    Buying a brand-new home offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future but dont forget, its also legal transaction.

    The term get it in writing has never been more important in the case of the new-home purchase, since such a document outlines everything your home will have in it, on it and around it. Your Agreement of Purchase and Sale spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, its impossible to prove what was agreed upon.

    Since building a home is much more complicated than a resale transaction where the unit and/or property likely already exists, there is no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders association or their new-home warranty program. Builders often prepare their own agreements, so contracts can vary from one builder/developer to another and from province to province.

    Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality.

    When buying a new home, many peoples vision involves an expansive property in an excellent location and at a great price within easy reach of all the amenities you need and where you work.

    If youre lucky, you can achieve all of this right off the bat. More likely, as prices rise and selection is increasingly determined by availability and aff ordability, you may need to compromise. Instead of a detached home in your number one neighbourhood, you fi nd yourself looking at a semi. If a townhome is not quite within reach in your fi rst area of choice, you may be considering a condo.

    But, builders and realtors alike say you should think about resale when you select the inclusions, design elements and decor basics of your new home. It may be your brand new home now, but one day you may choose to sell and thats when your personal tastes could affect the resale value of your home.

    Consider these insights from the recent Canadian Home Critics Survey from realty firm Century 21:

    DECORIn Quebec, for example, 20 per cent of homebuyers (the highest in Canada) dislike decor full of the owners personal

    touches. Buyers in Ontario rank dated flooring as one of their top decor turn-offs. In Alberta, 28 per cent (the highest in the country) say updated finishings such as counters, flooring and mouldings are added features that would persuade them to buy.

    ENERGY EFFICIENCYCanadians overwhelmingly would select a home due to energy efficiency upgrades (41 per cent) over updated finishings such as granite counters or hardwood floors (22 per cent). In Atlantic Canada, 59 per cent rated energy upgrades as the top feature that would persuade them to buy, the highest percentage in Canada. In BC, residents overwhelmingly say energy efficiency upgrades are the number one additional feature that would persuade them to buy a home (41 per cent).

    CLEAN, MODERN LOOKSOntarians rank dated flooring as the number two home decor turn-off. The number one way to turn off Ontario homebuyers is to not clean the house well (57 per cent), while 18 per cent say old furniture taints their first impression of a home. If a home has old flooring, it better be sparkling; uncleanliness tops Canadian homebuyers turn-off list (60 per cent), followed by dated flooring (40 per cent) and bold paint colours (18 per cent).

    SECURING THE BEST MORTGAGE

    for your first home

    Securing your first mortgage is truly one of lifes milestones. Being able to carry a six-figure loan indicates that you have achieved well-regarded levels of prosperity and responsibility.

    Before you apply for a mortgage, there are a number of measures that first-time and seasoned buyers alike can take to ensure they qualify for the best mortgage possible. Reducing your mortgage rate by just one per cent can save you thousands of dollars over the life of your mortgage.

    The primary focus for prospective buyers should be to exhibit an ability to manage your personal finances. Lenders look at your debt-to-income (DTI) ratio to determine how much you can afford to borrow. This ratio is calculated by dividing your monthly gross income by the amount you use to pay off debts such as auto loans, student loans and credit card balances each month.

    Your ability to manage debt and credit plays a major part in determining what rate a lender is willing to give you or if you even receive a mortgage at all. Lending institutions rely on your credit score a three-digit number that reflects the history of how youve paid your bills, how much open credit you have and anything else that would affect your creditworthiness.

    You should never apply for a mortgage without first getting your credit reports. The primary reason is to ensure there arent any errors or discrepancies. Errors on your file can force you to pay a higher interest rate on your mortgage and in some cases even torpedo your chances of getting a loan altogether. You could discover accounts that arent even yours, or collection accounts for debts you no longer owe.

    Once youve confirmed the accuracy

    of your credit report, you can begin to take steps to improve your credit score in the months leading up to your purchase.

    Thirty-five per cent of your score is determined by your payment history. Consistently being late on your credit card payments will significantly hurt your rating. Do your best to keep the balance on your credit cards under a quarter of the total line of credit. At the very least, pay your credit card bills on time to preserve a respectable score. If possible, pay off the balance entirely and promptly, even if it means using some of your money for the down payment.

