National Security Advisor Ajit Doval and Chinese Foreign Minister Wang Yi held the 21st round of border talks in China's southwestern Sichuan province on Saturday, offi- cials said. Besides the border dispute, the two senior officials at the picturesque Dujiangyan city, would also review the progress made in bilateral ties since the Wuhan Summit between Prime Minister Narendra Modi and President Xi Jinping in April, officials said. Doval and Wang are the designat- ed special representatives for border talks between India and China. The talks were expected to be concluded later Saturday. This is the first round of talks for Wang after he succeeded State Councillor Yang Jiechi earlier this year. Wang has become the state coun- cillor, a rank higher than the foreign minister in the Chinese government's hierarchy. Announcing the talks on November 21, Chinese Foreign Ministry spokesman Geng Shuang presented an upbeat picture of the bi- lateral ties saying, "We have properly managed the differences through dia- logue and consultation. The border areas on the whole maintained stability". Officials maintain that this round of talks may focus more on reviewing the progress on trade and mainte- nance of peace at borders than move- ment towards a solution to the border dispute as India is headed for general elections next year. Since the first-ever "informal sum- mit" between Prime Minister Modi and President Xi in Wuhan, the two countries have launched a dialogue between trade officials to enhance India's exports to China to address the over USD 51-billion trade deficit. Since then, progress has been made towards increasing India's ex- port of rice, sugar and pharmaceuti- cals. This is expected to come under review at the talks, officials said. Negotiations between the special representatives are regarded highly significant by both the countries as they cover all aspects of bilateral ties besides making efforts to resolve the vexed border dispute. The India-China border dispute covers 3,488-km-long Line of Actual Control. China claims Arunachal Pradesh as part of southern Tibet. The last round, held in New Delhi between Doval and Yang, took place in the backdrop of the 73-day standoff be- tween the two militaries at Doklam over Chinese army's plan to build a road close to India's strategic "Chicken's Neck" corridor connecting the north-eastern states. The standoff ended after the People's Liberation Army halted the plans to build the road. Officials on both sides say a lot of spadework has been done to ensure peace and tranquillity at the border, though the solution to the border dis- pute is still elusive even after 20 rounds of talks. Senior defence officials of India and China held the 9th India-China Annual Defence and Security Dialogue in Beijing on November 13 after a one-year gap due to the Doklam standoff. During the meeting, both sides agreed to enhance defence ex- changes and interactions. Security agencies went into a tizzy in Punjab's border district of Pathankot after a farmer reported suspicious movement of six men, with police launching a massive search operation. The agencies were already on alert after four people travelling from Jammu in a hired car snatched the vehicle from its driv- er at gun point on November 13 in the district's Madhopur area. The Punjab Police Saturday ruled out a terror angle in the snatching case after the vehicle's driver identified one of the suspects who, officials said, was a local criminal. Police were maintaining a vigil as in 2016, terrorists, who had launched at- tacks on the Pathankot air base, had snatched a Punjab Police offi- cer's car to get to the military facili- ty. On receiving information from the farmer, police have shared in- puts with all agencies concerned to trace the six men. Balbir Singh, a farmer in Pathankot district's Shadipur village, claimed that he had seen six suspicious men on Friday evening when he was work- ing in his fields. A total of 04 stu-dents are attending these classes.The coaching classes are being con-ducted to improve the theoretical andanalytical skills of the students. Thestudents are being coached in all sub-jects including the techniques of at-tempting the questions for the exam.The Army will also be assisting theaspirants for registration for the ex-amination. Army in the past fewmonths has conducted a series ofskill development classes which haveresulted in enhancing the skill basedemployment generation for theyouth.

The District ElectionAuthorities Bandipora onSaturday organized a spe-cial training session forpolling staff of Bandiporadistrict for the upcomingphases of Panchayat elec-tions.

The training sessionwas chaired by NodalOfficer Election ControlRoom Bandipora GM Loneand Nodal OfficerTraining Management,Mohammad Rafiq Parraywhile District level MasterTrainers MohammadRamzan Bhat andMohammad Iqbal Samoonimparted training to thepolling staff.

The polling staff in-cluding Presiding Officers(POs), P1, P2, P3 and otherconcerned staff of DistrictBandipora were informedabout the process ofpolling including collec-tion of polling material,different steps to be fol-lowed during polling to en-sure secrecy, powers andduties of the presiding offi-cers, handling of ballotboxes and allied papers,counting of votes and otherprocesses and proceduresto be adopted for thesmooth conduct ofPanchayat elections.

On the occasion, NodalOfficer, Election ControlRoom Bandipora, GMLone informed that it is es-sential for every PresidingOfficer and other staff tounderstand their role andresponsibilities properlyso that they shall performtheir duties in a profes-sional manner for success-ful elections in the district.

He urged them to be inconstant touch with thecontrol room so that theycan get proper guidance in

case of any assistance withregard to the polling to en-sure smooth conduct of theelections. He also urgedthem to keep control roominformed about hourly vot-ing updates.

Lone said all requisitearrangements have beenput in place for smoothconduct of the polling andthat proper arrangementshave been made to ferrythe polling staff upto thepolling booths beside thearrangements for theirstay in respective pollingbooths. He said adequatearrangements have beenmade with regard to the ac-commodation, heatingarrangement and food forthe polling staff and urgedthe staff to contact the con-trol room in case they haveany grievance with regardto the arrangements.

