FOREWORD
It’s been an exciting journey for me personally to bring EDS to the level it is today. I find the cooperation between our four partners unique. We each bring our own knowledge, network and experi-ence to EDS, which has led to very good results and shown that you can achieve more together than individually.
EDS has an outstanding selection of horses: from green three-year-olds to elite talents and schoolmasters. Something for eve-rybody. Over the past years, horses which were sold through EDS have scored very well in the sport. This success has led to an invi-tation from the KWPN to organize an EDS auction in conjuncti-on with the World Championships for Young Dressage Horses in Ermelo, a honor of which we are proud.
Fortunately, we are not the only ones pleased with EDS. This year, even more people from the Netherlands and abroad are calling us to inquire about the collection and schedule appointments to view and ride the horses. Hopefully this year too EDS can ensure that many riders go home pleased with their horses. In any case, we wish them much success!

Tim CoomansFokker en sportliefhebber met zijn eigen opfok-, handels- en africhtingsstal ‘Tim Coomans Dutch Sport Horses’. Onder andere Steffen Peters, Sjef Janssen, Gonnelien Rothenberger-Gor-dijn en Imke Schellekens-Bartels reden (Olympische) teampaarden, afkomstig van Tim Coomans. Ook is Tim in 2012 uitgeroepen tot beste fokker van het jaar. Enkele paarden uit de stal van Tim: Olympic Bo, Lancet, Ziësto, TC Ravel, TC Dolly, TC Athene, Great Lady TC, Hannelinde TC en Dream Boy.
Joep SchellekensGroot liefhebber van paarden, werkzaam bij familiebedrijf Academy Bartels, waar hij sinds jaren verantwoordelijk is voor sales en acquisitie van paarden. Als echtgenoot van Imke Schel-lekens-Bartels was Joep betrokken bij de carrière van Imke met o.a. Sunrise, Lancet en Toots in het Olympisch kader en ze behaalde meerdere individuele en teammedailles op Europese- en Wereldkampioenschappen en Olympische Spelen. Enkele paarden die vanuit Academy Bartels succesvol aan topruiters over de hele wereld zijn verkocht: Lancet, Victoria, Jazz, Voice, Ziësto, Rhapsody en Toots.
Breeder and dressage lover. Has produced many tophorses with his sales and training stable ‘Tim Coomans Dutch Sport Horses’. Steffen Peters, Sjef Janssen, Gonnelien Rothenberger-Gordijn and Imke Schellekens-Bartels rode (Olympic) team horses of Tim Coomans. Tim was in 2012 ‘the best KWPN breeder of the year’. Some horses produced by Tim: Olympic Bo, Lancet, Ziësto, TC Ravel, TC Dolly, TC Athene, Great Lady TC, Hannelinde TC and Dream Boy.
Loves horses and works at Academy Bartels, where he is responsible since many years for sales and acquisition of the horses. Husband to Imke Schellekens-Bartels, Joep was involved in Imke’s career with horses such as Sunrise, Lancet and Toots, winning several individual- and team medals at European-, World- and Olympic Championships. Some of the horses that have been successfully sold to top riders all over the world: Lancet, Victoria, Jazz, Voice, Ziësto, Rhapsody and Toots.

Joop van UytertEigenaar van internationale hengstenhouderij met eigen KI station en dressuurstal. Hengsten-station van Uytert was Hippische Ondernemer van het jaar 2009. De toppaarden van Joop van Uytert worden uitgebracht door (Olympische) ruiters en amazones, zoals Anky van Grunsven, Edward Gal en Hans-Peter Minderhoud. Enkele toppers uit zijn stal: Gribaldi, Krack C, TCN Partout, Vivaldi, Tango, United, Zhivago, Bordeaux, Ferdeaux, Eye Catcher, Estoril, Easy Game en Painted Black.
Dutch Equestrian Entrepreneur of the Year in 2009. Joop is owner and director of his stud in Heere-waarden, near Den Bosch. He has produced many approved stallions. His horses have been compe-ting with (Olympic) riders such as Anky van Grunsven, Edward Gal and Hans-Peter Minderhoud. A few horses from his sadle: Gribaldi, Krack C, TCN Partout, Vivaldi, Tango, United, Zhivago, Bor-deaux, Ferdeaux, Eye Catcher, Estoril, Easy Game and Painted Black.