    The second most important part of your credit score is your level of debt. You should look to pay down student or car loans that may be keeping your score low. Mortgage advisors encourage first-time buyers to limit their major purchases on credit until after theyve secured their mortgage. You might want to push back that new car until after youve bought your first home! As a first-time homebuyer, extending your unsecured credit to the maximum by buying one or more new cars before you get your first mortgage will almost always force you to remain a renter, and have you paying someone elses mortgage for years to come.

    Dont apply for more credit than you need. Too many open or unused accounts can hurt your chances of getting a mortgage. They can also be a major temptation to live beyond your means. Whatever you charge or borrow must eventually be repaid. Dont dig yourself into a deep financial hole.

    Many young professionals whove been renting or living with parents dont have much of a credit history. If this is this case, it might be a good idea to have one or more of your utilities in your own name. While just having your name on an electric or gas bill, telephone, cable or water service wont establish a credit score, it can still be helpful for a first-time borrower.

    The best thing you can do is to get a credit card and use it with the utmost prudence. Simply using it in place of money you actually have on hand, then using that cash to make your monthly payments can go a long way to helping you establish good credit history. It takes time and there are really no shortcuts or tricks that can take you from bad credit or no credit at all to a high score in a matter of months or even a few years. While it is important to initially establish credit, it is even more important to take the time to do the right things to maintain good credit.

    Securing a good mortgage doesnt have to be burdensome or disheartening. If you take the necessary steps to tidy up your financial affairs, you will find all aspects of homeownership, not just your mortgage, to be rewarding.

    All warranties come with limitations and rules, and your new homes warranty is no exception. The purpose of the warranty is to provide homeown-ers with protection against defective workmanship and materials. But if you make significant changes to your home through renovations or repairs, you may be forfeiting your warranty rights.

    The scenario usually goes something like this: A homeowner notices an issue with his new home and submits a statutory warranty form. Not wanting to wait the 120-day builder repair period, the homeowner completes the repairs. However, any alterations, deletions or additions made by the homeowner are excluded from your warranty, and Tarion cannot cover such defects.

    In addition to performing their own renovations or repairs, there are a few ways homeowners can forfeit their warranty rights, such as failing to properly maintain their home and not submitting their forms on time. These are the most common ways to jeopardize your warranty rights.

    WAIT TO MAKE RENOVATIONSMost homeowners cant wait to put their mark on their new home by decorating and renovating. Before making any renovations to a new home, read your Agreement of Purchase and Sale.

    Builders often include a clause that states you should not finish your basement within the first two years of possession when you should be watching for foundation cracks or water leaks. If there is water penetration, unless the builder finished the basement, theyre not responsible for the damage.

    If renovations damage an item under warranty, the item will no longer be

    covered for example, if you install pot lights and the alterations cause issues with the electricity.

    JEOPARDIZING YOUR WARRANTYHealth and safety concerns can cause panic in any homeowner. This can include issues with heating, plumbing, electricity and your water supply. Homeowners often feel they must take matters into their own hands if the situation is urgent.

    This could involve calling a plumber or electrician to get an immediate repair. However, you may forfeit your warranty if you hire a contractor to fix a system that is under warranty. Once the repair is complete, your builder may not be able to assess if the issue was caused by a defect in construction or installation both warrantable.

    Both your builder and Tarion have emergency contact information and procedures in place to handle these situations, and Tarion has technical representatives available.

    So, before you attempt to fix the issue yourself, contact your builders emergency number and then Tarion. Only if you cannot reach your builder or Tarion should the emergency condition be corrected.

    Homeowners should obtain a detailed written report of the problem, and an invoice that sets out the repair methods used by the contractor, as soon as possible after completing the repair. In these cases, limit the repair to the emergency condition and not subsequent damage that may have been caused.

    MAINTAIN YOUR HOMEOwning a new home comes with a responsibility to manage and maintain it. By conducting regular and proper mainte-nance, you will help to ensure that your statutory warranty rights are protected. Your Homeowner Information Package, provided by your builder and available on Tarions website, includes a complete home maintenance checklist that can ensure your home stays healthy.