During the trainingprogram, trainers advisedthe polling staff to gothrough the Election hand-book for acquiring properknowledge about the pollprocess. All facilities andproper support from thedistrict administrationwill be provided to the

polling staff, they added.The trainers also sensi-

tised the participantsabout NominationProcess, Scrutiny ofNomination Forms,Withdrawal ofCandidature and proce-dure for submission of var-ious forms by the candi-date including affidavitand other documents, col-lection of stationary fromElection cell, placement ofballot box, handling of vot-er slips, voting procedure,secrecy, security and thesteps to be followed duringcounting besides variousDo’s and Dont’s to be keptin mind during countingas well as polling.

A detailed presenta-tion was given by the train-ers regarding scrutiny, fill-ing up of nominations, re-jection of nominations,qualification of nomina-tions and completion ofpolling process until theconclusion of the declara-tion of the results.Trainers called upon theconcerned officers to stayprepared well before thepolls.

DDC Rajouri reviewsstatus of languishingprojectsRAJOURI, NOVEMBER 24:

District Development Commissioner Rajouri,Mohammad Aijaz Asad, today chaired a meeting to re-view the status of various languishing projects in thedistrict.Threadbare discussion was held on variousdevelopment works during the meeting attended byofficers and engineers of R&B, PHE, PDD, Tourism,Irrigation & Flood Control, and RDD.

Taking note of languishing projects under PWD, itwas informed that a total of 16 bridges and 61 roads fordistrict Rajouri have been approved in the languish-ing projects. The amount released for bridges is Rs27.62 crore and Rs 97.97 core for the roads. While tak-ing stock of PHE sector, it was said that a total of 32schemes stand approved in the languishing projectsand the total amount released for the approvedschemes is Rs 30.93 crore. Similarly, on the I&FCfront, it was informed that 13 schemes stand approvedin the languishing projects. The amount released forthe schemes is Rs 9.36 core.

The DDC took scheme wise review of projects un-dertaken by different departments and funded underthe languishing projects. It was informed in the meet-ing that the work on all the approved bridges has beenstarted and the other projects are in different phasesof executions. A detailed discussion was held on vari-ous issues related to the effective implementation ofcore development schemes in the district. The DDC di-rected the concerned officers to gear up their men andmachinery for effective and timely completion of de-velopmental projects.

DDC instructed the officers to expedite the pace ofworks and complete the ongoing projects within thestipulated time period. He emphasized upon the offi-cers to ensure quality and timely completion of allprojects. He also directed officers to ensure field visitto check the quality of works and remove bottlenecks,if any. Earlier, DDC had sought feedback from vari-ous departments regarding the physical and financialstatus of developmental works in the district. He di-rected the concerned officers to take effective stepscompletion of the projects on a mission mode for opti-mum results on the ground.

The DDC also asked the officers to submit physi-cal and financial progress of ongoing developmentworks on a weekly basis so that delays in completionof projects do not occur.

JAMMU, NOVEMBER 24:

The State Taxes Department(STD) has sought details of paymentsmade by various government depart-ments to the contractors since thepromulgation of GST Act in the Stateto ensure compliance of the filing ofmonthly GSTR-3B returns.

“State Taxes Department hassought information regarding pay-ments made to the contractors for ex-ecuting work contracts by variousDDOs of government departmentsfrom 8.07.2017, the date from whichthe Goods and Services Tax Act waspromulgated in the State,” saidMohammad Shahid Saleem,Additional Commissioner, StateTaxes (Administration &Enforcement), Jammu.

He said the action has been initi-ated after it came to surface duringdata analysis of the payments madeby the government departments tothe contractors against variousworks that the return filing underthe GST was not up to the mark. Hesaid all the contractors who have re-ceived payments from the govern-ment departments had to mandatori-

ly file monthly GSTR-3B returns un-der the GST regime.

“Due to default on part of the con-tractors huge amount of tax due tothe State has been held back causinghuge loss to the state exchequer,” hesaid and added that letters have beensent to all the DeputyCommissioners, Heads ofDepartments and Chief Engineers toprovide details of the payments madeto the contractors on work contractssince 8 July 2017 so that action is ini-tiated under Section-76 of the J&KState Goods & Services Tax Act-2017against defaulting contractors whohave not filed GSTR-3B returns.

Meanwhile, continuing with itsdrive against GSTR-3B non-filers, theState Taxes Department has intensi-fied its drive in various districts.Acting on strict directions of thePrincipal Secretary Finance, NavinK Choudhary, a team of the officers ofthe State Taxes Department compris-ing State Taxes Officer, AbdulRehman, Inspectors MohammadYusuf and Pervaiz Wani under over-all supervision of MohammadShahid Saleem, AdditionalCommissioner, State Taxes

The Registering Officer Antiquities Ladakh Regionhas informed the general public that the Department ofArchives, Archaeology and Museum is planning to set upa regional museum in Kargil. It has further been stated inthe notice that LAHDC Kargil has allotted 3 kanals ofprime land in Kargil town for this purpose, and theDepartment is approaching the Ministry of Culture forfunds to start the construction work of the proposed muse-um. As a precondition for such grants from the Ministry ofCulture, the department needs to have artefacts relevantto the theme of the museum. Accordingly humble requesthas been made to the people having interest in culture andheritage to come forward and donate artefacts related topastoral and agricultural lifestyle of Ladakh and adjoin-ing regions like jewellery, traditional household items ofthe past, traditional, agricultural and household imple-ments and items depicting age old trade relations of Kargilwith adjoining areas and Central Asian countries,Eastern China and Tibet, particularly areas falling on thefamed Silk Route. All these items can be deposited in theoffice of LAHDC Kargil and Registering Officer ArchivesLeh against proper receipt. A court in Kerala on Saturday denied bail to BJP stategeneral secretary K Surendran in a case of alleged involve-ment in violent protests at Sabarimala earlier this month.

