ISRO to launch GSAT-6 communica-tion satellite on August 27DELHI

The launch of Geo-synchronous Satellite LaunchVehicle (GSLV) D6 carrying India's latest communica-tion satellite GSAT-6 is scheduled for August 27, IndianSpace Research Organisation said.

The launch of GSLV-D6 carrying GSAT-6 is scheduledat 1652 hours from Satish Dhawan Space Centre atSriharikota in Andhra Pradesh, ISRO said.

ISRO chairman A S Kiran Kumar had earlier said thatthe satellite would be for strategic application.

"It will give you a capability with very small hand helddevice to communicate, so like a small mobile you cancommunicate directly through the satellite to any otherpart, because the antenna size is very large, so it has gota signal grasping power much larger," he had said.

K Sivan, Director of Vikram Sarabhai Space Centre,Thiruvananthapuram, had said that cost of the 2.5 tonnevehicle would be around Rs 250 crore, adding that thelaunch of GSAT 6 is expected to give a huge impetus inthe field of communication sector in the country.

New Delhi: Two men have been sentenced to sevenyears in jail for trying to kill a person following a quar-rel over alcohol, by a Delhi court which said the modeand manner of the crime was detrimental to societalpeace.

Additional Sessions Judge Pankaj Gupta handed downthe jail term to Delhi residents Rahul Thakur and KarnailSingh for stabbing the victim, Vishal, in a drunken con-dition after he refused to give them more alcohol.

"The aggravating circumstances are that the convicts(Rahul and Karnail) had committed the offence by caus-ing injuries on the vital parts of the complainant at a pub-lic place in night time. The mode and manner of thecrime was detrimental to the societal peace," the judgesaid while also imposing a fine of Rs 10,000 on each ofthem.

The court while holding them guilty under section 307(attempt to murder) read with 34 (common intention) ofIPC, also noted that while committing the act, they knewthat it was imminently dangerous and in all probabilitycould cause death or such bodily injuries that were like-ly to cause death.

It relied on the victim's testimony and his medicalreport saying, "Vishal is the victim as well as the eye wit-ness to the incident and accused have failed to shake hiscredibility," and the injury caused to him was "dangerousin nature".

The court also observed that motive is only a piece ofevidence to corroborate prosecution case and even if it ispresumed that there was absence of motive, "even thenthe prosecution has successfully proved the case againstaccused".

According to the prosecution, on November 6, 2012,Vishal was sitting in office in Pitampura area here whenRahul and Karnail came in a drunken state and asked formore alcohol.

When Vishal refused and asked them to leave, theydragged him out of office and injured him with a knife onhis neck and nose and fled from the spot, it said, addingthat he was taken to a hospital by people nearby whoheard his scream.

The duo were arrested and chargesheeted for theoffence of attempt to murder.

AP Shah says no to Delhi Lokayukta postNEW DELHI

Law Commission Chairman A P Shah has turned downArvind Kejriwal government's proposal to appoint himas Delhi's next Lokayukta, a post which has been lyingvacant since November 2013.

"I have declined the offer," Shah, who is the formerChief Justice of Delhi High Court, told PTI here.

Delhi's last Lokayukta (state ombudsman) Justice(Retd) Manmohan Sarin had relinquished his charge inNovember 2013 after completing a five-year term.

The Delhi government had recently "sounded out"Justice Shah that his name is being proposed as the nextLokayukta. Justice (Retd) Shah, whose term as theChairman of the 20th Law Commission is coming to anend on August 31, refused to say anything further on theissue. He was appointed the Chairman of the law panel inNovember, 2013. As per the Delhi Lokayukta andUplokayukta Act, the Lokayukta is appointed after con-sultation with the Chief Justice of the Delhi High Courtand the Leader of the Opposition in the Assembly.

Kejriwal has promised to checkwhether he can reject the Rs. 60crore that builders Gopal and SushilAnsal have been asked to pay as fineby the Supreme Court in the Uphaarcase, the mother of two childrenwho died in the devastating fire atthe south Delhi cinema, hassaid.

Neelam Krishnamoorthy, whoseson and daughter were among 59people killed in the fire 18 yearsago, met Mr Kejriwal this morningand requested him not to accept themoney.

Mr Kejriwal's office said the gov-ernment will seek legal opinion onwhether rejecting the money will putthe Delhi government in contempt ofcourt or cause a constitutionalbreakdown.

On Wednesday, the Supreme Courtruled that the Ansals, who ownedUphaar cinema in south Delhi, willnot be jailed and ordered them topay Rs. 60 crore to be used by theDelhi government to build a newtrauma centre.

The Chief Minister has said thatthe Delhi government has theresources to build a trauma centre

and dedicate it to the Uphaar vic-tims. He reportedly told the familiesthat they could decide on a name forthe centre.

Mr Kejriwal has also agreed inprinciple to their demand for a newlaw with enhanced punishment forman-made disasters like the Uphaartragedy.