Nico WitteEigenaar van opfok-, handels- en africhtingsstal Stal Witte BV. Echtgenote Madeleine Witte werd in 2012 met Wynton en Vontango toegevoegd aan het Olympisch kader dressuur. Met Cennin is Madeleine recent toegevoegd aan het Olympisch kader en was ze eerste reserve voor de Olympische Spelen in Rio 2016. Tevens staat Madeleine op plaats 27 van de World Ranking. Internationale namen als o.a. Ulla Salzgeber, Morgan Barbacon, Matthias Rath, Hans Peter Minderhoud, Ashley Holzer, Sue Blinks, Tineke Bartels, Mary Hannah en Rozzy Ryan reden paarden afkomstig van Stal Witte BV, in de internationale Grand Prix. Nico heeft oog voor jong talent. Enkele voorbeelden: Jazz, Wynton, Bretton Woods, Charmeur, Vontango, Ampére, Franklin, Grand Galaxy en Daily Daimond.
Owner of Stal Witte BV, an equestrian center specializing in raising foals, training horses and sales. In 2012, Nico’s wife Madeleine Witte was added to the Olympic dressage cadre with Wynton and Vontango. Recently, Madeleine was added to the Olympic cadre with Cennin and was first reserve for the 2016 Olympics in Rio. In addition, Madeleine is 27th on the World Ranking list. Horses from Stal Witte BV have competed in the international Grand Prix under renowned riders inclu-ding Ulla Salzgeber, Morgan Barbaçon, Matthias Rath, Hans Peter Minderhoud, Ashley Holzer, Sue Blinks, Tineke Bartels, Mary Hannah and Rozzy Ryan. Nico has a great eye for young talent, examples of which include Jazz, Wynton, Bretton Woods, Charmeur, Vontango, Ampére, Franklin, Grand Galaxy and Daily Daimond.

Try outIf you are interested in one or more of the auction hor-ses it is possible to come and have a look and try them under saddle. If you wish to do so in the week prior to the auction all horses will be based at the venue. If an earlier appointment is necessary this can be arranged and the horses seen and trialled at their own barns. Please contact the organisation to make an appoint-ment on + 31 (0)13-5091666 or e-mail [email protected]. Unridden horses will be stock in hand. Please note: trial rides are entirely at your own risk.
Auction orderThe horses will be shown in a different order to that in the catalogue. The official order of the horses will be announced at the beginning of the auction on 15 April 2017.
Conditions of auction In the back of the catalogue the complete conditions of auc-tion can be found. In cases of dispute only the Dutch version is binding; the English version is only meant as an explana-tion of the Dutch version.
Veterinary reportIn the three months before the auction all horse will be X-rayed and clinically examined. The veterinary reports as well as the x-rays will be available for public inspection in the auctioneer’s office during the auction period. The orga-nizations veterinarian will be present to supply explanati-ons. If you require information on x-rays and/or veterinary reports earlier than the auction period this can be arranged by contacting the organisation on [email protected].
InsuranceXcellent Horse Insurance will be present during Excellent Dressage Sales to offer you the possibility of insuring your horse(s). A variety of possibilities are available. If you would like to receive information straightaway before the auction please contact the organisation.

UitproberenWanneer u geïnteresseerd bent in één of meerdere veiling-paarden, dan kunt u een afspraak maken met de organisa-tie om de paarden te bezichtigen en uit te proberen onder het zadel. Een week voorafgaand aan de veiling kunt u de paarden proberen op de veilinglocatie, daar voor is het mogelijk om de paarden te rijden op de thuisbasis van het betreffende paard. Neem contact op met de organisatie om een afspraak te maken, telefonisch + 31 (0)13-5091666 of per e-mail [email protected]. Paarden die nog niet bereden zijn worden aan de hand getoond. Het rijden van de paarden geschiedt geheel op eigen risico.
BIJZONDERE BEPALINGEN
Veilingvolgorde De catalogus volgorde wijkt af van de veilingvolgorde. De officiële veilingvolgorde wordt bekend gemaakt voor aanvang van de veiling op 15 april 2017.
VeilingvoorwaardenAchter in de catalogus zijn de complete veilingvoorwaar-den opgenomen. In geval van een geschil prevaleert de Nederlandse versie. De Engelse versie is slechts een toe-lichting op de Nederlandse.
Veterinaire rapportenAlle paarden zijn drie maanden voorafgaand aan de vei-ling röntgenologisch of klinisch onderzocht. De rappor-ten en röntgenfoto’s liggen op 15 april ter inzage op het kantoor van Excellent Dressage Sales. Vanuit de organi-satie is tijdens de veilingdagen een dierenarts aanwezig om desgewenst toelichting te geven op de foto’s. Indien u eerder toelichting op de rapporten en röntgenfoto’s wenst kunt u telefonisch contact opnemen met de or-ganisatie, deze zal u in contact brengen met een van de dierenartsen.
VerzekeringTijdens Excellent Dressage Sales is Xcellent Horse Insurance aanwezig om u de mogelijkheid te bieden om na de veiling uw paard te verzekeren. U heeft daarbij de keuze uit verschillende verzekeringen. Indien u op voorhand informatie wenst dan kunt u deze opvragen bij de organisatie. Zij kunnen u infor-meren over de verschillende mogelijkheden.

