Is there hope? I think so. The gig startups have been launched out of Silicon Valley and have swelled into multi-billion dollar valuations that have the wherewithal to fight back. Their argument is obviously that it’s about connecting talent and/or ambition with opportunity, and it’s done digitally. Millions of people are benefitting as the gig phenomenon evolves, not just in the U.S. but worldwide. And as the next generation’s roots take hold in our economy, freelancing

has the attractive flexibility that millennials cherish the most and which is obviously inherently part of independent contracting. Online platforms effectively connect individuals with work opportunities, and websites like Monster and LinkedIn match individual resumes with job postings, and millions of people around the world are using these services. Are Uber and Lyft and Handy and myriad others like them so different? I don’t think so. So while on one hand we truckers have the winds against us, the momentum of the gig economy is HUGE and perhaps Silicon Valley will help us shift those winds.

A ttacks on the legitimacy of independent contractors are no longer isolated to a few industries, particularly our own, but are now ubiquitous throughout the American

economy. This new “sharing economy” that has sprung up with the likes of Uber, Lyft, Airbnb and Handy enable people to share services like offering rooms for rent or driving passengers or cleaning houses, and those services are brokered through smartphone apps and connect independent contractors (freelancers) with available short-term “gigs.” And this on-demand “gig” evolution is creating tremendous opportunities for enterprising individuals. Nevertheless, the left is quick to demonize this revolutionary momentum as some sort of rip-off or exploitation of an oppressed underclass. Sound familiar? And although stories of successful independent entrepreneurs vastly outnumber the misfires, criticisms have become mainstream on the left. Until recently the term “misclassification” was part of the vernacular of labor lawyers, but even Hillary Clinton has latched onto it as part of her proposed economic agenda. “I’ll crack down on bosses that exploit employees by misclassifying them as contractors or even steal their wages,” she said on July 20th. What may be evolving here, which is indeed troubling, is that regardless of the most noble and legitimate operation one may operate, the groundswell of emotion emanating from misguided, naïve, crusading do-gooders who vilify anyone using independent contractors is rampant and will undoubtedly taint future judgements.

July 17th marked the beginning of the month-long summer recess for legislators in California, but it also signifies a short lull before the legislative machinery starts cranking

up again. Upon their return to Sacramento in mid-August, legislators will have less than a month to complete all of their remaining tasks before the legislature breaks for the rest of the year on September 11th. Up until this point, it’s been a grueling marathon, but it’s about to turn into a full-on sprint.

As you can imagine it’s a flurry of activity with bills both passing and making it on to the Governor for review, or bills dying for the year at either the Appropriations Committee or on the floor. For trucking, there are still bills making their way through the process that are of significant interest to our industry. Alternative fuel development, vehicle incentives, safety concerns, and emissions reduction targets are still very much in play. Each of these issues easily deserve their own column this month, but its infrastructure funding that poses some of the greatest risks and rewards to our industry at this moment.

On top of the existing legislative session, Governor Brown has called a special session in the legislature to deal exclusively on California’s transportation maintenance backlog and our long-term funding needs. After years of neglect, the state’s roadway system has fallen into complete disrepair with $59 billion needed just to address our maintenance backlog. When you combine that figure with the billions needed to improve our system to meet today’s congestion, efficiency, and operational needs that number balloons to $536.2 billion over the next decade.

In the special session, legislators will be turning over every stone searching for revenue and transportation-related costs savings in an attempt to bring that monstrous need down. Weight Fee Recapture, Vehicle License Fees, Registration Fees, Fuel Taxes, Loan Repayments, and other revenue mechanisms will all be on the table. The risk for the industry is the potential for a large tax increase to be put on trucking companies and the vehicles they operate. Legislators are currently discussing a transportation funding package that

would be valued at $3 to $6 billion annually with the industry potentially on the hook for $500 to $1 billion of that total.

Although the risks are clearly great, the rewards that could be reaped are significant as well. Our industry could see an

across the board increase in the amount of investment put into roadway goods movement projects that could help lower congestion and increase productivity across the state. Freight bottleneck relief, last-mile connectors to freight hubs, critical trade corridors, and other trucking specific infrastructure are all being discussed in these early stages of the special session. These benefits will be geographically diverse as well, where all areas of the state could see benefits from this program.