Surendran was arrested earlier this week fromNilackal, the base camp of Sabarimala, after he refused togo back despite a request from the police.He was producedbefore a local court at Ranni in Pathanamthitta and re-manded in judicial custody for 14 days. Later he was grant-ed conditional bail. Subsequently, he was arrested in thecase relating to violence at Sanndihanam when a 52-year-old woman, who had come for the 'choorunu' (rice feedingceremony) of her grandchild, was blocked and allegedlyattacked. While denying him bail Saturday, the court,however, allowed Surendran to talk to his family mem-bers through phone in the presence of the jail superinten-dent. Police were also granted permission to question theBJP leader for one hour this evening.Sabarimala had wit-nessed violent protests from a section of devotees over thestate government's decision to implement the September28 order of the Supreme Court, allowing entry of women ofall age groups into the shrine. The court denied bail to theBJP leader, saying that the case was related to Section 308of the Indian Penal Code (attempt to commit culpablehomicide) and also has conspiracy charges. Governor’s justified decision

Assembly dissolution in Jammu and Kashmir hascome under criticism from certain quarters in-cluding political parties of the State and some na-

tional opposition parties terming the act as unconstitu-tional. The legal fraternity is divided over the validity ofthe abrupt decision of the Governor to dissolve theJammu and Kashmir Assembly. Governor SatyapalMalik had cited four main reasons for dissolving theAssembly with immediate effect, including extensivehorse-trading and possible exchange of money and the im-possibility of forming a stable government by parties withopposing political ideologies. Some constitutional and le-gal experts have supported the governor's decision short-ly after the PDP and arch rival National Conference(NC)along with the Congress staked claim to form the govern-ment which was followed by another bid from the two-member People's Conference which claimed the supportof the BJP and 18 legislators from other parties. They saidthe governor is well within his rights to do so as he felt astable government was untenable. Former Lok Sabha sec-retary general and constitutional expert P D T Acharyahas said it is for the first time that an assembly has beendissolved after the governor concluded it was impossibleto form a stable government by parties with opposing po-litical ideologies. Acharya said the conclusion of the gov-ernor that opposing political ideologies cannot put up astable government was not credible. Echoing Acharya'sview, senior lawyer Rajiv Dhavan said citing opposing po-litical ideologies as a reason for dissolution was incorrect.The parties are disparate. That makes no difference.Coalitions are bound together by all kinds of ideologies.But former LS secretary general Subhash C Kashyap saidthere is "nothing unconstitutional" in the governor's deci-sion. Senior advocate Ajit Sinha said the governor willhave to justify the grounds that parties with opposing ide-ologies cannot form a government but it is a valid consti-tutional ground because there is failure of constitutionalmachinery and rule of law and the governor acted wellwithin his powers. Governor is entitled to conclude thatsuch a government will not be stable ... there is no viola-tion of constitution and there is nothing unconstitutionalin his decision. The governor should have dissolved theassembly much earlier and called for elections. No partywas in a position to form government or to provide stablegovernment. The PDP and the National Conference werestrongly opposed to each other and they have changedtheir stances only when the defection started in their par-ty. In this scenario, the governor would be justified in con-cluding that there is no stability in the political situation.

Manhandling J&KAre Kashmiris unfit for democracy? The Governor’s refusal to allow

NC and PDP a shot at power will intensify anger against Delhi. Since In-dependence, Jammu & Kashmir has led a troubled and contentious exis-tence. Pakistan has never tired of making trouble here, starting with thefirst attempt in 1948 to forcibly detach the State from India. It hardlyneeds recalling that hardcore Islamic groups in the Valley are aided andabetted by Islamabad to keep the State simmering. These external provo-cations have been compounded by many internal errors of judgment orham-handed actions fomenting popular discontent. Democracy, the cor-nerstone of India’s political basis since 1952, has only fitfully survived ina State riddled by myriad complexities. For many decades after electionsbegan in the rest of India, voters of Jammu & Kashmir rarely got an op-portunity to exercise their franchise as candidates’ nomination paperswere routinely rejected to ensure hand-picked nominees of Delhi wereelected unopposed and presided over the State’s destiny. Also, Govern-ments in Srinagar were periodically toppled on Delhi’s orders and puppetpoliticians installed as Chief Ministers. Many rued the growing alien-ation of Kashmiris from the mainstream of Indian politics and societybut the Centre, citing national security reasons, firmly kept the lid on. Acombination of these factors along with the rise of Islamic radicalism inthe 1980s saw the eruption of terrorism in the State in a big way after1989. The Centre’s iron-fisted response to this led to the forced migrationof Kashmiri Pandits from the Valley. Rigged elections and frequent spellsof direct Central rule removed the remaining safety valves and the gulfof mistrust between Delhi and Srinagar continued to widen, spurred byoccasional excesses by security forces and frequent terrorist outrages.But instead of reaching out to the Kashmiri people including politiciansloyal to India, Delhi carried on playing a double game. Only once at theinitiative of then Prime Minister Atal Bihari Vajpayee was a sincere at-tempt made to address the festering sores in a spirit of insaniyat or hu-manity. But that too was short-lived and the State was pushed back intothe dark abyss from which it had tried furtively to emerge.

