The incident occurred last night when the matador, which was on its way to Billawar from Kathua, overturned near Pinthar killing two persons on the spot and injuring 29 others, a police officer said. Twenty-one people with seri- ous injuries were rushed to the Government Medical College and Hospital, Jammu, whereas rest 8 of the 29 injured, were admitted to dis- trict hospital, Kathua, he said. The deceased have been identified as Sahil (16) and Subash Chand (30), both residents of Billawar, the See 2 Killed on page 11 Devotees paying obeisance at Amarnath shrine cross 2 lakh mark Srinagar, Jul 25 (PTI) Over two lakh pilgrims have so far paid obeisance at the Amarnath cave shrine and the yatra which was suspended thrice due to unrest in the Kashmir Valley is now continu- ing smoothly, officials said today. So far 2,04,146 pilgrims have paid obei- sance at the cave shrine which hous- es the naturally-formed ice-shiv- lingam. 1646 pilgrims performed 'darshan' at the holy cave till 1 PM to- day while 3175 yatris visited the cave during the day yesterday, they said. The 48-day yatra commenced from the twin tracks of the 42-km Pahalgam route in Anantang dis- trict and the 12-km shorter Baltal route in Ganderbal district on July 2. It is scheduled to conclude on See Devotees on page 11 Jammu, July 25 With peace returning gradually in different parts of Kashmir valley the state govt authorities Monday evening restored the mobile internet services after a gap of more than 15 days in Jammu. The services will continue to remain suspended in Kashmir valley. The mobile internet services were snapped in Jammu after violent clash- es were reported across Kashmir val- ley in the aftermath of killing of HM Commander Burhan Wani on July 8. The news was greeted by youngsters by hooking on to their social network- ing sites and exchanging notes with each other. The local administration in Jammu had decided to suspend the mo- bile internet services to check mush- rooming of rumour mongers on the so- cial networks at a crucial time. During the period the local authorities took pe- riodic review and extended the ban as they were awaiting improvement in the law and order situation in parts of Kashmir valley as well. According to official sources no untoward incident was reported during the period and sit- uation remained under control. The decision to resume the mobile internet services was taken during the fresh re- view meeting and overall assessment of the security situation across the state during the two day long visit of Union Home Minister Rajnath Singh. The student community also heaved a sigh of relief after the services were re- stored as they were required to com- plete admission formalities and pay their fees online to complete the admis- sion formalities in different colleges. Though broad band services were functional in Jammu but it was not suf- ficient to cater to the growing demand of net users in the state. Drass (Kargil), Jul 25 (PTI) Army Chief Gen Dalbir Singh Suhag today paid homage to martyrs of Operation Vijay on the 17th Kargil Vijay Diwas at the War memorial in Drass. Accompanied by Lt Gen DS Hooda, Army Commander, Northern Command, and GOC Fire and Fury Corps, Gen Suhag also interacted with the widows and rela- tives of the martyrs and oth- er awardees during the event. He paid tributes to the sacrifices and expressed his gratitude to the martyrs, their next of kins. New Delhi, Jul 25 (PTI) Amidst growing strain in Indo-Pak ties, India today ad- vised its diplomats and offi- cials posted in its High Commission in Islamabad to make arrangements for edu- cation of their wards outside Pakistan from this academic session, virtually downgrad- ing it as a "non-school-going station". The announcement came after a government's re- view of staffing and related policies for their diplomatic missions as also prevailing circumstances at the station. External Affairs Ministry Spokesperson Vikas Swarup said, "It is a normal practice for all countries to review staffing and related policies for their diplomatic mis- sions, including in view of prevailing circumstances at those stations. "With effect from this academic session, officials posted in the High Commission of India in Islamabad have been advised to make arrangements for ed- ucation of their wards out- side Pakistan, till further no- tice." According to officials, there are about 50 school-go- ing children of Indian offi- cials, who are currently post- ed in Indian mission in Islamabad. The activists, led by Mann, in half a dozen vehicles, were on their way to Kashmir from Amritsar and were detained at Lakhanpur of the district, police said. The activists staged a protest at Lakhanpur while raising slo- gans to restore peace and stop atrocities in Kashmir. "We are going to Kashmir with a message of peace and want to talk to all sections of society, government, public, hurriyat conference and oth- er parties as other political parties have failed to restore peace in the state," Mann said. He also condemned the using of pellet gun on protest- ers in Kashmir. New Delhi, Jul 25 (PTI) Congress leader Mallikarjun Kharge today sought a statement from Defence Minister Manohar Parikkar on the fate of the Indian Air Force AN-32 air- craft which went missing over Bay of Bengal with 29 defence personnel on board four days ago. Parliamentary Affairs Minister Ananth Kumar said the Government, Defence Ministry and Air Force were working to locate the aircraft and rescue the See Defence on page 11 New Delhi, Jul 25 (PTI) With a series of terrorist activities being reported in Jammu and Kashmir and the North East region, the Centre today said such acts have af- fected tourism "locally" but ruled out its impact on the overall industry in the coun- try. In a written reply to Lok Sabha, Tourism Minister Mahesh Sharma said, "Though terrorist activities have to some extent affected tourism locally, they have not had an impact on overall tourism in the country." He was responding to queries whether the "grow- ing" incidents of terrorist ac- tivities in the North East states and Jammu and Kashmir were causing "enor- mous" loss to tourism. In Jammu and Kashmir, Domestic Tourist Visits (DTVs) fell about 3 per cent to 91.45 lakh last year from 94.38 lakh in 2014, while Foreign Tourist Visits (FTVs) de- creased by about 32 per cent to 58,568 in 2015 from 86,477 in 2014, Sharma said. He said the DTVs to different states and Union Territories recorded a growth of 11.6 per cent in 2015, while FTVs increased by 4.4 per cent. Media reports have claimed thousands of tourists were fleeing violence-hit Kashmir and bookings were being cancelled due to unrest and consequent curfew in the Valley following the killing of Hizbul commander Burhan Wani in an encounter on July 8. North Eastern states also ac- count for casualties due to ter- ror attacks, with a report stat- ing that 413 people died in the region in 2014, with Assam be- ing worst affected. Sharma al- so listed out various state ini- tiatives to boost tourism in Jammu and Kashmir, includ- ing special campaigns on the See Violence on page 11 Jammu, July 25 Branding the separatists "stooges of Pakistan," BJP to- day said there was no need to hold talks with the Hurriyat leadership which has been working hard to keep the "Kashmir pot boiling." "No talks should be held with the separatist leaders like Syed Ali Shah Geelani, Mirwaiz Umar Farooq and Yasin Malik who are not only responsible for the present situation in Kashmir Valley but are acting as stooges of Pakistan to keep Kashmir pot boiling," BJP state spokesman Virender Gupta said. He said separatists were working for the benefit of Pakistan and against the in- terests and integrity of India. There are a snumber of cases against them for committing murder of army, security per- sonnel and pro-India ele- ments and were instrumental in migration of Kashmiri Pandits and other minority communities. Gupta said these leaders have waged a war against India at the be- hest of Pakistan and favour Kashmir becoming a part of Pakistan. He said there was a need to vigorously pursue the pending cases against the separatists as "this is essen- tial to restore normalcy and peace in the Valley." "The stakeholders for whom the talks can be held for resolving the issues of Jammu and Kashmir are the people of Jammu region, Kashmir valley, Ladakh re- gion, Kashmiri Pandits, dis- placed persons of PoK and people of various religious and ethnic groups," he said. He said people of Jammu and Ladakh regions have suf- fered discrimination and po- litical neglect since Jammu and Kashmir acceded to India and the displaced peo- ple of PoK need more atten- tion in any negotiation to be held. "Granting of greater au- tonomy would harm the na- tional interest and aspira- tions of the people of Jammu and Ladakh regions as it shall further empower the Valley elite and subject the people of these regions to more neglect," Gupta said. He said Kashmir was not entire Jammu and Kashmir, it is merely 15 per cent area of the state which is under Indian ju- risdiction and constitutes about 45 percent of the state's population. There is more than 60 per cent silent majority in the Valley which has nothing to do with the present turmoil and wants to remain part of Indian democracy. Srinagar, Jul 25 (PTI) Curfew and other restric- tions continued in Kashmir as authorities on Monday stepped up security in view of a march called by separatists to Anantnag district, which has seen the highest number of deaths during the unrest in the Valley. "Curfew is in place in Anantnag, Baramulla, Kulgam, Pulwama and Shopian districts of the Valley as a precautionary measure in view of the call given by some elements for a march to Anantnag district town," a police official said. He said areas falling un- der the jurisdiction of 11 po- lice stations Srinagar were al- so placed under curfew. "Restrictions are in place in four districts -- Bandipora, Budgam, Ganderbal and Kupwara and remaining ar- eas of Srinagar city," he said. The official said the situa- tion in the Valley was so far peaceful with no untoward in- cident reported from any- where. Clashes had broken out between protesters and security forces after Hizbul Mujahideen commander Burhan Wani and his two as- sociated were killed in an en- counter with security forces on July 8. So far 47 people including two policemen have been killed and over 5,500 injured in the violence. Mobile telephony, mobile internet services and train services remained suspended for 17th day while schools, colleges and other education- al institutions also remained closed due to a strike called by the separatist groups to protest the civilian deaths. Separatist groups, which are spearheading the protests in the Valley, had called for a march to Anantnag on Monday. More than 15 persons have died in Anantnag dis- trict alone during the unrest. They have also extended the strike call till July 29 with a call to march to Kulgam dis- trict on Wednesday. From Jaishree Balasubramanian Bangkok, Jul 25 (PTI) Advocating outright re- jection of state-sponsored ter- rorism, India today said it is vital to construct a strong in- ternational legal regime on the principle of "zero toler- ance" for terrorism and iso- late those who harbour, sup- port or sponsor terrorists. "Countering terrorism is an imperative, in the face of ris- ing terrorist attacks across the globe, including in our re- gion, notably in Jakarta, Bangkok, Pathankot, Dhaka and Kabul in recent times," Minister of State for External Affairs V K Singh said at the 14th ASEAN-India Foreign Ministers' Meeting in Vientiane, Lao People's Democratic Republic. "It is vital to construct a strong international legal regime, built on the principle of 'zero tolerance' for direct or indirect support to terror- ism, adopting an 'extradite or prosecute' standard and en- suring obligatory collabora- tion by countries in the inves- tigation of terrorism related cases," he said. Singh assert- ed that deepening of security cooperation must be based on an "outright rejection" of state-sponsored terrorism, isolating those who harbour, support or sponsor terrorists and bringing the perpetra- tors, organisers, financiers and sponsors of terror to speedy justice. Noting that today's reali- ties warrant that nations act for urgent finalisation of the Comprehensive Convention on International Terrorism at the UN, he called on ASEAN countries to support its early adoption. Singh said India would also like to host an ASEAN-India Conference on preventing radicalisation and promoting de-radicalisa- tion, to share India's experi- ence and benefit from the ex- perience of ASEAN coun- tries, notably Malaysia, in this important area. In addition, India will co- cost with Indonesia, an ASEAN Regional Forum in- ter-sessional meeting on counter-terrorism, he said. "Politico-security coopera- tion between ASEAN and India is on the upswing. Reflecting our commitment to strengthen cooperation to effectively deal with tradi- tional and non-traditional se- curity challenges, the first G- 2-G ASEAN-India Cyber Dialogue would be held in India in August 2016," he not- ed. "We have also offered ASEAN countries a 'spe- cialised programme' on re- ducing cyber crime through knowledge exchange and ca- pacity building" and a semi- nar on "e-governance", as joint activities under infor- mation and communications technology cooperation, Singh said. He stressed that India's relationship with ASEAN is one of the corner- stones of its foreign policy and the foundation of the 'Act East Policy'. "We look for- ward to working closely with you to realise the full poten- tial of our relationship as an enabler for the shared progress and development of our countries and region," Singh, who also attended the seventh Mekong Ganga Cooperation Ministerial Meeting here, said. Mekong Ganga Cooperation member states, including India, have strong- ly pitched for ASEAN inte- gration and increased con- nectivity to help narrow the development gap and called for collaboration with a "sense of urgency". The pledge was made at the sev- enth Mekong Ganga Cooperation Ministerial Meeting held here yesterday, that was attended by foreign ministers of the member states, including Singh and Mayanmar's Foreign Minister Aung San Suu Kyi. The Mekong Ganga Cooperation (MGC) was es- tablished on November 10, 2000 at Vientiane at the First MGC ministerial meeting. It comprises six member coun- tries -- India, Thailand, Myanmar, Cambodia, Laos and Vietnam. Curfew and other restric-tions continued in Kashmiras authorities on Mondaystepped up security in view ofa march called by separatiststo Anantnag district, whichhas seen the highest numberof deaths during the unrest inthe Valley.

