P rodded by organized labor, the assault by govern-ment agencies on independent contractors continues to broaden. Labor’s PR

machine remains very formidable, to say the least, and many outside of the industry, including those at the EDD and DOL/DLSE, have naively bought into the notion that trucking company owners are somehow exploiting an underclass of truck drivers. The fact is, this assault on independent contractors is an assault on freedom, capitalism, individual creativity, opportunity and entrepreneurship.

Most of our companies began with one truck…one enterprising individual…one American dream. As many of our companies have grown, expanded and INVESTED, we have also enabled others to incubate their own businesses along with us, frequently repeating this cycle of

success. Yet somehow we leaders are being vilified in the media. Government administrators, with the best of, yet, misplaced intentions, are on a mission to liberate what they believe to be an oppressed, exploited and indentured fleet of independent contractors.

One has to hand it to organized labor - - They are smart, creative and relentless. Their on-going efforts could thwart any individual driver’s dream of ever having his or her own company.

We need to ramp up our PR and education efforts to change the misperceptions that abound. It is a long-term endeavor, no doubt, but one worth pursuing. There are two ways members can help in the short term: One is to participate in an economic study dispelling the myth of exploitation by supplying data to showcase how well-paid your contractors are. Chris Shimoda can provide you more details. The other is to join us on April 21st in Sacramento for CTA’s “Capitol Day,” whereby we can take our message directly to the legislators.

Our relationship with state and federal regulatory agencies such as the California Highway Patrol, Department of Motor Vehicles, Caltrans, Air Resources Board, the Board of Equalization and the Federal Motor Carrier Safety Administration is long standing and strong. We can communicate with those agencies on behalf of our members when issues arise amplifying your voice so it is heard.

The California Trucking Association is also a trusted

community, where leaders of the trucking industry come to grow, learn, innovate, contribute and help their peers. By creating our community of trucking industry leaders, we can tackle the most significant public policy and compliance issues and everyone benefits.

Our goal for 2015 and beyond is to grow our community of trucking industry leaders. We want to be an engine of knowledge and learning, problem solving and innovation for our members. In order to grow our outreach, we need the many trucking companies that are not part of our association to partner with us. We need support from each and every one that is part of the California trucking industry. The larger our membership, the more influential we will be, which will help your business in return.

Be part of the solution! We need each voice of the California trucking industry to successfully influence the way business is being done in California.

In 2015 I would like to ask you to talk to your peers, talk to other trucking companies that are not part of CTA! Tell them we need their support. We are significantly stronger with each additional voice. By giving their support we can work on behalf of the industry and make positive changes.

We serve the larger good of the trucking industry by standing up for the interests of our members. We cannot advocate and help the industry without supporters like you. Your support helps us every day to advocate for the industry that is your livelihood. We thank you for your investment.

ObituaryCleo Evans, CTA President – 1981

Cleo Evans, the founder and former President of Evans Dedicated Systems and Evans Tank Lines, died February 4,

2015, at his home in Seal Beach, Calif. His death came several months after being diagnosed with West Nile Virus Encephalitis. Cleo was 6 weeks short of his 95th birthday. Mr. Evans was born a twin in Mesa, Ariz., to James Harley Evans (founder of Evans Tank Lines) and Charlotte Evans on March 21, 1920.

Cleo joined the California Trucking Association in 1948 and served as its President in 1981. As a member he worked on multiple committees and was also on the Board of Directors. He

served as Chairman of the LA/Orange unit between 1972 and 1976, and again later from 1978 to 1979. In 1988 he became a member of the Golden Jubilee Club, and also led the Tank Truck Conference as Chairman.

Cleo Evans served as president of the Maywood Water District; Maywood Chamber of Commerce; and Downey Toastmasters. He was “Maywood Man of the Year” in 1962, and was a 33 degree Scottish Rite Mason.

