WASHINGTON THIS WEEK

The Commission has approved the sale of Carlson Communications' classic rocker

KRSP -FM, Salt Lake City, UT to the Simmons Family, but not before slapping the

station and its sister, children's -programmed KKDS, with an $8,000 fine for EEO

violations. Simmons Family's standards KDYL and soft AC KSFI was also hit for

$8,000 for the same violations.

The NAB's Eddie Fritts has again urged the FCC to limit satellite Digital Radio

Services to subscription -based services only. Fritz believes subscription only

services will provide satellite service providers with "the economic framework

that will permit them to deliver on their promise of providing niche

programming . . .while helping to minimize the drastic harm . . . that will

otherwise wreak on the over - the -air free terrestrial service. Minimally, Fritts

has asked the Commission to consider introducing satellite digital radio at the

same time as land -based digital radio. M Street: We wonder if Mr. Fritz and the

NAB would have opposed the introduction of color television to preserve black and

white broadcasts. Perhaps its time to embrace new technologies, not fight them.

The new telecommunications bill going through the U.S. House might as well be

called the "telephone /cable act" as both radio and television ownership issues

have been dropped from the bill. Accordingto Radio Business Report, broadcast

ownership issues have been separated out and will most likely be introduced as an

amendment to the main bill. The NAB is working to get the ownership issue back

into versions of the bill in both the House and Senate. Meanwhile, according to

Inside Radio, the House bill zaps the current license renewal procedure by

automatically granting renewals to broadcasters who have had no problems or

complaints regarding FCC rules issues. Those that have had problems would go

through comparative hearings. The new renewal procedures could go into effect

immediately after the bill is signed.

The heads of the four largest public broadcasting organizations have proposed to

Congress a plan to create a trust fund, similar to ones established for the

American Red Cross and the U.S. Olympic Committee, to fund public broadcasting in

lieu of the federal appropriations that have been threatened with extinction

recently. National Public Radio, Public Radio International, America's Public

Television Stations, and the Public Broadcasting Service have jointly proposed the

plan which calls for funding from noncommercial spectrum leases and auctions,

spectrum transfer and use fees, and contributions by commercial broadcasters. The

latter has the NAB up in arms. In a statement, the NAB said sarcastically, "The

public broadcasters' idea of a 'road to self- sufficiency' seems to be 'let's take

it from somewhere else.'"

Arbitron had one of its best male 18 -24 books ever as the sampling index of that demo was up 3 1/2 points to 82.7 %. An index of 100 means that the sample is exactly proportional to that demographic's percentage of the population. Arbitron attributes the increase to raised diary premiums from $2 to $3 and changes to the mailer in which the diaries were placed to make them stand out in the mailbox.

Inside Radio reports Noble's Denver talker KHOW got hit with a 5 -B note in the Winter book for a conversation one of their hosts had with a listener about how to fill out the diary, including a reference by the host asking, "So we're in there for the entire two hours ?" WASHINGTON THIS WEEK

The FCC, in a Memorandum Opinion & Order (MO &O), granted the application of J.C.

Bell, case trustee, for assignment of WHSY and WXRR, Hattiesburg, MS, to Blakeney

Communications. On November 17, 1994, Design Media filed a petition to deny the

assignment, contending that the combo and Blakeney's other station in the market,

country WBBN, Taylorsville, MS, didn't comply with EEO rules. The Commission

found that Design Media's allegations did not raise a "substantial or material

question of fact sufficient to warrant a hearing or denial of the assignment

application." The Commission also noted that the stations are silent.

Ricardo A. del Castillo, Tichenor Media System's VP /Operations, has been reelected

to the NAB's Radio board. Radio Board members serve two -year terms.

ELSEWHERE

In a move that stunned much of the radio community, not to mention Cox

Broadcasting, the Commission denied Cox's application to purchase its second FM in

Atlanta, jazz outlet WJZF, La Grange, GA. Cox was taking a two -step approach.

They asked to modify the station's signal so that it didn't overlap with WSB -FM.

Secondly, they asked for a waiver of the cross -ownership rules if the signal

modification were denied. The Commission ruled against both. The denial begs the

question of the validity of Cox's LMA with the station since the Commission has

ruled Cox can't own it. Cox currently owns two stations, LMA's two others, sells

two additional stations, owns the ABC television affiliate, a cable system, and

both of the city's major newspapers. According to Inside Radio, Cox's Executive

VP /Radio Bob Neil says they'll keep the LMA going pending an appeal or a change in

the ownership rules.