Luckily for our industry and for all Californians, the legislature will need a 2/3 vote in both houses to approve any transportation package moving forward. This means that Democrats will need to work with Republicans on a compromise that sees investments made, but also revenue protections and other reforms built into the final plan. This is a great opportunity for us to fix the revenue misappropriations made in the past, but also set the state on a true infrastructure investment plan for the future.

In any event, your team at CTA is directly plugged into these negotiations and legislators know that they need our industry’s support to move anything forward. Make no mistake, our position is strong and we will continue to push for our member-approved policy positions.

The last couple of months are going to be extremely busy in Sacramento, with the special session only adding to this urgency. I hope every member stays engaged in this process, even with all of the twists and turns that are bound to present themselves along the way.

CTA Responds to Governor Brown’s Executive Order on Sustainable Freight

On July 17, Governor Brown issued an Executive Order directing the Transportation Secretary, Secretaries of

Cal/EPA and the Natural Resources Agencies to lead relevant departments including CARB, Caltrans, the CEC and GO-BIZ to develop an "integrated action plan by July 2016 that establishes clear targets to improve freight efficiency, transition to zero-emission technologies, and increase competitiveness of California's freight system".

In response, the California Trucking Association released the following statement to our state and national media list:

"The executive order issued today by Governor Jerry Brown's office demonstrates the importance of California's freight transportation system to the state's economy. Trucking is currently, and is projected to remain, the primary mode of goods movement in California. Hauling nearly 90% of manufactured tonnage in the state with 80% of California communities depending exclusively on trucks, California truckers are already spending a billion dollars a year to reduce emissions by up to 99%. In the past few years, the trucking industry - 3/4 of which is made up of small family-owned businesses, has invested over $7 billion on clean truck technologies. This number alone is equivalent to taking 1.4 million cars off the road.

“As the State contemplates more costly new emissions

targets, it must consider the economic impact to the trucking industry. The California Trucking Association urges Governor Jerry Brown and other applicable state agencies to work closely with all stakeholders on a plan that will allow California to continue operating smoothly and efficiently."

Leadership in Logistics Roundtable Slated Next Month

CTA will host a Leadership in Logistics Roundtable at the Old Ranch Country Club in Seal Beach Sept. 3

featuring U.S. Congressman Alan Lowenthal, Federal Maritime Commission Chairman Mario Cordero and California Transportation Commissioner Fran Inman.

CTA’s Intermodal Conference Executive Director Alex Cherin will moderate the panel discussion which will provide insight on the state of the logistics, drayage and transportation in an around Southern California.

As part of the event, the CTA will also be presenting the “Josh Owen Memorial Leadership in Logistics Award” to Fran Inman (Majestic Realty).

The panel discussion will be followed by lunch featuring keynote speaker former major leaguer Jim Abbott.

4 Things to Know about the Governor’s Freight Plan Executive Order

1. The executive order highlights freight’s incredible place in California’s economy. The Governor highlights some awe-inspiring figures on freight’s role in California’s economy, including making up one-third of the State's economy and jobs, with freight-dependent industries accounting for over $700 billion in revenue and over 5 million jobs. No wonder “truck driver” is the State’s most common job.

2. The plan could lead to emission caps for freight hubs, including warehouses and distribution centers. The California Air Resources Board (CARB) floated the idea of emission caps for freight hubs in a draft version of the Plan this April. This new rule would impact operations at thousands of facilities across the State, including ports, air freight hubs, railyards and warehouses/distribution centers. Which is another way to say that…

3. The plan could be expensive. Although not commercialized, zero-emission truck technology (such as battery-electric and hydrogen fuel cell) is expected to cost as much as 3 to 4x as much as their brand-new diesel counterparts. The range of these vehicles is also limited, going less than 80 miles per charge for battery-electric and less than 200 miles per fueling for hydrogen fuel cell. Given the huge advances in modern emission control technology, we’d be spending a lot to clean up very little. In order to balance these priorities with the dire need for working class jobs in California.

