NEW DELHI, July 30: Army Welfare Housing Organisation is nothing but an extension of the Army and comes under the ambit of the Right to Information Act, a full bench of the Central Information Commission has held. "We hold that the AWHO, though on paper a separate enti- ty, is nothing but an extension of the Army by virtue of being under the all pervasive control of the senior serving Army offi- cers, including the AG. We, therefore, hold that the AWHO is public authority under... The RTI Act," the Commission held. The Full Bench of the Commission comprising Chief Information Commissioner Satyananda Mishra and Information Commissioners ML Sharma and Vijay Sharma said regular deputation of Army offi- cers to the AWHO on the terms and conditions determined by the Defence Ministry also rein- forces the impression that in quintessence the AWHO is noth- ing but an Army organisation. AWHO was opposing bring- ing it under the ambit of the RTI Act arguing that it is a society registered with the Registrar of Societies with the objective of providing dwelling units to serv- ing and retired Army personnel and their widows on 'no profit no loss' basis. During the hearing, AWHO counsel explained at length that it is a private body where senior army officers are on its board of management are in their ex-officio capacity, hav- ing advisory role and do not get any renumeration from the organisation for their services. "In sum and substance, it is advocate Tewari's contention that despite overwhelming pres- ence of senior Army officers in the Board of Management of the AWHO, it is not controlled either by the Army Headquarters or by the Defence Ministry," the Commission noted in its order. On the other hand, RTI applicant Lt Col (Retd) R Bansal said the organisation was an inseparable part of army and presented a broad structure of the force where AWHO appears under the Adjutant General's branch. "Both the Chief of Army Staff and AG have complete control over the affairs of the AWHO. It is his contention that when Army is a public authority per se, the AWHO, being an inseparable part of the Army, cannot claim that it is not public authority under the RTI Act," the Commi-ssion noted. According to a senior offi- cial of the Crime Branch, the charge sheet has been filed against the three under various provisions of the IPC, includ- ing sections 384 (extortion), 120 B (criminal conspiracy) and 420 (cheating). The charge sheet was filed in the court of Chief Metropolitan Magistrate Amit Bansal. Chaudhary and Ahluwalia were earlier arrested in the case but they are presently on bail in the case filed by Congress MP Naveen Jindal’s firm. Regarding Chandra’s son and MD of Zee Entertainment Enterprises Ltd Punit Goenka, the police said they have not yet found any evidence against him but the probe into the case is still on. The Full Bench of theCommission comprising ChiefInformation CommissionerSatyananda Mishra andInformation Commissioners MLSharma and Vijay Sharma saidregular deputation of Army offi-cers to the AWHO on the termsand conditions determined bythe Defence Ministry also rein-forces the impression that inquintessence the AWHO is noth-ing but an Army organisation.

AWHO was opposing bring-ing it under the ambit of the RTIAct arguing that it is a societyregistered with the Registrar ofSocieties with the objective ofproviding dwelling units to serv-ing and retired Army personneland their widows on 'no profitno loss' basis.

Extortion case: Subhash Chandra, Zee editors chargesheeted

NEW DELHI, July 30:

Zee Group Chairman SubhashChandra and Zee editors SudhirChaudhary and Samir Ahluwaliawere today chargesheeted in acourt here in connection with thealleged Rs 100 crore extortion bidfrom Naveen Jindal’s firm, DelhiPolice said today.

According to a senior offi-cial of the Crime Branch, thecharge sheet has been filedagainst the three under variousprovisions of the IPC, includ-ing sections 384 (extortion),120 B (criminal conspiracy)and 420 (cheating).
