build a new environment for the people,” he added.

The tough-talking president has earlier spoken of his intention to devolve power and distribute wealth from Manila to the other regions in the country.

LIPA CITY, Batangas May 26 (PNA) – Out of the country’s 18 regions, the CALABARZON region comprising Cavite, Laguna, Batan-gas, Rizal and Quezon, remains the country’s top most populous region, according to the latest population census released by the Philippines Statistics Agency (PSA) this month.

PSA IV-A (Calabarzon) disclosed on Thursday that the region’s inhabi-tants soared to 14.41 million with an average annual population growth rate (PGR) of 2.90 since 2010.

The country’s total population stands at 100,981,437 based on the PSA population survey as of Aug. 1, 2015.

The National Capital Region (NCR) follows with 12.88 million people and Central Luzon (Region III) next at 11.22 million.

Four out of the fi ve Calabarzon provinces are in the country’s top 10

densely populated places.Cavite ranks the biggest populated

province with 3.68 million; Bulacan at 3.29 million and Laguna at 3.04 million.

Two other Calabarzon provinces of Rizal with 2.88 million people and Batangas with 2.69 million also land in the Top 10 Most Populous Provinc-es at 6th and 7th spots, respectively.

Among the country’s top heavily populated municipalities (towns), Rodriguez in Rizal province made it to the top with 369,000.

Three other towns in the province of Rizal are among the next highest in the headcount with Cainta (332,000), Taytay (319,000) and Binangonan (282,000).

Santa Maria in Bulacan ranks fi fth with a population of 256,000.

Calabarzon cities like Antipolo also in Rizal province ranks the thickest populated urban center with

776,000 people.Dasmariñas City (659,000) and

Bacoor City (601,000) of Cavite prov-ince rank next in the country’s most inhabited cities.

The PSA conducted its mid-de-cade 2015 Census of Population (POPCEN) pursuant to Republic Act 10625 or the Philippine Statistical Act of 2013 and Executive Order No. 352 which authorizes the statistics agency to undertake population survey including the barangays for government planning purposes.

DAVAO CITY, May 26 (Mabuhay) – The word war between presumptive President-elect Rodrigo Duterte and Senator-elect Leila de Lima is far from over.

In an early morning press confer-ence here on Thursday, the incoming President said he would launch an investigation on De Lima for her supposedly slow response in busting the illegal drug trade inside the New Bilibid Prison.

Duterte said that it took the for-mer Justice Secretary seven months to start doing anything about his tip on the proliferation of methamphet-amine hydrochloride (shabu) inside the national penitentiary.

“I will dig deep. Sabihin ko sa kanya, ‘Hoy, hija. Huwag mo akong masyadong pakialaman sa bunganga ko (I will tell her, ‘Woman, don’t focus on how I say things’). You better look in your own backyard because you have a very serious problem there. Shabu is being cooked there inside the penitentiary. It took her seven months to enter the premises,” the tough-talking mayor said.

To probe his critics wrong, Presi-dent Aquino cited two events where

he showed ‘empathy’ to the suffering victims of super typhoon Yolanda (Haiyan) in November 2013 and of the Zamboanga siege.

In Tacloban City, the President said he and the local government unit (LGUs) offi cials and fellow na-tional government leaders visited the evacuation centers to assure the people of the government’s assistance three days after the typhoon ravaged Eastern Visayas.

The week before that, he spent a couple of days hunting rabbits in Arizona with his camper in tow. He still works as a commissioned salesman when he feels like working, grossing about $30K a year. He has a beautiful fi ancée who loves him for who he is since he doesn’t really have much in his name in this world. So what kinds of fi nancial problem can someone like this have? He made the mistake of acting as a guarantor on a commercial lease for his friend.

His friend owns a business, which requires commercial space. The lease on the space is $20K monthly. It’s a fi ve-year lease with three more years to go.

His friend’s business was doing well until recently. You know how businesses go. You make money, breakeven or lose money. The fi rst situation is the best. The second situ-ation give you a fi ghting chance, after all, no money are being lost because the business is able to pay for all of its expenses. But the last situation sucks. Unless you have deep pockets, losing $10K a month means losing $60K in six months. You know what I mean. This defi cit has to be fi nanced by new capital from stockholders or from bank loans.

