Notice of Hearing

A public hearing will be conducted at 9 a.m. Thursday,December 13, in the offices of the Kansas DevelopmentFinance Authority, 555 S. Kansas Ave., Suite 202, Topeka,on the proposal for the KDFA to issue its AgriculturalDevelopment Revenue Bond for the projects numberedbelow in the respective maximum principal amount. Thebond will be issued to assist the borrower named below(who will be the owner and operator of the project) tofinance the cost in the amount of the bond, which is thentypically purchased by a lender bank who then, throughthe KDFA, loans the bond proceeds to the borrower forthe purposes of acquiring the project. The projects shallbe located as shown:

Project No. 000703—Maximum Principal Amount:$199,025.38. Owner/Operator: Jerrod A. and Jessica Ho-faker. Description: Acquisition of 320 acres of agriculturalland and related improvements and equipment to be usedby the owner/operator for farming purposes. The projectis being financed by the lender for Jerrod A. and JessicaHofaker and is located at the South Half of the South Halfof Section 18 and the North Half of the North Half ofSection 19, Township 45, Range 20 West, Phillips County,Kansas, approximately 1 mile west from the intersectionof Hwy. 9 and West 1300 Road, 2 miles north on West1400 Road, and 1 mile west on West Victory Road.

Project No. 000705—Maximum Principal Amount:$250,000. Owner/Operator: Matthew L. and Janel E. Har-twell. Description: Acquisition of 317.32 acres of agricul-tural land and related improvements and equipment tobe used by the owner/operator for farming purposes. Theproject is being financed by the lender for Matthew L. andJanel E. Hartwell and is located at the Southeast Quarterof Section 2, Township 6 South, Range 37 (158.15 acres),Sherman County, Kansas, and the Southwest Quarter ofSection 31, Township 5 South, Range 36 (159.17), RawlinsCounty, Kansas, approximately 14 miles north of Brew-ster on Road 2 and 2 miles west.

The bond, when issued, will be a limited obligation ofthe KDFA and will not constitute a general obligation orindebtedness of the state of Kansas or any political sub-division thereof, including the KDFA, nor will it be anindebtedness for which the faith and credit and taxingpowers of the state of Kansas are pledged. The bond willbe payable solely from amounts received from the re-spective borrower, the obligation of which will be suffi-cient to pay the principal of, interest and redemption pre-mium, if any, on the bond when it becomes due.

All individuals who appear at the hearing will be givenan opportunity to express their views, and all writtencomments previously filed with the KDFA at its officesat 555 S. Kansas Ave., Suite 202, Topeka, 66603, will beconsidered. Additional information regarding the projectmay be obtained by contacting the KDFA.

Kansas Rehabilitation Services (KRS) and the StatewideIndependent Living Council of Kansas (SILCK) invite in-dividuals and organizations interested in independentliving services for people with disabilities to participatein a statewide public hearing from 1:30 to 3:30 p.m. Fri-day, January 4. The hearing will be an interactive Webcast facilitated by Michael Donnelly, KRS director, andShannon Jones, SILCK executive director.

Participants will have the opportunity to provide inputon a variety of issues, including the following:

* Priorities for use of federal independent living funds.* Identification of unmet independent living service

needs.* Other priorities for the independent living

community.Input received will be used to update the State Plan for

Independent Living and to establish priorities for use ofavailable funds.

The interactive Web cast will use technology to connectpeople in the following 12 Kansas communities througha live audio and video broadcast. In addition, participantsin each of the following locations will be able to sharetheir comments or questions that will be broadcast live toall locations:

Administrative Regulations

A public hearing will be conducted at 10 a.m. Wednes-day, January 30, in the fourth floor training room of theKansas Department of Agriculture, 109 S.W. 9th, Topeka,to consider the adoption of proposed pesticide regula-tions.

This 60-day notice of the public hearing shall constitutea public comment period for the purpose of receivingwritten public comments on the proposed rules and reg-ulations. All interested parties may submit written com-ments prior to the hearing to the Secretary of Agriculture,109 S.W. 9th, 4th Floor, Topeka, 66612, or by e-mail [email protected]. Comments also may be madethrough the department’s Web site at http://www.ksda.gov under the proposed regulation.