The Ansals were found guilty ofcausing death by negligence, whichcarries a maximum jail term of twoyears. In its order, the SupremeCourt restricted their jail term to the

period they have already spent inprison.

Sushil Ansal was jailed for fivemonths and Gopal Ansal for fourimmediately after the tragedy.

At Uphaar, routes to fire exits hadbeen blocked to plant extra seats,turning the cinema hall into a deathtrap when the fire broke out on June13, 1997, during a screening of theBollywood film "Border."

Most of the 59 people killed weretrapped in the balcony and died ofasphyxiation.

In the draft report, CAG has

reportedly said the firmsBSES Yamuna Power Ltd(BYPL) and BSES RajdhaniPower Ltd (BRPL), backed byReliance Infra, and Tata PowerDelhi Distribution Ltd hadinflated their previously-incurred losses.

The CAG report has allegedthat discoms manipulated con-sumer figures, bought costlypower, inflated costs and sup-pressed revenue and favouredtheir group companies.

According to reports, CAGhas also alleged that the dis-coms inflated their regulatoryassets by nearly Rs 8,000crore.

During the brief hearing,CAG counsel Rajeev Yadavtold the court that the govern-ment auditor had only for-warded the report to govern-

ment to seek its comments.Yadav also said the govern-

ment would in turn forward itto each of the discoms, theportions of report that pertainsto them to get their comments.

He also placed before thecourt a letter sent to the Delhigovernment along with thereport, in which CAG hadsought that confidentiality ofthe document be maintainedas the matter pertaining toaudit of discoms was sub-judice.

Delhi government also toldthe court that the CAG hadinvited comments from itwhich has been given.

The government also said itwas not going to act on thebasis of the report as it is notthe authority which wouldtake action.

"They may call itnegligence but I call itmurder by willful negli-gence," said MrsKrishnamoorthy, Presidentof the Association forVictims of UphaarTragedy, who has beenspearheading the fight forall these years.

"I would like them tomove forward and ensurethat they bring in a law...so the courts just don'taward punitive damagesand let them buy their free-dom at Rs. 60 crore," sheadded.

cated a steel bridge which they havesuccessfully placed below the existingelevated metro line at Rajouri Gardenin a six day long operation providing avital link to the 59Km long MajlisPark-Shiv Vihar metro corridor ofPhase III of the Delhi Metro Project.

The steel bridge span is 60 metreslong and weighs 350Metric Tonne andis located at the under constructionLine 7( Majlis Park- Shiv Vihar)Rajouri Garden intersection whichconnects Mayapuri and RajouriGarden under construction stations, asper DMRC press release.

This steel span was constructed toachieve the mandatory ground clear-ance of 5.50 metres which otherwisewas not available with the convention-al technique of building a box girderviaduct, as the Line 7 viaduct wasgoing under the existing Line 3(

Dwarka sector 21-Noida/Vaishali).The height of blueline’s (Dwarka-Noida/Vaishali)viaduct is 16.6 metres from the roadand line 7 viaduct is at 5.73 metres.

The various components and partsof the steel span were taken to the con-struction site and assembled in a sys-tematic way. The span was then"pushed" starting from pillar P157towards pillars P 156 at RajouriGarden intersection.

The steel span was pushed about 60mtrs to reach the final location. Thepushing work was started on 11thAugust, 2015 and was completed by17th August. About 12 ‘HILLMAN’rollers of capacity 200 MT each and 2nos. hydraulic jacks of capacity of50MT were engaged to complete thelaunching operation.

The launching of the steel span wascarried out in the night hours so as toavoid inconvenience to the road trafficduring the day time. Adequate trafficmarshals were deployed to regulatethe traffic. Usually, Delhi Metro usesspans of 31 metres for construction ofviaduct, but due to the presence ofheavy traffic on the ring road, thismammoth steel span which is muchlonger in length (almost double) hasbeen used to connect the upcomingRajouri Garden station with theviaduct joining the line further to theupcoming Mayapuri station.

NEW DELHIFinancial crunch has led the North

Delhi Municipal Corporation (NorthDMC) to discontinue an old-age pen-sion scheme since July last year, thecivic body told the Delhi High Courton Friday.

The corporation told the court it haswritten to Delhi government to con-sider merging the Old Age Pensionscheme with a similar one run by itsSocial Welfare Department.

Maintaining that the annual budgetunder the scheme was Rs 142.16crore, the North DMC also said thatsince the trifurcation of the MCD,North DMC's budget deficit was Rs500 crore in 2013-14, Rs 540 crore in2014-15 and Rs 700 crore as per thebudget estimate for 2015-16.

The corporation made the submis-sions in an affidavit filed after thehigh court on April 8 directed it totake a policy decision with regard toits pension scheme. The directive was

also issued to the East and SouthDelhi municipal corporations.

