A restroom at Dolphin Beach is at long last a reality!

The homeowners in Montclair began asking for a restroom at Dolphin Beach over 20 years ago. At one time there was a serious attempt to construct a building in an effort lead by long-time resident Glenn Niemi. Architectural plans were drawn up but the project did not progress beyond the planning stage due to lack of support.

In early 2011, Mark and Allen Roltsch put forth the idea once again. The Roltsch family is one of the original residents of Montclair. Mark was an MPOA board member who, along with his family, relocated to Texas. Allen is a life-long resident of Montclair with his wife and family. The project was taken up in the Spring of 2011 and the Restroom Project Committee was formed that included Catherine Kudrick, Allen Roltsch and myself.

The first step involved months of planning. After investigating cost and other factors, the decision was made to go with a pre-fabricated concrete building. The question was where to locate the building in the limited space at Dolphin Beach. Most of Dolphin Beach is an emergency spillway, and the remainder is a cemetery on top of the hill; therefore, the only open space above the floodplain, and accessible to a large transport truck, was the basketball court. The size of the building was also a factor. While a larger one was preferable, there were limits on the size of truck and crane that could reach the basketball court in the narrow area between the retaining wall and edge of the court. Also limiting the scope of the project was budget constraints which are determined by the Amended Declaration of Montclair. Once the building and location were selected, the next step was a site plan which was done by GJB Engineering and approved in January 2013.

There is water service to Dolphin Beach for the showers, but it is an irrigation account with no sewer service. There were meetings with the Service Authority to convert the existing service, but it was eventually decided that a new account was the most cost effective solution. It was agreed that the restroom water line would be installed to meet a service access point in Spillway Lane, and the sewer line extended across the parking lot.

Next was the involved process of finalizing quotes, negotiating with contractors and obtaining County permits. Because of the budgetary constraints on the project this was a very challenging task, however, the various construction trades, as well as the CXT building distributor, responded to Catherine’s negotiations.

The proposal was presented to the Board by Brad Hancock at the August 14, 2013 board meeting and given final approval.

The project moved forward and the building was scheduled for delivery in late fall of 2013. There were hurdles in securing the various County permits but eventually they were all obtained and the building delivered and set up without any problems on December 19, 2013.

This project would not have succeeded without the support and cooperation of the following people: Catherine Kudrick, who started the project as MPOA President and saw it through to completion as a volunteer and project manager; Al Roltsch, who provided expert advice on County requirements and supervised the pad installation; Aaron Clark of Prince William Pipeline, who went beyond what was required in installing the water and sewer lines; the Prince William Pipeline foreman on the job, Earl Corbin, who was most helpful in having his crew hammer through the granite beneath the parking lot and otherwise doing whatever was asked of him; Greg Budnik of GJB Engineering, who did the site plan; JABS Construction, who installed the electrical and assisted with the last minute revisions to the plans to obtain the County Building permit; Woodbridge Plumbing, who installed the ground works and who were on site when the building was delivered to make sure the plumbing lined up properly; Greg Zentarsky of CXT Buildings who was willing to negotiate to lower the cost of the building; Heather

Last but not least, this project would not have happened without the tenacity of the project committee (and project manager Catherine Kudrick who after leaving the Board) were determined that Montclair would have a clean restroom at Dolphin Beach for the children

and homeowners of Montclair. There were many times in the past two years when it looked impossible but the committee kept pushing forward. Montclair also owes a debt of gratitude to the contractors who were willing to keep their costs as low as possible to accomplish this community project.

The bathroom will now permit Montclair to expand the play area at Dolphin Beach relieving some of the use of Kids’ Dominion.

And yes, Donna Mezny and all the others posting positive support of the bathroom, next up should be a restroom for West Beach.

Welcome New MPOA Staff Member

In early January, the MPOA office welcomed a Covenants Inspector, Luis

Solloso. Prior to joining FirstService Residential, Luis worked for a high-rise

condominium. Luis is currently studying Information Technology at Northern

Lights Out?

It has been noted that many homes in Montclair have porch lights or lamp posts that are no longer

working. These outdoor lights are not only helpful when arriving at home after dark, but can also

discourage unwanted activity. Please check your outdoor lighting to ensure all bulbs are fully functional.

