Manila recommends criminal charges Probe points to criminal negligence on part of skipper, owner of 'Solar I'

Justice officials recommended criminal charges against the skipper and owner of a tanker that caused one of the nation's worst oil spills off a central Philippine province. Justice Undersecretary Ernesto Pineda told a news conference that an investigation showed there was criminal negligence on the part of the skipper and owner of the tanker Solar I, which sank in rough seas on Aug 11 off Guimaras island. The charges have to be approved by Justice Secretary Raul Gonzales, Mr Pineda said.

The tanker spilled some of about two million litres of bunker oil it was transporting from northern Bataan province to the southern Philippines, affecting a 220-kilometre stretch of coastline that includes pristine marine reserves. About 26,000 villagers dependent on fishing have been displaced. The United States and Japan sent experts to help Philippine authorities contain the oil spill. Guimaras, about 500 kilometres south of Manila, was placed under a 'state of calamity', which authorised officials to use emergency funds.

Mr Pineda said he recommended criminal charges against the tanker's skipper, Capt Norberto Aguro, and owner, the Sunshine Maritime Development Corp. The owner of the bunker fuel, Petron Corp, the country's largest oil refiner, could face civil liability, he said. Capt Aguro acknowledged during questioning that he violated a number of shipping regulations in handling the Solar I and proceeded with the journey even after the tanker took in water because of an unspecified problem, Mr Pineda added. The oil spill struck a region known for its marine reserves, rich fishing areas and popular beach resorts. It also exposed weaknesses in the government's ability to deal with such accidents.

ETV FOR CAIRNS THE Australian Government Minister for Transport and Regional Services, Warren Truss ahs commissioned the ETV Pacific Responder, a dedicated emergency towage vessel (ETV) which will be based in Cairns. Mr Truss said that unlike in most other regions, none of the available tugs in the northern Great Barrier Reef are suitable to carry out ETV tasks. "The Australian Government, for this reason, has agreed to fund the ETV Pacific Responder to service the northern Great Barrier Reef and Torres Strait areas. This is the only vessel of its type in Australia and will spend the majority of its time patrolling at sea.” He announced: "Australian Maritime Systems Ltd, working with Swire Pacific Offshore, has won an eight-year contract to provide the services managed by the Australian Maritime Safety Authority (AMSA). The emergency towage component of this contract is about A$9m (US$6.9m) per annum. This will be collected from the shipping industry through the Protection of the Sea Levy. "To offset the vessel's operating costs, the ETV Pacific Responder will also be engaged in services to maintain the national navigation aids network in the region. However, the ETV tasks will always take precedence over maintenance duties," he added

At least 20 Feared Dead in Ghana Boat Sinking More than 20 people are feared dead after a passenger boat capsized on Lake Volta in Ghana. Officials say 20 people have been rescued. Officials say it is not yet known how many people were on board the vessel when it sank Monday.

Boat Owners Association Chairman Kofi Baako says it will take three days to determine the actual number of casualties. Reports say the boat was traveling across Lake Volta from Drubin, in the Northern Region, to Yeji, in the Brong Ahafo Region, when it was hit by a storm. The incident is the second major boat disaster in five months on Lake Volta, which covers 8,500 square kilometers, more than three times the size of Luxembourg. The Brong Ahafo Regional Coordinator of the National Disaster Management Organization, Nana Atta Afena, told a local radio station the search is still underway. "That particular boat has been marked as not very competent to be on the Volta Lake," said Afena. "Because Ghana Maritime Association has declared that particular boat unfit or not safe to travel on that river, but what I heard was that there was a rainstorm and there was a heavy wind and that resulted in that accident." Afena also says boat accidents are common on Lake Volta, adding that many are due to overloading and sub-standard vessels. Last April, a boat carrying about 120 people, twice the number of authorized passengers, capsized in the Afram Plains region, whiles traveling across the lake. The actual number of people who died in that accident is yet to be established, as the local people disputed the official death toll of about 10. A committee set up by the government to investigate that incident has not submitted its full report.

