Clean Water Act Fines – Civil penalties are set on either the amount of oil discharged (up to $1,100-$4,300 per barrel) or the duration of the spill ($37,500 - $140,000 per day).

• Supplemental Environmental Projects (SEPS)-Environmentally beneficial projects which a defendant/respondent agrees to undertake in settlement of an enforcement action, but which the defendant/respondent is not otherwise legally required to perform.

• RESTORE Act - Directs 80% of administrative and civil Clean Water Act penalties from the Deepwater Horizon spill to Gulf Coast Restoration Trust Fund.

Natural Resource Damage Assessment Restoration- The process under the Oil Pollution Act of 1990 through which public officials attempt to return injured natural resources and service to the condition they would have been if the incident had not occurred and compensating for interim losses from the date of the incident until recovery of such natural resources through the restoration, rehabilitation, replacement, or acquisition of equivalent natural resources and/or services.