The court's direction had come on aPIL filed by NGO Social Juristthrough advocate Ashok Aggarwalclaiming that the municipal bodieshad stopped paying the pension underthe old-age/widow/disabled personspension and stipend scheme.

South Delhi Municipal Corporation(SDMC) on Wednesday informed thecourt that over 73,000 people wereeligible to receive the benefit under itsOld Age Pension scheme, but it hadpaid the amount to only 63,914 tillSeptember 30 last year, and the restwould be paid as soon as they provid-ed details of Electronic ClearanceService (ECS) or Real-time gross set-tlement (RTGS) systems.

On whether it intended to continuethe scheme, SDMC said the matterhas been placed before the standingcommittee of the corporation for tak-ing a policy decision.

The decision has been taken fol-lowing an intervention of HomeMinister Rajnath Singh as MsNasreen has been requesting theIndian government to further extendher visa. The 52-year-old writer'svisa was granted for a year witheffect from July 23, a Home Ministryofficial said.

Reacting to the decision, MsNasreen told PTI that she was veryhappy even though she was expecting

her visa to be extended by more thana year.

"Anyway, this is always a welcomenews. I am yet to be officially con-veyed (the government decision) and

you are the one who broke the newsto me," she said.

Taslima Nasreen, living in exilesince she left Bangladesh in a cloakof secrecy in 1994 in the wake ofthreats to her by fundamentalistgroups, was given a one-year visa bythe government in 2014.

A Swedish citizen, she has beengetting an Indian visa on a continu-ous basis since 2004.

She has also stayed in the US andEurope in the last two decades.However, on many occasions she hadexpressed her wish to live in Indiapermanently, especially in Kolkata.

for Home Kiren Rijijutoday said there is nomove by the central gov-ernment to imposePresident's Rule inManipur, but the strengthof central paramilitaryforces will be increased.

Inner Line Permit is anofficial travel documentissued by the central gov-ernment to allow inwardtravel of an Indian citizeninto a protected/ restrictedarea for a limited period.

Informing that the cen-

tral government hasdecided to send reinforce-ment to Manipur, MrRijiju said Assam Riflestroopers have beeninstructed to move for-ward to the zero point ofthe India-Myanmar bor-der.

"Earlier our forces(Assam Rifles) were 20 to40 km far away from theinternational borderexcept Moreh and someother points and in somepoint but we have decidedto send them closer to the

border to the zero point tosecure the border and itwill be a herculean taskfor them," the UnionMinister said.

Assam Rifles has thetwin responsibility ofguarding the 1,643-km-long India-Myanmar bor-der and also conductingcounter-insurgency oper-ations.

international India-Myanmar border wasaimed at preventing theIndian rebels from criss-crossing the border andcarry out attacks.

"All along, the AssamRifles troopers have notbeen able to move in tothe zero point of the inter-national border due tovarious reasons includingthe treacherous terrain butwe analysed those prob-lems and now we havedecided to move themcloser as part of the gov-ernment strategies to takeon rebels," a Union HomeMinistry official toldIANS on the condition ofanonymity.

No Proposal for President's Rulein Manipur, Says Kiren Rijiju

Maharashtra, want the Centre toamend the Right to Education Act andrevoke its no-detention policy for stu-dents of Classes I to VIII, a state min-ister has said. During a recent meetingheld by the Central Advisory Board ofEducation (CABE), most states urgedthe Union government to revoke itsno-detention policy as students tend tonot take their exams seriously, andthus it becomes difficult for them inClasses IX and X, Maharashtra'sMinister of State for Home RanjitPatil said.

"The CABE had convened a meet-

ing where we discussed the detentionof students in the same class. We havevery strongly conveyed to the Centrethat though this policy makes thingseasier in the short-term, it makes mat-ters difficult for them in Classes IXand X," Mr Patil said.

"Also, students should inculcate ahabit wherein they learn that one doesnot achieve anything until one workshard for it," he said.

Ministers from maximum states,who were present at the meeting, hadthe same view, he said, adding thatprimary, secondary, higher and techni-cal education issues were among otherthings discussed at the meeting. "We

apprised the Centre with whatMaharashtra has done in terms of edu-cation, steps taken by us like reducingthe weight of school bags. We alsosaid that NCC and NSS can be madeelective subjects," Mr Patil said. Theno-detention policy, a key componentof the RTE Act, was enforced on April1, 2010 with an aim to ensure thatevery child between the age of 6 and14 studies in school.

The idea behind the policy was tominimise the number of students whodrop out of the schooling systembecause of failure and are too embar-rassed or de-motivated to repeat ayear.

"The lift got stuckbetween the two floorsand its metal doors alsogot jammed at around11.30 pm last night. Therewas no lift operator orperson capable of han-dling such emergencyaround. They had to tear apartsteel doors of the elevatorto pull out Mr Shah andother leaders trappedinside.