4. The plan calls for “clear targets” for freight efficiency, economic competitiveness and a transition to zero-emissions. By July 2016, the California Air Resources Board, the California Department of Transportation, the California Energy Commission, and the Governor's Office of Business and

Economic Development must develop an integrated action plan to achieve each target. The State has already adopted a goal to put 1.5 million zero-emission cars on the road by 2025. We could see similar numerical targets for commercial vehicles and other freight equipment, despite the fact that most zero-emission freight technology is trailing passenger cars by decades.

How “freight efficiency” and “economic competitiveness” will be defined is yet to be seen. However, making the economic sustainability of an industry responsible for 1/3rd of California’s economic a co-equal priority is undoubtedly a step in the right direction.

It is that time of year when CTA begins to make preparations for 2016 and therefore it is time to advise its membership about the process regarding the annual election of Unit and Conference Officers and Unit Directors and of Statewide Officers.

Each member who is interested in serving as a Unit or Conference Officer or Unit Director should contact their respective Unit or Conference chairperson and indicate their interest. This contact can take any form (phone call, email, regular mail or fax), but should be done as soon as possible.

Each Unit and Conference should meet prior to October 16 to elect its 2016 Officers (Chairperson, Vice Chairperson, Treasurer and Secretary) and Unit Directors.Once each election is completed, please send a notification of the election results via email to CTA CEO Shawn Yadon. Also, please send a biography of each person elected.Officers and Directors who have been elected will serve a one-year term of office, commencing at the beginning of the Board meeting held in conjunction with the AMC, and expiring at the beginning of the following year's Board meeting at the AMC.

In addition to serving as a Unit Officer and Unit representative on the CTA Board, each year there are opportunities for members to serve as statewide CTA Officers. CTA has several positions to which members are elected each year. These are: Chairperson of the Board, President, First Vice President, Treasurer, Secretary and three Vice Presidents. Any member interested in running for one of these elected positions should send a resume and/or letter of interest via email to Shawn Yadon no later than September 30.

It is not required that you be nominated by another member. If you are interested in serving in leadership, you are invited to express your interest during this time.

Caltrans Commercial Vehicles Operations Personnel Update

On July 21, John Holzhauser was named the permanent Senior Transportation Engineer

(Supervisory) for the Transportation Permits Policies and Compliance Branch of Caltrans HQ Traffic Operations, Office of Commercial Vehicle Operations. He is responsible for establishing policies and guidelines for the issuance of transportation permits, updating the Transportation Permits Manual, enforcing the compliance program and overseeing equipment inspections statewide. He also will be responsible for maintaining good working relations with the trucking industry and will be actively involved in CTPAC meetings and communications. Additionally, Jeff Jewett, Narayan Selwal and Mastri Alvandi have been hired as the three new Branch Chiefs for their Transportation Permits writing staff. Each comes with years of experience at Caltrans.

Caltrans Raises Vertical Clearance

A unique bridge project, the first of its kind in Caltrans District 3, began in 2014. Nicknamed “Raise80,” the project

calls for the increase in vertical clearance of nine bridges that cross Interstate 80 in south Placer County.

The overcrossings, from Brace Road in Loomis to Magra Road east of Colfax, include eight vehicle bridges and one railroad crossing.

The vertical clearance of these structures must be 16 feet, 6 inches in order to meet federal standards. Caltrans and the Federal Highway Administration worked together to fund and award the $36 million project in order to meet the needs of today’s larger trucks, as well as national security concerns about the movement of larger military vehicles.

Built in the 1950s and ‘60s, these nine structures were nearly 2 feet short of the federal standard. Caltrans design team identified six overcrossings that could be lifted and three structures that required the freeway be lowered to achieve the required clearance.

Contractor RGW Construction successfully lifted its first overcrossing at Magra Road in September 2014. Using hydraulic jacks, steel bracing and a crew of nearly 40, RGW developed a process to precisely lift the nearly 2-million-pound overcrossing. The process required the interstate and local road to be closed. I-80 was shut down for two consecutive nights during the bridge raising, and the overcrossing was closed for several weeks while work was done to reconnect to the local road.