Geronimo is a handsome bay. This Chippendale
son boasts good conformation, lovely carriage in
the trot and an uphill canter. Furthermore, he has
a textbook-classic walk with excellent rhythm and
scope. Geronimo’s dam is the champion mare Reina.
In addition to earning the elite, sport and preferent
predicates, she competed successfully in the Small
Tour. Bred to Negro, Reina also produced Elegant,
the future elite horse of Spain’s Beatriz Ferrer-Salat.
Geronimo’s entire dam-line is graced by an impres-
sive list of sporthorses.

A magnificent moving miracle
This large and impressive Bordeaux offspring show-
cases a wonderful front end with an expressive front
leg. Jupiler trots with abundant power and supple-
ness. In addition, he has beautiful conformation.
Even though Jupiler is just three years old, he has
excellent balance in all three gaits. He also boasts
very interesting bloodlines with a combination of
performance sires. For example, Jupiler’s sire is Bor-
deaux and his grandsire is the top stallion Vivaldi.
Jupiler’s dam Estrada competed in Z-level dressage
and earned the Elite predicate. Jupiler is a dressage
horse with the potential to compete in the elite sport.

This black eye-catcher boasts three good basic gaits
with a very good hind leg. Gatsby has an exceptio-
nally good disposition, making him a quick and easy
learner. He moves with abundant push. His sire is
the foundation stallion Jazz, who has produced nu-
merous Grand Prix horses. Dressage-lines are also
anchored in Gatsby’s dam-line: his dam Tiffany, a
Florestan I daughter, competed in Z2-level dressa-
ge. Gatsby is closely related to the KWPN-approved

Dream a Dream is intelligent and willing, two im-
portant traits for a good dressage horse. This likea-
ble mare competes at the Z-level and already does
very easy flying changes. Her sire is Diamond Hit,
a former Grand Prix competitor. Following his reti-
rement from the sport, he became a very successful
breeding stallion. Dream a Dream’s dam is Wale-
na, a daughter of the Hanoverian-approved stallion
Wanderbursch II. Dream a Dream is a mare with
presence, a wonderful disposition, and all the quali-
ties needed to advance up the levels.

Jarreaux is a well-developed and energetic stallion
with abundant presence. He boasts three excellent
basic gaits with good articulation of the joints. Jar-
reaux’s half-brother is the gelding Amadeus (s. Gri-
baldi), a successful Grand Prix dressage competitor
under Judith Huizinga; and Jarreaux’s half-sister
Samaike (s. Gribaldi) competes at the Intermediaire
I level. Furthermore, Jarreaux’s granddam produ-
ced Arjen Teeuwissen’s horse Goliath, who was the
Dutch champion in the Big Tour. Jarreaux’s sire is
the prematurely deceased stallion Estoril, whom the
KWPN deemed one of the best stallions of his birth
year.

Edeem is a real powerhouse. In addition, this at-
tractive chestnut boasts good conformation, giving
her a major advantage under saddle. Edeem shows
very abundant talent for collection and performs all
the movements easily. She is classified at the ZZ-ad-
vanced level, making her among the first Apache
offspring to compete at this level. An Elite mare,
Edeem also successfully showed in several Dutch
Championships and scored above 70% multiple
times in the Subli Cup competition.

