Notice of Hearing

A public hearing will be conducted at 9 a.m. Thursday,March 13, in the offices of the Kansas Development Fi-nance Authority, 555 S. Kansas Ave., Suite 202, Topeka,on the proposal for the Kansas Development Finance Au-thority to issue its Agricultural Development RevenueBond for the project numbered below in the respectivemaximum principal amount. The bond will be issued toassist the respective borrower named below (who will bethe owner and operator of the project) to finance the costin the amount of the bond of acquiring the project or forthe purpose of refunding a bond previously issued to fi-nance the project. The project shall be located as shown:

Project No. 000559—Maximum Principal Amount:$73,000. Owner/Operator: Luke P. Pfizenmaier. Descrip-tion: Acquisition of 80 acres of agricultural land and re-lated improvements and equipment to be used by theowner/operator for farming purposes. The project is lo-cated at Section 17, Blaine Township, Clay County, Kan-sas, approximately 5 miles west of Clay Center on Hwy.24 and 1 mile south on Hackberry Road.

The bond, when issued, will be a limited obligation ofthe Kansas Development Finance Authority and will not

constitute a general obligation or indebtedness of theState of Kansas or any political subdivision thereof, in-cluding the Authority, nor will it be an indebtedness forwhich the faith and credit and taxing powers of the Stateof Kansas are pledged. The bond will be payable solelyfrom amounts received from the respective borrower, theobligation of which will be sufficient to pay the principalof, interest and redemption premium, if any, on the bondwhen it becomes due.

All individuals who appear at the hearing will be givenan opportunity to express their views, and all writtencomments previously filed with the Authority at its of-fices at 555 S. Kansas Ave., Suite 202, Topeka, 66603, willbe considered. Additional information regarding the pro-ject may be obtained by contacting the Authority.

Any individual affected by the above-described projectmay, at or prior to the hearing, file a written request withthe Authority that a local hearing be held on the proposalto issue a bond to finance said project. A local hearing, ifrequested, would be conducted in the county where theproject in question is located.

Negotiations for Architectural Services

Notice is hereby given of the commencement of nego-tiations for architectural services for a new greenhouselaboratory at the Kansas State University Agricultural Re-search Center in Hays. The project features the design andconstruction of a 14,000 gsf greenhouse, laboratory andhead house facility. The new facility will support five pro-grams: wheat breeding, sorghum breeding, entomology,plant disease resistance and weed control. The laboratory/head house will feature three labs, support spaces andgrowth chambers for various plant materials.

The Kansas Department of Health and Environmenthas reviewed an application from The Tire Cutters, Inc.to establish and operate a new waste tire monofill (a land-fill exclusively for processed waste tires). The proposedmonofill site is located in the Southeast Quarter of Section18, Township 5 South, Range 12 East in Nemaha County.From the City of Corning, the proposed facility will belocated 3 miles south on Highway 63, then 4-1/8 mileseast on the county road, then north on property ownedby Donald Bonjour. The proposed landfill will cover ap-proximately 13 acres on the 585-acre property, which iscurrently undeveloped.

In 2002, a permit was issued to Tire Cutters to operatea waste tire processing facility at the proposed monofillsite. The proposed monofill is designed with approxi-mately 491,200 cubic yards of capacity for processedwaste tires and intermediate cover material. Based on anestimated daily average disposal rate of 40 cubic yards,the period of active monofill operation is projected to beapproximately 47 years. The monofill is proposed to par-tially fill-in two existing ravines. The bottom of the mon-ofill is proposed at the existing surface of the ground inthe bottom of the ravines, at elevations ranging from ap-proximately 1,275 feet to 1,330 feet, with approximately85 feet to 100 feet of lateral excavation in each directionfrom the centerline of the ravine bottom. The completedsurface of the monofill (including the final cover) is pro-posed at elevations ranging from approximately 1,280feet to 1,340 feet, representing fill depths of approxi-mately 5 feet to 25 feet, and resulting in broad trapezoidaldrainage ways in place of the current V-shaped ravinebottoms. The final cover on the monofill is proposed toconsist of at least 30 inches of soil with native grassesestablished on the surface.

