Administrative Regulations

A public hearing will be conducted by the Departmentof Revenue at 9 a.m. Tuesday, April 9, in the secretary’sconference room, Room 230, Docking State Office Building,915 S.W. Harrison, Topeka, to consider the adoption of al-coholic beverage control regulations. Copies of these pro-posed regulations may be found at www.ksrevenue.org.

This 60-day notice of the public hearing shall constitutea public comment period for the purpose of receivingwritten comments from the public on the proposed reg-ulations. All interested parties may submit written publiccomments on the proposed regulations prior to the hear-ing to Kathleen Smith, Tax Specialist, Office of Policy andResearch, Room 230, Docking State Office Building, 915S.W. Harrison, Topeka, 66612, or through email at [email protected].

All interested parties will be given a reasonable oppor-tunity to present their views, either orally or in writingor both, concerning the adoption of the proposed regu-lations. In order to give all parties an opportunity to pres-ent their views, it may be necessary to request that eachparticipant limit any oral presentation to five minutes.

Any individual with a disability may request accom-modation in order to participate in the public hearing andmay request the proposed regulations and economic im-pact statements in an accessible format. These regulations are proposed for adoption on a per-manent basis. A summary of the proposed regulationsand the economic impact follows:

Article 13.—RETAIL LIQUOR DEALERAdoption of 14-13-16. Tasting events; requirements;

prohibitions. This new regulation implements the pro-visions of Section 3 of 2012 Substitute for HB 2689, allow-ing retail licensees to serve free samples of alcoholic liq-uor on the licensed premises and at adjacent premisesmonitored and regulated by the Division of ABC. Theregulation establishes procedures for conduct of theevent, record keeping and storage of liquor.

Economic Impact: The Department of Revenue doesnot anticipate any impact on the department or other gov-ernment agencies. Licensees may see an increase in salesof alcoholic liquor through the sampling program.

Adoption of 14-13-17. Tasting events; supplier partic-ipation; requirements; prohibitions. This new regulationimplements the provisions of Section 3 of 2012 Substitutefor HB 2689, allowing suppliers to participate in tastingevents conducted by a retail liquor store licensee on thelicensed premises and at adjacent premises monitoredand regulated by the Division of ABC. The regulation es-

tablishes procedures for a supplier’s conduct of the event,record keeping and storage of liquor.

Economic Impact: The Department of Revenue doesnot anticipate any impact on the department or other gov-ernment agencies. Licensees may see an increase in salesof alcoholic liquor through the sampling program.

Adoption of 14-13-18. Change of ownership; notice todirector. This new regulation requires a retailer to notifyABC of its intent to transfer ownership in its business atleast 20 days prior to the transfer, then notify ABC againnot later than 10 days after the transfer takes place. Thenotices must include all information necessary to deter-mine the continued eligibility of the licensee.

Economic Impact: The Department of Revenue doesnot anticipate any impact on the department or other gov-ernment agencies.

Sealed bids for Turkey Creek Bicycle and PedestrianTrail (PR-1067), KDOT Project No. 46 N-0553-01, will bereceived by the city of Overland Park, Kansas, at the of-fice of the city clerk, City Hall, 8500 Santa Fe Drive,Overland Park, 66212, until 2 p.m. local time March 5,2013. At that time all sealed bids will be transferred tothe City Council Chamber, City Hall, where they will bepublicly opened and read aloud. Any bid received afterthe designated closing time will be returned unopened.

Contractors should read and be fully familiar with allcontract documents before submitting a bid. All bidders shall verify that they have considered allwritten addenda. Neither the city nor the consultant shallbe responsible for oral instructions.

Any written addenda issued during the time of biddingshall be covered and included in the bid. There will beno clarifications or exceptions allowed on the bid. Bidsare for a total bid package, total contract price.

Bids shall be made upon the form provided in ink ortypewritten. Numbers shall be stated both in writing andin figures, the signature shall be longhand, and the com-

plete form shall be without alteration or erasure. On al-ternate items for which a bid is not submitted, a writtenindication of ‘‘no bid’’ on the bid form is required.

No oral, telegraphic, facsimile or telephonic bids or al-terations will be considered.

The following items must be included in the sealed en-velope with the bid:

Each bidder shall file with its bid a bid bond, a cashier’scheck or a certified check drawn on any acceptable bank,made payable to the city of Overland Park, Kansas, in anamount of not less than 5 percent of the total bid, whichshall be retained by the city of Overland Park until a con-tract for the project has been executed. Bid bonds will bereturned to the unsuccessful bidders, with the exceptionof the second qualifying bidder, at such time as their bidsare rejected. The bid deposit of the successful bidder andthe second qualifying bidder will be returned when sat-isfactory bonds in an amount equal to 100 percent of thecontract amount, required insurance certificates andother required documents shall have been furnished andthe contract documents have been executed.

In the event the successful bidder is unable to executethe contract, for whatever reason, the city may exerciseits legal prerogatives, including, but not limited to, en-forcement of its rights as to the bid security.