All interested parties will be given a reasonable oppor-tunity to present their views orally on the adoption of theproposed regulations during the hearing. In order to giveall parties an opportunity to present their views, it maybe necessary to request that each participant limit anyoral presentation to five minutes.

The regulations are proposed for adoption on a per-manent basis. A summary of the proposed regulationsand their economic impact follows:

K.A.R. 4-13-1 clarifies ‘‘restricted-use pesticide’’ andadds ‘‘stump treatment’’ to definitions.

K.A.R. 4-13-3 incorporates the requirements of com-mercial applicator certification categories and subcate-gories as set forth in the existing 4-13-11 into the require-ments for categories and subcategories of licensedpesticide businesses currently in 4-13-3. This clarifies therequirement for licensees to have applicator certificationin all subcategories of business activity. Changes also in-clude the addition of subcategories for stump treatmentand sewer root control and allowing industrial weed con-trol to be performed under right-of-way category.

K.A.R. 4-13-9 are changes in language to clarify.K.A.R. 4-13-11 is deletion of the regulation due to in-

corporation of requirements into 4-13-3.K.A.R. 4-13-13 are changes in language to clarify and

provisions for certification examinations for the new sub-categories in 4-13-3.

K.A.R. 4-13-20, 4-13-21, 4-13-22, 4-13-23, 4-13-24 and 4-13-33 reflect fees implemented as a result of statutorychange.

There will be costs associated with modifying elec-tronic data storage, form modifications, and developmentof new certification examinations for the proposed newsubcategories. Costs are estimated to be less than $10,000.Kansas State University is expected to incur costs asso-ciated with developing study materials for the new cer-tification subcategories. These costs are expected to beless than $10,000.

111-4-2612. Name of drawings. The Kansas lot-tery, in cooperation with the Iowa lottery, shall conductdrawings entitled ‘‘Midwest Millions Second ChanceDrawings,’’ and will accept entries starting the day the‘‘Midwest Millions’’ instant ticket is offered for sale forthe drawings to be conducted on January 11, 2008, andApril 18, 2008. Rules applicable to these drawings arecontained in K..A.R. 111-4-2612 through K.A.R. 111-4-2615 and K.A.R. 111-3-1 et seq. (Authorized by and im-plementing K.S.A. 74-8710; effective, T-111-11-14-07,Sept. 13, 2007.)

111-4-2613. Prize. (a) The grand prize winner se-lected in each ‘‘Midwest Millions Second Chance Draw-ing’’ on the date specified in these regulations shall re-ceive $500,000, and 50 second prize winners at eachdrawing shall win $1,000 each. The lottery will withholdall taxes as may be required by law, but all winners areresponsible for any and all taxes that may be due andowing.

111-4-2614. Method of entry. (a) Entry into the‘‘Midwest Millions Second Chance Drawings’’ shall beaccomplished as follows:

(1) Obtain a valid ‘‘Midwest Millions’’ Kansas lotteryinstant lottery ticket.

(2) Determine if the ticket is a winning ticket in accord-ance with the rules of said instant game. If the ticket is awinning ticket, it is not eligible for the drawing and shallbe redeemed in accordance with the instant game rules.

(3) If the ticket is a valid non-winning ticket, the ticketis eligible for the drawing and the holder of the ticket mayuse it to enter the drawing.

(4) The holder of the non-winning ticket must completethe information form on the back of the ticket in a legiblemanner. Only one name shall appear on a non-winningticket entered.

(5) Apply proper postage to the back of the ticket whereindicated and deposit into the mail, or place one or moreentries into an envelope with proper postage and mail itto: ‘‘Midwest Millions Drawings, c/o Kansas lottery, P. 111-4-2615. Selection of winners. The followingprocess shall be used for the selection of winners in the‘‘Midwest Millions Second Chance Drawings’’:

(a) Kansas lottery personnel shall pick up all mail con-taining entries for this drawing at the United States PostOffice in Topeka, Kansas, with final pickup for the firstdrawing after the morning mail delivery on January 4,2008, prior to the drawing on January 11, 2008, and finalpickup for the second drawing after the morning maildelivery on April 11, 2008, prior to the drawing on April18, 2008.

(b) Lottery personnel shall transport the mail to theKansas lottery mail room where the envelopes will beopened and emptied into the drawing receptacle or drum,along with all entries deposited into receptacles desig-nated by the lottery pursuant to the rules of this drawing.

