Electronic copies of the letting proposals and plans areavailable on the KDOT website at http://www.ksdot.org/burconsmain/contracts/proposal.asp. The website will al-low the contractor to request approval from KDOT to bidas a prime contractor and be included on the ‘‘Bid Hold-ers List,’’ or to be included on the ‘‘Non-Bid Holders List’’as a subcontractor/supplier. KDOT’s approval is requiredto bid as a prime contractor. To bid as a prime contractor,KDOT needs to be notified of the intent to bid not laterthan the close of business on the Monday preceding thescheduled letting date. Failure to obtain prior approvalto bid as a prime contractor on any projects listed belowwill be reason to reject the bid. The secretary of transpor-tation reserves the right to reject bids that do not complywith all requirements for preparing a bidding proposalas specified in the 2007 edition of the Kansas Departmentof Transportation Standard Specifications for State Road andBridge Construction.

KDOT will only accept electronic proposals using the BidExpress website at http://www.bidx.com until 1 p.m. localtime September 17, 2014. KDOT will open and read theseproposals at the Eisenhower State Office Building, 700 S.W.Harrison, Topeka, at 1:30 p.m. local time September 17,2014. Each bidder shall certify that such person, firm, asso-ciation or corporation has not, either directly or indi-rectly, entered into any agreement, participated in anycollusion, or otherwise taken any action in restraint of freecompetitive bidding in connection with the submittedbid. The Kansas Department of Transportation requests com-ments on the amendment of the Statewide TransportationImprovement Program (STIP) FY 14-17. In accordance with Kansas Administrative Regulations28-16-57 through 63, 28-18-1 through 17, 28-18a-1 through33, 28-16-150 through 154, 28-46-7, and the authorityvested with the state by the administrator of the U.S. En-vironmental Protection Agency, various draft water pol-lution control documents (permits, notices to revoke andreissue, notices to terminate) have been prepared and/orpermit applications have been received for discharges towaters of the United States and the state of Kansas for theclass of discharges described below.

The power station isdesigned to maximize water reuse resulting in zero wastewater dis-charge. Pursuant to the provisions of K.S.A. 2-2117, a hearingwill be conducted at 10 a.m. Thursday, September 25, inRoom 124, Kansas Department of Agriculture, 1320 Re-search Park Drive, Manhattan, in the matter of the issu-ance of a permanent quarantine regarding the emeraldash borer (Agrilus planipennis [Coleoptera: Buprestidae]).The proposed quarantine would affect LeavenworthCounty, Johnson County and Wyandotte County, Kan-sas. The quarantine would prohibit movement of regu-lated items from the quarantined areas, except under spe-cific conditions.

Regulated items under quarantine would include thefollowing:

• The emerald ash borer (Agrilus planipennis[Coleoptera: Buprestidae]), in any living stage ofdevelopment;

• Firewood of all hardwood (nonconiferous) species;• Nursery stock of the genus Fraxinus (Ash);• Green lumber of the genus Fraxinus (Ash);• Other material living, dead, cut or fallen, including

logs, stumps, roots, branches, and composted anduncomposted chips of the genus Fraxinus (Ash);

• Any other article, product or means of conveyancethat an inspector determines presents a risk ofspreading emerald ash borer and notifies the personin possession of the article, product or means ofconveyance that it is subject to the restrictions of theregulations.

In addition, the quarantine would require anyone whodiscovers emerald ash borer in an area not currently un-der quarantine to report the discovery to the Kansas De-partment of Agriculture within 72 hours.

All HCBS waivers, both thosesupporting people with disabilities and the SED waiver,are reflected in Attachment J as a result of this revision,and most measures are global across all waivers for con-sistency and comparability. As well, the Statewide Qual-ity Strategy (SQS) will be amended to include further de-veloped detail and updates on the Pay for Performance(P4P) measures, as defined in the KanCare contracts thestate holds with the managed care organizations (MCOs).All additional performance measures, such as physicalhealth measures, have been revisited to ensure they arecurrent and functional.

KDADS estimates that expenditures of $11,000 fromthe State General Fund would be incurred for start-upcosts to make necessary changes to the agency’s registra-tion software. The agency would then use registration feerevenue to finance ongoing administrative expendituresfor production and processing of applications, processingapprovals for continuing education requirements, andmaintenance of the registry. The biennial registration feeis $65.00 per person. The agency estimates 500 individu-als will register in each two-year registration period, re-sulting in a total amount of $32,500 for a two-year period.

In addition to KDADS, the Department of Administra-tion, the Attorney General, the Kansas Legislature(through the Joint Committee on Rules and Regulationsand the Legislative Research Department) and the Sec-retary of State shall bear the costs associated with theadoption of these regulations.

Operators will be required to submit an application feeof $65.00 biennially. The regulations require registeredoperators receive 30 hours of continuing professional ed-ucation for each two-year registration period. The cost ofobtaining these hours will be borne by the individual op-

erator or the employing facility. Continuing educationcosts are estimated at $15.00 per hour for a total of $225.00per operator per year. There is no economic impact to thegeneral public.

A list of the proposed regulations and a brief summaryfollows:

K.A.R. 26-39-500. Definitions. This regulation definesthe terms referenced in this set of regulations including:accredited college or university, clock-hour, continuingeducation, core of knowledge, disciplinary action, do-mains of practice, in-service education, long term careprovider organization, registration, relevant experience,relevant field, sponsor, and sponsorship.

