FRIDAY, DECEMBER 16, 2016 (PAGE 16) DAILY EXCELSIOR, JAMMU SC threatens perjury, contempt proceedings against BCCI Prez NEW DELHI, Dec 15: The Supreme Court today threatened to initiate contempt and perjury proceedings against BCCI President Anurag Thakur for asking the ICC CEO for a letter but denying it on oath, warning he may have to go to jail if found guilty. The court reminded the BCCI top brass that Thakur as President of the board had asked for a letter from ICC CEO Dave Richardson that the appointment of a CAG nominee in the cricket body would compromise with autonomy and amount to gov- ernment interference. The bench, comprising Chief Justice T S Thakur, Justices A M Khanwilkar and D Y Chandrachud, pulled up the BCCI for trying to mislead the court and warned Thakur that he may land in jail if the apex court pronounces its order in perjury proceedings. "Why are you trying to mis- lead the court? If you want to escape perjury charges, you ought to apologise. At every stage you have been trying to obstruct. Everyone wants to go around and continue to hold the post even after 70 years. This is such a lucrative business that everyone wants to go on forever. "Freedom of expression allows you to disagree with the order but you can't obstruct implementation of order. Once we pronounce the order (in per- jury proceedings), you will have no other place to go except jail," the court said. The top court also referred to a letter by the current ICC Chairman Shashank Manohar and said even he has said that Thakur had asked for such a let- ter, which he had refused. While the bench was dwelling on the issue of Justice R M Lodha panel's suggestion to appoint former Home Secretary G K Pillai as an observer of BCCI, senior advocate Kapil Sibal, appearing for the board, said, "we have strong reserva- tions but I don't want to come out with the reason in public domain". However, expressing its strong displeasure against Anurag Thakur's conduct, the bench said "If you are asking for a letter from ICC, we prima facie feel that you are in con- tempt and we also prima facie feel that you are liable for per- jury and we are inclined to launch prosecution." "Manohar is very clear. You did ask him to write a letter from ICC that CAG nominee in BCCI would affect the autonomy of the board. What was the occa- sion for you to raise this and say so? CAG nominee was for main- taining the transparency. "What was the occasion to raise this issue after the judge- ment of this court? How can you tell ICC CEO to give a letter that what this court has said in its judgement about CAG nominee amounts to governmental inter- ference. This amounts to per- jury," the bench said. The apex court said that by asking the ICC to write such a letter, BCCI has intended to defeat the purpose of the verdict, that too when the bench had made it clear that appointment of CAG nominee would bring about transparency in the cricket body. On the issue of Thakur ask- ing ICC for letter, Subramaniam said that Manohar had also said that the letter was asked for. "He (Thakur) is prima facie in contempt of court and perjury both. How can we have such a person at the helm of affairs who is prima facie in contempt of the court," he asked. He also suggested that besides Pillai, two more persons should be there in the panel of observers to oversee the affairs of BCCI. When the bench asked him to suggest some names for it, he referred to the names of former CAG Vinod Rai and retired cricketer Mohinder Amarnath. On July 18, the court had accepted major recommenda- tions of the Lodha Committee on reforms in BCCI, including a bar on ministers and civil ser- vants and those above 70 from becoming its members, but left it to Parliament to decide whether it should come under RTI or whether betting on the game should be legalised. The apex court had also accepted the recommendations of the Committee headed by retired Chief Justice of India Justice R M Lodha to have a CAG nominee in BCCI. The bench had, however, rejected BCCI's objection against recommendations for 'one-state, one-vote' and said that states like Maharashtra and Gujarat having more than one cricket association will have voting rights on rotational basis. The bench also accepted the recommendation that one person should hold one post in the cricket administration to avoid conflict of interest and scrapping of all admin- istrative committees in BCCI after the CAG nominee comes in. The apex court-appointed Lodha Committee had on January 4 recommended sweep- ing reforms and an administra- tive shake-up in the troubled BCCI. (PTI) India eye biggest-ever win, England aim to salvage pride CHENNAI, Dec 15: Cricket will provide the rav- aged city some succour and the Indian team an opportunity to record its biggest-ever series victory against England when the two sides lock horns in the fifth and final Test starting here tomorrow. The match will also be a chance for the Indians to stretch their unbeaten run to a record 18 matches. The southern metropolis has been ravaged by Cyclone Vardah that left in its wake, large-scale destruction. The catastrophe did not spare the iconic Cheapauk either, but the square and the outfield have not been damaged. Opting to bat, India U-19 scored 289 for 8 with opener Prithvi struck 12 boundaries and a six in 79 balls. Malaysia were bundled out for 54 in 22.3 overs. STC dominates on Day-1 of Senior State Basketball Excelsior Correspondent JAMMU, Dec 15: SAI Training Centre Jammu estab- lished their supremacy on the Day -1 of the Senior State Basketball Championship which got underway at the MA Stadium here today. Besides the STC, the men teams of Jammu, Udhampur and Kathua districts also gave spirit- ed performances in their respec- tive matches. Eight matches were played on the first day of the championship being organ- ized by the J&K Basketball Association. In the first match of the day, STC club, the team of the younger players outplayed their experienced counterparts from Jammu district by 52-50 in a cliffhanger. The winning team was trailing by 21-27 at the half time. Abhinav Sharma was top scorer for the winners with 20 points and was ably assisted by Gourav Rajwal, Shivam Heer and Sumit Kumar. A patriotic song being presented by the students while cele- brating KVS Foundation Day in Udhampur. 65th All India Police Hockey C’ ship Punjab to lock horns with CRPF in summit clash today Excelsior Sports Correspondent JAMMU, Dec 15: Defeating their rivals convincingly in the semifinals today, CRPF and Punjab have sealed berths in the finals and will take on each other in the summit clash of the 65th All India Police Hockey Championship, being played at KK Hakhu Astroturf Hockey Stadium, here tomorrow. In the first semifinal, CRPF got better of ITBP by five goals to four (5-4) via tie-breaker. Both the teams finished goalless in the stipulated time and the decision of the match was left to tie-breakers, wherein CRPF emerged winner. For CRPF, Rajinder Singh and Arun Minz netted 2 goals each, while Sanjay Ekka scored one goal. For ITBP, the goal scorers were Jaswinder Singh, Harwinder Singh, Siraj Aalam and Jaswinder Singh. AK Choudhary, MD Police Housing Corporation was the chief guest in this match. However, expressing itsstrong displeasure againstAnurag Thakur's conduct, thebench said "If you are asking fora letter from ICC, we primafacie feel that you are in con-tempt and we also prima faciefeel that you are liable for per-jury and we are inclined tolaunch prosecution."