Recounting the inci-dent, Mr Pandey said allattempts to open the

doors of the lift failed.The caretaker of the placewas also not of much usein the situation and peo-ple waiting on the groundand first floors of theguest house became anx-ious about the conditionof those trapped inside.

"Nothing worked andaround 40 minutespassed. It was then thatCRPF was asked to breakopen the doors. It did soand Shah and other lead-ers were rescued," MrPandey said, adding

"Once the doors werebroken, the trapped per-sons came out".

"It is a gross derelictionof duty and irresponsibili-ty shown by the peopleresponsible for facilitiesat the state guest house.There was nobody presentthere to deal with suchemergencies despite thefact that a person havingZ+ security cover wasstaying there," he said.

No government offi-cials are available forcomments.

Here are two stories inspired by real lifeevents, but only one with a happy ending.In the first story, a Danish actor fromCopenhagen visits her husband (aBrooklyn resident) with their child. Theyear is 1997. The other is about a youngcouple recently transferred to a privatecompany’s U.S. office where the husbandis employed. They are both Indians. Theyear, 2015.

One afternoon, the Danish motherdecides to have lunch with her partner andparks the baby in a stroller outside arestaurant on an East Village street as theyenjoy a leisurely meal. For her, this iscommon practice in Copenhagen,arguably one of the safest cities for chil-dren. Several passers-by see what theybelieve is an “abandoned and cryingchild”, and call emergency services.The police arrive and the couple isarrested for negligence.

In the second story, an Indian couplelive with their sons in Oregon. The moth-er decides to give up her career to care forthe two toddlers. One evening, the elderchild falls down and is hurt while playful-ly climbing on his father’s back. He isrushed to hospital where the parents areinformed about a hairline fracture of thetibia. Following treatment, the mother isinterrogated about what looks like a sus-picious injury, during which she innocent-ly remarks that the father “may have acci-dentally dropped the child”.

These two stories have a similar narra-tive: Immigrant parents, unaware of thepossible consequences of their conduct ina foreign country, and confronted with theultimate nightmare — the loss of theirchildren to child protection services.However, the subsequent events unfoldvery differently for the two families.

Like fish in water, we human beingsseem unable to view different cultures incontext. We are socialised into believingthat our ways are the best and those whodo not fit into our paradigm are consid-ered peculiar or perverse. Nowhere is thismore evident than in childcare practices.When people migrate, these dynamicsbecome more complicated.

Whether one culture’s practices will be

considered acceptable depends on severalfactors, especially the direction of move-ment. A shift ‘upwards’ to a more devel-oped country automatically marks peopleout as ‘immigrants’, while a move to aless developed country makes people‘expatriates’. In Delhi, such expatriatesretain their cultural and educational prac-tices by establishing little islands of theirown with minimal contact with Indians.

Same story, different outcomes

The consequences were dramaticallydifferent for the two stories. In thefirst case, the judg-ment wasu n a m -

bigu-ous: thepolice had actedhastily with the Danishcouple, interfering in what was a privatematter. “It was an innocent mistake, if youcan call it a mistake”, was the argumentadvanced. The case was closed and thecustody of the baby restored to the par-ents.

In contrast, the Indian couple is undertight scrutiny. The husband has beencharged with assault, and the family facesrepeated interrogation and assessment.During these sessions, the mother naivelymentioned aspects of their parenting,commonplace in an Indian home, but con-sidered abusive by the U.S. Departmentof Health and Human Services. Forinstance, unaware of the potential conse-quences, she said they were strict with thechildren, wanting to be perceived as goodparents. On being asked some leadingquestions, she said they frequently senttheir children to the play area, a well-litgarage. This did not go down well withthe evaluators. When the department wasgiven custody of the children, it declaredthe mother mentally unfit. She now faces

a prolonged legal battle to prove her fit-ness. According to media reports, the chil-dren will soon face an evaluation for men-tal “incapacity on account of theirupbringing”.

In a distressing trend, the conduct ofIndian children abroad is frequently beingpathologised as mental disorder by for-eign child protection officers on accountof perceived wrong parenting. In coun-tries such as Norway, the U.K. and theU.S., immigrant parents who happen tocome into conflict with child protection

services face

simi-lar patterns of hostil-

ity. Visiting care workers criticise theirlifestyle and childcare practices. It is nowonder that parents become defensive,distant and even indignant. As a conse-quence, they are deemed uncooperative.An emotional outburst from a parent usu-ally seals their fate — they are declaredunfit for parenting.

At no point are we implying that anIndian parent can do no wrong. Our argu-ment is that before a family is tormentedin this manner, abuse on the part of par-ents must be established beyond reason-able doubt. Otherwise, child protectionservices, originally conceived asguardians of human rights, become perpe-trators of the very crimes that they areauthorised to prevent.