(c) Each drawing shall be held at the lottery headquar-ters in a place accessible to the public and open for publicattendance with lottery security personnel present. Eachdrawing shall be audio and video taped.

(d) At the start of each preliminary drawing, lotterysecurity personnel shall present the receptacle or drum tothe person designated by the executive director to per-form the drawing. The receptacle or drum for the draw-ing shall contain all entries eligible for the drawing. Thedrum shall be rotated at least 10 times or receptacle mixedthoroughly as may be applicable. The designated individ-ual shall then unseal the receptacle or drum, and usingthe bare-arm technique, while looking away, remove oneat a time from the receptacle or drum the number of en-tries as determined pursuant to K.A.R. 111-4-2614 andmark them in numerical sequence in order drawn. Eachvalid entry so drawn shall be eligible for the respectivefinal drawing.

(e) The first final drawing on January 11, 2008, shall beconducted by the Kansas lottery. At the first final draw-ing, all valid preliminary entries from the Kansas lotteryfor the first final drawing shall be deposited into a draw-ing receptacle with all valid preliminary entries from theIowa lottery for the first final drawing. At the start of thefirst final drawing, lottery security personnel shall pres-ent the drawing receptacle to the person designated bythe executive director to perform the drawing. The draw-ing receptacle shall contain all entries eligible for thedrawing. The receptacle shall be rotated at least 10 times,or the contents mixed thoroughly, as may be applicable.The designated individual shall then, using the bare-armtechnique, while looking away, remove one entry fromthe receptacle. The person whose name appears on theentry shall be the winner of the grand prize as identifiedin these regulations, subject to validation. After one validentry has been selected, a total of 50 additional valid en-tries shall be drawn, one at a time, and marked in nu-merical sequence in the order drawn. Each person whosename appears on a valid entry so drawn shall be the win-ner of a secondary prize of $1,000.

(f) All valid entries drawn during the second prelimi-nary drawing conducted by the Kansas lottery shall be

delivered to the Iowa lottery prior to the second finaldrawing and deposited into the drawing receptacle con-taining all second preliminary drawing entries drawn bythe Iowa lottery. The second final drawing on April 18,2008, shall be conducted by the Iowa lottery pursuant toits rules and procedures. The prizes available in the sec-ond final drawing shall be identical to the prizes availablein the first final drawing.

(g) After all entries have been drawn and verified asvalid in each final drawing, at least five more entries willbe drawn, one at a time, to serve as alternate entries. Thealternate entries will be marked in numerical sequence inorder drawn. The alternate entries will be used only ifone or more of the original winners cannot be located orare declared ineligible, or fail to present a fully executedclaim form as required by these regulations. The alter-nates will be used, if necessary, in the order drawn. Inthe event a grand prize winner is declared ineligible orfails to present a fully executed claim form as required bythese regulations, the first drawn secondary prize winnershall be declared the grand prize winner.

(h) The Kansas lottery security official present shall re-view each entry drawn to determine the validity of theentry into each drawing in accordance with these regu-lations. If it is a valid entry and the name is legible, theevent manager and the security person present shall rec-ord the name of the winner. Each winner shall be givenor sent a prize claim form to be completed and returnedto the lottery within 30 calendar days of the drawing. TheKansas lottery will process all claims for persons utilizingKansas lottery entries and the Iowa lottery shall processall claims for persons utilizing Iowa lottery entries.

(i) If any entry is determined to be ineligible, it shall bediscarded by the security person present and another en-try drawn. This procedure will be repeated until validselections are obtained.

(j) All entries remaining in the drum or receptacle afterthe winners have been selected and certified and all en-tries not received in compliance with these rules shall bedestroyed pursuant to K.A.R. 111-3-34. Thefollowing restrictions shall apply to the prize packages:

(a) Prize packages are not transferable; however, anyprize winner in this drawing may designate, in writing,another person to participate on his or her behalf in the‘‘Deal or No Deal’’ show, if selected.

(b) The lottery shall choose and reserve all hotel rooms.(c) The lottery shall provide transportation to and from

(h) No later than 5:00 p.m. on the fourteenth calendarday following the drawing, the winner of a prize as theresult of this drawing shall return to the lottery a com-pleted claim form as provided by the lottery or the personnamed on the entry drawn will no longer be eligible forthe prize. In such an event, the first eligible alternate entrydrawn pursuant to these regulations shall be declared thewinner. All alternate winners shall then be subject to thesame rules of eligibility as original winners.

