Ask your friends and rela-tives who have sold homesrecently for their recommenda-tions. Or, you can use the find-a-REALTOR® search to locateone in your area.

Before working with a TexasREALTOR®, you should knowthat their duties depend onwhom the they represent.

The REALTOR® who liststhe property for sale representsthe owner. Your REALTOR®’ssole duty is to ensure that yourhome sells quickly, easily, andat a suitable price.

All brokers must treat youhonestly and fairly regardlessof whom they represent.

If you choose to have aREALTOR® represent you,you should enter into a writtencontract that clearly establishesthe obligation of both partiesand specifies how your REAL-TOR® will be compensated.SStteepp 22:: SSeettttiinngg aa pprriiccee

When setting a price, theimportant thing is to be realis-tic. If the price is too high, youmay not find a buyer. Too low,and you cheat yourself out ofmoney. AApppprraaiissaall

Regardless of what you orig-inally paid for your home andthe cost of improvements youhave made, the only price thatmatters is what the market willbear at the time you decide tosell. You may consider hiringan independent real estateappraiser with specializedtraining and experience. Don’trely on assessed valuationsmade for tax purposes. Whether or not you get anappraisal, your REALTOR®

can develop a comparativemarket analysis. This analysiswill describe homes in yourarea that have recently with-drawn from the market andmay compare specific featuresof your home to others—thevalue of a corner lot, a city view,or an extra bedroom, for exam-ple. The analysis may alsopoint out market fluctuationscaused by the opening of a newschool or business, as well aslong-term trends.NNeett pprroocceeeeddss

Once you’ve decided on aprice range, the REALTOR®can help you calculate an esti-mated amount you might netfrom the sale.

If you have owned yourhome for several years, youmay have built up sizable equi-ty. Equity is the differencebetween the value of yourhome and the balance on yourmortgage. After subtractingwhat you owe on your mort-gage, ask your REALTOR®what costs you will incur inclosing.

These may include title fees,taxes, a penalty for prepayingyour mortgage, brokeragecommission, attorney fees, andcharges for preparing andrecording documents. Most REALTORS® will askfor an exclusive right-to-selllisting. This means that youwill owe the broker a commis-sion regardless of who finds abuyer during the listing period.In other words, if you decide tosell the house to your cousin,your broker still gets a commis-sion. In an exclusive listing, thebroker is usually motivated towork harder to sell your home.

It’s possible that a REAL-TOR® from another companywill find a buyer for your home.In that case, your broker is thelisting broker, and the secondagent is the cooperating broker.Many times the listing brokerwill agree to pay the cooperat-ing broker a fee from theamount you pay the listing bro-ker. Your listing broker cooper-ates with other brokers whoprocure buyers interested inyour property and offers tocompensate the other brokersfor procuring a buyer.Cooperating and compensat-ing other brokers is discussedin the listing agreement yousign with the listing broker.LLeennggtthh ooff lliissttiinngg

The listing agreement willspecify how long you agree tolist your house with a company.You want a period that’s long

enough to motivate yourREALTOR® to advertise yourhome and respond to buyers,yet short enough to allow youto change to a different compa-ny if you become unhappy withthe REALTOR®’s service.

Remember that the listingagreement is a contract. Youshould get a copy for yourrecords. Your REALTOR® isbound to the terms just as youare. Preparing your homeIn preparing your home forviewing by prospective buyers,remember that people buy onemotions. Your home has tofeel right, or buyers will lookelsewhere. Ask your REAL-TOR® and some honest friendsto look at your home objective-ly and suggest ways to makeyour home more inviting andsellable. Consider both theexterior and interior. Since youwill be appealing to buyers’feelings, you need to pay atten-tion to detail. An extra $50 youspend on red geraniums or newbath towels might mean a sig-nificant increase in a buyer’soffer.

Clean your home thoroughlyand make minor repairs such

as tightening towel racks andgluing wallpaper edges. Forlarger repairs, consult yourREALTOR® as to whetherrepairing the item will generatea good return on the sale.Repainting the woodwork maybe worth it, but replacing thecarpet may not. Hire a profes-sional inspector to examineyour house for structural andmechanical defects. Get aninspection early, and you canavoid surprises.HHoonneessttyy aanndd ccaannddoorr

If your home has a majorproblem you don’t intend tocorrect, be candid about it.Don’t paint over the watermarks on the ceiling to hide aleaky roof. Buyers will find outabout the problems anyway,especially if they are smartshoppers and hire a profession-al to inspect your home. In anage when lawsuits are as com-mon as family sit-down din-ners, it pays to be open abouteverything.

