WHEREAS, Lorain County Transit is required to submit their Title VI program to the Federal Transit Administration (FTA) every three years; and

WHEREAS, Lorain County Transit’s Title VI program requires that no person shall, on the ground of race, color, or national origin, be excluded from participation in, denied the benefits of, or be subjected to discrimination under any program of activity receiving Federal financial assistance from the FTA.

NOW, THEREFORE BE IT RESOLVED, that the Lorain County Board of Commissioners hereby declares that they have reviewed and approved Lorain County Transit’s Title VI Program for 2019-2022.

In the matter of approving and entering into a )Agricultural Land Lease Agreement with Dechant-)Notley Farms to farm 591.11 tillable acres at the )Regional Airport. ) April 17, 2019

Mr. Cordes said several people picked up the bids but the only farmer that bid that has been doing it for some years now. The northwest parcel has become too wet and is untillable; these parcels are going back into natural state. The growing of the corn is our number one resource for funds on this property.

In the matter of approving and entering into a )Agricultural Land Lease Agreement with Dechant-)Notley Farms to farm 591.11 tillable acres at the )Regional Airport. ) April 17, 2019

WHEREAS, the Lorain County Board of Commissioners publicly advertised seeking proposals to farm the land at the County Airport and only one bid was received and opened on March 20, 2019.

WHEREAS, the bid received from DeChant Notley Farms being deemed the most responsible bid at $201.50 per acres for years 2020, 2021 and 2022.

WHEREAS, the Board hereby accepts the bid and authorizes an agreement between the County and DeChant Notley Farms to cultivate approximately 591.11 tillable acres of agricultural land to grow, corn, soybeans and wheat at the Lorain County Airport starting March 1, 2020 through February 28, 2022. Said agreement is considered a part hereof to this resolution by reference thereto and can be found o file in the Commissioners/Purchasing Office.

NOW, THEREFORE, BE IT RESOLVED, that the Board authorizes the County Administrator to execute all necessary documents on behalf of the Board with Prosecutors’ approval as to form.

Auditor Craig Snodgrass said the 2018 reappraise is complete and a lot was invested in technology, so the computers will be recycled amongst the staff now and then there will be 10-11 pc with windows 7 and 20 monitors donated to the township. He stated the township are excited to receive

In the matter of authorizing the Office of the Lorain County)Auditor to donate computer equipment to townships ) April 17, 2019

WHEREAS, the office of the Lorain County Auditor, has various HP desktop computer and monitors which are more than six years old; and

WHEREAS, said equipment is outdated, obsolete and unfit for any use by the Auditor; and

WHEREAS, the office of the office of the County Auditor has requested permission of the Lorain County Board of Commissioners to donate said equipment to the townships of Lorain County; and

WHEREAS, Section 307.12(D) of the Revised Code authorizes the Board of Commissioners to donate county personal property to any political subdivision of the state, regardless of the property’s value.

NOW, THEREFORE BE IT RESOVLED, by the Lorain County Board of Commissioners that the Board hereby authorizes that the office of the Lorain County Auditor, pursuant to Revised Code section 307.12(D), to donate the computer equipment described above to the Board of Trustees of any of the Lorain County Townships.

In the matter of approving and entering into )a Proposal for Professional Surveying Services )with Rafter A, LTD for one year in an amount )not to exceed $49,500.00 to supplement the ) April 17, 2019engineering staff to assist with surveying )associated with road bridge and ditch Projects )

WHEREAS, Ken Carney, Lorain County Engineer by letter dated April 9, 2019 submitted the following:“The Lorain County Engineer would like to engage the services of Rafter A, LTD to assist with Professional Surveying Services. This

proposal would be used to supplement the engineering staff of the department to assist with surveying associated with road, bridge and ditch projects.

Rafter A, LTD will provide general professional surveying services on a task order basis with fees based upon the number of hours worked in accordance with their hourly rates. The one year proposal amount is $49,500 and funds are available in the Engineer Project Account #2580-0000-300-000-04-6200-6218.

At this time, Lorain County Engineer Ken Carney is requesting authority to sign and execute the contract with Rafter A, LTD. The proposal has been reviewed by the Lorain County Prosecutor’s Office and is approved as to legal form.

