AThe last 12 months were unsettled as the government discussed various tax changes. Several tax changes

are now in place and we can speak to both buyers and sellers with confidence as their prospects look to brighten, along with the sunnier turn in season.

The November announcement of a three percentage point increase in stamp duty for buy-to-let properties and second homes came into force from the 1st April. This caused both buyers and sellers to feel bruised and certainly caused the market to slow down as we saw the number of transactions being agreed ease up in pace and frequency. While the measure is unlikely to have the same dampening impact on demand as the December 2014 change, it heightens the sense of uncertainty after a series of tax changes in recent years.

We still see Prime Central London as a number one spot for second home ownership but the market remains fragile and price-sensitive. Buyers have to accept that double-digit annual price growth is unlikely to return in the short-term. Vendors who are focussed on selling must remember that it is as important as ever to be realistic with asking prices to achieve a successful sale. We are finding that when sellers market their homes with an asking price that is 10% too high, it results in a lack of viewings and ultimately offers.

Since the 1st April we have agreed a good number of sales at good price levels and we have had best and final bids on a number of occasions.

marketviewRupert Collingwood CEO of The London Search Company reports...The Bank of England recently

announced that they will require lenders to assess the affordability of landlords to repay buy-to-let mortgages. Not only this, but they will be stress testing landlords’ ability to pay against an increase in interest rates by 5%. This is, of course, all set against the backdrop of responsible lending and the BoE responsibility to ensure the economy remains stable.

Since 2008/9 the BoE have been obsessed with preventing another housing market crash, yet their constant meddling combined with George Osborne’s obsessive tinkering in a market of which he has no understanding, for me represents the single greatest threat to the stability of the housing and mortgage market, let alone the wider economy.

Let us be clear, the BoE and Chancellor do not give two hoots about the mortgage market and housing stability. The Chancellor only cares about re-election and it appears that the BoE, although supposedly independent, are increasingly playing to Osborne’s tune. The stamp duty land tax (SDLT) increase for investors which came into force this month, as well as this recent news on affordability, is aimed at preventing both professional and amateur landlords from purchasing property for investment, so to preserve it for more “worthy” buyers such as first time buyers and “hard working families”. This is all of very noble on the face of it, if only it wasn’t so dangerous.

The deep irony in all of this is that the BoE’s recent nerves regarding the property investment sector have come about due to the increased activity in this sector over recent months. Would it be polite for someone to point out that the recent increase in activity in this sector might just might have something to do with the imminent increase in SDLT by 3%, not to mention the changes in the pensions sector? So we now find ourselves in a most ridiculous situation where the BoE is moving to calm the market that has been sent into a frenzy by the Chancellor of the Exchequer whose apparent aim was to prevent buy-to-let landlords from buying… I am assuming if this carries on that at some point either the BoE or Osborne will end up eating their own head?!

The simple fact of the matter is that rather sadly, there is absolutely zero strategy guiding the government’s housing policy, be it for first time buyers, house building, taxation, or any other sector. They seem to make it up as they go along and damn the consequences. It is no way to make policy and no way to manage what is ultimately the backbone of the UK’s domestic economy. We need stability, but more importantly. we need to maintain a free market. Ultimately, it free markets regulate themselves without the need for constant meddling and interference from quangos and government bodies whose only motivation is achieving re-election.

Buy-to-let investors storm the marketIn February, over eight in ten (85 per cent) estate agents reported an increase in the number of buy-to-let (BTL) investors flooding the market to beat the stamp duty changes on second homes, according to the National Association of Estate Agents (NAEA) February Housing Market report1.

The Chancellor’s announcement around stamp duty for additional homes, made in last year’s Autumn Statement, meant in January and February this year, 72 per cent and 85 per cent of agents respectively, saw an increase in interest from those hoping to purchase second homes.

With added pressure from BTL investors on the market, demand for housing was the highest level for 12 years in February. There were an average 463 house hunters registered per member branch – the highest since August 2004 when 582 were registered per branch. This is following an increase in January when estate agents reported 453 per branch, the highest since July 2015.

