The apex court on April 8 had di- rected the poll panel to increase random matching of VVPAT slips with EVMs from one to five polling booths per assem- bly segment in the Lok Sabha polls, saying it would provide greater satisfaction not just to political parties but the entire elec- torate. On Tuesday, Singhvi told the bench, which also comprised Justices Deepak Gupta and Sanjiv Khanna, that random matching of Voter Verifiable Paper Audit Trail (VVPAT) slips with Electronic Voting Machines (EVMs) should be in- creased to at least 25 per cent as against the present 2 per cent. "The Supreme Court had increased it from one to five (polling booths per assembly segment). We have asked for 50 per cent but we will be happy with 33 or even 25 per cent. We want at least 25 per cent. It is for increas- ing satisfaction and confidence building measure," he told the bench. He said that the number of random matching of VVPAT slips with EVMs should be "viable" and the order for in- creasing it to five polling booths per as- sembly segment would amount to only 2 per cent. When the apex court said it would not modify the April 8 order, Singhvi said, "Suppose they (EC) find any fault in five, then? There is no guidelines for this". Sibal also joined the arguments and said the poll panel had earlier "misled the court" on this aspect. To this, the CJI said, "This is a review petition. We are not obliged to hear you in an open court." During the hearing, opposition lead- ers including Naidu, National Conference's Farooq Abdullah and CPI's MP D Raja were present in the courtroom. These leaders had sought a review of the court's order, saying the "increase from one to five is not a reasonable num- ber and does not lead to satisfaction de- sired by this court". "The petitioners submit that the afore- said increase to a mere 2 per cent is not sufficient and will not make any substan- tial difference to the situation that existed prior to the passing of the impugned or- der," they said. "Therefore, even though the petition- ers have succeeded on merits of their con- tention, their success does not resolve their grievance or cause any meaningful change to the situation that they were originally aggrieved," the plea said. Referring to earlier observations of the apex court, it said the 2 per cent in- crease in random matching of VVPAT slips with EVMs would not achieve the purpose of raising "public confidence in the integrity of the electoral process". The plea opposed the poll panel's argu- ment, which was earlier accepted by the court, that as the elections were nearby and hence it would not be viable to in- crease the number of random matching of VVPAT slips with EVMs. "It is submitted that, once this court agrees that the num- ber of EVMs that should be subjected to ! $! These restrictions be- came necessary following the large movement of se- curity forces on an un- precedented scale after the Pulwama terror attack. These forces were re- quired both for anti-mili- tancy operations and for conducting general elec- tions peacefully. In order to facilitate secure move- ment of Security Forces’ Convoys, the Government had imposed a prohibition on civilian traffic on NH- 44 from Baramulla to Udhampur twice a week, i.e. on Sunday & Wednesday, from 4.00 a.m to 5.00 p.m. Elaborate arrangements were, how- ever, made by the local ad- ministration to facilitate movement of public dur- ing the period of restric- tion. Earlier, the restriction on civilian movement be- tween Srinagar and Baramulla on NH-44 was reduced only to Sunday w.e.f. 22-04-2019 and later completely lifted w.e.f. from 2-5-2019. The Government is alive to the needs of citi- zens and has once again re- viewed the requirement of security forces. Following the completion of elec- tions in Pulwama & Shopian districts and as the requirement of Security Forces is now re- ducing, the Government has decided to further re- lax the restrictions on traf- fic imposed earlier as fol- lows: 1. The restriction on civilian movement be- tween Srinagar and Udhampur on NH-44 will be lifted on Wednesdays w.e.f. 13-05-2019. The submission by the Ministry of Home Affairs was made before a bench of Chief Justice Rajendra Menon and Justice A J Bhambhani in re- sponse to a plea by the hus- band of a Pakistani woman who has been asked by the government to leave the country in view of adverse se- curity reports against her. According to the woman's husband, she has a long term visa which is valid till 2020. In its affidavit, filed through the central government's stand- ing counsel, Anurag Ahluwalia, the ministry said that once it decides to serve a 'leave India notice' to a for- eigner, he or she has no vest- ed right to continue staying here despite a valid visa. "Leave India notice itself is cancellation of further va- lidity of the visa period. There is no statutory obliga- tion on the part of the central government to serve a show cause notice to the foreigner," the MHA said. The ministry further said that under the Foreigners Act of 1946, the government has "an unrestricted right to expel", and urged the court to dismiss the petition. It also claimed that it decided to serve the woman with a leave India notice in view of ad- verse inputs received from security agencies. The woman's husband had initially challenged be- fore a single judge the gov- ernment's February 7 direc- tion to her to leave the coun- try within 15 days. The single judge had dis- missed the plea and gave the woman two weeks to leave the country, saying that un- der the principles of law she has no right to stay here. Her husband appealed against the order of the single judge and the division bench on March 12 directed the gov- ernment not to take any coer- cive steps against the woman. Since then, the interim order has been extended from time to time and the next date of hearing of the matter is on May 13. Issuing the interim order, the bench had on March 12 observed that the confidential security report, based on which action was taken against the woman, "does not inspire confidence". It had also observed the long-term visa held by the woman since 2007 did not ap- pear to be cancelled till date. The 37-year-old woman had come to India in 2005 af- ter marrying the man. She has been residing in Delhi with her husband and two sons aged 11 and 5 years. According to her hus- band's plea, she has a long- term visa valid till 2020 which has not been cancelled, but Government can expel any foreigner from India without a show cause: MHA to HC " Divisional Commissioner, Kashmir, Baseer Ahmad Khan, today convened a meet- ing to review the arrange- ments for smooth conduct ex- aminations of various cate- gories of posts to be conducted from May 09 to 26 by J&K Services Selection Board (JKSSB). The ministry further saidthat under the ForeignersAct of 1946, the governmenthas "an unrestricted right toexpel", and urged the court todismiss the petition. It also

claimed that it decided toserve the woman with a leaveIndia notice in view of ad-verse inputs received fromsecurity agencies.

The woman's husbandhad initially challenged be-fore a single judge the gov-ernment's February 7 direc-tion to her to leave the coun-try within 15 days.

The single judge had dis-missed the plea and gave thewoman two weeks to leavethe country, saying that un-der the principles of law shehas no right to stay here.

Her husband appealedagainst the order of the singlejudge and the division benchon March 12 directed the gov-ernment not to take any coer-cive steps against the woman.Since then, the interim order

has been extended from timeto time and the next date ofhearing of the matter is onMay 13. Issuing the interimorder, the bench had onMarch 12 observed that theconfidential security report,based on which action wastaken against the woman,"does not inspire confidence".

It had also observed thelong-term visa held by thewoman since 2007 did not ap-pear to be cancelled till date.