Since you know its losing money,

you don’t want your own money at risk, so you apply for bank loans to transfer the risk to the banks. You tell the banks that the situation will change if this happens or that happens. But nothing happens; you just continue to lose money. When push comes to shove, and you see the writing on the wall, you might decide that its time to call it quits and shut down the business. Client is thinking that friend’s business is facing some headwinds that may eventually force his friend to shut it down.

If the business is shut down, the commercial lease won’t be paid and guess who is holding the bag for the next three year’s lease of $720K?

Fortunately for client he qualifi es for a Chapter 7 wipe out of the $720K commercial lease guaranty. He will keep all his assets, including his mobile home, and his 2015 MB E 320. With this $720K liability out of the way and out of his life, client can become productive again, a ben-efi ciary of the Chapter 7 fresh start. I understand that he plans to start a new life with his beautiful bride as soon as the court discharges his $720K personal guaranty liability.

It is going to be a very tall order for Senator Bongbong Mar-cos to win the Vice Presidency.On top of Robredo, he has to con-tend with Senators Koko Pimentel Jr, and Alan Peter Cayetano, as well as with Danding Cojuangco Jr of San Miguel Brewery and the entire and influential Aqui-no-Cojuangco clan of the Haci-enda Luisita, headed by soon to be ex-president Noynoy Aquino.All of these personalities have conspired or worked hard against the possible election of Bongbong Marcos as the next vice president.

Both Pimentel and Cayetano are now eyeing not only the senate presidency but a possible run to be the next Philippine president. With Marcos out of the loop, it would be easy for either Pimentel or Cayeta-no to defeat Robredo in case she decides to run for president in 2022.As everybody knows, Danding will never let go of his San Miguel Corporation, which he apparently acquired through his friendship with the late strongman President Ferdinand Marcos.

If Bongbong Marcos wins, there is no way of stopping him to be the next president in 2022. It is possible that he may forcibly take back San Miguel from Danding.And I know that once Marcos be-comes president, I am 100 percent sure that the Cojuangco-owned Hacienda Luisita will eventually be land reformed by the government.As of Wednesday, Congresswoman Leni Robredo is still ahead of Bong-bong based on the offi cial canvass of votes for the vice presidency on the fi rst day of the joint congres-sional National Board of Canvass (NBOC).

Yes, Robredo is leading the vice presidential race through the help of the Liberal Party’s “dag-dag-bawas” scheme and with the cooperation of Comelec Chairman Andres Bautista. I cannot just yet say that Robredo – a reluc-tant candidate – was involved in the cheating. I have a high regard for her honesty although I do not know her personally.But most of the people believed that Robredo has benefi tted from “dag-dag-bawas” since she has always been in the tail end in the surveys among the vice presidential candi-dates, even a week before election day.

Therefore, there might be some truth to the allegations made by the Camp of Senator Marcos regarding massive cheat-ing in large areas of Mindanao.People are now coming out in the open and ready to testify about how they were prevented from voting and saw how LP supporters shav-ing the votes of Marcos in favor of Robredo.

One witness even claimed that he has a video to show to the pub-lic the “wholesale” vote-shaving in favor of Robredo in his province of Basilan. I hope Comelec Chairman Bautista will fi nd time to seriously look into this matter.

23) here in Orange country from a month-long vacation the Philip-pines. I arrived in the Philippines two weeks before the May 9 election and most of the people I talked with at the airport and in shopping malls

were all rooting for a Duterte/Mar-cos tandem.

They said it was already a done deal. They claimed that there was no way for “Bongbong” to be de-feated since the “solid north” will catapult him to victory. Also, they said the “Iglesia Ni Kristo” has endorsed Marcos, in addition to the Jesus Is Lord (JIL) movement and other religious sects.

I was surprised that I was the only one in our family that did not believe that Marcos will make it. I told them that it is Robre-do who is going to make it, but did not explain the reason why.When the results of the voting were coming in shortly after 9 p.m., I was shocked to fi nd out that Marcos was way ahead of everybody, particu-larly in Metro Manila. Everybody in the family was laughing and

making fun of me. I told myself, I could be wrong after all.