Nemaha County has certified that the application de-scribed herein is consistent with the local solid wastemanagement plan and compatible with the surroundingland use. KDHE has reviewed the application and foundit to be in conformance with the state solid waste statutesand regulations.

KDHE is providing public notice of its intent to issuea permit to Tire Cutters for the proposed monofill de-scribed herein. A copy of the administrative record,which includes the permit application, engineering draw-ings, draft permit and other information with respect tothis permit action, will be available for public reviewMarch 3-April 25, during normal business hours, at thefollowing locations:

Article 4.—OCCUPATION ANDCONCESSIONAIRE LICENSES

112-4-1a. Concessionaire licenses. (a) No organi-zation licensee or facility manager licensee shall permitany entity not owned and operated by that licensee to sellgoods or services within a racetrack facility where thatlicensee conducts race meetings unless the entity has beenissued a concessionaire license by the commission pur-suant to K.S.A. 74-8817 and amendments thereto.

(b) Before providing or selling any of the followinggoods or services within a racetrack facility, each personshall pay the required fee and secure the appropriate li-cense or licenses from the commission:

(1) Hay;(2) feed;(3) tack;(4) sawdust;(5) bedding;(6) horse walkers;(7) massage therapy;(8) horseshoes;(9) veterinarian services;(10) physical examinations by a physician;(11) win photos;(12) videos;(13) tip sheets;(14) food;(15) beverage machines and snack or cigarette ma-

chines;(16) amusement and entertainment devices or ma-

chines; or(17) any other goods or services.(c) Each applicant shall apply for the license in the fol-

lowing category that best fits the services or goods thatthe applicant is providing:

(1) Each applicant who proposes to have an annual on-track sales revenue for goods or services totalling$100,000 or more at a non-county fair race meet shall ap-ply for a class 1 concessionaire license.

(2) Each applicant who proposes to have an annual on-track sales revenue for goods or services totalling lessthan $100,000 at a non-county fair race meet shall applyfor a class 2 concessionaire license.

(3) Each applicant who proposes to sell goods or serv-ices at a county fair association race meeting that is heldfor a total of not more than 21 race days per calendar yearshall apply for a class 3 concessionaire license.

(4) Each applicant who proposes to provide any coin-operated device that dispenses goods, entertainment, oramusement shall apply for a class 4 concessionaire li-cense.

(5) Each applicant who proposes to provide any pro-fessional service or service requiring special training shallapply for a class 5 concessionaire license. This license cat-

egory shall include physicians, veterinarians, masseuses,and farriers.

(6) Each applicant who proposes to sell goods or serv-ices for an event that lasts three days or less shall applyfor a class 6 concessionaire license.

(d) The organization licensee or facility manager li-censee shall notify the commission of all entities provid-ing goods and services to third parties at the racetrackfacility and shall be subject to the penalties provided inK.A.R. 112-3-17 for failure to notify the commission.

(e) Each applicant shall complete a concessionaire li-cense application form furnished by the commission,which shall include the following:

(1) The applicant’s name, address, and telephone num-ber;

(2) Kansas tax identification number;(3) federal tax identification number;(4) the name of each individual employed by applicant

and working at the racetrack facility;(5) proof of workers compensation if liable under the

workers compensation act in Kansas; and(6) the name, address, and telephone number of each

partner, owner, officer, director, board member, policy-making manager, and any other person or entity havingcontrol or a voting interest in the business of the appli-cant, and the percentage of voting interest for each personor entity.

(f) Each applicant may be required to provide, on aquarterly basis, a financial report of on-track sales reve-nue.

(g) The applicant shall not knowingly provide false in-formation on any concessionaire application or fail to dis-close any material fact on the concessionaire applicationform.

(h) Each applicant shall obtain and provide, with theapplication, written authorization from the organizationlicensee or facility manager licensee to sell goods or serv-ices at the racetrack facility.