Public NoticeAs approved at the January 8, 2014 Board of Directors meeting. These amendments will go into effect March 1, 2014.

Amendments to Community Guidelines Section 3, Enclosure 1 Standing Committee Charters - Safety Committee Charter1. Purpose/Background: The Montclair Security Force patrols the community of Montclair to observe and report. They provide a twenty-four hour per day

patrol of the community in highly visible security vehicles with radio and telephone communications with police and emergency services. In 1996, the MPOA BOD expanded the mission of the standing committee, which oversees the Montclair Security Force to include safety matters and concerns of Montclair. The name of the committee was changed to the Safety Committee, to reflect this expanded responsibility. The Safety Committee shall act to assist Montclair Property Owners Association in developing and implementing practices that make the community safer and support programs that promote safety for Association members, such as Neighborhood Watch, National Night Out, street safety, and address issues such as crime statistics and crime prevention.

2. Mission/Objectives: a. To provide oversight over the implementation of policies, directives, resolutions, and communications of the MPOA BOD concerning safety and security in the community. b. To provide information to the MPOA BOD on the overall operation, management, and effectiveness of the Montclair Security Force. c. To review, analyze, and recommend modifications to the operations and/or management policies and procedures of the Montclair Security Force to enhance the efficiency and effectiveness of the force. d. To discuss, develop, and recommend necessary safety measures that will best serve the citizens of Montclair.To promote awareness and involvement by Montclair Property Owners Association members to report and rectify safety issues within the community. Provide review and input to recommend policies, resolutions, and communications of The Montclair Property Owners Association Board of Directors (MPOA BOD) concerning safety and security in the community.3. Type: The Safety Committee will be a standing committee. Committees are advisors to the Board of Directors. Their primary role is not to establish

policies, but rather to provide information and options to enable the BOD to make fully informed decisions for the Association. Every volunteer on the committee has an equal right to express their opinions and ideas as how to best serve the interests of the community. The role of the Committee members is to work together in a cooperative and open manner to complete the mission and responsibilities of the Committee.

4. Guidance: The Safety Committee will be guided by the MPOA Articles of Incorporation, Declaration, Bylaws, Community Guidelines, Security Procedures, and other policies, directives, resolutions, and communications of the BOD.

5. Responsibilities/Requirements: a. To discuss, investigate, and recommend appropriate organizational objectives for the committee. b. To maintain, cultivate, and pursue beneficial contacts with various agencies in Prince William County and the Commonwealth of Virginia that will enhance the safety, security, and welfare of Montclair. c. To facilitate communications between the Montclair Security Force, the BOD, and the residents of Montclair. a. The Safety Committee is responsible for reviewing and monitoring the safety and security of our community. b. Discuss, investigate and recommend necessary safety measures that will best serve the residents of Montclair. c. Remain in regular contact with the Prince William County Police department in concert with our Management contractor to be informed of potential criminal situations and issues in the area; and to notify the Board of Directors as appropriate and develop communication materials for their dissemination. d. Develop crime prevention and awareness programs for the Association such as the Neighborhood Watch Program. e. Monitor and report any safety violations or illegal activities to law enforcement agents, the Board of Directors, MPOA General Management Staff and encourage residents to do the same. f. Compile quarterly and yearly periodic summaries of police reports for incidents occuring in the neighborhood, distribute to the Board of Directors and Management staff to be shared with Montclair residents.6. Administration: The committee will follow the procedures and guidelines in Article 3 of the Community Guidelines.

The Board Treasurer shall review Owner accounts on a quarterly basis for each fiscal year and may remove past due balances from Owners’ accounts which are $5.00 or below. Upon notice by a Member of an account discrepancy or waiver request: 1. If the Accounting Department cannot resolve an issue of a late and/or service fees with a Member, they will prepare a summary report and forward this report to the Treasurer, via the General Manager, with a recommended course of action; 2. If the issue involves any adjustment to the Member’s account, including any member requesting the removal of a late and/ or service fees from their account, the General Manager will have the authority to credit accounts up to $45.00 and the Treasurer shall authority up to $100.00. The reasons for granting or not granting the request and the Account Department’s report will be forwarded to the Board of Directors with the appropriate report from the General Manager and/or Treasurer. 3. If the issue or Member request for the waiving of late and/or service fees cannot be resolved then the open issues, along with the appropriate recommendations from the Accounting Department, General Manager, and/or Treasurer, shall be referred to the Financial Appeals Board (FAB), a standing committee of the Board for resolution.