Actions like what we witnessed late last Wednesday night are typicalof the cavalier manner in which Jammu & Kashmir has been handled byDelhi. The appointment of a has-been politician with no experience ofKashmir affairs as the State’s Governor was bad enough, especially afterthe enforced demise of the BJP-PDP coalition. But the refusal to allow

The message to the world must beclear: Attempts to revive insurgencyand terrorism in Punjab will becrushed. At the time of writing,Bikramjit Singh alias Bikram, one ofthe two alleged perpetrators of thegrenade attack on a Nirankari con-gregation which left three dead and20 wounded in Amritsar onNovember 18, has been arrested. Theother, Avtar Singh, remains at large,with security personnel assiduouslylooking for him. Simultaneously, ef-forts are reportedly afoot to squelchany attempt to revive the violencethat terrorist groups, created,trained, armed and provisioned byPakistan’s Inter-ServicesIntelligence Directorate (ISI), had un-leashed to carve Punjab, and someadjoining territories, out of India andestablish thereon a sovereign Statecalled Khalistan (Land of the Pure).Those suspected of association withterrorist outfits are being ques-tioned. Guest houses have beensearched to ferret out suspicious newarrivals. Highway patrolling hasbeen intensified, as has been surveil-lance of key installations and publicplaces. All this is hardly surprising.The violence, that had raged for morethan a decade, had consumed asmany as 21,469 lives and plungedPunjab into a nightmare before beingcomprehensively defeated in 1993 bythe Punjab Police under the inspira-tional leadership of its director-gen-eral, KPS Gill. There have, however,been credible reports over severalyears that the ISI was trying to reviveKhalistani terrorism and link it with

Pakistan’s unconventional waragainst India in Jammu & Kashmir.Indeed, shortly after the Amritsaroutrage, Punjab Chief Minister,Captain Amarinder Singh had statedthat it marked an attempt by the ISIto disturb the peace in the State.

His statement gains credencefrom the fact that the Austria-madeArges Type 84 fragmentation handgrenade, used in the Amritsar attack,is widely used by the Pakistani army.Not just that, such a grenade was re-portedly to be used in an ISI-backedterror attack which was foiled withthe arrest on November 1, 2018, of oneShabnamdeep Singh alias MohinderLahoria. The grenade, reportedlyprovided by an ISI contact, was foundin Lahoria’s possession. The latter,who had been asked to target policeposts and public places, confessed tohave been receiving instructionsfrom his handlers in Pakistan. Aspointed by Kamal Davar in Tryst

with Perfidy: The Deep State ofPakistan, which provides a compre-hensive overview of the ISI’s activi-ties in India, the outfit “has beencrafting its strategy for fanning se-cessionism in Punjab since decadesand deviously tapping some political-ly disgruntled elements to forge theminto a potent force.” It stepped up itsactivities in the early 1980s when itbegan coordinating the Afghan jihadagainst the Soviet forces with fundsand weapons received from theUnited States and Saudi Arabia. InBin Laden: The Man Who DeclaredWar on America, Yossef Bodansky,then Director of the CongressionalTask Force on Terrorism andUnconventional Warfare in the US,wrote, “The ISI capitalised on therapidly expanding and lavishly fund-ed training and support system forthe Afghan Mujaheedin as cover forexpanded sponsorship of and supportfor other insurgent groups dedicated

to subversive activities in India.”Bodansky further stated, “The

main reason the ISI decided to keepthe CIA out of the [training] campswas the extent of training and sup-port non-Afghan ‘volunteers’ andothers were getting in these camps.Most numerous were the thousandsof Islamist trainees from IndianKashmir and to a lesser extent theSikhs from the Punjab.” He adds thatin “1985 and 1986, as the quantity andquality of the weapons improved,Sikh terrorism and subversion in thePunjab and throughout India showedincreased militarisation and radical-isation.” The ISI did not abandon itssinister efforts even after theKhalistan movement was crushed in1993. Its attempts, however, drew ablank for a long time as Punjab hadenough of murder, forcible mar-riages, rape and extortion by the ter-rorists and the collateral conse-quences of the campaign against ter-rorism, including the virtual col-lapse of normal life. Things havebeen changing in the past severalyears. What warrants particular con-cern is the fact that the latest inci-dents are part of a continuum of therenewed terrorist violence in andflow of arms to Punjab since 2015. Thearms seized include Chinese-madeAK-47 and modified MP9 rifles, 7.62mm pistols, .32 bore revolvers andhand grenades. Enormous quantitiesof ammunition have also been appre-hended. There are also indications ofan increase in support among people.The reasons include farmers’ discon-tent, perceived injustice to Sikhs anduneasiness over the rise of an as-

President Ram Nath Kovind’schoice of Vietnam as the firstSoutheast Asian country to visit inhis capacity as the President is notsurprising. A close ‘ally’ of India forover 70 years, and not limited to offi-cial diplomatic ties, Vietnam is criti-cal for India’s foreign policy at the re-gional and systemic levels. While Mr.Kovind’s visit highlights the ‘nor-mal’ trajectory of a presidential visit,there is a need to understand howVietnam has calibrated its domesticand foreign policy shifts and whereIndia’s relevance can fit into thesepolicy changes. Domestically, sincethe start of its Doi Moi policy its polit-ical and economic renewal campaignin 1986, Vietnam has made dramaticstrides. Today it is a rapidly growing,regional economic giant, showingboth dynamism and pragmatism inits calculations. While earlier it im-ported agricultural products, today itis a major exporter. Agriculturalcompetence has furthered Vietnam’sentry into the Comprehensive andProgressive Agreement for Trans-Pacific Partnership (CPTPP). TheVietnam National Assembly ratifiedthe CPTPP on November 12, assert-ing its growing economic impactglobally, with exports increasing toapproximately $240 billion for theyear 2018. Membership to the CPTPP,which accounts for nearly 14% of theglobal GDP, will boost Vietnam’s eco-

nomic growth, from 6.8 % in 2017-18,by a further 1.1% to 3.5% by 2030. Oneof the core areas of Mr. Kovind’s visitfocussed on furthering cooperationin agriculture and innovation-basedsectors, pushing the potential for in-creasing bilateral trade to $15 billionby 2020. Common ground of health