Before I slept on the evening of May 9 at 11 pm. Marcos was ahead of Robredo by more than 1 million votes. Robredo has al-ready overtaken Escudero and Cayetano and was on second place.The following day, at 6 a.m., my relatives woke me up and told me that Robredo was indeed ahead of Marcos by more than 65,000 votes. I was not surprised at all. I knew it will come. I even told my fellow journalists at the Manila Bulletin and at the National Press Club where I had drinks with my former colleagues.

While some disagreed with me about a possible scenario of a Robredo victory. A day after the election, a lot of my friends called to congratulate me for being right in my prediction. I even won P10,000 for betting for a Robredo victory. I used the money I have won to buy my sister a new refrigerator.People were shocked and could not believe that Marcos lost to someone who is not even known to voters outside of the Bicol area. Someone who has not been seen on the tele-vision or newspapers, appearing or

participating in plenary debates, or delivering privilege speeches or sponsoring bills to uplift the lives of Filipinos, or how to combat the pro-liferation of drugs in the country.

She was even labeled by some of her colleagues as a member of the “silent majority” in the lower house. What they meant they were the lawmakers who do nothing during sessions except to attend, listen and vote and collect they salaries, perks and payolas.

Yes, Robredo will win because that is what President Aquino and the Liberal Party want. Noynoy and his allies found it impossible to overcome the huge lead of Duterte over Roxas so they shifted their “dagdag bawas” scheme to Robredo.

Do I like Robredo to be the next Vice President of the Philippines” My answer is “No.” There is no question about her honesty and dedication to serve her constituents in Naga Camarines Sur. I think she did a remarkable job as as a Congresswoman in her district.But I dont think she is prepared to tackle a job bigger that want she was doing as a “silent” Congress-woman representing Naga city or the Camarines Sur province.

The Philippine Drug Enforcement Agency (PDEA) appears to be among government agencies that may fi nd itself on the chopping board, as Jimenez hinted that Duterte’s pre-paratory team was seriously consid-ering abolishing the agency because of its failure to stop drug syndicates

from making inroads to about 93 % of the country’s barangays.

While some agencies may be abolished, Jimenez disclosed that the preparatory team might create new agencies – particularly one that would monitor and supervise law enforcement organizations and agen-cies in their crime-fi ghting efforts.

The incoming administration, Jimenez added, will defi nitely ask Congress to reimpose the death penalty to complement its campaign against crimes.

Curfew for minors is not an empty threat, Jimenez said, but will become a reality for the entire country once the Duterte administration begins.

as Bing Baloy attended his creative writing classes, somehow or other, the time frame of his elective classes didn’t coordinate with mine. How-ever, during our senior years when we used to hang around the Faculty Center with the likes of our other

revered professors: Dr. Epifanio San Juan, Dr. Lucila Hosillos, Professors Franz Arcellana, Josefi na Mariano, Carmelita Ramirez, Antonio Hidal-go, Benjamin Santos, Nilda Rimonte, Jimmy Abad and Dean Eugenio,

NVM would come around and gracious-ly greet all of us with his warm smile and dynamic personality.

So, on Sat-urday, May 21st, through the invitation of media col-leagues Dan-te and Ce-cile Ochoa, this author

couldn’t resist attend-ing the tribute to our very own Philippine National Artist for Literature, Nestor Vicente Madali (NVM in short) Gonzalez, at the Echo Park Library, spearhead-ed by Joselyn Gea-ga-Rosenthal, Presi-dent of “Friends of the Echo Park Library” and moderated by Linda Nietes-Little of Philippine Expres-sions Bookshop.

Most of us knew that NVM was born on September 8, 1915 in Rom-blon, Philippines, though he was raised in Mansalay, a southern town in the province of Oriental Mindoro. He was a son of a school supervisor and teacher. As a youngster, he used to help his father delivering meat door-to-door to nearby towns and villages.