New Navy submarine arrives in Galveston for commissioning

Texas The Navy's newest submarine has arrived in Galveston for a commissioning ceremony this weekend. The Texas docked in preparation for Saturday's scheduled commissioning by first lady Laura Bush. That's when the vessel will officially earn a "USS" designator. The tall ship Elissa, which was built in 1877, guided the submarine into Galveston's harbor. Galveston Mayor Lyda Ann Thomas and other city officials invited the submarine's 150 crew members to make the most of their week on the Texas coast.

Security was tight for the arrival of the submarine, which will be based in Groton, Connecticut. Construction of the two-point-seven (b) dollar vessel began in 2002. It weighs 78-hundred tons, measures 377 feet long and can remain submerged on covert surveillance up to three months.

Chinese warships to visit Pearl Harbor Chinese warships are scheduled to sail into Pearl Harbor on Wednesday for exercises with the U.S. military - the first visit by a Chinese navy ship to a U.S. state in six years.

The port call, aimed at deepening understanding between the U.S. and Chinese navies, comes as the two Pacific powers cautiously rebuild military relations that collapsed after a U.S. spy plane and a Chinese jet fighter collided off the coast of China in 2001. The Qingdao, a Luhu-class guided missile destroyer, and the Hongzehu,a refueling ship, are due to arrive at Pearl Harbor for four days of exercises, personnel exchanges, and touring. The vessels are scheduled to head to California on Saturday - either to San Diego or Long Beach - before sailing to the Canadian port of Victoria and the Philippines on their way home.

The trip marks the first visit by a Chinese warship to the U.S. since 2000, when the Qingdao visited Pearl Harbor and Everett, Wash. In 2003, two Chinese navy vessels called on Guam, a U.S. territory in the Western Pacific. Capt. Joseph Skinner, who heads the Pacific Command's Northeast Asia planning, said Tuesday the visit offered the United States an opportunity to learn more about an emerging naval power. "Many of the countries in the region are

concerned when they start buying submarines, when they start buying cruise missiles, ships," Skinner said. "Is it a peaceful intention or military projection of power in the future?" Capt. Jeff Alderson, a Pacific Command spokesman, said the port visit was a building block toward establishing better ties that could help the United States avoid situations like the spy plane collision. "We didn't know who to call. We didn't know what to do, we couldn't talk to each other," Alderson said of the 2001 incident when a Chinese fighter veered into a Navy EP-3 surveillance plane in international airspace over the Sea of Japan. The Chinese pilot died and the damaged American plane was forced to make an emergency landing. The top U.S. Pacific commander, Adm. William Fallon, has visited China three times since taking office about 18 months ago. He has urged China to be more transparent about what it plans to do with its growing military power.

ST1 Reduces Availability Costs for Ohio Class Submarines

Submarine Team One (ST1), Team Submarine’s cross-organizational group tasked with reducing submarine maintenance costs, has continued its efforts by pushing for the removal of bore sand from Ohio Class submarine's main propulsion shafts during availabilities. In previous Ohio Class maintenance availabilities, the propulsion shaft was removed from the submarine, restored by the shipyard, refilled with bore sand, and then re-installed. Refilling the shaft with sand is a costly and time-consuming process so ST1 used USS Nevada as a test platform for leaving the shaft empty. Sea Trials following Nevada’s refuelling overhaul showed no change in the acoustic signature, and the initiative was deemed a success on August 10. ST1 consists of Commander, Naval Submarine Forces; Commander, Submarine Forces Pacific Fleet; NAVSEA Deputy Commander for Undersea Warfare; the Submarine Maintenance Engineering, Planning and Procurement Activity; NAVSEA Deputy Commander for Industrial Operations; NAVSEA Naval Nuclear Propulsion; Supervisor of Shipbuilding, Conversion, and Repair in Groton and Norfolk; and the Naval Shipyards.

Poland to revise shipyard strategy The Polish government said it will revise plans for restructuring its shipyards, seeking to save 16,000 jobs. Under pressure from the European Commission, Poland said it will come up with a new strategy to rescue the three Baltic coast shipyards that doesn't violate European rules on government subsidies. The European Union's executive agency estimates that the yards received 1.6 billion euros ($2.1 billion) in unlawful government aid since 2003. “The government has promised a change in its strategy for the shipyards,” said a Treasury Ministry spokeswoman. “The final version will be sent to Brussels today.” The commission will take several weeks to analyze Poland's plans and the EC could order the repayment of the aid if it determines that Poland broke EU subsidy rules.