An area of potential convergencefor both Vietnam and India is healthcare. The 12th National Congress ofthe Communist Party of Vietnam, in2016, highlighted the importance oflinking economic growth to univer-sal health care, whereby 80% popula-tion would be covered by health in-surance. Internationally,Vietnam’s foreign policy is charac-terised by ‘multidirectionalism’,which addresses regional asymme-tries of the power balance by engag-ing across a broad spectrum of statesto achieve its interests. Increasingly,this asymmetrical power structure

in the region, offset by the rise ofChina, is bringing regional and ex-tra-regional states together to ad-dress the shifts in the normative or-der. Within this context, Vietnameven normalised relations with theU.S., its former opponent, credit forwhich is given to the late U.S.Senator, John McCain. Security con-cerns Today there is increasing com-monality of security concerns be-tween Vietnam and its ASEAN part-ners as well as with Australia, India,Japan and the U.S., particularly inthe areas of maritime security andadherence to the United NationsConvention on the Law of the Sea. dorsed the term Indo-Asia-Pacific.Similarly, Mr. Kovind’s speech in theVietnamese National Assembly re-ferred to a ‘rules based order in theIndo-Pacific’, reiterating India’s ownconcerns over troubled maritimespaces. Finding compatibility be-tween the ‘Indo-Asia-Pacific’ and theU.S. driven ‘Indo-Pacific’ necessi-tates a more nuanced approachwhereby regional concerns ofASEAN centrality can be assuagedwhile accounting for diverse ap-proaches to maintaining regionalstability. In pursuance of this, thetwo countries have planned a bilater-al level maritime security dialoguein early 2019.Focus on sub-regional-

Proposals to hasten constructionof a Ram temple at Ayodhya are ex-tremely ill-advised. There is a clam-our by the Rashtriya SwayamsevakSangh (RSS) and Sangh Parivar foran ordinance and later a statute (i.e.Act) for building a Ram temple overthe ruins of the Babri Masjid inAyodhya immediately. No morewaiting, they say. The supposedlyneutral Justice J. Chelameswar, whoretired as a Supreme Court judge ear-lier this year, joined the fray, sayingit was possible. The ex-justice islearned and bold, but needed to showthe downside. The Centre’s remitAny ordinance would have to bepassed by the Central government ifthe President (as advised by PrimeMinister Narendra Modi’s cabinet)“is satisfied that circumstances existwhich render it necessary for him totake immediate action” to promul-gate an such an ordinance, which willcease if it is negated or lapses. If itlapses, re-promulgation can takeplace. Repeated re-publication wasfrowned upon in the D.C. Wadhwacase (1986). Again, by brute strengthan Act may be passed amidst up-heavals and rancour throughoutIndia. But can the Central govern-ment as statutory receiver pass suchan ordinance or even table a Bill inParliament? There is an immediateconflict of interest. The alternative isa Private Member’s Bill. Given the

conflict of interest, the Central gov-ernment is obliged to oppose it, albeitwith a three-line whip. The State ofUttar Pradesh is bound by its stancein the Allahabad High Court that it isnot interested in the site.

Even if passed, any such statutewould have to cross many hurdles.First, there is the Places of Worship(Special Provisions) Act of 1991. Inthis Act, the cut-off date for freezingthe religious character of a place ofworship is August 15, 1947 and allsuits regarding their status wouldabate. Section 6 prescribes punish-ment of up to three years or fine orboth if this is violated. But Section 5of the Act said: “Nothing contained in

this Act shall apply to the place orplace of worship commonly known asRam Janma Bhumi-Babri Masjid sit-uated in Ayodhya in the State of UttarPradesh and to any suit, appeal orother proceeding relating to the saidplace or place of worship.” This, how-ever, does not pave the way for sim-ply repealing the section, for thatwould give further protection to theMuslim case. Second, we have to turnto the Acquisition of Certain Area atAyodhya Act, 1993, which acquiredthe site to put an end to the litigation,and vested the property in Centralgovernment. Third, the Act of 1993was interpreted in Ismail Faruqui v.Union of India (1994) so that the prop-erty would remain with the Centralgovernment as a “statutory receiv-er”, a concept invented by the court.The cessation or abatement of thepending Ayodhya case between theMuslims and Hindus (Section 4(3))was set aside by the Supreme Courtwhile unfairly allowing Hindu wor-ship. The court declared: “The bestsolution in the circumstances, on re-vival of suits is, therefore, to main-tain status quo as on 7th January,1993 when the law came into force.”Any action taken now (i.e. 2018 on-wards) would violate this status quo.As the “statutory receiver”, theCentral government has the respon-sibility to wait for the result of thesuit. No ordinance or statute can sitin appeal on the IsmailFaruquijudgment of 1994. Separation