"Curfew is in place inAnantnag, Baramulla,Kulgam, Pulwama andShopian districts of theValley as a precautionarymeasure in view of the callgiven by some elements for amarch to Anantnag districttown," a police official said.

Advocating outright re-jection of state-sponsored ter-rorism, India today said it isvital to construct a strong in-ternational legal regime onthe principle of "zero toler-ance" for terrorism and iso-late those who harbour, sup-port or sponsor terrorists."Countering terrorism is animperative, in the face of ris-ing terrorist attacks acrossthe globe, including in our re-gion, notably in Jakarta,Bangkok, Pathankot, Dhakaand Kabul in recent times,"Minister of State for ExternalAffairs V K Singh said at the14th ASEAN-India ForeignMinisters' Meeting inVientiane, Lao People'sDemocratic Republic.

"It is vital to construct astrong international legalregime, built on the principleof 'zero tolerance' for direct orindirect support to terror-ism, adopting an 'extradite orprosecute' standard and en-suring obligatory collabora-tion by countries in the inves-tigation of terrorism relatedcases," he said. Singh assert-ed that deepening of securitycooperation must be based onan "outright rejection" ofstate-sponsored terrorism,isolating those who harbour,support or sponsor terroristsand bringing the perpetra-tors, organisers, financiersand sponsors of terror tospeedy justice.

for urgent finalisation of theComprehensive Conventionon International Terrorismat the UN, he called onASEAN countries to supportits early adoption. Singh saidIndia would also like to hostan ASEAN-India Conferenceon preventing radicalisationand promoting de-radicalisa-tion, to share India's experi-ence and benefit from the ex-perience of ASEAN coun-tries, notably Malaysia, inthis important area.

"We have also offeredASEAN countries a 'spe-cialised programme' on re-ducing cyber crime throughknowledge exchange and ca-pacity building" and a semi-nar on "e-governance", asjoint activities under infor-mation and communicationstechnology cooperation,Singh said. JKNPP state presidentBalwant Singh Mankotia, to-day met Union Home MinisterRajnath Singh in Srinagar to-day to discuss the prevalentsituation in the State. This wasdisclosed by him in the pressconference held in the partyheadquarters in Jammu today.Mankotia while interactingwith the media disclosed thathe had submitted to the UnionHome Minister that ever sincethe BJP-PDP had forged an al-liance to form the government,ugly subversive incidents hadbeen continuously takingplace thus vitiating peace andtranquility in the State. Hesaid that the two parties wereopposite poles and their subse-quent coalition had betrayedthe aspirations of the people.He further added that it wasone of the factors which led tothe turbulence in the valleyand several agitations besidesprotests in Jammu region aswell. Mankotia also brought tothe notice of the HomeMinister that during the pres-

ent regime of the coalition gov-ernment, open space and free-dom were given to the seces-sionists and anti-national ele-ments which had emboldenedthem to rebel against the stateand the country. He said thatthere were several incidentsduring the holy month ofRamadaan where ISIS and Pakflags were brazenly waved bythe miscreants in Kashmir toflare up tension and the delib-erate negligence and gross fail-ure of the State government to

