    The Main Points.

    Different types of claim statements are possible for differenttypes of products. Is your product a Health Food Product, an HerbalDietary Supplement Product, an Herbal Homoeopathic Drug Productor a Natural Cosmetic Product?

    The Food and Drug Administration (FDA) and Federal TradeCommission (FTC) require different levels of evidence to supportlabel claims or advertising claims depending on the type of product.

    Different Types of Products

    = Different Types of Claim StatementsThe claim statements that can be made on the label of a finishednatural product are determined by the regulatory framework that theproduct is subject to.

    the form of the product (e.g. herbal extract in capsule or tablet,

    juice drink, herbal tea or tincture, nutrition bar, spray, cream or gel,etc);mode of administration (e.g. topical, oral, nasal or enteral); andrecommended use(s)

    will place it into a particular regulatory category, i.e., dietarysupplement product, drug or non-drug cosmetic product, foodproduct, food for special dietary use, medical food product, andover-the-counter (OTC) drug product or prescription (Rx) drugproduct.

    Different Types of Products

    = Different Types of Claim StatementsThe types of acceptable claim statements are limited to certaintypes of products.

    In many cases claim statements are limited to specific definedsubstances that are expressly listed in a regulation to be allowedunder certain conditions.

    Each regulatory framework has very different requirements for:

    good manufacturing practice (drug, food or supplement GMPs);

    quality of the substance that is the subject of the claim;

    levels of evidence necessary to support a claim statement; and

    listing (drug) or notification (dietary supplement) requirements.

    Authorized Health Claim Statements

    Authorized Health Claim Statements are:

    allowable for certain dietary supplement products and

    certain food products;limited to claims about disease risk reduction; and

    cannot be claims about the diagnosis, cure,mitigation, or treatment of disease.

    Use of a health claim on a product label requires pre-marketing review, evaluation and authorization of theclaim by FDA.

    that characterize the documented mechanism by which anutrient or dietary ingredient acts to maintain such structure or

    function; provided that such statements are not disease claims (unlessthe claim is an authorized health claim for which the productqualifies).

    Non-drug cosmetics are defined as "articles intended to berubbed, poured, sprinkled, or sprayed on, introduced into, orotherwise applied to the human body

    Their labels may bear claims such as for cleansing, beautifying,

    promoting attractiveness, or altering the appearance"

    Non-drug cosmetics include skin moisturizers, perfumes,lipsticks, fingernail polishes, eye and facial makeup preparations,shampoos, permanent waves, hair colors, toothpastes, anddeodorants, as well as any material intended for use as acomponent of a cosmetic product.

    Cleansing / Beautifying Claim Statements

    A normal shampoo is a non-drug cosmetic because its intended use isonly to cleanse the hair. An antidandruff shampoo product is a drugbecause its intended use is to treat dandruff.

    Toothpaste for merely cleaning or whitening the teeth is a non-drug

    cosmetic while toothpaste that contains fluoride is a drug for preventingcavities.

    Deodorants are non-drug cosmetics unless they also containantiperspirant active ingredients.

    Skin moisturizers are non-drug cosmetic products unless the label bearssun-protection claims which would cause the product to become a drugproduct.

    Disease Claim Statements

    In the U.S., there are a few biodiversity products (botanicals) thatare classified as Generally Recognized as Safe and Effective(GRASE) active ingredients for specific over-the-counter (OTC) druguses.

    The labeling standards monographs, which provide the permitteddisease claim statements and/or structure/function claim statementsare published in either:

    a Final Monograph (FM) in the Code of Federal Regulations(CFR); or

    may appear in a Tentative Final Monograph (TFM) that hasbeen published in the Federal Register(FR).

    It is possible that a single natural ingredient could be allowed forseveral different recommended uses depending on the finishedproduct form, mode of application, the specified quality standardand the type of GMPs applied to manufacture the finished product.

    Peru is a producer and exporter of capsicum fruit powder as wellas extracts and oleoresins of capsicum fruit a.k.a. paprika oleoresin.

    Depending on the form, this Latin American botanical species canbe used in every type of product, dietary supplement product, drugproduct, food product, and non-drug cosmetic product, and even forpolice use or self-defense as a less-than-lethal force weapon forincapacitating dangerous or violently resisting suspects.

    Levels of Evidenceto Support Label Claims

    The manufacturer or marketer of a dietary supplement product making anutritional deficiency, structure/function, or general well-being claim musthave substantiation that the claim statement is truthful and not misleading.The substantiation file should be written by a qualified person.

    The FDA has published a guidance document: Guidance for Industry:Substantiation for Dietary Supplement Claims Made Under Section 403(r)(6)of the Federal Food, Drug, and Cosmetic Act.

    This guidance document is intended to describe the amount, type, and

    quality of evidence FDA recommends a manufacturer have to substantiate aclaim. The guidance document is available at the FDAs website.

    Levels of Evidenceto Support Advertising Claims

    FTC and FDA work together under a long-standing liaison agreementgoverning the division of responsibilities between the two agencies.

    As applied to dietary supplement products (DSPs):

    FDA has primary responsibility for claims on product labeling,

    including packaging, inserts, and other promotional materialsdistributed at the point of sale; and

    FTC has primary responsibility for claims in advertising, includingprint and broadcast ads, infomercials, catalogs, and similar directmarketing materials. Marketing on the Internet is subject to regulationin the same fashion as promotions through any other media.

    The FTC has published guidelines for levels of evidence to support claimstatements for the advertising of DSPs: Dietary Supplements: AnAdvertising Guide for Industry, which is available at the FTC website.

    Levels of Evidenceto Support Advertising Claims

    FTC has also developed Green Guides for the use ofenvironmental benefit claim statements e.g. biodegradable,compostable, photodegradable, recyclable, recycled content,refillable, and reusable.

    The FTC Green Guidesapply to environmental claims included inlabeling, advertising, promotional materials and all other forms ofmarketing, whether asserted directly or by implication.

    The guides apply to any claim about the environmental attributesof a product, package or service in connection with the sale,offering for sale, or marketing of a product, package or service.

    Acceptable and Non-acceptable ClaimsSelected Peruvian Natural Products

    This section provides examples of claims that have been made forPeruvian natural products in the U.S. market, some acceptable and somenot.

    Many Peruvian products have been the subject of Import Refusals, FDALetters of Objection, FDA 15-day Warning Letters, and Nationwide Recalls.

    Usually the reasons include non-acceptable claim statements or otherlabeling violations.

    Explanations are provided for acceptability or non-acceptability of claimsto help Peruvian companies better understand U.S. market accessrequirements for claim statements and labeling.

    FDA Notification

    No later than 30 days after the first marketing of a dietarysupplement product (DSP), the manufacturer, packer, ordistributor must submit a Notification Letter to FDA (a signedoriginal and two copies) which includes the text of thestructure/function statement among other required
