Adult probation started with 1 Chief 5 officers and 2 support staff in 1990. It currently has 42 employees. 19 are officers, 4 are supervisors, 1 Deputy Chief, 5 are support staff, 2 are drug testing monitors 1 is the specialized docket coordinator, 1 is a jail case manager, 1 is the electronic monitor officer,1 is a case manager for programming, 7 are PSI writers. In addition to this 42 we have a vacant Director of Probation Services. That should get filled in February of 2020. In addition, they have hired 3 new officers and have 5 starting in September. We have 2 vacant officers to fill. We will be adding 1 more supervisor and 1 more support staff. They also manage the recovery and veterans court and soon to be mental health court. In 2019 they were notified that Adult Parole Authority may no longer supervise community control cases for Lorain County and in July 2019, that supplemental probation services would no longer be provided. There were 19 counties affected by this and were told that Lorain County was going to get an additional 1200 cases but more like 800 now that will be transferred in January 2020. A department meeting was held because we had to get the officers on board and training is on going for the job and policy changes and APA is helping with the transition. The state is allocated funds for around $75,000 per officer allotted at 12 officers, which is a little short because of benefits. They will also be doing a pilot program from September-November as Teleworking for PSI

B. PRESENTATION

9:40 a.m. Common Pleas/Adult Probation – Sherry Clouser, Court Administrator / Deb Tansey, Deputy Court AdministratorMs. Clouser said Common Pleas for the last 30 years has provided probation services through Adult Probation. Adult probation started

with 1 Chief 5 officers and 2 support staff in 1990. It currently has 42 employees.  19 are officers, 4 are supervisors, 1 Deputy Chief, 5 are support staff, 2 are drug testing monitors 1 is the specialized docket coordinator, 1 is a jail case manager, 1 is the electronic monitor officer,1 is a case manager for programming,  7 are PSI writers.  In addition to this 42 we have a vacant Director of Probation Services.  That should get filled in February of 2020.   In addition, they have hired 3 new officers and have 5 starting in September.  We have 2 vacant officers to fill. Ms. Tansey said yes, but its just like funding PSI and the state has continued so she

does not see where it would not be covered. Commissioner Lundy asked about the telemarketing and working outside of the courthouse, what if something happens; stolen equipment, etc.Ms. Clouser said this is a trail, Judges had same concern, but it is just a portal from their home into their office computer as a web base to do data administrative work and then they will be in the office for their interviews, etc. and it will be 4 of the 7 workers as of now for space constraints. Mr. Cordes said when the courthouse was being renovated the Commissioners took the correct approach and did the extra work on the third floor so provide space, Ms. Tansey said PSI is going into this space.

Commissioner Kokoski said asked Adult Parole was seeing induvial coming from the prison system. Ms. Clouser said yes but all inmates are scored by ORAS on low/moderate and high and moderate/high come to Lorain County Adult Probation; sex offenders and interstate go to Adult Parole. Ms. Tansey said no one is losing their job at Adult Parole its actually adding jobs

Commissioner Lundy asked if they are utilizing the merged boards of addiction and mental health. They said yes and they will continue because there are grants that are being utilized by all parties

Commissioner Lundy said after these 2 years what happens with the funds. Ms. Tansey said she hopes the state continues as they have with the 407 and 408 funding but there has been consolidation. 5 years ago, they had 407 grants but 4 different department and now it has been consolidated to 2 with the same amount of funds.

9:50 a.m. Clinton Avenue Restoration Project – Don Romancak & Matt Arnold, LCCDDMatt Arnold thanked the following for the partnership on this project; Commissioners, Stormwater District, Lorain County Port

Authority, Lorain County Land Bank, KE McCartney-Project Engineer and D&M Earthmoving-Contractor

Commissioner Kokoski asked about driving over a plastic pipe. Mr. Arnold said this is more of a culvert and will lastMr. Cordes said the former gas building was used as backfill so there was a lot of cleaning up. This basin will serve as an overflow with release and there are guardrails on both sides of ditch. Mr. Arnold said it can hold 3.8 acre fee which equates to 1.028 gallons of water and there is still green growth in the bottom and will replace seed once it is not so wet.