Fantastique
Fantastique has fantastic looks. This impressive gel-
ding is classified at the Z2 level in dressage, which
is just the beginning of his promising sport career.
Fantastique boasts impressive bloodlines. For exam-
ple, his dam Nilinda M, a daughter of the top sire
Contango, carries the elite, prestatie, preferent and
sport predicates. Several of her offspring compete at
a high level in dressage. Among them is Fantasti-
que’s half-brother Saint Tropez M (s. Mooiman),
who shows in the Small Tour. Fantastique’s relatives
also excel in the inspection ring. Recently, Jameson
RS2 (s. Blue Hors Zack), who is from Fantastique’s
direct line, was crowned champion of the KWPN
stallion selection in ‘s-Hertogenbosch 2017.

spection ring. At the KWPN inspection in Zeeland,
she was crowned the all-around champion and re-
ceived the following laudatory comments from the

ne. She always moves with abundant power, scope
and carriage.” The likeable mare also shows dres-
sage talent under saddle, moving through the ring

11. EDS stelt de veilingcatalogus zo zorgvuldig mogelijk samen. De infor-matie in de veilingcatalogus is erop gericht een indruk te geven van de kwali¬teit van de ter Veiling aangeboden paarden, zonder dat EDS hiermee volledigheid betracht en zonder dat daaraan rechten kunnen worden ontleend.
12. De ter Veiling aangeboden paarden zijn veterinair klinisch onderzocht. De laatste klinische inspectie vindt plaats op de dag voorafgaand aan de Veiling. Van het veterinair klinische onderzoek wordt een veterinair rapport volgens KNMvD-normen opgemaakt, hetgeen op de dag van de Veiling kan worden ingezien, of zoveel eerder als beschikbaar.
13. De ter Veiling aangeboden rijpaarden zijn röntgenologisch onderzocht aan rug en hals en voor de kenmerken straalbeen beide voorbenen, oste-ochondrose kniegewricht beide achterbenen, osteochondrose sprongge-wricht beide achterbenen, osteochondrose kogel alle benen, en kogelarthro-se beide voorbenen, sesambeentjes beide voorbenen, spronggewricht-spat beide achterbenen en nevenbevindingen. De röntgenbeelden voldoen kwalitatief aan de criteria van het meest recente reglement “keuringsdie-renarts voor paarden’, van de KNMvD. De röntgenbeelden zijn binnen drie maanden voorafgaand aan de Veiling gemaakt. De röntgenbeelden en een afschrift van het op basis daarvan opgemaakte veterinair rapport kunnen op verzoek worden ingezien tot aanvang van de Veiling.
14. De inhoud van de genoemde veterinaire rapportages is bindend voor EDS, voor Verkoper en voor Bieder/Koper.
15. Voorafgaand aan de Veiling en/of op de dag van de Veiling zijn de ter Veiling aangeboden paarden te bezichtigen op een nader door EDS aan te geven tijdstip en locatie.
Afslagbedrag, opgeld, koopsom, betalingsverplichtingen koper
16. Koper dient direct na afloop en op dezelfde dag van de Veiling de Koop-som in Euro’s aan EDS te betalen door overmaking op het bankrekening-nummer ten name van EDS, zonder enige korting of verrekening. De Koopsom wordt als volgt berekend: het Afslagbedrag wordt vermeerderd met een bedrag gelijk aan 7% van het Afslagbedrag (“Opgeld”), een en ander te vermeerderen met het van toepassing zijnde BTW tarief. 9. EDS cannot guarantee that the Vendor can transfer the title of ownership of the auctioned horse to the Bidder/Buyer that is free and unencumbe-red, and EDS is not liable for any losses or damages that are related to this.
10. As long as EDS has not received payment in full from Bidder/Buyer, also under any other Purchase Agreements, the Vendor remains owner of the horse. Until such time EDS has a right of retention over the horse. Exclu-sively after receiving of written permission of EDS, the Vendor is authori-sed to deliver the auctioned horse to Buyer.
Information
11. EDS devises the catalogue as carefully as possible. The information in the auction catalogue is intended to provide an impression of the quality of the horses offered for Auction, without EDS trying to achieve complete-ness and without conferring any rights.
12. The horses offered for Auction have been clinically examined. The final clinical examination takes place on the day prior to the day of the Aucti-on. A veterinary report is composed of the clinical examination in accor-dance with KNMvD-standards, which can be inspected on the day of the Auction or as soon as available.
13. The horses Auction for Auction have been examined radiographically. This includes a radiographic examination of the back and neck and of the radius in both front legs, for osteochondritis in the knee joints in both hind legs, for osteochondritis in the hock in both hind legs, for osteochondritis in the fetlock in all legs and for arthritis in the fetlock joint in both front legs, of the sesamoid bones in both front legs, for blood-spavin in both hind legs and secondary findings. The quality of the X-ray images meets the criteria set in the most recent regulation on veterinary examinations of horses provided by the KNMvD. The X-ray images have been produced within a period of three months prior to the Auction. The X-ray images and a copy of the veterinary report written on the basis of these images, can be inspected on request up to the start of the Auction.
14. The content of the aforementioned veterinary reports is binding for EDS, for Vendor and for Bidder/Buyer.
15. Prior to the Auction and/or on the day of the Auction the horses being offered for auction can be inspected at a time and location to be specified by EDS.
Exit amount, buyer’s premium, purchase price, buyer’s payment obligations
16. Immediately following the Auction and at the same day, Buyer will pay the Purchase Prise to EDS in euros via bank transfer to the ac-count number in the name of EDS, with no discount or setoff being applied. The Purchase Prise will be calculated as follows: the Exit Amount is increased with an amount equal to 7% of the Exit Amount (“Buyer’s Premium”), plus the applicable VAT rate. The VAT rate can depend on the capacity/nationality of the Vendor, Buyer and on appli-

