Whereas, it is the intent of the Board to clarify the Section A on FMLA to include any prior service in accordance with federal laws changes effective April 11, 2018.

BE IT RESOLVED by the Board of Commissioners of Lorain County, Ohio that all previous versions of Section 6.11 of the Board of Commissioners Personnel Policy Manual are hereby repealed, and in their stead the Board of Commissioners hereby adopts the following.

A. An employee who has been employed by the County for at least twelve (12) months and who has completed at least one thousand two hundred and fifty (1,250) hours worked during the twelve (12) month period immediately preceding the commencement of the leave shall be eligible for Family and Medical Leave as provided in this policy. Any prior service with the County will count towards the twelve (12) month requirements, unless the employee had separated from service for a period of more than seven (7) years.

B. An eligible employee may be permitted a total of twelve (12) work weeks of unpaid leave during the twelve (12) month period measured forward from the first date the employee uses Family and Medical Leave. Family and Medical Leave may be used for the following reasons:1. To care for the employee's child after the birth of the child;2. Placement proceedings and to care for a child after the child is placed with the employee for adoption or foster care;3. To care for the employee's spouse, child, or parent who has a serious health condition; or4. Because of a serious health condition that makes the employee unable to perform the functions of the employee's position,

including a workers’ compensation qualifying injury; or

Resolution No. 18-249 cont. April 11, 20185. Because of any qualifying exigency arising out of the fact that the spouse, or a son, or a daughter, or parent of the employee is

on covered active duty (or has been notified of an impending call or order to active duty) in the Armed Forces in support of a contingency operation. Qualifying exigencies are one or more of the following: short-notice deployment, military events and related activities, child care and school activities, financial and legal arrangements, counseling, rest and recuperation and post-deployment activities.

C. An eligible employee may be permitted a total of twenty-six (26) work weeks of unpaid leave during the twelve (12) month period measured forward from the first date the employee uses Family and Medical Leave in order to care for a covered service member with a serious injury or illness if the employee is the spouse, son, daughter, parent or next of kin of the service member. However, when Family and Medical Leave is used for this reason and one or more of the reasons listed in "B" above, the eligible employee will be entitled to a maximum combined total of twenty-six (26) work weeks of leave.

D An eligible employee will be required to provide the Employer with thirty (30) days advance notice of the employee's intention to take Family and Medical Leave. The only exception will be when unforeseen circumstances prevent the employee from providing the required notice.

E The Employer will require the employee to provide medical certification from the employee's health care provider or the family member’s health care provider in order to support a leave request to care for a spouse, child, or parent who has a serious health condition; or for leave due to a serious health condition that makes the employee unable to perform the essential functions of the employee's position.

The Employer, at the Employer's expense, may require a second opinion on the validity of the certification. Should a conflict arise between the opinions of the two (2) health care providers, a third opinion will be sought. The third opinion will be provided by a health care provider mutually agreeable to the employee and the Employer. The expense of a third opinion will be paid by the Employer. U.S. Department of Labor Forms WH-380 shall be utilized by health care providers in supporting the leave request.

F An eligible employee will be required to use paid accrued vacation, sick leave (if appropriate), bonus time and personal leave prior to being granted unpaid Family and Medical Leave. (The paid time will run concurrent with the Family and Medical Leave.) The combined period of leave, including vacation, sick leave, personal leave, and unpaid Family and Medical Leave, shall not exceed the total of twelve (12) or twenty-six (26) work weeks during the twelve (12) month period defined in paragraphs “B” and “C” of this policy.

G In the event of the continuation, reoccurrence, or onset of a serious health condition of the employee, after such employee has exhausted the twelve (12) work weeks of leave as provided in this policy, the employee may request an unpaid disability leave of absence or a voluntary disability separation in accordance with the Employer's policy.

H. The Employer will also require the employee to provide appropriate certification in order to support a leave request because of the qualifying exigency or to care for a covered service member with a serious injury or illness.

I In any case in which a husband and wife, both employed by the County, request leave due to the birth or placement with the employees of a child, the total number of work weeks of Family and Medical Leave to which both employees are entitled will be limited to twelve (12) work weeks during the twelve (12) month period.

J An eligible employee who is the spouse, son, daughter, parent or next of kin of a covered service member (including covered veterans) shall be entitled to a total of twenty-six (26) weeks of leave during a twelve (12) month period to care for a service member who is receiving medical treatment, recuperation, or therapy, or is in outpatient status, or is on the temporary disability retired list for a serious injury or illness.