The 37-year-old womanhad come to India in 2005 af-ter marrying the man. Shehas been residing in Delhiwith her husband and twosons aged 11 and 5 years.

It was informed that 14905candidates are appearing forStorekeeper, Driver, Urdu NTand C.B.T posts at various ex-amination centers. TheDivisional Commissioner di-rected concerned officers todeploy Micro Observers at

each center besidesMagistrates for carrying ex-amination material fromstrong room to venue and viceversa. Khan stressed for ap-pointment of examination ob-servers for each examinationcentre, deployment of regularand adequate police contin-gent around examination cen-ters and imposition of section144 of CrPC around examina-tion centers during examina-tion days fixed by the JKSSB.

District Development Commissioner, BandiporaShahbaz Ahmad Mirza on Tuesday chaired a meet-ing of officers to review the progress of ongoing workon 80 languishing projects across the district.

The meeting was informed that an amount of Rs205.35 crore have been approved for work completionof 124 languishing projects in the district through theJammu & Kashmir Infrastructure DevelopmentFinance Corporation (JKIDFC) Limited.

The languishing projects include projects aimedat providing pure drinking water supply, infrastruc-ture for healthcare besides several roads andbridges. The DDC reviewed the progress on the proj-ects and stressed on concerned to expedite work onall projects and ensure that all the projects are com-pleted within the set deadline. He asked the officersto remove all the bottlenecks that come in way of theearly completion of projects and urged them to up-date the district administration regularly about theprogress on the languishing projects.

Regarding PDD, it was furtherinformed that the set targets like re-pairs and replacement of damagedtransformers have been achieved inthe district under District CapexBudget.

The meeting was further in-formed that 7000 electric poles, 600km conductor and 65 transformerswere installed in the un-electrified

areas of District Kishtwar undercentrally sponsored schemes.

The DYSSO apprised the meet-ing that under District plan, workon levelling and construction ofboundary wall of 06 play grounds isin progress and shall be completedby the end of June this year.

He further informed that underKhelo India Scheme, 12 playgrounds were sanctioned, of whichwork on 10 playgrounds has beencompleted.

The Government has been reviewingthe restrictions imposed earlier thismonth on civilian movement on theNational Highway (NH-44) connectingJammu to Srinagar with a view to balanc-ing the security needs of Forces’ Convoyswith the need for minimizing public incon-venience. These restrictions became nec-essary following the large movement of se-curity forces on an unprecedented scale af-ter the Pulwama terror attack. Theseforces were required both for anti-militan-cy operations and for conducting generalelections peacefully. In order to facilitatesecure movement of Security Forces’Convoys, the Government had imposed aprohibition on civilian traffic on NH-44from Baramulla to Udhampur twice aweek, i.e. on Sunday & Wednesday, from4.00 a.m to 5.00 p.m. Elaborate arrange-

ments were, however, made by the localadministration to facilitate movement ofpublic during the period of restriction.

Earlier, the restriction on civilianmovement between Srinagar andBaramulla on NH-44 was reduced only toSunday w.e.f. 22-04-2019 and later com-pletely lifted w.e.f. from 2-5-2019.

The Government is alive to the needsof citizens and has once again reviewedthe requirement of security forces.Following the completion of elections inPulwama & Shopian districts and as therequirement of Security Forces is now re-ducing, the Government has decided tofurther relax the restrictions on traffic im-posed earlier as follows:

1. The restriction on civilian move-ment between Srinagar and Udhampur onNH-44 will be lifted on Wednesdays w.e.f.13-05-2019. The prohibition on civilian traf-fic in this stretch would now be only on

Sunday.2. The local administration would con-

tinue to facilitate movement of civiliantraffic as has been happening so far, in-cluding by allowing public transport ofJKSRTC to move during the period of re-striction on the NH.

3. A complete review of remaining re-strictions on the Highway would be donesubsequently.

The Government stated that the pur-pose of these restrictions is in the largerinterest of security of everyone and ap-pealed the people to extend full coopera-tion in the smooth regulation of traffic.The restrictions strike a balance betweenthe needs of people and inconveniencecaused to them on one side and the needs ofsecurity forces. The restrictions will con-tinue to be reviewed on a real time basisand modifications will be made as neces-sary in the coming days.

Pawan Kumar Bansal, theCongress candidate fromChandigarh Lok Sabha seat andformer railway minister PawanKumar Bansal Tuesday accusedhis BJP rival Kirron Kher of at-tempting to defame him.

Bansal vent his ire againstthe BJP and its sitting MP inChandigarh after theEnforcement DirectorateTuesday attached Rs 89.68 lakhcash in a money laundering caseinvolving his nephew.

"Dragging me mischievouslyin a case of which I am a prosecu-tion witness, proves that the BJPhas already smelled defeat inChandigarh. Hence, KirronKher and her party are now try-ing all desperate means to de-fame me," he told reporters here.

The ED, in a statement, saidit has issued a provisional orderunder the Prevention of MoneyLaundering Act (PMLA) tofreeze the "bribe" money, whichaccording to it was "proceeds ofcrime".

Bansal said, "Six years back,the case filed against me by CBIwhen I was the railway ministerwas blown out of proportion. Forover eight hours I was interro-

gated by the CBI but nothing wasfound against me. On the con-trary, I was made the prosecu-tion witness in that case com-pletely acquitting me of all thecharges."

"Had I got anything to dowith that case, do you think theBJP government over the lastfive years would have sparedme?" he posed.

Bansal alleged that eversince his name was announcedas the Congress' Chandigarhcandidate, the BJP has been try-ing hard to "smear" his name inone way or the other.

"The BJP has already accept-ed defeat. Otherwise, instead offinding ways to attack me, theywould have concentrated ontalking about their own achieve-ments. The truth is that the sit-ting MP has done nothing for thedevelopment of Chandigarh," hesaid. Chandigarh Congress chiefPardeep Chhabra alleged thatthe BJP had "stooped to the low-est level of dirty politics".

"Recently, Kirron Kher hasbeen served with two show causenotices by the poll panel. Itseems the BJP has lost its bal-ance. Amit Shah's rally inChandigarh has already turnedout to be a faux pas. Nothing is

working for them," he said.Chhabra claimed this was an

old case which has no relevancenow and is a deliberate move bythe BJP to defame Bansal sincethey have nothing to say againsthim.

"It is a deliberate attempt todivert the attention of the votersfrom their failures to somethingwhich does not hold true. She(Kher) is using official machin-ery which she could not use forpeople's good," he alleged.

The cash was allegedlyseized by the CBI from the officeof Bansal's nephew Vijay Singlain 2013 in a bribery and corrup-tion case related to appoint-ments at top positions in the rail-ways.