The city reserves the right to accept or reject any andall bids and to waive any technicalities or irregularitiestherein. Bids may be modified or withdrawn by writtenrequest of the bidder received in the office of the city clerkprior to the time and date for bid opening; provided,however, that no bidder may withdraw its bid for a pe-riod of 30 days from the date set for the opening thereof.All bidders agree that rejection shall create no liability onthe part of the city because of such rejection. It is under-stood by all bidders that an unsuccessful bidder has nocause of action against the city for bid preparation costs.The filing of any bid in response to this invitation shallconstitute an agreement of the bidder to these conditions.

A pre-bid conference will be held at 1:30 p.m. February21 in Conference Room 1 of the Overland Park City Hall,8500 Santa Fe Drive, Overland Park.

The Kansas Department of Health and Environmentreceived an application from the city of Salina to modifythe city’s municipal solid waste (MSW) landfill (PermitNo. 144) at 4292 S. Burma Road, southwest of Salina inSaline County, Kansas.

The total facility permitted site area remains unchan-ged at approximately 656.5 acres, which is all containedwithin Section 7, Township 15 South, Range 3 West, inSaline County. City officials have proposed adding 9.6acres of landfill disposal area to the existing 280.1 acresof MSW disposal area, for a total of 289.7 acres of dis-posal. City officials also have proposed increasing the fi-nal elevation of the landfill from an elevation of 1,408 feetto approximately 1,545 feet above sea level. These modi-fications would add approximately 8.4 million cubicyards of capacity or approximately 73 years of disposalat current disposal rates. Existing solid waste manage-ment activities at this facility include temporary storageof MSW in drop-off containers, white goods and scrapmetal storage, tree and brush burn pit, and post-closurecare of closed MSW landfill areas.

The city of Salina has certified that the application de-scribed herein is consistent with its solid waste manage-ment plan and compatible with surrounding land use.

KDHE is providing public notice of its intent to issuea permit to the city of Salina to allow the facility modifi-cations described herein. However, a final decision to is-sue the permit has not been made, and KDHE will con-sider information gathered during the public commentperiod before making a final decision. A copy of the per-mit application, engineering drawings and draft permitwith respect to this permit action will be available forpublic review through March 1 at www.kdheks.gov/waste or at the following locations during normal busi-ness hours:

Administrative Regulations

The Kansas Department of Health and Environment,Division of Environment, Bureau of Waste Management(BWM), will conduct a public hearing at 1:30 p.m. Tues-day, April 2, in the Azure Conference Room, fourth floor,Curtis State Office Building, 1000 S.W. Jackson, Topeka,to consider the adoption of proposed new hazardouswaste management regulation K.A.R. 28-31-260b and theadoption of amended hazardous waste management reg-ulation K.A.R. 28-31-268. A summary of the proposedregulations, environmental benefit and estimated eco-nomic impact follows.

Summary of Regulations:K.A.R. 28-31-260b. General provisions and defini-

tions; adoption of technical documents. This regulationadopts technical documents that are cited in the federalhazardous waste regulations which the state has adoptedby reference. Adoption of these technical documents isneeded to maintain and update Kansas’ authorization toadminister the hazardous waste management program inlieu of the EPA.

K.A.R. 28-31-268. Land disposal restrictions; adoptionand modification of federal regulations. The proposedamendment corrects an error in K.A.R. 28-31-268, whichadopts 40 CFR Part 268, Land Disposal Restrictions, byreference. 40 CFR Part 268 sets standards for treatment ofhazardous waste that is destined for disposal in a munic-ipal solid waste landfill or a hazardous waste landfill.

Under federal regulations, land disposal restrictions(LDRs) apply to generators of more than 100 kg of haz-ardous waste each month, i.e., small quantity generatorsand large quantity generators. Kansas’ most recent adop-tion of this regulation changed the generation limit to 25kg per month, thus requiring that Kansas small quantitygenerators (KSQGs) also comply with all of the LDR reg-

ulations. The intent was that KSQGs only needed to com-ply with two sections of the LDRs.

It is important that this error be corrected before Kan-sas’ authorization to administer the hazardous waste pro-gram is updated. If the EPA authorizes the regulationwithout the correction, the EPA could require KSQGs tocomply with all of the LDR requirements in 40 CFR 268.

Environmental Benefit: The adoption by reference oftechnical documents in K.A.R. 28-31-260b and the correc-tions to K.A.R. 28-31-268 do not provide any environ-mental benefit.

Economic Impact: The adoption by reference of tech-nical documents in K.A.R. 28-31-260b imposes no addi-tional costs on the regulated community. The amendmentto K.A.R. 28-31-268 reduces the potential regulatory bur-den and cost of compliance with this regulation for morethan 600 KSQG facilities in Kansas. There will be no in-crease in costs to governmental agencies or the generalpublic.

The time period between the publication of this noticeand April 2 serves as the required public comment periodof at least 60 days for the purpose of receiving writtenpublic comments on the proposed regulatory action. It will be held in conjunctionwith the Kansas lottery’s ‘‘Road Trip’’ game (K.A.R. 111-4-1759 through 111-4-1763).

(b) With each book of ‘‘Road Trip’’ tickets activated, aretailer location will automatically be entitled to one entryfor the random selection of winning entries.