Early on, he was not only a gifted violinist and musician but a crafts-man as well. He made four guitars by hand and later, while attending

Mindoro High School, he occasion-ally played violin part-time, which enabled him to go to college at the National University in Manila, though he was unable to fi nish his undergraduate degree.

While a student at the university, Gonzalez wrote for the “Philippine Graphic,” and later edited for the “Evening News Magazine,” and “Manila Chronicle.” He made his fi rst mark in the Philippine writing community as a member of the Board of Advisers of “Likhaan: the Uni-versity of the Philippines’ Creative Writing Center,” followed bybecom-ing founding e ditor of the “Dilliman Review,” and as the fi rst President of the “Philippine Writers Association.”

To further his literary knowledge, NVM Gonzalez attended creative writing classes under Wallace Steg-ner and Katherine Ann Porter at Stanford University and when he returned to the Philippines in 1950, he taught at the University of Santo Tomas, Philippine Women’s Univer-sity and the University of the Phil-ippines (UP) In UP, he was only one of the two faculty members accepted to teach at the university without holding a college degree.

Some of his novels were “The Bamboo Dancers”, “The Winds of April”, “A season of Grace”, “The Happiest Boy in the World”’ and numerous short stories and essays.

Thus, on the basis of his literary publications and distinctions, NVM Gonzalez later taught a the Univer-sity of California in Santa Barbara, California State University, Hay-ward, University of Washington, UCLA and UC Berkeley.,

On April 14, 1987. the Universi-ty of the Philippines conferred on NVM Gonzalez the degree of “Doctor of Human Letters, honoris causa,” “for his creative genius in shaping the Philippine short story and novel and making a new clearing within the English idiom and tradition on which he established an authentic vocabulary; for his insightful crit-icism by which he advanced the literary tradition of the Filipino and enriched the vocation for all writers of the present generation; for his vi-sions and auguries by which he gave the Filipino sense and sensibility a profound and unmistakable script read and reread throughout the international community of letters.”

In 1997, NVM Gonzalez was proclaimed, “National Artist of the Philippines.” He died on November 29 1999 in ther Philippines at the age of 84 and was honored with a state funeral at the “Libingan ng mga Bayani.” The afternoon tribute to NVM Gonzalez included the un-veiling of his centenary stamp by his son, Dr. Michael Gonzalez,Director and Founder of the NVM Gonzalez Writer’s Workshop.

nese Ambassador to the Philippines Zhao Jianhua on Wednesday ap-proved of incoming president Rodrigo Duterte’s intention to improve the strained Sino-Philippine relations through possible bilateral talks over the South China Sea row.

“We’re glad that the presi-dent-elect has already opened the option for direct bilateral negotia-tion talks and we welcome that. It has always been China’s policy to settle our disputes and differences through bilateral channels,” Zhao told reporters on the sidelines of the handover ceremony of donations at the University of the Philippines Diliman in Quezon City.

”We are looking forward to work with the incoming president and his team to explore the possibility of returning to bilateral talks over disputes we have,” he added.

China has been fi rm with its policy

to resort to bilateral negotiations in resolving border disputes.

The Chinese diplomat noted that the president-elect also has the same stance when it comes to “properly” handling the issue of South China Sea. This involves a peaceful di-alogue with no confrontation, he noted. Zhao expressed confi dence in the upcoming administration to alle-viate tensions and improve relations between China and the Philippines, as he acclaimed Duterte for being a man of principles. “My impression is that the president-elect is a very strong man, a man with principle, and the type of leadership that you would like to work with to improve our bilateral relationship,” said the ambassador.

Manila-Beijing ties have been somewhat muddled due to maritime disputes with a pending arbitration case the Philippines brought to the United Nations Permanent Court of Arbitration in the Hague, Nether-

lands in 2013 against China’s terri-torial claims in the South China Sea. The ruling is expected soon.

Duterte earlier said that he will consider holding direct talks with China if the multilateral approach remains stalled after two years.

Commenting on this two-year time frame, Zhao said that 2 years is too long and quoted Chairman Mao Zedong to “seize the moment, seize the hour.” (PNA)

who got approved for loan modifi -cation many years ago under the HAMP Program, chances are that you obtained a low interest rate of 2% for 5 years and then your interest rate is set to increase after that time period. Other homeowners either did not qualify under HAMP and so were given by their lender an in-house modification with less favorable terms or the interest rate given by their lender under HAMP was much higher than 2% from the start.