The number of properties available per branch increased marginally from 33 in January to 35 in February, as the number of sales agreed per branch in February increased too. There were an average nine sales completed in February, back to the level seen in October 2015 and a rise from

eight sales agreed per branch in January.A quarter (24 per cent) of total sales

made in February were to first time buyers (FTBs), a decrease of five percentage points from January, as mounting pressure from investors increased competition.

Mark Hayward, managing director, National Association of Estate Agents (NAEA), comments: “It is evident from February’s report findings that we’ve seen a real sense of urgency from landlords trying to complete on sales ahead of the stamp duty reforms– which now come into force next week. However, the mounting pressure and increased demand for housing has meant that first time buyers have had to compete with landlords for property and as a result they have lost out.

“We would like to say that come April things will look better for first time buyers. Schemes like the Help to Buy ISA, Help-to-Buy scheme and the new Lifetime ISA all sound great on paper, and there’s no doubt that some young people will definitely benefit from them. The crux of the problem though is that there is still a huge issue with supply and until we build more homes, and crucially the right sort of homes, we cannot fool ourselves into thinking we are doing enough to help people buy their own home.”

Activity in the London residential property market has been inflated over the last few months due to

the desire to escape the additional rate of stamp duty which came into effect at the end of March. Estate agents will highlight this increased activity over the first quarter of this year but due to the March deadline we will see a market that is slower moving forward and will not be witnessing the upwards trajectory it has witnessed in past years. From being a ‘vendor’s market’ we are now seeing buyers having the upper hand and the pressure to secure property in a short time frame has been lifted, allowing purchasers to take their time and consider each property over a much longer timetable. A property that is bought in haste can be a costly mistake, particularly with the large stamp duty implications now in place.

The property market could be defined in two parts. A number of vendors are aware of the correction in the market

and will be prepared to accept offers below the market peak. The other side of the market are the more discretionary vendors who do not need to sell but are prepared to sell at their price rather than the market price. Due to the high volume of estate agents there are still agents anxious to secure property on their books and are reluctant to discuss the proverbial elephant in the room, namely, price. As vendors become more attuned to current market conditions and adjust asking prices, the effect is to drive demand. Asking prices are typically declining by in excess of 10% to attract price-sensitive buyers.

Assessing future price growth is difficult to read in this market with the forthcoming London Mayoral Election and future concerns over the outcome of the EU Referendum, it makes looking in the market predictions murkier in the short term.

Spring has sprung, the birds are singing and the sun is making brief appearances, and the London

property market is bucking up, says Jenny Knight.

Tim Fairweather, director of Sandfords, says: “Valuations have been steadily increasing and we’re looking at a lot more properties for sale which is great news considering stock levels had been previously suffering. The majority of activity has been in the £1 million to £2.5 million bracket, but we will see this extend into the higher price ranges as we see buyers, who have been sitting on their hands awaiting confirmation of the new stamp duty surcharge on second homes, go ahead and make a purchase.

“The recent rise in valuations has created a strong spring market where good stock is available, helping to match increased demand from purchasers.”

Other agents report a post Easter rush of people looking to rent family houses and also more sales enquiries.

Knight Frank reports that prime central London is showing signs of a springtime momentum with lower asking prices and the stamp duty deadline adding a sense of impetus so that transaction volumes rose in March compared to last year.

Tom Bill, Knight Frank’s head of London residential research, says: “The incentive to act before April was one of the reasons Knight Frank sales volumes in March exceeded last year’s figure. This bucked the trend of the first quarter of 2016, where volumes were flat in January and marginally down in February.”

According to the National Association of Estate Agents reported that 85% of agents reported an increase in the number of buy-to-let investors flooding the market to beat the stamp duty changes on second homes.

Good news is filtering through from many sources. Rightmove director Miles Shipside says: “Visits to Rightmove are up by 14% in early March compared to the same period in 2015, so it’s no surprise that those buyers who can borrow more or can find some extra cash are keeping the price merry-go-round spinning.”

Data from the Council of Mortgage Lenders shows that gross mortgage lending reached £17.6 billion in February, the highest figure for that month since the lending downturn began in 2008.