(i) Each owner, officer, board member, or other entitywith a voting interest or ownership of three percent ormore may be required to submit to a background inves-tigation to be conducted by either of the following:

(1) The commission’s director of security or the direc-tor’s designee; or

(2) the Kansas bureau of investigation.(j) Each applicant for a concessionaire license shall pay

the appropriate application and license fees as designatedby the commission.

(k) Each applicant shall pay any additional fees forbackground and fingerprint processing, as needed to paythe actual, reasonable expenses of processing the appli-cation and investigating the applicant’s qualifications forlicensure.

(l) Each applicant for a concessionaire license may berequired to provide copies of income tax returns for eachof the five years immediately preceding the applicationor all tax returns if the applicant has been organized forfewer than five years.

(m) The applicant shall not sell goods or services at theracetrack facility before being licensed by the commis-sion.

(n) Each licensee or applicant for a license shall reportimmediately and in writing any change in license or ap-plication information to the commission.

(o) A licensed concessionaire may be permitted to sellveterinary prescription drugs or medications if the indi-vidual meets the following criteria:

(1) Is registered pursuant to K.S.A. 65-1601 et seq., andamendments thereto;

(2) has a valid written prescription from a licensed vet-erinarian for each prescription drug or medication; and

(3) maintains a copy of each written prescription forinspection purposes.

(p) Before the expiration of a concessionaire license,the concessionaire licensee may apply to the commissionfor renewal of this license on a form furnished by thecommission. The renewal shall be granted by the com-mission if the licensee meets all of the qualifications re-quired for an initial license. A fee may be charged by thecommission for processing the renewal application. Thisfee shall not exceed the application fee authorized for aninitial license. 112-4-1b. Racing or wagering equipment or serv-ices. (a) No organization licensee or facility manager li-censee shall permit any business not owned and operatedby that licensee to provide integral racing or wageringequipment or services, as designated in subsection (b), tothat licensee unless the business has been issued a racingor wagering equipment or services license by the com-mission pursuant to K.S.A. 74-8837 and amendmentsthereto.

(b) ‘‘Integral racing and wagering equipment andservices’’ shall mean those services and equipment thatare provided on-site at the racetrack facility. This termshall include the following:

(1) Tote services;(2) tote boards;(3) photo finish;(4) video replay;(5) video reception;(6) transmission services and equipment;(7) starting gate; and(8) lure.(c) Before providing integral racing or wagering

equipment or services at a racetrack facility, each individ-ual or entity shall pay the required fee and secure theappropriate license or licenses from the commission.

(d) The organization licensee and facility manager li-censee shall notify the commission of all racing or wa-gering equipment or services being provided at the race-track facility pursuant to K.A.R. 112-3-17.

(e) Each applicant shall complete a racing or wageringequipment or services application form furnished by thecommission, which shall include the following:

(1) The applicant’s name, address, and telephone num-ber;

(2) the names of all individuals employed by the ap-plicant and working at the racetrack facility;

(3) proof of workers compensation if liable under theworkers compensation act in Kansas; and

(4) the name, address, and telephone number of eachpartner, owner, officer, director, board member, policy-making manager, and any other person or entity havingcontrol or a voting interest in the business of the appli-cant, and the percentage of voting interest for each personor entity.

(f) The applicant shall not knowingly provide false in-formation on any racing and wagering equipment orservices application or fail to disclose any material facton the racing and wagering equipment or services appli-cation.

(g) Each applicant shall provide a copy of the contractentered into with the facility manager licensee or organ-ization licensee, or both.

(h) Each partner, owner, officer, director, board mem-ber, policy-making manager, or other entity with a votinginterest or ownership of three percent or more may berequired to submit to a background investigation to beconducted by either of the following:

(1) The commission’s director of security or the direc-tor’s designee; or

(2) the Kansas bureau of investigation.(i) Each applicant for a racing or wagering equipment

or services license shall pay the appropriate applicationand license fees as designated by the commission.