of powers. There is a well-knownprinciple, emanating from the doc-trine of separation of powers in theConstitution, that the legislativepower of Parliament cannot usurpthe judicial power to sit in appealover the judicial decision-making –still less where the case is pending asa suit or in appeal. This decision,which was considered earlier, wasfirmed up on a tax case Shri PrithviCotton Mills (1969) after which therehave been dozens of cases going oneway or the other. But the legislaturecan change the basis of the law. It’smore complicated than you think.What will a proposed Act or ordi-nance say? Can it say that this firstappeal to the Supreme Court underthe Code of Civil Procedure will betaken away? The right to adjudicatecannot be taken away as it would bediscriminatory if applied to a partic-ular case to take away a valuableright. The new basis for the lawwould have to invalidate theAllahabad High Court judgment of2010, Ismail Faruqui (1994) and the or-ders subsequent to it and then in-junct the pending proceedings in theSupreme Court. The justification forthis can only be that strident mem-bers of the Hindu majority are impa-tient to reverse the Allahabad deci-sion which gives one-third of the landto the Muslims. There is also a resist-ance by the Nirmohi Akhara, whichclaims the entire site and does not

want to give the Deity its one-third.As soon as the ordinance or Act is passed, it will be chal-

lenged in the Supreme Court because it is of national im-portance and affects the jurisdiction of the Supreme Court.True, there is a presumption of the constitutional validityof a statute. Even if no stay is granted, the urgency of thematter may mean an assurance sought by the court that noprecipitous steps would be taken during these new pro-ceedings. There will be counter-clamour, protests, newsthat India favours Hindus over Muslims. Throughout theworld the destruction of the Babri Masjid has provokeddoubts on the capacity of India to be neutral. India has oneof the largest Muslim populations in the world — short of200 million. The case against the constitutionality of thenew ordinance or Act will take some time to decide. The de-cision in the Ayodhya case will be delayed further.

There is only one part of Justice J.S. Verma’s majorityin Ismail Faruqui (1994) that I like. He begins by quotingJonathan Swift: “We have enough religion to make us hate,

but not enough to make us love one another.” A secularstate? With the rise of an uncompromising fundamental-ism, India is faced with extreme populist demands againstminorities and the rule of law. The Constitution is secular,but parts of civil society are rabidly communal. The de-mand for the state to intervene to allow the Ram temple ispart of an aggressive Hindu fundamentalism which seeksto suborn the state to its wishes. The state has to remainneutral. To yield to a demand of one faith against anothernot only condones the destruction of the Masjid, but aban-dons the very basis of India’s multi-religious and culturalethos which it is bound to protect. It is the Constitution thathas pledged our diverse people together. It is not a play-thing – still less in the hands of a motivated majoritarian-ism that puts ‘India’ to ransom. Muslim fundamentalism isallegedly terrorists, its violent elements banned. Hindufundamentalism reigns free with its Hindutva, “ghar wap-si”, cow protection, violence, murders of activists and theRam temple movement seeking immediate solution.

The most important element hereis intelligence without which no terrorist movement canbe defeated. Efforts to further improve it must receive athrust, as must those to enhance the ability of the securityforces to act on the information received. Finally, terror-ists must be firmly dealt with. Sri Lankan PresidentMaithripala Sirisena, who lastmonth abruptly sacked prime min-ister Ranil Wickeremesinghe andreplaced him with former strong-man Mahinda Rajapksa, will write abook on his "unsuccessful politicalmarriage" with the ousted premier.

Sirisena's controversial actionon October 26 led to a political crisisin the country with bothWickremesinghe and Rajapaksaclaiming to be the legitimate primeminister.Wickremesinghe termedhis dismissal as invalid and said hestill holds a majority in the 225-member Parliament.Sirisena, ad-dressing a public gathering onFriday, said the book will be titled'My unsuccessful political marriagewith Ranil'.

"I know that people are criticis-ing me right now. I will tell them towait until I release my book," thePresident said.

Sirisena claimed that despite hisaction, he had not been isolated.

"I know that right thinking peo-

ple are with me on this battle againstthe corrupt and the traitors," headded.Sirisena's announcementcame hours afterWickeremesinghe's alliance woncontrol of a powerful panel inParliament, dealing a major blow tohim and his prime ministerial ap-pointee Rajapaksa. Former presi-dent Rajapaksa, who ruled SriLanka for almost a decade, was un-expectedly defeated by his deputy,Sirisena, in the presidential electionin January, 2015 with the supportfrom Wickremesinghe's UnitedNational Party.

Speaker Karu Jayasuriya thenordered a floor test in the 225-mem-ber assembly to end the ongoing po-litical crisis, a move which invitedthe wrath of the government ofRajapaksa. Indonesia on Fridaywrapped up the grim task ofidentifying Lion Air jet crashvictims from recovered bodyparts, with a preliminary re-port on the cause of the acci-dent that killed 189 people duenext week.

The Boeing 737 Max jet --one of the world's newest andmost advanced commercialplanes -- plunged into the JavaSea on October 29 shortly aftertaking off from capitalJakarta to Pangkal Pinangcity, killing all on board.

Since then, investigatorshave been doing DNA testingon recovered body parts.

As of Friday, 125 peoplehave been identified after test-ing on human remains thatfilled some 200 body bags, saidArthur Tampi, head of the na-tional police medical centre.

"We have identified 89

men and 36 women, includingtwo foreigners, namely anItalian and an Indian nation-al" who was the flight's cap-tain, Tampi told reporters inJakarta.

The identification was be-ing called off because all therecovered remains have beentested, he added.

Budget carrier Lion Airhas said it is paying a littleover USD 100,000 in compensa-tion to the families of eachcrash victim.

