AN ORDINANCE
AMENDING SECTION 3 OF THE BUILDING ZONE MAP
Be it ordained by the City Council of the City of Springfield as follows: SECTION 1. The Zoning Ordinance of the City of Springfield, Massachusetts entitled “An
Ordinance for Consolidating and Arranging, Enlarging, Modifying and Amending the Ordinances of
the City Restricting Buildings, Structures, and Premises According to Their Use or Construction to
Specified Parts of the City”, text enacted, May 28, 2013, as amended, is hereby further amended by
changing from Residence B to Residence C the zoning on Plot #3212, Section 3 of the Building
Zone Map as indicated in red ink on the plan thereof hereto attached and marked “Section 3
Building Zone Map of the City of Springfield.”

Order Approving Fifth Amendment to Host Community Agreement with Blue Tarp ReDevelopment, LLC (Mayor
Sarno)
WHEREAS, pursuant to “An Act Establishing Expanded Gaming in the Commonwealth”,
codified at Chapter 194 of the Acts of 2011 and regulations promulgated thereunder
(collectively, the “Act”), the Mayor selected "Blue Tarp reDevelopment, LLC, an affiliate of
MGM Resorts International" ("Blue Tarp"), as preferred developer, to construct and operate a
destination casino resort project in the City on a site bounded generally by State Street, Main
Street, Union Street, and East Columbus Avenue; and
WHEREAS, the City and Blue Tarp subsequently entered into a Host Community
Agreement which was approved by the City Council and signed by the Mayor and other City
officials on behalf of the City; and
WHEREAS, Section 13.15 of the Host Community Agreement allows for amendments by a
written instrument signed by the parties; and
WHEREAS, in Section 13.21 of the Host Community Agreement, the City and Blue Tarp
agreed to cooperate and work together in good faith to the extent reasonably necessary and
commercially reasonable to accomplish the mutual intent of the Parties that the Project be
successfully completed as expeditiously as is reasonably possible; and
WHEREAS, pursuant to the terms of the Agreement the Parties have agreed to the
development of market rate housing; and
WHEREAS, in furtherance of this obligation, Blue Tarp has requested a "Fifth
Amendment to the Host Community Agreement", a copy of which is attached hereto as
Exhibit # 1 , providing that the City, the Springfield Redevelopment Authority, Blue Tarp and
31 Elm LLC, a Massachusetts limited liability company (the “Elm Street Developer”) and
certain funding parties to a Cooperative Funding Agreement, which sets forth the specific
terms and conditions under which such parties will jointly finance and facilitate the
redevelopment of the properties located at 3-7 Elm Street and 13-31 Elm Street (collectively,
the “Elm Street Project) to include 59 market rate upscale apartment units, 15 workforce
apartments and approximately 12,000 square feet of first floor retail and restaurant space, in a
manner to preserve the historic and aesthetic elements of the property and create an attractive,
friendly and inviting environment within the City’s Downtown in lieu of MGM’s Housing
Obligation under the HCA and, due to the potential for increased revenue to the Downtown
area resulting from the Elm Street Project, upon the funding of the MGM Contribution a CPI
adjustment should be applied to certain payments required by the Developer under the
Agreement.

WHEREAS, the Parties wish to amend the Agreement in substantially the same form as the
draft "Fifth Amendment to the Host Community Agreement" which is attached hereto as
Exhibit #1, by
1) Deleting Paragraph 3 of Exhibit A in its entirety and replacing it with a new paragraph
as set forth in Exhibit #1, section (1) on page 2:
2) Deleting the Residential paragraph in Exhibit G in its entirety and replacing it with a
new paragraph in Exhibit E, as described in Exhibit #1, section (2) "Section 15. Housing
Obligations", paragraphs (a) through (c), on pages 2-3; and
3) Deleting Paragraph 4 of Exhibit U in its entirety and replacing it with the language in
Exhibit #1, section (3) on page 3.
NOW THEREFORE BE IT ORDERED, pursuant to Mass. Gen. Laws ch. 23K, § 15, that the
City Council hereby:
1) Approves the Fifth Amendment to the Host Community Agreement in substantially
the same form as the draft Fifth Amendment submitted by the Mayor to the City Council
and attached hereto as Exhibit #1; and
2) Authorizes the Mayor to execute the Fifth Amendment to the Host Community
Agreement referenced herein, in substantially the same form as the draft Fifth
Amendment submitted by the Mayor to the City Council and attached hereto as Exhibit
#1.

Bond Authorization - Court Square Hotel Building Revitalization Project - $4,000,000 (Mayor Sarno)

(Court Square Hotel Building Revitalization Project)
Ordered: That the sum of $4,000,000 is hereby appropriated to pay costs of remediating
hazardous materials, undertaking selective interior demolition and paying other ancillary costs
related to the historic renovation of the Court Square Hotel Building, such project to be
undertaken in concert with the Springfield Redevelopment Authority, and that to meet this
appropriation, the City Treasurer, with the approval of the Mayor, is authorized to borrow said
amount under and pursuant to M.G.L. c. 121B, §20, or pursuant to any other enabling authority,
and to issue bonds or notes of the City therefor. The Mayor is hereby authorized to take any and
all action necessary or convenient to accomplishing the purposes of this order. Any premium
received upon the sale of any bonds or notes approved by this vote, less any such premium
applied to the payment of the costs of issuance of such bonds or notes, may be applied to the
payment of costs approved by this vote in accordance with M.G.L. c. 44, §20, thereby reducing
the amount authorized to be borrowed to pay such costs by a like amount.
Further Ordered: That the City Treasurer is authorized to file an application with The
Commonwealth of Massachusetts’ Municipal Finance Oversight Board to qualify under M.G.L.
c. 44A any and all bonds or notes of the City authorized by this order, and to provide such
information and execute such documents as the Municipal Finance Oversight Board of The
Commonwealth of Massachusetts may require.

Purpose: The purpose of this memo is to provide an explanation of the order sponsored
by the Mayor for the February 24, 2020 Council meeting, which authorizes the City to
pay $4,000,000.00 for the costs of remediating hazardous materials, undertaking selective
interior demolition, and paying other ancillary costs related to the historic renovation of
the Court Square Hotel Building.
Background: The City of Springfield, working in concert with the Springfield
Redevelopment Authority, plans to undertake pre-development renovations of the historic
Court Square Hotel Building. This work will include the removal of environmental
hazards from the currently derelict building.
This work is necessary for the redevelopment of the long vacant building. When this
redevelopment is completed, the building will be home to market rate housing units, and
will return to the tax rolls for the first time in many years. This historic redevelopment
project will help build on previous private and public investments in Springfield’s
downtown area, making it a more popular destination for residents to live, work, and find
entertainment.
CAFO Certification: This memorandum will confirm that in my professional opinion, as
the Chief Administrative and Financial Officer, after an evaluation of all pertinent
financial information reasonably available, that the City's financial resources and
revenues are and will continue to be adequate to support the proposed expenditures and
obligations involved in this City Council Order, without a detrimental impact on the
continuous provision of the existing level of municipal services, in accordance with
Section 2(f) of Chapter 656 of the Acts of 1989, as added by Section 1 of Chapter 468 of
the Acts of 2008.
This certification is made in accordance with Section 2(f) of Chapter 656 of the Acts of