Mr. Evans served in World War II in the US Army from 1943 until his honorable discharge in 1946, spending most of the time in the European Theatre. He is survived by his wife of 73 years, Mary E. Evans; two daughters, Janet and husband Howard; Judy and her husband Bill; four grandchildren; and soon to be nine great-grandchildren.

CTA Member Helps Out with Teen Driver Training

KKW Trucking’s local dispatch group has been partnering with the B.R.A.K.E.S. (Be Responsible and Keep Everyone

Safe) Teen Driving School whenever it holds a training session at the Fairplex in Pomona, most recently Feb. 14-15.

B.R.A.K.E.S. aims to promote highway safety by training and educating teen drivers and their parents about safe driving.

Part of that is learning how to drive safety around large trucks. KKW takes a No Zone trailer and stages vehicles around the truck in the “no zones.”

At the end of each class, the truck is parked in the middle of five vehicles. Students and their parents identify all of the vehicles before climbing into the cab of the truck where they soon learn these blind spots do exist.

According to Jim Kraft, F.T.S. regional manager at KKW, once the students sit in the truck’s driver seat, it produces a “Wow, you are right!” moment every time.

Students in a B.R.A.K.E.S. teen driver training session held in Pomona last month learn about how to drive safely around large trucks and how to avoid a truck’s “no zones” with the help of drivers and dispatchers from CTA member KKW Trucking.

A teen driver learns first hand what truck drivers can’t see during a B.R.A.K.E.S. driver training program last month. Drivers and dispatchers from KKW Trucking volunteer their time to the program.

ARB Seeks CTA Member Input on Emission Control System Inspection and Maintenance Survey

The California Air Resources Board is attempting to bet-ter understand maintenance practices related to OEM and

aftermarket emission control systems by trucking fleets and has constructed the following survey. The CTA has agreed to distribute this survey on the condition that feedback provided by fleets is anonymous.

Survey results will be collected by CTA and survey answers will be provided to CARB without fleet identifiers. The information collected through this survey will be critical in ongoing stakeholder discussions over engine inspection and maintenance best practices. An industry workgroup has been meeting since summer of 2014. If you have any questions or

Aperia Wins 2014 CoolCalifornia Award

Aperia Technologies, makers of a self-powered, bolt-on tire inflation technology, announced last month it had been

named a winner of a CoolCalifornia Small Business Award by the California Air Resources Board. The American made Halo Tire Inflator is designed to solve the problem of tire under-in-flation in medium- and heavy-duty trucks and trailers, reducing fuel consumption, tire waste and emissions.

“Being acknowledged by CARB for climate consciousness is an honor we are proud to receive,” said Josh Carter, CEO and co-founder of Aperia. “We work hard to increase the efficiency of our own operations and strive to empower even greater impact by helping our customers increase the efficiency of theirs.”

Volvo Trucks to Recognize Safest North American Fleets with 2015 Award

Volvo Trucks is seeking North America’s safest fleets to recognize them with the Volvo Trucks Safety Award. For the

seventh straight year, two fleets with the safest driving records and top safety programs will receive the annual award and $25,000 to be used for their safety-related activities.

“Nothing is more important in managing a fleet than maintaining a stellar safety record, and we are proud to honor the trucking industry’s best performers again this year,” said Göran Nyberg, president of Volvo Trucks North America. “Safety is a core value at Volvo, and we are proud to offer active safety technologies to help make the highways safer for everyone and passive safety features to help protect a fleet’s most valuable asset: The driver.”

Michelin Americas Truck Tires will again join Volvo Trucks in sponsoring the annual award. Michelin has been a supporting sponsor since 2010.

“Michelin Americas Truck Tires is proud to continue our sponsorship of the Volvo Trucks Safety Award,” said Mike Cain, Michelin Americas Truck Tires vice president of original equipment. “This award embodies the commitment to safety that has been a foundation of Michelin for 120 years, and we are thrilled to again participate with Volvo Trucks in recognizing the safest truck fleets in North America.”