Algemeen
1. Deze Veilingvoorwaarden (hierna: “Veilingvoorwaarden”) zijn van toepassing op de rechtsverhoudingen tussen de besloten vennootschap Excellent Dressage Sales B.V. (hierna: “EDS”) en deelnemers aan de door EDS georganiseerde veiling op zaterdag 15 april 2017 te Hooge Mierde (“Veiling”) van paarden. Degene die tijdens de Veiling op (een) paard(en) biedt (hierna: “Bieder”/”Koper”) wordt geacht de toepasse-lijkheid van deze Veilingvoorwaarden te hebben aanvaard. Toepasse-lijkheid van andere algemene voorwaarden is uitgesloten.
2. EDS organiseert en faciliteert de Veiling en veilt de paarden in opdracht van een verkoper (“Verkoper”).
3. Koper is degene die het bod tijdens de Veiling uitbrengt dat door EDS in opdracht van Verkoper als hoogste bod wordt aanvaard en aan wie het ter Veiling aangeboden paard van Verkoper wordt gegund. Tussen Ko-per en Verkoper komt een koopovereenkomst (“Koopovereenkomst”) tot stand op het moment dat EDS een bod van Bieder/Koper als hoogste bod aanvaardt (“Afslagbedrag”) en het geveilde paard aan die Bieder/Koper is gegund. Gunning vindt plaats op het moment van onderte-kening van de volledig ingevulde Verklaring Koopovereenkomst door Bieder/Koper direct na afloop van de Veiling.
4. Alle bedingen in deze Veilingvoorwaarden zijn mede gemaakt ten behoeve van al degenen die voor, ten behoeve van en/of namens EDS werkzaam zijn of waren. Zij kunnen op de bepalingen van deze Veiling-voorwaarden rechtstreeks een beroep doen, als waren zij zelf EDS.
5. Alle bedragen genoemd in deze Veilingvoorwaarden zijn exclusief BTW, tenzij uitdrukkelijk anders vermeld.
De Veiling
6. De Veiling vindt plaats onder leiding van een door EDS aangestelde vei-lingmeester en onder toezicht van een notaris. EDS bepaalt de orde en de volgorde van de Veiling. EDS heeft het recht een ieder zonder opgaaf van redenen toegang tot en/of deelname aan de Veiling te weigeren, dan wel (nadere) voorwaarden aan deelname aan de Veiling te stellen.
7. De ter Veiling aangeboden paarden worden voetstoots geveild/verkocht zonder actie of refactie, in de staat waarin zij zich bij gunning bevinden, zonder aansprakelijkheid van EDS verband houdende met de waarde, de staat en/of de hoedanigheid van geveilde paarden. Het risico van ver-lies van en/of van schade aan en/of van schade veroorzaakt door het geveilde/gekochte paard berust bij Bieder/Koper vanaf het moment van totstandkoming Koopovereenkomst.
8. Bieder/Koper biedt voor eigen rekening en risico en is aan zijn bod ge-houden totdat een hoger bod is geaccepteerd.
VOORWAARDEN EDS CONDITIONS EDS
General
1. These Auction terms and conditions (hereafter: “Auction Terms and Con-ditions”) apply to all legal relationships between the private limited lia-bility company Excellent Dressage Sales B.V. (hereafter: “EDS”) and the parties participating in the by EDS organised auction of horses in Hooge Mierde (“Auction”) on Saturday April 15th 2017. Those who bid on (a) horse(s) during the Auction (hereafter: “Bidder”/”Buyer”) is deemed to have accepted the applicability of these Auction Terms and Conditions. The applicability of general terms and conditions other than these Auction Terms and Conditions is expressly excluded.
2. EDS organises and facilitates the Auction and auctions the horses as com-missioned by a vendor (“Vendor”).
3. Buyer is the party that makes the bid during the Auction that is excepted by EDS on instruction of the Vendor as the highest bid and to which the Ven-dor’s horse offered for auction is allotted. A Purchase Agreement (“Purchase Agreement”) is concluded between the Vendor and Buyer at the moment EDS accepts a bid made by the Bidder/Buyer as the highest bid (“Exit Amount”) and the auction horse is allotted to that Bidder/Buyer. Allotment takes place at the moment the fully completed Purchase Agreement Declara-tion is signed by the Bidder/Buyer immediately following the auction.
4. All clauses in these Auction Terms and Conditions are also stipulated for all persons who work or have worked for, on behalf of and/or in the name of EDS. These persons may directly invoke the provisions in these Auction Terms and Conditions as if themselves were EDS.
5. All amounts stated in the Auction Terms and Conditions exclude VAT, un-less explicitly stated otherwise.
Auction
6. The Auction takes place under supervision of an auctioneer appointed by EDS and a civil-law notary. EDS determines the order and the sequence of the auction. EDS has the right to refuse anyone access to and/or partici-pation in the auction, without being required to state reasons, or to attach (additional) conditions to participation in the Auction.
7. The horses offered for Auction will be put of for auction/sold outright, without proceedings or recompense, in the state in which they are allotted, without any liability on the part of EDS in connection with the value, condition and/or quality of the auctioned horses. The risk of loss of and/or damage to and/or damage caused by the auctioned/purchased horse rests with the Bidder/Buyer from the moment the Purchase Agreement is concluded.
8. Bidder/Buyer bids at his/her own risk and account and is committed to his/her bid until a higher bid has been accepted.