The Uttar Prdesh chief minister saidhe landed at the Hindon Air Base first andafter entering Delhi, he said he was ap-palled after seeing the condition of roadshere. "The AAP government has turnedDelhi into a city of potholes and has hurtthe sentiments of people of the city,"Adityanath alleged.

"Kejriwal has nothing to do with 'vikas'(development) and he does not have any in-terest in working in collaboration with thecentral government for the betterment ofnational capital," he claimed.

Taking a jibe at Kejriwal, he askedwhether the AAP supremo was a "mukhiya

of Delhi or dharna" (head of Delhi or leaderof dharnas and demonstrations).

He said the AAP supremo attacked theCongress before gaining power in Delhiand then sought to "make an alliance" withthe same party.

Discussing her vision for theEast Delhi constituency, Atishisaid the main focus this time is thefight for full statehood becausemany problems faced by the citi-zens of East Delhi are related tothe structure of governance.

For example, safety and secu-rity in East Delhi is a very big con-cern and this is an across classconcern. It isn't an issue that onesegment faces and another doesnot... But because Delhi Policecomes under the Central govern-ment there are virtually no stepsbeing taken, she said.

Education, she added, is an-other major concern as it is one ofthe most neglected areas.

We have tried to rectify that asfar as schools go. But higher edu-cation still does not come underDelhi government so improvinghigher education is also related tothe issue of full statehood, shesaid.

She listed affordable housingas an important concern for thearea.

In January, the courtgranted KartiChidambaram, son of sen-ior Congress leader andformer Finance Minister P.Chidambaram, permissionto travel abroad, after hedeposited Rs 10 crore withthe Secretary General ofthe court.

China has observer status in the ArcticCouncil, but that status is contingent upon its respect forthe sovereign rights of Arctic states. The US wants Chinato meet that condition and contribute responsibly in theregion. But China's words and actions raise doubts aboutits intentions. Arctic nations must be aware of the realChinese intentions. The US and Arctic nations are wel-coming transparent Chinese investments that reflect eco-nomic interest and national security ambitions. Between2012 and 2017, China invested in the Arctic nearly USD 90billion. It's planning to build infrastructure from Canada,to the Northwest Territories, to Siberia. Do we wantArctic nations broadly or indigenous communities specif-ically, to go the way of former government in Sri Lanka orMalaysia, ensnared by debt and corruption? Do we wantcrucial Arctic infrastructure to end up like Chinese-con-structed roads in Ethiopia, crumbling and dangerous af-ter only a few years? Beijing is attempting to develop criti-cal infrastructure using Chinese money, Chinese compa-nies, and Chinese workers in some cases, to establish apermanent Chinese security presence. China could use itscivilian research presence in the Arctic to strengthen itsmilitary presence, including deployment of submarinesincluding deployment of submarines to the region as a de-terrent against nuclear attack which is going to harm thesecurity interests of neighbouring countries.

With only aroundsix aircraft operating, Jet Airways, which at one point of time adecade ago was India’s largest airline, is on the verge of a collapse. Atthe Delhi Airport, a line-up of several Jet Airways’ Boeing 737s sit for-lornly, their engines and wheels covered in plastic sheeting and othervital parts protected by metal foil. The ultimate blow for the airlinecame when the leasing companies, which own those planes, said thatthey would transfer many of them to low-cost rival SpiceJet. In thetimes to come, many studies will be conducted to dissect what wentwrong with Jet Airways. But for most, an ill-fated acquisition of AirSahara, being a poison pill that took its time, is what ultimatelydoomed the airline. This was aided by a non-diverse board populatedby friends of the promoter until the coup de grâce came from the low-cost expansion drive in India, which left the airline unable to main-tain its bottomlines. Its limited international operations left it unableto cope with the onslaught from the Middle-Eastern carriersEmirates, Etihad and Qatar Airways in India. Even though Jet founda white knight in the Abu Dhabi-based Etihad Airlines, the latter’sown issues have meant that it has not been able to fund the former ade-quately as the airline got badly hit by high fuel prices. The question iswhat should the Government do over here? Should Jet Airways besaved because it is a national asset and several State-owned banks areowed hundreds of crores? 1915 : German submarine sinks LusitaniaThe earlier German attacks on merchant ships off the south coast

of Ireland prompted the British Admiralty to warn the Lusitania toavoid the area or take simple evasive action, such as zigzagging toconfuse U-boats plotting the vessel’s course. The captain of theLusitania ignored these recommendations, and at 2:12 p.m. on May 7,in the waters of the Celtic Sea, the 32,000-ton ship was hit by an ex-ploding torpedo on its starboard side. The torpedo blast was followedby a larger explosion, probably of the ship’s boilers. TheLusitaniasank within 20 minutes. Germany justified the attack bystating, correctly, that the Lusitania was an enemy ship, and that itwas carrying munitions. It was primarily a passenger ship, however,and among the 1,201 drowned in the attack were many women andchildren, including 128 Americans. Colonel Edward House, close as-sociate of U.S. President Woodrow Wilson, was in London for a diplo-matic visit when he learned of the Lusitania‘s demise. It is sad that the debate now isabout the Commission ratherthan the appalling conduct of ourleaders. The 2019 general electionwill long be remembered not justfor the transgressions of the toppolitical leadership, but also forthe Election Commission (EC) it-self being put in the dock. The EChas repeatedly found itself at thereceiving end of scathing attacksfrom the Opposition, the public,the media and the judiciary. Thisis unprecedented for what was un-til now the most trusted institu-tion in the country. Trust deficitIndeed, the trust deficit betweenthe EC and the Opposition partiesand the voters started with theEVM/VVPAT saga. The EC wasaccused of being on the defensiverather than being communica-tive. On April 8, in a letter to thePresident, a group of retired bu-reaucrats and diplomats ex-pressed concern over the EC’s“weak-kneed conduct” and saidthat the institution is “sufferingfrom a crisis of credibility today”.