Shipyard earnings to surge until 2008 Korean shipbuilders' earnings are forecast to improve through 2008 as the tight supply and demand balance allows them to pass on rising costs, said U.S.-based investment bank Lehman Brothers in a report. Lehman expects earnings at the shipyards to report a 64 percent growth over the 2006-08 period as revived interest in container ship investment amid continued demand for tankers and gas carriers is increasingly making global shipbuilding a seller's market. "At the same time, Korean shipyards are more keen on managing risk and costs by hedging their foreign exchange exposure and procuring lower-cost steel plates from China," the report said. It also noted that Korean shipyards' flexible vessel design capabilities are the key differentiating factor that positions them ahead of their Japanese and Chinese counterparts. Lehman's top picks were Hyundai Heavy Industries Co. among shipbuilders, and Samyoung M-Tek among vessel parts suppliers. Yet, it might not be all smooth sailing for Korea's shipyards after 2008 with Brazil, Russia, India and China rushing to build large shipyards to meet the growing demand for vessels to transport oil and raw materials, according to maritime information portal site Marine-net. The industrial expansion of the so-called "BRIC" economies to build more ships on their own could challenge Korea's position as the world's leading shipbuilder in a decade, industry sources said. "Japanese shipyards receive enough domestic orders to survive on, but Korean shipbuilders depend heavily on exports as they account for more than 95 percent of sales," said an official of the Korea Shipbuilders' Association. "The impact could be intimidating should the BRIC nations attain self-sufficiency in vessels." The biggest potential competitor, China, is building large-scale dockyards in Shanghai, Qingdao and Shandong Province on the country's eastern coast. After construction projects are completed in 2008, China's total shipbuilding capacity is projected to reach between 7 and 10 million gross tonnage annually. Korea's nine largest shipyards currently have the capacity to build about a million gross tonnage per year.

India, which had been passive in shipbuilding, is scheduled to invest more than $1 billion in building two large shipyards on the eastern and western coasts. The Indian government also plans to spend $200 million in improving existing shipyards. Awash with oil revenue, Russia also plans to build a new shipyard around the Baltic Sea. Several European shipbuilders are studying investment opportunities in the new dockyard where vessels as large as 100,000 deadweight tonnage are expected to be produced. In southern Brazil, construction of a new shipyard is on target to be completed by 2008. Some 200 billion won ($208.8 million) will be invested in the new facility with a 360-meter-long dock. To make up for the lack of technology, shipyards of the BRIC nations are purchasing shipbuilding know-how from Korea, Japan and Europe. A consortium led by Brazil's Atlantico signed an agreement with Samsung Heavy Industries Co. in July to receive technological support on shipyard construction and operation as well as design layout for ships. Samsung Heavy explained that the technology transfer will not affect domestic shipbuilding industry because Atlantico builds bulk carriers and tankers which are major products of China and Japan. Samsung Heavy said it gets a royalty of $14 million in exchange for its technical know-how on shipbuilding, shipyard layout and equipment installation. Atlantico plans to complete a 360-meter dock, capable of building 100,000 tons of ships per year, in the eastern industrial complex of Suape, Brazil, by 2008.

VT Halmatic Delivers Pilot Boat Since its introduction to the VT Halmatic range in 1993 a considerable number of Nelson 42 Mk11s have been built as

patrol boats. Operators of these boats include HM Customs and the Royal Gibraltar Police. VT Halmatic has also moulded many motor yacht versions and two pilot boats, for Venice and La Rochelle, which were fitted-out by yards in Italy and France. Due to the continued success of the venerable Nelson 40 VT Halmatic has designed a pilot boat based on the Nelson 42 Mk 11 hull. The customer for the first of class vessel are the Tenerife Pilots, who having admired a Nelson 42 patrol boat in service with Las Palmas Port Authority, chose the VT Halmatic Nelson 42 hull form over other options available from the VT Halmatic range.