Results of unknown conditions Buried debris resulted in a change order for the amount of $45,199.63 for removal and proper disposal at a C&D facility. This brought

the total costs of the project from $272,342.92 to $317,542.55. Extremely wet spring conditions extended construction time for completion and added challenges.

Results Potential reduction in the quantity and frequency of flooding issues to local residents, businesses, and Lorain County Board of Elections. Detention basin can hold approximately 90% of 100-year storm which equates to 1,028,000 gallons of water. Have received calls from local residents stating that it has already helped.

Commissioner Kokoski said she would like to see before and after pictures of this project side by side as well as the Lake Avenue project because no one will see that. It is amazing what the Stormwater District is doing. Mr. Cordes said Clinton Avenue will be a maintenance challenge because it is so visible. Commissioners have purchased all the parcels west of the Board of Elections for their expansion. Parcels are also being obtained down stream but we will wait when they become available at a decent price because people think that there is gold there, no it’s a wetland non-buildable property. Commissioner Kokoski said lots of water is running into the 36th Street. Mr. Cordes said the more the Stormwater District cleans up these ditches, more water will be going north. Mr. Romancak said there were 40 landowners that the county acquired under delinquent with the landbank and some were volunteer. For instance, there was a parcel that had not paid taxes in over 30 years and the cost was only $300. These parcels are not a lot of money and will wait for the opportunity in order to enhance these projects at a reasonable cost. Mr. Romancak said he has been receiving a lot of positive feedback and they see this improvement working and thanked the commissioners for their continued support.

Patty Echko, Sheffield Township Fiscal Officer thanked the Commissioners. She remembers Commissioner Lundy bringing Jerry Good to a meeting at the hall and there was flooding that day and they said we are going to get something done here. Well we are all still here and something did get done, she is very appreciated as well as others. She would like to see Phase 3 done and also Packard Ditch. Mr. Cordes said the Township would have to apply for a grant through the District and will look at the projects. There are other projects being worked on now, and the district has to spread the funds around the county. Ms. Echko said she understands but believes that the Packard Ditch which is private would alleviate some problems in the Township and City of Lorain, this is behind the old builder square on SR57 and was original railroad ROW

In the matter of adopting a Federal Funds )Procurement Policy to meet federal grant )                  August 21, 2019Requirements                                     )   BE IT RESOLVED, by the Lorain County Board of Commissioners that we hereby adopt the following Federal Funds Procurement Policy to meet federal grant requirements

POLICY SUBJECT: FEDERAL FUNDS – PROCUREMENT

PURPOSE: To assure proper and efficient administration of Federal funds in accordance with the Uniform Guidance over Federal programs.

POLICY: Procurement of all supplies, materials, equipment, and services paid for from Federal funds or Lorain County matching funds shall be made in accordance with all applicable Federal, state, and local statutes and/or regulations, the terms and conditions of any Federal grant policies and administrative procedures, Resolutions 17-97 and 17-105 and the following standards and principles.

Lorain County shall maintain a procurement and contract administration system in accordance with the requirements of 2 CFR 200.317-.326 for the administration and management of Federal funds and Federally-funded programs. The County shall maintain a contract administration system that requires contractors to perform in accordance with the terms, conditions, and specifications of their contracts or purchase orders. Except as otherwise noted, procurement transactions shall conform to the provisions of the County’s documented general purchasing policy Resolution #17-105.

All Lorain County employees, officers, and agents who have purchasing authority shall abide by the standards of conduct covering conflicts of interest and governing the actions of its employees, officers, and agents engaged in the selection, award, and administration of contracts as established in Board of Commissioner’s Policy Manual - Conflict of Interest.