The last two months have beena trying time for me as well. Eversince I demitted office in 2012, Ihave been a self-appointedspokesperson for the EC, defend-ing every action of the body thatneeded to be defended. I must haverefused at least a hundred re-quests by the media to commenton recent happenings. On the fewoccasions I was drawn into the de-bate, it was a painful struggle to

find suitable words that would notsound like an indictment of thebody of which I was proud to be apart. I noticed the same predica-ment on the faces of two formerChief Election Commissioners(CECs) who appeared on televi-sion recently. Then I rememberedthe words of Martin Luther King,Jr.: “Our lives begin to end the daywe become silent about thingsthat matter.” And Plato, “I will putdown your silence as consent.” Ittook repeated raps on its knucklesby the Supreme Court for the ECto crack the whip. It is a pity thatwe needed the Supreme Court toremind the EC of powers that it al-ways had. Article 329 of theConstitution has barred courtsfrom interfering in electoral mat-ters after the election process hasbeen set in motion. In a long chainof judgments, the Supreme Court

has reiterated that provision andrestrained all courts from inter-vening. It is therefore significantthat in the last couple of months,the apex court itself had to jump infor course correction. This ismore serious than is realised atpresent. On April 15, a SupremeCourt Bench headed by the ChiefJustice of India pulled up the ECfor not acting against hate speech-es and statements on religiouslines. It was reported that the ECtold the apex court, “We are tooth-less, we are powerless, we issuenotices, then advisory and on re-peated violation, we file com-plaint.” The Supreme Court wasfurious with this stand. TheSupreme Court had observed in1977 that “where these [the exist-ing laws] are absent, and yet a sit-uation has to be tackled, the ChiefElection Commissioner has not to

fold his hands and pray to God fordivine inspiration to enable himto exercise his functions and toperform his duties or to look toany external authority for thegrant of powers to deal with thesituation. He must lawfully exer-cise his power independently, inall matters relating to the conductof elections, and see that the elec-tion process is completed proper-ly, in a free and fair manner.” Thishas been the EC’s bible. After theEC had not acted on complaintsagainst Prime Minister NarendraModi and BJP president AmitShah for almost a month, theSupreme Court ordered it to do sobefore May 6. The EC promptlydisposed of several complaints,giving the two leaders a clean chitin each case. Just as the EC wasbeing written off, we got the goodnews that at least one ElectionCommissioner had dissented onfive decisions taken by the EC onegiving a clean chit to Mr. Shah andfour to Mr. Modi. He thought thatthe Prime Minister had, in fact, in-voked the armed forces in an elec-tion campaign in violation of theEC’s guidelines instructing politi-cians to refrain from the same. Hisminority vote may not havechanged the result, but dissent is ahealthy sign of objective delibera-tion, and thus presents a ray ofhope. I can say from experiencethat the EC has got away withmany mistakes largely because ofits credibility and people’s trust inthe institution. But this trust can-

There are some striking simi-larities between what WinstonChurchill had said about Indian in-dependence in the BritishParliament on March 6, 1947 andwhat The Economist wrote aboutIndia in general and PrimeMinister Narendra Modi in partic-ular in its latest issue, that hitnewsstands over the weekend. Inhis speech, Churchill had arguedthat India should be given “domin-ion” status, still partially governedby the British King, versus full in-dependence. Second, he argued:“Let the House remember this. TheIndian political parties and politi-cal classes do not represent theIndian masses. It is a delusion tobelieve that they do.” A lot of waterhas flowed down the Thames andthe Ganga-Yamuna since then butin the minds of the editors of TheEconomist, time has not changed.In such a time-wrapped mindset,it’s not surprising that they thinkthey have better judgment than or-dinary Indians about India’s ownaffairs. These apostles of Britishsupremacy, who themselves can-not decide for the past two yearsabout a pivotal issue in their coun-try like Brexit, are questioning thewisdom of the Indian electorate. Itis not the first time that TheEconomist has shown such a su-

premacist mindset. This magazinehad even expressed disapproval ofIndia’s space programme, and hadargued: “What if the 16,000 scien-tists and engineers now workingon space development were de-ployed instead to fix the rotten san-itation?” Of course, The Economistwon’t suggest scrapping the £400million UK Space Agency’s budgetto partially fill the mega deficit of£4.3 billon in Britain’s publichealth system. It’s indeed morethan spare change. Coming to thespecifics, The Economist has de-tailed a long list of so-called “fail-ures” such as demonetisation.Even if we ignore that many itemsin this list are copy-pasted from thespeeches of their favourite leader,Rahul Gandhi, the magazine hasconveniently forgotten that theruling BJP has won several elec-tions after demonetisation. It alsothinks that the rise of GDP growthfrom five per cent in 2014 to aboveseven per cent under the NarendraModi government is only a margin-al increase. So cluttered is the vi-sion of this magazine’s editors thatwhen the entire Opposition inIndia criticises Mr Modi for overoccupying media space, TheEconomist claims that he appearsonly at major events. Its claim of araging Hindu-Muslim divide bythe current government is alsoequally baseless. This government

hasn’t discriminated against any-one on the basis of his/her caste,region, faith or gender while imple-menting any of its welfare and de-velopment schemes, be it beUjjwala, microfinance, housing orcritical healthcare. They all wereimplemented in a highly efficientand transparent manner and onthe basis of uniform criteria. Ofcourse, The Economist won’t talkabout it. On the contrary, despiteaccepting that the Congress is cor-rupt, inefficient and weak, there iswishful thinking in the minds ofthe editors of The Economist thatRahul Gandhi should lead the nextgovernment. Even in 2014, it en-dorsed Rahul Gandhi as PrimeMinister. They have given a longlaundry list of the so-called mis-deeds of this government, butdidn’t bother to mention even one

for the Congress, conveniently for-getting the 1984 pogrom againstSikhs by Congress workers forwhich no one is convicted so far.They are full of praise for the unre-alistic promises in the Congressmanifesto. As a magazine which isfocused on the economy, TheEconomist at least should haveasked some tough questions onhow a scheme like “Nyay” wouldbe funded without increasing taxesand/or widening the fiscal deficit.

One finds a few other strikingsimilarities between the attitude ofChurchill and that of TheEconomist and its editors as far asIndia is concerned. Churchill’srole in the deaths of millions in the1943 Bengal Famine is well docu-mented. But there are some histori-ans like Allan Packwood, who have

Will the honourable Justicesstand up as the collective con-science of the Supreme Court?Finally, the in-house committeehas spoken: “No substance in theallegations contained in theComplaint dated 19th April, 2019 ofa former Employee of the SupremeCourt.” In the absence of anyknown procedure, the non-obser-vance of the principles of naturaljustice and the absence of effectiverepresentation of the victim, the re-port, even though not for the pub-lic, is non-est and void ab initio.

The story so far : The complaintmade by the victim of sexual ha-rassment to the judges oftheSupreme Court had two equallyserious facets. One related to sexu-al harassment, a very seriouscharge. The other related to the vic-timisation of the complainant andher family “at the hands of theChief Justice of India [CJI]”, asclaimed by her. It is this lattercharge to which the nation needs topay equal, if not greater, attention.The charge on this count, as per heraffidavit, involves the following: af-ter the alleged incident on October11, 2018, her transfer to the Centrefor Research and Planning onOctober 22, change of position to

“Admin, Material Section” onNovember 16, issuance of a memo-randum on November 19 by DeepakJain, Registrar, accusing the vic-tim of violating conduct rules andseeking an explanation, her thirdtransfer to the Library Division onNovember 22, the issuance of amemorandum on November 26 re-jecting her explanation and propos-ing further action, her suspensionon November 27, and the communi-

cation of December 18 from theRegistrar that the charges againsther stood proved. On December 21,she was dismissed from service.