Powered by twin 389hp MAN D2866LXE engines their new boat, which is named Abona P, features a resiliently-mounted wheelhouse offering very low noise levels & 72 db) at its 23 knot maximum speed. The VT Halmatic Nelson 42 Mk11 hull offers the legendary head-sea keeping qualities of the 40. Its extra beam affords better handling down-sea and in quartering-seas and the additional volume allows for greatly improved wheelhouse and machinery spaces as well as significantly wider side decks and larger boarding areas.

Trico Marine orders OSV's at Bender Trico Marine Services, Inc. says it has reached an agreement, effective September 1, 2006, to build two GPA 640, 210 ft offshore supply vessels for a total cost of approximately $35 million. The vessels will have diesel electric propulsion and class 2 dynamic positioning systems. Bender Shipbuilding & Repair Co., Inc. will build the vessels at its shipyard in Mobile, Alabama, with an expected delivery date for the first vessel in March 2008 and the second vessel in July 2008.

The agreement guarantees the construction costs of the vessels as well as technical specifications and contains penalties for late delivery. Trico expects to fund construction costs related to each vessel from cash and cash flow from operations. Trico President and CEO Trevor Turbidy commented, "We are pleased to announce the construction of these vessels, which is consistent with our previously announced strategy of upgrading our fleet in a fiscally responsible manner. These vessels address our customers' operating requirements and will have the ability to work in almost any market in the world. We are delighted that Bender will be constructing the vessels and we have the utmost confidence in their ability to deliver the vessels on each of their expected delivery dates in 2008." The vessels incorporate an additional deck level for increased accommodation of client personnel. Trico says that diesel-electric propulsion provides excellent fuel efficiency and lower operating costs for customers. These characteristics will make the vessel attractive for global deployment including specialized disciplines such as seismic, ROV, and subsea applications.

China builds shipyards to drive industry China will build three shipyards at Bohai Bay, the mouths of the Yangtze River and the Pearl River over the next five years, according to the national shipbuilding authority, which disclosed the information today. The country will enhance management in the shipbuilding industry from this year to 2010 by speeding up the construction of three major shipyards, and by enhancing the development of new ship types, establishing modern shipbuilding models and developing the building technology for ship accessories, according to China's medium and long-term shipping development plans. It is time for China to further develop its shipbuilding industry, said an official from the Commission of Science Technology and Industry for National Defense. China's shipbuilding industry is now at a critical stage where it can become even stronger, the official added. In the next ten years, China will face opportunities and robust demands from international markets as well as an improved domestic macro-economy, as shipbuilding centers around the world move from other countries to China, the official said. However, China still needs to face a series of challenges, such as fierce competition, industry uncertainties, weak innovation abilities and less-developed accessory building technologies, the official said. With the abundance of skilled human resources, a long coastline and a strong demand from the domestic market, China has been the third largest ship builder around the world for 11 years. Its proportion in the world's shipbuilding industry has surged from six percent in 2000 to 20 percent last year. China built 12 million deadweight tons of ships last year, accounting for 18 percent of the world's total, said Jin Zhuanglong, the spokesman of the commission.

Cape runs out of capacity to repair ships The Port of Cape Town is experiencing pressure on its ship-servicing and marine-surveyor services due to insufficient capacity, says Arthur James, head of maritime law at law firm Webber Wentzel Bowens. James has warned that if nothing is done, the city’s port might soon lose lucrative business to other ports such as Walvis Bay, Luanda and Maputo, costing jobs and economic growth. He said the ship repairs and oil-rig maintenance sector contributed R1,5bn a year to Western Cape’s economy. It could support as many as 2500 jobs when a large oil rig, for example, was being repaired. “So it is a huge contributor to the economic success of the region,” he said. Right now, the repair facility was stretched to capacity, and work was being lost. “The port therefore needs to capitalise on deep-sea oil prospecting and related rigs and vessels-servicing requirements off the west African coast — especially Angola.