control the situation were re-sponsible for the prevalent cri-sis in the valley. Mankotia di-vulged that Pakistan had beenpersistently pushing terror-ists in the State and unleash-ing false propaganda againstIndia via electronic and socialmedia. He submitted to theHome Minister that hostilePakistan had waged a full scaleproxy war against India as itwas evident from the obser-vance of ‘Black Day’ on July20th in Pakistan against the

elimination of dreaded Hizbcommander Burhan Wani inKashmir. Mankotia urged theUnion government to rein- inPakistan by diplomatic meansto prevent the rogue country tospread terror on our soils. Hesaid that it was a high time forIndia to take up the issue ofdeclaration of Pakistan as aTerrorist State besides politi-cal banishment of the roguenation from the internationalcommunity. He further sub-mitted that the NDA govern-

ment had shown non-chalantapproach towards the aspira-tions of the people of JammuPrade He added that the elec-torate of Jammu region washoodwinked, cheated and be-trayed by the heavily mandat-ed BJP leaders who had suc-cumbed to the dictates of its al-ly and the secessionist forcesfor the loaves of power.

He apprised the HomeMinister that the seethingfury among the Jammu mass-es would erupt explosively iftheir demands were not con-ceded sooner which werepromised by the BJP duringelection campaigns. He fur-ther maintained that the inci-dents of violence and man-handling of Jammu driverson the Highways by the felonsin Kashmir would further ag-gravate the situation andwith cross- plying of commer-cial vehicles between Jammuand Srinagar coming to halt,it would severely hit the econ-omy of the State. Mankotiasaid that imposition ofGovernor Rule only couldsave the State from furtherdeath and distruction.

MaloveShah, Nilesh Doshi from M/S.Siddhi Industrial Co, Ahmadabadand Nishank Shah, Duro Green(Towards Zero waste)Ahmadabad, demonstrated theworking of the composting Unitand apprised the authorities thatthe process of waste managementshall be completely odour free, costeffective and requires no addition-al man power. Also, the compostgenerated as the end product of thecomposting process has high NPK

value and carbon content and canbe used to maintain the lawns andnursery of the University. Sher-e-Kasmir Universityof Agricultural Sciences andTechnology - TeachingAssociation Jammu(SKUAST-TAJ) has expresseddisappointment overGovernment’s decision to de-fer the implementation of 7thPay Commission recommen-dations for another two yearsin the Sate.

The issue came up for dis-cussion in the meeting of theassociation held here todayunder the chairmanship ofSKUAST-TAJ President Dr.Vikas Sharma. Questioningpresent CoalitionGovernment Dr. Vikas saidthat late implementation of6th pay commission by threeyears has already created amess in different StateVarsities and Departments asthe pay anomalies of 6th CPCare not yet removed leading tofinancial liability inEducational Institutions ofState and this timeGovernment is again commit-ting same mistake. He also de-manded grant of HRA at equalrates / at par with Jammu cityfor scientists who are working

in Research Stations andKVKs in far flung areas for thebetterment of farming com-munity as per 7th PC.

Speaking on the occasion,SKUAST-TAJ President saidthat the attitude of Govt.shows double standard as onone side, the salaries of legis-latures were doubled in a sin-gle stroke and now in case ofemployees the Govt. is giving

excuses of financial crunch.He further said that no prob-lem that Government haspassed the bill to double thesalaries /allowances of legis-lators from Rs 80,000-160,000/month, but at thesame time the coalition Govt.should take care of Sate Govt.Employees regarding 7th PayCommission.Dr. Vivak. TAJ said that the implementa-tion of 7th Pay Commission bythe Central Government is alaudable step, State Govt.while taking a cue from thisdecision needs to implement7th PC report in letter andspirit and its benefit be ex-tended to the Employees since2016, as early as possible. Alleging large scalebunglings and frauds in therecent transfer orders ofMasters in Jammu Division,Harsh Dev Singh ChairmanJKNPP and FormerEducation Minister hassought a high level probe intoall such transfers in view ofcomplaints of serious naturepouring in from various quar-ters.

He said that besides me-dia reports of irregularitiesand violation of stipulatednorms, several deputationshad called upon him and ap-prised of the extraneous con-siderations that had gone intothe issuance of the said trans-fer orders. He expressed hisdismay that the transfer list ofMasters revealed that dozensof Masters had been trans-ferred against non-existentposts while several otherswere transferred againstposts which were to becomeavailable in Dec. 2016 andJanuary 2017. He furtherpointed out the large scale ‘ze-ro’ km transfers of Masters inblatant violation of transfernorms which were reported tohave been made on monetaryconsiderations which howev-er needed to be investigated.

Singh said that there wereseveral other instances wherepre-mature transfer ordershad been issued by DirectorEducation without approvalof administrativeDepartment which is an es-sential concomitant of trans-fer policy thus rendering thewhole exercise illegal. He saidthat transfer policy with re-gard to single parent and re-tiring employees was alsobeen blatantly violated. Hefurther pointed out transferorders having been issued onmedical grounds without ful-filling the mandatory require-ment of certificate from stand-ing Medical Board. It is 25 years since July 1991, etchedin memories as a watershed, when eco-nomic liberalisation began life in India.The story starts earlier. I lived throughthat era as Chief Economic Adviser tothree successive governments in a spanof two years marked by economic crisesand political uncertainties. During the1980s, the competitive politics of pop-ulism led governments into a spendingspree. But it was not possible for the gov-ernment, or the economy, to live beyondits means year after year. The fiscalregime was unsustainable. The in-evitable crunch did come. The minor oilshock of 1990 following Iraq’s invasion ofKuwait was the last straw that broke thecamel’s back. The balance of paymentssituation became almost unmanageable.

We simply could not default on ourinternational payments obligations. Itwould have turned us into a basket case.It was firefighting day by day, survivingmonth by month, while working at solu-tions, whether borrowing from theInternational Monetary Fund (IMF), im-posing massive cash margins on im-ports, or selling gold confiscated fromsmugglers. This provided breathingtime, enabling us to strategise for whatneeded to be done when an elected gov-

ernment assumed office. This happenedin late June 1991. Meeting the challenge Itwas the worst crisis in the economy of in-dependent India. The prospect of defaulthung over our heads, much like theproverbial Sword of Damocles, for al-most 12 months. The continuing politicaluncertainties compounded difficulties.

Yet, there was a strong determination tomeet the challenge. It is mirrored inthree stories. In mid-October 1990, amonth before it fell, the V.P. Singh gov-ernment decided to approach the IMF fora loan. This step was recognised as essen-tial despite caricature perceptions of theIMF as a moneylender in the Shylock tra-

dition. The successor Chandra Shekhargovernment, hesitant to begin with,quickly endorsed the idea. Over the nexttwo months, I led our negotiations withthe IMF for borrowing under the firstcredit tranche and the Compensatoryand Contingency Financing Facility (de-signed to help meet the increased cost ofpetroleum imports). It was a toughprocess, but we obtained $1.8 billion withminimal conditions in late January 1991.The resolve of the government to avoiddefault and the stature of the Republic ofIndia, even in deep crisis, helped us drivea hard bargain.

The comfort did not last long. TheCongress party withdrew support andthe Union Budget could not be presentedin February 1991. We had a caretakergovernment and a general election tocome. But the liquidity crunch was on.Foreign exchange reserves were per-ilously low. There was capital flight fromnon-resident deposits. In this milieu,restoring international confidence wasimperative. In the midst of the electionprocess, the caretaker government de-cided to ship 20 tonnes of gold, confiscat-ed from smugglers, to raise $200 millionfrom the Union Bank of Switzerlandthrough a sale-with-a-repurchase option.