The County will avoid acquisition of unnecessary or duplicative items. When appropriate, the County will consider opportunities to use Federal excess and surplus property in lieu of purchasing new equipment and property. Additionally, consideration shall be given to consolidating or breaking out procurements to obtain a more economical purchase. Where appropriate, an analysis shall be made of lease versus purchase alternatives, and any other appropriate analysis to determine the most economical approach. These considerations are part of the process to determine the allowability of each purchase made with Federal funds.

To foster greater economy and efficiency, Lorain County may enter into state and local intergovernmental agreements where appropriate for procurement or use of common or shared goods and services.

When determined to be in the County’s best interest fiscally and procedurally, the County may opt to utilize Design-Build contracts.

CompetitionWhen possible, Lorain County shall seek a minimum of three (3) price quotations for any proposed procurement that will be paid for with Federal funds, even if the bidding amount falls below the applicable Federal or state competitive bidding thresholds. Exceptions include, but are not limited to sole source providers, emergency purchases, professional services (e.g. architect, engineer, etc.), and proprietary services.

All procurement transactions shall be conducted in a manner that encourages full and open competition and that is in accordance with good administrative practice and sound business judgement. In order to promote objective contractor performance and eliminate unfair competitive advantage, Lorain County

shall exclude any contractor that has developed or drafted specifications, requirements, statements of work, or invitations for bids or requests for proposals from competition for such procurements.

Some of the situations considered to be restrictive of competition include, but are not limited to, the following:

A. unreasonable requirements on firms in order for them to qualify to do business

B. unnecessary experience and excessive bonding requirements

C. noncompetitive contracts to consultants that are on retainer contracts

D. organizational conflicts of interest

E. specification of only a "brand name" product instead of allowing for an "or equal” product to be offered and describing the performance or

F. any arbitrary action in the procurement process

Lorain County will not consider geographical preferences in the evaluation of bids or proposals, except in those cases where applicable Federal statutes expressly mandate or encourage geographic preference. Licensure and certification requirements, however, are valid. When contracting for architectural and engineering services, geographic location may be a selection criterion provided its application leaves an appropriate number of qualified firms, given the nature and size of the project, to compete for the contract.

To the extent that the County uses a pre-qualified list of persons, firms or products to acquire goods and services, the pre-qualified list includes enough qualified sources as to ensure maximum open and free competition. The county allows vendors to apply for consideration to be placed on the list continuously.

Solicitation LanguageThe County shall require that all solicitations incorporate a clear and accurate description of the technical requirements for the material, product, or service to be procured. Such description shall not, in competitive procurements, contain features which unduly restrict competition. The description may include a statement of the qualitative nature of the material, product or service to be procured and, when necessary, shall set forth those minimum essential characteristics and standards to which it shall conform if it is to satisfy its intended use. Specific manufacturer detailed product specifications should be avoided if at all possible.

When it is impractical or uneconomical to make a clear and accurate description of the technical requirements, a "brand name or equivalent" description may be used as a means to define the performance or other salient requirements of procurement. The specific features of the named brand which shall be met by offers shall be clearly stated; and identify all requirements which the offerors shall fulfill and all other factors to be used in evaluating bids or proposals.

The Board will not approve any expenditure for an unauthorized purchase or contract.

Procurement StandardsLorain County will make procurement awards only to responsible contractors possessing the ability to perform successfully under the terms and conditions of a proposed procurement according to Resolution #17-97. Consideration will be given to such matters as contractor integrity, compliance with public policy, record of past performance, and financial and technical resources.

The Board of Commissioners alone will be responsible, in accordance with good administrative practice and sound business judgment, for the settlement of all contractual and administrative issues arising out of its procurements. These issues include but are not limited to source evaluation, protests, disputes, and claims.

Contract/Price AnalysisLorain County shall perform a cost or price analysis in connection with every procurement action in excess of $50,000, including contract modifications. A cost analysis generally means evaluating the separate cost elements that make up the total price, while a price analysis means evaluating the total price, without looking at the individual cost elements.

