Executive Directive No. 14-451Authorizing Expenditure of Federal Funds

and Authorizing Fund Transfers

By virtue of the authority vested in the Governor as thehead of the Executive Branch of the State of Kansas, thefollowing transactions are hereby authorized:

Pursuant to the authority of the Secretary of the De-partment of Wildlife, Parks and Tourism to receive andexpend federal funds, and pursuant to the authoritygranted the Governor by Chapter 136, Section 288 of The2013 Session Laws of Kansas, approval is hereby granted tothe Kansas Department of Wildlife, Parks and Tourismfor expenditure in FY 2014 of monies in the federal fund‘‘Rural Business Enterprise Grants.’’

The request of the Adjutant General, that $17,098.80 betransferred from the General Fees Fund (911 Coordinat-ing Council) (034-00-2102-14-2131) to the Military FeesFund (Emergency Management Indirect Cost Fee Fund)(034-00-2152-14-2000) is hereby approved, effective im-mediately.

A public hearing will be conducted at 9 a.m. Thursday,April 10, in the offices of the Kansas Development Fi-nance Authority, 555 S. Kansas Ave., Suite 202, Topeka,on the proposal for the KDFA to issue its AgriculturalDevelopment Revenue Bond for the project numbered be-low in the respective maximum principal amount. Thebond will be issued to assist the borrower named below(who will be the owner and operator of the project) tofinance the cost in the amount of the bond, which is thentypically purchased by a lender bank who then, throughthe KDFA, loans the bond proceeds to the borrower forthe purposes of acquiring the project. The project shall belocated as shown:

Project No. 000889 — Maximum Principal Amount:$198,984.77. Owner/Operator: Marvin R. and Jackie L. Miller.Description: Acquisition of 75 acres of agricultural land andrelated improvements and equipment to be used by theowner/operator for farming purposes. The project is beingfinanced by the lender for Marvin R. and Jackie L. Miller andis located at Section 31, Township 24 South, Range 7 West,Reno County, Kansas, approximately 3.5 miles south of Par-tridge and 1 mile west.

The bond, when issued, will be a limited obligation ofthe KDFA and will not constitute a general obligation orindebtedness of the state of Kansas or any political sub-division thereof, including the KDFA, nor will it be anindebtedness for which the faith and credit and taxingpowers of the state of Kansas are pledged. The bond willbe payable solely from amounts received from the re-spective borrower, the obligation of which will be suffi-cient to pay the principal of, interest and redemption pre-mium, if any, on the bond when it becomes due.

All individuals who appear at the hearing will be givenan opportunity to express their views concerning the pro-posal to issue the bond to finance the project, and all writ-ten comments previously filed with the KDFA at its of-fices at 555 S. We understand that you have requested this opinionin your capacity as supervisor of Environmental Radia-tion, Emergency Preparedness for Kansas Department ofHealth and Environment (KDHE). This opinion is in re-sponse to your request to the Kansas GovernmentalEthics Commission (Commission), concerning applica-tion of the state governmental ethics law, K.S.A. 46-215et seq. We note at the outset that the Commission’s juris-diction is limited to the applicability of K.S.A. 46-215 etseq., and the Commission’s opinion does not addresswhether some other statutory system, common law the-ory, or agency rule or regulation applies to your inquiry.Factual Statement

An agency sponsored Radon mitigation training foragency staff and radon remediation technicians certifiedby KDHE will utilize a house that is owned by state em-ployees, one of which is a KDHE employee. This housecame to the attention of agency staff through one of theowners who is employed with the agency. The selectionof the home is due to the specific characteristics requiringmultiple techniques for mitigation. These varied mitiga-

The training will be video-tapedfor use in developing a computer based training programin diagnostic and mitigation techniques. The programwill be available to all Kansas certified technicians forcontinuing education credit. The mitigation training willresult in the installation of a Radon mitigation system inthe state employees’ house. The system consists of a fanunit, PVC pipe and brackets for mounting. Agency staffconsider the opportunity that the state employees’ housepresents for the training is of equal or greater value to theagency then the value of the mitigation system and itsinstallation in the state employees’ house.Question

Does installation of a radon mitigation system in ahouse owned by state employees at no cost constitute agift or economic opportunity to the state employees inviolation of K.S.A. 2013 Supp. 46-237a?Analysis and Opinion

A gift, economic opportunity, loan, gratuity, specialdiscount or service received by state employees is notprohibited by the state governmental ethics law unless itis provided because of the official position of a state em-ployee. K.S.A. 2013 Supp. 46-237a(b). ‘‘‘Gift’ means thetransfer of money or anything of value unless legal con-sideration of a reasonably equal or greater value is re-ceived in return.’’ K.A.R. 19-40-3a(b). ‘‘The value of a giftshall be the fair market value or a reasonable estimatethereof. Where a transfer is made for less than reasonableconsideration, the amount by which the value of thetransfer exceeds the value of the consideration shall bedeemed a gift.’’ K.A.R. 19-40-3a(b)(1).