It has really become a norm for Pakistanipoliticians to make unrealistic claims and repeat popularphrases for getting votes. The newspaper termed the state-ment as “wishful thinking “ and suggested Nawaz Sharief tosit back and think with a cool mind the ways to resolve the re-gional issues. History shows that wars or war like tactics donot help resolve the conflict. Rather the masses continue tosuffer due to this mentality. India has always extended a handof friendship to its neighboring countries but in wake of state-ments like this it becomes difficult to remain friends forever.He is the Prime Minister of Pakistan and a cheap statementlike he said was not expected from him this time though Indiahas got many unexpected actions like Kargil from Pakistan.Political equations in India too have changed and country isin better position to deal with trouble makers. Instead of in-terfering in India’s internal affairs Pakistan needs to makePoK a better place to live. Many areas of the PoK are still fac-ing neglect where people have no access to basic needs of life.Law and order in cities like Karachi of Pakistan is worse.People don’t feel safe in road, they are hiring gun wieldingguards to survive in Karachi, Armored cars reinforcementbusiness has gone very high in Pakistan where people fear oftheir lives. Even doctors and dentists hire gunmen to reachtheir clinics in Karachi. So Pakistani PM should set his housein order rather indulging in mindless statements onKashmir. India is a strong nation and knows very well, how toprotect its mother land. By planting few agents in KashmirPakistan is dreaming to make Kashmir a part of Pakistan.This is a dream of Nawaz Sharief and this dream will neverfulfill. “Sapne agar sach ho jate, to ye sapne keon kehlata”.

Nalanda Mahavihara arya vikshusanghasya”. These words were inscribedon several plaques, discovered while ex-cavating a huge mound covered withwild vegetation in Bargaon, an obscurevillage of Bihar in 1861. Thus was estab-lished, beyond doubt, the existence of anelite educational institution at Nalanda,that had also been mentioned by Chinesetraveller Hiuen Tsang in his famous trav-elogues. The legendary British Directorof the Archeological Survey of India, SirAlexander Cunningham, had declaredthe travelogues as an authentic chronicleof history and not merely a figment ofimagination. Today, the historic site atNalanda has been included as a WorldHeritage Site by United NationsEducational, Scientific and CulturalOrganisation. It is a great honour andtribute for all that the site carries in it-self. ‘Nalanda’ is a syntax of ‘Nalam’ iethe lotus of wisdom and ‘Da’ ie the deliv-

erer. True to its name, the fourth centuryNalanda Mahavihara was the first majorresidential university in the world, fi-nancially and otherwise, supported notonly by native monarchs but also byoverseas patrons from place such as Javaand Sumatra. After flourishing and dis-seminating world-class education formore than 600 years, it was finally burntinto ashes by a Muslim barbarian-in-vaders who had no respect for otherfaiths, talent and achievements, in 1193.

Sixth century monarch Kumarguptaof the Gupta dynasty was the founder-pa-tron of the Mahavihara. During the reignof King Harsa of Kannauj, in 606-647 AD,the university evolved into a dynamic,international institution, enjoying pa-tronage from all over. The royal patron-age ended with the Pal dynasty that ruledover Bengal and Bihar of today. Threemore contemporaries viz Vikramsilaand Odantapuri in Bihar and SomapuraMahavihara in Paharpur (now inBangladesh), were also supported by the

Pal dynasty. Of these, Vikramsila posedtough competition for Nalanda with re-spect to academic excellence and re-search. Hindu and Buddhist monarchswere equally disposed towards these in-stitutions in terms of financial supportand patronage. With 10,000 students oncampus, 2,000 teachers fromBharatvarsa, China, Tibet, Siam, Persia,Korea, Java, Sri Lanka, Japan, Sumatra,Nepal and Greece, Nalanda Mahaviharaspread across a 50 square kilometre areahad mind-boggling infrastructural facili-ties. Revenue collected from 200 villagesunderwrote all expenses, and campus ed-ucation was completely free.

Nalanda also had an interesting ad-mission procedure. With four gates onfour sides, every student aspirant was re-quired to outdo the learned gatekeeperswith his intellectualism and answers atthe gate itself, before being allowed to en-ter into the campus for admission. Withone Nagarjuna being the first Principal-Master of the Mahavihara, it had very

eminent scholars like Vasubandhu,Asanga, Silabhadra, Dharmakriti andAryadeva as faculty teachers. The entireMahavihara was always pulsating withscholarly discussions, debates, intellec-tual arguments and intellectual rejoin-ders with advanced education offered indisciplines like theology, geography, log-ic, mathematics, philosophy, grammar,metallurgy, metaphysics, aviation, ar-chitecture, chemistry, cosmology, astrol-ogy and astronomy, tantra, medicine andsurgery, ayurveda, and the languages. Itproduced scholars like Aryabhatta,Varahamihira, Kalidasa andVatsayayana. Hiuen Tsang too taught forsometime after completing his educationtherein. The Nalanda campus, the firstresidential university in the world, wasequipped with 108 units with every unithaving 30 well-furnished rooms, centralassembly hall, various prayer halls andnumerous stupas scattered around.Parks, pavements, rest-halls, water canalflowing through the campus, excellentdrainage system and a gigantic centralkitchen adorned the campus. In its previous incarnation under A B Vajpayee, the BJP-ledNDA dispensation (1998-2004) had vigorously pursued “strate-gic” disinvestment of Union government’s shares in public sec-tor undertakings (PSUs), some of the high profile cases beingModern Food Limited (MFL), Hindustan Zinc Limited (HZL),Bharat Aluminium Company (BALCO) etc. The UPA govern-ment which took charge in 2004, abandoned this route. Thepresent NDA regime under Modi may have resurrected theidea. Looking at the budget for current and previous year, itwould appear so. For these years, Finance Minister ArunJaitley provided for Rs 28,500 crore (2015-16) and Rs 20,500 crore(2016-17) as proceeds from strategic route out of total divestmentproceeds of Rs 69,500 crore and Rs 56,500 crore, respectively.

But, so far, the outcome has been rather disappointing.Whereas, during 2015-16, not even a single case of divestmentthrough strategic route was pursued (in fact, the overall pro-ceeds by itself was less than half of the target), during the cur-rent year, at best, there is a possibility of the government takingup only one such case. Meanwhile, Jaitley asked Niti Aayog tocome up with options for divestment of government’s equity inPSUs. The Aayog has already submitted two reports viz, (i) onedealing with loss making PSUs and other (ii) for undertakingswhere strategic sales can be made. In category (i), it has recom-mended that their assets especially land and buildings (in manycases, these are in prime locations and can fetch tremendousvalue) should be sold. For category (ii) cases, it opines that thegovernment can enhance value by bringing in a strategic part-ner (this may also include some loss making PSUs).

Under this concept, the intent is to transfer a sizeable por-tion of ownership and management control to an investor (callhim ‘strategic’ investor) by selling commensurate shares.Apart from the much needed capital, he/she can bring in tech-nology, management skills, intellectual property and other re-sources that can help transform the way a PSU is run, make itgrow faster and enhance its competitiveness in an increasinglychallenging world. What should be the extent of divestment –10%, 20%, 25%? There cannot be “one-size-fits-for-all.” The levelcould vary depending on the area of operation, size, market cap-italisation, net worth, profit, potential to grow etc. In a transfor-mative sense, the government could also relinquish majorityownership and control by reducing its holding to below 50% orprivatisation in plain words. So, what is the stance of the gov-ernment? To get a sense of which way our policy makers couldmove, it may be worth navigating through the mindset of PrimeMinister Narendra Modi. From the day of taking charge (May2014), he has been chanting the mantra of ‘minimum govern-ment and maximum governance’ to ensure that development isspeeded up and people’s problems are solved promptly.Towards this end, he has removed bureaucratic hurdles, simpli-fied procedures, streamlined processes, and expedited ap-provals and clearances. Most crucial, in each of these areas, hehas put the entire machinery in to e-governance mode.Extrapolating from here, Team Modi has a sense that gover-nance reforms will percolate to PSUs as well. If it feels confidentof transforming the PSUs concerned without a strategic part-ner, why would it look for one? Forget shedding majority con-trol (that Jaitley has categorically ruled out), there is littlechance of the government divesting a good chunk of its holdingsay, 15-20% to a single investor. In the case of loss making PSUstoo, driven by the same logic, it seems unlikely that the govern-ment would pursue sale of assets. Thus, last year, the cabinetapp-roved revival of sick plants of Fertiliser Corporation ofIndia Limited (FCIL) at Sindri (Jharkhand) and Gorakhpur(UP) besides Barauni (Bihar) of Hindustan FertiliserCorporation Limited (HFCL). These plants have been sick formore than two decades even as attempts to revive them in thepast failed. Yet, the government is in no mood to relent. Apartfrom the confidence in its capability to turn around things on itsown, the government does not want to invite the displeasure ofentities affiliated to BJP (Bharatiya Mazdoor Sangh) whichhave opposed attempts for share sale in PSUs even in small bits.The opposition to stake sale in Coal India Limited (CIL) from