Mohammad Jamei, CML economist, says it is possible that there will be no UK interest rate rise this year, further bolstering buyers’ confidence.

“Lending continues the year on a positive note. The recovery is being underpinned by market fundamentals in the UK, as wages grow and unemployment falls.”

Star quality: famous ‘Notting Hill’ fl at for saleThe owner of the Travel Bookshop made famous in the fi lm Notting Hill is selling her fl at above the iconic world-famous shop.

Sarah Anderson, 67, remembers the fi lm’s scriptwriter Richard Curtis coming to see her and making notes about the bookshop she founded in 1979.

Although she sold the shop in 2011 it re-opened as the Notting Hill Bookshop and continues to trade to this day. It remains the focus of curious attention by tourists and fans of the fi lm who may hope to see its stars Hugh Grant - who played the bumbling bookseller - and Julia Roberts as the fi lm-star browsing the shelves.

Sarah who has lived above the shop for 35 years in a two bedroomed maisonette and is moving across London once said: “The main difference between reality and the fi lm is that I’m a much better bookseller than Hugh Grant.”

Her fl at which has two bathrooms, two reception rooms and a roof terrace is, as you might expect, packed with travel books. But she says that it is time to move on and that she embraces change.

However, she will miss both the fl at and the shop which is genuinely world famous. “Wherever I go people anywhere in the world people ask me about the shop and I can hardly go out of the door without being photographed 17 years on after the fi lm’s release,” she says.

Although the fi lm-makers recreated the shop for the fi lm and used the exterior of another building the Travel Bookshop in Blenheim Crescent, Notting Hill became the focus for people who wanted to see the original location for the fi lm.

Sarah remembers the fi lming taking place in nearby Portobello and a visit to the shop by the fi lm stars Roberts, who played a Hollywood movie star and Grant who played William Thacker the stammering bookseller. “He bought a book – she didn’t!”

Sarah’s fl at is being sold by Marsh & Parsons Notting Hill offi ce. Marsh & Parsons Gareth Kelly said:“Buyers will be buying a piece of British fi lm history but they also get a comfortable slightly bohemian fl at in a very sought after area of Notting Hill.”

ARLA warningThe new stamp duty reforms for buy-to-let (BTL) properties, coming into effect on 1st April will increase rent costs for tenants and trigger a decline in the supply of available properties, reveals the Association of Residential Letting Agents (ARLA) February Private Rental Sector (PRS) report1.

Over half (52 per cent) of letting agents reported an uplift in interest from buyers looking to invest in BTL properties before the stamp duty reforms come into effect – an increase from 47 per cent in January. However, after the deadline, two thirds (63 per cent) predict that supply will fall as landlords are pushed out of the market.

Almost six in ten (57 per cent) ARLA members agree rents will be pushed up once the stamp duty reforms have come in to effect, as increased costs for landlords are passed through to tenants. This is especially high in London, where three quarters of letting agents (73 per cent) expect to see this happening.

David Cox, managing director, Association of Residential Letting Agents (ARLA) said: “The stamp duty changes are now imminent, and as well as hitting small landlord’s, they will also impact institutional investors. Although members are reporting a rush from landlords trying to snap up their buy-to-let investments now, it’s likely that we’ll see the buy-to-let market drop like a stone come April and probably not pick up again until next year. This will most certainly cause rents to increase, with supply dropping, as competition for the limited availability of properties intensifi es.”

Demand rose by almost a fi fth (19%) in February, with an average 37 prospective tenants registered per member branch. This is the highest level seen since February last year, when an average 40 tenants were registered per branch. Alongside growing demand, the supply of rental properties on letting agents’ books increased to 176 in February, a rise from 172 in January.

David Cox continues: “The demand for housing continues to intensify as supply remains an issue across most of the country. We are concerned that the government rhetoric of wanting to help people onto the housing ladder does not tally with their action of continuing to target the rental market with additional costs. Some landlords will simply withdraw from the market whereas others who can take the hit of the extra stamp duty will simply raise rents to cover the extra costs. The dream of home ownership will remain out of reach for many as we move closer towards becoming a nation of forever renters.”