(j) Each applicant shall pay any additional fees forbackground and fingerprint processing, as required topay the actual, reasonable expenses of processing the ap-plication and investigating the applicant’s qualificationsfor licensure.

The renewal shall be grantedby the commission if the licensee meets all of the quali-fications required for an initial license. A fee may becharged by the commission for processing the renewalapplications. This fee shall not exceed the application feeauthorized for an initial license. Article 9.—PARIMUTUEL WAGERING

112-9-44. Place pick (N) pools. (a) The place pick(N) shall require selection of the first-place or second-place finisher in each of a designated number of contests.Each licensee shall secure written approval from the com-mission concerning the scheduling of place pick (N) con-tests, the designation of one of the methods stated in sub-section (b) of this regulation, the distinctive nameidentifying the pool, and the amount of any cap to be seton the carryover pool. Each change to the approved place

pick (N) format shall be approved by the commission be-fore that change is implemented.

(b) Each place pick (N) pool shall be apportioned usingone of the following methods:

(1) For a place pick (N) with carryover pool, each netplace pick (N) pool and carryover pool, if any, shall bedistributed as a single-price pool to those who select thefirst-place or second-place finisher in each of the placepick (N) contests, based upon the official order of finish.If there are no such wagers, then a designated percentageof the net pool shall be distributed as a single-price poolto those who select the first-place or second-place finisherin the greatest number of place pick (N) contests, and theremainder shall be added to the carryover pool.

(2) For a place pick (N) with a minor pool and a carry-over pool, the major share of the net place pick (N) pooland the carryover pool, if any, shall be distributed tothose who select the first-place or second-place finisherin each of the place pick (N) contests, based upon theofficial order of finish. The minor share of the net placepick (N) pool shall be distributed to those who select thefirst-place or second-place finisher in the second greatestnumber of place pick (N) contests, based upon the officialorder of finish. If there are no wagers selecting the first-place or second-place finisher of all place pick (N) con-tests, the minor share of the net place pick (N) pool shallbe distributed as a single-price pool to those who selectthe first-place or second-place finisher in the greatestnumber of place pick (N) contests, and the major shareshall be added to the carryover pool.

(3) For the place pick (N) with no minor pool and nocarryover pool, each net place pick (N) pool shall be dis-tributed as a single-price pool to those who select the first-place or second-place finisher in the greatest number ofplace pick (N) contests, based upon the official order offinish. If there are no winning wagers, the pool shall berefunded.

(4) For a place pick (N) with a minor pool and no carry-over pool, the major share of the net place pick (N) poolshall be distributed to those who select the first-place orsecond-place finisher in the greatest number of place pick(N) contests, based upon the official order of finish. Theminor share of the net place pick (N) pool shall be dis-tributed to those who select the first-place or second-placefinisher in the second greatest number of place pick (N)contests, based upon the official order of finish. If thereare no wagers selecting the first-place or second-place fin-isher in a second greatest number of place pick (N) con-tests, the minor share of the net place pick (N) pool shallbe combined with the major share for distribution as asingle-price pool to those who select the first-place or sec-ond-place finisher in the greatest number of place pick(N) contests. If the greatest number of first-place or sec-ond-place finishers selected is one, the major and minorshares shall be combined for distribution as a single-pricepool. If there are no winning wagers, the pool shall berefunded.

(5) For a place pick (N) with a minor pool and no carry-over pool, the major share of the net place pick (N) poolshall be distributed to those who select the first-place orsecond-place finisher in each of the place pick (N) con-tests, based upon the official order of finish. The minor

share of the net place pick (N) pool shall be distributedto those who select the first-place or second-place finisherin the second greatest number of place pick (N) contests,based upon the official order of finish. If there are nowagers selecting the first-place or second-place finisherin all place pick (N) contests, the entire net place pick (N)pool shall be distributed as a single-price pool to thosewho select the first-place or second-place finisher in thegreatest number of place pick (N) contests. If there are nowagers selecting the first-place or second-place finisherin a second greatest number of place pick (N) contests,the minor share of the net place pick (N) pool shall becombined with the major share for distribution as a sin-gle-price pool to those who select the first-place or sec-ond-place finisher in each of the place pick (N) contests.If there are no winning wagers, the pool shall be re-funded.