One of my friends, who is an anthropolo-gist, argues that the middle class Indian doesnot need to be psychoanalysed on a couch. “Acrowd,” he claims, “is a better method ofanalysing Indian repressions.” India’s politicsof anxiety emerges more at the level of thecrowd. “Crowds,” he adds, “are for negativedemocracy, the public for citizenship.” Forhim, the psychology of India unravels at twolevels. The first is at the level of the family, andwhere violence is more patriarchal. The sec-ond is at the level of an imaginary Jajmani sys-tem a socio-economic system more predomi-nant in rural areas and of its interaction be-tween the upper and the lower castes. In thiscaste bundle, there is constant shuffling whichprovides a sense of order and disorder. But thefact is that what looks like order at one levelmight be mayhem at the second level. For thishe uses the example of the cow and the politicsaround it which are very much in the news. Atthe domestic level, the cow is a god and repre-sents something sacred. Simultaneously, it isthe embodiment of an agricultural way of life.The cow is Gau Mata representing man’s one-ness with nature and is embodied in histotemic relation with the animal.

Now, a symbol of social fissuresBut this domestic arrangement acquires

political overtones. The nature of the symbol,the cow, changes and it soon comes to representthe worst in the caste system. The political bat-tles around the cow soon become deep. Let me

put it this way. The cow expresses the socialtensions within an agricultural society that isturning urban in its ways. Here, local panchay-ats disrupt what is normal by becoming vigi-lantes. Ironically, the cow becomes a symptomof the deep fissures within a society. Brahmins,Muslims and Dalits are fast losing their moor-ings in agriculture and the cow becomes asource of violence. Ironically the cow, insteadof representing the best of agricultural values,embodies the tension between a changing castesystem and the ideals of a constitutional India.As a result, we are soon inundated with imagesof and reports about social violence. In suchmoments of change, the Constitution becomesan empty document. Neither the rule of law norlaw and order is maintained. Vigilante groupsplay kangaroo courts while the rest of the na-tion can only watch. It is this sociology of vio-lence that we must confront. One thing is clear.The Government of India is blissfully deep inslumber as this process plays out. As victimsprotest the violence, the regime plays a game ofbeing indifferent. I must add that I am not re-porting one singular event but a cascade ofevents. As the urban social landscape flares up,one even begins wondering whether the muchtalked about smart cities of the future will havea civic place for the cow, even as imagination.Given the nature of Twitter and the Internet,every act soon goes viral. Events in even the re-motest corners of the country soon become aglobal spectacle. They become a part of the ecol-ogy of everyday memory and are difficult toshrug off.

It is not as if these “cow protection” groupsprotect the cow. They are not like the Jaingoshalas where there is deep respect for animallife and cattle are given shelter. These groupssee little connection between the cow and thefuture of agriculture. In fact, the cow, which isan icon, honoured in festivals, and consideredas a totem, becomes a symbol that leads to irra-tional violence. The high caste Hindu, insteadof seeking harmony between nature and cul-ture in which the cow is cosmologically repre-sented, now brutally disrupts both.

Minorities at the receiving endI go to the incident which lies at the heart of

all this. It was a scene that even went viral,which is perhaps how the world got to knowabout it. Mota Samadhiyala, 20 km from Unatown in Gujarat, is a village of around 3,000,comprising the upper-caste Patidars, and othercastes such as Kshatriyas, Kolis, Valand andDalits. While there are no visible lines that de-marcate the upper caste areas from this basti,the divide runs deep. People in the basti mostlywork as farm labourers and supplement theirincome by skinning dead cows. On July 11, a“cow protection group” attacked a group ofDalits who were skinning a dead cow in MotaSamadhiyala. Four of them were then brutallybeaten with steel pipes and iron rods, stripped,tied to a sport utility vehicle and paraded in themain market near the local police station inUna by members of local cow vigilante group,Gau Raksha Samiti. The flogging was filmedand posted on Facebook as warning to otherDalits were they to repeat such acts. The inci-

dent has since led to an eruption of protests andunrest across Gujarat, and even political tur-moil. What has added to the brutality is the so-called piety of the cow rakshak who is pretend-ing to be protecting the ideals of a fading socie-ty. It is not as if gau rakshaks do not understandthe Jajmani system or the political economy ofa society where the lower castes play a scaveng-ing role. In this case, the four Dalits were tak-ing away a dead cow to be skinned. This hasbeen a part of tradition and is a social function.What is worse is that these vigilante groupshave been further encouraged by the rhetoricof government spokespersons who periodical-ly announce elaborate plans for cow protec-tion. Stopping illicit cattle trade between Indiaand Bangladesh is understandable, but usingthis as a pretext to inflict atrocities on Dalits isnot. Such atrocities have been recurring withimpunity and Dalits are deeply frustrated.Some have even gone to the extent of endingtheir lives. In all this, one realises that vigi-lante-sponsored violence is not sporadic but in-volves organised networks. They even patrolhighways looking out for trucks ferrying cowsand then attack those in the vehicle, usingweapons to mete out instant justice. In turn, theCentre remains silent, almost tacit in what itconsiders an informal validation of govern-ment policy. It is not sacred cows that theregime is protecting. What it is tacitly desacral-ising is the Constitution. The so-called rights ofa cow are getting precedence over the rights ofDalits. The very sacred idea of a cow which

This is equally true forterrorism and terrorist attacks all over theworld, including India, Turkey, the US,France, Bangladesh, Afghanistan, Pakistanand even for the recent terrorist attack in Nice,France, where a terrorist, Mohamed LahouaiejBouhlel, drove his lorry through crowds of peo-ple who were celebrating national day. TheIslamic State (IS) claimed responsibility forthe attack. An IS-run media outlet said that theman who drove his truck into a crowd in theFrench coastal city of Nice was a "soldier" ofthe group. Aamaq news agency cited a securitysource saying that the attacker "carried out theoperation in response to calls to target the citi-zens of coalition countries, fighting the IS."The trucker was a French-Tunisian citizen.According to the Soufan Group which closelytracks jihadi organisations, Tunisia accountsfor the highest number of foreign fighters —6,000 — in Iraq and Syria. About another 6,000fighters have gone to war-torn countries fromEurope. In Belgium, on March 22, twin bomb-ings at Brussels airport and a subway stationkilled 30 people and injured at least 230. This,apart from a dozen of attacks in the US and theUK where a number of citizens have been

killed by terrorists. India has since long beentalking about Pakistan's role in terrorism.However, the Western nations simplyshrugged their shoulders and left it at that.Now, they are realising the danger of keepingtheir doors open in the name of liberalism tothe terrorists and many countries have beensponsoring them. As far as our country is con-cerned, it will be suffice to say that trouble inJammu & Kashmir is inspired by our neigh-bour, Pakistan. It does not realise that it is do-ing great disservice to the Muslims by killingtheir own people.I am saying this based on per-sonal knowledge. After the killing of IndiraGandhi, more than 3,000 Sikhs were massacredin Delhi and other places. While many hadnothing to do with the crime, they were killedand looked upon as terrorists. A Sikh friend ofmine, who was holding a top position in theGovernment of India, went to see one of his rel-ative who was a Hindu. His daughters, whowere less than 10-year-old, innocently askedhim whether he had come to kill them. And myfriend was shocked. Despite his being overcourteous, none of them came near him.