The Volvo Trucks Safety Award is open to all U.S. and Canadian fleets operating at least five Class 8 units. Fleets must have at least one Volvo tractor in operation to be eligible for the award. Entrants will be ranked by their accident frequency rates and will also be judged on their accident prevention activities. The two grand prizes will be awarded to the fleets with the best records in two divisions based on annual vehicle miles traveled: less than 20 million miles and more than 20 million miles.

The deadline for entry is June 30, 2015. The award winners will be announced during the American Trucking Associations’ Management Conference & Exhibition in October 2015 in Philadelphia.

Equipment Leasing Economic Activity Index Up

The Equipment Leasing and Finance Association’s Monthly Leasing and Finance Index, which reports economic activity

from 25 companies representing a cross section of the $903 bil-lion equipment finance sector, showed their overall new business volume for January was $6.7 billion, up 12% from new busi-ness volume in January 2014, the association reported Feb. 25. Volume was down 48% from December, following the typical end-of-quarter, end-of-year spike in new business activity.

Receivables over 30 days were 1.1%, up slightly from 1% the previous month and from 1% the same period in 2014. Charge-offs were unchanged for the tenth consecutive month at an all-time low of 0.2%.

Credit approvals totaled 78.6% in January, unchanged from December. Total head count for equipment finance companies was up 1.0% year over year.

Separately, the Equipment Leasing & Finance Foundation's Monthly Confidence Index for February is 66.3, a slight increase from the January index of 66.1 and the highest level in the last three years.

FMCSA Asks for Help in HOS Study

The Federal Motor Carrier Safety Administration is recruit-ing truck drivers and carriers willing to participate in the

Driver Restart Study. FMCSA said the study will measure and analyze the fatigue and safety performance levels of drivers who take two nighttime rest periods during their 34-hour restart break compared to those who take less than two nighttime rest periods during their restart break.

Drivers will be paid for their participation and carriers may be compensated for lost revenue due to the study and for the cost of installing data collection equipment on their trucks. During the study, participants will drive their normal revenue-producing routes.

The Driver Restart Study will compare data from five months of driver work schedules to assess the following:

•Safety critical events. •Operator fatigue and level of alertness. •Driver health. The findings will help improve our knowledge of driver

FMCSA Establishes Committee to Update Truck and Bus Driver Training

The Federal Motor Carrier Safety Administration announced Feb. 10 the formation of a 26-member advisory commit-

tee that is tasked with updating classroom and new behind-the-wheel training requirements for professional truck and bus drivers.

“Over the next 30 years, we’re going to be relying on trucks – and truckers – to move more than 40 percent more freight than they currently do,” said U.S. Transportation Secretary Anthony Foxx said in a press release. “With more people and freight crossing our country than ever before, this committee’s work will be critical to ensuring that commercial drivers are fully capable of operating their vehicles safely.”

In December, FMCSA reported that it intended to establish a committee to examine minimum training requirements, including length of classroom instruction and behind-the-wheel experience, accreditation versus certification of Commercial Driver’s License training programs and schools, curricula for passenger, property and hazardous materials carriers, instructor

qualifications, as well as other areas. The Entry-Level Driver Training Advisory Committee

comprises a diverse cross-section of motor carrier interests, including training organizations, the intercity bus and trucking industries, law enforcement, labor unions, and safety advocates. The committee is tasked with negotiating the issues to be addressed in a proposed training rule, which the agency intends to issue by the fall of 2015, with a final rule expected in 2016.

“Ensuring roadway safety starts with the driver,” said FMCSA Acting Administrator Scott Darling. “Finalizing new training requirements for truck and bus operators is one of my top priorities and we have tapped a group of uniquely qualified stakeholders to help us work through the details and meet this goal.”

The MAP-21 transportation bill directed FMCSA to establish new minimum training requirements for individuals seeking to obtain an intrastate or interstate commercial driver’s license and become a professional truck or bus operator.

from across North America as the 2015 Best Fleets to Drive For. The 7th annual survey and contest identifies for-hire trucking companies that provide the best workplace experiences for their drivers.