The KDHE staff have concluded the rare opportunityto utilize the employees’ house, unfettered for purposesof conducting and video recording a mitigation training,outweighs the value an installed mitigation system to theemployees. This opportunity is lawful consideration foran installed mitigation system. Consequently, the in-stalled mitigation system is not prohibited by K.S.A. 2013Supp. 46-237a insofar as the system is not a gift.

Since the installed mitigation system is not a gift, is itan economic opportunity? ‘‘‘Economic opportunity’means any purchase, sale, lease, contract, option, or othertransaction or arrangement involving property or serv-ices wherein a state [...] employee [...] may gain a personaleconomic benefit, but not including any gift.’’ K.S.A. 46-217. Installation of a mitigation system in a house is aneconomic benefit when done at no cost to the owner whowould otherwise have to pay. Under the present facts,this economic opportunity is a result of a ‘‘transaction orarrangement involving property or services.’’ Thereforethe mitigation system is an ‘‘economic opportunity,’’ thereceipt of which by a state employee due to their officialposition is prohibited.

In Governmental Ethics Opinion 1999-50, the Commis-sion determined that:

the term ‘‘official position’’ refers to an individual’s par-ticular position with the [s]tate and does not apply gen-erally to a person because they are a [s]tate employee. Forguidance, the Commission notes that a gift or discount

which is provided to all [s]tate employees is not beingprovided to a person because of his or her ‘‘official posi-tion.’’ On the other hand, a gift or discount which is pro-vided to all purchasing agents, for example, or all em-ployees of a particular agency, will be deemed to beprovided because of such persons’ ‘‘official position.’’

Applying this meaning of ‘‘official position,’’ to thepresent facts, the selection of the KDHE employee’s housewas because of that employee’s official position. Even so,subparagraphs (1)-(4) of K.S.A. 46-237a(b) provide excep-tions that allow a state employee to accept such benefitseven if received because of their official position:

(1) A gift having an aggregate value of less than $40given at a ceremony or public function where theperson is accepting the gift in such person’s offi-cial capacity; or

(2) gifts from relatives or gifts from personal friendswhen it is obvious to the person that the gift is notbeing given because of the person’s official posi-tion; or

(3) anything of value received by the person on behalfof the state that inures to the benefit of the stateor that becomes the property of the state; or

(4) contributions solicited on behalf of a nonprofit or-ganization which is exempt from taxation underparagraph (3) of subsection (c) of section 501 ofthe internal revenue code of 1986, as amended.

Among these exceptions only one provided under sub-paragraph (3) is arguably applicable. As noted previ-ously, the opportunity to provide mediation training is abenefit that inures to the state as a result of this transac-tion between KDHE and the state employee. However,the economic benefit received through the transaction bythe state employee is the mitigation system. The systembenefits the state employees and no benefit from the mit-igation system itself inures to the state. Hence, the sub-paragraph (3) exception does not apply. Without an ap-plicable exception, acceptance of an installed radonmitigation system in their house, an economic benefit be-cause of one owner’s official position, violates K.S.A. 2013Supp. 46-237a(b).

In Opinion No. 2002-08 the Commission determinedthat state employees subject to K.S.A. 46-237a could notaccept gifts, discounts, or access to entertainment andsporting events from anyone, including state agencies,unless one of the enumerated exceptions applied. TheCommission also noted in the same opinion that state em-ployees may accept such items as part of their compen-sation. Compensation is defined by K.S.A. 46-216 as ‘‘anymoney, thing of value, or economic benefit conferred on,or received by, any person in return for services rendered,or to be rendered, by such person or another.’’ Accord-ingly, if something of value other than salary is given toan employee by the agency, it must be considered part ofhis or her total compensation package to not violateK.S.A. 2013 Supp. 46-237a(b).

Article 1.—DISEASES

28-1-23. Management of occupational exposures.(a) For the purpose of this regulation, each of the follow-ing terms shall have the meaning specified in this sub-section:

(1) ‘‘Occupational exposure’’ means any occupationalexposure, as defined in K.S.A. 65-116a and amendmentsthereto, that occurs to any of the following under the con-ditions specified:

(A) Any individual providing medical or nursing serv-ices, clinical or forensic laboratory services, emergencymedical services, or firefighting, law enforcement, or cor-rectional services, whether for compensation or as a vol-unteer;

(B) any individual in training for certification, licen-sure, a position, or a job providing any services listed inparagraph (a)(1)(A); or

(C) any individual receiving services from an individ-ual specified in paragraph (a)(1)(A) or (B).