Studies show a high percentage of default even after modifi cation. From what I’ve seen personally, these defaults could have been for a number of reasons: (a) the homeown-er’s changed fi nancial circumstances after modifi cation (b) the homeowner decided that he or she still couldn’t afford the modifi ed payments after all although income has remained the same and (c) the homeowner was never interested in keeping the home on a long term basis to begin with and simply wanted a loan modifi cation “to buy more time” to stay in their home. Again, these have been my personal observations only- there could be other reasons.

But for those who have remained current since their modifi cation, they are now facing a new challenge as they approach the fi fth year of their modifi cation. Unless their income has increased in the last 5 years, there’s a good chance that they will not be able to afford the higher payments after the 5-year period under HAMP. So unless they can keep their payments the same, they may be back in the same position as they were before they obtained a loan modifi cation 5 years ago and be at risk for foreclo-sure again. NOT GOOD. This is the reason why a lot of people are looking

into doing a loan modifi cation again. The BAD NEWS is that you now have a very limited time to apply because the government program ends this year 2016 unless extended again, which I highly doubt.

DO NOT MISS THIS IMPORT-ANT DEADLINE if you think you will benefi t from a loan modifi cation by helping you get current if you have fallen behind on payments, reduce your interest rate, which of course, will result in a much lower monthly payment than what you currently have.

If you have an interest-only loan, read your loan agreement to find out when your payments will adjust because there’s a good chance that when it does adjust, it will be an amount that is signifi cantly higher than what you are paying right now. I fi nd that most people are in for a shock when they fi nd out what the higher payment will be! Don’t let this happen to you.

Of course, this program is not for everyone. Whether or not you should apply for loan modifi cation again will, of course, depend on your intentions and long-term plans with regard to your home.

DAVAO CITY, May 24 (Mabuhay) – Presumptive President Rodrigo Duterte on Monday night gave dire warnings to supposedly corrupt and ineffi cient government agencies and offi cials.

Speaking to reporters in Davao City, Duterte called the Bureau of Internal Revenue (BIR), Bureau of Customs (BOC) and Land Trans-portation Offi ce (LTO) as the “most corrupt” agencies.

Duterte also said it may be better to simply disband these agencies.

“I’m very sorry pero sabihin ko sa inyo, isa sa pinaka-corrupt na agency ang BIR, Customs, LTO—iyang tat-long iyan... I-abolish ko na lang para wala na,” he said.

Duterte also lambasted the “use-less” Philippine Drug Enforcement Agency (PDEA), saying that it cannot

combat illegal drugs because many of its own offi cials are embroiled in the narcotics trade.

He added that a high-ranking PDEA offi cer needs to be sacked from the agency because of alleged conniv-ance with drug syndicates.

Duterte said that once he assumes offi ce, he will order the military to take over the corruption-riddled agency. Aside from the PDEA, Dute-rte also wants military men to lead the Bureau of Immigration (BI), and the Bureau of Corrections (BuCor), which maintains the New Bilibid Prison (NBP).

He also warned local government offi cials involved with illegal drugs. “Huwag kayong magkamali d’yan kung naaawa kayo sa sarili n’yo. P***** *** mamamatay kayo d’yan.” (MNS)

MANILA, May 24 (Mabuhay) – Bureau of Internal Revenue (BIR) Commissioner Kim Jacinto Henares on Tuesday is hurt by allegations of corruption at the BIR agency, fol-lowing reports that incoming Pres-ident Rodrigo Duterte may abolish the bureau due to corrupt staff.

“Nasasaktan ho ako para sa mga tao ko, sa BIR, kasi anim na taon ho silang nagtrabaho nang mabuti.... Naiangat din namin, nila, ang estado ng bansang ito.... Hindi narerecognize efforts nila,” Henares said.

Duterte was reported to have

said he would abolish the BIR, Bureau of Customs, and the Land Transportation Offi ce (LTO) once he steps in as President due to rampant corruption in these agencies.