The method and degree of analysis is dependent on the facts surrounding the particular procurement situation; however, the County shall come to an independent estimate prior to receiving bids or proposals.

Time and Materials ContractsLorain County may use a time and materials type contract only (1) after a determination that no other contract is suitable; and (2) if the contract includes a ceiling price that the contractor exceeds at its own risk. Time and materials type contract means a contract whose cost to the County is the sum of the actual costs of materials, and direct labor hours charged at fixed hourly rates that reflect wages, general and administrative expenses, and profit. Since this formula generates an open-ended contract price, a time-and-materials contract provides no positive profit incentive to the contractor for cost control or labor efficiency. Therefore, the County sets a ceiling price for each contract that the contractor exceeds at its own risk. Further, Lorain County shall assert a high degree of oversight in order to obtain reasonable assurance that the contractor is using efficient methods and effective cost controls.

Suspension and DebarmentLorain County will award contracts only to responsible contractors possessing the ability to perform successfully under the terms and conditions of the proposed procurement. All purchasing decisions shall be made in the best interests of the County and shall seek to obtain the maximum value for each dollar expended. When making a purchasing decision, the County shall consider such factors as (1) contractor integrity; (2) compliance with public policy; (3) record of past performance; and (4) financial and technical resources.

The Board of Commissioners shall have the authority to suspend or debar a person/corporation, for cause, from consideration or award of further contracts. The County is subject to and shall abide by the non-procurement debarment and suspension regulations implementing Executive Orders 12549 and 12689, 2 CFR Part 180.

Suspension is an action taken by Lorain County that immediately prohibits a person from participating in covered transactions and transactions covered under the Federal Acquisition Regulation (48 CFR chapter 1) for a temporary period, pending completion of an agency investigation and any judicial or administrative proceedings that may ensue. A person so excluded is suspended. (2 CFR Part 180 Subpart G)

Debarment is an action taken by the Board of Commissioners to exclude a person from participating in covered transactions and transactions covered under the Federal Acquisition Regulation (48 CFR chapter 1). A person so excluded is debarred. (2 CFR Part 180 Subpart H)

The County shall not subcontract with or award subgrants to any person or company who is debarred or suspended. For contracts over $25,000, the County shall confirm that the vendor is not debarred or suspended by either checking the Federal government’s System for Award Management, which maintains a list of such debarred or suspended vendors at www.sam.gov; collecting a certification from the vendor; or adding a clause or condition to the covered transaction with that vendor. (2 CFR Part 180 Subpart C)

Maintenance of Procurement RecordsLorain County maintains records sufficient to detail the history of all procurements. These records will include, but are not necessarily limited to the following: rationale for the method of procurement, selection of contract type, contractor selection or rejection, and the basis for the contract price (including a cost or price analysis).

WHEREAS, Ken Carney, Lorain County Engineer by letter dated August 14, 2019 submitted the following: “In August of 2019, K.E. McCartney & Associates was selected by the Lorain County Engineers’ Office, Sanitary Department, to

provide General Engineering Services as part of a 24-month task order. The selection was based on Letters of Interest received from five firms that responded to the LPA Posting on the Ohio Department of Transportation Website.

K.E. McCartney & Associates will provide general engineering consulting services on a task order basis with fees based upon the number of hours worked in accordance with their hourly rates. The two year contract amount is $250,000 and funds are available through the sanitary department.

At this time, Lorain County Sanitary Engineer Ken Carney is requesting authority to sign and execute the contract with K.E. McCartney & Associates. The contract has been reviewed by the Lorain County Prosecutor’s Office and is approved as to legal form.