The company that filed the petition to deny the sale of WJZF, La Grange, GA from

NewCity Communications to Cox in Atlanta, Jacor Communications, has been granted

permission to buy Pathfinder's classic rocker WPPT, Cincinnati for $9 million. At

the same time, the Commission granted permission to CR Acquisition, Inc. to buy

adult standards WSAI from Pathfinder. Both sales had been held up for months

because of petitions filed by local competitors who said Jacor already owns or

controls much of the market. The grants come with conditions, however. According

to RBR, Jacor can continue its sales agreement with CR's children's station WAOZ

or WSAI, but neither station can be sold in combo with any of Jacor's owned

stations --WLW, WCKY, or WEBN. It can also continue to sell its other SMA'd

station, new rock WAQZ, Milford, but can only sell up to 30% of the station's

inventory in combo with Jacor stations. Jacor volunteered to limit the sale of

WSAI's inventory to 2/3.

Jacor doubles up in Jacksonville this week as it was the successful bidder on

bankrupt urban outlet WHJX -FM, Brunswick, GA. Jacor picks up the station for $4.5

million from George Reed, the receiver for Eagle Broadcasting. Jacor owns country

WQIK -FM and talk WJGR in that market.

Trumper Communications paid $1.85 million to double up in Salt Lake City with the

purchase of adult alternative KUMT, Centreville, UT from Ragan Henry's U.S. Radio.

Trumper just bought sports KISN and hot AC KISN -FM last month.

Inside Radio reports that the aforementioned WJZF got hit with a page 5B notice

for a top -of- the -hour bumper that asks listeners to make a mental note of their

"time spent listening to 104.1 FM."

Radio Business Report is reporting that the dreaded ad tax has been shelved. The tax would have dropped the deductibility of advertising expense down to 90% from the current 100% allowance. House Ways & Means Committee Chairman Bill Archer (R -TX) took it out of the bill.

We raised a few hairs after our editorial comment last week regarding the NAB's stance on Digital Radio Services. The NAB believes digital radio services should be limited to subscriber -based only, or at the very least, be introduced at the same time as land -based digital radio. There are two sides to every issue, so we thought we'd pass along the comments of Frank Newell, owner of KJMO /KWOS, Jefferson City, MO, who faxed us a note saying, "Mr. Fritts should be commended for attempting to represent his constituents in their struggle for a "level playing field" with this emerging new technology." Newell argues that DBS will allow one licensee to serve the entire country without any local service obligations while current broadcasting companies have been limited with the number of markets they can serve. Newell asks, "If the FCC allows DBS to emerge while handicapping current licensees technical capabilities to deliver CD quality, who do you think will prevail ?"

M Street Correction: In a story last week regarding the approval of the sale of Carlson Communications' KKDS and KRSP -FM, Salt Lake City to Simmons Family's KDYL and KSFI subject to fines and reporting conditions, we inadvertently attributed an $8,000 fine to both KDYL /KSFI and KRSP /KKDS. The fine and reporting conditions should have applied only to KDYL /KSFI. KRSP /KKDS was only admonished.

CANADA THIS WEEK

The CHUM Satellite Network debuted with a full -time Canadian talk service this past Monday (May 8). Vice President -Special Projects Bob Laine expects the concept to enable AM stations not only to survive but to compete effectively, even in markets with heritage talkers. The web feeds nearly 20 hours on weekdays and 24 hours on weekends with respected Canadian and Stateside hosts.

The lineup includes anchor Lowell Green from Ottawa, Debbie Nigro (the "Working Mom on the Run), Master Gardener Jerry Baker, and Dr. Laura Schlessinger. Listen for Dr. Joy Brown in the near future. Overnights are covered by One On One sports, and Sports Collectors Radio airs on Sunday evenings. National (Canadian) news, comedy, drama, agriculture, home -improvement, and kids' programs are also featured.

The first full -time affils are CJCH in Halifax and CIFX, Winnipeg. CRFA Ottawa carries about 75% of the network's schedule and originates nearly 30 hours per week. Powerhouse CKLW, Windsor (Detroit) is also broadcasting some of the web's offerings. Dr. Laura Schlessinger is heard on 21 stations, including the top nine Canadian markets, and the "Renovations" home show is carried by 16. You can reach Laine at 416 925 -6666 for additional info.