“Perception niya ‘yun eh.... Bakit mag-aaway sa perception....” Henares said.

Henares also said that it would be up to Duterte to decide on what to do once he takes offi ce.

“Siya naman ho ang President, pwede niya namang gawin ano ang gusto niyang gawin.... Bahala siya anong gusto niyang gawin.... Wala naman hong problema,” she said.

MANILA, May 24 (Mabuhay) – A party-list representative on Tuesday sued offi cials of technology provid-er Smartmatic-Total Information Management and employees of the Commission on Elections over the alleged tampering of the automated election system (AES) used in the May 9 national elections.

In a complaint filed with the Manila Prosecutor’s Offi ce, Abaka-da-Guro party-list Rep. Jonathan dela Cruz accused the respondents of committing a security breach in the AES, particularly in the script of the transparency server, “compromising the integrity and credibility of the 2016 elections, in addition to the con-fi dentiality, integrity and availability of computer data and system.”

Dela Cruz said the Smartmatic offi cers’ actions were in violation of Sections 4(a)(1), (3), and (4) of Repub-lic Act No. 10175, which required the Smartmatic to inform and secure an authorization from Comelec en banc for any modifi cation in the script to be used in the server.

Marlon Garcia, Smartmatic project director Elie Moreno, technical sup-port team member Neil Banigued, Mauricio Herrera, Comelec informa-tion technology offi cer Rouie Penal-ba, and Comelec employees Nelson Herrera and Frances Mae Gonzalez.

The supposed “security breach” that the complainant was referring to was when Smartmatic made an ad-justment to the script to fi x an issue involving the “Ñ” character being re-placed by “?”. After learning that the data package in the script contained a special character “?” in the name of the candidate, Garcia said they made the necessary “cosmetic change” on the script to correct the error.

Garcia had said that there was no longer any need to notify the Comelec chairman and commissioners about the modifi cation he made, saying: “There are just certain matters that need to be escalated to en banc.”

Comelec Commissioner Rowena Guanzon, however, said that the Smartamtic should have notified the poll body about the modifi cation made in the script of the transpar-ency server.

The community in this situation acquires a pro tanto inter-est in the ratio that the payments on the purchase price made with com-munity funds bear to the total pay-ments on the purchase price and any appreciation should be apportioned accordingly. Marriage of Moore (1980) 28 C3d 366,371, 373, 168 CR 662, 664, 665. Other expenses associated with the property are not considered in the calculation such as mortgage interest, taxes, and insur-ance. In essence, the real property would accumulate both a separate property and a community property component by the date of separation. The appropriate remedy in this sit-uation where separate property is subsequently paid with community funds is “apportionment.”

The process of apportioning be-tween the separate and community property component is laid out in the Marriage of Madsen. In that case, the court determined the ratio or percentage in which the mortgage loan principal was reduced during

the marriage and applied that per-centage to the appreciation of the real property during the marriage. The community property component would then consist of the reduction in the mortgage loan principal during the marriage plus the portion of appreciation during the marriage applying the ratio discussed above.

In the Marriage of Madsen, the real property was purchased by the husband for $38,300 mprior to the marriage. The original mortgage was $30,000. By the time the husband got married, the house was now worth $65,000 while the mortgage has gone down by $7,000. Both the appreci-ation of $26,700 and the mortgage reduction of $7,000 would be sepa-rate property since it occurred prior to marriage. Marriage of Madsen (1982) 130 CA3d 426,181 CR 910.

During the marriage until the time of trial, the property has appre-ciated another $117,500 (property now valued at $182,500) while the mortgage has further declined by $9,200 up to the date of separation. The ratio at which community funds paid down the mortgage ($9,200) during the marriage to the original

Generally, in California, property acquired by a spouse prior to mar-riage is considered separate property under family code section 770 while those acquired after marriage are considered community assets under family code section 760. How do you characterize real property pur-

purchase price ($38,300) amounts to 24.02%.

This percentage of the property appreciation during the marriage of $117,500 ($28,223.50) plus the re-duction in mortgage balance during the marriage ($9,200) would consti-tute the community component of the real property. The rest was the husband’s separate property. The husband in that case was awarded his separate property component of the real property plus one half of the community property component.