(2) ‘‘Exposed person’’ means any individual who hadan occupational exposure.

(3) ‘‘Source person’’ means any individual from whoman occupational exposure originated.

(4) ‘‘Infection control officer’’ means the individual onduty and designated to monitor and respond to occupa-tional exposures by an entity providing medical or nurs-ing services, clinical or forensic laboratory services, emer-gency medical services, or firefighting, law enforcement,or correctional services.

(b) Each exposed person specified in paragraph(a)(1)(A) or (B) shall inform the entity’s infection controlofficer about the occupational exposure as soon as pos-sible, but within four hours of the occupational exposure.

(c) The infection control officer shall determine whetherthe occupational exposure was sufficient to potentiallytransmit a pathogen or an infectious and contagious dis-ease, considering current guidelines from the Kansas de-partment of health and environment, the centers for dis-ease control and prevention, and the United States publichealth service.

(d) If the infection control officer determines that theoccupational exposure was sufficient to potentially trans-mit a pathogen or an infectious and contagious disease,the infection control officer shall direct that an appropri-ate specimen be obtained from the source person for test-ing.

(1) If the source person refuses to provide a specimenfor testing, the infection control officer may submit anapplication to a court of competent jurisdiction for an or-der requiring the source person to submit an appropriatespecimen for testing. The application shall include the fol-lowing:

(A) An allegation that the source person has refused toprovide an appropriate specimen for testing following anoccupational exposure;

(B) the specific test or tests needed to be performed;and

(C) specification of whether and how frequently anyadditional tests may be required.

(2) If the source person has died and the infection con-trol officer requests a specimen, the custodian of thesource person’s remains shall obtain and preserve an ap-propriate specimen from the source person for testing.

(e) If a person who has been transported to a healthcare facility is subsequently determined to be a sourceperson of a pathogen or an infectious and contagious dis-ease that can be transmitted from person to personthrough the air or by exposure to respiratory droplets,the following notifications shall be required:

(1) Within four hours of the diagnosis, the treatinghealth care provider shall notify the infection control of-ficer of the health care facility of the presence of a sourceperson.

(2) Within four hours of receiving notification from thetreating health care provider, the infection control officerof the health care facility shall provide to the entity thattransported the source person at least the following in-formation:

(A) The name of the source person;(B) the diagnosis; and(C) the date and time the source person was trans-

ported to the health care facility.(3) Within four hours of receiving notification from the

health care facility, the infection control officer of the en-tity that transported the source person shall notify allother entities whose personnel could have cared for orinteracted with the source person in a manner that couldtransmit the pathogen or the infectious and contagiousdisease and shall provide at least the following informa-tion:

(A) The name of the source person;(B) the diagnosis; and(C) the date and time the source person was trans-

ported to the health care facility.(f) The results of the infectious and contagious disease

test or tests shall be disclosed to the exposed person, theinfection control officer responsible for the exposed per-son, and the source person as soon as possible. To theextent feasible, the disclosure to the exposed person shallnot include the name or identity of the source person.

(g) If an infection control officer has determined that aperson who is or has been in the care or custody of anindividual providing medical or nursing services, emer-gency medical services, or firefighting, law enforcement,or correctional services has been exposed to an infectiousand contagious disease, blood, or other potentially infec-tious materials by the individual providing those serv-ices, the infection control officer shall advise the exposedperson and recommend appropriate testing as soon asfeasible. AN ACT authorizing the secretary of state to grant an easement to theunified government of Wyandotte county, Kansas.

Be it enacted by the Legislature of the State of Kansas:Section 1. (a) The secretary of state is hereby authorized and directed

to grant an easement on land owned by the state of Kansas along thenorth bank of the Kansas river in Wyandotte county and within andwithout the city of Kansas City, Kansas, to the unified government ofWyandotte county/Kansas City for use as a boat ramp. Such easementshall be 80 feet in width and shall be 40 feet on each side of the following

fied government of Wyandotte county/Kansas City prohibiting publicaccess to such easement and assuming full responsibility for such useand holding the state of Kansas harmless therefor.

(c) The legal document granting the easement described under sub-section (a) shall be approved by the attorney general and shall be exe-cuted by the secretary of state. The conveyance may be in such form asdetermined to be in the best interest of the state by the attorney generalin consultation with the secretary of state.

(d) In the event the secretary of state determines that the legal de-scription of the parcel described by this section is incorrect, the secretaryof state may grant the easement utilizing the correct legal descriptionbut the legal document granting the easement shall be subject to ap-proval by the attorney general.

(e) The conveyance of the easement authorized by this section shallnot be subject to the provisions of K.S.A. 75-3043a or K.S.A. 2013 Supp.75-6609, and amendments thereto.

Sec. 2. This act shall take effect and be in force from and after itspublication in the Kansas register.