JOURNAL ENTRY

Mr. Cordes said the jail upgrades are ongoing but serious discussions will need to happen about a new jail, which would cost around $60-80 million. Security measures are dealt with first, like locks but so much more work needs done. The jail tax was passed several decades ago after numerous attempts but it is an outdated facility and there are many dangerous people in our county jail. He also stated that he is looking at putting crime lab over at the Broad Street location since this facility has been updated with hvac, etc and our lab is evolving with doing more testing. They are now handling the juvenile fingerprints and with adult probation those testing and now evidence needs to be stored in a central location. He will have Elizabeth from Crime Lab come next week to make a presentation on the levy.

WHEREAS, Ohio Department of Rehabilitation and Correction, Bureau of Adult Detention conducted a review of said upgrades.

Commissioner Kokoski attend CCAO meeting in Columbus and President of Jobs Ohio was present and discussed economic development. We all gave a heartfelt concern to Montgomery Commissioner Deb Liebman, staff and City of Dayton with the shooting

Commissioner Kokoski along with Commissioner Sweda the Road to Hope golf outing this past Saturday, event was sold outCommissioner Kokoski said Tuesday was the 1st public hearing on Carpenter Ditch and had good dialogue and the residents are very

respective of what we are trying to do with the flooding in their community for a long time. The Stormwater district meeting was held right after and discussed erosion/sediment controls and stormwater management regulations.

Commissioner Lundy said the Commissioners continued to work with the communities to have a better quality of life and Carpenter Ditch is an important project through the stormwater district. We always try to do the best we can and work with everybody and work on a fair and reasonable approach and Commissioners have the ability to waive the fees involved in the process

Commissioner Lundy commended the Prosecutors office for donating all the backpacks and supplies to the Lorain City Schools and people are overreacting with a label on the items and it’s a shame these are being returned. These funds were from confiscated items.

Commissioner Lundy said the cookout at SouthPark and Elyria Dems was nice.Commissioner Lundy commended Genesis House on their wine fundraiser, nice event.Commissioner Lundy congratulated on all the organizers on the South Lorain back to school event that was held at Mexican Mutual, was

Commissioner Sweda said the Commissioners do receive nice letters regards to our employees and she wanted to share this;“I am sure you are aware but wanted to let you know that you have a gem called “DD”, she is a bus driver. I had to be a jury and parked

at Washington Lot, Elyria and took the bus and it was nice to have her drive the bus. Then one day they were released early and she followed people but she could not keep up and then she saw the empty bus with DD and wanted to thank her for being so kind.”

Commissioner Sweda said last night she ran into an Oberlin resident David Think who said he intendent to write a letter with his deepest gratitude for the completion of the bike path to the county line. He is an avid bike rider and the rocky path was difficult to navigate and does not know what it cost in taxpayers money but he is happy to pay his share

Commissioner Sweda said we had the Keep Lorain County Pride day wrap up; flowers were planted, over 2,000 volunteers, tons of garbage, old tires removed and September 7 is upcoming planning day

Commissioner Sweda said last night attended the confronting faith for Fair Minded Coalition and not to be this to death, but she thinks it is important to recognize it is not about 1st amendment rights, but about selling rather than selling controversy items at the fair. The confederate flag has long been used as a controversy item and most in light of its most recent advocation by white supremacist and hate groups she is personally going to ask the fair board to take a new view of this issue. To determine the increase of controversy surrounding the flag implementation is a show of solidarity for those groups would valid the request to follow the lead of the Ohio State fair and classify that as a controversy item that it has become known and recognize that.

Commissioner Sweda said she received a lot of calls this morning form citizens very concerned that CEO David Hardy, Lorain Schools was going to stop the distribution of Lorain County Prosecutor Will’s office in sending those school supplies to the schools, she thinks the CEO Hardy has come under scrutiny for a lot of spending issues and now will spend school dollars to backpacks that they will not accept because tomorrow is the first day of school. The bags and supplies we stopped and these items you will find on shelves in local stores and parents can determine if the constitutes a risk or not but withholding all these supplies seems to have backfired.