There is adequate anthropological evi-dence to explain cultural differences inchildcare practices, and there is no onemethod that can claim to be the perfectformula for raising children. Social scien-

tists have also established that ecological,economic and social circumstances deter-mine methods of parenting.

Culture specific

Every culture has evolved its own prac-tices. For instance, among Indian fami-lies, sleeping with the child is consideredbeneficial to their sense of security.Letting a child ‘cry it out’ in isolation isdeemed extremely cruel. Other indul-gences allowed to children include feed-ing on demand, in contrast to the strictfeeding schedules typical of a Westernupbringing. Fresh food is prepared for

each meal and serving frozen food isconsidered an act of neglect.

Unlike the West, very fewpublic spaces prohibit the

entry of children.

These are justsome practices thatdemonstrate thedifferences inchildcare methods

between European-American communi-

ties and those in Indianhomes. Even the United

Nations Convention of theRights of the Child (UNCRC)

accepts this diversity while declaring thatparental responsibility is to be protectedfrom government interference.

There is no element in the UNCRC thatimposes on parents rules on how theyshould raise children. Between global,cultural, ethnic, familial and individualideologies, parents negotiate the care oftheir children. It is also to be noted thatIndian authorities do not adopt the moralhigh ground that child protection servicesin the West do when expatriates fromthese countries visit and settle in India.

Many Indians travel abroad on studyand work, often to provide for a betterfuture for their children. Ironically, theyrisk losing the very reason for which theyemigrate — their children. It is an issuethat needs immediate attention.

Cultural sensibilities matter in parenting

The near washout of themonsoon session ofParliament brought back

memories of the 2010 wintersession. Only, the protagonistshave now switched sides. In2010, it was the BharatiyaJanata Party (BJP), sitting inthe Opposition benches, whichwas the main player in disrupt-ing Parliament over the 2Gscam. Now, it’s the Congress,with far fewer members in theLok Sabha but significantlymore in the Rajya Sabha, whichhas managed to stallParliament. While the govern-ment and the Opposition tradedcharges and the publicbemoaned the deadlock, wemust not lose sight of oneimportant fact: disruptions arenow very much a part of estab-lished parliamentary practice inIndia. Trying to wish disrup-tions away is unrealistic; tryingto minimise them is in the bestinterests of democracy anddeliberation. Both the govern-ment and the Opposition havesignally failed in the latter.

The first thing to note is thatdisruptions and disorderlyscenes in Parliament are not ofrecent vintage. As far back as1952, the Preventive Detention(Amendment) Bill — accord-ing to the journalist B.G.Verghese — brought about “anunprecedented hullabaloo”.Again, in the third Lok Sabha,in 1963, when the OfficialLanguages Bill was introduced,there were strong protests bysome Opposition memberswhich a newspaper describedas the first time that such “dis-orderly scenes” were witnessedin the House. Two members,including SwamiRameshwaranand of the Jan

Sangh, had to be forcibly eject-ed by the watch and ward staff.That such behaviour was rare atthe time was apparent fromNehru’s comment: “I do notknow if that gentleman has theleast conception of whatParliament is, what democracyis, and how one is supposed tobehave or ought to behave.”That year, some members hadtried to disrupt the President’saddress to the two Houses, con-sidered a sacrosanct feature ofParliament. This too wasstrongly disapproved of byNehru, who said, “ThisParliament is supposed not onlyto act correctly but lay downcertain principles and conven-tions of decorous behaviour.”

‘Politics in the raw’

As I had highlighted in anarticle of mine published in2012, from the fourth LokSabha — the first withoutNehru present in the House —walkouts and disruptive behav-iour became more common.Former Secretary-General ofthe Lok Sabha and author of amulti-volume book onParliament, Subhash C.Kashyap, points out, “Thefourth Lok Sabha period maybe remembered for the funda-mental changes in the idiom,the style and culture of parlia-mentary politics. Hereafter, itwas politics in the raw withmuch of masks and gloves off.”Such disruptions became fre-quent since the 1970s, with aveteran journalist noting that“bedlam in both Houses has bynow become a daily routine,rather than an exception to therule.” Even someone as emi-nent as the Communist MP,Hiren Mukherjee, wrote in areport on the conduct of mem-

bers during the President’sAddress: “If… circumstanceshappen to be somewhat abnor-mal in the country, it mightconceivably be the duty ofOpposition parties inParliament to focus attention onthe people’s discontent even onsuch an exceptional occasion.”

House composition anddebate

It is true, however, that thetime lost to disruptions has dra-matically increased in the lasttwo decades. In the 15th LokSabha (2009-14), when theCongress-led UnitedProgressive Alliance (UPA)was in government, as much as40 per cent of the total time waslost to disruptions, making itthe least productive Lok Sabhaever. Indeed, there has been asecular rise in the time lost dueto disruptions in the last fiveLok Sabhas.