“Developing this source of income and job creation is vital as it will provide a boon to the region,” said James. “New liquid and gas facilities are being created. Angola could become the new Nigeria. Since the surge in oil prices there are many parties looking to find oil in other parts of the world, so it’s an opportune time to invest or lose out,” he said. Cape Town Regional Chamber of Commerce and Industry CE Albert Schuitmaker agreed there was a problem. “If ports cannot provide the services, it’s a relatively small step in maritime terms to take the business to Walvis Bay which … is falling over backwards to attract business.” The National Ports Authority said it had called for proposals to develop a new ship-repair facility at the port’s Elliot Basin to ensure the industry’s sustainability. Billy Cilliers, planning man-ager of the Port of Cape Town, said the facility would be developed by a “selected consortium” on a long-term lease basis. Cilliers said the authority had already selected a “preferred bidder” for the development, and was finalising the negotiations mandate to conclude a contract between the authority and the preferred bidder. The new ship-repair facility would consist of a ship lift with multilane repair facilities, and increase the port’s ship-repair handling capacity, said Cilliers. However, it is believed the facility cannot be in place for at least two years — the time remaining on the Royal Cape Yacht Club’s lease on Elliot Basin. With the current facilities, ships have to book up to eight months in advance to have access to repair facilities. Asked if the Port of Cape Town was losing repair business, Cilliers said there had been a reduction recently in the number of vessels in certain sectors visiting Cape Town. This was influenced mainly by the strong rand and reduction in fishing quotas. The quota system is being challenged in the Equality Court, a court that hears claims of unfair discrimination. Two senior government officials, who were paid R100000 a month to restructure the industry, were found to have been moonlighting as private fisheries consultants. Cilliers said the ship-repair industry was dynamic, with many variables that influenced the volume of vessels moving through the facilities on a yearly basis.

De gebruikelijke twee afvaarten per week vanuit Rotterdam blijven ongewijzigd. Hetzelfde geldt voor de twee terminals die Unifeeder aanloopt, de ECT Delta en ECT Home terminal.

Hurtigruten on sale trail Hurtigruten is looking to sell off one modern vessel to make room for a newbuilding arrival in 2007. The Hurtigruten Group of Norway is planning to sell one of its modern cruise ferries. The 16,100-gt Midnatsol (built 1003), Finnmarken (built 2002) and Trollfjord (built 2002) each have a book value of NOK 700m ($111m).

The vessels are considered to be the flagships of the recently-listed coastal ferry operator. Hurtigruten has hitherto announced that it plans to dispose of elderly tonnage. Managing director Henrik Andenaes tells the Norwegian daily Dagens Naeringsliv that the company will next year take delivery of the 12,000-gt newbuilding Fram and that Hurtigruten will thus have one more ship than it needs. Andenaes stresses that a sale will not be a result of pressure from the banks. Any sale will be an ordinary sale and not a sale-and-leaseback deal as Hurtigruten has done in the past. The company has had poor results lately and is expected to log a NOK 100m loss this year. It posted a net deficit of NOK 79.76m ($12.71m) in the first half to 30 June, compared to NOK 36.54m in the same period of 2005. Hurtigruten operates 11 vessels along the Norwegian coast running simultaneous tourist cruises and cargo operations from Bergen to Kirkenes. It also runs 54 ferries in Nordland, Troms and Sunnmore. It now also has two cruiseships - the 11,400-gt vessels Nordnorge (built 1997) and Nordcapp (built 1996) - running between Chile and the Antarctic while another vessel to be deployed on cruises to Greenland is under construction.

Jack's flash for Chevron US supermajor Chevron has completed what it called "a record setting production test" at the Jack-2 well at Walker Ridge Block 758 in the US Gulf of Mexico. Chevron said the Jack well was completed and tested in 7000 feet of water, and more than 20,000 feet under the sea floor, breaking Chevron's 2004 Tahiti well test record as the deepest successful well test in the Gulf of Mexico. During the test, the well sustained a flow rate of more than 6000 barrels of oil per day, Chevron said.

The block partners plan to drill another appraisal well in the Jack structure in 2007. Operator Chevron first announced the discovery of the Jack prospect in September 2004. Chevron holds a 50% stake in the Jack field. Statoil and Devon each hold 25%. Jack lies 435 kilometres south-west of New Orleans, about 280 kilometres offshore.