2013 Montclairion of the Year

Catherine KudrickCatherine Kudrick served the Montclair community as a board member starting in 2006 in

multiple positions including Secretary, 1st Vice President and President. During her time on the

MPOA Board she was instrumental in ensuring the landscaping plan for the medians was adopted

and implemented, including the inclusion of the Blue Star Memorial and the benches placed along

Waterway Drive. Without Catherine’s hard work and dedication, the bathrooms at Dolphin Beach

would not be a reality.

In addition to her MPOA positions, Catherine has also served for

many years as the president for her townhome association, Nob Hill.

Congratulations, Catherine, and thank you for your contributions to the

community!

Do you have other experience that would contribute to your success as a board member?I am intimately familiar with current and emerging issues within Montclair through committees and monthly attendance at MPOA Board meetings. As a Marine Corps Officer, I collaborate with diverse groups of people to achieve organizational goals and participate in/lead working groups that successfully solve organizational problems and streamline processes.

Why are you interested in serving on the MPOA Board of Directors?To continue community service - as I retire from the Marines - and to bring a fresh and objective view to the management of Montclair. Do you have other experience that would contribute to your success as a board member?I’m an executive Board member (Treasurer) with the PWC Citizens Police Academy Alumni Association and a member and prior Vice President of the Quantico FBI Citizens Academy Alumni.

Why are you interested in serving on the MPOA Board of Directors?As a former Communications Committee Chair and current Board Liaison, I initiated many changes in the articles in The Montclairion and encouraged CC Chairs to continue to keep it fresh. The Montclairion has become a “must read magazine.” I fostered update of a new website which will continuously upgrade our communications.

Give a brief statement of views on what you feel you can contribute to the community and what you would like to see done in Montclair.Montclair is a hidden jewel in PWC. I want the rest of NoVA to know how great it is. I would like more block parties and game nights that would involve members of the community. Do you have other experience that would contribute to your success as a board member?In addition to my service in Montclair, I am a Professional Engineer and Project Management Professional, which provides structure to my decision making process and program management. As a facilities professional, I understand the facets of communications management, contracting , budgeting , etc. that contribute to a community to running smoothly.

Why are you interested in serving on the MPOA Board of Directors?Having served on the Board, I understand many of the member’s current concerns and the future challenges facing the community. Vote “YES” to Amending the Deed of DeclarationThis article has been written and agreed upon by all eleven members of the MPOA Board of Directors.

The Board of Directors urges all Montclair homeowners to vote “Yes” in support of adopting the Second Amendment to the Montclair Deed of Declaration at the Annual Meeting on March 15, 2014 (see the end of this article for the proposed amendment). This amendment requires at least 67% of those casting ballots to vote “Yes” in order to adopt it. All of the MPOA Board members urge you to take a minute to read the information that follows. Simply voting to pass the proposed budget and to elect a Board member but leaving blank a vote of “Yes” or “No” on the proposed amendment is actually a “No” vote against the document change. Please plan to vote in order to establish quorum for the Annual Meeting and vote “Yes” in support of adopting the Second Amendment to the Montclair Deed of Declaration.

Recent Virginia Supreme Court rulings prohibit an association’s right to impose

monetary sanctions unless there is clear language in the governing documents to include its declaration (or master deed) and its bylaws. The Virginia courts are now demonstrating a tendency toward restricting any authority exercised by community associations unless that authority is expressly created by the association’s governing documents. Changes to our Deed of Declaration are necessary to bring Montclair’s governing documents in compliance with these rulings.

Home ownership in a community governed by a Homeowners Association (HOA) like Montclair includes entering into a contract to abide by the Association’s governing documents. These documents contain covenants, conditions, and restrictions that run with the land and all owners are subject to these documents’ terms and provisions. The Board of Directors has a fiduciary responsibility to uphold and enforce these governing documents.