It is a sad truth that for the actions of a fewmisguided people, the entire community suf-fers, as the Sikhs did. It is now for the Muslimcommunity's political and religious leaders toguide and make it sure that no wrong impres-

sion goes in the minds of others aboutKashmiris and other Indian Muslims.

To foment trouble, Pakistan has declared amilitant, who was recently killed in an en-counter, as a martyr. He is really a murderer,and not a martyr, if his contribution to killingsof Indians, which includes Kashmiri Muslims,as well as the Indian Army and the paramili-tary and the police, (mostly Muslims) is takento account. Most terrorists forget the fact thatthose who live by gun, die by gun. It does nothappen only in case for terrorists, but also inmurder cases. Some circumstances will exposeit, just as it happened in the case of a motherkilling her grown-up daughter in Mumbai. Thekilled terrorist may be ac martyr in the eyes ofPakistan, but for a common man, both in Indiaand Pakistan, he was nothing more than a mili-tant. Such people bring an evil name to thecommunity as that of the terrorists. At thesame time, Sikhs have been extremely liberal.Just to remind that the foundation of the HolyGolden Temple, in Amritsar, was laid by aMuslim holy man, Mian Mir. Terrorism inPunjab in the 1980's was controlled by the Sikhpolice and the paramilitary forces. A reportsays that Pakistan was humiliated on theworld stage after it attempted to crank up inter-national pressure on India on the Kashmir is-sue. A range of lawmakers, analysts, and diplo-

mats called Pakistan a terrorist entity, andsaid that it should be denied foreign aid, andproposed that its leaders, including its mili-tary generals, be sanctioned and stopped fromtraveling to the US for consistently cheatingthe world community on terrorism. A congres-sional hearing in Washington and the UnitedNations General Assembly were the forums forPakistan's public shaming after its representa-tives tried to rake up the Kashmir situation inthe wake of the violence in the Indian State. Itwas a well-planned strategy by Pakistan and itssupporters in Kashmir to throw out the non-Muslims from the valley in the 1990's. Insteadof Jammu & Kashmir and the UnionGovernment stopping the out flux, fromKashmir of non-Muslims, the thenGovernment of India and the Jammu &Kashmir Government turned Nelson's eyes. Inthe name of mollifying the situation, even legalaction, which should have been taken, was ig-nored. The result is the present situation inKashmir. It is another name if appeasementthat the then Government is willing to talk toanybody. Despite a number of visits by the thenPrime Minister, nobody came to discuss theKashmir situation. All thanks to the incite-ment of Pakistan. It is not that every IndianMuslim is a fanatic. I had the privilege of work-

I found them to not only be loyal towards theircountry, but they were more than keen to deal with the anti-Indian elements and I happily trusted my life in their hands andwould do so now. In a society where only a bankrupt household would mort-gage its gold, it was a brave decision that was also high risk. Theshipment process had a script that could match a thriller. It waskept secret. And it bought us most valuable time. The electionprocess, prolonged by the assassination of Rajiv Gandhi, wascompleted in June 1991. The situation was dire. P.V. NarasimhaRao was Prime Minister designate but had not yet been sworn in.Late at night on June 20, 1991, Cabinet Secretary NareshChandra, Finance Secretary S.P. Shukla and I met him at 12,Willingdon Crescent. For the meeting, I had prepared a note onthe crisis in the economy with a handwritten annexure on a strat-egy outlining measures that needed to be announced before theBudget, plus what needed to be done in the Budget, setting out al-ternatives and their implications. He read the note and spentsome time with us in discussion. The resolve to do whatever wasessential came through clearly. Making tough decisions Theseevents do highlight the resilience of the political process despiteall its flaws and warts. Two short-lived governments that inherit-ed an economic crisis made tough decisions instead of postpon-ing the day of reckoning. The governmental system and its insti-tutions did everything to avert default even when there was noelected government that could make policy decisions. A minoritygovernment that had not yet won a vote of confidence inParliament acted promptly and decisively. Cynics might think itwas the crisis that focussed minds. But there was more. In theeventful month that followed, between June 24 and July 24, 1991,critical decisions were made: sharp depreciation in the exchangerate of the rupee, using gold held as reserve assets by the Reserve

Bank of India (RBI) to borrow, announcing dramatic changes ineconomic policies, presenting a Budget that delivered the much-needed fiscal adjustment, inter-alia by slashing subsidies andraising prices of petroleum products. The decision to negotiate aStand-By Arrangement with the IMF and a StructuralAdjustment Loan from the World Bank was also made aroundthen. I led these negotiations, which were concluded in lateSeptember 1991. In my view, any government that came to powerin mid-1991 would have done almost the same. The blueprints ex-isted. There was little choice. Even so, the outcome was possibleonly because we had an elected government after months of polit-ical instability, and a Prime Minister, Narasimha Rao, who wasmost decisive in this crisis situation and quietly persuasive in po-litical management. There were dissenting voices, rather thanconsensus, both in the Congress Party and in the Opposition. Butthere was recognition of the deep crisis in the economy amongpoliticians across parties. And no one was willing to bring downthe minority government to force yet another election on people.Effective governments . At this juncture, 25 years later, it must bestressed that reforms are means, not ends. The essential objectiveis the well-being of our people. In this quest, markets and govern-ments are complements, not substitutes. There are many thingsthat only markets can and should do. However, there are somethings that only governments can and must do. If governmentsperform these tasks badly, it is not possible to dispense with gov-ernments and replace them with markets. Governments must bemade to perform better. Indeed, efficient markets need effectivegovernments.

Grant of autonomy Unwillingness to go for strategic sale wouldbe a tactical blunder. True, good governance and government’scommitment not to interfere in working of management willhelp improve performance of PSUs. But, problem of resourcesand access to technology would still remain. This void can onlybe filled by inducting a strategic partner. Modi also needs to pon-der that grant of autonomy will sustain only as along as he re-mains at the helm. It cannot be guaranteed eternally. On the oth-er hand, if the present government pursues strategic disinvest-ment seriously (relinquishment of majority control would bestill better), giving proportionate weightage to the strategic part-

ner (read a private company including MNC) in taking deci-sions, then even with someone else at the helm, the undertakingwill remain impervious to political interference. Likewise, pres-ent will be a good time to take prompt decisions in regard to thesale of assets of PSUs which have been making losses for decadesand it makes absolutely no sense to keep them on the ventilatorpouring more and more good money yet, without any certaintythat they will come in to black. The government should seize thecurrent feel good factor (courtesy, its pro-reform image) andpromptly act on the recommendations of Niti Aayog for strategicdivestment in PSUs to unlock value and selling assets of thosewhich are beyond redemption.

It appears that the Modi government is oper-ating on split levels, with one entity suggesting modern proposalsfor policy, while the other wants all of this to be anchored to a fun-damentalism. It is this which makes the violence so overt. Oddly,the function of policing is being handed over to these groups andthe regime sees them as arms that are helping to consolidate theideology of the government. A structure of violence Let me lookat another incident which happened last year where a 50-year-oldman, Mohammad Akhlaq, was beaten to death and his 22-year-oldson severely injured in Dadri in Uttar Pradesh, allegedly by resi-dents of Bisara village, after rumours spread in the area about thefamily storing and consuming beef. In fact, if one looks at thelynching of Akhlaq and the attack on the four Dalit men for skin-ning a cow, one sees similarities. There is a third incident I willlook at. This time it is on a video that emerged in late June thisyear which showed volunteers of the Gau Raksha Dal forcing two“beef smugglers” to eat cow dung and drink cow urine. Accordingto reports, their leader admitted that his group had forced the twoMuslim men to eat cow dung on June 10. The man claimed thatvolunteers, acting on a tip-off, intercepted a vehicle transporting“700 kg of beef from Mewat to Delhi” on the Kundli-Manesar-Palwal Expressway. He said the group chased the car for a fewkilometres before stopping it near the Badarpur border. “Whenwe caught them, they had 700 kg of beef in their car. We made

them eat panchgavya, a concoction of cow dung, cow urine, milk,curd and ghee, in order to teach them a lesson and also to purifythem,” the man said. Thus there seems to be adequate evidence ofa new fundamentalist rule of law. The sad part is that the politicalOpposition, especially the Congress party, is reading all this assporadic events rather than as an emerging structure of violencethat does need to be confronted.