A "MOVE IN" FOR HOUSTON ?... Houston has a new station this week as Chameleon Radio Corporation moves KIOX 1270's tower and studios from Bay City, TX to Houston. The same principal players in Chameleon had been in an LMA with Salem Communications' KENR. The brokered programming that had been found on KENR moves over to KIOX, or as they are new calling it, K -FCC. How this move was accomplished is a mystery as we could not find an application or CP to move the tower closer to Houston or to change the city of license. Bay City is 50 miles S.W. of Houston and KIOX can not now cover its city of license. KIOX promised to get back to us with the details but as of press time we have not received their call

SONNY'S ULTIMATE REMOTE. "Exile on Your Radio Dial" was the headline in the New York Post this past Tuesday as embattled talk show host H.I. "Sonny" Bloch decided the U.S. just wasn't for him anymore and fled th,. country to the Dominican Republic. Bloch has been under scrutiny from federal investigators for investment schemes advertised and allegedly endorsed on his show. He's also the target of class action suit from listeners. Bloch's daily show over his Independent Broadcasters Network has been airing from the Caribbean nation since last week. His New York affiliate, WOR, has dropped the show. On April 19, Sonny filed applications with the Commission to transfer control of his Florida stations, WGGG, Gainesville and WBDN, Brandon (Tampa), to Paul H. Bloch. Bloch's California station, KLXR, Redding, is reported to be off the air.

WASHINGTON THIS WEEK

Debate in the House subcommittee over the new telecom bill is finally over - -and

it's blatantly absent of any radio deregulation. There's still a chance for radio

as the bill now goes to the House Committee, which will begin debate next week.

Margaret Escriva, President and GM of KWIC, Topeka, KS, has been named as this

year's recipient of the NAB /BROADCAP Minority Fellowship Award. The award promotes further advancement and training for minority broadcasters. Escriva receives free tuition, room, and board at the NAB Executive Management Development Seminar for Radio Broadcasters in June at the University of Notre Dame.

The NAB is producing an alcohol -abuse reduction program this summer called

"STAR " -- Stations Target Alcohol Abuse Reduction. Inside Radio reports the

campaign was produced with the support of Senator Strom Thurmond in hopes of

heading off government bans of beer and wine advertising.

ELSEWHERE

The deal of the week is the merger of the GulfStar and Sonance Broadcasting groups, forming one of the largest groups in Texas. Brothers Steve and Bill Hicks will combine the two companies to operate as GulfStar. Inside Radio reports

Sonance owner Bill Hicks is buying out his brother's interest in GulfStar. The

deal will give the new company stations in Waco, Midland -Odessa, Lubbock, Killeen - Temple, Bryan -College Station, Victoria, Texarkana, Beaumont, Tyler, and Lufkin -

Nacogdoches, as well as a recently purchased duopoly situation in Baton Rouge.

The $711 million sale of Park Communications closed this week, according to Inside Radio, giving financiers Don Tomlin and Gary Knapp a big taste of the media business. Park's group of 22 radio stations, nine television stations, and 107

newspapers will stay intact except for the Richmond, Chattanooga, and Greenville markets. It has temporary waivers to sell off its radio stations in those markets because of TV ownership.

According to the St. Paul Pioneer Press, the cuts came on the same day the Minnesota State Legislature approved a bill that would require the total compensation of MPR executives to be disclosed publicly. MPR President Bill Kling blamed the layoffs on federal spending cuts and higher costs of doing business at the station'. for - profit catalog sales division, Greenspring Co. Kling's salary at MPR is $67,000, but his salary as President at Greenspring, which isn't currently required to be disclosed, has been estimated to be between $200,000 and $500,000. MPR operates 28 stations and also operates PRI, Public Radio International.

ABS TO JAM IN GREENVILLE. . . Richmond -based ABS Communications buys into a duopoly in the Greenville- Spartanburg market with the purchase of AmCom General's urban WJMZ -FM, Anderson, SC for $5.3 million. ABS already owns rock outlet WROQ, Anderson. WJMZ -FM was to be sold to its present LMA partner, HMW Communications' new rock combo WXWX, Easley, SC, and WXWZ, Greer, SC, but that deal fell through.

WASHINGTON THIS WEEK As a follow up to last week's story, the Commission has ordered Chameleon Radio

Corp.'s KIOX, Bay City, TX, (which has applied for the call letters "KFCC ") to

return to its original transmitter site after Chameleon moved its studios and

transmitter approximately 50 miles to the northeast to a location just outside of

Houston, eliminating FCC -mandated coverage of its city of license. According to

the station, the reason for making the move so quickly was the need to keep their

programming on the air after an LMA with Salem Communications fell apart. After

the resulting loss of its transmitter site in Bay City, KIOX proposed moving to

the new site under Special Temporary Authority (STA) until the engineering could

be done to make the new site permanent. The Commission granted the STA, but due

to complications with the geographic coordinates of the tower on the application,

the station's STA power change dropped Bay City out of the station's primary

coverage. The Commission has rescinded the STA, and instructed KIOX to

immediately return to its old location or shut down until a new site that allows

the station to cover its city of license can be found. At this time, the station

remains on the air and continues to try to work out a deal with the Commission.

