NEW DELHI, July 30:
Army Welfare HousingOrganisation is nothing but anextension of the Army andcomes under the ambit of theRight to Information Act, a fullbench of the CentralInformation Commission hasheld.
"We hold that the AWHO,though on paper a separate enti-ty, is nothing but an extension ofthe Army by virtue of beingunder the all pervasive controlof the senior serving Army offi-cers, including the AG. We,therefore, hold that the AWHOis public authority under... TheRTI Act," the Commission held.
The Full Bench of theCommission comprising ChiefInformation CommissionerSatyananda Mishra andInformation Commissioners MLSharma and Vijay Sharma saidregular deputation of Army offi-cers to the AWHO on the termsand conditions determined bythe Defence Ministry also rein-forces the impression that inquintessence the AWHO is noth-ing but an Army organisation.
AWHO was opposing bring-ing it under the ambit of the RTIAct arguing that it is a societyregistered with the Registrar ofSocieties with the objective ofproviding dwelling units to serv-ing and retired Army personneland their widows on 'no profitno loss' basis.
During the hearing, AWHOcounsel explained at lengththat it is a private body wheresenior army officers are on itsboard of management are intheir ex-officio capacity, hav-ing advisory role and do not
get any renumeration from theorganisation for their services.
"In sum and substance, it isadvocate Tewari's contentionthat despite overwhelming pres-ence of senior Army officers inthe Board of Management of theAWHO, it is not controlledeither by the Army Headquartersor by the Defence Ministry," theCommission noted in its order.
On the other hand, RTIapplicant Lt Col (Retd) RBansal said the organisation wasan inseparable part of army andpresented a broad structure ofthe force where AWHO appearsunder the Adjutant General'sbranch.
"Both the Chief of ArmyStaff and AG have completecontrol over the affairs of theAWHO. It is his contentionthat when Army is a publicauthority per se, the AWHO,being an inseparable part ofthe Army, cannot claim that itis not public authority underthe RTI Act," the Commi-ssionnoted.
To buttress his point, healso said that Board ofManagement of the AWHOentirely comprises Army offi-cers -- three Lieutenant Gene-rals, seven Major Generals anda number of Brigadiers andColonels.(PTI)