We must understand that there is a style to the violence andits staging. In one way it is plain bully boy brutality, where brutemajoritarianism seeks to make a point to some minority group,be it Dalit, Muslim or tribal and that “they must be taught a les-son”. Vigilante and policeman literally mirror each other even asthe government appears to be instructing the victims to be re-strained! The unending sequence of probes being demandedmatches the widening cycle of violence. It is almost as if it takesonly one sacred cow to kill another —in this case, democracy. Inall this, middle class India watches silently as it is overcome by“atrocity fatigue” and wants to get back to “aspiration and desiremode”. In the end, the Muslim and the Dalit are violated twice.Riots first displace the Muslim, and vigilante groups then forbidhim from pursuing his occupation. In the case of the Dalit, he hasto face never-ending atrocities. Thus in the roster of democracy,both Muslim and Dalit are less than equal. What needs to be ex-posed is the sanitised hypocrisy behind these acts of brutality.The cow rakshak syndrome needs to be analysed and exposed as athreat to Indian democracy.

Ratna-Ranjika and Ratna-Uday were three huge libraries. Thenine storied Ratna-Sagar central library was the largest of itskind in the world, had some of the finest manuscripts in theworld and the collection of books was so huge that the maraud-ers, when they attacked the place, had to spend a whole sixmonths before they could burn down the whole place. The cam-pus was a marvel of architecture, and reflected the amalgama-tion of two different architectural schools ie the Gupta and thePal. In its town planning too, Nalanda was marvellous. When oth-er contemporary civilizations were struggling to becomecivilised human beings, Nalanda offered wisdom and lifestyle ofthe highest order. The gradual decline of Nalanda began with theaugmenting influence of Buddhist tantra, and the final nail in thecoffin was struck by Bakhtiyar Khilji, one of the generals of Qutb-ud-din Aibak, in the year of 1193. The Mughals destroyedNalanda and Vikramsila Mahaviharas in one go, they beheadedand burnt alive most of the students and teachers, vandalised en-tire campus beyond wildest imagination, set the library buildingwith invaluable manuscripts on fire — the ugly dance of destruc-

tion continued for days together. A glorious intellectual history of 700 years was destroyed in

the most despicable and brutal manner. Nalanda was re-discov-ered in the early 19th century. After the area was deserted, it be-came a dense jungle. A new village with the name Bargaon cameup on the same location later. When British geographerBuchanan Hamilton wrote a study on several Hindu andBuddhist images scattered around the village, Sir Cunninghamconducted a scientific excavation in 1861. With the study of alarge number of inscriptions, coins, copper plates, idols etc re-covered from the site, the amazing splendour of Nalanda came tothe fore. There were several subsequent rounds of excavations —in 1872, then from 1915 to 1936, and even between 1974 and 1982,which revealed artifacts like images, murals, plaques, theMahavihara seal and the finest terracotta. Most of these are pre-served in museums in Patna, Nalanda and Kolkata. Today,Nalanda is a UNESCO World Heritage site, and hopefully this tagwill bring tourists from around the world to this ancient institu-tion and compel the authorities to protect and preserve this im-portant piece of our civilisational history.

NEW DELHI, July 25 :

In an ‘unprecedented’move, the NDA governmenthas sacked as many as 111lawyers appointed during theUPA regime to represent theCentre in indirect tax cases be-fore various judicial bodies.Ina June 18 order, the CentralBoard of Excise and Customs(CBEC) cancelled their ap-pointment as its standingcounsel, overturning its ownJune 9 order, where these ad-vocates were included in anappointments list of 251 sen-ior/junior standing counselfor the Board. As per the origi-nal order, the tenure of these251 standing counsel, includ-ing the 111, was to expire onlyon June 8, 2019.The Board,however, did not assign anyreason for the removal of the111 lawyers.The position ofstanding counsel of the CBECis considered prestigious in le-gal circles as they are appoint-ed by the President of India, af-ter the CBEC — including itsChief Commissioner ofCustom/Central Excise — ex-amines their “expertise inhandling indirect tax mat-ters.”A detailed questionnairesent to CBEC Chairman NajibShah on July 20 elicited no re-

sponse till the time of going topress.The June 18 order stat-ed: “…it is informed that theorder of the 111 counsel [as perlist enclosed] who were on thepanel as on 14.10.2014 is herebyrescinded.”In its June 9 order,the CBEC had said, the ap-pointments were made withthe concurrence of theMinistry of Law and Justice.Sources privy to the develop-ment told The Hindu that the111 counsel were reappointedafter the Chief Commissioner(of Customs) found their per-formance to be satisfactory —following which the Board haditself approved the renewal oftheir appointment. The 111

were among the standingcounsel appointed on October15, 2011 for a three year-termending on October 14,2014.Fresh panelOn June 24,the CBEC — in a letter to allthe Chief Commissioners ofCentralExcise/Customs/Service Taxand the Director General ofthe Directorate of RevenueIntelligence (DG, DRI) — saidit has been decided to consti-tute a fresh panel of senior/ju-nior standing counsel againstthe existing 111 slots.Elaborating on the criteria forselection, it said theCommittee (of ChiefCommissioners) should “in-

Bollywood actor SalmanKhan was today acquitted bythe Rajasthan High Court intwo cases related to poaching ofChinkaras in Jodhpur in 1998.The court held that the pelletsrecovered from the Chinkaraswere not fired from Khan's li-censed gun.The driver of thejeep that was used by Khan andhis co- stars on their allegedhunting mission has been miss-ing, weakening the prosecu-tion's case against the moviestar.Khan, 50, was jailed in 2007for nearly a week for shootingan endangered gazelle in1998.Appeals of Khan againstsentence in the two cases relat-ing to poaching of Chinkaras inBhawad and Mathania was al-lowed by the high court whichacquitted him in both the cases.

He also argued that bothof these cases have been built oncircumstantial evidences andthere was no eye-witness or anymaterial evidence againstKhan.Besides this, the majorobservation by the court wasthat it did not find the pellets re-covered from the vehicle match-ing with those, recovered fromthe possession of Khan.Defencealso strongly argued that thesepellets had been planted sincethey were not found in the vehi-cle during forest department’sinspection and were foundthere surprisingly by the policelater.Similarly, the defence alsoargued that Khan was not inpossession of weapons allegedlyused in poaching and werebrought to Jodhpur fromMumbai only on demand of theforest department.

"Due to non-availabilityof a specialist gynaecologistin Mandi, the victim hasbeen sent to Civil Hospital,Bilaspur, for a detailed med-ical examination. Primarytests suggest that the womanwas sexually assaulted,"Chand said.

The victim had in a po-lice complaint alleged the ac-cused offered her lift in theircar while she was waiting fora cab to get to Lahaul to re-unite with friends who hadalready left for the nearbytown.