To be considered for the Best Fleets program, a company operating 10 trucks or more had to be nominated by at least one of its company drivers or owner operators. CarriersEdge then interviewed human resources representatives and executives of the nominated fleets about their corporate direction, policies, and programs. Nominated fleets were evaluated against a scoring matrix covering a variety of categories, such as:

• Total compensation package – including base pay, bonuses, vacation, and sick day allotment

• Health benefits• Pension plans• Professional development opportunities (training, coaching

programs, etc.)• Career path/advancement opportunities• Commitment to employee personal growth, including

work/life balance, driver family support, and employee-directed charitable contributions

• Commitment to continuous improvement, including dispute resolution processes and inclusion of driver feedback in policymaking

• Team building and driver community development activities

• Annual driver turnover rate• Fleet safety recordA selection of each fleet’s drivers was also surveyed, with

their feedback compared to management’s and incorporated into

the final score. The responses were then tallied, resulting in the selection of this year’s winners and honorable mentions.

Robert Tennies, Western Truck Center

Robert Tennies brings first-hand knowledge to his job in new and used truck sales at Western Truck Center in Stockton. Before getting into the sales end of the busi-

ness, he was an owner-operator for 28 years, driving in every one of the lower 48 states and several Canadian provinces.

Now he helps his customers find the right vehicles for their businesses.

Western operates 18 dealerships from California’s Central Valley up to Alaska selling Volvo, Mack and other truck brands.

The desire to spend more time with his family led to his job switch. It also gave him more time to devote to CTA.

For nine years, he has served as either unit chair or co-chair, starting with the Bay Area Unit and then with the San Joaquin Unit.

He has stepped back from those leadership roles a “little bit,” he said, but will still remain actively involved in CTA programs, particularly the Truckin’ for Hospice motorcycle and classic car rally sponsored by the San Joaquin Unit and other CTA members. The ride helps raise funds for hospice operation in San Joaquin and Stanislaus Counties and has become a major fundraiser for the organizations.

“Last year we broke the $600,000 mark in raising money,” he said.

As for his long career in trucking, Tennies said he wouldn’t hesitate to recommend the industry to young folks looking to start out. “I would say, it’s a nice career, a very good career. It’s one of those where you can chose to work for someone else or work for yourself.”

And there is always a need for folks with trucking experience, he added. “No matter where you go in life, you can always find a job in trucking, whether it’s as a driver, dispatcher or a technician. There are so many opportunities in trucking.

He is involved with CTA because he said it provided him with a way of “giving back and making a difference after all the industry has done for me.”

He said he is particularly interested in the legislative aspects

of the Association. “As a whole, CTA is a leader in making changes for the entire industry,” in terms of working with lawmakers and regulators.

In all his years in the industry, along with the many regulatory changes that have come along, perhaps the biggest changes he has seen are in the quality of the trucks. He remembers that trucks didn’t have power steering or air conditioning when he started driving. Now, the vehicles are more comfortable, better running and more are high-tech, he said, noting that today’s technicians must be more than mechanics to work on trucks.

Freight Index Remains Flat in December

The Bureau of Transportation Statistics – part of the U.S. De-partment of Transportation reported Feb. 11 that its Freight

Transportation Services Index remained virtually flat in Decem-ber from November.

Shipments in December measured 123.8 according to the index (the year 2000 = 100), less than 1% below November’s all-time high level of 123.9, BTS said.

The Freight TSI measures the month-to-month changes in freight shipments by mode of transportation in tons and ton-miles, which are combined into one index. The index measures the output of the for-hire freight transportation industry and consists of data from for-hire trucking, rail, inland waterways, pipelines and air freight.

BTS said that trucking, rail carloads, and waterborne shipments grew in December but air freight, pipeline, and rail intermodal decreased, resulting in the overall freight index remaining almost level.