As the morbidity rate of type 2 diabetes keeps in-creasing, about 40 million people with the disease willnot have access to insulin for treatment by 2030, a re-cent study from Stanford University suggested.

Researchers simulated burden of the disease from2018 to 2030 across 221 countries using data from theInternational Diabetes Federation and 14 studieswhich represent more than 60 percent of the globaltype 2 diabetes population, Xinhua reported.According to the study, the number of people withtype 2 diabetes worldwide will increase from 406 mil-lion in 2018 to 511 million in 2030.About 79 million peo-ple will need insulin to control their condition, whileonly 38 million will be able to get it if access to insulinremains the same, researchers predicted. "These esti-mates suggest that current levels of insulin access arehighly inadequate compared to projected need, partic-ularly in Africa and Asia, and more efforts should bedevoted to overcoming this looming health chal-lenge," said Sanjay Basu, lead author of the study."The number of adults with type 2 diabetes is expectedto rise over the next 12 years due to ageing, urbanisa-tion, and associated changes in diet and physical ac-tivity," he said, urging more governmental actions."Unless governments begin initiatives to make in-sulin available and affordable, then its use is alwaysgoing to be far from optimal."

2 killed, 24 injured inexplosion in China

At least two persons have been killed and 24 others injured in an ex-plosion at a factory in China's Northeast Jilin province, the local govern-ment said Saturday.

The explosion occured at Jiangcheng Machinery Company based in a village in

Dongfeng county on Friday, state-run China Daily reported.About 41 buildings were also damaged in the explosion.According to a statement by the local government, two persons were

killed, including one who succumbed to injures in hospital, and 24 otherswere injured.The explosion also caused a large fire, another daily GlobalTimes said. The explosion triggered an emergency response from the gov-ernment. Rescue and investigation efforts are underway. The early inves-tigation has determined that the incident was not related to terrorism, theDaily report said.

We welcome the ruling this week by aGuatemalan court to convict and sentence a for-mer soldier to 5,130 years in prison for his role inthe Dos Erres massacre, she said, describing itas one of the most shocking episodes of the coun-try's long civil war, when more than 200 peoplewere killed in the village of Dos Erres in 1982.

Ms Throssell added that the court had con-cluded that the crimes against humanity com-mitted in Dos Erres were part of a larger statepolicy of the ruling military junta.

According to a UN-backed national rightscommission, 200,000 lives were lost amid hun-dreds of massacres that were carried out in in-

digenous Maya villages.State forces and paramilitary groups were

responsible for 93 per cent of violations docu-mented, Guatemala's Commission for HistoricalClarification found, including 92 per cent of arbi-trary executions and 91 per cent of forced disap-pearances.

Santos Lpez Alonso, who was a member of anelite force of the Guatemalan military known asthe Kaibiles, was found guilty of crimes againsthumanity and murder in 171 of these cases, Ms.Throssell said.

The massacre was planned and involved peo-ple of all ages, with many women and girls re-portedly raped, while children were thrown intothe village well.

The Kaibiles suspected the inhabitants ofDos Erres of sympathizing with left-wing guer-rillas, and after carrying out a search of the vil-lage for weapons, they proceeded to systemati-cally shoot or bludgeon to death hundreds ofmen, women and children, the OHCHRspokesperson explained.

In an appeal to the Guatemalan authoritiesto continue to investigate and prosecute thoseresponsible for crimes committed during thecountry's 36-year civil war, Ms. Throssell noted

that such trials have frequently been stalled bythe malicious use of injunctions.

Despite the courageous efforts by victims,lawyers and civil society organizations to en-sure justice, truth, reparations and non-repeti-tion, there have been very few prosecutions andconvictions, particularly of high-level officials,and few victims have received reparations, theOHCHR spokesperson said. Denouncing the dangers faced by mi-grants and asylum seekers in Libya, theUN refugee agency (UNHCR) called for anend to their detention and advised thoseintercepting or rescuing them at seaagainst returning them to a countrywhere they face squalid conditions.

Refugees in Libya are faced with anightmarish scenario, said RobertoMignone, UNHCR's Chief of Mission inLibya. They have fled their homes insearch of safety and protection only to endup incarcerated, languishing indefinitelyin squalid conditions.As large numbers ofrefugees and migrants continue to at-tempt the dangerous crossing of theMediterranean from Libya to Europe, ac-cording to the International Organisationfor Migration (IOM), many are being in-tercepted by the Libyan Coast Guard,brought back to shore, and placed in de-tention upon arrival.These interceptionsor rescue operations, have led to the place-ment of large numbers migrants in officialdetention centres, nearly doubling be-tween 2017 and 2018, from 5,500 to 9,300.

It is reprehensible that they are de-tained instead of protected. This is despitethe fact that viable alternatives to deten-

tion within Libya can be found, includingthrough a Gathering and DepartureFacility that we have been waiting to opensince July, which could offer immediateprotection and safety for those most vul-nerable, said Mr. Mignone.

