Non-Hearing Agenda Attachment 2 The following proposals are made to the Board by either CalHR or SPB. It is anticipated that the Board will act on these proposals without a hearing. Anyone with concerns or opposition to these proposals should submit, in writing, a notice to the Executive Officer clearly stating the nature of the concern or opposition. Such notice should explain how the issue in dispute is a merit employment matter within the Board's scope of authority as set forth in the State Civil Service Act (Government Code Section 18500 et seq.) and Article VII of the California Constitution. Matters within the Board's scope of authority include, but are not limited to, personnel selection, employee status, discrimination and affirmative action. Matters outside the Board's scope of authority include, but are not limited to, compensation, employee benefits, position allocation, and organization structure. Such notice must be received not later than close of business on the Monday before the Board meeting at which the proposal is scheduled. Such notice from an exclusive bargaining representative will not be entertained after this deadline, provided the representative has received advance notice of the classification proposal pursuant to the applicable memorandum of understanding. In investigating matters outlined above, the Executive Officer shall act as the Board's authorized representative and recommend that the Board either act on the proposals as submitted without a hearing or schedule the items for a hearing, including a staff recommendation on resolution of the merit issues in dispute. SUMMARY OF ISSUES:In line with the California Department of Human Resources' (CaiHR) Strategic Plan (Objective1.1, Initiative 1.1.1) and the Classification Consolidation Project Report, the CaIHR's PersonnelManagement Division (PMD) has committed to abolish classifications that have been vacant formore than 24 months. To date, 183 classifications that were vacant for more than 24 monthshave been abolished.

PMD has identified an additional 30 classifications that have been vacant for more than 24months for abolishment in this phase. Of the proposed 30 classifications, 18 are service wideand 14 are department specific. The five impacted departments, as well as the ServiceEmployees International Union (SElU), the California Statewide Law Enforcement Association(CSLEA), the Professional Engineers in California Government (PECG), the Association ofCalifornia State Supervisors (ACSS), and the California Association of Managers andSupervisors (CAMS) were notified and no objections were stated. Career Executive Assignments Attachment 3 This section of the Agenda serves to inform interested individuals and departments of proposed and approved Career Executive Assignment (CEA) position actions. Section A lists position actions that have been proposed and are currently under consideration. Parties having concerns with the merits of a proposed CEA position action should submit their concerns in writing to the CalHR Personnel Management Division and the department proposing the action. To assure adequate time to consider objections to a CEA position action, issues should be presented immediately upon receipt of the SPB Agenda in which the proposed position action is noticed as being under consideration. In cases where a merit issue has been raised regarding a proposed CEA position action and the dispute cannot be resolved, a hearing before the five-member Board may be scheduled. If no merit issues are raised regarding a proposed CEA position action, and CalHR recommends approval the action becomes effective without further action by the five-member Board. Section B of this portion of the Agenda reports those position actions that have been approved and are effective as of the date they were approved by the Board. A. Requests to Establish New or Revise Existing CEA Positions

1. CHIEF, SPECIAL PROGRAMS DIVISION

The California Public Employees’ Retirement System proposes to create a new Career Executive Assignment (CEA) position responsible for the full operation of the Special Programs Division (SPD). Previously the State Personnel Board approved a 24 month limited term CEA to perform similar duties. This request is for a permanent full-time CEA to perform the duties within the SPD. The SPD encompasses the Judges’ and Legislators’ Retirement System including the Judges’ Retirement System, the Judges’ Retirement System II and the Legislators’ Retirement System, as well as the Supplemental Income Plan program, the California Employers’ Retiree Benefit Trust program, and Marketing for the Customer Services and Support Bureau.

2. CHIEF, OFFICE OF LAW ENFORCEMENT SUPPORT

The California Health and Human Services Agency is requesting to establish a new CEA over the Office of Law Enforcement Support. As outlined in Welfare & Institutions Code section 4023.5(a) the CEA position is responsible for reviewing and evaluating best practices and strategies, including independent oversight, for effectively and sustainably addressing the employee discipline process, criminal and major incident investigations, and the use of force within state hospitals and psychiatric

programs run by the State Department of State Hospitals and Department of Developmental Services.

1. ENFORCEMENT PROGRAM MANAGER

The Department of Consumer Affairs, Medical Board of California is requesting approval to allocate the above position to the CEA category. This position is responsible for the Enforcement Program established as a result of Senate Bill 304 (Chapter 515, Statutes of 2013). This position will provide settlement authority to the Office of the Attorney General on stipulated decisions and will work with the Executive Director to make critical decisions on emerging issues related to enforcement of the Medical Practice Act. Taken under submission at the January 8, 2015, Board Meeting.

2. CHIEF OF OPERATIONS

The Office of Traffic Safety is requesting approval to allocate the above position to the CEA category. This position will advise the Director on ways to maximize existing funding to increase statewide traffic safety efforts related to multimodal transportation as well as seek new grant opportunities for the state. In addition, the position will implement changes necessary to meet federal, state and legislative mandates, and align overall strategic objectives to meet the Administration’s traffic safety objectives. Taken under submission at the January 8, 2015, Board Meeting.

3. The California Department of Human Resources proposes to revise the