FCC Chairman Reed Hundt "pulled the plug" on the Commission's 22- year -old

Honeywell mainframe computer this week as the Commission switched entirely to a

PC -based system. Although the new system brings the FCC into the 90's, much is to

be done to solve the glitches in keeping track of all that paper.

The Commission handed out the Catherine Forster Public Service Award to ten of its

finest. Three were awarded in the Mass Media Bureau. The award recognizes

Commission employees who provide "excellent service to the public in the most

efficient, uncomplicated, timely and courteous manner possible." The three were

James Crutchfield, Supervisory Program Analyst in the Audio Services Division;

Arbitron has released its 1995 Edition of Radio County Coverage. The annual study

provides Persons 12+ audience estimates for every county in the continental U.S.

plus Metro counties in Alaska and Hawaii. The company noted significant

improvement (i.e., reduction) in the number of counties clustering with adjacent

counties to meet minimum diary requirements. The 1994 edition had 102 clusters of

multiple counties, while the recent edition contains but 26. Arbitron Radio GM

Pierre Bouvard noted that for many stations in counties outside the standard

Arbitron radio markets, the County Coverage is the only source of listening

estimates. The reports provide data for all counties by state. The dayparts

available are 1) Monday- Sunday, 6AM- Midnight and 2) Monday- Friday, 6AM -7PM. The

listening estimates include cume persons 12+ and cume ratings, average quarter -

hour shares and ratings, as well as county and Metro breakdowns. Thom Mocarsky is

available for additional information at (212) 887 -1314.

Washington, DC's WETA -FM is launching its own classical music format on the bird.

The programming will be separate from WETA's regular programming and will be

available during non -drive weekday hours, as well as weekends. According to the

Washington Post, the programming does not require local studio staffing, so it can

be used as for vacation relief or last- minute emergencies. The Corporation for

Public Broadcasting is expected to help the venture with a $400,000 grant.

Denver -based Jones Satellite Networks has purchased the 24 -hour music formats of

Chicago -based Major Networks for an undisclosed sum. The sale will allow Major to

focus on its news and talk products while beefing up Jones' affiliate list. No

word on the fate of the three formats, "Super Hit Country," "Adult nit Radio," and

"Lite Hits," as Jones has 24 -hour programming competing with each of the acquired formats.

The Atlanta market gets a new player soon as Design Media's WQUL, Griffin, GA,

changes its city of license to Fayetteville, GA on a new frequency of 97.5 MHz.

Its new facilities of 6000 watts at 666 feet snake it heard in most of the Atlanta market (see map). Alfred Liggins, who is an exec. at Cathy Hughes' Radio One group, is buying the station for an undisclosed sum and will probably go with an

urban format, taking on Granum Communications' urban WVEE.

Despite reports of some post- strike Major League Baseball attendance erosion, a

new study compiled by the Research Division of the Interep Radio Store

demonstrates that radio coverage delivers a broader, more affluent audience than

the tube. "Hit A Home Run With Baseball On Radio" found that "...radio indexes

higher in all major upscale audience categories than baseball on television..."

and more effectively targets college graduates, professional /managerial types, and

$75,000+ income households. Jane Sperrazza, VP /Corporate Communications, would be

happy to go over this lineup with you. She's at 212 916 -0524.

The NAB's Broadcasters' Employment Clearinghouse Jobline will be available 24

hours a day beginning June 1. In the past, the service had been operating only

after business hours. The Clearinghouse collects resumes for referral to stations

for jobs ranging from entry -level to managerial positions. The new job line phone

number is (202) 429 -5359. For more info, call Mike McKinley at (202) 429 -5497 or

WASHINGTON THIS WEEK

The Commission has reaffirmed the dismissal of Red Rock Broadcasting's application

for a new FM station at St. George, UT. Following the dismissal of its

application by the FCC, Red Rock appealed to the U.S. Court of Appeals. While the

appeal was pending, the FCC requested that the proceeding by remanded to the

Commission for further consideration, in order to address more fully an argument

made by Red Rock regarding the standard applied by the Commission for waivers of

FM spacing rules and the FCC's basis for denying the request.

The Commission reiterated that the test of service for purposes of obtaining a de

minimus waiver is whether the proposal will serve the public interest by providing

service to listeners who currently lack service. The Commission found that a

grant of Red Rock's application would not provide such service and therefore Red

Rock's showing was properly found inadequate on that count.

FCC Chairman Reed Hundt will address the NAB Radio show at the "FCC Chairman's

Breakfast" at 7:30 am on Friday, September 8 in the New Orleans Convention Center.