TAMEIR is aRs. 80,000 crore Prime Minister’srelief package for the state to as-sist the state in rebuilding infra-structure in the state which gotdevastated in the floods of 2014.To be completed by March 2017,TAMIER plan covers projectsworth Rs.200 crore to be complet-ed by March 2017 and includesup gradation of industrial es-tates in Anantnag, Anchidoora,Bijbehara, Pulwama, Poonch,Udhampur, Kathua among oth-

Branding the separatists "stooges of Pakistan," BJP todaysaid there was no need to hold talks with the Hurriyat leader-ship which has been working hard to keep the "Kashmir potboiling." "No talks should be held with the separatist leaderslike Syed Ali Shah Geelani, Mirwaiz Umar Farooq and YasinMalik who are not only responsible for the present situation inKashmir Valley but are acting as stooges of Pakistan to keepKashmir pot boiling," BJP state spokesman Virender Guptasaid. He said separatists were working for the benefit ofPakistan and against the interests and integrity of India.

There are a snumber of cases against them for committingmurder of army, security personnel and pro-India elementsand were instrumental in migration of Kashmiri Pandits andother minority communities. Gupta said these leaders havewaged a war against India at the behest of Pakistan and favourKashmir becoming a part of Pakistan. He said there was a needto vigorously pursue the pending cases against the separatistsas "this is essential to restore normalcy and peace in theValley." "The stakeholders for whom the talks can be held forresolving the issues of Jammu and Kashmir are the people ofJammu region, Kashmir valley, Ladakh region, KashmiriPandits, displaced persons of PoK and people of various reli-gious and ethnic groups," he said. He said people of Jammu andLadakh regions have suffered discrimination and politicalneglect since Jammu and Kashmir acceded to India and thedisplaced people of PoK need more attention in any negotia-tion to be held. "Granting of greater autonomy would harm thenational interest and aspirations of the people of Jammu andLadakh regions as it shall further empower the Valley eliteand subject the people of these regions to more neglect," Guptasaid. He said Kashmir was not entire Jammu and Kashmir, itis merely 15 per cent area of the state which is under Indian ju-risdiction and constitutes about 45 percent of the state's popu-lation. There is more than 60 per cent silent majority in theValley which has nothing to do with the present turmoil andwants to remain part of Indian democracy.

leges are available for admissionas the State Government and theAICTE have worked out a fool-proof mechanism to ensure ad-mission of the students only inthe best colleges of the countryunder PMSSS. The Ministersaid role of the touts, who earliermisused the scheme and fleecedthe students, has been complete-ly done away with and the stu-dents will only get admission torecognized colleges through agenuine selection process.

The National GreenTribunal (NGT) has directedJammu and KashmirGovernment and state pollu-tion control board to file acomprehensive report beforeit about the hospitals whichwere not complying with bio-medical waste rules and theaction proposed to be takenagainst them. A bench head-ed by NGT ChairpersonJustice Swatanter Kumarsaid that report filed by thestate pollution control boardin relation to the collection,transportation and disposalof the bio-medical waste bydifferent hospitals was not inaccordance with law and itsaffidavit was inadequate.

"Normally, we wouldhave directed coercive stepsagainst the erring authori-ties," the bench said andgranted a final opportunity tothe government and Jammuand Kashmir pollution con-trol board to comply with thedirections without any delay."A complete and comprehen-sive report shall be filed, stat-ing the actions taken againstthe hospitals in the entirestate which are operatingwithout obtaining consent ofthe board. It should also bestated as to how many hospi-tals including the big hospi-tals catering to large numberof patients of Jammu andKashmir are not complying

with the bio- medical wasterules and what action is takenor proposed to be takenagainst them," the tribunalsaid. "The report shall alsodeal with the status of bio-medical waste dumping sitesand whether they are ade-quately prepared for thedumping of the bio-medicalwaste," it said. The tribunalobserved that authoritieshave not "acted properly" indealing with the issue ofwaste to energy plant."Srinagar alone generates 400metric tonnes of waste everyday indicating as to what fa-cilities are required beforethe entire city is converted in-to a dumping ground," it said.The counsel appearing for thestate told the tribunal thateven after extending the timefor submission of tender, theyhave not received any tenderfor waste to energy plant.

During the hearing, thestate pollution control boardfiled its affidavit in which itstated that a joint inspectionteam comprising of officialsand a representative ofCentral Pollution ControlBoard had inspected differ-ent sites. The bench has post-ed the matter for hearing onAugust 11. The tribunal hadearlier directed concernedauthorities to conduct a jointinspection regarding hospi-tals and disposal of bio-med-ical waste in the entire city ofSrinagar and Jammu.

State High Court holds that any water source/talab/pondexisted in the State as on 10.11.2010 would be deemed to be theproperty of the Government and not before that. This signifi-cant judgment has been passed by Justice Tashi Rabstan in apetition filed by one Ajay Singh seeking quashment of orderdated 06.08.2014 passed by the 2nd Additional District Judge,Jammu, whereby the status-quo order dated 03.07.2014 passedby the Chief Judicial Magistrate, Jammu, with respect to theconstruction being raised upon a Talab approximately 13kanals 12 marlas comprised in Khasra No.178(Old) 320(new),Khata No.115/120 and khewat No.1, situate at Thanger, ChanniBye Pass, Jammu, has been vacated. Justice Tashi Rabstan ob-served that the next contention of petitioner is that in terms ofWater Resources Act, any proprietary and ownership rights ofany person in any water source, talab/pond in the State shall bedeemed to have been terminated with the commencement ofthe Act and vested with the Government and quote Section 3(1)of Jammu and Kashmir Water Resources (Regulation andManagement) Act, 2010 in which it has been submitted thatEvery water source in the State is, and ammu and KashmirWater Resources (Regulation and Management) Act, 2010 cameto be enacted on 23.10.2010 and it came into force on 10.11.2010vide SRO 415 when the Government notified the same in theGovernment Gazette; meaning thereby, Section 3(1) of the Actwould apply only with effect from 10.11.2010. Therefore, as perthe Act, any water source/ talab/pond existed in the State as on10.11.2010 would be deemed to be the property of theGovernment and not before that.ownership, or any riparian orusage right, on such water resources vested in any individual,group of individuals or any other body, corporation, companysociety or community shall, from the date of commencement ofthe Act, be deemed to have been terminated and vested with theGovernment.” The Act provides that any proprietary or owner-ship rights of any person in any water source in the State shallbe deemed to have been terminated and vested with theGovernment with the commencement of the Act. Jammu being a resident ofPakistan was not entitled tobe the Permanent Resident ofthe state but he in connivancewith the revenue officials pro-cured a reserved category cer-tificate in-terms of SRO-294by forging the records and thedocuments, vide File No.946/SC/BCE dated 04-09-2010.It was also alleged that hisname was shown in the voterlist of 1984 as Ashok KumarS/o Sant Ram whereas, in thecaste certificate it was shownas Ashok Kumar S/o AnantRam. It was further allegedthat Ram Lal S/o Late. AnantRam, Kamal Kishore S/o RamLal and Brij Mohan S/o Ram

Lal also applied for the is-suance of SC category certifi-cate by projecting and refer-ring said Ashok Kumar to bethe real brother of Ram Laland uncle of Brij Mohan andKamal Kishore whereas, saidAshok Kumar was neitherthe real brother nor the uncleof the accused persons.However, all the accused per-sons obtained the categorycertificates in their favour onthe basis of fake and forgeddocuments in connivancewith the revenue officials etc.

The ac-cused in furtherance of acriminal conspiracy obtainedthe PRC and other relateddocuments viz. Ration Card,Voter list etc. pertaining toPishori Lal and used the samefraudulently and procuredthe PRC in their favour inconnivance with the revenueofficials. It was further re-vealed that Ashok Kumar was

son of Sant Ram who migrat-ed from Pakistan and startedliving in Batala, Punjab andthereafter, in the year 1979-80he came to Jammu and mar-ried one Smt. Sudesh Kumariand started living with his in-laws and that all the docu-ments viz voter card, rationcard etc. used for procuringthe PRC belonged to the realfore-fathers of Smt. SudeshKumari. Similarly, SC catego-ry certificates were also pro-cured by the accused personson the basis of fake docu-ments as the accused fraudu-lently prepared fake and ma-nipulated records in conven-ience with the revenue offi-

cials in order to secure unduebenefits for themselves andtheir family members.