Households perceive prices have been rising for three yearsGráinne Gilmore, head of UK residential research at Knight Frank, said: “The fundamentals for the UK housing market remain steady, especially around mortgage costs which remain at record lows.

“The imbalance between demand and supply of housing is also underpinning house prices. The delivery of new homes remains some 30-40% below the levels needed to start to address the annual shortfall of housing in the UK.

“There have already been several large targeted government policies to try and boost development and ease the path of first-time buyers – and it is notable the future sentiment reading for 25-34 year olds is the highest it has been for 15 months.

“As reflected in the index, the sound fundamentals of the market will combine to support overall prices in the coming year, but as the index also reveals, the market will continue to be ‘multi-speed’ across regions and price bands.”

Tim Moore, senior economist at Markit, said: “The latest survey is a clear signal that UK house prices have stayed on an upward trajectory throughout the first quarter of 2016.

“One of the factors supporting price sentiment seems to be the expectation that interest rates will remain ultra-low for longer, and this belief has become more widespread so far this year.

“Households’ current price sentiment is stronger now than at any time over the past 17 months, but the economic landscape is not lacking in potential headwinds for buyer confidence.

“In particular, UK pay growth is uneven at best and slowing at worst, while at the same time some lenders have started to lower their maximum loan-to-income ratios. Stretched affordability is of course never far from any discussion of

UK house prices – but it could bite harder now for first time buyers, especially in London and surrounding hotspots.”

Cash is kingThe number of cash buyers purchasing property in London is on the rise. Robert Gardner, Nationwide Building Society’s Chief Economist recently stated that 38% of homes were bought without a loan. Investors in London are choosing to put their money into housing despite a slowdown in price growth. Buy-to-let investors and second homeowners are rushing to sink their money into the London property market, and using cash to do so, especially in light of the forthcoming 3% surcharge to SDLT.

Rachel Thompson, a Partner in The Buying Solution (TBS) London team, states that ‘prime central London (PCL) has always been awash with cash but now it buys a greater amount of bargaining power as mortgages become more constrained by regulation which is limiting how much people can borrow against their earnings and given lenders requirements to stress test affordability. However where this used to be the sole domain of the postcodes of PCL, this has spread to OPLC (outer prime central London) where cash buyers in the capital are looking to house their money.’

‘As a result of the lengthy process in organising a mortgage,’ she continues, ‘a lot of transactions are falling through, not because of changes of heart or nervousness of the market but simply because buyers are unable to organise a mortgage in time and vendors are getting frustrated by the delays.’

For best in class properties, the market is still competitive but for a cash buyer there is a much greater chance of negotiating hard as vendors expectations continue to align with market reality, as new taxes continue to be absorbed. According to Rachel there is often scope for ‘up to 20% off asking prices.’

Philip Eastwood, Head of the London team at TBS advises ‘if two buyers were offering on a property and one had a mortgage and the other was a cash buyer, and both offered similar prices, the cash offer would win hands down.

Lending requirements have become more complicated and in many cases more convoluted with the result that it takes a greater length of time, frustrating a vendor anxious to sell. Ultimately a buyer with a mortgage would win the competition if the offer was substantially higher however they do run the risk of being re-valued.’

Jonathan Mount, Partner, would caution sellers to be certain that their would-be purchaser is truly a cash buyer as ‘it has been commonplace in recent times for buyers to exchange contracts as “cash buyers” and then raise finance between exchange and completion in order to make themselves appear as attractive as possible. The introduction of the MMR has meant that it is far from straight forward, even for the most solvent of buyers to arrange a mortgage quickly and we have seen situations in very recent times where buyers have defaulted on completion as a result of the mortgage not being offered in time. This in turn could bring financial penalties for the buyer and could risk the seller’s onward purchase if there is a chain involved. Buyers who are considering going down this route should start the process significantly earlier than they would have thought so that they are not caught out.’

Sam McArdle, Associate and investment specialist at TBS says ‘a cash buyer is more likely to appeal to any vendor over and above the competition. Choosing a buyer is like going to the races, as much as a seller wants to maximise their achieved price they also want to back the best horse, one that will cross the finish line. With a cash buyer there is one less complication to worry about, especially in the current mortgage market.’