Other FCC officials scheduled to appear include Commissioners Jim Quello and Susan

Ness, Mass Media Bureau Chief Roy Stewart, Compliance and Information Bureau Chief

Beverly Baker, MMB Enforcement Division Chief Charles Kelley, FCC General Counsel

William Kenard, Chief Economist Michael Katz, and Audio Services Division Chief

Larry Eads. For more info about the show's sessions, call the NAB at

The story of Harry Irwin "Sonny" Bloch darkened this week as the denouement of a

federal investigation leveled 35 counts of fraud and conspiracy against the

beleaguered talk show host. The SEC is alleging Bloch bilked $21 million from

listeners who invested in shaky wireless cable systems and accuses Bloch of mail

and wire fraud, conspiracy, making false statements to a bank, and interstate

transportation of investor money obtained by fraud. Four others related to the

case have been arrested, as well.

In a separate action, Bloch has been named in a criminal complaint alleging he

fraudulently sold securities in his radio stations during his broadcasts. The

suit claims of the $3.8 million raised for shares in Broadcast Radio Group, Inc.,

which controls the licenses for WBDN (AM), Brandon, FL; WGGG (AM), Gainesville,

FL; and WCNX (AM), Middletown, CT, over $1 million was diverted to personal

accounts. His wife Hilda, Bloch's Independent Broadcasters Network, a Florida

corporation owned by Bloch's wife, and Broadcast Radio Group have also been named

in the suit. Bloch filed applications with the Commission recently to transfer

control of Broadcast Radio Group to his son, Paul. The suit further claims the

shares were not registered with the SEC and the materials used to entice listeners

to invest were false and misleading. If found guilty of any of the charges, Bloch

may face hearings as to his qualifications to remain a Commission licensee.

Bloch fled the country to the Dominican Republic last month and attempted to do

his daily show from an apartment in Santiago. According to Radio Business Report, Bloch's Independent Broadcasters Network has replaced his two hour daily show with "Financial Forum with John Shipman." "Today's Business Journal,' a one -hour

weekday show Bloch hosted, continues with Bob Hensler as host. Because of the

indictments, Bloch's assets have been frozen, forcing employees of his stations and network to wonder if they will ever see a paycheck. According to Inside Radio, U.S. authorities, with the help of Interpol, have extradited Bloch to

Puerto Rico, where he awaits transport back to the mainland.

The NAB has announced that more than 100 radio stations and radio personalities have been selected as finalists from a record number of entries in this year's Marconi Radio Awards competition. The awards will be presented at a September 9

dinner which wraps up the four day NAB Radio Show at the New Orleans Convention Center.

Marconi nominees were selected in 22 categories by a special task force of

Marwick in Washington, DC will tabulate the results.

Space doesn't permit covering the 22 categories, but the nominees for "Legendary Station of the Year" are KGO, San Francisco; KSL, Salt Lake City; WBZ, Boston; WOR, New York; and WSB, Atlanta.

Speaking of awards, forty finalists were announced for the 1995 $200,000 Radio - Mercury Awards, which will be presented at the Waldorf in New York on June 14.

In an "everybody wins" situation, the Sports Byline USA talk show is selling its

logo tee shirts, hats, and sports radios as well as tee shirts, sweatshirts, and

team jerseys commemorating ten teams which participated in the old baseball Negro

League. This is the 75th anniversary of the league.

A portion of the proceeds will be donated to the Negro Leagues Baseball Museum in

Kansas City, MO. There has been a recent reawakening of interest in the Negro

Leagues through an extensive series (no pun intended) produced by Ken Burns on

baseball on Public TV. Josh Gibson, Buck O'Neil, and Satchel Paige were among the

more prominent of the Negro League's players who moved into the Majors in the 40s

and 50s.

Women's sports are also enjoying long- deserved recognition. The Miller Lite

Women's Sports Journalism Award for radio was recently presented to Cecil Taylor,

co -host of the weekly "Women's Sports Hour" on Prime Sports Radio. The program,

which is heard on Saturday mornings via 27 affiliates, had originated as a local

talk show on KSKY -660 in Dallas. Taylor's winning entry was a February interview

with Pepper Davis, the baseball player portrayed by Geena Davis in "A League of

Their Own." Taylor was a finalist for the 1989 award as well.

"Native America Calling," will debut June 5 as the first national call -in radio

Public Broadcasting Consortium, and Airos. The programs are hosted by prominent

Native Americans who have developed a following in their individual locales.

Public stations are encouraged to call Pam Belgarde at 505 277 -7999 for additional