17. Bij gebreke aan tijdige betaling van de Koopsom is Bieder/Koper in ver-zuim en heeft EDS het recht het paard onmiddellijk onderhands te verko-pen, waarbij het bod van de oorspronkelijke Bieder/Koper niet meer geldt. Bieder/Koper heeft nimmer recht op een meeropbrengst bij onderhandse verkoop en blijft gehouden de minderopbrengst aan EDS te vergoeden. EDS heeft dan voorts de bevoegdheid zonder ingebrekestelling namens Verkoper en zonder Verkopers toestemming de Koopovereenkomst als ontbonden te beschouwen zonder dat Bieder/Koper een recht op (schade)vergoeding(en) toekomt. In geval van verzuim van Koper heeft EDS een retentierecht op het paard, is Bieder/Koper aan EDS administratiekosten verschuldigd ter hoogte van 6% van de Afslagbedrag en is Bieder/Koper alle (buiten)gerechtelijke kosten gemoeid met incasso van EDS’ vordering op Bieder/Koper, met een minimum van € 1.000,--, aan EDS verschul-digd. Koper komt geen recht op verrekening toe.
Uitsluiting en beperking aansprakelijkheid EDS
18. EDS is niet aansprakelijk voor schade veroorzaakt door verstrekking van onjuiste en/of onvolledige informatie, ongeacht aard en omvang van die schade en van die informatie en ongeacht de herkomst van die informatie.
19. EDS is niet aansprakelijk voor schade ontstaan voorafgaand aan, tijdens en/of na afloop van de Veiling veroorzaakt door of aan personen en/of door of aan zaken en/of door of aan paarden.
20. EDS is niet aansprakelijk voor schade, direct noch indirect en ongeacht aard en omvang, als gevolg van een tekortkoming in de nakoming van een verbintenis door een derde(n).
21. Bieder/Koper is aansprakelijk voor alle schade door hemzelf veroorzaakt en vrijwaart EDS tegen iedere aanspraak van (een) derde(n), waaronder mede begrepen, maar niet beperkt tot, Verkopers en/of andere Bieders/Kopers, verband houdende met die schade, ongeacht aard en omvang.
22. Uitsluitingen van aansprakelijkheid van EDS gelden niet in geval van aan EDS toe te rekenen opzet of grove schuld van EDS.
23. Iedere aansprakelijkheid van EDS is te allen tijde beperkt tot een bedrag van maximaal € 10.000,--. Het recht op schadevergoeding vervalt in ie-der geval 12 maanden na de gebeurtenis waaruit de schade voortvloeit en waarvoor EDS aansprakelijk is, onverminderd het bepaalde in art. 6:89 BW.
Omzetbelasting
24. EDS is ondernemer voor de omzetbelasting. Wijzigingen ten aanzien van het geldende BTW-tarief kunnen aanleiding zijn voor een overeen-komstige aanpassing van de toe te passen BTW percentages.