The Madsen apportionment meth-od is also applicable to situations where a community real property is later transmuted into one spouse’s separate property through execution of a quit claim by the other spouse but is subsequently paid using com-munity funds.

Marriage of Broderick (1989) 209 CA3d 489, 257 CR 397.

Since California case law allows the creation of a community interest in real property acquired prior to marriage, one has to consider vehi-cles to protect themselves if you own property and you are contemplating of getting married. There are several ways of avoiding the creation of a community interest on your separate real property. One, you can sign a prenuptial agreement. Two, the parties can execute a postnuptial agreement if the parties are already married. Three, the parties can ex-ecute a transmutation agreement

with a waiver of any family code section 2640 reimbursement claim. If your divorce case involves complex issues of asset distribution, it is best to retain the representation of com-petent counsel.

Is real estate property purchased prior to marriage considered community property in a divorce?

MANILA, May 27 (Mabuhay) – Of-fi cials from the Philippine Consulate in Dubai stopped a Filipina from re-turning to the Philippines after she tried to use a fake passport for her adopted child.

According to a report of Khaleej Times, the Filipina’s husband al-legedly bought the bogus pass-port in the Philippines for P75,000 (Dh5,900).

Consul Ferdinand Flores said the Filipina was unable to apply for a genuine Philippine passport as the whereabouts of the baby’s biological parents were unknown.

Flores said the biological mother was an illegal resident in Dubai who left the child with the foster mother a year ago.

The foster mother claimed to have tried but failed to contact the biolog-ical mother by phone.

Flores said no case was filed

against the foster mom but insists the consulate does not condone her actions.

The Khaleej report quoted Flores as saying, “fortunately they went fi rst to the consulate before they traveled lest they be held up in the immigra-tion and the mother will be possibly charged with human traffi cking.”

The child remains with the foster mom.

Meanwhile, a report on Gulf News said an overseas Filipino worker used a fake passport as a guarantee to obtain a company loan. He report-edly even tapped his coworkers as guarantors before running away with the money. Another case involved a Filipina who used a fake passport, fake immigration stamps, and even a fake Dubai visa.

DAVAO CITY, May 25 (PNA) – With 36 days left to the inauguration of a new president, incoming President Rodrigo Duterte admitted people are prodding him to practice presidential protocol for his June 30 oath-taking.

He however said he refused, saying, “I already told them ituro niyo lang sa akin saan ako magtindig (point to me where I should stand).”

Duterte has been telling his inaugural team to prepare only a simple inauguration suggesting that serving fi nger foods for the guests will do. Under the law, the oath-taking of the president should take place 12 noon. The president will have a choice where to deliver his inaugural address after.

He said he plans to fl y only to Manila on June 30 before the 12noon oath-taking then fl y back to Davao.

“Kung delayed ang fl ight di walang oath-taking (If the fl ight is delayed then there is no oath-taking),” he said drawing laughter from the reporters.

After the oath-taking, Duterte said he would go on na-tional television. Duterte, who usually spends time talking on media interviews, rallies and conversations with friend, said it would only take him fi ve minutes to spell-out his governance and let each member of the Cabinet detail the program later. What is important is action, he said.

In holding offi ce, Duterte said he wants to spend more in Davao and for the papers needing his signature could be done here. “Pwede naman siguro yun (Maybe this can be done),” he said in jest.

For attire, Duterte, who dons maong pants to go with his barong, said he is looking for a barong made of cotton because he does not like fabrics that are itchy. Sources close to the mayor revealed a tailor has already designed a barong embroidered with a design unique to Davao.

ter 115 years since it was taken by American soldiers in 1901 during the Filipino-American War, the San Pedro bell of the Saints Peter and Paul Church here was fi nally reinstalled Monday after it was returned back to the Philippines from its location at West Point Military Academy in New York, USA.

“After more than a century, we are so glad that we now have the opportunity to once again hear the call of San Pedro to our church services,” said Fr. Ronald Chan, the parish priest, in his remarks during the unveiling and ceremonial rites.

