WATER MANAGEMENT ACT 1999

Public Notice of an Application for the Establishment of an Irrigation District under the Water Management Act 1999

Duck Irrigation District

NOTICE is hereby given in accordance with Section 174 of the Water Management Act 1999 that an application has been received under Section 168 for the establishment of the Duck Irrigation District.

The application relates to the establishment of an irrigation district covering part of the Duck catchment and overlapping into parts of the Montagu and Black-Detention catchments. The proposed Duck Irrigation District will be used to provide a secure and reliable supply of irrigation water for the farming district within the Forest, Irishtown, Edith Creek, Mella and Montagu regions utilising water from the Duck River to enhance the economic wealth of the Circular Head

Water Management

Region. Tasmanian Irrigation Pty Ltd is seeking contracts to sell 6,000 ML of irrigation rights to irrigators within the proposed district. Water will be extracted from Duck River and stored in a yet to be constructed dam at Edith Creek. Water will then distributed through the Duck River and picked up at Scotchtown and delivery will be achieved through the pipelines, which will be constructed if the application is approved. Irrigators will access water directly from the pipeline. The proposed Scheme will be managed by Tasmanian Irrigation Pty Ltd.

The application has been made by the Tasmanian Irrigation Pty Ltd, a water entity declared by the Minister under section 166(1)(e) of the Act.

a) report on or before 31 October 2016 to the Anti-Discrimination Commissioner on actions taken in reliance on this exemption; and

Occupational Licensing (Plumbing Exemptions) Order 2015

Section 99 – Exemptions

I, DALE WEBSTER Administrator of Occupational Licensing, make the following Order under section 99 of the Occupational Licensing Act 2005.

1. Short title

This Order may be cited as the Occupational Licensing (Plumbing Exemptions) Order 2016.

2. Commencement

This Order takes effect on 18 May 2016.

3. REVOCATION

The Occupational Licensing (Plumbing Exemptions) Order 2015, which commenced on the 21 October 2015, is revoked.

4. Purpose of the Order

(1) The purpose of the Order is to exempt, under section 99 of the Act, certain –

(a) specified prescribed plumbing work;

(b) persons of specified occupations and classes of prescribed plumbing work; and

(c) specified persons –

from the provisions of the Act.

(2) The exemptions may be made with or without conditions.

5. Interpretation

In this Order, unless the context otherwise requires –

“Act” means the Occupational Licensing Act 2005;

Occupational Licensing

“Administrator” means the person appointed as the Administrator of Occupational Licensing under section 10 of the Act;

“plumbing work” has the meaning prescribed by regulation 3 of the Regulations;

“plumber practitioner” has the meaning given by regulation 3 of the Regulations;

“plumber practitioner (certifier)” has the meaning given by regulation 3 of the Regulations;

“Regulations” means the Occupational Licensing (Plumbing Work) Regulations 2010;

6. Application of Acts Interpretation Act 1931

The Acts Interpretation Act 1931 applies to this Order.

7. Exemption of persons to undertake certain prescribed plumbing work

(1) In this Clause –

“minor tap repairs” do not include the repair of any thermostatic mixing valve, tempering valve, backflow prevention valve, or a non-return valve on a hot water storage heater.

(2) In accordance with section 99(1)(b) of the Act, I exempt from the requirement to be licensed under section 22(1) of the Act, persons who undertake the following prescribed plumbing work–

(a) the repair or replacement of tap washers and other minor tap repairs by the owner of a dwelling; or

(b) the replacement of a shower head in a dwelling, with a shower head with a minimum 3 star water rating under the Water Efficiency Labeling Standards (WELS) Scheme.

(3) Despite sub-clause (2) above, persons who carry out plumbing work under this exemption must, nevertheless, undertake the work in accordance with the standards for plumbing work prescribed by the Building Act 2000.

8. Exemption of persons of a specified occupation and class

In accordance with section 99(1)(a) of the Act, I exempt from the provisions of the Act sheetmetal work undertaken by sheetmetal tradespersons, where the work is carried out in connection with the manufacture, installation, maintenance or repair of ventilation or air conditioning plant or equipment.

9. Exemption of specified persons

(1) In accordance with section 99(1)(a) of the Act, I exempt persons assisting plumber practitioners and plumber practitioner (certifiers), who perform work in association with prescribed plumbing work, from the provisions of section 22(1) the Act.

(2) This exemption applies only if the persons assisting the plumber practitioners and plumber practitioner (certifiers) are supervised at a level commensurate with their knowledge, skills and experience in accordance with the Occupational Licensing (Supervision of Prescribed Work) Code of Practice 2010, as amended from time to time.

10. Exemption of persons to undertake the servicing and maintenance of Domestic On-Site Waste Water Management Systems

(1) In accordance with section 99(1)(a) of the Act, I exempt persons undertaking the servicing and maintenance of

Domestic On-Site Waste Water Management Systems from the requirement to be licensed under section 22(1) of the Act.

(2) This exemption only applies if persons performing the servicing and maintenance are -

(a) working under the control and management of a licensed plumber contractor, whose nominated manager holds a Plumber Practitioner (Certifier) Drainage class licence with the Domestic On-Site Waste Water Management Systems Maintenance endorsement; and

(b) have successfully completed the manufacturer’s or Administrator’s training requirements for the servicing and maintenance of those systems; and

GENERAL PURPORT OR EFFECT OF THE ABOVEMENTIONED STATUTORY RULES

(1) Local Government (Rates and Charges Remissions) Amendment Regulations 2016These regulations amend the definitions of “totally” and “permanently incapacitated person”, “war widow” and “war widower” in the Local Government (Rates and Charges Remissions) Regulations 2014 and thereby amend the meaning of the definition of “eligible pensioner” for the purposes of the Local Government (Rates and Charges Remissions) Act 1991.

(2) Vehicle and Traffic (Offence Detection Devices) Amendment Regulations 2016

These regulations amend the Vehicle and Traffic (Offence Detection Devices) Regulations 2012 by –

(a) clarifying who may test certain devices in accordance with those regulations; and(b) removing a provision that prevented a photograph, taken by a photographic detection device, from being admissible

as evidence in certain circumstances.
