Exemption/s Granted

The following application for exemption from the provisions of the Anti-Discrimination Act 1998 (Tas) (the Act) has been granted:

1. Women's Legal Service (Tasmania) Inc – 18/06/012 – Application for an exemption granted under section 57 of the Act for a period of three years.

This exemption has been granted to permit Women's Legal Service (Tasmania) Inc to recruit and employ women only in the identified positions within the organisation for the purposes of:

a) Providing Tasmanian women with legal assistance and advice across many areas of law; and

b) Providing a safe and un-threatening working environment to its clients in particular, women addressing family violence issues accessing these services on a daily basis.

Granted on the 4th day of July 2018.

The exemption is for the period of three years subject to the fulfilment of the conditions that Women's Legal Service (Tasmania) Inc:

(c) on at least one occasion in the 6 months before expiry of this exemption, will undertake a one hour free discrimination information session provided by Equal Opportunity Tasmania. This is to increase awareness of rights and obligations under the Anti-Discrimination Act 1998 (Tas). The participants will include senior/executive management, Board members of Women's Legal Service (Tasmania) Inc.

A person may apply to the Anti-Discrimination Tribunal for a review of the Commissioner’s decision within 28 days from the date of this notice being published.

Rule 11 of the Fisheries (Rock Lobster) Rules 2011

Pursuant to the powers under the Fisheries (Rock Lobster) Rules 2011 ("the Rules") that were delegated to me on 19 August 2015 by the Minister acting pursuant to section 20( 1) of the Living Marine Resources Management Act 1995 ("the Act"), in accordance with rule 11 of the Rules, I hereby determine that:

(1) the dates of the closed seasons for the commercial rock lobster fishery for male rock lobster are as follows:• closed season from 1 September 2018 for the

"September closed region"; and• closed season from 1 October 2018 for all State

waters;(2) the remainder of state waters for the recreational rock

lobster fishery for male rock lobster is closed from 1 September 2018.

where:"September closed region" is defined to mean State waters adjacent to the east, south and west coasts of Tasmania enclosed by an imaginary line starting at the high water mark on the east coast of the mainland of Tasmania at longitude 41° 16' 30" East (St Helens Point), then running due east to the limit of State waters, then running in a clockwise direction at the limit of State waters until that imaginary line meets the line of latitude 41° 29' 0 South off the west coast of Tasmania (3.7NM south of Sandy Cape), then running due east to the high water mark of the mainland of Tasmania and then running in a anticlockwise direction along the high water mark of Tasmania to the starting point of that imaginary line;and where:"western region" is as defined in the Fisheries (Rock Lobster) Rules 2011.

Words and expressions used in this public notice have the same meaning as in the Living Marine Resources Management Act 1995 and the Fisheries (Rock Lobster) Rules 2011.

Pursuant to the powers under section 270 of the Living Marine Resources Management Act 1995 ("the Act") that were delegated to the Director (Marine Resources) on 2 July 2018 by the Minister acting pursuant to section 20( 1) of the Act I make the following order:

1. Short titleThis order may be cited as the Fisheries (Biosecurity) Order 2018 No. 2.

2. SpecificationThis order is made -

(a) in respect of the harmful pest the soft-shell clam Mya japonica; and

(b) to place restrictions on the take and possession of that harmful pest to control and prevent the spread and introduction or re-introduction of Maya japonica into areas of State waters.

3.Directions issued

( 1) That, unless otherwise authorised, a person must not take Mya japonica in State waters.

(2) That, unless otherwise authorised, an unauthorised person must not possess Mya japonica.

4.Interpretation

In this order -

"unauthorised person" means any person who is not an employee of the Department of Primary Industries, Parks, Water and Environment or the Tasmanian Museum and Art Gallery undertaking research or biosecurity activities on the soft shell clam Mya japonica.

GENERAL PURPORT OR EFFECT OF THE ABOVEMENTIONED STATUTORY RULES

(1) Inland Fisheries (Commercial Nets and Fees) Amendment Regulations 2018

These regulations amend the Inland Fisheries (Commercial Nets and Fees) Regulations 2009 by –

(a) prescribing offences under the Inland Fisheries Act 1995 in respect of which infringement notices may be served and the penalties payable in respect of those offences; and

(b) making minor consequential amendments; and

(c) amending the title of the regulations.

INTENTION TO ASSIGN PLACE NAMES NOTICE is hereby given pursuant to section 20F of the Survey Co-ordination Act 1944, that it is the intention of the Nomenclature Board to assign the following place names in Tasmania.

Any objections to the proposed assignments or alterations of the gazetted place names must be lodged with the Secretary of the Nomenclature Board, GPO Box 44, Hobart 7001, or via e-mail to [email protected], within one calendar month from the date of this publication, in accordance with Section 20G of the Act. Any objection shall be in writing, setting out the grounds of the objection. Likewise, written expressions of support are also invited.

Please note: any information that you provide may be subject to disclosure under the Right to Information Act 2009 or as otherwise required by law. If you wish for your objection to be treated as confidential please mark it clearly as ‘confidential’ and provide reasons why you consider the information should remain such. The Board will endeavour to deal with the objection accordingly but this does not make it automatically exempt from disclosure.