Meanwhile, according to her af-fidavit, on November 27, her hus-band, a head constable with theDelhi Police, Crime BranchDivision, was transferred to theThird Battalion. On December 8,her husband, and the latter’s broth-er, also a constable with the Delhi

Police, were suspended over tele-phone, and the orders followed thenext day. On January 2, 2019, an in-quiry was initiated by a DeputyCommissioner of Police againsther husband on the ground that“unsolicited calls were made to theOffice of the Hon’ble Chief Justiceamounting to official misconduct”.On January 11, the victim and herhusband were summoned toDelhi’s Tilak Marg police stationby Station House Officer (SHO)Naresh Solanki. In their presence,the SHO called the Registrar, Mr.Jain, to discuss ways to reach theresidence of CJI Ranjan Gogoi. TheSHO, the victim and the husbandwent there, and in the presence ofMr. Jain, the victim was forced tofall at the feet of the CJI’s wife.

Upon their return to the policestation, the SHO had a long conver-sation with the victim and her hus-band. On January 14, the disabledbrother-in-law of the victim, whohad been appointed temporaryJunior Court Attendant under theorders of the CJI himself onOctober 9, 2018, was removed fromservice. On March 3, an FIR wasregistered on a complaint by a per-son named Naveen Kumar at theTilak Marg police station in respectof an alleged demand made by the

victim in June 2017 for a bribe of •10 lakh for getting hima job in the Supreme Court and his payment of •50,000 asadvance. Based on this FIR, the victim and her husbandwere arrested from their village in Rajasthan, hand-cuffed and subjected to cruel and inhuman treatment.The victim was remanded for a day on March 10. She wasreleased on bail on March 12. The affidavit in support ofthe complaint appears truthful and honest. The detailsare heart-rending and extremely troubling, and reflect adeep malaise that appears to have set in in high offices.These incidents are all corroborated by official records.Collectively, they establish beyond doubt the victimisa-tion of the woman, her husband and other family mem-bers at the hands of the state machinery, including theRegistry of the Supreme Court. Violations of rights Eachof these actions is either unconstitutional or illegal orcriminal in nature. Clearly, they establish a well-de-signed conspiracy to victimise the victim beyond re-demption so as to ensure that neither she nor her hus-band and her family members could raise their headsagain to seek justice in respect of the complaint madeagainst the CJI. Together, they constitute gross viola-tions of the constitutional and fundamental rights of thevictim and her family members, including those guar-anteed under Articles 14 and 21. Clearly, the motive be-hind ensuring grossly inhuman, illegal, unconstitution-al and disproportionate punishment to the victim andher family members seems to be to suppress her will andspirit so that she does not raise any charge about the in-cident of October 11, 2018. One thing is clear: com-plainant Naveen Kumar, who alleged that the victim de-manded a bribe and willingly offered, according to hisown case, •50,000, has made himself an accomplice to thealleged bribery to secure public employment. He musttherefore face the rigour of the law. The case on its ownshowing appears to be concocted and its timing raisesserious questions about its authenticity. If the bribe wasdemanded in June 2017, it is a curious coincidence thatthe complainant from Jhajjar, Haryana surfaces inMarch 2019 and that too in Tilak Marg police station tomake the complaint. It activates the entire police ma-chinery against the victim and her family. This was thefinal nail in the coffin, as the proverb goes, pushing thevictim and her family to the wall and igniting in themthe courage to stand up against the CJI and make thecomplaint on April 19. Those who have doubts about theso-called delay in the complaint must be prepared to putthemselves in the shoes of the victim, a Class III employ-ee pitted against the Chief Justice of India, one of thehighest and the most powerful constitutional func-

tionaries. Her approaching lawyers who are widely re-spected as human rights activists was natural and can-not be viewed with suspicion under any circumstances.The Constitution Bench of the Supreme Court in OlgaTellis v. Bombay Municipal Corporation recognisedprocedural safeguards as necessary and said they have“historical origins in the notion that conditions of per-sonal freedom can be preserved only when there is someinstitutional check on arbitrary action on the part ofpublic authorities”.

In Uma Shankar Sistani v. Commissioner ofPolice,Delhi (1996), the Supreme Court ordered theCentral Bureau of Investigation to investigate the cir-cumstances under which a false complaint was regis-tered against the petitioner, leading to his arrest. TheFIR against the victim in this case needs the same treat-ment. Equally, the punishment of dismissal imposed onher is grossly disproportionate, even assuming that thecharges against her were proved. The Supreme Courthas consistently frowned upon such punishments.InRanjit Thakur v. UOI (1987), the court interpreted thedoctrine of proportionality “as part of the concept of ju-dicial review” to ensure that if the sentence is an outra-geous defiance of logic, then it can be corrected. Groundsfor judicial review Irrationality and perversity arerecognised grounds of judicial review. The court hasheld that if the punishment is outrageously dispropor-tionate and the court considers it arbitrary in that it iswholly irrational or “a punishment is so excessive ordisproportionate to the offence as to shock the con-science of the Court the same can be interfered with”. Oneach one of these counts the punishment of dismissal im-posed upon the victim is completely arbitrary and per-verse. It must go. Where can she and her family mem-bers get justice if the police at the highest level is pittedagainst them? Will they ever get a fair investigation andfair reports in the criminal cases? It is doubtful. Can sheand her family get justice at all at the hands of the judici-ary, considering the respondents would be the CJI andthe Supreme Court? Only time will tell. But certainly forthe present, the picture is dark for them. All these raiseextremely troubling and discomforting thoughts in theminds of many. Is it the Supreme Court as an institutionthat is responsible for what has happened, or is it theCJI? The dichotomy will emerge only when otherJustices act independently, uphold the majesty of thelaw and steer the institution out of troubled waters. Ifthey fail, the institution is doomed to serious loss of faceand credibility. It is time the collective conscience of theJustices prevails.

justified even this dreaded action of Churchill. “It was ahorrendous event but it needs to be seen within the con-text of the global war… Churchill was running a globalwar at this point, and there are always going to be con-flicting priorities and demands… It’s an incrediblycomplex and evolving situation — and he’s not alwaysgoing to get everything right,” wrote Packwood.Similarly, The Economist too argues that the Congressis “corrupt, inefficient”, but is still better suited to gov-ern India (because the Congress has different priori-ties). Similarly, this is what Churchill said aboutMahatma Gandhi: “It is alarming and nauseating to seeMr Gandhi, a seditious Middle Temple lawyer, now pos-ing as a fakir… striding half-naked up the steps of theViceregal Palace.” He even argued in favour of “gettingrid of the Mahatma”. It seems The Economist’s editorsfeel equally nauseated seeing the “backward” NarendraModi occupying the hearts and minds of over a billionIndians, rather than princely dynast Rahul Gandhi.