A true cash buyer adds real liquidity to the market. The fact that they are not restricted by the heavily regulated mortgage market or by the often long delayed process of raising finance has always made them attractive to vendors.

It seems there is a return to the good old days where cash really is king.

A recent report told of how average fixed rate mortgages continue to fall. For example, two-year and three-year products stand at just over 2.5 per cent and 3 per cent respectively. Higher loan-to-value products benefitted from the biggest reductions. In contrast, tracker rates have headed in the other direction, with the average rate having risen for the third consecutive month. Even with this good news, anyone looking for a new mortgage in coming weeks should shop around. Borrowers can substantially beat those averages, especially if they have significant equity. Two-year fixes are available from a little over 1 per cent, five-year fixes around 2 per cent and those looking for long-term security may qualify for a ten-year fix under 3 per cent – all excellent deals to tempt borrowers. Rates may fall lower still but, as always, if you are working to a budget it makes sense to secure a great rate now. Rates are at historic lows so you won’t get a bad deal and regret it for years to come.

Doom and gloomThe increased stamp duty on second homes may not be all bad news, suggests Duncan Farmer

Since the beginning of April buyers of second homes – or

more – have to pay an extra 3 per cent stamp duty on the entire purchase price which, according to the Association of Residential Letting Agents, will “see supply nose-dive, demand sky-rocket and rent prices go through the roof”.

David Cox, Arla’s managing director, goes on to say: “The introduction of the new stamp duty charges is set to push the private rental sector into a state of despair.”

If these predictions are true, London will suffer far more than most other areas, simply because it has such a big private rental market. But this doomsday scenario seems unlikely.

In the year between August 2013 and August 2014, average property prices in London rose by almost a fifth (19.6 percent) and yet the buy to let market did not suffer at all: landlords kept adding to their stock and although average rents rose, the rate of increase was far less pronounced, at 7.7 percent.

According to Land Registry figures, property prices in London rose by 13.5 per cent in the year to February 2016, meaning that even the additional 3 per cent stamp duty would not take annual growth to 2014 levels. In fact, buyers today would effectively be paying less than they did 18 months ago.

Additionally, the buy-to-let market continues to look very attractive to

investors, because interest rates remain so low. NatWest for example has a two-year fixed-rate buy-to-let loan with an initial interest rate of 1.93 percent. In 2014, the best on the market had a rate of 2.49 percent.

One of Arla’s arguments is that the additional cost would be passed on to tenants, but again that is unlikely. It did not happen in 2014 and the rental market, like the sales market, is driven by demand. If potential tenants simply cannot afford to rent a particular house or flat they won’t and will look elsewhere. Additionally, the English Housing Survey reported that last year the number people in the private rented sector fell by 100,000 – surely that is worse news for potential landlords.

The other side of the coin is that if landlords do stop buying there will be more property available for owner occupiers, particularly first and second-time buyers who are generally squeezed out of the market by investors snapping up one and two-bedroom flats.

The new stamp duty rate is expected to raise about £1 billion for the Treasury, of which £60 million has been earmarked for schemes to help young buyers take their first step on the property ladder. If the rest were used to increase the availability of new homes, both for sale and to let, George Osborne’s decision might one day be seen as having done both buyers and tenants an enormous favour at a relatively small cost to investors.

In a fixMore borrowers are opting for fixed-rate loans than at any other time, according to the National Mortgage Index, whose figures show an increase of 0.7 per cent and that 94.7 of people on fixed rates opted to stay on them when the term ended. The Mortgage Advice Bureau puts this down to comments from Mark Carney, the governor of the Bank of England, who has strongly suggested that low rates are to stay. The bank’s monetary policy committee has kept interest rates at 0.5 percent for more than 80 months and analysts now believe a rise is unlikely this year.

Good buyingAccording to Treasury figures house buyers are losing £270 million a year because their sale or purchase falls through, leaving them with wasted costs of survey fees, mortgage application charges and other costs. Now the Government is to look at ways to improve the whole house buying process to make it simpler and more cost effective. The Treasury went on to say: “The Government will shortly publish a call for evidence on how to make the process better value for money and more consumer-friendly.”