There are several reasons forthis. The first is the change inparliamentary culture. In thefirst decade of Parliament’sexistence, there was a fairdegree of homogeneity in thecomposition of the House, withmany of the leading MPs hav-ing been schooled in the tradi-tions of British parliamentarypractice. This was as true forNehru as it was for OppositionMPs such as Shyama PrasadMookerjee and HirenMukherjee. Besides, theCongress’s formidable majorityin the early years of Parliamentmeant that the Oppositionnever really had the numbers toseriously challenge the govern-ment. Hence, an Oppositionlegislator of the time ended adebate in Parliament with thewords, “We have the argu-

ments. You have the votes.”

The adherence to British par-liamentary norms graduallybroke down from the 1970s,which was also the time theCongress lost its dominance.The composition of the Housebecame even more heteroge-neous — in terms of both casteand class — completely trans-forming the tenor and idiom ofdebates. This process was has-tened in the late-1980s, whichsaw the establishment of coali-tion politics as well as newpolitical forces, particularly thesharp rise in the number of rep-resentatives from the OtherBackward Classes, unleashedby the Mandal Commissionreport. The changed composi-tion and diversity of Parliamenthad a significant impact on par-liamentary culture, which wasfar more permissive to disrup-tions and protests inside theHouse.

Beamed live

A second, and more recent,reason that helped fuel disrup-tive behaviour and theatricswas the live telecast of pro-ceedings inside the House.Though the Railway Budgetand Union Budget were telecastlive for the first time in 1992, itwas from 2006 that the entireproceedings of the Lok Sabhawere telecast live byDoordarshan. While the phe-nomenon of disruptions predatelive telecast of proceedings,live images and the explosionof television channels changedthe rules of the game. AsDevesh Kapur and PratapBhanu Mehta point out in ananalysis of Parliament: “In part,the overt tumult witnessed inparliament is a rational

response by MPs to the incen-tives created by the media,which gives greater coverage toMPs who engage in this behav-iour than those who busy them-selves in parliamentarydebates… many MPs believethat publicity, even bad public-ity, especially if it makes it tothe evening news is better thanno publicity.”

Over the last 25 years or so,disruptions have got a legitima-cy which they lacked earlier.This has meant that bothnational parties, the Congressand the BJP, along with theregional outfits have beenguilty of disruptions at differenttimes. Indeed, Union FinanceMinister Arun Jaitley, who hasbeen vocal in his criticism ofthe disruptions by theOpposition, himself had in thisnewspaper defended suchbehaviour in his capacity asLeader of the Opposition in theRajya Sabha: “Parliamentaryobstructionism should beavoided. It is a weapon to beused in the rarest of the rarecases… If parliamentaryaccountability is subverted anda debate is intended to be usedmerely to put a lid on parlia-mentary accountability, it isthen a legitimate tactic for theOpposition to expose the gov-ernment through parliamentaryinstruments available at itscommand.”

These words have come backto haunt the BJP. Though Mr.Jaitley and others in the gov-ernment have justified theirown disruptive behaviour whenin Opposition, in the cause ofserious issues like corruptionscandals, they have dismissedthe Congress’s tactics as pettyand personal. But once disrup-

tions are interpreted as legiti-mate “parliamentary instru-ments”, it becomes very awk-ward to brand someone else’sprotests as illegal.

Monsoon session

The Speaker has the power,under Rule 374(A) of the gen-eral Rules of Procedure andConduct of Business, to ejectand suspend members who dis-rupt proceedings. And the LokSabha Speaker, SumitraMahajan, did suspend 25Congress MPs on August 3 forfive sessions. But such discipli-nary action, as in the past whenMPs have been suspended,often proves counterproduc-tive. In the current instance, itonly served to unite the entireOpposition which was prior tothat ready to part ways with theCongress on its disruptiveagenda.

The Congress leadership sawthe controversies aroundExternal Affairs and OverseasIndian Affairs Minister SushmaSwaraj and the BJP ChiefMinisters of Rajasthan andMadhya Pradesh as an easy anda highly publicised way toenthuse a moribund party. Theyfigured that protests on thefloor of the House were likelyto get far more media coveragethan hitting the streets. Unlikethe earlier parliamentary ses-sions, where the Congresscooperated on certain items oflegislation, in the monsoon ses-sion it made the mistake of pro-longing its disruptive tactics forfar too long. In the process, theCongress stalled the Goods andServices Tax (GST) Bill, withwhich it has no fundamentalquarrel, drawing a sharpresponse from industry. The

Treasury benches, particularlysenior BJP leaders, did not helpmatters by indulging in person-al attacks against the Congressleadership instead of trying toreach out and craft a workableconsensus. The entire episodereflected poorly on the floormanagement skills of the BJPand its Parliamentary AffairsMinister. It also registered theinability of the BJP to recog-nise that there is an Opposition,however anaemic, which needsto be brought on board; other-wise even a small Opposition,as has happened on earlieroccasions, can hold upParliament.