While the arguments in The Economist editorial arefull of arrogance, a “we know better than you” attitudeand elitist, at the same time it’s a reflection of its de-featist mindset. Churchill was very saddened by the“disappearance of Britain from the East”, and he fur-ther said: “It is with deep grief I watch the clattering

down of the British Empire, with all its glories and allthe services it has rendered to mankind. But, at least, letus not add by shameful flight, by a premature, hurriedscuttle at least, let us not add, to the pangs of sorrow somany of us feel, the taint and smear of shame.” Onefinds a similar tone of accepting the eventual defeat ofthe Congress in the editorial of The Economist.Fortunately, not everyone in the United Kingdom is ofthe same mindset as The Economist. After NarendraModi’s thumping victory in 2014, London’s Guardiannewspaper wrote: “Today, 18 May 2014, may well godown in history as the day when Britain finally leftIndia. Narendra Modi’s victory in the election marksthe end of a long era in which the structures of power didnot differ greatly from those through which Britainruled the sub-continent. India under the Congress wasin many ways a continuation of the British Raj by othermeans.” Therefore, it’s not the popularity and certainvictory of Narendra Modi that is despicable and danger-ous, but the elitist mindset of The Economist. The soon-er it comes out this echo chamber, the more acceptabili-ty it is likely to gain. Otherwise, it can continue with itseternal daydream of making Rahul Gandhi India’s nextPrime Minister. That daydream will not become realityon May 23, 2019, and not even in 2024!

business would, stranding thousands of passengersand leaving thousands more unemployed? Frankly, theGovernment has its hands tied, it is damned if it attempts arescue and damned if it doesn’t. Indian banks are tryinghard to ensure that the airline can find a buyer, even ifthat buyer is Naresh Goyal himself, with the banks tak-ing a massive haircut on their loans. However, ideally,the airline should find a new owner. Unlike Kingfisher,Jet Airways has a well-established brand value and a

frequent flyer programme with millions of fairly loyalpassengers, many of whom are willing the airline tosucceed. But the airline business, as we are well aware,is a brutal one, and the Government should not step into keep the airline running on taxpayer money, having onedrain on taxpayer funds Air India as it is. Ironically, someexperts feel that Jet’s demise might actually help sur-viving airlines in India to do better with more sustain-able airfares and eventually more sustainable growth.

not be taken for granted. The moment there is a deficitof credibility, problems begin. Appointments and re-moval The root of the problem lies in the flawed sys-tem of appointment of Election Commissioners. Theyare appointed unilaterally by the government of theday. There has been a demand for de-politicising ap-pointments through a broad-based consultation, as isdone in other countries. The uncertainty of elevationby seniority makes them vulnerable to governmentpressure. The government can control a defiant CECthrough the majority voting power of the two ElectionCommissioners. In its 255th Report, the LawCommission of India recommended a collegium sys-tem for appointing Election Commissioners. Politicalstalwarts such as L.K. Advani and former CECs B.B.Tandon, N. Gopalaswami and I supported the ideaeven when in office. But successive ruling dispensa-tions have ducked the issue, not wanting to let go oftheir power. It is obvious that political and electoralinterests take precedence over national interest. Apublic interest litigation was also filed in the SupremeCourt in 2018. This has been referred to a ConstitutionBench. I feel that on issues of such vital importance,even the Supreme Court, which I have always de-scribed as the guardian angel of democracy, has to act

urgently. If democracy is derailed, its future too wouldbe in jeopardy. Apart from the manner of appoint-ment, the provision for the removal of ElectionCommissioners also needs correction. At present, on-ly the CEC is protected from being removed (exceptthrough impeachment). One has to remember that theConstitution enabled protection to the CEC as it was aone-man Commission initially. This must now be ex-tended to other Commissioners, who were added in1993, as they collectively represent the EC. In the richhistory of democratic India, all institutions of the statehave come under pressure at one point or another. Butthe strength and credibility of an institution is testedwhen it buckles under political influence. It is unfor-tunate that the topic of debate now is the EC ratherthan the appalling and unconstitutional conduct ofour leaders. Over 40 electoral reforms remain pendingfor two decades. While it seems futile to have any hopefrom the political leadership, it is imperative that theEC asserts the ample authority that it already possess-es constitutionally. It has the full support of theSupreme Court. It must act tough. This is not a merequestion of its discretion, but a constitutional duty.Governments come and go, but the reputation of theEC stays for good.

Fugitive diamond merchant NiravModi will file a third bail plea Wednesdaybefore a UK court, which has already re-jected his bail twice before as he fights hisextradition case in the Punjab NationalBank (PNB) fraud and money launderingcase amounting to up to USD 2 billion.

Chief Magistrate Emma Arbuthnot isscheduled to hear the third bail applica-tion at Westminster Magistrates' Court inLondon.

It remains unconfirmed whether Modiwill appear in person or via videolinkfrom Wandsworth prison in south-westLondon, where the 48-year-old has beenlodged since his arrest in March.

His barrister, Clare Montgomery, willseek to convince the judge of a change ofcircumstances in order to seek bail for athird time at the same court.

"He has had his two bail applicationsin the lower court. He can only make a

third application if he can persuade thecourt that there has been a change in cir-cumstances. He is arguing a change of cir-cumstances based on new evidence," saida spokesperson for the UK's CrownProsecution Service (CPS), which repre-sents the Indian government in the extra-dition proceedings.

"He will have to seek to persuade theJudge that this constitutes a change of cir-cumstances and that he should be permit-ted to make another bail application," thespokesperson said.

Modi's legal team, led by solicitorAnand Doobay, have previously offered 1million pounds as security alongside anoffer to meet stringent electronic tag re-strictions on their client's movements,"akin to house arrest". It remains to beseen how they plan to bolster the applica-tion for a third attempt before the samecourt. "This is a case of substantial fraud,with loss to a bank in India of betweenUSD 1-2 billion. I am not persuaded that

the conditional bail sought will meet theconcerns of the government of India inthis case," Judge Arbuthnot had said,when rejecting the previous bail applica-tion. She also noted that "very unusuallyin a fraud case", Modi had made deaththreats to witnesses and also attempted todestroy evidence in the case. The diamond

dealer's "lack of community ties" in the UKand an attempt to acquire the citizenshipof Vanuatu - a remote island in the SouthPacific Ocean - in late 2017 went againsthim, as the judge said it seemed like hewas trying to "move away from India at animportant time".