For years, Virginia community associations like Montclair have enforced their governing documents by suspending nonessential privileges or by imposing monetary sanctions against owners who violate association covenants. As is the case in Montclair, associations have typically and historically established the processes used to impose sanctions through adoption of resolutions called “due process resolutions.” These resolutions and the enforcement processes are contained in other subordinate association documents like the Montclair Community Guidelines (see http://www.montclairva.com/documents).

The proposed Amendment to the Montclair Deed (see http://www.montclairva.com/documents for a copy of the Deed) addresses three areas related to assessments:1. Establish within the Deed enforcement

of covenants by clearly stating authority to assess “reasonable charges.” This is a critical missing aspect of the current Montclair Declaration as recently interpreted by the Virginia State Supreme Court in review of another Virginia HOA.

2. The opportunity for owners in good standing to pay assessments in monthly installments with service fees included as part of selecting this option. The current Declaration characterizes an annual assessment due on the first day of the fiscal year and makes no reference to a monthly installment program, as is the current practice.

3. The collection of assessments and the need to stipulate the specifics on assessing a late charge.

Covenant enforcement is a consuming job for the management company. Typically, the vast majority of covenant violations are resolved through the notification process as communicated in letters of violation from the management company. Using statistics from the calendar year 2012, nearly 99% of covenant violations were resolved through the notification process. Without approval of this Amendment, unresolved violations will require the Association to initiate a process where the Association corrects the violation and seeks reimbursement, suspends privileges (common area access), and/or files a suit seeking an injunction to compel compliance, to include the recovery of the Association’s

attorney fees and costs.

On average, over a 12 month period, the total number of covenant violations that resulted in additional assessments, i.e., monetary sanctions intended to compel covenant compliance is approximately 24 per year. Statistics show that of these 24 annual cases, 19 were resolved by imposing monetary sanctions, thus averting legal action. The remaining five required legal action to seek resolution.

Since December of 2012 (when the Court’s determination became widely known in Virginia), collection attorneys have refused to take on any covenant-based cases with monetary sanctions imposed to force covenant compliance if an association’s documents are not clear on applying such charges.

It is important to understand that Montclair’s current Declaration considers seeking an injunction to compel compliance to include the recovery of the Association’s attorney fees and costs. However, as noted in the pre-2013 statistics, this will mean that an additional 19 cases per year will require court injunctions to compel compliance because the monetary sanction tool is no longer available to encourage compliance.

The MPOA Declaration requires the Board to protect and enforce Montclair covenants. In doing so, it is our desire to achieve the correction of covenant violations as inexpensively as possible for both the homeowner and the Association as a whole. The means to do this is the application of monetary charges in the form of an added assessment to compel covenant compliance. This long-standing practice of enforcement minimizes expense and embarrassment for the owner, and minimizes the need for costly legal action, and minimizes the need to go to court.

Your vote is important - please vote “Yes” to approve the Second Amendment to the MPOA Deed of Declaration.

Look for further information in the weeks leading up to the Annual meeting to include the MPOA website, the 2014 Annual Meeting literature and personal outreaches across the community by your elected Board members.

-------- PROPOSED AMENDMENT --------R1. The Amended Declaration dated March 31, 1990 and recorded on April 18, 1990 in Deed Book 1729, at page 955, et. seq. among the land records of Prince William County, Virginia, submits the lots and common areas within the residential planned community of Montclair to the covenants, conditions and restrictions therein set forth.R2. By its terms, the Amended Declaration may be amended with the approval of at least sixty-seven percent of the votes present and voting at a duly convened meeting of the Association at which a quorum is present.

PROPOSED AMENDMENTNOW, THEREFORE, the Amended Declaration is amended as follows:1. Article 3, Section 3.7 (c) is deleted in its entirety and the following paragraph is substituted in its stead:(c) Limitations. The rights and easements of enjoyment created hereby shall be subject (in addition to any easements granted or reserved in this Declaration or pursuant to the other Association Documents) to all rights and powers of the Association when exercised in accordance with the other applicable provisions of the Association Documents, including without limitation the Association’s right to regulate the use of the Common Area and to establish reasonable charges therefor, to suspend the rights of Lot Owners to use the services, amenities and facilities in the Common Area for violations of the Association Documents, to grant easements across the Common Area, to dedicate portions of the Common Area and to mortgage the Common Area.