A serious injury or illness is one that is incurred by a service member in the line of duty on active duty that may cause the service member to be medically unfit to perform the duties of his or her office, grade, rank, or rating. A serious injury or illness also includes injuries or illnesses that existed before the service member’s active duty and that were aggravated by service in the line of duty on active duty.

The leave shall only be available during a single twelve (12) month period. The aggregate total of workweeks of leave to which both a husband and wife working for the county may be limited to is twenty-six (26) workweeks during the single twelve (12) month period when the leave is service member leave or a combination of service member leave and other qualifying FML leave. When leave is taken to care for a covered service member with a serious injury or illness, the Employer may require an employee to obtain a certification completed by an authorized healthcare provider of the covered service member.

K. Leave due to the serious health condition of the employee or the employee's spouse, child, or parent or to care for a covered service member with a serious illness or injury may be taken intermittently or on a reduced leave schedule when medically necessary. The Employer may require an employee who takes leave in this manner for planned medical treatments to transfer temporarily to an alternative position which has equivalent pay and benefits and better accommodates the recurring periods of leave. Leave due to a qualifying exigency may also be taken on an intermittent or reduce leave scheduled basis.

The taking of leave intermittently or on a reduced leave schedule will not result in a reduction in the total amount of leave to which the employee is entitled in accordance with this policy. Leave due to the birth or placement of a child may not be taken on an intermittent or reduced leave schedule.

L. It will not be considered a break in service when an employee takes leave in accordance with this policy, provided the employee returns to work at the expiration of the leave period. During any uncompensated portion of a leave period, employees shall not accumulate sick, vacation, bonus or any other accrued leave.

M. An eligible employee who takes leave in accordance with this policy shall, upon return from such leave, be restored to the position held by the employee when the leave commenced, or a similar position of equivalent pay and benefits. The Employer will require the employee's physician to certify that the employee is able to resume work as a condition of return to employment.

N. During any period that an eligible employee takes leave in accordance with this policy, the Employer shall maintain the employee's group health care coverage under the conditions coverage would have been provided if the employee had continued in employment for the duration of the leave. The employee will be responsible for paying the employee's share of the health insurance costs during the leave. If the employee does not return from the leave, the Employer may recover the premiums it paid for maintaining the health care coverage during the period of unpaid Family and Medical Leave.

O. Upon requesting Family and Medical Leave, an eligible employee will receive a written notice, from the Employer, outlining the employee's rights and obligations

BE IT RESOLVED, by the Lorain County Board of Commissioners that we hereby Advertise bids for Airport upgrade signing and replace apron ramp lighting.

Said notice will be in the Chronicle on April 17 & 24 and open at 2 pm on May 3 as follows:Sealed bids will be received until 2:00 p.m. on Thursday, May 3 rd, 2018 by the Lorain County Board of Commissioners; Purchasing

Department; 226 Middle Avenue, Elyria, Ohio 44035, for the furnishing of all labor, material, and equipment for the LORAIN COUNTY REGIONAL AIRPORT UPGRADE SIGNING AND REPLACE APRON RAMP LIGHTING, using various materials in accordance with specifications prepared by Richland Engineering Limited. All interested parties are welcome to attend the bid opening to be held immediately following the deadline in the Commissioners’ Meeting Room D located on the fourth floor of the Lorain County Administration Building. The estimated cost of all work for this project is $145,000.00.

A mandatory Pre-Bid Meeting will be held at 11:00 A.M. Friday, April 27, 2018 at the site, 44050 Russia Rd, Elyria, Ohio 44035. All contractors involved with this project will to the extent practicable, use Ohio products, materials, services and labor in the implementation of this project. Bidders shall submit a list of equipment available and all labor shall be paid not less than the prevailing wage rate as determined by the U.S. Department of Labor.

Specifications can be obtained at the office of the Lorain County Board of Commissioners; Purchasing Department; Lorain County Administration Building; Fourth Floor; 226 Middle Avenue, Elyria, Ohio, 44035 between the hours of 8:00 a.m. and 4:30 p.m., Monday through Friday. A $27.00 non-refundable deposit is required for each set of bidding documents. Lorain County will not accept and/or consider any bid as an official bid unless said bidder has picked up and paid for a complete bid package from the Lorain County Purchasing Department. In order to bid this project you must be a plan holder of record with the Purchasing Department.