At locations where the road is lowered, a lane is closed while the road is lowered one side first, followed by lowering the road on the second half.

Gaining experience with each lift, the operation of the strategically placed 100- and 200-ton hydraulic jacks resulted in each overcrossing being lifted more and more efficiently. Two of the most recently completed overcrossings, Horseshoe Bar Road and King Road, were lifted in one night instead of two.

“The process has gone exceptionally well,” said Caltrans Public Information Officer Liza Whitmore.

This partnering effort between Caltrans and the contractor has succeeded in limiting the impact to the local communities, the traveling public and trucks that transport $4.7 million in goods per hour along the interstate.

Collaboration with local chambers of commerce, public safety agencies, news media and organizations such as Caltrux has insured that accurate information, detour maps, and project schedules have been efficiently distributed via the project’s website, www.raise80.com, e-blasts and community newsletters. Social media has also played a huge role in keeping everyone up to date – Raise80 has nearly 200 Twitter followers and more than 800 Facebook followers.

The work to increase the vertical clearance on the remaining two bridges is scheduled after Labor Day to avoid busy summer traffic. Caltrans looks forward to a successful completion of the Raise 80 project by the end of the year.

Training Video for Driving in San Francisco

San Francisco's Municipal Transportation Agency has developed a training video for large vehicle drivers that

operate on busy city streets. This 15-minute training video focuses on preventing collisions with people walking and biking, and is useful as either as a standalone training item, or as an element of a larger training curriculum. The information contained in the training video is applicable to the conditions found in large cities across the country.

San Francisco is offering this training video at no cost, with the hope that the SFMTA's video, or proprietary training modules that communicate the same information, will be adopted state- and nationwide by companies and organizations that use large vehicles. Spreading these training principles will help reduce traffic injuries and fatalities. Organizations that utilize the training will--if so desired--have their name displayed on the city's Vision Zero website to showcase those in support of safe driving. California "No defect" DVIR Update

Late last year, the Federal Motor Carrier Safety Administration (FMCSA) rescinded the requirement

that commercial motor vehicle drivers operating in interstate commerce, except drivers of passenger-carrying CMVs, submit, and motor carriers retain, Driver Vehicle Inspection Reports when the driver has neither found nor been made aware of any vehicle defects or deficiencies.

This rule also harmonizes the pre- and post-trip inspection lists. According to the FMCSA, the rule was responding in part to the President's January 2011 Regulatory Review and Reform initiative, removing a significant information collection burden without adversely impacting safety.

Following the implementation of the rule, CTA received numerous calls and inquiries from members asking when California would be implementing the "No-defect" DVIR. In response to the numerous member inquiries, in March CTA formally requested that the California Highway Patrol initiate a rulemaking to bring Title 13 California Code of Regulations into compliance with 49 CFR Parts 392 and 396. CHP responded to CTA's request in April and began to initiate the rulemaking. CTA anticipates that the final rule will be adopted and implemented in California in late summer. In 2008 during a CTA Officers Council meeting the subject of new member recruiting and existing member retention came up as it often does. The Council decided

that it would help the association to have “Hooks” to attract and retain members. These “Hooks” needed to be products and services that CTA could offer to the members that every trucking company needed. The most ideal of products or services would reduce the operating expenses of the members while also creating a revenue source for the Association. From that discussion the “Big Ideas” were conceived. One of those “Big Ideas” was to offer a way to save money on a trucking company’s number one expense “Fuel”. It was also recognized that the small to medium carrier (under 20 trucks) had no purchasing power when it came to fuel.

Petroleum Management Service (PMS) created the California Trucking Association Group Fuel Program aka CTA FUEL to address those needs.

There is more than one way to save money on fuel. The price you pay for fuel is determined by (1) who you buy from (2) where you buy and (3) when you buy.