(i) A total of two prize packages shall be awarded.(j) All entries not selected for the trip prize packages

111-4-2618. Method of entry. (a) Entry into the‘‘Deal or No Deal Second Chance Drawing’’ shall be ac-complished as follows:

(1) Obtain a valid ‘‘Deal or No Deal’’ Kansas lotteryinstant lottery ticket, game number 716.

(2) Determine if the ticket is a winning ticket in accord-ance with the rules of said instant game. If the ticket is awinning ticket, it is not eligible for the drawing and shallbe redeemed in accordance with the instant game rules.

(3) If the ticket is a valid non-winning ticket, the ticketis eligible for the drawing and the holder of the ticket mayuse it to enter the drawing.

(e) After two entries have been drawn and verified asvalid by lottery security, two more entries will be drawn,one at a time, to serve as alternate entries. The alternateentries will be marked in order drawn, 1A and 2A. Thealternate ticket entries will be used only if one or more ofthe original winners cannot be located or are declaredineligible, or fail to present a fully-executed claim formto lottery headquarters as required by these regulations.The alternates will be used, if necessary, in the orderdrawn.

(f) The Kansas lottery security official present shall re-view each entry drawn to determine the validity of theentry into this drawing in accordance with these regula-tions. If it is a valid entry and the name is legible, theevent manager and the security person present shall rec-ord the name of the winner. Each winner shall be givenor sent a prize claim form to be completed and returnedto the lottery within 14 calendar days of the drawing.

(g) If the entry is determined to be ineligible, it shall bediscarded by the security person present and another en-try drawn. This procedure will be repeated until validselections are obtained.

(h) All entries remaining in the drum or receptacle afterthe winners have been selected and certified and all en-tries received pursuant to these rules through and includ-ing September 2, 2008, shall be retained for the bonusgrand prize drawing. Article 101.—ELECTRONIC GAMING MACHINESAT RACETRACK GAMING FACILITIES

111-101-16. Internal controls. (a) No racetrackgaming facility manager shall place or permit the opera-tion of electronic gaming machines at a racetrack gamingfacility unless the following criteria are met:

(1) The racetrack gaming facility manager has submit-ted to the executive director policies and procedures es-tablishing a system of internal controls at the racetrackgaming facility to ensure the safe handling and move-ment of money and money equivalents and the mainte-nance of timely and accurate accounting information anddata; and

(2) the policies and procedures establishing a system ofinternal controls are approved by the executive directorin writing.

(b) The policies and procedures establishing a systemof internal controls submitted by a racetrack gaming fa-cility manager shall provide reasonable assurance thateach of the following conditions will be met:

(1) Financial records and reporting will be accurate, re-liable and prepared on a timely basis;

(2) potential for error and fraud is minimized;(3) money and money equivalents will be safeguarded;(4) access to gaming machines, currency, coins, and to-

kens is restricted;(5) each job function has a proper segregation of duties;(6) all assets are safeguarded;(7) financial transactions will comply with applicable

laws and regulations; and(8) efficient operations will be promoted.(c) Each racetrack gaming facility manager shall have

its policies and procedures establishing a system of inter-nal controls reviewed by a certified public accountant,who shall provide to the executive director a written re-port as to whether the internal controls submitted for ap-proval comply with this regulation, as well as generallyaccepted standards for internal controls used in the gam-ing industry.

(d) Each racetrack gaming facility manager shall havea certified public accountant review at least annually theoperations at the racetrack gaming facility and provide tothe executive director a written report as to whether thoseoperations are conducted in accordance with the policiesand procedures establishing the system of internal con-trols approved by the executive director.

(e) A racetrack facility manager who proposes tochange any of the policies and procedures establishingthe system of internal controls approved by the executivedirector shall submit the proposed changes to the exec-utive director for approval, along with a written verifi-cation by a certified public accountant that the proposedchanges comply with this regulation, as well as generallyaccepted standards for internal controls used in the gam-ing industry.

(f) Each racetrack gaming facility manager shall ensurethat its operations are conducted in accordance with thepolicies and procedures establishing the system of inter-nal controls approved by the executive director.