You should consider includ-ing a one-year residential serv-ice contract with the sale ofyour home. This buyer perk is acommon practice and helpsease concerns. Typically, afterthe first year, the buyer has theoption of renewing the cover-age at his or her expense. A res-idential service contract is sim-

Asresponses come in, yourREALTOR® will screen outsightseers and half-heartedinquirers and make appoint-ments with the seriousprospects.

When the showings begin,keep your home clean andready. Your REALTOR® willtry to give you advance warn-ing before showing yourhome but be prepared any-way. If people drop by andare not with a REALTOR®,it’s best not to show themyour home. Ask for theirnames and phone numbersand refer them to yourREALTOR®.PPuurrppoosseeffuull aabbsseennccee

When a REALTOR®comes to show your home,it’s best if you are not there.Many buyers feel like intrud-ers when the owner is pres-ent; they tend to hurry away.Letting the buyers walkthrough your property attheir own pace will help putthem at ease. They will feelfree to look around and askquestions. If you must bethere, let the REALTOR®handle the showing. Sit qui-etly and be courteous, butavoid engaging the buyer inconversation. When a buyer makes an offeron your home, your REAL-TOR® will contact youpromptly. The REALTOR®will scrutinize the document,review it with you carefully, andanswer your questions. Thewritten offer lays out all theterms of the proposed transac-tion—the price the buyer iswilling to pay and the financingterms—and becomes a bindingcontract if you sign it.

The offer may be contingenton the buyer selling a homefirst or obtaining an inspection.Ask your REALTOR® howthese terms affect you andwhether the offer is in line withthe market. The offer describesthe property, states who paysfor which closing costs, andspecifies dates of closing andpossession. Along with makingthe offer, the buyer may placesome earnest money with theescrow agent as a sign of good

faith. The earnest money willbe kept in an escrow accountand applied to the buyer’sdown payment or closing costswhen the sale closes.YYoouurr ooppttiioonnss

In reviewing the offer, youhave three options: accept,reject, or make a counteroffer.A counteroffer is a rejection of abuyer’s offer with a simultane-ous offer from you to the buyer.Carefully review the figurescompiled earlier to determineyour net proceeds—closingcosts may be quite differentfrom earlier calculations.Discuss the possibilities withyour REALTOR®, your attor-ney, and a tax adviser. which to grow vegetables has

expanded, too. From classical

glazed and footed urns and

upside-down tomato and pep-

per baskets to $5 party tubs

drilled with drainage holes,

mixed containers that supply

food as well as ornamentation

Crawford, recently published a

colorful how-to manual that

addresses the questions of

beginners as well as longtime

gardeners intrigued by the idea

of combo containers whose

"thrillers" are vegetable plants.

that are difficult to cultivate in

Before signing the contract,take precautions to protectyourself against unseen defectsin the home. An inspection bya qualified inspector can pro-vide you with unbiased opin-ions about the condition of thefoundation, mechanical sys-tems, plumbing systems,appliances, etc. If you can,accompany the inspector at thetime the inspection is conduct-ed.

It’s also a good idea to get atermite and other wood-destroying insect inspection.

You may also want to haveyour REALTOR® request thatthe seller furnish you with aone-year residential servicecontract as part of the deal.This is common practice withthe purchase of existing homes(after the first year, you’ll havethe option of renewing cover-age at your expense) andensures that certain items willbe repaired by the company ifthey fail to function after youmove in. If you buy a newhome, the builder may offer awarranty as well. The REALTOR® workingwith you will present the con-

tract to the seller’s agent orseller. The seller has threeoptions: accept, reject or makea counteroffer—a rejection ofthe offer with a simultaneousoffer from the seller to thebuyer. If the seller makes acounteroffer, you then have thesame three options. Thisprocess goes on until a suitableprice is agreed upon by bothparties.BBiinnddiinngg ccoonnttrraacctt

Once you and the selleragree to the written terms andboth of you sign, the documentbecomes a binding contract.Be sure that you pay closeattention the terms.Otherwise, you may waivesome contractual rights.

The contract may also setout other contingencies thathave to be satisfied, so read thecontract carefully and complywith its requirements.

If repairs are required, thecontract will specify who willbear the cost of the repairs,who will arrange for therepairs, and when the repairsmust be made. Before youclose, be sure that the condi-tion of the property meets therequired condition specified inthe contract.

Once a contract becomesbinding, you’ll probably haveto arrange for financing.Depending on the terms of thecontract, the purchase of thehome may be contingent uponyou finding the right financing.LLeennddeerrss

Most homebuyers get loansthrough savings institutionsand mortgage bankers and, toa lesser extent, from commer-cial banks, credit unions, otherprivate sources, or even theseller. Sellers often can offer acompetitive interest rate andattractive terms. Check onspecifics. TTyyppeess ooff llooaannss

In general, three broad cate-gories of loans are available:

11.. PPrriivvaattee vvss.. ggoovveerrnnmmeennttllooaannss.. Most mortgage loans aremade by savings institutions,

banks and mortgage compa-nies. Generally, a lender willrequire you to buy mortgageinsurance, particularly if youmake a low down payment.This insurance may be paid atclosing or added to the loanamount. VA loans require nomortgage insurance, but onlyqualified veterans may applyfor them. Mortgage insuranceprotects the lender, to a degree,in the event of default.