Diesel Prices Inch Up

The U.S. Energy Information Administration reported in its Feb. 10 Short-Term Energy Outlook that it expected retail

diesel prices to fall to a national average of $2.83 per gallon in 2015 from a national average of $3.83 per gallon in 2014.

But prices are expected to rise again next year, with EIA predicting a national average of $3.24 per gallon in 2016.

On Feb. 23, the average retail price in California rose almost 7 cents per gallon to $3.208 per gallon compared to a national average of $2.90 per gallon. Despite rising from the previous week, prices in California were 90 cents lower than at the same time last year and $1.12 lower on the national level than last year.

Personal Income Up in December

Personal income for U.S. residents increased $41.3 billion, or 0.3%, in December from the previous month, the Bureau of

Economic Analysis reported Feb. 2.Disposable income also increased by 0.3%.Consumer spending decreased by $40 billion (0.3%), BEA

said, after increasing $58.8 billion (0.5%) in November.Wages and salaries were up in December, but by a smaller

amount than in November – $6.9 billion vs. $42.2 billion.Proprietor’s income was up $12.8 billion in December, after

ATA Truck Tonnage Index Jumped 1.2% in January

The American Trucking Associations reported last month that its advanced seasonally adjusted For-Hire Truck Tonnage

Index increased 1.2% in January, following a revised gain of 0.1% during the previous month. In January, the index equaled 135.7 (2000=100), an all-time high.

Compared with January 2014, the SA index increased 6.6%, which was the largest year-over-year gain in over a year.

The not seasonally adjusted index, which represents the change in tonnage actually hauled by the fleets before any seasonal adjustment, equaled 126.9 in January which was 3.5% below the previous month (131.5).

ATA recently revised the seasonally adjusted index back five years as part of its annual revision. For all of 2014, tonnage was up 3.7%, slightly better than the 3.4% originally reported. In 2013, the index increased 5.5%.

In a prepared statement, ATA chief economist Bob Costello said, “Truck tonnage continued to improve in January, marking the fourth straight gain totaling 3.5%. Last year was slightly better for truck tonnage than we originally thought and I am expecting that momentum to continue in 2015.”

Costello added that since bottoming out in March 2014, tonnage is up 6.7%.

Trucking serves as a barometer of the U.S. economy, representing 69.1% of tonnage carried by all modes of domestic freight transportation, including manufactured and retail goods. Trucks hauled 9.7 billion tons of freight in 2013. Motor carriers collected $681.7 billion, or 81.2% of total revenue earned by all transport modes.

ATA calculates the tonnage index based on surveys from its membership and has been doing so since the 1970s. This is a preliminary figure and subject to change in the final report issued around the 10th day of the month. The report includes month-to-month and year-over-year results, relevant economic comparisons and key financial indicators.

NAFTA Trade Value Declines in December

U .S.-NAFTA freight totaled $95.8 billion in December 2014, according to the U.S. Department of Transporta-tion’s Bureau of Transportation Statistics. In a report re-

leased Feb. 26, BEA said year-over-year, the value of U.S.-NAF-TA freight flows by all modes increased by 5.4%, with December marking the 11th consecutive month of year-over-year increases.

In December 2014 compared to December 2013, the value of commodities moving by truck grew by the largest percentage of any mode, 9.3%. Rail freight increased by 8.3%, air rose by 6.3%, and pipeline grew by 4.0%. Vessel freight decreased by 22.6%, mainly due to lower mineral fuel prices.

Trucks carried 59.2% of U.S.-NAFTA freight and were the most heavily utilized mode for moving goods to and from both U.S.-NAFTA partners. Trucks accounted for $28.4 billion of the $52.5 billion of imports (54.0%) and $28.4 billion of the $43.3 billion of exports (65.6%).

Rail remained the second largest mode, moving 15.1% of all U.S.-NAFTA freight, followed by vessel, 8.3%; pipeline, 8.0%; and air, 4.1%. The surface transportation modes of truck, rail and pipeline carried 82.3% of the total U.S.-NAFTA freight flows.