17. In the event of a failure of timely payment of the Purchase Price, Bidder/Buyer will be in default and EDS will have the right to privately sell the horse forthwith; whereby the bid of the original Bidder/Buyer is no longer applicable. Bidder/Buyer is never entitled to any additional profit from this private sale and continues to be obligated to pay the difference in case of less profit to EDS. EDS will be authorised, with no notice of default on behalf of nor consent from the Vendor being required, to consider the Purchase Agreement to have been dissolved, without Bidder/Buyer being entitled to any (damage) compensation. If Buyer is in default, EDS will have the right of retention of the horse; Bidder/Buyer will owe EDS administration fees equal to 6% of the Exit Amount and Bidder/Buyer will owe EDS any (ex-tra)judicial costs involved in collecting EDS’ claims against Bidder/Buyer, subject to a minimum amount of €1,000. Buyer has no right to any setoff.
Exclusion and limitation of EDS’s liability
18. EDS is not liable for any loss caused by incorrect and/or incomplete infor-mation being provided, regardless of the nature and score of this loss and of the information and regardless of the source of this information.
19. EDS is not liable for loss arising prior to, during and/or after the Auction caused by or to persons and/or to property and/or to horses.
20. EDS is not liable for damage, either direct or indirect, and regardless of the nature and scope of the damage, resulting from a failure to meet an obliga-tion by a third party or third parties.
21. Bidder/Buyer is liable for any damage caused by Bidder/Buyer and indem-nifies EDS against any third-party claim or claims, including, but not limi-ted to, Vendors and/or Bidders/Buyers, related to such damage, regardless of the nature and scope of the damage.
22. Any exclusion of liability on the part of EDS do not apply if EDS has acted with intent or is guilty of gross negligence.
23. Any liability on the part of EDS will at all times be limited to the maximum amount of €10,000. In any case, the right to damages will lapse 12 months after the incident from which the loss arises and in respect of which EDS is liable, without prejudice to the provisions in Article 6:89 of the Dutch Civil Code (BW).
Turnover tax
24. For the purpose of turnover tax EDS is considered as an entrepreneur. Changes in respect of the applicable VAT-rate can give rise to a proportio-nate adjustment to the VAT-rates to be applied.
25. If, when an auctioned horse goes to another EU member state at the request of the Bidder/Buyer the VAT on the invoice is itemised as zero, the Bidder/