2. The fifth paragraph of Article 4, Section 4.2 (a) is deleted in its entirety and the following paragraph is substituted in its stead:Any and all such assessments and other charges shall be a lien against each Owner’s Lot as provided in Section 10.2 hereof. Except as provided immediately below, on or before the first day of each fiscal year, each Owner shall pay to such Person at such place as the Board of Directors may direct the annual assessment due for that fiscal year. Notwithstanding the foregoing and subject to the provisions of Section 10.2 (b) hereof, the Board of Directors may permit those Owners in good standing who elect to do so to pay the annual assessments in installments during the fiscal year. In such event, the annual assessment shall be due in such installments and on such dates as the Board of Directors

may determine and shall be subject to such service fees, not exceeding five percent (5%) of each installment, as the Board of Directors may fix from time to time. All sums collected by the Board of Directors with respect to assessments against the Lots or from any other source may be commingled into a single fund.

3. Article 4, Section 4.5 is deleted in its entirety and the following paragraph is substituted in its stead:Collection of Assessments. Any assessment, or installment thereof, not paid within ten days after the due date shall be delinquent and shall accrue a late charge in such amount as may be determined from time to time by resolution of the Board of Directors in an amount not to exceed fourty-five dollars ($45.00) or such other amount as may be determined from time to time by resolution of the Board of Directors and shall be subject to the provisions of Section 10.2 (b) hereof. The Board of Directors shall take prompt action to collect any assessments for Common Expenses due from any Owner or member that remain unpaid for more than thirty days after the due date for payment thereof.

4. Article 10, Section 10.1 (h) is deleted in its entirety and the following paragraph is substituted in its stead:(h) Imposition of Charges and Suspension of Rights. The Board of Directors shall have the power to suspend the use of any service, amenity or facility located on the Common Area, to suspend the right to vote in the Association (pursuant to Subsection 3.2 (d) of the Bylaws) or to impose charges not to exceed those authorized by Section 55-513 of the Code of Virginia 1950, as amended in any instance of an Owner found by the Board of Directors to be responsible for a violation of the Association Documents, including but not limited to nonpayment of assessments which are more than 60 days past due. No such penalty shall be imposed until the Owner charged with such a violation has been given notice and an opportunity for a hearing as set forth in Subsection 10.1 (i) hereof. The Board of Directors may deliberate privately but, shall either announce its decision in the presence of the Owner or give the Owner notice thereof. A decision adverse to the Owner shall require a two-thirds majority vote of the Directors present and voting at the meeting at which a decision on the violation is made.

The Wizard of Oz Comes to Henderson!Auditions were held in late December for a musical production of the Wizard of Oz. Over 100 students will be included in the cast with even more participating behind the scenes! Rehearsal began in January and will continue until the performances, which will be held March 27-29. Parent volunteers are needed to help with costumes, props, makeup, publicity, programs, graphic design, set building, house manager, dressing room supervision, set load-in and strike, ticket sales, cast party and more. Boy ScoutsTroop 35By Matthew LaGrange, Troop ScribeIt was a Happy New Year in January for Boy Scout Troop 35. Our scouts, led by Conner Pedersen, planned and held an amazing over-night lock-in at All Saints Church. The scouts who attended had an awesome time playing games of all sorts, eating pizza and staying up the whole night. Troop 35 also held their annual family ski trip to Timberline Ski Resort in West Virginia. Scouts and their families had a great time skiing and snowboarding and enjoying some winter fun.

Troop 35 has a group of scouts preparing for a trip to the Philmont Scout Ranch High Adventure Base this summer. They participated in their first work-up hike which will help prepare them to carry all their gear and supplies, and to help them adjust to the stronger physical demands on their bodies. They will complete about ten work-up hikes before departing for Philmont Scout Ranch in northern New Mexico in July.

Any assessment not received within ten days of the due date will incur a $45 late fee.