On government (FHA andVA) loans, the governmentdoes not actually loan themoney but rather guarantees(or insures) to repay the lenderif you default for some reason.Government loans haveimportant advantages—theygenerally require a lower downpayment than conventionalloans and often have a lowerinterest rate or points. On thedown side, government loanslimit the amount you can bor-row, often take longer toprocess, and sometimes havehigher closing costs.

22.. FFiixxeedd rraattee vvss.. aaddjjuussttaabblleerraattee.. On a fixed rate mortgage,the interest rate stays the sameover the life of the loan, usual-ly 15 or 30 years. That meansyour payment will not changeexcept for adjustments ontaxes and insurance.

Adjustable rate mortgages(ARMS) have interest rates ormonthly payments that can goup or down over time. Thesemortgages typically start outwith a lower interest rate,lower monthly payments, andlower fees and points thanfixed rate mortgages and oftenappeal to first-time homebuy-ers, younger couples whoexpect their incomes to growin the coming years, and peo-ple who might not have muchcash for down payment andclosing costs.

If you consider an adjustablerate mortgage, ask the lenderto explain the terms fully. Askabout the interest-rate cap (themaximum rate you will becharged no matter how highrates go in the market), theindex that will be used to cal-

culate future interest rates, andhow index charges will affectyour mortgage.

3. AAssssuummaabbllee vvss.. nneeww llooaann..Some loans, particularly FHAand VA loans as well as someadjustable rate mortgages, areassumable. That means abuyer can assume an existingloan usually on the same termsas the previous owner.

Assuming a loan may savesome costs and time. As thebuyer, you would typically paythe lender a fee at closing forprocessing the assumption. TThhee ttrruuee pprriiccee ooff ffiinnaanncciinngg

When shopping for a loan,don’t judge the loan by theinterest rate alone. Compareseveral items in the entire loanpackage, including:

Points on a low-interest-rateloan can be double those for aloan with a higher interest rate,causing you to pay more upfront.

Total fees charged by thelender. Some lenders willabsorb the cost of many servic-es, while others do not, so askin advance.

TTeerrmm.. In general, the longerthe life of the loan and themore fixed the payment, themore you can expect to payover the life of the loan. Forexample, a 30-year, fixed-rateloan will cost more in interestthan a 15-year, fixed-rate loan.

PPeennaallttiieess.. Ask what penal-ties will be charged if you payoff the note early. A prepay-ment clause could require youto pay a penalty if you pay offthe loan early, such as refi-nancing the loan at a latertime. LLooaann aapppprroovvaall pprroocceessss

From the lender’s viewpoint,approving the loan, based onyour financial standing, is onlypart of the risk; the other partis the property itself. Thelender may require an apprais-al to verify that the home isworth the loan as well as aphysical survey to discover anyencroachments on the proper-ty. Repairs may be required.Insurance must be purchased.Verifications of employment,

deposits, and other mattersmust be obtained. Loan docu-mentation and conveyanceinstruments must be drawnand approved. In addition, thetitle company must researchthe title and arrange for payingoff any liens, taxes, and othercosts. All these conditions andothers must be satisfied beforea transaction can close. As another protection, thelender may require insuranceto protect against fire andstorms. (Flood insurance couldbe required if the house is in aflood plain.) Even if notrequired by a lender, it’s proba-bly a good idea for you to con-sider all types of insurance.

SStteepp 66:: CClloossiinngg tthhee ddeeaall The closing is the end of

weeks or even months ofresearch and decision making.The closing could last less thanan hour but may take longer,depending on the complexityof the transaction. It oftenoccurs at the title company’soffice. The title company offi-cer will explain each documentbefore you sign. You may wantyour attorney present as well. If buying a home were stict-ly a cash transaction, youwould simply hand over themoney and receive the deed.More than likely, however, youare borrowing money for thehome, which means that youare actually making two trans-actions—acquiring the loanand buying the home.

As a borrower, you will signa note promising to repay theloan and a deed of trust (alsoknown as the mortgage) pledg-ing the house (or other collat-eral) as security for the note.You will also sign numerousother papers includingacknowledgments, disclosures,surveys, certificates, etc. Besure to read each documentcarefully. Ask questions if youdo not understand anything.There are no dumb questions.Seriously consider having your