When opened, the facility proposed byUNHCR would be the first of its kind in thecountry, sheltering vulnerable asylumseekers until a solution could be found toget them out of Libya. They said 5,239 candidatesare in the fray for 358 sarpanch and 1,652 panch seats.Ninety-six sarpanchs and 1,437 panchs have been electedunopposed in this phase, they added. Ishfaq Ahmad Ganaie was injured in the firing near thecamp of Army's 50 Rashtriya Rifles unit at Chattergamarea of Budgam in central Kashmir on Friday, a police of-ficial said. He said Ganaie succumbed at the SMHS hospi-tal here Saturday morning. Local residents had accusedthe Army of opening unprovoked fire that led to Ganaiegetting injured. However, Srinagar-based defencespokesperson Col Rajesh Kalia said the Army did notopen fire and the civilian was injured in a "terrorist com-mitted atrocity". "In a case of terrorist committed atroci-ty, Ishfaq Ahmad Ganie of Magraypora was shot at by theterrorists, 500-600 metres away from Army camp atChhatargam," Kalia said in a statement. He said when theArmy troops heard the sound of the firing, the QuickReaction Team immediately rushed towards the direc-tion of the fire to find out what was happening. "When theparty reached the spot, they saw Ishfaq in a pool of blood.He had bullet injuries, one in head and the other in leg andwas immediately taken to Chhatargam hospital fromwhere doctors shifted him to SMHS," Kalia said.

They looted Rs 1 crore at gunpoint from the goodscarrier, police said. Police registered a case and investi-gation started, they said. During investigation, numberof suspicious persons were interrogated and after sus-tained efforts, the police succeeded in unearthing thecase and arrested eight accused involved in it, they said.They were identified as Kiran Bhagat alais Chottu,Pintu Jamwal, Gourav Kumar Gautam, Vikas Talwar,Ajay Kumar, Yogesh Salgotra, Rajat Kagial alais Rajuand Varun Singh, officials said. Police also recoveredthe looted money, they said, adding that more arrestsand recovery is expected in the case wherein further in-vestigation was on.

Official sources said that the girl, identified as MuskanJan, sustained a bullet injury during cross-firing whenmilitants attacked an Army camp in Quimoh Khudwaniin Kulgam on Thursday morning.

DC Doda informed that 23 kanalland has been acquired for constructionof court complex. Notwithstanding a growingchorus for early constructionof a Ram temple in Ayodhyaahead of next year's generalelections, many youth in theholy city say they don't want tobe drawn into the "politicalmelee" while asserting thattheir future "won't hinge" onthe fate of the proposed temple.

Another section of youth,however, are anxious to havethe temple constructed but "notat the cost of communal harmo-ny". Aman Kumar, a stonecraftsman in his late 30s whoruns a statuary shop namedShri Ram Murti in the heart ofthe city, says, "Ayodhya is theland of Lord Ram. I was bornhere and more than three gen-erations of my family havebeen living here. We are a fami-ly of Ram worshippers, and itpains us to see Ram Lalla insidea tent."

A precious idol of RamLalla (child avatar of LordRam), along with those ofLaxman, Bharat andShatrughan, is currently keptinside the tent at the disputedRamjanmabhoomi-BabriMasjid site, which manyHindus believe to be the birth-place of Lord Ram.

Kumar, when asked aboutthe current frenzy surroundingthe controversial temple issue,says, "People of Ayodhya, of allcommunities, have always

lived in peace. It is outsidersand politicians with agenda,who come to our town and viti-ate the atmosphere."

"I will be very happy if aRam temple is built but itshould not happen at the cost ofcommunal harmony. Ayodhyahas already suffered in 1992,"he told PTI.

On December 6, 1992, anarmy of 'kar sewaks' (right-wing activists), drawn fromvarious parts of the countryconverged in Ayodhya andrazed the 16th century BabriMosque, triggering unrest inthe temple town and large-scaleriots in other parts of India.

The spectre of 1992 stillhaunts many people of both thecommunities, who had directlyor indirectly suffered in the vi-olence that erupted after thedemolition of the mosque.Meanwhile, senior police offi-cials say, security has beenstepped up in Ayodhya, in view

of the Vishwa Hindu Parishad's'Dharma Sabha', being toutedas the largest congregation of'Ram bhakts' in Ayodhya sincethe 1992 'kar seva'. RohitPandey, 18, a tour guide, whospeaks multiple Indian lan-guages, and wears a prominent'tilak' on his forehead, comfort-ably pallies with MohammadAzim, a 46-year-old auto-driverin the city, who bore the bruntof the 1992 tragedy.

"We affectionately call him'Mamu' (uncle). He brings thetourists here and I then takethem to Ramjanmabhoomi andother sightseeing places. Hinduand Muslims do not have prob-lem here. I also want a RamMandir but the peaceful atmos-phere should not be disturbed,"he says.

Azim says Rohit is almost ofthe same age as one of his foursons and "youth like him wantto focus on building their fu-ture, but are misguided by

politicians. My sons want to fo-cus on their career, not this is-sue, which anyway is in court."

Vikas Dwivedi, 18, anAyodhya native, currently pur-suing engineering atChaudhary Charan SinghUniversity, Meerut, says, "I ammore concerned about my fu-ture, my family's future. Thefate of the Ram temple is nei-ther going to affect my career,nor would I let it be affected."

Another Ayodhya resident,Anil Yadav, a college graduatenow preparing for competitiveexaminations, says, "We havefriends from all communities.We celebrate Holi and Eid to-gether. Some politicians andright-wing groups may bewhipping up sentiments onRam temple issue, but I am go-ing to be focussed on my careergoals." "The Supreme Courtwill decide on the contentiousissue, and everyone should re-spect that," he says.

The chorus has grown with-in the BJP and the SanghParivar, seeking constructionof a temple there through ordi-nance as the apex court recent-ly fixed the Ayodhya title suitfor the first week of Januarynext year before an appropriatebench, which will decide theschedule of hearing.

Several BJP and VHP lead-ers have claimed that majoritypopulation of Ayodhya and restof the country want to see thetemple get built as it is a "mat-ter of faith" for them.