1. The small trucker usually buys such small amounts of fuel that they do not have pricing power with their vendors. CTA FUEL has addressed that issue by combining the purchases of all the participants together. This creates enough volume that vendors are interested in offering discounts for the businesses. CTA FUEL is currently facilitating the sale of 500,000 gallons of diesel per month. An additional program unique to CTA FUEL is known as the INVITEE program. This allows a company that has bulk fuel in their yard to INVITE other CTA FUEL customers to fuel in their yard. This program is beneficial for all parties involved. The INVITOR (host company) is free to set pricing and can usually realize a profit. When the INVITEE is out of area with

no terminal; it allows the INVITEE company to save money on their on-road fuel purchases.

2. It is no secret that fuel prices can vary widely from location to location & state to state. CTA FUEL has developed a unique fuel optimization program that is accessed via the internet. It allows its users to input a route, like Mapquest, including a starting location and up to four stops. In addition, user customization for company specific metrics or individual trucks needs can be set. CTA Fuel Optimization program will show you all the fuel stops along the route along with their most recent pricing. It will suggest where you should stop for fuel and even how many gallons to take on to get you to the next best price. It includes every fueling stop along your route for your comparison.

3. The fuel market is very volatile. Prices can change by the hour. The United States production capacity is so tight that any disruption in the supply or production can cause immediate swings in prices. The CTA FUEL staff watches the domestic as well as the global energy market and all the indices throughout the day. Any events that are estimated to effect prices both in a positive or negative manner will prompt alerts to our bulk customers to buy now and fill your tanks because prices are going to rise or hold off on purchases as we see prices falling. Our experience has shown price swings of as much as $0.15 up or down per day. That is a savings of over $1000.00 per truckload by timing your purchase. With CTA FUEL you can continue to use your current bulk fuel supplier and for $.01 per gallon CTA FUEL will order for you.

CTA FUEL has a couple of partners in this effort. The California Trucking Association benefits by receiving a royalty for each gallon pumped, sold, or delivered. Fleet One is the

credit vehicle that will evaluate your credit, do the collections, and pays the vendors. Neither the CTA nor CTA FUEL will know your credit information or be privy to your account setup. There is complete confidentiality. CTA FUEL uses online routing software to integrate pricing along routes and bring you the most up to date pricing along routes.

data PointsDiesel Prices Down, Crude Production Up

California on-highway retail diesel prices averaged $3.111 per gallon July 20, down 2 cents from the previous week

and down 98 cents from a year ago, according to the Energy Information Administration. While prices have eased in recent weeks, California still pays 33 cents per gallon more than the national average and 24 cents less than other West Coast states.

In its July 7 Short Term Energy Outlook, EIA said diesel prices are expected to average $2.85 nationwide this year after averaging $3.83 per gallon in 2014. Next year, EIA is projecting the prices to average $3.33 per gallon.

Domestic crude oil production is expected to increase to an average of 9.5 million barrels per day this year, up from an average of 8.7 million barrels per day in 2014.

Freight Index Rises in May

The amount of freight hauled by the for-hire transportation industry rose 0.8% in May from the previous month,

according to the Bureau of Transportation Statistics’ Freight Transportation Services Index released July 9. The index in May was 122.7, up from 121.7 in April of this year.

The index measures month-to-month changes in freight shipments by mode in tons and ton-miles. The May index reflected a large gain in trucking freight, BTS said while there were slight declines in airfreight and rail freight.

The TSI hit an all-time peak in November 2014 and since then has fluctuated up and down, mirroring the economy at large.

Year-Over-Year Value of NAFTA Freight Down in April

The Bureau of Transportation Statistics reported June 25 that the total value of freight between the U.S. and its NAFTA

trading partners Canada and Mexico was down 6.8% in April from the previous year and off 2.8% from March.

Trucks continue to carry the vast majority of NAFTA freight, accounting for 64% of total freight and 70% of surface freight, according to BTS figures.

Average Retail Diesel Prices 6 - Month Trend

A big reason for the decline in value of freight is the drop in prices for mineral fuel shipments carried by pipeline and vessels, with decreases of 44.6% and 22.8% respectively, BTS said.

Freight traded between the U.S. and Canada totaled $8.8 billion in April, down 12.5% from April 2014 while the value of freight moved between the U.S. and Mexico totaled $4.5 billion, up 0.3% from the previous year.