"Manohar is very clear. Youdid ask him to write a letter fromICC that CAG nominee in BCCIwould affect the autonomy ofthe board. What was the occa-sion for you to raise this and sayso? CAG nominee was for main-taining the transparency.

"What was the occasion toraise this issue after the judge-ment of this court? How can youtell ICC CEO to give a letter thatwhat this court has said in itsjudgement about CAG nomineeamounts to governmental inter-ference. This amounts to per-jury," the bench said.

The apex court said that byasking the ICC to write such aletter, BCCI has intended todefeat the purpose of the verdict,that too when the bench hadmade it clear that appointmentof CAG nominee would bringabout transparency in the cricketbody.

On the issue of Thakur ask-ing ICC for letter, Subramaniamsaid that Manohar had also saidthat the letter was asked for.

"He (Thakur) is prima faciein contempt of court and perjuryboth. How can we have such aperson at the helm of affairs whois prima facie in contempt of the

court," he asked.He also suggested that

besides Pillai, two more personsshould be there in the panel ofobservers to oversee the affairsof BCCI.

When the bench asked himto suggest some names for it, hereferred to the names of formerCAG Vinod Rai and retiredcricketer Mohinder Amarnath.

On July 18, the court hadaccepted major recommenda-tions of the Lodha Committeeon reforms in BCCI, including abar on ministers and civil ser-vants and those above 70 frombecoming its members, but left itto Parliament to decide whetherit should come under RTI orwhether betting on the gameshould be legalised.

The apex court had alsoaccepted the recommendationsof the Committee headed byretired Chief Justice of IndiaJustice R M Lodha to have aCAG nominee in BCCI.

The bench had, however,rejected BCCI's objectionagainst recommendations for'one-state, one-vote' and saidthat states like Maharashtra andGujarat having more than onecricket association will havevoting rights on rotational basis.

The bench also accepted therecommendation that one personshould hold one post in the cricketadministration to avoid conflict ofinterest and scrapping of all admin-istrative committees in BCCI afterthe CAG nominee comes in.