The CPS team, represented by barris-ter Nick Hearn from Furnival Chambers,is expected to oppose the latest bail appli-cation on similar grounds.

At the last hearing in the extraditioncase on April 26, when Modi had appearedbefore Judge Arbuthnot via videolinkfrom prison, no application had beenmade for bail and he was further remand-ed in judicial custody until May 24.

The court was also told that May 30 hadbeen tentatively ear-marked as the firstcase management hearing ahead of an ex-tradition trial, but it now remains to beseen how the case will progress after thelatest bail application.

Earlier, the CPS had confirmed that

Modi intends to appeal against his bail re-jection in the UK's High Court. However,the bail hearing this week will take placeat the same lower court on the basis of"change of circumstances".

Modi was arrested by uniformedScotland Yard officers in central Londonon March 19. During subsequent hearings,Westminster Magistrates' Court was toldthat Modi was the "principal beneficiary"of the fraudulent issuance of letters of un-dertaking (LoUs) as part of a conspiracy todefraud PNB and then laundering the pro-ceeds of crime.

GobinathanDevathasan, 69, whosebehaviour was de-scribed as "reprehensi-ble" during the litiga-tion, was ordered onApril 29 to pay his ex-wife ChristieDevathasan Canadiandollars 5,498,344 inspousal support, withanother Canadian dol-lars 612,084 for child sup-port.

During the course ofthe litigation,Devathasan had handledfunds in his Singaporebank account despite anasset freezing order,failed to disclose proper-ties, deliberately embar-rassed his daughter andsuggested that a judgehad "spread her legswide" to the claimant'scounsel, the court wastold. The doctor ran aprivate clinic at MountElizabeth Hospital, andhad married Devathasanin 1997. She filed for di-vorce in 2016, ChannelNews Asia reported. Thecouple was described inthe court judgment as be-ing "uncommonlywealthy", and had ownedexpensive cars, jew-ellery, artwork and

homes, with investmentproperties in Canada,the US, Singapore,Thailand and Malaysia.Devathasan divorcedher first husband in 1996,while Devathasan di-vorced his first wife,with whom he had twochildren with, in 1997.Shortly after, the couplegot married inSingapore in August1997. The couple's rela-tionship deteriorated in2015 and early 2016, ac-cording to the court pa-pers. Devathasan com-menced divorce proceed-ings in July 2016.

Devathasan obtainedan asset freezing orderand a protection order,and these orders wereserved to Devathasan inAugust 2016. The doctor

claimed that they werenot binding as he was inSingapore and took stepsto deal with his assets.

Devathasan's pastconduct was also takeninto account in decidingongoing and future childsupport. He has to payCanadian dollars 33,084for past child supportand a lump sum ofCanadian dollars 579,000for child support for theperiod through to June2022.

The police canhappily announce thateveryone with direct linkshave been either arrestedor killed by now," he said.

Wickramaratne did notsay how many people havebeen arrested over thebombings, but policespokesman RuwanGunasekera has said that73 people, including ninewomen, were arrested andbeing questioned by theCID and the TerroristInvestigation Department(TID). the US have had little impact onproduct cost, mostly borne byChina. Chinese Foreign Ministryspokesman Geng Shuang onTuesday refuted US criticism thatChina has gone back on commit-ments made in the previous roundsof talks.

Mutual respect and mutual ben-efit is the precondition for us toreach a treaty. Raising tariffs can-not resolve any problem. I have toclarify that negotiation itself is aprocess of discussion," he said.

Reacting to criticism thatChina is changing its position onthe negotiations in view of Trumps'threats to impose tariffs, he said,we have seen that many times be-fore.

An Indian owner of aMalayalam television station inthe UAE and its finance head al-legedly fled the country withoutpaying the staff their dues, afterthey struggled to keep the ventureafloat amid mounting losses, ac-cording to a media report onTuesday.

Channel D was launched abouttwo years ago and it operated fromits boutique studio in Jumeirah inthe UAE. The channel also had aunit in Kochi, Kerala.

The owner and the finance headfled the UAE without paying sever-al months of outstanding salary,the Gulf News reported.

"We had not been paid formonths but in the hope of a turn-around the dozen odd staffers lum-

bered on. Nobody expected the endto come so soon," an unnamed sen-ior staff of the channel was quotedas saying by the Gulf News.

The TV station's office inJumeirah remains shut but thechannel is still on air.Channel Dwas launched about two years agoand it operated from its boutiquestudio in Jumeirah in the UAE. Thechannel also had a unit in Kochi,Kerala.

"They are running repeats ofold shows. But even that is likely tostop when their contract withEtisalat expires this month end,"he said.

A cameraman, who claims thecompany owes him seven monthssalary in arrears, said he was re-peatedly assured that their dueswould be settled.

"We were told that a new in-

The Federal InvestigatingAgency (FIA) arrested eightChinese nationals, including awoman, on Monday and lastweek, two Chinese nationalswere arrested when a marriageceremony was being per-formed in Fasialabad, about150 kms from Lahore.

"On Monday, we have ar-rested seven Chinese men anda Chinese woman for their al-leged involvement in traffick-ing of Pakistani girls to Chinafor the purpose of prostitu-

tion," FIA Punjab DirectorTariq Rustam told PTI.

The FIA swung into actionfollowing reports of Chinesenationals being involved in or-gan trade and forced prostitu-tion of Pakistani girls, mostlyfrom the minority Christiancommunity, after marryingthem and taking them back toChina.

Rustam said that theirleader, indentified as 'Candice',was among those arrested. Hehas been living near the Lahoreairport for the last one year.

"The girls were moved tothe rented houses acquired bythe Chinese in Lahore wherethey were taught Chinese lan-guage before they leaving forChina after completion of theirmarriage related documents,"he said, adding the girls wereforced into prostitution inChina.

Afghanistan chief selector Dawlat KhanAhmadzai Tuesday justified the unexpectedsacking of ODI skipper Asghar Afghan aheadof the World Cup, saying the decision was tak-en looking at the long-term future of the team.

The three-member selection panel led byAhmadzai announced three captains for threeformats last month, in a move that led to un-rest in the team with star players Rashid Khanand Mohammad Nabi openly voicing theirconcerns over the timing of the decision.

"We realised that we can't win the WorldCup at this moment under Asghar's captaincyor anyone else who would have been in charge.We made the decision not just thinking aboutthis World Cup, we are thinking about the 2023edition.

"We will be getting 10 matches with fullmembers and we feel it will provide perfecttraining for the new captain (Gulbadin Naib),"said Ahmadzai, who is a former Afghanistanfast bowler, in response to a PTI query.