(c)(1) If there is a dead heat for first place in any of theplace pick (N) contests involving contestants representingthe same betting interest, the place pick (N) pool shall bedistributed as if no dead heat had occurred.

(2) If there is a dead heat for first place in any of theplace pick (N) contests involving contestants representingtwo or more betting interests, the place pick (N) pool shallbe distributed as a single-price pool with a winning wa-ger, including each betting interest participating in thedead heat.

(d)(1) If there is a dead heat for second place in any ofthe place pick (N) contests involving contestants repre-senting the same betting interest, the place pick (N) poolshall be distributed as if no dead heat had occurred.

(2) If there is a dead heat for second place in any of theplace pick (N) contests involving contestants representingtwo or more betting interests, the place pick (N) pool shallbe distributed as a single-price pool with a winning wa-ger including the betting interest that finished first or anybetting interest involved in the dead heat for second.

(e) If a betting interest in any of the place pick (N) con-tests is scratched, the actual favorite, as determined bytotal amounts wagered in the win pool at the host trackfor the contest at the close of wagering on the contest,shall be substituted for the scratched betting interest forall purposes, including pool calculations. If the win pooltotal for two or more favorites is identical, the substituteselection shall be the betting interest with the lowest pro-gram number. The totalisator shall produce reports show-ing each of the wagering combinations with substitutedbetting interests that become winners as a result of thesubstitution, in addition to the normal winning combi-nation.

(f) The place pick (N) pool shall be canceled and allplace pick (N) wagers for the individual performanceshall be refunded if any of the following occurs:

(1) At least two contests included as part of a place pick3 are canceled or declared ‘‘no contest.’’

(2) At least three contests included as part of a placepick 4, place pick 5, or place pick 6 are canceled or de-clared ‘‘no contest.’’

(3) At least four contests included as part of a placepick 7, place pick 8, or place pick 9 are canceled or de-clared ‘‘no contest.’’

(4) At least five contests included as part of a place pick10 are canceled or declared ‘‘no contest.’’

(g) If at least one contest included as part of a placepick (N) is canceled or declared ‘‘no contest,’’ but notmore than the number specified in subsection (f) of thisregulation, the net pool shall be distributed as a single-price pool to those whose selections finish first or secondin the greatest number of place pick (N) contests for theperformance. Each distribution shall include the portionordinarily retained for the place pick (N) carryover poolbut not the carryover pool from previous performances.

(h) The place pick (N) carryover may be capped at adesignated level approved by the commission so that if,at the close of any performance, the amount in the placepick (N) carryover pool equals or exceeds the designatedcap, the place pick (N) carryover shall be frozen until itis won or distributed in accordance with this regulation.After the place pick (N) carryover pool is frozen, 100 per-cent of the net pool, part of which ordinarily would beadded to the place pick (N) carryover pool, shall be dis-tributed to those whose selection finishes first or secondin the greatest number of place pick (N) contests for theperformance.

(i) A written request for permission to distribute theplace pick (N) carryover pool on a specific performancemay be submitted to the commission. Each request shallcontain a statement of justification for the distribution,the benefit to be derived, and the intended date and per-formance for the distribution.

(j) If the place pick (N) carryover pool is designated fordistribution on a specified date and performance in whichthere are no wagers selecting the first-place or second-place finisher in each of the place pick (N) contests, theentire pool shall be distributed as a single-price pool tothose whose selection finishes first or second in thegreatest number of place pick (N) contests. The place pick(N) carryover pool shall be designated for distribution ona specified date and performance in the event of any ofthe following:

(1) Upon written approval from the commission asprovided in subsection (i) of this regulation;

(2) upon written approval from the commission ifthere is a change in the carryover pool cap or a changefrom one type of place pick (N) wagering to another, orif the place pick (N) is discontinued;

(3) on the closing performance of the race meeting orsplit meeting; or

(4) upon the written approval of the commission that,if the organization licensee fails to pay out the carryoverpool according to paragraph (j)(3) and the commissiondetermines that it would not be feasible for the track torun another race, the total carryover pool remaining willbe distributed to charitable organizations that have metthe requirements of K.S.A. 74-8813(d), and amendmentsthereto, and meet the organization’s approved charitabledistribution guidelines.