The bell was installed in front the church, left side of the main door.

Most Reverend Rodolfo Beltran, Bishop of the Diocese of San Fernando, La Union, offi ciated the mass during the ceremonial rites attended by representatives from the U.S. Embassy in Manila, U.S. war veterans, the West Point Association of the Philippines, parishioners, local offi cials and residents.

“I would like to express my sincerest grat-itude to the U.S. military for the return of the bell, the voice of God,” said Beltran, who made the ceremonial ringing of the bell after it was unveiled in its old location.

Bauang Mayor Martin De Guzman thanked all those who facilitated the re-turn of the bell especially retired U.S. Navy Captain Dennis Wright who discovered the existence of the bell through research work.

“This (bell) is very important to us. It is our long lost treasure. The return of the bell would strengthen our faith and further unite us here in our town,” De Guzman said.

The bell was transported from the West Point Community in New York, USA on April 30 and arrived in the Philippines, at Clark Pampanga, on May 17.

Before the bell’s shipment, a ceremony and mass at West Point’s Most Holy Trinity Catholic Chapel were conducted attended by Philippine consulate offi cials and repre-

sentatives of the United States government.For his part, Capt. Dennis Wright said

he fi rst learned of the bell’s existence three years ago through research work to effect the return of the Ballangiga bells.

“It was through this research that we learned of another bell (San Pedro) from the Philippines that was located at the U.S. Mil-itary Academy in West Point New York. We learned that it was taken in 1901. However, the circumstances surrounding the removal of the bell and its journey to the U.S. remain lost in history,” Wright said.

Wright said that he, along with a group of American veterans, rediscovered the bell and found out that it belonged to the Church of Saints Peter and Paul here.

The veterans then worked with Fr. Chan and Mayor De Guzman to formally request for the bell to be returned to the church.

In January 26, 2016, Lt. General Robert Caslen Jr., the 59th Superintendent of the U.S. Military Academy, honored the request and agreed to return the bell as a gesture of goodwill and in recognition of America’s enduring friendship with the Philippines.

It was learned that the bell was taken by American soldiers under General Thomas Barry in 1901, during the Philippine-Amer-ican war. He (Barry) gave it to the U.S. Mil-itary Academy at West Point, which hung it outside the academy’s chapel.

Historical records show that in 1883, Gobernadorcillo Mariano Balancio, who be-came Mayor of Bauang, and Lt. DD. Hilario Calica, gave the bell to Father Mariano Gar-cia, who was then parish priest of San Pedro from November 1872 to July 25, 1876.

The bell was almost destroyed during the Philippine revolution but the advance of American forces prevented it and other bells in the Philippines from being melted down and made into guns and other war ammunition.

Salmon Fillets with Raspberry Citrus SauceServes: 4Prep Time: 10 minutesCooking Time: 10 to 11 minutes 1/4 cup sliced almonds, toasted 1 cup water 2/3 cup couscous 1/2 cup chopped green onions 1 pound skinned salmon fillets, 1 inch thick 2 tablespoons Mrs. Dash® Garlic & Herb Seasoning Blend 3/4 cup fresh squeezed orange juice 1 cup minced shallots 2 tablespoons raspberry preserves 2 teaspoons fresh grated peeled ginger 2 tablespoons raspberry vinegar 1/4 cup fresh raspberries, optional garnishTo toast almonds, place in a small skillet over medium heat, shaking often until golden all over, approximately 4 minutes.

Preheat broiler. Bring water to a boil in medium sauce pan and remove from heat. Stir in couscous and green onion.

Rinse and pat dry salmon fillets, then sprinkle seasoning blend on each side. Place fillets on a broiler pan coated with non-stick spray. Broil 5 minutes per side, 5 to 6 inches from heat source.

Over medium heat, bring orange juice and shallots to a slight boil in a small saucepan. Lower heat and whisk in raspberry preserves, ginger and vinegar; keep warm while salmon is cooking.

Fluff couscous with fork and place equal amounts on 4 dinner plates. Lay a piece of salmon on top. Drizzle citrus sauce over salmon and sprinkle almonds on top. Garnish top with raspberries, if desired.