K.A.R. 26-39-501. Registration. This regulation out-lines the requirements an applicant must meet prior toregistering as an operator as determined in the statute.Applicants must submit appropriate applications withfees, be at least 21 years of age, have a high school di-ploma or equivalent with one year of relevant experience,have an associate’s degree in a related field or a bachelor’sdegree, and have successfully completed an operatorcourse as specified in 26-39-503.

K.A.R. 26-39-502. Application for registration. Thisregulation outlines the requisite components of an appli-cation to become a registered operator. The applicantmust provide a high school diploma or equivalent, aca-demic transcripts, or evidence of relevant work experi-ence. Applicants who have received their academic train-ing outside the United States shall obtain an equivalencyvalidation from an approved entity that specializes in ed-ucational credential evaluations. Applicants must pro-vide all necessary records, affidavits, or other documentsrelated to any adverse information received throughcriminal history records, or other disciplinary actionstaken against them. Any applicant who has been subjectto such action has the burden of proof that the applicanthas been rehabilitated and warrants the public trust.

K.A.R. 26-39-503. Operator course. This regulation out-lines the process and criteria for approving and disap-proving operator courses for the purpose of registeringoperators. The requirements identify which entities mayprovide the course, basic requirements for course instruc-tors, course content, course length, testing protocols, andsets the passing score of the test at 80 percent. An indi-vidual who fails the exam may take the exam one addi-tional time. An individual who fails the exam a secondtime must retake the course prior to challenging the examagain.

K.A.R. 26-39-504. Registration renewal and reinstate-ment; continuing education. This regulation outlines theprocesses for normal registration renewal, late renewal,and reinstatement of the credential when the credentialhas lapsed for failure to renew. Renewal requirementsinclude timely submission of renewal application, andcompletion of 30 hours of continuing professional edu-cation with content specified by the department. The reg-ulation provides an auditing process for verification ofapplicants’ continuing education and describes the ele-ments required for sponsors of continuing education tohave their offerings approved for use toward the renewalof an operator’s registration. Applicants may file a late

Operators who fail to renew within thefinal date of the late renewal window will have a regis-tration that is lapsed for failure to renew. Applicantswhose registration is lapsed no longer than 24 monthsmay complete application and 30 hours of continuing ed-ucation to have their registration reinstated. Applicantswhose registration lapses longer than 24 months must re-take the approved operator course and pass the exami-nation to be reinstated.

K.A.R. 26-39-505. Fees. This regulation sets the fee forregistration at $65.00 for a two-year period, and proratedfor periods less than two years. Late renewal fee of $35.00will be applied to applications completed within 30 daysfrom the expiration of the registration. An additional feeof $65.00 will be assessed an operator renewing after hav-ing a lapsed or revoked registration.

K.A.R. 26-39-506. Change of name or address. Thisregulation requires operators to provide notice of nameor address change to the department within 30 days ofthe change.

K.A.R. 82-11-1. This existing regulation defines the keyterms used in Article 11 – Natural Gas Pipeline Safety.The proposed amendments clarified the definition of‘‘yard line’’ to end at the outside wall of a residentialpremise that is individually metered. This edit was nec-essary to permit utility companies to supervise the repairsor replacement of natural gas lines, specifically ‘‘yardlines,’’ which run between the main and to the outer wallof a residence. This amendment also permits the utilitycompany to recover the expenses in accordance with thecompany’s tariffs.

The commission does not anticipate an economic im-pact resulting from the adoption of this proposed regu-lation.

K.A.R. 82-11-4. This existing regulation adopts the fed-eral minimum safety standards for the transportation ofliquid and gas pipeline operations. The amendments forthis regulation include updating the regulation to becomecurrent with the federal 2013 version of the rules. Also,the proposed amendments edit the requirement for a util-ity company to make immediate repairs of all class 1 leaksor to continue efforts until a resolution has been reachedand the hazard has passed. The edit removes the formerfive-day repair requirement.

The commission does not anticipate an economic im-pact resulting from the adoption of this proposed regu-lation.

K.A.R. 82-11-11. The proposed amendments to this ex-isting regulation simplify the former fee schedule thatgoverns the collection of fees for the inspections and su-pervision of standards of safety as required by the FederalNatural Gas Pipeline Safety Act of 1968 (49 U.S.C. § 60101et seq.). The new version no longer contains outdated as-sessment information for the years of 1998 through thecurrent year.

The commission does not anticipate an economic im-pact resulting from the adoption of this proposed regu-lation.

The following is a brief summary of the proposed reg-ulation:

K.A.R. 51-9-7. Fees for medical and hospital services.The proposed change to this regulation is made in ac-cordance with K.S.A. 44-510i(c)(2), which requires theschedule of maximum fees to be revised as necessary atleast every two years by the director of workers compen-sation to assure that the schedule is current, reasonableand fair. The fee schedule establishes the maximum feesfor medical, surgical, hospital, dental, nursing, vocationalrehabilitation or any other treatment or services providedor ordered by health care providers and rendered to em-ployees under the Workers Compensation Act.

The following is a brief summary of the economic im-pact:

K.S.A. 44-510i requires the director of workers com-pensation to adopt rules and regulations to establish aschedule of maximum medical fees, and to revise theschedule at least every two years to ensure that it is cur-rent, reasonable and fair. The National Council on Com-

pensation Insurance, Inc., predicts that the January 1,2015, ‘‘Schedule of Medical Fees’’ will result in an overalldecrease on workers compensation system costs of -$2million or a 0.5 percent decrease. This amendment willhave no economic impact on the Division of WorkersCompensation or Kansas Department of Labor in termsof administering the schedule of fees under the WorkersCompensation Act.

Similarly, there will be no economic impact on the Kan-sas Insurance Department, consumers, small businessesor other governmental agencies.
