SC threatens perjury, contemptproceedings against BCCI Prez

NEW DELHI, Dec 15:The Supreme Court today

threatened to initiate contemptand perjury proceedings againstBCCI President Anurag Thakurfor asking the ICC CEO for aletter but denying it on oath, warning he may have to go tojail if found guilty.

The court reminded theBCCI top brass that Thakur asPresident of the board had askedfor a letter from ICC CEO DaveRichardson that the appointmentof a CAG nominee in the cricketbody would compromise withautonomy and amount to gov-ernment interference.

The bench, comprising ChiefJustice T S Thakur, Justices A MKhanwilkar and D YChandrachud, pulled up theBCCI for trying to mislead thecourt and warned Thakur that hemay land in jail if the apex courtpronounces its order in perjuryproceedings.

"Why are you trying to mis-lead the court? If you want toescape perjury charges, youought to apologise. At everystage you have been trying toobstruct. Everyone wants to goaround and continue to hold thepost even after 70 years. This issuch a lucrative business thateveryone wants to go on forever.

"Freedom of expressionallows you to disagree with theorder but you can't obstructimplementation of order. Oncewe pronounce the order (in per-jury proceedings), you will haveno other place to go except jail,"the court said.

The top court also referred toa letter by the current ICCChairman Shashank Manoharand said even he has said thatThakur had asked for such a let-ter, which he had refused.

While the bench wasdwelling on the issue of JusticeR M Lodha panel's suggestion toappoint former Home SecretaryG K Pillai as an observer ofBCCI, senior advocate KapilSibal, appearing for the board,

said, "we have strong reserva-tions but I don't want to comeout with the reason in publicdomain".

However, expressing itsstrong displeasure againstAnurag Thakur's conduct, thebench said "If you are asking fora letter from ICC, we primafacie feel that you are in con-tempt and we also prima faciefeel that you are liable for per-jury and we are inclined tolaunch prosecution."

"Manohar is very clear. Youdid ask him to write a letter fromICC that CAG nominee in BCCIwould affect the autonomy ofthe board. What was the occa-sion for you to raise this and sayso? CAG nominee was for main-taining the transparency.

"What was the occasion toraise this issue after the judge-ment of this court? How can youtell ICC CEO to give a letter thatwhat this court has said in itsjudgement about CAG nomineeamounts to governmental inter-ference. This amounts to per-jury," the bench said.

The apex court said that byasking the ICC to write such aletter, BCCI has intended todefeat the purpose of the verdict, that too when the bench hadmade it clear that appointmentof CAG nominee would bringabout transparency in the cricketbody.

On the issue of Thakur ask-ing ICC for letter, Subramaniamsaid that Manohar had also saidthat the letter was asked for.

"He (Thakur) is prima faciein contempt of court and perjuryboth. How can we have such aperson at the helm of affairs whois prima facie in contempt of the

court," he asked. He also suggested that

besides Pillai, two more personsshould be there in the panel ofobservers to oversee the affairsof BCCI.

When the bench asked himto suggest some names for it, hereferred to the names of formerCAG Vinod Rai and retiredcricketer Mohinder Amarnath.

On July 18, the court hadaccepted major recommenda-tions of the Lodha Committeeon reforms in BCCI, including abar on ministers and civil ser-vants and those above 70 frombecoming its members, but left itto Parliament to decide whetherit should come under RTI orwhether betting on the gameshould be legalised.

The apex court had alsoaccepted the recommendationsof the Committee headed byretired Chief Justice of IndiaJustice R M Lodha to have aCAG nominee in BCCI.

The bench had, however, rejected BCCI's objectionagainst recommendations for'one-state, one-vote' and saidthat states like Maharashtra andGujarat having more than onecricket association will havevoting rights on rotational basis.

The bench also accepted therecommendation that one personshould hold one post in the cricketadministration to avoid conflict ofinterest and scrapping of all admin-istrative committees in BCCI afterthe CAG nominee comes in.

The apex court-appointedLodha Committee had onJanuary 4 recommended sweep-ing reforms and an administra-tive shake-up in the troubledBCCI. (PTI)

India eye biggest-ever win,England aim to salvage pride

CHENNAI, Dec 15:Cricket will provide the rav-

aged city some succour and theIndian team an opportunity torecord its biggest-ever seriesvictory against England whenthe two sides lock horns in thefifth and final Test starting heretomorrow.

The match will also be achance for the Indians to stretchtheir unbeaten run to a record 18matches.

The southern metropolis hasbeen ravaged by CycloneVardah that left in its wake,large-scale destruction. Thecatastrophe did not spare theiconic Cheapauk either, but thesquare and the outfield have notbeen damaged.

In their quest to get thevenue ready in time, the groundstaff were yesterday seen usingburning coal to dry the pitch tobe used for the match, whichwas rendered inconsequentialafter India wrapped up the serieswith a convincing win inMumbai.

Training was cancelled yes-terday owing to a wet ground, despite the stadium boasting ofone of the best drainage systemsin the country.

India are leading the five-match series 3-0 and should theytaste success in the final Test, itwill be their biggest against

England, the previous being the3-0 whitewash in 1992-93 underMohammed Azharuddin's cap-taincy.

It will be a sweet revenge forthe twin defeats, including a 4-0drubbing in 2011, which Indiasuffered at the hands of Englandin the last two series between thetwo nations.

Having clinched the rubber, skipper Virat Kohli has assertedthat India would now "reallyexpress ourselves fully" andhope to make it 4-0 againstopponents who are lookingbruised and battered.

Kohli has been in the form ofhis life, having become the firstIndian to notch up three doublecenturies in a calendar year.

Entering the game on theback of a monumental 235 inMumbai, Kohli is in no mood torelax and is expected to pilemore misery on the beleagueredEnglish outfit.

The 28-year-old, who isamong just five batsmen, includ-ing Don Bradman and RickyPonting, to amass three double-centuries in a single year, is 135short of bettering SunilGavaskar's (774 runs) record ofmost runs by an Indian in a sin-gle series.

Undoubtedly, Kohli willonce again be the cynosure of alleyes at Chepauk, which is host-

ing a Test after a gap of threeyears during which time Indiahave risen to number one in theICC rankings.

While Kohli loves to leadfrom the front, he has in his arse-nal an array of players who canproduce match-winning per-formances, be it with the willowor the ball.

With questions being raisedover his future as captain,Alastair Cook will be keen toturn around what has so far beena winter of discontent andrestore some pride before theygo into the Christmas break.

Both the teams are unlikelyto get a feel of the ground beforethe real action kicks off.