Finally, a word about PrimeMinister Narendra Modi.Despite his dramatic entranceto Parliament on May 20, 2014,when he touched his foreheadon the steps of ParliamentHouse, he has been a reluctantparliamentarian at best. Hisinterventions have been fewand rarely spontaneous orunscripted; for the entire mon-soon session he was silentinside the House.

Mr. Modi’s lack of engage-ment with Parliament is in con-trast to Mr. Atal BihariVajpayee who enjoyed the cutand thrust of debate. Theabsence of leadership, of thesort that a Nehru or Mr.Vajpayee provided, offeredfodder to the Opposition andcontributed to the parliamen-tary gridlock.

For the first time in India’s banking sector, theReserve Bank of India is giving out differentiatedbanking licences. The in-principle go-ahead given

on Wednesday to 11 ‘payments banks’ is, by the RBI’sown admission, an experiment — the latest in a long seriesof attempts to take banks to the unbanked. The pushtowards financial inclusion started with the nationalisationof 14 commercial banks in July 1969 through the BankingCompanies (Acquisition and Transfer of Undertakings)Ordinance, 1969. Then a second round came in 1980,involving six more commercial banks. With a view to eco-nomically mainstreaming rural areas, the Indira Gandhigovernment established regional rural banks by means ofan ordinance in 1975. But even 45 years later, all theseattempts have had little success in expanding banking cov-erage to the desired extent and scale: only 7 per cent ofIndia’s villages have a branch of a rural or commercialbank. The policymakers seem now to have finally under-stood that banking inclusion cannot be just one amongmany businesses of a bank: it has to be the core business.The licensing condition that puts a Rs. 1-lakh cap ondeposits that payments banks can receive from customersdefines the market they will target — primarily theunbanked population. The RBI expects payments banks totarget migrant labourers and the self-employed, besideslow-income households, offering low-cost savingsaccounts and remittance services so that those who nowtransact only in cash can take their first step into the for-mal banking system. Going by the international experi-ence, this innovation of basically transforming a citizen’smobile phone into a stripped-down bank branch has agreater chance of success. The initiative takes Vodafone’sM-Pesa closer to the version that is working successfullyin Kenya, where payments on this product constitutedabout 30 per cent of the country’s GDP in 2014. Similarproducts in India so far were essentially mobile applica-tions dependent on tie-ups with banks to make cash with-drawals and interest payments. The licence frees thesecompanies to provide such services on their own. Thegreater operational flexibility will enable them to draw inmore customers. Their operations could now become morecost-effective as the licence-holders will be banks in theirown right, albeit without the provision to extend loans toindividuals. If they indeed succeed in becoming the targetmarket’s chosen mode of financial transactions, this tech-nological solution could also turn out to be a major step inachieving a truly cashless economy. So, while this is abold move, and underscores that the RBI is anything butconservative, it is ironical too that the cycle of experi-ments that started with the 1969 round of nationalisationhas now come full circle. The responsibility of financialinclusion is now almost entirely entrusted to the privatesector.

Won't 'Take...signal, India said, that it will prevent them

from meeting with Mr Aziz at the PakistaniHigh Commission on Sunday.

Sources in Pakistan said the meeting withthe Hurriyat leaders has been rescheduled toMonday - that is being by some as an attemptto offer a compromise. If the separatists meetwith Mr Aziz after the NSA talks are held,India can claim that the Hurriyat was not con-sulted and made a third party to the dialogue;equally, Pakistan can declare that it did notrevoke the invite to the separatists.

However, sources in the Indian governmentsay that no conference of any sort betweenMr Aziz and the Hurriyat is tolerable.

"India has advised Pakistan yesterday thatit would not be appropriate for Mr SartazAziz to meet with Hurriyat (separatist) repre-sentatives in India," foreign ministryspokesman Vikas Swarup said on Twitter.

Pakistan has, in the past, described suchmeetings with pro-independence leaders as a"longstanding practice" to "facilitate mean-ingful discussions".

Though earlier governments have grudg-ingly accepted such meetings, the NarendraModi administration cancelled foreign secre-tary talks between the two countries last Julyover a similar invite to the separatists.

Prime Minister Modi met Pakistani coun-terpart Nawaz Sharif during a visit to theRussian city of Ufa last month, with the hour-long talks seen as a new thaw in ties betweenthe countries.

No Redlines...Hurriyat feels that if both the countries are

able to carry forward the dialogue processwith sincerity, the amalgam has no issuewhether to join the process of dialogue nowor later.

"Hurriyat is desirous of a meaningful dia-logue (between the two countries) to settle alloutstanding problems, especially the coreissue of Kashmir," he said adding "sideliningKashmir or ignoring the Kashmiris won'thelp."

"Kashmir is not a boundary dispute or aregional problem but linked to the future of1.25 crore population. The issue could beresolved only by taking into consideration thewishes and aspirations of the people of thestate," he said.