(k) If the place pick (N) carryover pool is carried overto the corresponding place pick (N) pool of a subsequentrace meeting, the carryover pool shall be deposited in aninterest-bearing account approved by the commission.Each place pick (N) carryover pool plus accrued interest

then shall be added to the net place pick (N) pool on thedate and performance designated by the commission.

(l) With the written approval of the commission, thelicensee may contribute to the place pick (N) carryover asum of money up to the amount of any designated cap.

(m) Providing information to any person regardingcovered combinations, amounts wagered on specific com-binations, number of tickets sold, or number of live ticketsremaining shall be strictly prohibited. This subsectionshall not prohibit any necessary communication for theprocessing of pool data between totalisator and parimu-tuel department employees.

(n) Any organization licensee may suspend previouslyapproved place pick (N) wagering with the prior ap-proval of the commission. Any carryover pool shall bemaintained until the suspended place pick (N) wageringis reinstated. Any organization licensee may request ap-proval of a place pick (N) wager or separate wageringpool for specific performances. Article 11.—SECURITY AND SAFETY

112-11-20. Greyhound racetrack facility safetystandards; specifications; prohibition of chemical useon track surface. (a) Each greyhound racetrack shall havethe following:

(1) A minimum width of 20 feet with inside and out-side fixed curbs at a specified slope in the outside curb;

(2) a first turn radius of 128 feet, with a second turnradius of 118 feet, and straightaways of 279.6 feet;

(3) a graduated minimum bank of 11⁄2 inches to each12 inches on each turn;

(4) the 5⁄16 mile starting box set back in a chute;(5) a water pumping system providing adequate vol-

ume and pressure to uniformly hand water the entire rac-ing surface, as needed. Automatic sprinkling systemsmay be used to complement, but shall not replace, thehand watering system;

(6) automatic openers with a manual backup for eachstarting box;

(7) one curtain placed at least 50 feet before the escapeand one curtain placed 25 feet beyond the escape andplaced so as not to distract greyhounds while they areracing;

(8) an inside lure with an extendible arm;(9) a commission-approved track base that is nonabra-

sive to a greyhound’s feet and that has adequate trackdrainage and proper resiliency;

(10) unless otherwise approved by the commission, aclosed-fluid winterization system extending from thestarting boxes to the entire width and length of the track;and

(11) a video monitoring system with a monitor in thejudges’ room and trainers’ lounge that permits the racingjudges and trainers to view the activities in the lockoutkennel, the movement of the lead outs and greyhoundsfrom the lockout kennel to the starting boxes, and theactivities at the starting boxes.

(b) Unless otherwise approved in advance by the com-mission, chemicals shall not be applied to the racing sur-face of a greyhound racetrack.

(c) Each lockout kennel shall have the following:(1) Soundproofing, including masonry construction,

that prevents the greyhounds from being disturbed byoutside noises;

(2) crates located at floor level, unless otherwise ap-proved by the commission;

(3) crates of molded fiberglass or metal with the fol-lowing:

(A) Removable wooden floors;(B) minimum inside dimensions of 36 inches wide, 42

inches deep, and 36 inches high;(C) closed crate doors that leave one inch of clearance

at top, bottom, and latching sides that protect the grey-hound’s tail and feet from injury; and

(D) drop latches or comparable latches that preventhazard to the greyhounds;

(4) a design providing for partitions to separate eachcrate if this is desired by the majority of the kennelsbooked at that meet;

(5) a sufficient number of crates to house the grey-hounds required to schedule 13 races. A second weigh-inshall be held as soon as crates are available during per-formances with more than 13 races;

(6) a climate control system that can maintain a tem-perature between 68 and 75 degrees Fahrenheit; and

(7) an area equipped with heating and air-conditioningwhere greyhounds and trainers may wait to weigh in.