Container vessel gets registered Another container vessel has been registered under Pakistan flag. It will ply between Port Qasim and Indian ports. However, private shipping companies believe that the Pakistan-India shipping protocol is the biggest impediment to the registration of vessels under Pakistan flag. “If the shipping protocol is not amended to allow lifting of a third-country cargo from ports of both the countries, the shipping industry in Pakistan could not grow,” they feel. The Mega and Forbes, which purchased Mega-I container vessel about two months back and had been successfully operating between Karachi and Jable-Ali with a capacity to carry 1,000 TEUs as a feeder service, has purchased another container vessel -– Mega-II -– and has informed the director general ports and shipping. After the induction of new vessel, the company will be better placed to serve Pakistani trade. At present 100 per cent containerised cargo is being lifted by foreign flag vessels. Furthermore, efforts are being made by the private Pakistani company to acquire a LPG vessel, and it is also learnt from a representative of Mega and Forbes Group that they are in the process of acquiring Mega-III and Mega-IV.

The ministry of ports and shipping after discussions with the Indian delegation had finalized the technical details and the same were approved by the cabinet. However, the ministry is awaiting approval of the Indian government which will be largely beneficial to ship owing under Pakistan flag as well as improvement of trade and commerce with India, opening new avenue of business for Pakistani ports.

Dual-Purpose Ship Receives Officers In Hamburg, one of the largest training ships in the world, the Chicago Express, has for the first time taken a group of future officers on board – eight nautical officer cadets have reported for duty. The 8,750 TEU container is the second training ship in the Hapag-Lloyd fleet. On August 31, the nautical officer cadets boarded the vessel at Container Terminal Altenwerder. They complete their time at sea (in total one year) towards qualifying to study at a nautical college. On October 19, the ship’s mechanic apprentices, who are learning a skilled trade, will follow. In total, alongside the crew, there will be 15 apprentices on board, aged between 18 and 22, coming from the whole of Germany, plus two training officers. During their deployment on the training ships, Hapag-Lloyd aims to encourage the trainees to get to know other countries, their peoples and cultures. When on shore, they will take part regularly in excursions. The Chicago Express, which was named in Korea in February this year, has a length of 335 m and measures at least 60 m from keel to superstructure. Displacing 104,000 t, she has slots for 8,750 standard containers. The vessel is deployed within the Grand Alliance framework in the Europe-Far East Trade on the round voyage calling Shanghai, Xiamen, Yantian, Hong Kong, Singapore, Southampton, Hamburg, Rotterdam, Port Kelang and again Hamburg.

DFDS buys Fjord Norway From Fjord Line in order to continue the Bergen-Haugesund-Stavanger-Newcastle route and sells

m.s. Princess of Scandinavia DFDS Seaways has purchased the passenger ship m.s. Fjord Norway from the Norwegian shipping company Fjord Line. She will be delivered 15 October 2006. After refurbishment and change of name, the vessel will be deployed on the previous Fjord Line route Bergen-Haugesund-Stavanger-Newcastle from the start of November, which will be a new route of DFDS Seaways’. "We are convinced that there is a large market potential, which will increase for passengers and for freight, on both sides of the North Sea, and we have at our disposal the necessary know-how to

develop operations with reasonable profit margins on this traditional route,” DFDS COO, Søren Jespersen, said. Fjord Norway will sail under Danish colours. A thorough refurbishment and upgrade will bring the ship up to DFDS standard. Fjord Norway has large public areas, seven restaurants, a nightclub, piano bar, a 500m2 tax-free shop, conference facilities and a play area for children. She has 501 cabins and can accommodate 1,600 passengers and 580 passenger vehicles. Freight capacity: 1410 lane metres. Fjord Norway is sister ship to KING OF SCANDINAVIA, which was acquired by DFDS Seaways in February 2006 and deployed on the Amsterdam-Newcastle route. As a consequence of the acquisition of the Fjord Line's route to England, DFDS Seaways’ current Gothenburg/Kristiansand-Newcastle route will close 1 November 2006 and the passenger ship PRINCESS OF SCANDINAVIA has been sold to interests abroad as a result. The parties have agreed not to disclose the sales and purchase price of the vessels.