Bids must be accompanied by a bid bond, certified check, cashier’s check, or Letter of Credit equal to ten (10%) of the amount bid or a contract bond for the full amount of the bid, as a guarantee that if the bid is accepted, a contract will be entered into and a contract bond properly secured. Should any bid be rejected, such instrument will be forthwith returned upon proper execution of a contract.

Each bid shall contain the full name or names of persons and company submitting the bid and shall be enclosed in a envelope marked “LORAIN COUNTY REGIONAL AIRPORT UPGRADE SIGNING AND REPLACE ARPON RAMP LIGHTING”.

ALL WORK MUST BE COMPLETED WITHIN 120 DAYS FROM THE NOTICE TO PROCEED. The Board of Commissioners reserves the right to reject any and all bids and to waive any informalities or irregularities if it is deemed in

the best interest of Lorain County to do so. Any interpretation, correction, or modification to the specifications desired shall be submitted in writing to James R. McCartney )& Assoc., Mansfield, Ohio in the amount not to exceed )$49,000 for the Lateral Televising/System Analysis- ) April 11, 2018Phase 1 project in the Cresthaven Homes Subdivision, )Elyria Township. ) WHEREAS, Ken Carney, Lorain County Engineer by letter dated March 30, 2018 submitted the following:

“As part of the sanitary engineer’s continuing efforts to reduce stormwater infiltration into the sanitary sewers, the department is requesting authority to enter into a contract with K.E. McCartney & Associates for lateral televising in the Cresthaven Homes Subdivision located in Elyria Township. Similar work was recently conducted in the Plum Creek and Eaton Subdivisions resulting in the replacement of individual sanitary laterals and a significant reduction in stormwater infiltration.

Due to the size of the Cresthaven Development, Phase 1 will consist of the televising of approximately 100 sanitary laterals on Freeland, Emerald, Galaxy and Woodhill Drives. Additional testing on the remaining streets will take place later this year. K.E. McCartney has agreed to perform this work for a not to exceed amount of $49,000 and the department believes this amount to be fair and reasonable. Funding for this project would be made available through account 7100-7100-300-304-11-6200-6218, Sanitary O&M Professional Services.

At this time, Lorain County Sanitary Engineer Ken Carney is respectfully requesting that the Board enter into a contract with K.E. McCartney & Associates for the Lateral Televising/System Analysis-Phase 1 in the Cresthaven Homes Subdivision for a not to exceed amount of $49,000. Work would proceed as soon as authorized and be complete within six months. Jennifer Kennedy said Restaurant week was March 2-11, 2018. This is the 2nd year with 11 restaurants, offering a 3 course dinner for $30 and overall reception and participation double over last year. The goals was to shine the spotlight on great culinary scene and fine dining restaurants in our county.

The following is how it was advertised;• Display Advertising- We targeted people based on age, gender location, income and behavior. Websites we will appear (but not limited

to cooking.com, foodnetwork.com, cleveland.com, etc.). We also will retarget, meaning if they clicked on our ad, they will get it again and again. 

• Facebook advertising- based on age, gender, location, income and past websites visited (cookies!). • Look alike targeting. We have built a list of approximately 5,000 people that have participated in our food events over the last year. We

are using this list to build a list of "look a likes" people that look like our past participants. We will then target them on Facebook and Instagram

• Instagram advertising- same as Facebook just a different platform• Geofencing- we are going to pick certain fine dining restaurants close to Lorain County. If you open an app or a web browser while in

the restaurant- users were served RW ad when you go online.  • Local radio- spots on WOBL, WDLW and WEOL through March 9. • Cleveland Now, WOIO's prepackaged show https:// www.youtube.com/watch?v=1CyNOoOSqYM&feature=youtu.be • Ran 28 :15 second commercials on WOIO • Fox 8 News http://fox8.com/2018/03/06/its-restaurant-week-in-lorain-county/ • On 2/24 RW ad ran on Ohio Magazine's E-blast. Surveys gauged the success of Restaurant Week, we conducted multiple surveys to the following audiences at participating restaurants and diners who submitted an entry card.

Participants Survey was all that submitted and out of 158 cards, 64 responses for 40.5% response rate

Impact on Business had an average increase in business at 11% and increase in revenue 12% with a range of 0%-40%.