Asked about the need for announcing splitcaptaincy less than two months from theWorld Cup, the chief selector said: "Like youare expressing your concern to me, there wereconcerns expressed by the players (Rashidand Nabi) and the entire issue was handledprofessionally.

"They felt it was not the right time tochange captaincy but later understood that itwas in the best interest of the team."

Asghar was the captain in all formats butnow Naib will lead the team in the 50-overWorld Cup, Rashid in T20s and Rahmat Shahin Tests.

Ahmadzai insisted Naib is the right choiceto captain Afghanistan in ODIs.

"The team members, including Rashid andNabi, are now happy for Gulbadin. He is not anew man. He has been playing for 17 years andhas captaincy experience at the first-class andU-19 level. "Asghar himself has said thatGulbadin is like his younger brother who be-lieves that Asghar's experience will come inhandy in the World Cup. They are a united

front now. Changes happen. Sri Lanka alsochanged their captain," said Ahmadzai refer-ring to Naib, who has played 52 ODIs and 38T20 Internationals.

"Hamid Hasan is back into the fast bowlingattack and that is a big boost. He has been agreat fast bowler for Afghanistan and will leadthe pace attack alongside Dawlat Zadran." Heis also happy with the team's preparation forthe quadrennial event.

"Two things are required for the team toperform well: selection and preparation. Wehave been working on that for the past sixmonths. We have played in Scotland andSouth Africa, we feel the preparation is com-plete. "We have a well-balanced team. Rashidhas done well in county cricket, Mujeeb canuse the new ball and we have potent fastbowlers who can exploit English conditions."

In bunch of petitions challenging selectionmade by respondent for the posts of AssistantTourist Officers pursuant to AdvertisementNotification No.03 of 2012 dated 28.12.2012.Justice Sanjeev Kumar dismisses the petitionswith the observations that question of eligibili-ty of two candidates Basharat Hussain, whowas selected under ALC category and AmarMaqbool who being next in order of merit isplaced in the wait list. The petitioner-ManojKumar is aggrieved of the selection of BasharatHussain and placement of Amar Maqbool in thewait list whereas Amar Maqbool assails the se-lection of respondent Basharat Hussain underALC category so that he being next in the orderof merit gets birth in the select list. It is not indispute and is, otherwise, clearly borne outfrom the record that Basharat Hussain is agraduate and therefore, fulfills the basic eligi-bility of qualification. Whether he had the ade-quate knowledge of history, geography of theState and foreign language or not, is a questionwhich cannot be determined by this Court.There was objective type written test conductedby the respondents which contained a widerange of questions good enough to test theknowledge of the candidate in the field of histo-ry, geography, foreign language and tourismand travel etc etc. The shortlisted candidateswere also subjected to viva vice, where alsothere was ample opportunity for the InterviewCommittee to test such knowledge of the candi-dates. The grievance of the petitioners that re-spondent-board could not have considered theBA qualification of respondent No.6 BasharatHussain acquired from the IGNOU through dis-tance mode is not substantiated by any materialbrought on record or through persuasion sup-ported by logic. The UGC Notifications reliedupon by the petitioners do not prohibit a candi-date from simultaneously pursuing two cours-es; one from the State Board of SchoolEducation or other from the IGNOU. The UGCNotifications and the Regulations framed bythe UGC, however, do not permit a candidate tosimultaneously pursue two degrees from thesame University or from different Universities.Admittedly, in the instant case, respondentNo.6 Basharat Hussain while he was nearingcompletion of his diploma course of State Boardof Technical Education, J&K, he took admis-sion in the degree course in Tourism from IG-NOU, New Delhi. In these circumstances, itcannot be said that the respondent No.6Basharat Hussain pursued two degree coursessimultaneously either from the sameUniversity or from two different Universities.The diploma course, which Basharat Hussainwas pursuing was from the State Board ofTechnical Education and not from anyUniversity, therefore, he was not prohibited bylaw, rules or regulations to pursue his degreecourse through distance mode from the IGNOU,New Delhi. I do not find any illegality commit-ted by the respondent- board in considering hiscandidature. Admittedly, Basharat Hussain ob-tained more points in the selection process thenthe petitioners Manoj Kumar and AmarMaqbool and therefore, placed in the select listunder ALC category. The grievance of AmarMaqbool against respondent No.6 BasharatHussain on the similar lines, is also not tenablein law. The reliance of the learned counsel forthe petitioners under Notification of IGNOU is-sued in June, 2012 is equally not tenable. Whatis permitted by the IGNOU in case of certainprogrammes/combinations is to pursue suchtwo programmes/combinations of distance andregular modes simultaneously from the sameor different Universities. Whether it is aNotification issued by the IGNOU or by theUGC it pertains only to the pursuing of two pro-grammes simultaneously from the sameUniversity or from different Universities.There was, thus, no prohibition of any kind puton pursuing the two courses simultaneouslyone from the Board and another from theUniversity. For all these reasons JusticeSanjeev Kumar observed that this Court is notpersuaded to agree with the submissions urgedby the petitioners in this behalf. JNF

In the 2018-19 fis-cal year, alcohol sales fromoutlets run by the KeralaState BeveragesCorporation (BEVCO) andConsumerfed touched arecord Rs 14,508 crores, pro-pelled largely by the liberalliquor policy of the currentLDF regime and re-openingof outlets that had beenshut down as part of a pro-hibition policy of the previ-

ous UDF government. Therise in sales of nearly Rs1570 crores over the 2017-18FY confirms a pattern ofcontinued positive growthof liquor sales in the statesince 1984-85. The grossliquor sales value in 1984-85

was Rs 55.46 crores. In thelast fiscal, Rs 12,424 croresfrom liquor sales fell intothe state coffers, nearly 85per cent of the total rev-enue. A total of 216.34 lakhcases of IMFL and an addi-tional 121.12 lakh cases of

beer were sold across thestate. While brandy was theclear favourite among thetipplers followed by rumand vodka, McDowell’sNumber 1 was the most soldbrand. Incidentally, thehighest gross sales value ofBEVCO was reported inAugust last year, the monthwhen the state was hit bydevastating floods. Liquorsales touched Rs 1264.69crores that month, whichBEVCO officials attributeto the festival of Onam.Every month in the last FYhas recorded an averagesale of Rs 1200 crores. Thestate government operates306 outlets of BEVCO andConsumerfed alongside 480bars.

A Delhi Police sub-in-spector allegedly commit-ted suicide on Tuesday byshooting himself with aservice pistol in SouthWest Delhi, police said.The deceased has beenidentified as SI SanjeevKumar, they said.