Thank you for your consideration and please feel free to contact this office if you should have any additional questions or comments.”;

NOW, THEREFORE, BE IT RESOLVED by the Board of Lorain County Commissioners, that based upon the recommendation of Lorain County Engineer in letter dated April 9, 2019 we do hereby approve and enter into a one year proposal for professional surveying services with Rafter A, LTD, Elyria, Ohio in the amount of $49,500.00 to supplement the engineering staff of the department to assist with surveying associated with road, bridge and ditch projects.

FURTHER BE IT RESOLVED that surveying services will be on a task order basis with fees based upon the number of hours worked in accordance with their hourly rates. Funds for this project are available in the MVGT fund, Engineer’s Project Account #2580-0000-300-000-04-6200-6218.

BE IT FURTHER RESOLVED THAT Ken Carney, Lorain County Engineer is hereby authorized to execute the Proposal on behalf of the Board of Commissioners. The Lorain County Prosecutor’s Office has approved as to form.

NOTICE TO CONTRACTORSSealed proposals will be received until 2:00 P.M. on May 7, 2019 in the Lorain County Board of Commissioners, 4 th floor, Purchasing

Department, 226 Middle Avenue, Elyria, Ohio for the furnishing of all labor, material and equipment for the 2019 Countywide Chip & Seal Program in accordance with plans and specifications prepared by the office of Ken Carney, Lorain County Engineer. All interested parties are welcome to attend the bid opening to be held immediately following the deadline, in the Lorain County Commissioners Public Hearing Room-D.

All materials and equipment must meet the specifications of the Ohio Department of Transportation and work performed shall be under the supervision of Lorain County Engineer. All contractors involved with this project will, to an extent practicable use Ohio products, materials, services and labor in implementation of this project. Additionally, contractor compliance with the equal employment opportunity requirements of Ohio Administrative Code Chapter 123 is required.

Bidders must submit a list of equipment and must comply with the prevailing wage rates on Public Improvements in Lorain County, Ohio as determined by the Ohio Department of Commerce, Bureau of Wage and Hour Administration, (614) 644-2239.

Official bid documents and specifications can be obtained at the office of the Lorain County Engineer, 247 Hadaway Street, Elyria, Ohio between the hours of 8:00 A.M. and 4:00 P.M., Monday through Friday. Only bids prepared on the official documents obtained by the County Engineer will be accepted. A $50.00 non-refundable deposit is required for each set of bidding documents. Bids must be accompanied by a Bid Guaranty and Contract Bond in accordance with Section 153.54 of the Ohio Revised Code. Bid security furnished in Bond form, shall be issued by a Surety Company or Corporation licensed in the State of Ohio to provide said surety.

Each proposal shall contain the full name or names of persons and company submitting the proposal and shall be enclosed in a sealed envelope marked “2019 Countywide Chip & Seal Program”.

The Board of County Commissioners reserves the right to reject any and all proposals and to waive any informalities or irregularities if it is deemed in the best interest of Lorain County to do so. Any interpretation, correction or modification to the specifications desired shall be in writing to James R. Corrections Officer Fide introduced K9 Johnny and thanked the Commissioners for this opportunity. K9 Johnny is a multipurpose dog being used in the jail and also narcotics. Commissioner Sweda asked what is the age K9’s retire. CO Fide said K9 Johnny is 9 years old and has done great but agility is catching up to him. He said he will take on the responsibility of now being his family dog but not quit ready to take on another dog right now, but excited to see what the next chapter is. Captain Jack Hammond said he is the last of the German Sheppard’s we now have Malinois breeds and there is no general fund monies used it is all outside sources and they have 6, 3 assigned to our jail. Not even state prisons have this

WHEREAS, the office of the Lorain County Sheriff, has seven (7) Samsung Galaxy S5 phones which are being replaced and are therefore no longer needed; and

WHEREAS, said phones are outdated, obsolete and unfit for any public use; and

WHEREAS, Section 307.12(B)(1) authorizes the sale of personal property valued at less than $2500.00 at private sale without advertisement of public notification; and

WHEREAS, the office of the Lorain County Sheriff has requested permission of the Lorain County Board of Commissioners to dispose of said phones.

NOW, THEREFORE BE IT RESOVLED, by the Lorain County Board of Commissioners that seven Samsung Galaxy S5 phones of the Sheriff are obsolete and unneeded or unfit for public use and for the use for which the were acquired; and finds that said phones are valued at under $2500.00; and

The Board of Commissioners hereby authorizes that the office of the Lorain County Sheriff, pursuant to Revised Code section 307.12(B)(1), to sell the above described Samsung Galaxy S5 phones at private sale without advertisement or public notification.