Banks and building societies have agreed to cooperate and no doubt the legal profession and surveyors will want their voices heard.

New hoopsAbout a fifth of private landlords got into the game by accident, often inheriting a house that they did not or could not sell so opted to let it instead. For those who also inherited a mortgage, things are about to change under the European Mortgage Directive and they will have to jump through the same hoops as “deliberate” landlords applying for a buy-to-let mortgage and prove that they can afford it. Their income and expenditure will be scrutinised by their lender, although at this stage it is not clear what will happen to borrowers who fail the test. Consulting a broker in this situation might be a good idea.

Historically Kent has been known as the garden of England and to this day grows some of the best apples and cherries. This is generally put down to the brick earth covering the underlying chalk. The cherry orchards are mentioned as far back as the 12th century and although threatened by cheap imports, the orchards are still filled with a profusion of blossom in spring and a number of road-side stalls pop up unexpectedly at the height of the season when the fruit ripens in early summer.

Many of the orchards now form part of the substantial area of Kent designated as an Area of Outstanding Natural Beauty and managed or protected by a number of organisations such as The Woodland Trust, Natural England, The Kent Wildlife Trust or the Forestry Commission.

The fears that the M20, M2 and high speed rail service would change the face of this corner of England has, for the most part, proved to be unfounded and drive a mile off the motorway and the fields, old drovers roads, wooded banks and hedgerows remain as they would have been found a century or more ago.

The county is also rich with beautiful period houses, many of which trace their origins back to the 16th or 17th century and a few even earlier. During the reign of Henry VIII the demand for timber for ship building became so great that there was a shortage of mature trees for housebuilding and with the absence of a plentiful supply stone brick became the most popular building material.

A house like Stodmarsh Court, near Canterbury, is typical of a property that has evolved over the centuries. It probably dates from the 16th century and the wall paintings found in the house in 1914 were removed and are now at the Victoria and Albert Museum. market, as we are seeing now due to the expected rush to buy rental properties before the introduction of increased stamp duty on additional homes, the key thing to do as a prospective landlord is to make your property stand out from the crowd, to maximise your chances of letting it quickly and to good tenants.

Over the last couple of months in Brook Green, we have noticed applicants viewing more properties before they decide upon one to move into; it is not unusual now for prospective tenants to view 10 to 15, when it would previously fall around 5 to 10 properties. It is always the case, regardless of market conditions, that the better- presented and well looked after properties let more quickly and often for a stronger price.

Most of our landlords now are doing far more regular work to their properties, often redecorating after old tenants leave, replacing the carpets and refreshing the paintwork. It is well worth taking the time and

spending the money to do this, as it will considerably increase your chances of finding good tenants quickly, who more often than not will pay a stronger price for a well looked after property.

Our family market has not yet started in earnest, though we expect it to pick up in due course to allow those tenants time to move in before the summer holidays and new school year. The busiest section of the market is currently with the smaller one and two bedroom flats, particularly with single professionals and young couples.

This area offers six fantastic transport links into and out of London, and those living around Brook Green love being able to have a straightforward daily commute whilst being in a lovely residential area, with very well respected schools added to the mix for the families. While of course a I’m a little biased, I really do think that, especially with all the new amenities and restaurants that will accompany the new Television Centre by the end of next year, there are few better places to live in Central London.

Benham & Reeves Residential LettingsDemand for one and two bedroom apartments in Kensington is still on the increase, but we are now also seeing more enquiries for larger apartments in both modern blocks, particularly in W14, and Victorian conversions. Many offers from applicants are at full asking rental. The number of tenancy renewals is up, at around 80%, as tenants opt for security and stability, saving themselves the cost and inconvenience of moving.

Kensington is seeing the relocation market opening up and we are starting to see strong competition to secure the best properties. We are also accommodating the start of the student market, with some applicants looking many months ahead. Two and three bedroom apartments will be much in demand later this year.

Generally, landlords are recognising that they have to compete with new builds and the standard of décor they provide; no longer can properties be let easily if the bathrooms and kitchens have not been modernised.