(d) Each organization licensee shall provide a cool-outarea that shall have a minimum of four water faucets withhoses and a dipping vat through which greyhounds maybe walked to quickly cool them after racing. Each organ-ization licensee shall change the water in the vat at leastdaily and prevent muddy residue from accumulatingaround it.

(e) Each organization licensee shall provide the follow-ing:

(1) A covered walkway from the parking area to thelockout kennel; and

(2) a covered walkway from the cool-out area to theparking area.

(f) Each kennel compound area shall have the follow-ing:

(1) Separate kennel buildings of masonry constructionfor each contract kennel;

(2) a location far enough away from the grandstandand racing areas that kenneled dogs are not disturbed byracetrack noises; and

(3) 24-hour security for the compound enclosure pro-vided by the organization licensee during the official rac-ing season.

(g) Each kennel building shall have the following:(1) A partitioned kitchen area and crate area;(2) minimum dimensions of 20 feet by 62 feet;(3) at least two adjoining turnout pens meeting the fol-

lowing specifications for each kennel building:(A) Is free of obstructions;(B) measures at least 30 feet by 40 feet each;(C) is equipped with interconnecting gates;(D) is equipped with drainage and a water faucet in

each;

(E) is lighted by at least two halogen lights of at least300 watts each in each turnout pen, one at each end; and

(F) is surrounded by a chain link fence that is at leastsix feet high;

(4) a 20-foot overhang that extends the length of thebuilding;

(5) at least 12 inches of sand in turnout pens, whichshall be removed and replaced by the organization li-censee with new sand at least once every 12 months ofracing;

(6) a gate in each turnout pen through which a vehiclemay be driven to remove the sand and deposit new sand;

(7) a fenced safety pen eight feet wide, located betweenthe parking area and turnout pens and equipped withgates, to facilitate the moving of greyhounds directly be-tween the parking area and the turnout pens;

(8) a maximum of 60 crates or, with the prior approvalof the animal health officer, a maximum of 72 crates;

(9) metal crates with compartments that are at least 36inches wide, 42 inches deep, and 36 inches high andequipped with drop latches and casters;

(10) not more than 72 greyhounds housed in each ken-nel building with not more than one greyhound in eachcrate, unless the racing judges have approved a specificrequest otherwise;

(11) a kitchen area equipped with a hot water heaterwith a minimum capacity of 20 gallons, a deep sink ofdurable construction with a drain board, adequate shelv-ing and cabinet space, and a shower and commode in anenclosed area;

(12) one floor drain in each crate area and one floordrain in each kitchen area;

(13) a climate control system that is capable of main-taining a temperature between 68 and 75 degrees Fahren-heit;

(14) smoke and temperature alarms in each kennelarea connected to the compound security office and ca-pable of alerting security of emergency conditions;

(15) emergency backup power adequate to providecontinuous ventilation that will protect the greyhoundsif a power failure occurs at any time during a racing sea-son scheduled in the months of May through September;

(16) a fresh air ventilation system or at least four win-dows of approximately four square feet each that areequipped with screens and can be opened;

(17) lighting to adequately illuminate all areas insidethe kennel;

(18) adequate space within the kennel building foreach contract kennel to place a dog-walking machine andadequate floor space within the crate area for a hydro-therapy vat; and

(19) an on-line hookup for a telephone and a videomonitoring system that permits the trainers to watch theraces.

(h) Unless otherwise approved by the commission,each organization licensee shall provide sprint paths asfollows:

(1) One sprint path measuring at least 16 feet by 350feet, equipped with a common center fence, and heatedby a closed-fluid winterization system extending thelength and width of the sprint path;

(2) two open sprint paths measuring at least 20 feet by500 feet;