25. Indien ter zake van de overgang van geveilde paarden naar een andere lidstaat van de Europese Unie op verzoek van de bieder/koper wordt gefactureerd met het BTW-nultarief, verplicht de bieder/koper zich alle daartoe noodzakelijke voorwaarden te vervullen teneinde een rechtsgel-dige intracommunautaire transactie te verwezenlijken.
26. Indien toepassing van het BTW-nultarief door welke omstandigheid dan ook (achteraf) niet mogelijk blijkt, is de bieder/koper op dat moment als-nog een bedrag verschuldigd ter grootte van het bedrag dat verschuldigd zou zijn indien sprake is van een binnenlandse levering van het desbe-treffende paard. Op verzoek van EDS is de bieder/koper echter verplicht vorenbedoeld bedrag onmiddellijk aan EDS te voldoen. Alsdan zal terug-betaling daarvan eerst en slechts plaatsvinden indien de bieder/koper naar genoegen van EDS aan de voorwaarden sub 25 heeft voldaan. De bieder/koper is aansprakelijk en vrijwaart EDS in ieder geval voor alle schade die voortvloeit uit het niet voldoen aan de voorwaarden sub 25 . Daarnaast is de bieder/koper aansprakelijk voor alle (buiten)gerechtelijke kosten die EDS maakt, met een minimumbedrag van € 1.000,--.
27. Per paard wordt voorafgaand aan de Veiling kenbaar gemaakt onder welk BTW regiem het betreffende paard wordt geveild.
Geschillen en toepasselijk recht
28. Indien tijdens de Veiling een geschil ontstaat over de gang van zaken tijdens de Veiling is de veilingmees¬ter bevoegd hierover een bindend oordeel uit te spreken en bevoegd de Veiling bij opbod voort te zetten. Indien de veilingmeester de notaris verzoekt over de gang van zaken tijdens de Veiling een oordeel te vellen, zal de notaris bindend en onher-roepelijk voor alle partijen beslissen.
29. De rechtsverhoudingen tussen EDS en Verkoper, tussen EDS en Koper en tussen Verkoper en Koper worden uitsluitend beheerst door Neder-lands recht, met algehele uitsluiting van het Weens Koopverdrag (CISG). Geschillen, anders dan die aan het oordeel van de veilingmeester of de notaris zijn onderworpen, zullen worden beslecht overeenkomstig het Arbitragereglement van het NAI (Nederlands Arbitrage Instituut) door één arbiter te benoemen volgens de lijstprocedure. De arbitrage vindt plaats in Utrecht. De arbitrageprocedure wordt in de Nederlandse taal gevoerd. Indien Koper een consument is, is op diens schriftelijke ver-zoek de Rechtbank Midden-Nederland, locatie Utrecht, bevoegd. Indien Verkoper en/of EDS een procedure aanhangig wil maken en Koper is consument, zal Verkoper/EDS gedurende een maand Koper in de ge-legenheid stellen schriftelijk Kopers keuze voor NAI-arbitrage of de Rechtbank Midden-Nederland, locatie Utrecht, kenbaar te maken. In geval van een spoedeisend belang (kort geding) kan Verkoper/EDS die termijn bekorten tot vijf werkdagen.
30. De Nederlandse tekst van deze Veilingvoorwaarden is bindend.
Buyer undertakes to fulfil the conditions laid down with respect to this with a view to realising a legally valid intra-community transaction.
26. If it emerges (afterwards) that the application of the zero VAT rate is not possible due to any circumstances, the Bidder/Buyer will at that time be liable to pay an amount equal to the amount that would be payable if the auctioned horse in question were to be delivered within the Netherlands. However, at the request of EDS the Bidder/Buyer is required to pay the above amount to EDS forthwith. In that case repayment of this amount will only take place if the Bidder/Buyer has met the conditions set out in Clause 28 to the satisfaction of EDS. The Bidder/Buyer is liable for and indemnifies EDS against, at the very least, all loss arising from failure to meet the conditions set out in Clause 28. In addition, the Bidder/Buyer is also liable for all (extra) judicial costs incurred by EDS, subject to a minimum amount of € 1,000 including VAT.
27. Prior to the auction, it is announced per horse under which VAT-system the horse in question will be auctioned.
Disputes and applicable law
28. If a dispute should arise during the Auction about the procedure du-ring the Auction, the auctioneer is authorised to pronounce a binding opinion on this dispute and then to continue the increasing auction. If the auctioneer requests the civil-law notary to pronounce an opinion on the procedure during the auction, the civil-law notary will decide for all parties and this decision will be binding and irrevocable.
29. The legal relationship between EDS and Vendor, between EDS and Buyer and between Vendor and Buyer is governed exclusively by Dutch law, with full exclusion of the Vienna Sales Convention (CISG). Dispu-tes, other than those subject to the opinion of the auctioneer or the ci-vil-law notary, will be heard in accordance with the Arbitration Rules laid down by the Netherlands Arbitration Institute (NAI) by one arbi-ter to be appointed in accordance with the list procedure. The arbitral proceedings shall take place in Utrecht. The arbitral proceedings shall be conducted in the Dutch language. If Buyer is consumer, at his/her written request the district court Midden-Nederland, location Utrecht, is competent. If Vendor and/or EDS want to lay a matter before court and Buyer is consumer, Vendor/EDS will afford Buyer for a period of one month with the opportunity to make known his/her choice for NAI-arbitration or district court Midden-Nederland, location Utrecht. If cases involve an urgent interest (summary proceedings), Vendor/EDS may shorten this period to five working days.
30. The Dutch text of these Auction Terms and Conditions is binding.