He also said that the people of Kashmir are"not the third but the basic party to the issueand enjoy ownership rights".

"Hurriyat was always desirous of strongrelations between India and Pakistan so that aconducive atmosphere is created to pave wayfor resolution of all outstanding issues," headded.

Terming Kashmir as the "biggest hurdle",he said the two countries cannot improvetheir relations till the Kashmir issue remainsunresolved.

that any meeting between the Kashmiri sepa-ratists and the Pakistani delegation is unac-ceptable. Pakistan has asserted that it will notcancel a meeting with the separatists.

While sources at the Centre said that theeffort would be to keep the separatists fromleaving Srinagar for Delhi, the People'sDemocratic Party of Jammu and KashmirChief Minister Mufti Mohammad Sayeed hasreportedly refused to arrest or detain them inthe state capital.

The PDP has argued that no state govern-ment has ever disallowed the separatists frommeeting visiting Pakistani leaders in Delhi.

Separatists Yasin Malik, Syed Ali ShahGeelani and Mirwaiz Umer Farooq wereplaced under house arrest in Srinagar yester-day, but were released within two hours,reportedly after Mehbooba Mufti, who headsthe PDP and is the chief minister's daughter,intervened.

While the detention was described by theCentre as a signal that the separatists "cannotbe a third party to talks" and that they couldbe detained again if they tried to meet thePakistani delegation, the quick release wasseen as the state government's position on thematter.

lower demand from corporates for its serv-ices.

Shares of the world's No. 2 PC maker,which also forecast full-year adjustedprofit largely below estimates, fell asmuch as 4 percent in extended trading onThursday. Chief Executive Meg Whitmansaid the factors pressuring the PC marketwere expected to continue through thefourth quarter and well into the next fiscal

year. The 76-year-old company, which hasstruggled to adapt to mobiles and onlinecomputing, is splitting into two listedcompanies later this year, separating itscomputer and printer businesses from itsfaster-growing corporate hardware andservices operations. HP is nearing the endof a multi-year restructuring underWhitman, who has been cutting costs andfocusing on higher-margin sales. The planincludes the elimination of about 55,000jobs. Chief Financial Officer CathieLesjak said the company expects the num-

ber of job cuts to increase by up to 5 per-cent by the end of October. A relentlessdecline in PC sales has hurt the companyhard - HP has reported a drop in quarterlysales in 15 of the last 16 quarters.

The decline in global PC sales was exac-erbated in the second quarter of 2015 ascustomers awaited the release of Windows10 in July. As a result, revenue at HP's per-sonal computer and printer businesses, itslargest, fell 11.5 percent in the third quar-ter ended July 31. Enterprise services divi-sion sales dropped 11 percent, while rev-

Friday issued notice toBCCI on a petition byChennai Super Kings chal-lenging the order of JusticeLodha Committee sus-pending it from the IndianPremier League over the2013 betting scam involv-ing its top officialGurunath Meiyappan.

A division bench, com-prising Chief JusticeSanjay Kishan Kaul andJustice T S Sivagnanam,also allowed CricketAssociation of Bihar, onwhose plea the SupremeCourt had directed probe inIPL-6 betting and spot fix-ing scandal, to implead inthe case.

The court adjourned thehearing to next Thursday.

In its petition, city-basedIndian Cements Ltd, ownerof Chennai Super Kings(CSK), also sought a stayon the committee's lastmonth order.

It contended that thecommittee's order wasagainst fundamental prin-ciples of natural justice anda fair hearing.

Dhoni-led CSK andRajasthan Royals were onJuly 14 suspended for twoyears from the League fol-lowing the 2013 bettingscam involving their topofficials Meiyappan andRaj Kundra.

Son-in-law of the thenBCCI chief N Srinivasan,Meiyappan, a former TeamPrincipal of CSK, and

Kundra, co-owner ofJaipur IPL that runsRajasthan Royals (RR),were suspended for lifefrom any matches conduct-ed by BCCI.

The punishments werehanded down by a three-member panel headed byformer CJI R M Lodhawhich was asked by theSupreme Court to decidethe quantum of punish-ments after finding themguilty of betting.

India Cements, in itspetition, had contended

that imposing punishmenton the franchise (CSK)without going into thecharges or the offencecommitted was against theprinciples of natural justiceand a fair hearing.

It said refusal of JusticeLodha committee to enterinto the dispute of whetherIndia Cements was guiltyof violating clause 4.1.1.ofIPL operation rules had ledto "grave miscarriage ofjustice".

While referring to theSupreme Court order inJanuary last, the petitionsaid "Gurunath Meiyappanhad been (found) guilty ofbetting but not spot fixing,match fixing or misuse ofi n s i d einformation...Meiyappaannever had shares in IndiaCements nor was he is inthe management of thecompany."

The judges adjourned thecase for further hearing toAugust 27.
